Council Member White inquired as to why the following projects were not proposed for funding: TAP Transitional Living Center, Shaffer's Crossing improvements, Henry Street improvements, First Street Bridge improvements He inquired if appropriate officials of TAP and Henry Street were contacted in regard to applying for funds; whereupon, it was the consensus of Council that the matter would be referred to the City Manager for report. Council Member Trout requested that the City Attorney advise as to whether Council may endorse those projects to be recommended for funding following the public hearing on January 19. CITY MANAGER: BRIEFINGS: A briefing with regard to the Roanoke River Sanitary Sewer Project, Greenways and related issues. (45 minutes) It was the consensus of Council that the matter of valley-wide participation to address issues of flood control would be included on future meeting agendas for joint sessions of the Roanoke City Council, the Roanoke County Board of Supervisors, the Vinton Town Council and the Salem City Council. The briefing was received and filed. File #237-379 7 ITEMS RECOMMENDED FOR ACTION: A report recommending adoption of a resolution requesting the Virginia Department of Transportation to program a safety improvement project for installation of gates at the railroad crossing on Norfolk Avenue west of Third Street, S. A financial report for the month of November, 1998. Council Member Swain requested an annual projection on revenue to be generated to the City as a result of the five per cent increase in the water and sewer rates which took effect on August 1, 1998. He also requested a list of projects proposed to be completed as a result of the five per cent increase in water and sewer rates. It was the consensus of Council that the City's operating subsidy to the Hotel Roanoke Conference Center would be referred to 1999 - 2000 budget study for discussion. The financial report was received and filed. File #10-27-247-258-468 A report recommending an amendment to the City Code to provide for a late payment penalty of the tax due on the seller relating to the Special Tax on Consumers of Local Telephone Service, commonly known as the "E-911 Tax." Council Member White called attention to the number of major accidents on Interstate 81 and requested that the Mayor advise appropriate State and Federal officials of the City's concern that proposed improvements will be addressed as soon as possible, and that alternative means of increasing vehicular safety will be explored prior to construction of Interstate 81 improvements. Taylor retired from the pastorate at High Street Baptist Church on December 31, 1998, it was the consensus of Council that the City Attorney be requested to prepare the proper measure recognizing his many years of service to High Street Baptist Church and to the Roanoke community. File tt80 Council Member Swain requested information in regard to the penalty for failure to display a current vehicle inspection sticker and failure to display a current City decal. He inquired as to the financial impact of increasing the fines by ten per cent, twenty-five per cent and fifty per cent. The Mayor discussed the matter of enacting a prosecution fee which would be assessed by the Courts and payable to the Commonweath's Attorney and a police investigation fee; and inquired if the Commonwealth of Virginia has adopted enabling legislation authorizing Cities to impose such fees. Bowers, Mayor and Members of City Council Roanoke, Virginia Dear Mayor Bowers and Members of Council: Subject: Briefing - Downtown Traffic Patterns Background Ao The Outlook Roanoke plan which serves as a vision for downtown Roanoke included a recommendation for changing Salem Avenue and Campbell Avenue to two-way traffic. Representatives of the City administration have been meeting over the past several months with a task force appointed by City staff and comprised of individuals (see Attachment A) interested in this proposal to discuss the challenges and opportunities which such a change in traffic patterns could create for the downtown area. City Council's visioning process generated 23 draft strategic issue statements which were reviewed with City Council in an April 6, 1998, staff briefing. One of those strategic issues, which relates to downtown development, states "Continue efforts to further develop downtown and its entrance roadways". C. Traffic pattern options that were initially considered included: 1. Change both Salem Avenue and Campbell Avenue to two-way traffic. 2. Do not change either Salem Avenue or Campbell Avenue. Change the intersection of Williamson Road and Salem Avenue to include a new traffic signal and allow left turns. The City asked its traffic engineering consultant (Wilbur Smith Associates) to evaluate these options. They concluded that these options are technically feasible. The challenges and opportunities associated with these options were thoroughly reviewed by the task force. D The task force believes that changing to two-way streets would support economic investment in downtown by making: access to downtown destinations more direct downtown destinations more visible and easier for people to find Mayor Bowers and Members of Council No. 98-188/Downtown Traffic Patterns Page 2 January 4, 1999 II downtown a more appealing location for businesses by making it less confusing for people to find their way around The task force also indicates that, while slower traffic can be an inconvenience to motorists who are on their way elsewhere, the recent completion of the Second Street/Gainsboro Road project provides an opportunity to divert through traffic from Salem and Campbell Avenues, thereby allowing these downtown streets to serve as primarily local destinations. E Public input opportunities were made available through several methods. The initial public input generated from Outlook Roanoke workshops conducted in July, 1996, resulted in a request to restore as much two-way traffic as possible in downtown Roanoke. Additionally: An open house was held in a Salem Avenue storefront on June 16, 1998. Downtown employees and property owners were invited to drop in to ask questions and offer opinions on traffic flow options. Approximately 50 people attended. Survey forms were made available to document the opinions of interested persons. Newspaper coverage by The Roanoke Times on June 25, 1998, reported on some of the challenges and opportunities for 2-way traffic. 3. A survey was included on the Internet through Roanoke. Com. The August edition of The City Show on RVTV (Channel 3) included a segment on this issue. Citizens were given a telephone number to call to give their input. The City Page section of The Roanoke Times included two articles on this issue and requested input from the public. Current situation: A Citizens that responded to the open house survey were evenly divided on this issue, 21 persons were for the change to two-way and 21 persons were for keeping the existing street pattern. Attachment B provides a sample of those responses. There was relatively little response to the Internet, television and newspaper requests for opinions on this issue. The matter of the new signal with provisions for a left turn at the Williamson Road/Salem Avenue intersection had 75% support from the open house survey. Mayor Bowers and Members of Council No. 98-188/Downtown Traffic Patterns Page 3 January 4, 1999 C D E B One letter signed by 19 downtown business owners and representatives suggested that changing only Salem Avenue to two-way would be a good option. This option was then reviewed by the City's traffic engineering consultant who concluded that this was another feasible option. The three (3) alternative traffic flow options are summarized on the attached map (Attachment C). Task Force approved a recommendation on November 17, 1998, to the City of Roanoke that: 1) 2) 3) the traffic pattern on