requesting a briefing from the City Manager with regard to the
City of Roanoke's program relating to Small and Minority
Business Development.

Hearing of Citizens Upon Public Matters:
Request of Mr. Donald F. "Whitey" Taylor, F.C.S.
Enterprises, to address Council with regard to racing at
Victory Stadium.
Mr. Taylor was requested to place his proposal for trial
racing at Victory Stadium in writing and submit the infor-
mation to the City Manager, including such items as a per-
formance bond in amounts deemed appropriate by the City,
the type of cars proposed to be raced, a parking plan,
decimal readings on noise levels at similar facilities,
measures proposed to be taken to monitor the noise factor
at Victory Stadium, and any other information deemed
appropriate by the City Manager.

Mr. F. Don Fitzgerald appeared before Council with regard
to a proposal submitted by the Southwestern Virginia
Building and Construction Trades Council consisting of a
prequalification procedure to be considered by the City of
Roanoke in its procurement process involving construction
services. He expressed concern over the past and present
practice of construction firms doing work in the City of
Roanoke without utilizing the local area labor work force.
The City Manager, along with City staff deemed appropriate
by Mr. Herbert, were requested to meet with representatives
of the Southwestern Virginia Building and Construction
Trades Council to discuss their concerns and report to
Council accordingly.
Ms. Mary C. Terry, Chairman, Northwest Area Concerned
Citizens Group, advised that the organization was formed to
deal with the activities of youth and young adults in the
Cove Road and Lafayette Boulevard area, with specific con-
cerns relating to gathering of young people on private pro-
petty, fighting, reckless driving, drugs and other illegal
activities. She outlined a specific action plan, and
invited the Members of Council to attend future meetings of
the Northwest Area Concerned Citizens Group.

Mr. Rick Hendrick, 933 Missouri Avenue, N. E., President of
the Lincoln Terrace Parent-Teacher Association, welcomed
the Members of Council to the Lincoln Terrace Elementary
School.

Request for briefing on the City of Roanoke's program
related to Small and Minority Business Development
Dear Ur. ~erbert:
As we discussed at our February 19, 1991, Council meeting, I
requested you to provide a briefing to Council on the above
subject. From the discussion at the Council meeting, I concluded
that we have some work to be done in this area. From the com-
ments you made, it was my impression that the only reason the
City of Roanoke encourages Affirmative Action related to the
above subject is to meet Federal requirements.
I feel that Affirmative Action Programs relating to small busi-
nesses is first of all, just good sound business practice.
Secondly, it is in the public interest, and thirdly, I feel that
this is an area where a local government can have significant
impact without expending additional funds or creating new
programs. Small businesses create the majority of r~ew jobs
created in this country and, in our community, they are more
likely to employ persons who would require some type of local
government assistance. Therefore, if we can stimulate the growth
and maintenance of small businesses within the City, it will
benefit us in the long run.
It is my view that the public sector must set an example for the
private sector in this area. By this letter, T would respect-
fully request that your briefing include the following: a

historical statement and a projection of what direction we can
take, as well as specifics on how small and minority business
development interact with the City's highly recognized economic

A RESOLUTION approving the Roanoke Regional Airport
Commission budget for FY 1991-1992, upon certain terms and con-
ditions.
WHEREAS, Section 24.B of the Roanoke Regional Airport
Commission Act and Section 17.(a) of the contract between the
City of Roanoke, Roanoke County and the Roanoke Regional Airport
Commission provide that the Commission shall prepare and submit
its operating budget for the forthcoming fiscal year to the Board
of Supervisors of the County and the City Council of the City; and
WHEREAS, by report dated February 13, 1991, a copy of which
is on file in the Office of the City Clerk, the Chairman of the
Roanoke Regional Airport Commission has submitted a request that
the City approve the FY 1991-1992 budget of the Roanoke Regional
Airport Commission.
THEREFORE, BE IT RESOLVED by the Council of the City of
Roanoke that the FY 1991-1992 budget and proposed capital expen-
ditures for the Roanoke Regional Airport Commission as set forth
in the February 13, 1991, report of the Commission Chairman, a
copy of which is incorporated by reference herein, is hereby
APPROVED, and the City Manager and the City Clerk are authorized
to execute and attest, respectively, on behalf of the City, any
documentation, in form approved by the City Attorney, necessary
to evidence said approval.

