Harvey, II William White, Sr. Dear Mrs. Bowles & Gentlemen: As your liaison to the Roanoke Redevelopment and Housing Authority, I have been asked by the Board of Commissioners to request the City's installation of a blink- ing walk/don't walk light or other safety device to be in- stalled on Salem Turnpike between the Landsdowne Housing neighborhood and the Melrose branch of the Roanoke Public Library. The Authority has an open field beside the library, which is across the street from the residential neighborhood. Obviously, children are inclined to cross that very busy street to visit the library or to play in the area which is soon to become a RRHA park. The Board of Commissioners has requested that this matter be referred by Council to the administration for an immediate response. Certainly, if we can find millions of dollars to improve the streetscape in other parts of the City, we should surely be able to find some funding for the installation of a safety device to protect children in the Landsdowne neighborhood. Although, I will not be in attendance at the reg- ular meeting of the City Council on Monday, July 22, 1991, I would respectfully request that this matter be placed on the consent agenda and thereafter referred to the City Manager for his report, recommendation and response back to Council by September 12, 1991. Schlanger, Director of Finance Voluntary Retirement Incentive Program - Results On April 15, 1991 city Council passed an ordinance authorizing a Voluntary Retirement Incentive Program. Implementation of the program established by this ordinance would facilitate the City's down-sizing effort, encourage possible reorganization and reduce future operating costs. Implementation of the program began when the "window of opportunity" was opened on April 22, 1991 and closed at the end of business on June 21, 1991. Since the program has now concluded, it was felt Council would be desirous of certain information. 7--5 of the 124 eligible employees took advantage of the program · Of the 75, 14 were females and 61 were male · Ages: 49 - 50 4 51 - 55 17 56 - 60 23 61 - 65 27 66 - 71 --4 75 Honorable Mayor and Members of City Council July 22, 1991 Page 2 Twenty-five departments had at least one person retire with 21 individuals retiring from the Fire Department. Years of Service: 10 - 15 4 16 - 20 6 21 25 6 26 30 22 31 - 35 21 36 - 40 12 41 - 48 4 45 employees retired under the "New System" (ESRS) and 30 retired from the "Old System" (ERS) 13 of the 75 employees were in what are considered management positions. A further report on cost-savings will come to you at a later date when the final disposition of all the 75 positions are dealt with. The Board received 153 appeals; there were 29 commercial and industrial appeals considered, and 117 residential appeals considered. Seven appeals were withdrawn. The members of the Board advised me that they had been very active, and had considered some unusual and complex matters. The members of the Board unanimously requested and recommended that the Board's necessary access to computer service continue. The Equalization Board must have computer access to adequately deal with its duties. The Board reported that future Equalization Boards must continue to have separate office space from the Real Estate Evaluation Office. The Board of Equalization has respectfully requested that the City of Roanoke provide the Board with a room assignment by March 1 of each year, so that the Board can begin its work as soon as the oaths of the respective members are taken. The Board advised the undersigned that the location to which it was assigned this year worked quite well. This year the Board conducted its business in room number 162. Room number 162 is accessible and convenient to the public; it affords convenient access to Roanoke City personnel, and is well suited to the needs of the Board. The Board has requested that the Equalization Board appointed next year be assigned to the same room for its work. I met with the members of the Equalization Board on July 1 at 8:30 a.m. and generally discussed its activities. All of the members of the Board exhibited positive attitudes toward their work, and the working relationship between the Equalization Board and the Roanoke City Administration. If you are aware of any problems, or if you wish to offer any suggestions for the improvement of the appointment process for the Equalization Board, please advise us. I am providing copies of this letter to those persons indicated below. You will recall that by Order entered in this Court on December 21, 1990, pursuant to Virginia Code Section 58.1-3384, the Board of Equalization of the City of Roanoke was and is required to keep minutes of its meetings and to enter in the minutes all orders it makes. BACKGROUND Ao Preventive health care services are limited to many school-aged children in Roanoke City due to their families' inability to pay the costs of medical care. Approximately 40% of the Roanoke City School population is considered economically disadvantaged. Roanoke City Health Department's Six Year Plan noted that the Roanoke City Health Department and Roanoke City Public Schools should increase their collaborative efforts to implement school health programs in a more efficient and effective manner. Co Need for a school health coordinator was identified in November 1988 by the Roanoke City School Health Advisory Committee which is composed of Citizens, City Health Department and Roanoke City School Representatives. Coordinated school health program to meet the health