report from the Director of Finance with regard to:
(1) the amount of funds included in a bond issue for reno-

The City Manager was requested to report to Council by
Tuesday, February 19, 1991, with regard to placement of
banners and flags in the downtown area of the City, as well
as tourism signs for downtown Roanoke.
The City Manager was requested to report to Council with
regard to continuing the salary of those City employees who
are serving in the military and stationed in the Persian
Gulf or funding the difference between their military
salary and their City salary. The City Manager was also
requested to report to Council with regard to support ser-
vices for families of said City employees.

Annual Report of the City of Roanoke Pension Plan for
the Year Ended June 30, 1990
On behalf of the Board of Trustees of your Pension Plan I am
submitting a copy of the Component Unit Financial Report for the
year ended June 30, 1990.
As you can see from this comprehensive report, the Pension
Plan continues to grow and remain in an extremely sound financial
position.
I want to extend my sincere thanks to each and every member
of City Council who every year ensures that the Pension Plan is
always actuarially funded. This is the reason our Plan is so
strong and is able to provide a benefit structure that helps to

Basketball Tournament on March 7, 8 and 9. The Committee has been
working over the past year to prepare all the elements of a truly
wonderful tournament. The Roanoke Valley will be hosting literally
thousands of basketball fans.

At the regular meeting of Council on Monday, February 4, 199I, you
requested additional information with regard to a request of the
Roanoke City School Board for approval of a literary fund loan appli-
cation, in the amount of $2.5 million, for the purpose of modernizing
Forest Park Elementary School.
Inasmuch as Council Member Harvey will not be present for the Council
meeting on Tuesday, February 19, he requested that the item be held in
abeyance until a later Council meeting. I took the liberty of con-
tacting Mr. Kelley and he informed me that there will be no problem in
submitting appropriate documentation to the State if Council acts on
the request at its regular meeting on ~.~onday, March 4. (February 25
is a neighborhood Council meeting which will be held at Lincoln
Terrace Elementary School.)
With your concurrence, I will place the item on Council's March 4
agenda for appropriate action.

Council at its February 4, 1991 meeting regarding the Literary Loan
application for Forest Park Elementary School. It is requested that
the fact sheet and the School Board's request for approval of the
Forest Park Literary Loan application be discussed at the February 19
City Council meeting. School officials will be unavailable for the
February 11 Council meeting because of a VSBA legislative meeting in
Richmond on that date.

FACT SHEET
Subject: Renovation Cost of Older Elementary Schools
The budget estimate for renovation of the seven oldest elementary
schools was first proposed in 1986 at a cost of $8.6 million based on
a preliminary general architectural review of the schools to be
renovated. The School Board's May 1988 Capital Improvement Plan
subsequently updated this estimate to $1].7 million based on design
schematics for each school The Hay 1990 Capital improvement Plan
~ncreased the cost estimate to $15.2 million based on the cost
experienced in the planning and renovation of the first three schools.
Durlnq the last four years the School Board has kept City Council
apprised of major changes In school renovation costs through letters
and the Board's annual Capital improvement Plan.
The financing Plan approved in 1988 for the renovatlon projects
required the issuance by the City of $5.2 million in capital bonds
with the balance of the project costs to be funded by Literary Loans.
The School Board agreed to pay debt service costs on a portion of the
capital bonds and the total debt service requirements on the Literary
Loans. Since 1988 City Council has approved apPropriations annually
for each project {Highland Park, Oakland, and Crystal Spring)
consisting of $5.2 million for capital bonds, $4.0 million in Literary
Loans and $500,000 in Capital Maintenance and Equipment Replacement
Funds for a total of $9.7 million· City Council also has provided
$455,000 for land acquisition at Highland Park and Oakland.
The first project, Highland Park E]ementary School, was undertaken tn
the summer of 1988 and completed in the ear]y fa]] of 1989. The cost
of the project was $1.2 million more than the original estimate
because of additional asbestos abatement, demolition, and mechanical
work not anticipated in the orlglna] archltect's study. The purchase
of additional land by the City which led to an expansion of the
Cafeteria and parking lot also caused an increase in renovation cost.
Oak]and Elementary School was the second project and it was completed
In September 1990. its cost was $200,000 more than budgeted primarily
because of structural deficiencies found in the oldest section of the
building.
Construction work on Crystal Spring Elementary School started in
August, 1990 and its estimated project cost is about $375,000 more
than the original budget. The increase In the budget was the result
of added cost for two new classrooms, expansion of the cafeteria area
and COrrection of water problems in that area, and the cost of
relocatlng the main entrance In order to improve school bus safety.