Dear Mrs. Bowles and Gentlemen:
In accordance with the requirements of the Roanoke Regional
Airport Commission Act, and the Roanoke Regional Airport Commis-
sion Contract dated January 28, 1987, submitted for your approval
are the Airport Commission's 1991-1992 proposed operating and
capital budget, as well as a separate listing of proposed capital
expenditures which are expected to exceed $100,000 and are in-
tended to benefit five or more future accounting periods.
The Commission has been advised by bond counsel that formal
approval of the budget by resolution of each of the participating
political subdivisions would be appropriate. The capital expen-
diture list also requires formal approval.
Therefore, on behalf of the Commission, the fiscal year 1991-
1992 budget and the proposed capital expenditures are enclosed for
your approval by resolution.
I will be pleased to respond to any questions or comments
that you may have with regard to this matter. On behalf of the

WHEREAS, Section 24.B of the Roanoke Regional Airport
Commission Act and Section 17.(a) of the contract between the City
of Roanoke, Roanoke County, and the Roanoke Regional Airport
Commission provide that the Commission shall prepare and submit its
operating budget for the forthcoming fiscal year to the Board of
Supervisors of the County and 'City Council of the City; and
WHEREAS, by report dated February 13, 1991, a copy of which
is on file in the office of the Clerk to the Board, the Chairman
of the Roanoke Regional Airport Commission has submitted a request
that the County approve the FY 1991-1992 budget of the Roanoke
Regional Airport Commission.

Request from the City Manager for
authorization to file all necessary applications,
on behalf of the City of Roanoke, to alter by closure
with barricades, Maitland Avenue, N.W. between Williamson
Road and Woodbury Street
I. Back~round:
Request from Mr. Oscar Hollar, 5121Woodbury Street, N.W., was made to
City Engineering Department to investigate the possibility of making
some type of traffic safety improvement at the intersection of
Maitland Avenue and Williamson Road, N.W. In particular, Mr. Hollar
suggested barricading a portion of Maitland Avenue between Williamson
Road and Woodbury Street (see attached diagram).
Petition (attached) supporting Mr. Hollar's request has been signed by
48 of the residents of Woodbury Avenue and Hearthstone Road, as well
as the 2 businesses nearest the intersection, Sovran Bank and
Monticello Manor.
Traffic safety is a concern at this location due to the limited visi-
bility that Woodbury Avenue motorists have of vehicles turning from
southbound Williamson Road to westbound Maitland Avenue. Topography
of this intersection creates less than desirable sight distance.
II. Current Situation:
Fifteen (15) accidents repo~ted at the Maitland Avenue/Woodbury Street
intersection during the past four (4) years have occurred in the imme-
diate vicinity of the intersection, resulting in three (3) personal
injuries.
Traffic volume on Woodbury Street consists of trips generated from its
29 homes and from the exit from Sovran Bank. Traffic volume on
Maitland Avenue is approximately 2,400 vehicles per day and primarily
consists of through traffic traveling between Williamson and Airport
Roads~
Ce
Proposed barricade, which can be implemented on a trial basis, is not
expected to decrease traffic volumes, but should make the intersection
safer. If trial period is considered successful, City would make
application after the six (6) month period to permanently close this
segment of Maitland Avenue by permanent removal of pavement.

Subject: Roanoke River Flood Reduction Project
Environmental Site Assessments
I. Background:
Land Acquisition is the City of Roanoke's primary respon-
sibility (financial and manpower) for the Roanoke River Flood
Reduction Project. This responsibility includes producing
plats, obtaining independent property valuations, making
offers, preparing deeds, recording executed deeds, and
acquiring the property interests, through condemnation if
necessary.
Federal environmental legislation and regulations impose
significant potential liability upon purchaser of real pro-
perty. To provide maximum protection against liability, the
City must make reasonable efforts to determine if each parcel
has potential environmental problems prior to purchasing.
Environmental Assessments have been determined by the Corps
of Engineers to be a project cost element as defined in the
Local Cooperative Agreement.
II. Current Situation:
City staff advertised Request for Proposals for interested
firms to conduct phased Environmental Assessments. Based on
initial responses to the advertisement, staff interviewed the
following firms deemed fully qualified, responsible, and
suitable:
1. Dewberry & Davis
2. Froehling and Robertson
3. Hayes, Seay, Mattern & Mattern, Inc.
4. Mattern and Craig, Inc.
5. Olver, Inc.
6. Schnabel and Associates
7. Talbot and Associates
8. Westinghouse Environmental and
Geotechnical Services, Inc.

Dewberry & Davis, after ranking of qualifications, was deter-
mined (by the three (3) staff members) to be top ranked
offeror on basis of professional qualifications and proposed
services. Subsequent negotiations and review by the Corps of
Engineers resulted in a contract and a scope of work for
Phase I that was determined to be acceptable by all parties.
The negotiated fee is $152~000.00 for 237 parcels of land.
Additional parcels will cost $800.00 each.
Observations noted by Dewberry & Davis during Phase I (record
search and field visit) could result in the need for a Phase
II (field testing). However, any Phase II Environmental
Assessments will require the negotiation of additional
contract terms and Council's approval.