Salem Avenue be changed to two-way for its entire length the traffic pattern on Campbell Avenue be changed to two-way from 2"d Street west a traffic signal be installed on Williamson Road at the corner of Salem Avenue to permit left turns from Williamson Road to Salem Avenue, and from Salem Avenue to Williamson Road (This intersection is not included on the City's overall list of locations in need of signalization. Its installation becomes necessary as part of the overall CBD Signal System Project). Board of Directors of Downtown Roanoke1 Inc. resolved to support the task force recommendation at the Board's meeting on December 8, 1998. The Central Business District (CBD) traffic signal system coordinates the operation of 44 signalized intersections in the downtown area. Funding in the amount of $1,350,000 was included in the 1996 Bond Referendum for plans and equipment needed to replace the existing system which has been in operation for approximately 20 years. It is projected that the new system will also last for 20 years. Completion of the plans for this replacement project are being delayed until the traffic flow of Salem Avenue and Campbell Avenue is resolved. An engineering services contract with Wilbur Smith Associates was approved in an amount not to exceed $163,148 by City Council on January 21, 1997, for design services for this CBD traffic signal system. A supplemental agreement to this contract would be needed to address additional services related to the two-way traffic plan. The City Manager is "authorized to designate streets upon which traffic is permitted in one (1) direction" (Code of the City of Roanoke (1979), as Amended, Section 20-48. Cost IV Alternatives: A City Council concur in changing from one-way traffic to two-way traffic flow on Salem Avenue (from Williamson Road to 6th Street, S.W.) and Campbell Avenue (from 2"" Street to 5th Street, S.W.). This includes signalization of the Williamson Road/Salem Avenue intersection. Traffic flow is expected to be satisfactory based on the results of the traffic engineering study by Wilbur Smith Associates. Compared to existing conditions, it is projected that there would be a 2 to 4% increase in travel time, a 6 to 8% increase in delay time and average speed reduction of 1 to 3%. By leaving Campbell Avenue alone from Williamson Road to 2n" Street, S.W., the most significant challenges are avoided. On-street parking will need to be eliminated at a few locations while other locations will gain parking. The net effect is that on-street will not be reduced. Public input would appear to support this alternative based upon information received. In general, business and tourism is better served by the fiexibility afforded by the new traffic patterns. The task force does endorse this alternative. Timing is critical. Changes will need to begin being implemented in conjunction with the new CBD signal system replacement project. This includes redesign of nine (9) intersections for which additional traffic signal displays would be needed for two-way traffic. This redesign effort is expected to be completed in 60 days, following which the project could be advertised for construction. A minimum of six (6) months will be needed for construction, which results in a late- Mayor Bowers and Members of Council No. 98-188/Downtown Traffic Patterns Page 5 January 4, 1999 B 1999 completion (Y2K is not a problem for the existing system). Repaving of portions of Salem Avenue and Campbell Avenue and completion of the Williamson Road Viaduct are also planned for 1999. Cost to implement the change is estimated at $150,000. This additional cost can be funded from the bond funds available for the CBD Signal System Project in account 008-052-9701-9191. This funding will be appropriated at a future time. An additional $18,900 is needed for additional engineering services for Wilbur Smith Associates, funding for which is available from the Streets and Sidewalks Category of the 1996 General Obligation Bonds. City Council concur in changing from one-way traffic to two-way traffic flow on Salem Avenue (from Williamson Road to 6th Street, S.W.) and Campbell Avenue (from Williamson Road to 5th Street, S.W.). This includes signalization of the Williamson Road/Salem Avenue intersection. Traffic flow is expected to be unsatisfactory based on the results of the traffic engineering study by Wilbur Smith Associates. While it is projected that there would be a 2 to 4% increase in travel time, a 6 to 9% increase in delay time and an average speed reduction of 2 to 3%, there are situations that could be detrimental to traffic flow on Campbell Avenue between Williamson Road and 2nd Street, S.W. These situations include: Motorists would have less flexibility to bypass obstructions in the roadway. For example, there are many occasions, both scheduled and unexpected, when utility companies or City workers must divert traffic to maintain the electrical, gas, telephone, water and sewer lines under Campbell Avenue. bo Delivery trucks would be obliged to use designated curbside service areas - "double-parking" would not be an option. Motorists would encounter increased delays entering and exiting the Market Square parking garage. Valley Metro buses would encounter increased delays when entering and exiting Campbell Court. Motorists could encounter gridlock on Market Square due to the short distance available on Campbell Avenue to stack left- turn vehicles between Market Street and Wall Street. On-street parking would not change. Public input does not provide a clear consensus. The open house survey results were evenly divided for and against this alternative. Timing would enable the new CBD signal system to proceed toward completion without further redesign, with completion occurring in 1999. 5. Cost is not an issue. Excellent idea. I was reluctant, but the reasoning appears sound. If the experts recommend it, I'm for it. Easier for visitors to see downtown. Good idea -long overdue. All for it. Great idea; should give the avenues a better address and make them more people friendly. No Problem. I'm for it. Okay, I think it is worth a try. It will give more exposure to Salem Avenue businesses. I think it would help with traffic circulation downtown by reducing travel distances. May have some problems around 5 to 6 p.m., but bearable. Would be a terrible mistake! Basically, this is a large gamble that could cause gridlock. Proposal will create 40 left turns across oncoming traffic. Roanoke has continued to grow and prosper with the current pattern, why screw it up with this change? Traffic would be more congested and twice as slow, so very "encouraging" to get people to come downtown. The congestion at rush hour will be a problem. If the slow down becomes too much, we will end up with the opposite effect - people will stop coming downtown. I do not want this to happen. If you want to keep small business in Roanoke, visibility has little to do with it. I have operated in downtown for over 10 years and moved off the market for one reason only - lack of parking. I'm here to update Council on the status of the "HUD Funds Allocation Policy" and answer any questions Council members may have. (A briefing letter on this subject is included in Council's meeting package.) Is any action required by City Council? This is an administrative policy; therefore, no action is required on Council's part. What does this policy do? The "HUD Funds A/location Po/icy" provides a framework for the budgeting process for Community Development Block Grant (CDBG) and HOME Investment Partnerships (HOME) funds received by the City. It comp#es new and existing practices. How did this policy come about? This policy was prepared in response to Council's request fo/lowing the 1997-1998 budgeting process. Some on Council, particularly Mr. Harris, felt that the process would have benefitted from a uniform policy such as used for budgeting other City funds. What stages has development of the HUD policy gone through? There were four stages in the development of this HUD policy. o First, the Office of Grants Compliance prepared a policy and briefed Council in January 1998. 