needs of children and youth enrolled in Roanoke City Public Schools has been implemented by the City Health Department, Roanoke City Schools and the Office of the Director of Human Resources in response to the Six Year Plan and recommendations from the School Health Advisory Committee. City Council appropriated $22,017 from State and Local Hospitalization and City Health Department Subsidies last year for the school health nurse supervisor position. II. CURRENT SITUATION City's school health program is comprehensive and includes basic preventative health care services, abnormal finding follow-up, counseling and referral services. Bo Part-time school health nurse supervisor was hired by the Health Department in December 1989 to provide program coordination and supervision for the 5 part-time Chapter I nurses employed by Roanoke City Schools and the public health nurses assigned to schools. Co School health nurses provide valuable services including case management, vision, hearing, dental, and scoliosis screening, and immunization and record maintenance for Roanoke City Public School children. (They provide a link between the schools and parents in communicating medical concerns affecting the well-being of our City's children and youth.) The nurses accept referrals from school personnel regarding necessary medical opinions. D. Health Department requested $25,545 to continue the program for 1991-92. Funding for the position of school health nurse supervisor was not included in the 1991-92 budget but the position has been continued with funds from the Health Department Budget for other programs on a month to month part-time basis pending identification of funds to support it. III. ISSUES $22~223 is now available in the State and Local Hospitalization {SLH) account to help continue funding the school health program for 1991-92: During budget preparation, the State informed the City $111,442 in local funds would be required for the State and Local Hospitalization {SLH) Program. {See Attachment I) 2. The City was notified on July 8, 1991, that only $89,219 would be required for the program. {See Attachment II) A. Services to citizens. B. Funding. C. Timing. IV. ALTERNATIVES Ao Transfer ~22~223 to the Roanoke City Health Department to establish a separate line item account #001-054-5110-2017 for the purpose of continuing the part-time position of school health nurse supervisor. Services to citizens. Continued funding of the school health program would enhance the opportunities for the City school children and youth to receive necessary, preventative medical care through the schools. Coordination of the school health program would be enhanced. 2. Funding. Funds are available in the following account: 001-054-5330-2010 State & Local Hospitalization $22,223.00 3. Timing. School health nurse coordinator position will continue with no interruption in the delivery of service. B. Do not transfer $22,223.00 to account #001-054-5110-2017. Services to citizens. Discontinuation of the school health program coordination and supervision will have a negative impact on the quality of life of the City's children and youth. 2. Funding. Funding would not be an issue. 3. Timing. The position of School Health Supervisor may have to be terminated for the remainder of this fiscal year. V. By agreement of the localities in the Fifth Plannin~ District, the City of Roanoke acts as fiscal depository of all Consortium funds. Fifth Plannin~ District has been designated as a service delivery area, by the Governor of Virginia. II. CURRENT SITUATION Governor's Employment and Training Department requires that the attached Agreement be executed by tl~e Policy Board of the Fifth District Employment and Training Consortium, the Private Industry Council and the City, as the depository of the funds. A~reement, which has not changed from last year, primarily clarifies the roles, responsibilities, and liability of the Policy Board, the Private Industry Council, and the grant recipient (City of Roanoke). This contract shall consist of this signed agreement, the Title II-A signed agreement, dated, July 1, 1991, by and between the ~'.u and the SDA, and the ~ substate grantee project proposal (The Project), submitted by the SDA, dated April 12, 1991, and subsequent amenc~ts. 2. The grant period is July 1, 1991, through June 30, 1992. e This A~ is based upon and subject to the condition that funds for the Project will be granted or will continue to be granted by the DOL to the Co~,,~3nwealth of Virginia. Should funds not be forthcoming or at any time cease, then the Co,~nonwealth shall have no obligation to furnish funds on its own. Retain all records including financial, statistical reuorts and other documentation and correspondence pertinent to the Project for a period of three (3) years fro~ the end of this A~, or until any audit, monitoring report or litigation concerning the Project shall be concluded. Records of partici?ants and unsuccessful applicants shall be subject to each preservation. C. Maintain a financial management system which shall adequately provide records of all financial transactions under this contract. Such system shall provide generally accepted financial safeguards and ~ethods of adm/nistration to insure that expenditures were appropriate and establish auditable record trails. D. At the conclusion of the Project and/or earlier, if the parties shall so agree, a report of all activities undertaken under this contract shall be made by the SDA. Such reports shall adequately describe what progress was made toward -4- acom~lishing the stated goals of the Project, what goals were achieved, and by what method or means such work as performed. The (~'1~3 shall prepare an evaluation of the Project based upon the SDA's report and any other inquiry made and provide copies of the evaluation to the Secretary of Health and Human Resources, the Governor's Job Training Coordinating Council, the appropriate Private Industry Council(s) and the SDAo Audit The ~'lu, at its option, shall provide for an official audit satisfactory, to the Depazt,~nt of Labor. The audit of the SDA's Project records shall be at the conclusion of the Project or otherwise in accordance with the usual audit requirements of the dTPA, Title II programming. In this event, the SDA will ensure that Title III ~X4~A is included in the audits already requ/red of the SDA by Title II of the JTPA. From funds made available to the Governor of Virginia by the U.S. DeparL~nt of Labor pursuant to Sections 201 and 251 of the J'.'FA, funds shall be allotted to the said service delivery area in accordance with the provisions of Section 202 of the ~TPA and delivered to the Grant Recipient by the G~'i~ periodically and by such mode as is determined and selected by the ~'lu. 2. Funds allocated to the said service delivery area and delivered to the Grant Recipient shall be expended by the Second Parties to ir~ple~_nt and carry out the said Job Training Plan in accordance with the terms thereof as now approved or as the same ~ay hereafter be ~odified and approved in accordance with the terms of the O'i'FA for the program year cvL,~=-ncing on July 1, 1991, and ending on June 30, 1992. 3. The t~'lo shall exert its best efforts to provide the Second Parties with timely advice of changes in funding levels produced at the federal level or required by circumstances affecting with/n State allocations pursuant to Section 202 of the JTPA. 4. The Fifth District Employment and Training Consortium, (Administrative Entity) and the City of Roanoke, (Grant Recipient), agree, respectively as second parties, to receive, administer, disburse and account for the said funds and such property as ~ay be accoutred therewith or otherwise be placed under their control pursuant to the terms of the JTPA or direction of the U.S. Deparb',~nt of Labor. --2-- The Fifth District Employment and Training Consortium in conjunction with the Private Industry Council and the Grant Recipient agree to i~ple~ent and carry out the said approved Job Training Plan and to perform the related duties imposed upon them by the JTPA, in accor- dance therewith and the regulations of the U.S. Depazt,~nt of Labor and the GETD, as the same may presently exist or hereafter be enlarged or abridged during the period of this Agreement. 5. In pursuance of an agreement between the U.S. Secretary of Labor and the Governor of Virginia, the ~'.u reserves the right to interpret the requirements of the JTPA and all implementing regula- tions, consistent with the terms thereof, which by this Agreement are applicable to the Contractor. Such interpretations shall be speci- fically identified as "JTPA Interpretations or policies" and shall be issued in accordance with the internal policy of the ~'~'u. The Second Parties shall apply end abide by interpretations heretofore issued as well as all such interpretations issued during the term of this Agreement. The ~'~u shall review these or any subsequent o'~'~A Interpretation upon its own motion or the of the Second request Parties and the Second Parties shall have such further recourse if they be aggrieved thereby to review under the grievance procedure mandated by the JTPA . 6. The ~'~u recognizes the right of the Second Parties to this A~reement to make provision among or between themselves for division of duties and tasks requisite for the proper performance and adminis- tration of this Agreement subject to the provisions of the JTPA and i~Dle~enting regulations and the terms of that agreement specified in Section 103 (b) (1) of the ~','FA. The Second Parties agree that they --3-- shall not, by act of commission or cwaission, do or fail to do any act in relation to each other which would hinder, frustrate or delay the performance of this Agreement or any act or duty required hereby. Should the agreement required by Section 103(b) (1) of the ~'~A, or any subsidiary agreement made among or between the Second Parties be terminated, or there be a claim made of default thereon by any Second Party, then the C~airman of the Policy Board, or his designee, shall give written pl~,~Jt notice of the particulars to the Executive Director of the ~'l'u. In such event, the ~-1~3 shall have the right to withhold further funding under this Agreement or terminate this Agreement as to any Second Party upon such notice as may be reasonable under the circumstances, not in lieu of but in addition to any other remedy available under law if such action be deemed reasonably neces- sary by the G~u to carry out its duty under the o'l'~A and the laws of the C~,,~)nwealth of Virginia. 7. The performance of the Second Parties hereunder shall, for the purpose of Section 106 of the JTPA, be gauged by those performance standards, established by the Secretary of Labor pursuant to Section 106 of the JTPA as the same may be varied by the Governor, for the period of this Agreement. 