AN ORDINANCE authorizing the acquisition of a certain approximate
760 square foot area of real property bearing official tax number
1112822, for street preservation, construction, and maintenance pur-
poses located at the intersection of Campbell Avenue and Patterson
Avenue, $.W.; authorizing the City Manager to take appropriate action
for purchase of this property; authorizing the City's acquisition of
this property by condemnation, under certain circurastances; and pro-
viding for an emergency.
BE IT ORDAINED by the Council of the City of Roanoke that:
1. For the preservation, construction and maintenance of a por-
tion of Campbell Avenue located at the intersection of Campbell Avenue
and Patterson Avenue, the City wants and needs fee simple title, with
appurtenant rights, to a certain approximate 760 square foot triangu-
lar portion of official tax number 1112822, located immediately west
of the intersection of Campbell Avenue and Patterson Avenue, S. W. and
measuring 76' by 76.4' by 20.1', as more particularly set forth in the
report of this Council dated February 25, 1991, a copy of which is on
file in the Office of the City Clerk, and is incorporated by reference
as a part of this ordinance. The proper City officials are authorized
to acquire this land for the City for the amount of the final
appraised value, the amount negotiated by the City administration and
he landowner, or the amount of any condemnation award.
2. A public necessity and use exists for the acquisition of said
property being the preservation, construction, and maintenance of a
portion of Campbell Avenue and immediate acquisition by purchase or
condemnation is necessary and expedient.
3. The City Manager is authorized to contract with said land-
owners on behalf of the City for purchase of such property for an
amount deemed appropriate. Upon acceptance of any offer and upon
delivery to the City of a deed, approved as to form by the City
Attorney, the Mayor and City Clerk are authorized to execute and
attest, respectively, any necessary documentation and the Director of
Finance is directed to pay the agreed upon amount to the owner(s) of
the interest conveyed, certified by the City Attorney to be entitled
to the same.
4. Should the City be unable to agree with the owner(s) of the
real estate to be acquired as to the compensation to be paid or other
terms of purchase or settlement, or should the owner be a person under
disability lacking capacity to convey real estate or should the
whereabouts of the owner be unknown, the City Attorney, as well as the
City Manager, Mayor, DireCtor of Finance and other appropriate City
officials shall be authorized and directed to take any and all action
necessary in connection with condemnation or legal proceedings to
acquire for the City the appropriate real estate under Article 7,
Section 33.1-89, et seq, of Chapter 1 of Title 33.1, of the Code of
Virginia (1950), as amended, and Chapter 1.1, Section 25-46.1, ~t ~eq,
of Title 25 of the Code of Virginia (1950), as amended, including,
without limitation, issuance, execution, and recordation of an
appropriate certificate and accompanying documentation pursuant to
§33.1-119, et seq, Code of Virginia (1950), as amended, vesting title
to the subject property immediately in the City, and the Director of
Finance, upon request of the City Attorney, shall be authorized and
directed to draw and pay into Court the appropriate sums in connection
with such proceedings.
5. In order to provide for the usual daily operation of the
municipal government, an emergency is deemed to exist, and this ordi-
nance shall be in full force and effect upon its passage.

Property at 712 Patterson Avenue, S.W. was remodeled to pro-
vide office rental space. During the work, the property
owner requested the City to replace the existing brick
sidewalk on the Campbell Avenue side of the property with
concrete curb and gutter and sidewalk to protect an old
concrete retaining wall located on Campbell Avenue side of
the easterly portion of the property.
B. Building on property was later leased by City of Roanoke for
use by Health Department.
Upon investigation and survey it was discovered that the wall
projects some one foot six inches (1'6") into the Campbell
Avenue right-of-way at its easternmost terminus.
Wall was determined to be City property after legal research.
The City then prepared three (3) alternative plans for
restoring/removing the wall.
II. Current Situation:
Solution chosen as most cost effective consists of replace-
ment of the end of the wall, located on a portion of Lot 51,
Taylor Map, Official Tax No. 1112822, with a smaller wall
running between Campbell and Patterson Avenues, filling the
area between the streets, and landscaping the newly created
park-like area.
Independent appraiser was hired and the property owner
informed of what is being contemplated. Owner was apprised
of the value of the small parcel established by the appraiser
($900.00 to $950.00) and has indicated he would refuse that
amount for the lot.