0 Second, the policy was implemented as part of the 1998-1999 budgeting process. Two new practices included in the po/icy were to be phased in. One set a $5,000 minimum for funding requests and awards. The other set a 3- year limit for funding human services and sim#ar programs. These would not be applied to existing programs till after public input had been obtained. (Human services are often where the heaviest competition for funding occurs and were the main area of concern to Council. The competition is heightened by a regulatory funding cap for such programs. The po/icy was not meant to effect programs such as housing or economic development, though we could if desired.) HUD Funds Allocation Policy City Council Briefing January 4, 1999 O Third, in July, 1998, a letter requesting public comments was sent to about 400 individuals and groups. A public meeting was held on August 6th and a follow-up meeting was held October 5th. Several staff meetings were held during this period to consider the issues and the public comments. o Fourth, taking into consideration the public comments, a final consensus was reached among City staff regarding the new practices, leading to this briefing. What changes have been made to the original policy prepared last January? City staff have decided to remove the provision which would allow funding any human service program for no more than three years. In this regard, we concur with comments received from the public that the provision would be counter-productive. That is, the result of a three-year HUD funds limit would be increased pressure on City Council for General Funds. Since such a result would be the exact opposite of what Council intended in asking for a HUD policy, we are not pursuing the original provision. The $5,000 floor level provision is being retained. Where do we go from here? Un/ess Council has any objections, the revised policy will be published as part of the CDBG/I-IOME request-for-proposals to be issued at our public meeting to be held at the Jefferson Center this Thursday evening, January 7, 8 to 8 p.m. You are all invited, of course. Thank you, and I would be happy to try to answer any questions you may have, Office of the City Manager Roanoke, Virginia January 4, 1999 Honorable Mayor and Members of City Council Roanoke, Virginia Dear Mayor and Members of Council: Subject: Briefing Letter On "HUD Funds Allocation Policy" This briefing letter summarizes the status of the "HUD Funds Allocation Policy," including follow-up actions planned by the Office of Grants Compliance (OGC) concerning two provisions of this policy. As you know, in January, 1998, at City Council's request, the OGC developed this policy regarding allocating Community Development Block Grant (CDBG) and HOME Investment Partnerships (HOME) funds received from the U.S. Department of Housing and Urban Development (HUD). The policy compiled existing budgeting practices and added the phase-in of certain new practices. After public review, OGC was to update City Council regarding whether the new practices would be fully implemented. In July, the OGC sent the policy and a request for comments to nearly 400 interested community organizations, individuals, and City staff. A public meeting was held August 6 to provide an opportunity for citizens to offer comments in person. Approximately 30 individuals attended this meeting. The OGC received additional comments in writing and through phone conversations. About 10 individuals attended a follow-up meeting held October 5. Several staff meetings were also held to discuss the results of the public review process. Among the provisions of the policy, two represented significant departures from prior practice. First, a $5,000 "floor level" would be placed on all funding requests. In other words, the City would not consider requests or make any awards of less than $5,000. This provision had been included for cost-benefit reasons; i.e. to avoid the disproportionately high costs associated with administering small programs. The provision was implemented in the 1998/99 Request-for- Proposals (RFP) for all first-time funding applications. Neither then nor during the public review of the policy was there any substantive concern with this provision. The second significant change from prior practice involved placing a limit of 3 years for funding any "human service" or similarly structured program. This provision arose from concerns that human services programs were becoming dependent on CDBG, which the City had originally intended for use as "seed funding" for such activities. Much of the response obtained through the review process focused on this provision. Commenters uniformly took issue with the City's rationale, especially the idea that existing services needed by the community might be de-funded to allow for other programs that might or might not materialize. In addition, commenters predicted that de-funded programs would seek General Funds. Discussions at staff meetings, both during and after public review of the policy, have acknowledged that comments received on the 3-year limit are probably correct. This provision is likely to be counter-productive. Flexibility in the use of CDBG funds would be achieved at the expense of increasing competition for the City's General Funds. Since it was not the intention to merely transfer the pressure from one limited resource to another limited resource, removing the 3-year limit provision from the policy is the appropriate course. The policy will, however, retain the $5,000 floor-level provision. A copy of the revised policy incorporating these changes is attached. Parker, City Clerk HUD Funds (CDBG/HOME) Allocation Policy o Funding categories: The City will continue its current practice of using five funding categories: (1) planning/administration, (2) housing, (3) human services, (4) homeless services and (5) neighborhood and economic development. Preliminary funding levels and buffers: The City will continue its current practice of specifying initial target funding levels for each category. In order to avoid exceeding federally mandated limits ("caps") on planning/administrative and public services expenditures, target funding levels for these categories will be less than maximums allowed by the federal rules. The amount of these "buffers" will, in general, be no greater than 10 % of the maximums allowed by the federal rules. However, the City reserves the right to increase buffers when it judges the risks of exceeding federal limits to be greater. (For example, if the maximum amount of funds which could be provided to human services activities was $100,000, then, typically, at least $90,000 would be awarded for program and no more than $10,000 would be held as a buffer against exceeding the limits.) Funds shifting among categories: The City will continue its current practice of allowing any balance of targeted funds remaining in a category (due to a lack of proposals or the results of the proposal selection process) to be shifted to other categories where funds are insufficient for the proposals selected. Budgeting colmnittees: The City will continue its current budgeting committee structure, which includes the City's Budget Preparation Committee, Entitlement Advisory Team, Housing Coordination Team, City Manager' s Committee on Homelessness, Citizens Services Committee (for human services) and Neighborhood and Economic Development Committee; the Office of Grants Compliance staff will continue to act as the review committee for planning/administrative proposals. Budgeting committees' role: The role of the Entitlement Advisory Team, Housing Coordination Team, City Manager's Committee on Homelessness, Citizens Services Committee (for human services) and Neighborhood and Economic Development Committee shall be advisory to the Office of Grants Compliance in such matters as choosing plan priorities/objectives to emphasize, rating and ranking proposals, and funding recommendations. Further, Request for Proposal (RFP) packages will be prepared by the Office of Grants Compliance and may be revised yearly as appropriate to reflect such needs as targeting funds to specific areas of the City or service gaps, emphasizing unmet Consolidated Plan priorities and objectives, and achieving the goals of the City expressed in City Council Vision Statements and similar guiding principles. City government offices: The City will continue its current practice of requiring its departments and offices to submit "competing proposals" for CDBG and/or HOME funding. Unsolicited proposals from external (i.e. other than City government) agencies: Proposals from entities other than departments or offices of City government will be accepted only during regular proposal solicitation processes. 