A communication from Mr. Jeffrey A. Cromer, Manager~ Solid
~aste Disposal, transmitting the budget summary and revenue pro-
jections as approved by the Roanoke Valley Regional Solid Waste
Management Board for fiscal year 1991-92, and advising of an
increase in landfill tipping fees for local governments and
private/commercial haulers, effective July 1, 1991.

Petitions and Communications:
A communication from the Roanoke City School Board recom-
mending approval of a State Literary Fund loan application,
in the amount of $2.5 million, for the purpose of moder-
nizing Forest Park Elementary School.
Adopted Resolution No. 30424-30491. (7-0)
Council Member White addressed the matter of declining
school enrollment, as well as certain changes that have
taken place in the City of Roanoke since the original plans
for renovation of the elementary schools were developed in
1985-1986. He requested that the City Administration and
the School Administration submit a joint report to Council
and to the School Board relative to the three schools pro-
posed to be renovated after Forest Park Elementary School
renovations have been completed to determine if there
remains a need to renovate said facilities as elementary
schools.

A report recommending transfer of $75,000.00 and
appropriation of an additional $75,000.00 to cover a

deficit in funding for the cost of day care for
children of parents who are mandated to seek employment

Social Services.

A report recommending transfer of $12,993.00 from the
Capital Maintenance and Equipment Replacement Program
to provide funds for the purchase of one new seven
passenger mini-van to be used by the Department of
Social Services, from Capital Truck Center, of
Richmond, Virginia, at a total cost of $12,993.00.

A report recommending acceptance and appropriation of
an additional $39,454.30 in funding received from the
U. S. Department of Justice, Forfeited Property Sharing
Program, in order to expend said funds in accordance

A report concurring in a report of a bid committee
recommending acceptance of the bid submitted by J. W.

Inquiries and/or comments by the Mayor and Members of City
Council.
Council Member Fitzpatrick referred to an article which
appeared in the Sunday, March 3, 1991, edition of the
Roanoke Times and World-News with regard to the carnage
that continues in northwest Roanoke, specifically Lansdowne
Park, Hurt Park, Lincoln Terrace and other areas of north-
west. He requested that the City Manager submit a report
to Council providing more detailed information as to what
is happening in the area, along with an indication as to
the feasibility of establishing a police precinct in what
is considered to be the highest crime area of Roanoke, and
whether or not such action would have an impact on existing
problems·

Dear Mayor Taylor and Members of City Council:
At your Monday, August 27, 1990, regular meeting, City Council received
comments from Mr. F. Don Fitzgerald of the Southwestern Virginia Building and
Construction Trades Council regarding his organization's concern that the
developer of the Hotel Roanoke project may opt to use a "selective bidding"
process versus an open competitive process. Thereafter, City Council referred
Mr. Fitzgerald's comments to me.
The only agreement approved thus far between the City of Roanoke, the
Virginia Tech Real Estate Foundation, Inc. (VTREF), and the Virginia Polytechnic
Institute and State University (VPI/SU) specifies or sets forth the terms and
the conditions under which the aforementioned parties would construct and
operate a Conference Center. After several reviews of Mr. Fitzgerald's corres-
pondence, it appears that the construction of the Conference Center may have
been confused with the proposed renovation of the Hotel Roanoke. As you are
aware, these are currently two separate projects. In that the agreement which
Council approved regarding the Conference Center does not cover the renovation
of the Hotel Roanoke, the bidding procedures by which VTREF, VPI/SU, and/or a
private developer procure the services to renovate the hotel is yet to be
determined, and, as noted above, outside of the scope of the only agreement
which City Council has approved to date.
For your future information, I have scheduled a meeting with a represen-
tative of the Southwestern Virginia Building and Construction Trades Council to
discuss a separate but related matter which was publicly discussed at your
February 25, 1991, neighborhood Council meeting.
If you should have additional comments and/or questions regarding this
matter, please do not hesitate to contact me.