Committee recommend to City Council that it authorize the
City Manager to officially offer the property owner the
appraised value ($950.00) for the property, the current
assessed value of this portion of Official Tax No. 1112822 is
$911.00, and further authorize the City Attorney to institute
condemnation proceedings to acquire the property should the
property owner refuse to accept the offer.
Liability would be mitigated since the wall belongs to
the City and once the property ~s acquired, it would be
removed, area stabilized with new wall and filled.
2. Acquisition would be accomplished in an expeditious
manner.
Cost would be minimized at the estimated amount of
$2~000.00, including acquisition of the property,
appraisal, independent engineering analysis, survey, and
title search.
Funding would be required due to the potential liability
in not moving forward. Funds are available in account
008-052-9603-9181, Public Improvement Bonds - Series
1988 - Streets and Bridges. These funds are earmarked
to continue the Neighborhood Curb, Gutter and Sidewalk
Program but, due to the emergency nature of this
problem, could be used here.
Committee recommend to City Council that it not authorize the
City Manager to purchase the property and inform the property
owner that the wall is his and that he must repair or remove
the wall before damage is done to Campbell Avenue due to
failure.
Liability may still fall on the City since legal
research indicates the wall to be City property and the
owner is aware of that opinion.

4. Funding would still be needed to defend this position
against the property owner.

Committee recommend to City Council that it not authorize the
City Manager to purchase the property and insist that the
City solve the problem of the wall without permanently
encroaching on adjoining private property.
Liability would be adequately addressed except that the
property owner's building utilizes the wall for some
bearing purpose in the building.
2. Acquisition of temporary construction easement would be
necessary.
Cost would not be minimized since the two alternatives
studied will cost more than the method discussed in
Alternative "A".
4. Funding would still need to be made available in a
larger amount than contemplated in Alternative A.
Recommendation: Committee recommend to City Council that it
authorize the transfer of ~2,000.00 from account number
008-052-9603-9181 to an account to be established by the Director
of Finance entitled Campbell/Patterson Land Acquisition to fund
property acquisition and authorize the use of condemnation should
negotiations for the purchase not be successful, in accordance
with Alternative "A".

WHEREAS, Council is desirous of granting the request of the
Permittee pursuant to certain terms and conditions;

as follows:
1. Permission is hereby granted the Permittee to mount certain
flags on street lighting poles in the Central Business District of
the City, the Permittee's request being more particularly described

Chairman, Roanoke Valley Chapter, American Red Cross, a copy of
which is on file in the Office of the City Clerk.
2. The permit granted by this ordinance shall be revocable at
the pleasure of the City of Roanoke.

4. The Permittee shall and, by-execution of this ordinance,
does agree to indemnify and save harmless the City, its officers,
agents and employees from any and all claims, legal actions, and
judgments advanced against the City and for expenses the City may
incur in this regard, arising out of the Permittee's intentional
acts or negligent acts or omissions with respect to the rights or
privileges granted hereby.
5. Permittee shall give notice to the City's Director of
Public Works prior to entry onto City property or City facilities
for installation or mounting of the flags.
6. The permit granted by this ordinance shall expire, by its
own terms, without notice, at midnight on March 31, 1991.
7. This ordinance shall be in full force and effect at such
time after its effective date as a copy, duly signed, sealed,
attested and acknowledged by an appropriate official on behalf of
the Roanoke Valley Chapter of the American Red Cross, has been filed

I. Backsround:
During March 1990, City Council granted permission to the Roanoke
Valley Chapter, American Red Cross, to hang flags from street
lighting poles in the central business district. This was in
recognition of Red Cross Month to raise local awareness of the
volunteers who help their community through service in this
organization.
II. Current Situation:
By letter dated January 21, 1991, Mr. Edward C. Dunbar, Chairman
of the Roanoke Valley Chapter of the American Red Cross, has
again requested permission to fly the 3 foot by 5 foot American
Red Cross flags from street light poles in the central business
district.
III. Issues:

City Council grant a revokable permit to the Roanoke Valley
Chapter, American Red Cross to hang flags from street

Authority for approval or denial is solely City

past. The Roanoke Valley Chapter, American Red Cross,
has agreed to obtain public liability insurance as
reconnnended by the City Attorney. The City will be
named as an additional insured on the policy.