10. Unsolicited proposals from City government offices: The City will continue its current practice of considering, on a case-by-case basis, unsolicited proposals submitted by its departments and offices for projects addressing needs which are of particular importance and of such a nature that delay till the next regular proposal cycle would not be in the interests of the community. Such proposals will be required to provide standard information through use of a project write-up form developed by the Office of Grants Compliance. Funding "floor levels" (minimum proposals/awards): The City will not consider proposals requesting less than $5,000 in CDBG and/or HOME funding assistance, nor shall the City make any award of CDBG and/or HOME assistance that is less than $5,000. This policy will be phased in over two years starting with the FY 1998/1999 budgeting cycle beginning in January, 1998. During the first year of implementation, no program receiving FY 1997/1998 CDBG and/or HOME assistance of less than $5,000 will be precluded from applying for or being awarded funding under the $5,000 threshold. All propsals for new programs will immediately come under the new $5,000 threshold with the FY 1998/1999 budgeting cycle, i.e. in January, 1998. In the second year of implementation, i.e. for the FY 1999/2000 budgeting cycle beginning in January, 1999, all program proposals will be subject to the $5,000 threshold. For the purposes of this policy, a "new program" is one which, in the City's judgement, differs materially from an existing program (conducted by or on behalf of an entity) in such aspects as goals, design, or beneficiaries. Funding for staff: In conjunction with the above provision limiting the duration of funding, the City will continue its current practice of discouraging the use of CDBG and HOME funds for staffing in human services programs and programs similar to human services. 11. Performance considerations: The City will continue its current practice of considering the performance of an organization and its programs as part of the process for selection and/or continuation. Performance will be defined according to the type of program or project, and may include such considerations as: o timely completion of activities and expenditure of awarded funds; o satisfactory levels of achievement with respect to project goals and objectives; and o timely submission of payment requests, reports or other administrative documents. Organizations and programs demonstrating unsatisfactory performance will not be considered for selection and/or continuation. 12. Flexibility: In order to allow for flexibility while ensuring fairness, exceptions to this policy shall be supported by a written rationale which indicates the circumstances dictating separate treatment and the basis for decisions made. This action reauthorized the federal surface transportation programs for six (6) years, from fiscal year 1998 to 2003, replacing the Intermodal Surface Transportation Efficiency Act (ISTEA). The new law provides $215 billion in spending authority for highways and transit, including $3 billion for transportation enhancement projects. TEA-21 requires state departments for transportation to set aside 10 percent of their Surface Transportation Program (STP) allocation each year for transportation enhancements. This includes activities such as facilities for pedestrians and bicyclists (such as greenways) and rehabilitation of historic transportation buildings. Enhancement projects may be initiated by any group or individual, and need to be formally endorsed by City Council prior to being submitted to the Virginia Department of Transportation. I would like to issue a challenge to The Honorable David A. Bowers, Mayor and members Of Roanoke City Council to participate in Bowl for Kids' Sake, our major annual fund-raiser. Monies raised fi.om this event will be used to allow our organization to recruit and screen potential volunteers to serve as mentors and role models for area children. While we currently have 120 volunteers serving more than 100 children, we still have at least 100 children wanting a Big Brother or Big Sister. Our hope is that each of these children can be paired with positive adult role models. In addition, we have begun a new partnership with Roanoke City Public Schools to provide adult volunteer mentors to children in their classrooms. We hope to launch this program fully in January. I hope that you will provide me with the opportunity to inform members of Roanoke City Council about some of our new and non-traditional programming. This briefing will be presented, using slides, by various staff members. Following the briefing, we will be pleased to address questions from Council or to hear Council's discussion and directions. First, by way of definition, I believe everyone knows that a sewer interceptor is a large sewer pipeline that has been planned, the route has been sited, it has been funded and constructed. However, it's a little harder to understand greenways. Liz Belcher, who is our final presenter for this presentation, will tell you that there are three types of greenways, to include an urban greenway. Even for an urban greenway the following action or decisions have to be made: 1. Width 2. Paved 3. Side benches 4. Trash receptacles 5. Lighting 6. Restrooms 7. Allow traffic conflicts 8. Accent points of' interest 9. Type of planting (just grass or wild life shrubbery/trees) 10. Fencing 11. Hours of access 12. Access points 13. Bridges How do we get an urban greenway? Bowers, Mayor and Members of City Council Roanoke, Virginia Dear Mayor Bowers and Members of City Council: SUBJECT: Virginia Department of Transportation Safety Improvement Program - Project Resolution I. Background: Transportation Equity Act for the 21st Century (TEA-21) was signed into federal law June, 1998. This action reauthorized the federal surface transportation programs for six (6) years, from fiscal year 1998 to 2003, replacing the Intermodal Surface Transportation Efficiency Act of 1991 (ISTEA). The new law provides $215 billion in spending authority for highways and transit, including $3 billion for safety construction, including road hazard reduction and improved safety at rail-highway grade crossings. Bo Funding participation for approved projects is 90 percent federal and 10 percent local. Regular urban highway allocations may be used to provide 98 percent of the 10 percent local matching funds, with the locality providing the other 2 percent. This effectively means that the locality only needs to provide 0.2 percent in local funding. Virginia Department of Transportation (VDOT) project applications were submitted in June, 1998. One (1) application for a railroad grade crossing project was submitted to VDOT by the City. This project was selected by staff based upon site