Dear Mrs. Parker:
In accordance with Section 10(c) of the Roanoke Valley
Regional Landfill Agreement, attached are the budget summary
and revenue projections as approved by the Roanoke Valley
Regional Solid Waste Management Board for the upcoming
fiscal year 1991-92.
The Regional Landfill Board has approved a $1.00 per
ton increase in tipping fees for local governments and $2.00
per ton increase for private/commercial haulers effective
July 1, 1991. The Landfill Board approved an increase in
tipping fees for local governments from $19.00 per ton to
$20.00 per ton and for private/ commercial haulers from
$23.00 per ton to $25.00 per ton.
This rate increase is necessary to provide sufficient
funds to close the existing regional landfill according to
the new solid waste regulations, provide funds for
post-closure care after the facility closes and for
~evelopment costs for Phase i of the Area A disposal area.

VIRGINIA,
A RESOLUTION authorizing the School Board for the City of Roanoke
to make application for a loan from the State Literary Fund for improve-
ments to Forest Park Elementary School.
WHEREAS, the School Board for the City of Roanoke, on the 4th day
of March, 1991, presented to this Council an application addressed to
the State Board of Education for the purpose of borrowing from the
Literary Fund, $2,500,000 for adding to and improving the present
school building at Forest Park Elementary School, to be paid in twenty
(20) annual installments, and the interest thereon at four percent
(4%) paid annually.
BE IT RESOLVED that the application of the City School Board to
the State Board of Education of Virginia for a loan of $2,500,000 from
the Literary Fund is hereby APPROVED, and authority is hereby granted
the said City School Board to borrow the said amount for the purpose
set out in said application. This Council will each year, during the
life of this loan at the time it fixes the regular levies, fix a
rate of levy for schools or make a cash appropriation sufficient for
operation expenses and to pay this loan in annual installments and the
interest thereon, as required by law regulating loans from the
Literary Fund.

Dear Mrs. Bowles and Gentlemen:
At the regular meeting of Council on Monday, February 4, 1991, you
requested additional information with regard to a request of the
Roanoke City School Board for approval of a literary fund loan appli-
cation, in the amount of $2.5 million, for the purpose of modernizing
Forest Park Elementary School.
Inasmuch as Council Member Harvey will not be present for the Council
meeting on Tuesday, February 19, he requested that the item be held in
abeyance until a later Council meeting. I took the liberty of con-
tacting Mr. Kelley and he informed me that there will be no problem in
submitting appropriate documentation to the State if Council acts on
the request at its regular meeting on Monday, ~arch 4. (February 25
is a neighborhood Council meeting which will be held at Lincoln
Terrace Elementary School.)

FACT SHEET
Subject: Renovation Cost of Older Elementary Schools
The budget estimate for renovation of the seven oldest elementary
schools was first proposed in 1986 at a cost of $8.6 million based on
a preliminary general architectural review of the schools to be
renovated. The School Board's May 1988 Capital Improvement Plan
subsequently updated this estimate to $11.7 million based on design
schematics for each school. The May 1990 Capital Improvement Plan
increased the cost estimate to $15.2 million based on the cost
experienced in the planning and renovation of the first three schools.
During the last four years the School Board has kept City Council
apprised of major changes in school renovation costs through letters
and the Board's annual Capital Improvement Plan.
The financing plan approved in 1988 for the renovation projects
required the issuance by the City of $5.2 million in capital bonds
with the balance of the project costs to be funded by Literary Loans.
The School Board agreed to pay debt service costs on a portion of the
capital bonds and the total debt service requirements on the Literary
Loans. Since 1988 City Council has approved appropriations annually
for each project (Highland Park, Oakland, and Crystal Spring)
consisting of $5.2 million for capital bonds, $4.0 million in Literary
Loans and $500,000 in Capital Maintenance and Equipment Replacement
Funds for a total of $9.7 million. City Council also has provided
$455,000 for land acquisition at Highland Park and Oakland.
The first project, Highland Park Elementary School, was undertaken in
the summer of 1988 and completed in the early fall of 1989. The cost
of the project was $1.2 million more than the original estimate
because of additional asbestos abatement, demolition, and mechanical
work not anticipated in the original architect's study. The purchase
of additional land by the City which led to an expansion of the
cafeteria and parking lot also caused an increase in renovation cost.
Oakland Elementary School was the second project and it was completed
in September 1990. Its cost was $200,000 more than budgeted primarily
because of structural deficiencies found in the oldest section of the
building.
Construction work on Crystal Spring Elementary School started in
August, 1990 and its estimated project cost is about $375,000 more
than the original budget. The increase in the budget was the result
of added cost for two new classrooms, expansion of the cafeteria area
and correction of water problems in that area, and the cost of
relocating the main entrance in order to improve school bus safety.