Dear Bob,
We are now preparing for our annual March Month activities at the Roanoke Valley
Chapter. As you know, March is declared American Red Cross Month by the President
of the United States, and we try to raise local awareness of our volunteer services by
holding special events. With Council's permission, we'd like to fly the Red Cross flags
in downtown's business district in the latter half of March. We do this in honor of the
thousands of hours of pubhc service performed each year by our local volunteers.
We have coordinated the dates with the organizers of the Metro Tournament, and there
is no schedule conllict with their flags. Our Red Cross flags measure three-by-five feet,
and are hung on wooden staffs which we mount in lightposts along the downtown
streets. We would appreciate the City Council's consent for us to display these flags from
March 14th through March 31st. The streets we have used in the past include Campbell
Avenue, Church Street, Jefferson Street and the Market Square. All costs and labor in
this project will be the responsibility of the Roanoke Valley Chapter, including an
insurance provision to cover any potential damages and liabilities.

Subject: Request to Transfer Franchise -
Roanoke and Botetourt Telephone Company
Ordinance No. 30250-10190 was adopted by Roanoke City Council on first
reading at its meeting on Monday, September 24, 1990, and, again, on second
reading at its meeting on Monday, October 1, 1990. Said ordinance granted
Roanoke and Botetourt Telephone Company the right, for the term and upon the
conditions stated in the above-referenced ordinance, to use certain streets,
alleys and public ways of the City to erect, construct, operate and maintain a
fiber optic telecommunications system in the City of Roanoke.
Section 10 of said ordinance entitled, Approval of Transfer, provides, in
part, that no sale, assignment or lease by the grantee of the franchise or of
the privileges granted thereunder shall be permitted or effective without prior
approval by the Council of the City. The City has been put on notice that
Roanoke and Botetourt Telephone Company is in the process of transferring all of
its fiber optic assets in accordance with an Order of the State Corporation
Commission of Virginia to a subsidiary corporation, R & B Network, Inc. (see
attached letter). R & B Network, Inc., has agreed to assume all of the obliga-
tions and responsibilities under the franchise, and to comply with all of the
ordinance requirements.
Therefore, I recommend that Roanoke City Council approve the request in the
attached letter by adopting the appropriate measure prepared by the City
Attorney.

Dear Mr. Herbert:
We represent Roanoke & Botetourt Telephone Company ("R & B").
On October 1, 1990, the City Council granted to R & B a franchise
to construct and operate a fiber optic telecommunications system
within the City. R & B is in the process of transferring all of
its fiber optic assets in accordance with an Order of the State
Corporation Commission of Virginia to a subsidiary corporation,
R & B Network, Inc. ("Network"). I enclose a copy of this Order
and a certificate of good standing for your review.
The SCC order requires Network to file a report of action
taken by March 1, 1991. Section 10 of the Ordinance allows R & B
to assign the franchise and its related privileges and obligations
after notice to the City Manager and approval by City Council.
I have talked to Mark Williams and he is working with us on
the procedural aspects. Please review this matter with Mark at
your convenience. We would like to get this matter concluded by
mid-February. Thanks for your assistance in this matter.

Pursuant to the Roanoke Charter of 1952, as Chairman of the
Personnel Committee of Roanoke City Council, I am pleased to offer
you the position of Municipal Auditor effective February 19, 1991.
This letter and its terms and conditions are subject to and condi-
tioned upon your election by City Council at its regular meeting
of February 19, 1991, and adoption by City Council at the same
regular meeting of a resolution ratifying the terms and conditions
of this letter. If you accept this offer and are elected Municipal
Auditor, your duties, responsibilities and powers and your removal
will be governed by the Roanoke Charter of 1952, Constitution of
Virginia, Code of Virginia (1950), as amended, and the Code of the
City of Roanoke (1979), as amended.
The terms and conditions of your employment as Municipal Auditor
shall be as follows:
As Municipal Auditor, you will be paid a base
bi-weekly salary of $2,115.38, payable at the
same time as other employees of the City.
The City shall execute any necessary agreements
provided by the International City Management
Association-Retirement Corporation (ICMA-RC) for
your participation in said ICMA-RC Retirement
Plan and, in addition to the salary set out in
Paragraph 1 herein, the City shall pay an amount
equal to nine (9) percent of your gross salary into
ICMA-RC on your behalf, in equal proportionate
amounts each pay day, and the City shall transfer
ownership to any succeeding employers upon your
resignation or discharge; provided that the City's
contribution on your behalf to ICMA-RC during any
tax year shall not exceed the maximum amount per-
mitted by IRS regulations to be deferred from
Federal income taxation during any tax year (cur-
rently, $7,500 per year).

Recognizing that the job requirements of the
Municipal Auditor routinely require incurring
of travel related expenses in the course of
City business, a bi-weekly salary increment of
$69.23 will be provided for use of your pri-
vately owned or leased automobile in the conduct
of official City business.
The City shall put into force and make required
premium payments on your behalf on a disability
insurance policy providing income benefits equi-
valent to seventy (70) percent of your net salary
for the duration of any disability.