review and citizen complaints. The application is for the installation of gates at the railroad crossing on Norfolk Avenue west of 3rd Street, S.E., as located on Attachment I. This crossing is presently controlled by flashing lights. II Current situation: VDOT has approved this project application. The project will be authorized by VDOT upon receipt of a resolution from City Council and will be included in the next update of VDOT's Six-Year Improvement Program (FY 1999- 20O0). Grisso, Director of Finance November Financial Report This financial report covers the first five months of the 1998-99 fiscal year. The following narrative discusses revenues and expenditures to date. REVENUE General Fund revenues reflect an increase of 6.59% or $3,290,000 compared to FY98. Vahances in specific categories of revenues are as follows: General Property Taxes have increased 5.37% or $1,186,000. The first installment of real estate taxes was due October 5. Real estate taxes have increased $780,000 or 3.72% since FY98, slightly above the budgeted increase of 3.08%. Public service corporation tax rose due to a timing difference. Other Local Taxes are up 7.66% or $1,039,000. Sales tax rose $187,000 or 3.54% from FY98. E911 taxes rose due to a rate increase of $.46, from $.99 to $1.45 per line per month. This increase became effective September 1, 1997 to help fund the regional radio project and CAD system. Revenue from Use of Money and Property decreased $118,000 or 20.74% due to a decline in interest revenue resulting from lower average daily cash balances in the General Fund. Rental income from the Commonwealth Building also dropped. Grants-in-Aid Commonwealth are up $1,299,000 or 11.70%. Social service reimbursements from the Commonwealth have increased across the board. Law enforcement funding through House Bill 599, which is received on a quarterly basis, increased due to a timing difference. Funds were received in November during FY99 but were not received until December during FY98. Grants-in-Aid-Federal Government have decreased 49.57% or $8,000 due to a decline in FEMA revenue caused by a timing difference. Internal Services have decreased $113,000 or 19.23% due to a decline in billings for custodial services and engineering. Fire safety billings are down due to a timing difference. EXPENDITURES AND ENCUMBRANCES Expenditures and encumbrances in the General Fund have increased 9.12% or $6,464,000 since FY98. Variances in individual expenditure categories are discussed as follows: Honorable Mayor and Members Roanoke City Council January 4, 1999 Page 2 General Government expenditures increased 12.29% or $537,000. CIS charges to the Commissioner of the Revenue rose due to systems development related to the personal property tax relief act mandated by the state. CIS charges to the Department of Finance increased duc to systems development related to thc year 2000 compliant release of thc accounting system. Expenditures of the Office of Billings and Collections are up due to the purchase of computer equipment and increased CIS charges relating to the new utility information system. Personal service costs of the Director of Human Development office have increased. Health and Welfare expenditures rose $1,582,000 or 21.28%. Due to welfare reform, the City now receives more funding designated for day care service payments. Day care service benefits provided to clients increased substantially from FY98 to FY99 as a result. Personal service costs of social services income maintenance department also increased. Parks, Recreation and Cultural expenditures are up 11.53% or $212,000 as a result of increased expenditures and a decline in reimbursements received by the Recreation Department. Publication and subscription expenditures, CIS charges and personal service costs of the Library also increased. Transfer to Debt Service is up $1,962,000 or 32.55%. This increase is caused by an additional amount being transferred in FY99 for the principal and interest payment made on August 1, 1998 for the 1997 bonds. These bonds were issued during FY98 with payments starting in FY99. Nondepartmental expenditures rose $1,088,000 or 33.38% due to increased transfers to the Capital Projects Fund resulting from the appropriation of funding for various construction projects. The nondepartmental category is comprised primarily of transfers to other funds and miscellaneous, non- recurring expenditures. WHEREAS, City Council is concerned with the high cost of health insurance for employees of the City who retire prior to attaining the age of sixty-five; WHEREAS, by Resolution No. 33845-051898, adopted May 18, 1998, this Council provided for payment of a monetary supplement to certain members of the City of Roanoke Pension Plan who retire prior to attaining age sixty-five, but such Resolution did not, by its terms, apply to officers and employees of the City of Roanoke Sheriff's Department; and WHEREAS, City Council now desires to provide a monetary supplement to officers and employees of the City of Roanoke Sheriff's Department, who have earned twenty (20) or more years of "creditable service" with the City, which supplement may be used by such retired employees to partially defray the cost of health insurance; THEREFORE, BE IT RESOLVED by the Council of the City of Roanoke as follows: 1. Any officer or employee of the City of Roanoke Sheriff's Department who, on or after July 1, 1998, retires after earning twenty or more years of"creditable service" with the City of Roanoke, but prior to attaining age sixty-five, shall be paid a monthly supplement of $159 commencing with the first month of retirement and temainating with the month in which the officer or employee attains age sixty-five. 2. The supplemental benefit provided for by this resolution shall not be considered a pension benefit subject to any cost of living adjustment which may be provided by City Council to any beneficiaries under the City of Roanoke Pension Plan in the future. 3. The supplemental benefit provided for by this resolution shall be a personal benefit applicable to an eligible officer or employee only without any fight of survivorship. Upon the death of an officer or employee who is receiving such benefit, the monthly payment shall be made for the month of ~uch officer's or employee's death and shall terminate with the next succeeding month. 4. The terms "beneficiary", and "pension" shall have the meanings ascribed to them by §22.1-2, Code of the City of Roanoke (1979), as amended. The term "creditable service" shall mean twenty (20) or more years of service as an office or employee with the City of Roanoke. The word "employee" shall mean any officer or employee of the City of Roanoke SheriWs Department except a part-time officer or employee (one who is customarily employed less that twenty (20) hours per week or not more than five (5) months in a calendar year). 5. The benefit provided by this resolution shall not be considered permanent, and City Council reserves the right to amend the terms and conditions of this Resolution or to repeal this benefit. 