The Forest Park Elementary School project is estimated to cost $2.25
million, or about $325,000 more than the original estimate. The
increase in the cost is the result of expansion of the inadequate
library-media center, the added cost of providing handicap access to
all floors of the building, and maintaining the unique architectural
integrity of the building. The Literary Fund request is for $2.5
million and includes a 10% contingency which because of present
economic conditions we do not expect to use.
Project financing as proposed in the Board's May 1990 Capital
Improvement Plan is as follows:
A. City approved 1985 and 1988 Capital Bond Issues - $5.2
million.
B. Approved Literary Fund loans - $4.0 million.
C. Proposed Literary Fund loan for Forest Park - $2.5 million.
D. Additional Literary Fund loans for the remaining three
schools - $3.0 million.
E. Funds from Schools' share of prior year Capital Maintenance
and Equipment Replacement Fund $500,000.
The completion of the present contract for Crystal Spring Elementary
School will mean that $7.3 million has been expended for renovation of
the first three elementary schools ($2.8 million in capital bond
proceeds, $4.0 million in Literary Fund loans, and $500,000 in capital
replacement funds). This would leave a balance of $2.4 million in
capital bond proceeds and $5.5 million in proposed Literary Loans
($7.9 million total) for the remaining four schools. The budget for
these schools is:
A. Forest Park $2.25 million
B. Morningside $1.85 million
C. Virginia Heights - $2.0 million
D. Wasena - $1.8 million
The estimate for each school is about $350,000 higher than the
original budget in anticipation of renovation costs similar to those
encountered in the first three projects.
In reviewing renovation plans for these school projects, the School
Board and School Administration only have approved design plans that
incorporate changes necessary to school operation and needed to bring
the schools into compliance with state and local educational and
building regulations. However, the age and condition of the buildings
hide structural deficiencies that are apparent only after in-depth
architectural design work is initiated with a resultant increase in
project costs.

Day Care for children of parents who are mandated to seek
employment while receiving financial assistance for dependent
children or Food Stamps is arranged and paid for by the Department
of Social Services.

Parents must participate in job search or career exploration if
they do not become employed.
Employed parents are eligible for Day Care on a sliding fee scale
up to 12 months after they are no longer eligible for a money
payment from Social Services.
Parents whose earnings make them ineligible for financial
assistance through Aid to Dependent Children Program, but
who still have Day Care needs, are eligible through the Federal
Jobs Program.
E. State Department of Social Services is committed to reimburse 90%
of Day Care costs.
CURRENT SITUATION
A. Cost of Day Care was underestimated in FY 90/91 by $150,000.
B. Factors contributing to this deficit are as follows:
1. Number of children served increased from 317 in February,
1990, to 453 in February, 1991, because Jobs bill mandates
more recipients for Job Training and Employment.
2. Federal Jobs bill established a new program called
Transitional Day Care.
3. Families who are targeted by the new Jobs bill are families
who have children age 3 and older, which require more hours
per day of Day Care.

Application for an equitable share of property
seized by local law enforcement must be made to the
U. S. Department of Justice and certified by the
City Attorney as to the appropriate agency and
representative to receive the property and that the
transfer is not prohibited by state and local law.
Property ( including funds shared with state and local
agencies) may be used only for the purpose stated
in the application~, i .e. , narcotics investigations
related to law enforcement.

December 17, 1990 City Council designated
funds in the Capital Maintenance and
Equipment Replacement Program to provide for
the purchase of one (11 new Street Sweeper.

fourteen (14} vendors currently listed on the
City's bid list. A public advertisement was
also published in the Roanoke Times and World
News.
Bids were received, after due and proper
advertisement, until 2:00 p.m., on February
12, 1991, at which time all bids, so
received, were publicly opened and read by
the Manager of General Services.