The Forest Park Elementary School project ls estimated to cost $2.25
million, or about $325,000 more than the original estimate. The
Increase in the cost is the result of expansion of the Inadequate
library-media center, the added cost of providing handicap access to
all floors of the building, and maintaining the unique architectural
integrity of the building. The Literary Fund request is for $2.5
million and includes a 10% contingency which because of present
economic conditions we do not expect to use.
Project financing as proposed in the Board's May 1990 Capital
Improvement Plan is as follows:
A. Clty approved 1985 and 1988 Capital Bond
million. Issues - $5.2
B. Approved Literary Fund loans $4.0 million.
C. Proposed Literary Fund loan for Forest Park - $2.5 million.
D. Additional Literary Fund loans for the remaining three
schools $3.0 million.
E. Funds from Schools, share of prior year Capital Maintenance
and Equipment Replacement Fund $500,000.
The completion of the present contract for Crystal Spring Elementary
School will mean that $7.3 million has been expended for renovation of
the first three elementary schools ($2.8 million in capital bond
proceeds, $4.0 million In Literary Fund loans, and $500,000 In capital
replacement funds). This would leave a balance of $2.4 million in
capital bond proceeds and $5.5 million in proposed Literary Loans
($7.9 million total) for the remaining four schools.

The estimate for each schoo) is about $350,000 higher than the
original budget in anticipation of renovation costs similar to those
encountered in the First three projects.
In reviewing renovation Plans for these school projects, the School
Board and School Administration only have approved design plans that
incorporate changes necessary to school operation and needed to bring

BE IT ORDAINED by the Council of the City of Roanoke that:
1. Subsection (b) of §26-45, prohibited discharges

Standards, of Chapter 26, S~ewers and Sewage Disposal, are hereby
amended and reordained to read and provide as follows:
§26-45. Prohibited discharges generally.
(b) Discharges into public sewers shall not contain:

water supply greater than 10.0 mg/1.
(3) Benzene, toluene, ethylbenzene and xylene (BTEX)
greater than 5.0 mg/1.

I. Background:
A. City's Wastewater Code lists specific limited and prohibited
discharges.
B. Certain limited and prohibited discharges need to be changed
to better administer the pretreatment program. (See Attach-
ment "A".) These changes are subject to approval by the
Virginia Water Control Board.
C. Pretreatment programs protect publicly owned treatment works
(POTW) from harmful industrial discharges.

now or hereafter imposed by law, a tax is hereby
levied and imposed on the purchaser of all food sold in
the city in or from a restaurant, whether prepared in
such restaurant or not and whether consumed on the pre-
mises or not, or by a caterer regardless of place of
delivery or consumption. The rate of this tax shall be
four (4) percent of the amount paid for such food. In
the computation of this tax, any fraction of one-half
cent ($0.005) or more shall be treated as one cent
($0.01).
2. In order to provide for the usual daily operation of the

Proposed Change to Section 32-284 of Roanoke City Code
Tax on Prepared Food and Beverages
Roanoke City Code Sections 32-283 through 32-297 deal with the Tax
on Prepared Food and Beverages. During the 1990 Session of the
General Assembly, a change was made to Section 58.1-3841 of the
Code of Virginia concerning the situs for taxation of the sale of
food and beverages.
The new section provides that the situs for taxation for any meals
tax is the locality in which the sales are made, namely, the
locality where the place of business is located, without regard to
the locality of delivery or possible use by the purchaser. The
term "sale" means a final sale to the ultimate consumer.
The change also provided that sales of meals

BE IT ORDAINED by the Council of the City of Roanoke that:
1. The bid of L. H. Sawyer Paving Company, Inc. made to the

and West End Parks, such bid being in full compliance with the
City's plans and specifications made therefor and as provided in
the contract documents offered said bidder, which bid is on file
in the Office of the City Clerk, be and is hereby ACCEPTED.
2. The City Manager or the Assistant City Manager and the
City Clerk are authorized on behalf of the City to execute and
attest, respectively, the requisite contract with the successful
bidder, based on its proposal made therefor and the City's speci-
fications made therefor, said contract to be in such for as
approved by the City Attorney, and the cost of said work to be
paid for out of funds heretofore or simultaneously appropriated
by Council.
3. Any and all other bids made to the City for the afore-
said work are hereby REJECTED, and the City Clerk is directed to
notify each such bidder and to express to each the City's appre-