6. I. Background is as follows: mo Purpose of the current request to amend the condition, as stated in the petition, is to provide for the use of a second building on the site which formerly was used as a convenience store (Spur Station). The original rezoning to C-3, Central Business District, was approved by City Council on July 1, 1996. (The original rezoning addressed two parcels; however, proffers applied to only one of these parcels, Official Tax No. 4011103, which is the subject of the current petition.) At the time of the rezoning, the former use of this parcel was a legal, non-conforming convenience store with gas islands. The use had been discontinued for less than two years. Co Parcels originally requested for rezoning were in the special flood hazard area and subject to floodplain development regulations. Parcel with Official Tax No. 4011103 previously was zoned LM, Light Manufacturing District and abuts the LM district which extends along eight blocks of Campbell Avenue, S.W., to the east; the subject property is across from Norfolk Southern yards, zoned HM, Heavy Manufacturing District. Zoning of this area for light manufacturing is appropriate and the goal for the area is industrial development. Eo Rather than continuing the existing legal, non-conforming use, which could have included cosmetic and safety upgrades to the property, petitioner sought to rezone the property in order to construct a new convenience store on the property. As a result, the following planning issues arose: The existing, non-conforming use of the property as a highway convenience store (the Spur Station) was not a use that is encouraged in the Central Business District. Petitioner could not meet the zoning ordinance requirements to rezone the property to C-2, the district which allows highway convenience stores, because the C-2 district requires a minimum of two acres and subject parcel is 0.37 acre, more or less. (There is no adjacent C-2 district which could have been extended.) A new highway convenience store could not have met the use requirements of the C-3, Central Business District. Fo Petitioner requested to rezone the property to C-3, Central Business District, in order to construct a new building for use as a neighborhood convenience store and to continue the use of the gasoline islands as a non-conforming use. The proferred conditions set forth herein shall be met within 18 months from the date of the effective date of the rezoning or 90 days from the date of a certificate of occupancy for the new building, whichever is earlier. Following the approval of the rezoning, a new convenience store was constructed on the site. TOP Cleaners and Alterations currently occupies the second structure on the site which housed the former Spur Station and which petitioner proffered would be used for storage only or removed. This occupation of the former Spur Station store has been cited by the Zoning Administrator as being in violation of the city's zoning ordinance and proffered conditions. II. Current situation is as follows: Petition to amend a proffered condition was filed on September 17, 1998. The petitioner requested that proffer No. 2 of the Third Amended Petition to Rezone be repealed and that a new proffer No. 2 be substituted. A first amended petition to amend the proffered conditions was filed on October 26, 1998. Planning Commission public heating was held on November 4, 1998. Mr. Alton Prillaman appeared before the commission on behalf of petitioner and stated that at the time his clients had received approval of the rezoning in 1996 it had been proffered that only one convenience store operation would be located on the property. He said that currently the property was being used as a pick-up and drop-off laundry and alterations establishment which was in violation of the conditions of the 1996 rezoning. Mr. Prillaman said that he would like to amend the proffer to allow for that operation in addition to the current convenience store. Mr. Prillaman said he did not think the laundry use was detrimental and requested the Commission to approve the amendment. Ms. Tam Roop gave the staff report, noting that the background of the rezoning was very important. She said the parcel had originally been zoned for light manufacturing use and that the original use of the Spur Station building could have been continued as a legal, nonconforming use if petitioner had desired. However, she said, petitioner wanted to construct a new convenience store on the property and requested extension of the C-3, Central Business District, in order to do so. Several planning issues developed as a result of the rezoning request, she said, including the fact that a new highway convenience store (with gas islands) was not a permitted use in the C-3 district. Petitioner, she stated, instead sought Members of Council Page 4 to build a new neighborhood convenience store and to continue the use of existing gas islands as a nonconforming use. Ms. Roop said that in order to make the proposed use as harmonious as possible with the C-3 district petitioner had proffered that there would be only one permitted use on the property and that the original convenience store, which had housed the Spur Station, would be used for storage only or removed once the new convenience store had been constructed. That proffer was key to staff's decision to recommend approval of the rezoning, she stated, because it ensured that the use of the site would be only minimally expanded. Ms. Roop said that the Zoning Administrator had cited TOP Cleaners and Alterations, the second use on the property, as being in violation of the city's zoning ordinance and proffered conditions. She noted, also, that the city's Economic Development Administrator had expressed strong opposition to the change in proffered condition. She said staff had received no comments from the neighborhood organization or adjoining property owners. Staff recommend denial of the request, Ms. Roop, said, finding that: the existing proffer was appropriate and supported sound planning principles; the substitute proffer would enable an increase in the intensity of the use of subject property, contrary to good planning principles; and petitioner was currently in violation of the city's zoning ordinance. Mr. Butler said that he did not think staff had taken into consideration the character and nature of the block of Campbell Avenue under consideration. Ms. Roop said the parcel is located on the edge of a very viable industrially zoned area. She said that the issue was that the owner essentially has a highway convenience store in a C-3 zone, where a neighborhood convenience store is allowed. Mr. Rife asked if a dry cleaning establishment is allowed in a C-3 zone and Ms. Roop responded that it is. Mr. Prillaman clarified that the establishment is really a drop-off for dry cleaning and alterations and that no dry cleaning is done on premises. He admitted that the property owners are not in compliance with the proffer. Mr. Butler asked for comments from the audience and there were none. Mr. Talevi advised that the second sentence of the proffer was unenforceable and asked Mr. Prillaman to submit an amended petition clarifying the language of the substitute proffer and including all proffers relative to the property. Mr. Prillaman state that he would be happy to do so. Members of Council Page 5 There being no further discussion, Mr. Butler called for a vote. The request was approved 3 to 2. E. Petition to Amend Proffered Condition No. 2 of the Petition to Rezone was filed III. on November 13, 1998. The Comprehensive Plan recommends that: 1. development of new or existing commercial areas should be carefully planned and designed to promote quality development and good land use; and 2. development in the flood plain or flood-prone areas should be minimized. Alternatives are as follows: A. City Council approve the request to amend proffered condition. 1. Zoning status would change by way of Proffer No. 2 of the Third Amended Petition to Rezone, dated July 1, 1996, which would be deleted and a new condition, as states in item II.E. which would be substituted. 2. Intensity of the existing land use would be increased and the current use of the former Spur Station, which is in violation of the City's zoning ordinance, would be made conforming. 3. Economic development would be addressed by way of an additional business being provided. 4. Comprehensive plan could be followed. B. City Council deny the request to amend proffered condition. 1. Zoning status would not change, thus continuing non-conforming status. 2. Intensity of land use would not be allowed to continue through existing use of Spur Station which is in violation of City's zoning ordinance. 