Dear Mayor Taylor and Council Members:
Subject: A Recognition and Honor of Our Armed Service Personnel
in the Middle East
At the Council Meeting on Monday, September 17, 1990, as a part of the
Mayor's 1990 State of the City Address, it was recon~nended that consideration
be given to turning the Mill Mountain Star to an appropriate color in
recognition and in honor of our armed service personnel in the Middle East. At
that same meeting Council received petitions in support of placing a large
yellow ribbon on the Mill Mountain Star in recognition of the military
personnel in the Persian Gulf. Both of these suggestions were referred to the
City Manager's Office for review and report back to City Council.
Representatives of the City met on several occasions with citizens who had
made the suggestion of placing a large yellow ribbon on the Mill Mountain Star.
There was considerable discussion concerning the cost of such a proposal, the
ability of the Star superstructure to support such an installation, as well as
whether this concept would truly fulfill the desired goal of showing support
for our military personnel in the Persian Gulf. It was ultimately agreed by
the citizens and City representatives that this idea could not be readily
implemented.
Arrangements have been made to change the lighting on the Mill Mountain
Star to red, white, and blue such as was done during the bicentennial
celebration and again when the City received its 1988 Ail America City
designation. A brief ceremony will be held on Wednesday, January 31, 1991, at
6 p.m., at the Star overlook on the mountain. Vice-Mayor Howard Musser will
throw the switch to illuminate the star. Council Members are invited to
participate in the ceremony. Representatives of veterans' organizations and
news media have been invited.

Subject: Street Lighting - 600 block of Allison Avenue, S. W.
At your meeting on Monday, December 17, 1990, Mr. Davis S. Luck appeared
with a request for certain changes and additions to the street lighting in the
600 block of Allison Avenue, S. W. You referred this matter to me for study,
report and reco~nendation.
On January 24, 1990, Mr. Luck submitted a similar petition to the City
administration. In accordance with standard procedures, Mr. Luck's petition ·
was acknowledged and subsequently investigated. By letter of March 21, 1990,
Mr. Luck was advised of the results of this investigation which concluded that
~ ~e~ ~da~Ot meet the City's criteria for additional street lighting.

By far the greatest number of requests for additional Street lighting in
residential areas which must be denied by the City involve situations where
citizens are concerned with the safety of their property. While it is
certainly acknowledged that lighting can be a deterrent to criminal activity,
the City installs street lights principally for motor vehicle safety. As such,
our emphasis is on intersections, on hills and curves, and at the end of
dead-end streets. Annual funding is not available to provide street lighting
in residential areas to provide illumination to satisfy all citizen requests.
City policy on residential street lighting is as follows:
1. It is desirable, provided funds are available, that a street light be
installed at each intersection and at or near the dead-end of a
street. Mid-block street lights will be justified whenever there is a
minimum distance of 600 feet or greater between lights. The distance
may be reduced due to horizontal or vertical curvatures in the
roadway or other unusual circumstances (i.e., churches, parks,
schools, accidents, etc.)
2. Location of trees may be taken into consideration when installing new
justifiable lights; but the existence of trees alone does not justify
additional lighting.

3. The fact that elderly, young, or middle age citizens reside on a
street cannot be used as a consideration for additional lighting as
this may change from day to day.
4. The policy of the City is not to light alleys in residential areas.
5. Street lights are installed primarily to light the streets, with any
secondary benefits as to lighting yards, porches, driveways, etc.,
being coincidental.
The 600 block of Allison Avenue was again visited on January 10, 1991, to
see if any factors had changed which would have an impact on our previous
decisions concerning street lighting. We still conclude that the request is
not in keeping with the City's policy for street lighting on residential
streets.