4. In order to provide for the usual daily operation of the

I. Background:
Bids, following public advertisement, were publicly opened
and read aloud before City Council on January 22, 1991, for
Improvements to City Parks as listed above.
Eight (8) bids were received with L. H. Sawyer Paving
Company, Inc. submitting the low bid tn the amount of
$147~155.00 and 120 consecutive calendar days.
C. Work consists of the following:
Huff Lane: Extend paved area of the four (4) tennis
courts, new paving, fencing and tennis net posts,
concrete pads with benches and trash receptacles.
2. Thrasher: Replace basketball court, new concrete pad
with bench.
Fishburn: Remove existing tennis courts. New tennis
courts with paving and base, net posts, fencing,
concrete pads with benches and receptacles.
Shrine Hill: New concrete sidewalks from parking lot to
tennis courts and from tennis courts to school sidewalk,
new benches and waste receptacles on concrete pads.

Lakewoed: Remove existing basketball court. Replace
with regulation basketball court, concrete pad with
bench and waste receptacle. New 4' high fence along
park side of lake.
Staunton Avenue: Remove small basketball court.
Construct new regulation size basketball court, concrete
pad and bench, 4' high fence along 23rd Street to keep
balls out of street.
7. West End Park: New 4' high fence along Tenth Street
side of park to keep soccer balls out of Tenth Street.
The basketball and tennis courts are being removed and
replaced because they are smaller than regulation size and
because the pavement does not have the proper base material.

Re: Status of Legislative Matters
Dear Mrs. Bowles and Gentlemen:
At this time, we are just beyond the mid-point of the 1991 Session
of the General Assembly, and, as Chairman of City Council's Legisla-
tive Committee, I am pleased to submit this report with respect to the
status of certain legislative matters of interest to the City. Upon
review of this report, I think you will find that the 1991 Session is
being generally responsive to the City's Legislative Program. This
letter discusses six legislative issues, and in each case, the General
Assembly has acted in response to City Council's legislative proposals.
With respect to our Charter bills (Senate Bills 528 and 529), I
am pleased to report that these bills were passed by the Senate on
third reading on January 24, 1991. I am advised that each bill passed
by a vote of 38-0. As you know, Senate Bill 528 provides for civil
penalties for destruction of historic structures without obtaining any
required demolition permit and certificate of appropriateness from the
City. The civil penalty would be in an amount not to exceed twice the
assessed value of the structure. Senate Bill 529 provides for a de-
sign overlay district to protect neighborhoods or areas of the City
from new development which is not in harmony with existing develop-
ment.
The Hotel Roanoke Conference Center Commission Act (House Bill
1764) was introduced by Delegate Woodrum on January 22, 1991. During
the last week, Mr. Dibling worked with the Division of Legislative
Services to resolve technical issues with respect to the bill, and an
Amendment in the Nature of a Substitute has now been published. I am
advised that the bill has the approval of officials of Virginia
Polytechnic Institute and State University, and Delegate Woodrum
expects the bill to proceed routinely through the legislative process.
In in its 1991 Legislative Program, City Council urged the reduc-
tion of excessive regulatory or statutory mandates and requested full

funding of all mandates. In the alternative, given the expected cut-
backs in State funding, Council urged that mandates be suspended until
full State funding is available. In this regard, I am pleased to
advise that Delegate Diamonstein has introducted House Bill 1351 which
allows the Superintendent of Public Instruction, according to guide-
lines developed by the State Board of Education, to grant temporary
waivers of the Standards of Quality and accreditation standards for
school divisions facing fiscal difficulties. We have urged our legis-
lators to support House Bill 1351 because (1) it gives school boards
some flexibility in using available resources to meet educational
needs; (2) it is an important first step toward relaxation of State
mandates; and (3) it acknowledges that State standards should be
waived when State funding is not available at the level anticipated
when the standards were promulgated.
Also relating to mandates, Delegate Harris of Lynchburg has in-
troduced House Bill 1902 which authorizes the Governor to suspend any
State administrative mandates upon a finding that a locality is
fiscally stressed and that the suspension of the mandate would help
relieve the fiscal hardship of the locality. Again, this bill is
responsive to the City's Legislative Program.
You will recall that, as a result of the unfortunate attack on
India Renee Hairston by a vicious dog on October 3, 1990, City Council
adopted a resolution urging the 1991 Session of the General Assembly
to enact legislation requiring the humane destruction of "vicious"
dogs and imposing strict regulations on the keeping of "dangerous"
dogs. This matter was of particular interest to Councilman White.
In response to City Council's resolution, Senator Earley has intro-
duced Senate Bill 881 which will provide the much-needed authority for
localities to deal with this threat to the public health and safety.
Finally, in its 1991 Legislative Program, City Council requested
that the assessment for courthouse and jail maintenance enacted by the
1990 Session of the General Assembly be continued. You will recall
that the 1990 legislation permits an assessment as a part of the fees
taxed as costs in each criminal or traffic case in a district or cir-
cuit court in an amount not in excess of $2.00. The assessment is
used for the construction, renovation or maintenance of courthouse or
jail facilities and to defray increases in heating, cooling and elec-
tricity costs. The bill enacted by the 1990 Session included a sunset
of July 1, 1991. In response to City Council's request, Delegate
Woodrum has introduced House Bill 1510 which repeals the sunset clause
on this useful legislation.