3. Background: mo Land parcel as requested for rezoning is located at the southeast comer of Orange Avenue (U.S. 460 E.) and Kimball Avenue, N. E. Access to the site will be from Kimball Avenue. Proposed development would not have any unusual or adverse impact on traffic flow at Kimball Avenue. Industrial land in the city has been identified as a valuable economic asset which should be promoted for development or redevelopment. Comprehensive Plan recommends encouraging industrial development on appropriate sites and protecting and maintaining the City's industrial land base. III. Alternatives: A. Approve the rezoning request. Zoning of the subject parcel would become LM, Light Manufacturing District. Comprehensive Plan would be followed as the land will be maintained in an industrial use classification. B. Deny the rezoning request. 1. Zoning of the land will remain HM, Heavy Manufacturing District. 2. Land use will remain vacant. 3. Utilities would be unaffected. 4. Access would not be an issue. o Industrial land would remain in a non-revenue generating status and would not be an economic asset to the city. 6. Comprehensive Plan would not be an issue. IV. This developable area has apparently proved too small for heavy manufacturing use. The size of the usable portion of the tract, and its location at the heavily-traveled Orange Avenue-Kimball Avenue intersection, make it better suited to the greater flexibility afforded by the LM classification, particularly the retail sales use permitted to a limited degree in the LM district. Petitioner therefore believes that the requested rezoning will further the intent and purpose of the City's Zoning Ordinance and Comprehensive Plan by facilitating redevelopment of a long-idle industrial tract at a prominent location in the City. I. Background is as follows: Ao Roanoke City Planning Commission at its October 14, 1998, meeting, authorized staff to file a petition to rezone 15 parcels of land in the 1700 block of Loudon Avenue, N.W., and to schedule a public hearing on this matter at its November 4, 1998, meeting. Proposed area for rezoning to RM-1, Residential Multifamily, Low Density District, consists of a combined area of 2.4 acres, more or less. Co Purposes of the rezoning request are to promote the intent of the City's comprehensive plan and zoning regulations and to further the general welfare and good zoning practices by: (1) making the existing use of the subject properties consistent with the proper zoning category; (2) ensuring that the subject properties will be used in the future in a manner that will not negatively impact adjoining properties; and (3) facilitating preservation of and improvements to the neighborhood. Subject parcels were zoned LM, Light Manufacturing District, in the mid-1960's when the city developed a new comprehensive plan. At the time, a number of Roanoke's older, inner-city neighborhoods were not considered viable for continued residential development and the plan recommended reusing these older neighborhoods as centers for business, industry, offices and institutions. Under the current zoning of LM, Light Manufacturing District, residential properties in the subject area are non-conforming uses (Article VI of the city's Zoning Ordinance, "Nonconformities"). As a result, owners are prohibited from improving or expanding their structures and from building any structures on vacant property other than those allowed in the LM district. Blue Ridge Housing Development Corporation has secured all of the funding needed to implement a community revitalization project for the 1700 block of Loudon Avenue, N.W. Entitled "The Loudon/Melrose Community Rebuilding Initiative", the project's purpose would be to make significant physical improvements to a concentrated portion of the Loudon/Melrose neighborhood as a model for community development and neighborhood revitalization. The sources of funding for this project are as follows: $100,000 in CDBG/HOME grants from the City of Roanoke; $200,000 in construction financing from First Virginia Bank; and $60,000 in Venture Grants from the United Way. The project would have the following impacts on the 1700 block of Loudon Avenue, N.W.: four new homes (one of which would be handicapped accessible) would be constructed on vacant lots; critical repairs and improvements would be made to six owner-occupied homes; three owner-occupied homes would be rehabilitated; and landscaping would be added. Go The Loudon/Melrose Neighborhood Organization selected the site for the Blue Ridge Housing Development Corporation's community revitalization project Members of the neighborhood group looked at a total of 52 city blocks, narrowed possible sites down to three blocks and, finally, determined that the 1700 block of Loudon Avenue is the best site. II. Current situation is as follows: Planning Commission public heating was held on November 4, 1998. Ms. Tam Roop presented the staff report. She said it was apparent at the time of the Planning Commission's site visit in October that the 1700 block of Loudon Avenue is a viable residential neighborhood. She said that Blue Ridge Housing Development Corporation has secured all of the funding needed -- $360,000 -- to proceed with a model revitalization project which would be used to improve the block. However, because of the current zoning, she stated, residents are not allowed to improve or expand their homes, new homes cannot be constructed and Blue Ridge Housing's project cannot move forward. She said the Members of Council Page 3 proposed rezoning would affect all but one parcel on the block, a small garage, and that it is appropriately zoned. Ms. Roop said staff is aware that industrially zoned land is a valuable asset; however, she noted, the city's Economic Development Administrator supports the rezoning and has stated that the 1700 block of Loudon Avenue is not conducive to light manufacturing use. Ms. Roop stated that staff is recommending approval of the rezoning, finding that the area to be rezoned is a viable residential area; the neighborhood not only would be conserved but also improved through the implementation of Blue Ridge Housing Development Corporation's revitalization project and that affordable new housing would result. She noted, also, that Loudon Avenue is identified in the city's comprehensive plan as a priority residential revitalization area. Mr. Alvin Nash, executive director of Blue Ridge Housing Development Corporation, appeared before the board. He discussed the process that had been used to select the 1700 block of Loudon as the project area and said his organization had worked extensively with the community throughout the selection process. He said there are over 150 vacant lots in the neighborhood and four in the 1700 block of Loudon. Mr. Nash stated that he did not think any of the residents knew that their properties are nonconforming and that it makes sense to rezone their properties for residential use. Mr. Nash referred to a handout depicting various housing designs and said that Blue Ridge Housing would build homes like those which match the architectural character of the neighborhood. Mr. George Franklin addressed the commission, stating that he had lived in the 1700 block of Loudon Avenue since 1973 and that the area had been in decline since the early 1970's. He stated that the partnership between the neighborhood organization and Blue Ridge Housing had stimulated interest in the area and in developing a plan for the neighborhood. Saying that the project would not only revitalize the area but also the people who live there, Mr. Franklin urged the commission to favorably consider the rezoning request. Ms. Angela Norman appeared before the commission as a trustee of the Victory Christian Center which owns property, now vacant, at 1806 Loudon Avenue and asked what impact the rezoning would have on that property. Ms. Roop stated that the property was not part of