Initial lease of property was by the Norfolk & Western Railway Company
to J&S Parking Co., predecessor to Allright Roanoke Parking, Inc.
Term of that lease began on April 1, 1972, to continue until cancelled
by either party.

Parcel was acquired by City of Roanoke in 1974 as a portion of a site
for a future fire station. Lease between J&S Parking Co· and Norfolk
& Western Railway Company was assigned to the City of Roanoke effec-
tive August 1, 1974.
Lease was amended, for a four (4) year term beginning November 1, 1981
and ending October 30, 1985, by City Council by Ordinance No. 25794,
dated October 26, 1981.
Lease was extended, for a five (5) year term beginning on November 1,
1985 and ending on October 30, 1990, by City Council by Ordinance No.
27805, dated October 7, 1985. Terms of lease included a lease fee of
50% of gross receipts from parking fees and anticipated an estimated
annual revenue to the City of $18,400.00.

INSURANCE, LOSS PREVENTION / SAFETY AND CLAIM MANAGEMENT
Allfight's Risk Management Depamnent, in addition to obtaining insurance for our nationwide
parking operations, has the responsibility to work with the local city ope~fions to identify and
reduce possible risk, using a quality control system which is focused, directional and measurable
to locate problem areas and formulate solutions in ten specific areas. These areas include:
l:l'idng Practices - which may include background checks, psychological evaluations, driving
records and bond applications.
Safe~y - which may include analysis of lots and garages for potentially b~-~,'dous conditions,
structural deficiencies, areas that may lend themselves to po~,ible criminal activities and reducing
them through such means as lighting, sound detection and camera sRrwilln~ce.
Vendor Contracted Services- including reducing exposures to risk from conwactors involved with
demolition, snow removal, conslruction, towing and signage.
The goal of Allright's Risk Management Department is to mnl~. each parking operation a safer
place to work and park.
In the event an inddent does occur, the Risk Management Department not only works with the
insurance companies to investigate the incident, but, using an independent computerized Claims
Management System provided by Corporate Systems, monitors the claims on a regula~ basis. They
~nalntaln a constant liaison with the claims handlers to insure each claim is fully investigated and
handled in a fair and equitable manner.
The Risk Management Department not only reviews insurance coverages and costs on an annual
basis but also the carriers providing those coverages. All carriers providing coverage for Allright
must have a highly acceptable rating in Best's Insurance Rating Guide.
The Risk Management Department utilizes a computerized program to issue Certificates of
Insurance for each lease or management agreement. This program enables Allright to promptly

provide certification of their coverages based upon the requirements in each individual lease or
agreement. This program also automatically reissues Certificates when Allfight'$ insurance
policies annually renew.
Allright's Insurance Program includes the following coverages:
Comm~rdM General Liability Insurance - protects against claims arising out of Allright's
ownership or operation of a premises, completed operations, conwactual liability, personal inju~
torts, or other negligent or alleged negligent acts of Alldght Parking or its employees or agent.
Business Automobile Liability - protects against damage and injuries to third parties or their
property resulting from vehicles owned by Allright and non-owned, leased/rented or oper'~*__~_ by
Allright's employees.
Limits: ~,000,000.00 Combined Single Limit
Garage Liability- protects against damage and injuries to third parties or their property resulting
from Alh'ight's negligent or alleged negligent operation of garages and parking lots.
Limits: $2,000,000.00
Workers' Compensation- provides a schedule of benefits to Allright'$ employees, without regard
to liability, as required by State law in case of an injury, disability or death as a result of
occupational b,~rds. Benefits are pre-determined by each State in accordance with its hws.
Employers Liability Limits:

~Jmbrella / Excess Liability - provides additional liability limits above that provided by the
primary policies, generally nine m/Ilion ($9,000,000.00) dollars over the above stated primary
limits. However, Exce~ Limits can be adjusted to comply to our contractual responsibilities.
In addition to these coverages, Allright can provide additional coverages to comply with the
quirements of the lease or management agreement. Among the additional coverages available:

Garagekeeper's Legal Liability- provides protection against damage to customer's vehicles
resulting from Allright's negligence when a bailment is created. This generally occurs when the
keys of the automobile are in the care, custody and control of Allright. Damage to customer's
vehicles, not in the care, custody and control of Allright, which results from negligence or alleged
negligence is covered under the above referenced Garage liability Policy.
Limits: $2,000,000.00 Combined Shale Limit
Property- provides coverages for owned or leased prope~ies, primarily buildings (garages),
where there is a mortgage or the coverage is required by lease or contract. This policy provides
"replacement cost" coverage, including flood and earthqual~ coverage, on an "all risk" basis.

1. Permission be and is hereby granted the current owners,

Merchants Association, Inc., their grantees, assignees, or suc-
cessors in interest, of the property bearing Official Tax No.
1012308, otherwise known as 410 First Street, S.W., within the
City of Roanoke, to maintain an encroachment by an existing
building encroaching approximately 0.23 feet and 0.33 feet over
and into First Street, S. W., and a public alley east of First
Street, S. W., and north of Official Tax No. 1012308, respec-
tively, as more fully described in a report of the Water Resources
Commlittee dated February 25, 1991, on file in the Office of the
City Clerk.
2. Said permit, granted pursuant to §15.1-377, Code of
Virginia (1950), as amended, shall be revocable at the pleasure
of the Council of the City of Roanoke, and is subject to all the
limitations contained in the aforesaid S15.1-377.
3. It shall be agreed by the permittee that, in maintaining
such encroachments, said permittee and its grantees, assignees,
or successors in interest covenant and agree to indemnify and
save harmless the City of Roanoke, its officials, officers and
employees, from all claims for injuries or damages to persons or
property that may arise by reason of the above-described
encroachments over public right-of-way.
4. Permittee, its grantees, assignees or successors in
interest shall for the duration of this permit, with respect to
claims arising out of the maintenance and use of the structure
and areas permitted to encroach into City right-of-way hereunder,
maintain on file with the City Clerk's Office evidence of general
public liability insurance with limits of not less than
$300,000.00 combined bodily injury liability, including death,
and property damage liability for any one occurrence, and
including the City of Roanoke, its officers, employees and agents
as additional insureds.
5. This ordinance shall be in full force and effect at such
time as a copy, duly signed, sealed, attested, and acknowledged
by permittee, has been admitted to record, at the cost of the
permittee, in the Office of the Clerk of the Circuit Court of the
City of Roanoke, and shall remain in effect only so long as a
valid, current certificate evidencing the public liability
insurance required in paragraph 4 above is on file in the Office
of the City Clerk.

I. Back~round:
Structure constructed in (approximately) 1935 is currently owned by
Credit Marketing and Management Association and is to be sold to
Lingerfelt Development Corporation.
II. Current Situation:
Preparation of a new plat of the property was prompted by the sale of
the property. The plat identified encroachments by the structure into
First Street, S.W. and a City alley north of the structure.
Encroachment into First Street, S.W. is 0.23 feet at the northwest
corner tapering to 0.13 feet at the southwest corner of the 40.89 foot
wide structure. Encroachment into the alley north of the structure is
0.33 feet at the northwest corner of the structure, tapering to 0.0
feet about midway (fifty (50) feet) along the 100.10 foot depth of the
north side of the structure. (See attached plat.)

2. Timing to permit sale to proceed as quickly as possible is met.
Indemnification and Commercial General Liability Insurance includ-
ing bodily ~njury and property damage, with minimum limit of
$300,000.00 per occurrence will be provided by petitioner in form
as approved by the City Attorney and Risk Manager.