I. Background:
A. Construction of new addition to Roanoke Memorial Hospital (RMH)
requires revision of street and utility systems south of existing
structure.

Closing of Weller Lane~ S.E. just east of Water Pumping Station and
resulting installation of new structures and private driveway system
to serve RMH Power House and Emergency facilities as well as City
properties south of new structure will cause the removal of the
current electric system along Weller Lane, S.E.
II. Current Situation:
Indentur~ (deed of easement) has been submitted by APCO permitting a
new electric service line to be installed across the Crystal Spring
property from the intersection of Yellow Mountain Road, S.E., and
Jefferson Street to a location near the RMH Power Plant, easement 40
feet wide and approximately 650 feet long. (See attached map.)
B. Route of proposed easement and placement of poles has been reviewed
and approved by the Water Department.
C. Relocation of line one time at APCO's expense to be required as a
part of this agreement.
Reliability of electrical service (sectional/zing) for Crystal Spring
Water Pumping Station to be provided by APCO as a part of this
agreement.

Reference your letter request of November 20, 1990 to City Engineer
Charles Huffine for a 100 foot x 10 foot easement across Fishburn Park
to provide a new telephone cable to WBRA-T~.
Please be advised that paragraph 4 of the lease agreement between
the City of Roanoke and Blue Ridge ETV Association provides as follows:
"(4) Electrical and Telephone Services. The Lessee shall have the
right to enter into agreements with public utility companies for
the furnishing to the Lessee of electric, telephone or gas utility
services as may be required by Lessee for the conduct of Lessee's
educational television business, the location and type of any such
electric or telephone lines or gas lines or mains to be subject to
the prior approval of the Lessor and, if practical, to be laid
underground through adjoining lands of the Lessor. Lessee shall
pay or provide for the payment of the costs of all electric power
and telephone installations and services for use of and used by the
Lessee upon said premises".
The Lessor is obviously the City of Roanoke. An easement can only
be for~ually approved by Roanoke City Council. This process will take 30
- 60 days depending on the desires of the Chairman of the City's Water
Resources Committee (Mrs. Elizabeth T. Bowles) for this easement to be
reviewed by her committee. In the meantime, in consideration of your
need to proceed, you may do so, at your own risk, pending formal
ratification by City Council. The cable must be underground, avoid
damages to trees, and be field approved by Mr. Lynn Vernon, City Parks
Planner, and the area restored to a pre-construction condition. Mr.
Vernon's approval of a specific location, if different from your sketch,
must be documented by a revised sketch, and is not to negate the need
for formal Council ratification.
I will proceed with recommending the formal approval of your
request through City Manager W. Robert Herbert, Mrs. Bowles, and Roanoke
City Council. I also need you to provide me a copy of your form of
ease~ent agreement, which agreement will be subject to approval of our
City Attorney.

I. BACKGROUND:
Mill Mountain Zoo was opened in 1952, and was
first operated by the City of Roanoke as a
children's zoo. The Roanoke Jaycees operated and
maintained the miniature railroad (Zoo Choo) as
authorized by Ordinance No. 11526, dated August
11, 1952.
Mill Mountain Zoo, Inc. was formed by the Roanoke
Jaycees, Inc. in 1976, to take over the operation
of the zoo, since the City was about to close the
facility. A lease agreement was authorized by
Ordinance No. 23216, dated September 7, 1976.