Advertising Benches at Bus Stops
In my staff meeting this morning during a discussion of the
matter of advertising benches at bus stops which was on Council's
Agenda yesterday, A1 Beckley and Bill Mullins both remembered that
Council had granted permission in the '50s or '60s concerning this
matter.
I checked with Mary Parker and was able to find information
concerning a franchise which was awarded to Joseph W. Hazelgrove on
March 24, 1958, by Resolution No. 13324. This franchise was
subsequently transferred with Council's approval to Virginia Display
Benches, Inc., and finally A. C. Owen.
According to information in the Clerk's files, bids were
advertised for the granting of this franchise for "advertising benches
to be placed at various bus stops and other suitable and approved
locations," which locations were to be approved by the City Manager.
~qle City was to receive $4.00 per year per bench and to not less than
$200 per year.
The franchise was granted for a ten year period which would
seemingly have expired in 1968. The last notice of a bond as required
by Council resolution, expired in August of 1971. This may indicate
that the company also realized that they no longer had a franchise.
My question to you would be, should we take steps to remove any
remaining benches from the public right-of-way? I have not made any
attempt to locate A. C. Owen or otherwise find out if any individual
or firm thinks that they have a right to place these benches on City
right-of-way.

Dear Hr. Crandall,
Thank you calling me again with reference to our meeting with your
client, Mr. David Henderson, this past January. I was interested to
learn that Mr. Henderson still desires to establish a bench
advertising business within the service area of GRTC. Certainly the
positioning of benches along the GRTC routes will be of benefit to
our patrons and it is for this reason that I hope you are successful
in assisting Mr. Henderson establish his bench advertising business.
As I mentioned during our original meeting, my only concern with an
independent party establishing such a bench advertising business
relates to the maintenance of the benches and the appropriateness of
the advertisements. Invariably, people will associate the benches
and advertisements with GRTC and obviously we would not want either
to create a negative image. I suspect the City of Roanoke will share
this same concern and gaining approval to place the benches within
the public right-of-way might therefore require that Mr. Henderson
provide the City with some sort of formal assurance regarding these
issues as he indicated he would be happy to do.
Please let me know of your progress. I will be happy to provide
specific information about our routes and ridership to assist Mr.
Henderson in the placement of the benches in the event he gains the
necessary approvals.

DEPARTMENT OF AGRICULTURE
BACKGROUND
A. City of Roanoke receives funds from the United States
Department of Agriculture (USDA), through the Virginia
Department of Corrections to enhance the food service
program of the Crisis Intervention Center (Sanctuary),
Juvenile Probation House (Youth Haven), and Juvenile
Detention Home.
II. CURRENT SITUATION
USDA funds for the Fourth Quarter of Fiscal 1990 and the
First Quarter of Fiscal 1991 have been received by the
City of Roanoke for the facilities~ as follows:
1. Crisis Intervention $ 2,459.51
2. Juvenile Probation House 1,578.61
3. Juvenile Detention Home 8~014.66
4. Total $12,052.78
USDA funds usage regulations require the funds to be used
for:
1. Equipment and repairs;
2. Food costs;
3. Labor costs of food service workers.
USDA Requirements for record keeping are:
1. Monies are to be kept in separate account and cannot
be combined with State and Local funds;
2. Detailed records are to be kept for all expenditures
made against the funds;

equipment purchases and file annual reports to the
Department of Corrections.

Do not appropriate the USDA funds to the Crisis

Budget - Funds already received will have to be
returned to USDA.
Needs of Food Service Program - Facilities could not
upgrade their food service program and equipment.
Emergency needs of the facilities would have to come
from local funds or existing budgets.

A. 21~ along Peters Creek in northwest Roanoke City has
been a community issue of concern for a number of years.
B. Businesses and hom~ have been subject to periodic flooding
resulting in damage to real and personal property.
C. ~ was conducted by the Corps of Engineers
along Peters Creek in 1971 when most of the watershed was
located in Roanoke County. Following the 1976 annexation,
the Corps discontinued the study for lack of a local sponsor.
Roanoke City became the local sponsor in November 1985 and
the Corps completed its study in February 1988.
D. Noti£ieat~on ofan insuffioient benefit-to-cost ratio by the
Corps of Engineers on all Peters Creek alternatives was
received in February 1989. Additionally, the Federal
Government notified the City that it had no further role
concerning Peters Creek. The Corps of Engineers, under
Federal Regulations, is not allowed to consider common flood
control elements such as floodproofing of individual structures
and detention facilities for less than the probable maximum
flood. In addition, they do not consider the overall condition
of bridges for replacement.
E. ~ of Peters Creek was begun by the City Staff
ln March 1989. A number of small channel improvement projects,
detention facilities, floodproofiag and bridge improvements
proved to be feasible.
F. Peer rmview was requested by City Council and the City Manager
to assist City Staff in the identification of apPropriate flood
reduction alternatives for Peters Creek.
G. 2~was completed in January 1990. The results
confirmed the feasibility of all options noted in I-E and
generated an estimated project cost of ~4.000.000.00.
H. ~ for the project has been identified in
general obligation bonds per the bond referendum passed on
May 1, 1990 for~X)OiLD_O~.