the rezoning and that it should not be impacted at all. Ms. Norman stated that she was in favor of enhancing the neighborhood. III. Issues are as follows: A. Current zoning of the subject area is LM, Light Manufacturing District. Members of Council Page 4 Proposed zoning of the subject area is RM-1, Residential Multifamily, Low Density District. RM-1 is considered the most appropriate district in that it allows for the development of single-family detached dwellings and two-family dwellings. If the rezoning is approved, a total of six single-family dwellings and 15 parcels would change from non-conforming to conforming status. Co Land use in the subject area is exclusively single-family residential. The subject area comprises all but one parcel in the 1700 block of Loudon Avenue, N.W. That parcel, located at the comer of Loudon Avenue and 17th Street, is a small garage operation which is appropriately zoned. Rezoning is not being requested for that parcel. Land uses adjacent to the subject area are predominantly residential including, to the north and south, the adjoining blocks of Centre and Gilmer Avenues and, to the east, other blocks of Loudon Avenue. To the west, the 1800 block of Loudon Avenue is predominantly light manufacturing and one side of the block consists of vacant land. One parcel in the 1600 block of Loudon Avenue, at the comer of Loudon Avenue and 17th Street, is zoned CN, Neighborhood Commercial District, and operates as a neighborhood convenience store. Do Economic development is an issue because industrially zoned land in the city has been identified as a valuable asset which should be protected. However, the ci _ty's Economic Development Administrator stated that the subject area is not conducive for light manufacturing development and that he supports the rezoning request. Eo Neighborhood organization is the Loudon/Melrose Neighborhood Organization which selected the 1700 block of Loudon Avenue, N.W., as the site for the Blue Ridge Housing Development Corporation's community revitalization project. BRHDC and the neighborhood organization have conducted a number of meetings, both to select the project site and to involve and get input from residents of the project area. In addition, all of the homeowners in the 1700 block of Loudon Avenue have expressed, in writing, their support of the proposed rezoning. Letters notifying adjoining property owners of the proposed rezoning were mailed October 26, 1998. Planning staff received one comment from an adjoining property owner who was in support of the rezoning. F. Comprehensive plan recommends that: 1. neighborhoods should be conserved and neighborhood quality enhanced; Members of Council Page 5 priority should be given to the maintenance and rehabilitation of sound, usable structures rather than demolition; o non-profit housing development entities should be supported in carrying out housing rehabilitation efforts and the development of model approaches; programs supporting affordable housing should be continued/expanded; and o new construction and renovation should be sensitive to existing neighborhood character. Loudon Avenue is identified in the comprehensive plan as a priority residential revitalization area. III. Altematives are as follows: A. City Council approve the rezoning request. Current zoning would change from LM, Light Manufacturing District, to RM-1, Residential Multifamily, Low Density District, consistent with the existing single-family residential use. Proposed zoning of the subject area would become actual which would enable Blue Ridge Housing Development Corporation to proceed with its community revitalization project, thus directly promoting preservation of and improvements to the subject area and the residences in it. ° Land use in the subject area would remain the same but would gain legal status: six single-family residences and a total of 15 parcels would change from non-conforming to conforming status. Land uses adjacent to the subject area would not be affected. ° Economic development would not be affected, given that the subject area is a viable residential area which is not zoned appropriately and, according to the city's Economic Development Administrator, the area is not conducive for light industrial development. o Neighborhood organization involvement would be validated as the neighborhood group not only supports the rezoning but also selected the subject area as the best site in the neighborhood for the BRHDC community revitalization project. Neighborhood impacts would be Members of Council Page 6 positive and include the repair and renovation of existing residences and the construction of four new homes on vacant lots. 6. Comprehensive plan would be followed. B. Ci_ty Council deny the rezoning request. Current zoning would remain as is; as a result, six homes and 15 parcels on a viable residential block would remain in non-conforming status. Because the homes would remain as non-conforming uses, the Blue Ridge Housing Development Corporation would not be able to proceed with its community revitalization project and home owners would not be able to benefit from the repair and rehabilitation of their homes which is a key feature of the project. In addition, four affordable new homes would not be constructed on vacant, inner-city property. Proposed zoning which would bring existing residential uses into conformity with the appropriate zoning district would not be realized. o Land use in the subject area would remain as is, with resulting negative impacts and opportunity costs, as noted above. Land uses adjacent to the subject area generally would not be affected; however, the positive spillover effects of the community revitalization project on the surrounding residential area would not be realized. Economic development would not be affected because the subject area is not conducive to light manufacturing development. ° Neighborhood organization would not realize its desire to have this block serve as the site for the Blue Ridge Housing Development Corporation community revitalization project. Neighborhood impacts would be negative and include: the continued inability of residents to improve or expand their homes, the inability to construct affordable new housing and the associated effects on the stability of the neighborhood as well as the loss of a significant community revitalization project. 6. Comprehensive plan would not be followed. IV. Recommendation: The Planning Commission, by a vote of 5 to 0 (Ms. Duerk and Mr. Manetta absent), recommended approval of the proposed rezoning, finding that: the area proposed to be rezoned is a viable residential neighborhood; the neighborhood not only would be conserved but also improved through the implementation of a community revitalization Members of Council Page 7 project by Blue Ridge Housing Development Corporation; and affordable new housing, sensitive to existing neighborhood character, would result. Dibling, Jr. City Attorney Roanoke, Virginia Gentlemen: At a regular meeting of the Council of the City of Roanoke which was held on Monday, January 4, 1999, Council Member Swain requested information in regard to the penalty for failure to display a current State vehicle inspection sticker and failure to display a current City motor vehicle decal. He inquired as to the financial impact of increasing the fines by ten per cent, twenty-five per cent and fifty per cent. The Mayor requested information on enacting a prosecution fee which would be assessed by the Courts and payable to the Commonweath's Attorney and a police investigation fee, and inquired if the Commonwealth of Virginia has adopted enabling legislation authorizing Cities to impose such fees. It was the consensus of Council that the above matters would be referred to the City Manager, City Attorney and Director of Finance for report to Council at the Financial Planning Workshop on Saturday, January 16,- 1999.