Dear Kit:
Please be advised that we represent Credit Marketing and
Management Association who owns the above property in the City of
Roanoke. In accordance with our telephone conversation of
Wednesday, January 16th, I am enclosing to you a plat prepared of
this property by Lumsden Associates, P.C., dated December 12,
1990.
As you will note from the plat, the building constructed on
the lot encroaches on the alley 0.33 feet and encroaches on First
Street 0.23 feet. It also encroaches on the adjoining property
owned by S. E. Merricks, that in the process of being resolved by
a boundary line agreement between the two owners.
The purpose of this letter is that you take such action as
is necessary to assist our client in obtaining an Encroachment
Permit to allow the building to remain in its present location.
I have attempted to determine when the building was
originally constructed. However, the Building Department's
records only showed repairs being made in 1951. Based on our
title examination, it would appear that the building was built
somewhere around 1935.

as shown on the submitted sketch. We would thereby infringe four feet of the city easement. Since
there are already similar lighting devices along the same line in this neighborhood, we would hope
that there would be no objection. Also the columns could be easily removed if there is a demand
for the use of that part of the easement by the City of Roanoke. The Homeowner's Association of
The Aston Condominium would be glad to commit in writing for the eventuality of such an occasion.
A stud), of the sketch will also reveal that these proposed columns are located well away from the
actual driveway as well as from the parking lot hardtop and into the landscape. This being the reason
for requiring the use of the easement. Further, the access to the columns is protected by a curb no
less than four inches high along the edge of the driveway as well as along the edge of the parking lot.
The illumination for thc driveway is required for the following reasons:
For locating the entrance to the property at night, especially when this property
is being approached from the west - meaning Franklin Road. Theoretically, there
is a twenty-five mile per hour speed limit on this road and there is a stop sign on
Avenham Avenue going east. There is nothing to interrupt the flow of traffic
coming from the east and the crest of the hill makes it impossible to see an
oncoming car prior to executing a left turn into the property. Without the lighted
columns, the exact location of the driveway sometimes requires additional
entrance correction since the location of the driveway is hard to recognize.

In addition to the convenience factor the illumination would definitely assist in
removing a potential safety hoTard.
The Aston Homeowner's Association and all its members would greatly appreciate the authorization

2. The City Manager and City Clerk are authorized to
execute and attest respectively on behalf of the City, the City's
quitclaim deed of conveyance subject to reservation by the City
of Roanoke of easements for any sewer lines and water mains and
other public utilities that may now be located on or across such
property and any and all recorded restrictions, conditions, or
easements affecting the title of said property, and thereafter

on Monday, March 4, 1991, Council Member Fitzpatrick referred to
an article which appeared in the Sunday, March 13, 1991, edition
of the Roanoke Times & World-News with regard to carnage that
continues in northwest Roanoke, specifically Lansdowne Park, Hurt
Park, Lincoln Terrace and other areas of northwest Roanoke.
On motion, duly seconded and unanimously adopted, you were
requested to submit a report to Council providing more detailed
information as to what is happening in the area, along with an
indication as to the feasibility of establishing a police pre-
cinct in what is considered to be the highest crime area of
the City, and whether or not such action would have an impact on
existing problems.

~R. FITZPATRICK: I trust that most members of Council took the time
yesterday to read the article in the Roanoke Times & World-News
talking about carnage that continues in northwest Roanoke. I per-
sonally was appalled by those statistics and I don't think any of us
can stand to sit back and let that continue. I really don't know what
the solutions are, that's not something that comes lightly, but I
think that had I had the opportunity to be living in Lansdowne Park,
Hurt Park or Lincoln Terrace or some parts of northwest where we've
seen these difficulties, that I would think that we ought to be doing
everything possible in the power of this government to take care of
those folks. I'd like to have a report from the City Manager giving
us some more details on exactly what's happened over there, and the
paper pointed out the timeframe of the last 12 months and the folks
who had been murdered, it certainly put into perspective for me
something that this City not only is dealing with right now, but will
probably be dealing with in more numbers in the future. I think we
need to do our very best to address, the one thing that I'd like
included in the report is an indication to Members of Council of the
opportunity and possibility of locating a precinct in the highest
crime area of the City, and whether or not that would have an impact
on what we're seeing and reading about on a daily basis in some cases.
And I ask that Council concur in having us get more detailed infor-
mation so that we might understand the situation to see if there is
anything further we might be able to do to be of help.