on May 6, 1990 and three (3) proposals were received on

I. Background:
A. ~greement between City of Roanoke and Cova Corporation (UPS)
is dated February 13, 1989.
Construction contract for the Realignment and Reconstruction
of Thirlane Road was authorized by City Council on October 1,
1990 in the amount of $1~261~160.09.
C. Construction of both Thirlane Road and the UPS facility are
underway.
D. UPS facility's preliminary opening date ~s set for May 17,
1991.
UPS has requested the lowering of a portion of the new
Thirlane Road so that UPS property will have a road frontage
elevation that will better match the Thirlane Road elevation.
F. UPS has agreed to pay for the additional work estimated to
cost $99,617.00. (See attached.)
II. Current Situation:
City Council needs to authorize Change Order No.1 to the
Agreement w~th Cova Corporation (UPS) in the amount of
$99,617.00 to be received from Cova Corporation (UPS) for
payment of this additional work.

grubbing, and construction survey in the amount of
$99,617.00 and a 60 consecutive calendar day time exten-
sion.
1. Cost to the City will be zero as Cova Corporation (UPS)
has agreed to pay the additional cost.
2. Ability to meet time schedule will be maintained.
3. Enhancement to UPS property will be improved.
B. Do not authorize execution of Change Orders with Cova
Corporation (UPS) and S. R. Draper Paving Company.
1. Cost to City will be zero.
2. Ability to meet time schedule will not change.
3. Enhancement to UPS property will be denied.
V. Recommendation is that City Council:
Authorize the execution of Change Order No. 1 to the

DESCRIPTION OF WORK TO BE PERFORMED:
Compensation for cutting approximately 31,000 cubic yards of dirt including
mobilization, clearing & grubbing, and surveys for new Thirlane Rd. adjacent to
UPS property and filling said dirt on adjacent UPS property approximately 3' so
that property will have road frontage elevation that will match new Thirlane Rd.

Mattern, and an additional sixty days to do said work, but UPS entrances must be
completed by May 3, 1991.
Contractor agrees to provide all labor, supervision, materials, supplies, equip-
ment, transportation, tools, taxes, services, overhead and profit and all other
things necessary or appropriate for the proper and complete performance of the
above described work and for work not specifically described but reasonably
inferable from the description for the amount set forth below.
The provisions of the Contract Documents constituting the Agreement between the
referenced Owner and Contractor for the above project shall apply to this Change
Order. Acceptance of this Change Order shall preclude all further claims for
compensation for the above described work.

Dear Mrs. Bowles and Gentlemen:
Pursuant to Chapter 9, Education, of the Code of the City of
Roanoke (1979), as amended, establishing a procedure for the
election of School Board Trustees, this is to advise you that the
three year terms of Mrs. Marilyn C. Curtis, Mrs. Velma B. Seif
and Mr. James ~. Turner, Jr., will expire on June 30, 1991.
According to Section 9-16, on or before February 15 of each year,
Council shall announce its intention to elect trustees of the
Roanoke City School Board for terms cor~nencing July I through
(1) public announcement of such intention at two consecutive
regular sessions of the Council and (2) advertisement of such
intention in a newspaper of general circulation in the City twice
a week for two consecutive weeks.
Section 9-17 provides that all applications must be filed in the
City Clerk's Office by March 10. Inasmuch as March 10 falls on a
Sunday, applications will be received until 5:00 p.m., on Monday,
March 11, 1991. Application forms will be available in the City
Clerk's Office and may be obtained between the hours of 8:00
a.m., and 5:00 p.m., Monday through Friday. Information
describing the duties and responsibilities of School Board
Trustees will also be available.
Periodically over the next four months, I wil'l keep the Council
informed of the various steps to be followed throughout the
selection process.