Blue Ridge Zoological Society of Virginia was
formed in 1988 as a result of a reorganization of
the Mill Mountain Zoo, Inc.
II. CURRENT SITUATION:

Zoo lease agreement and miniature train agreement
expired December 31, 1990.
Blue Ridge Zoological Society has requested a new
lease agreement that would expand the zoo
boundaries in order to construct a tiger habitat.
(Refer to Attachment "A".) Although the City
endorses the project, it will encroach upon land
the City acquired in 1967 through a Federal Open
Space Program, and approval for the use of this
site must be obtained from the National Park
Service (NPS), before expanded zoo boundaries can
be included within new lease agreement. The City
is seeking the NPS approval. (Refer to Attachment
"B".)
Roanoke Jaycees has requested a one (1) year
renewal of their existing three (3) party
agreement between the Jaycees, the City and the
Blue Ridge Zoological Society, in order to
continue operation of the miniature railroad.
(Refer to Attachment "C".)

on an interim basis (for a period not to
exceed one (1) year), until NPS approval is
obtained and a new lease agreement can be

Zoological Society of Virginia for operation
of the miniature railroad, on an interim
basis (for a period not to exceed one (1)
year), until new lease agreement, referred to

On behalf of the Blue Ridge Zoological Society of Virginia%
Inc., which operates Mill Mountain Zoo, I would like to request
that the City of Roanoke consider a new lease agreement which will
allow the Mill Mountain Zoo to occupy its present area plus the
proposed expansion for a tiger exhibit for a term of five years
with three renewable five year terms. A separate agreement between
the Jaycees, the City, and Blue Ridge Zoological Society for the
operation of the Zoo Choo is being redrafted by the Jaycees at this
time.
We are presently operating under extension agreements which
are due to expire at year end. The major changes we are requesting
are as referenced above, the larger term of five years and an
expanded boundary for the Mill Mountain Zoo. I understand that due
to the various land acquisitions for the top of the mountain the
proposed tiger exhibit may encroach upon some of the land purchased
with federal and/or state funds. I would appreciate your advising
us on any deed restrictions or program restrictions which may
impact upon our operation relative to the land that we now occupy
and propose to expand into.
It is my understanding that the stamp of approval for our new
Siberian Tiger habitat has been given by Mr. Lennis B. Vernon,
Parks Planner for the City of Roanoke. It is my understanding also
that the Mill Mountain Development Committee and that Evelyn S.
Gunter, City Planner, are aware of and have approved the expansion
of the Zoo for the tiger habitat.

Dear Mr. Buehler:
As per previous conversations with Jim Guyton, the Blue Ridge
Zoological Society of Virginia has formally requested permission
from the City of Roanoke to expand the present limits of their
lease agreement within Mill Mountain Park in order to construct a
new Siberian Tiger Habitat. The Zoo has proposed to complete the
work in two (2) phases. Please refer to the enclosed letter dated
August 30, 1990 to Mr. Herbert from Ms. Beth Poff and the October
22, 1989 pamphlet about the Tiger Habitat.
According to the best available survey data, it appears that the
proposed total expansion will encroach, by approximately 10,500
square feet or 0.24 acre, onto property that was acquired by the
City in 1967 under the Bureau of Outdoor Recreation Program.
You will also find enclosed for your reference, review and
comments one (1) copy each of the overall and the Phase I plans
for the Siberian Tiger Exhibit as prepared by Hughes Associates
Architects and Hill Studio and a Map of Mill Mountain Recreation
Area highlighted to show the property, in question, that was
acquired through the Federal Open Space Program.
We fully endorse the Tiger Habitat Project and feel that this Zoo
expansion will enhance the educational and recreational opportu-
nities being offered by the Zoological Society and would not be
detrimental to the City's overall development of Mill Mountain
Park.

lease of the old No. 6 Fire Station to the Southeast Action Forum,
Inc. and the sub-lease of portions of the building during certain
times of the day to the League of Older Americans for the Senior
Citizens Dining Club from July 14, 1990 to July 13, 1995, with provi-
sions for the lease and sub-lease to continue on a year to year basis
thereafter, with sixty (60) days notice of termination of e~ther lease
or sub-lease by either party. Lease to be in a form approved by the
City Attorney.
1. Need by petitioners for continued use of facility is met.
2. Timing to renew expired lease quickly is met.
3. Neighborhood Stability is enhanced by supporting the continued
provision of services to the neighborhood by petitioners.
Cost to City remains the expense of maintaining certain exterior
portions of structure. Cost of maintenance for FY 1989-90 was

Indemnification and Public Liability Insurance in favor of the
City to be provided by lessee and sub-lessee in form and amounts
acceptable to the City Attorney and Risk Manager.