8. This Agreement shall not be assignable, in whole or part, by any Second Party without the %rritten consent of the ~'lu; provided, hc~ever, that contractors may be engaged by the Second Parties to provide services or programs to eligible JTPA participants for which provision is made in the said Job Training Plan. In the exercise of the discretion afforded by this provision, the Second Parties shall -4- adhere to the standards set forth in Section 164 (e) (2) of the JTPA, and shall assure that all procurements c~,~ly with sound practices and elements of contracting. Whenever the ~rd "contractor" appears in the succeeding provisions of this Agreement, the same shall mean such contractors as are permitted by the terms of this paragraph 8. Any such contract shall be conditioned to secure the benefits of the succeeding provisions to the Second Parties and the Subcontracts must be subject to review and approval in writing by the Second Parties and shall be allowed in performance contracts for specialized client service, in a fee payment or cost-reimbursement basis. 9. The Second Parties shall give the ~IU timely notification of the possibility of disallowed costs incurred in their administra- tion of this Agreement or by their contractors and use pro,vt and efficient debt collection procedures to obtain cash repay~aent of disallowed costs. The Second Parties shall not forego debt collection procedures without the express written approval of the ~TU. In appropriate cases, the t~'l'u shall petition the Secretary of Labor to: First: Forgive those costs, if possible; if not to: Second: Accept repayment of those costs in other than cash reimburse- ment. Nothing in this provision, however, shall be construed to limit or preclude the pursuit of remedies, either legal or administrati-~e, by the ~'lu or the Second Parties. 10. Neither the Governor nor the C~,unwealth of Virginia assumes liability by virtue of this Agreement for any costs incurred above the amounts provided pursuant to this Agreement or for costs incurred by second parties or their contractors which are determined -5- to be unallowable. Any such costs shall be at the sole risk of the Second Parties or their contractors. The foregoing provisions of this paragraph are not intended to preclude, and shall not be deemed to preclude the Second Parties or their contractors from asserting any defense which may be asserted by them hereafter. 11. The Second Parties agree to give the G~-~'u prc~t notice in writing of any action or suit filed or any claim otherwise made against the Second Parties or their contractors of which they have been notified. 12. The ~'~u, the Secretary of Labor, the C~,%fcroller General of the United States, or any of its or their representatives shall have access to work and training sites and to any books, documents, papers, and records of the Second Parties and their contractors provided or made in the performance of this AxFree~t, for the purpose of moni- toring, making surveys, audits, examinations, excerpts and transcripts. 13. No waiver or modification of the terms of this Agreement, J_ncluding, without limitation, this provision, shall be valid unless in writing and duly executed by the party to be bound thereby. 14. In addition to termJ3~tion in accordance with the provisions of paragraph 6, hereof, as well as in addition to termination resulting f~,, the non-availability of funds as cont~,~lated by Paragraph 3, the right to terminate this Agreement in accordance with the applicable provisions of the Job Training Partnership Act is reserved. The ~'lu reserves the right to apply any lesser sanction not prescribed by law or seek any lawful re~dy available to it as it -6- may deem requisite to obtain proper performance under this Agreement, to carry out the requirements of the Act and federal and State regula- tions ~ade pursuant thereto, and to ~aintain the integrity of programs funded through this A~c~r~t. Unless an emergency_ exists, the ~'lu shall not act to i~pose a sanction except upon reasonable notice and after the Second Parties have opportunity for review in accordance with procedures mandated by JTPA. This Agreement shall terminate at the close of business on June 30, 1992, provided, however, that the same shall re, hain in effect thereafter until the close of business on September 30, 1992, for the purpose of the conduct of '"Sumner Youth" programs pursuant to Title II-B of the JTPA for which provision is made in the above Job Tra/ning Plan, or for which provision is hereafter made in the next succeeding approved Job Training Plan, as the case may be. Background: Bids were received on May 31, 1991, for recycling carts and bins to be used in the ongoing recycling program. June 24t 1991 - a bid committee report was presented to City Council with recommendations for the award. Resolution No. 30598-6249] was adopted by Council awarding 4,500 thirty-two gallon recycling carts to Zarn, Inc., and 3,000 recycling bins to Piper Casepro. II. Current Situation: As provided in the Resolution, requisition purchase orders were issued to the respective vendors to purchase aforementioned items. Bo Specifications for the recycling bins specifically stated that each bin would be appropriately stamped with a serial number. Stamped serial numbers are necessary to maintain proper control and accountability of recycling bins. For the purpose of this chapter certain terms and words used herein shall be defined as follows: Animal shelter: A use in which the principal activ- ity is the temporary housing of domestic animals which are stray, abandoned, abused, neglected or placed there for adoption or disposal of in a manner regulated by the Virginia Comprehensive Animal Laws. §36.1-271. Petition to amend the ordinance was filed by the Roanoke Valley SPCA, Inc. on May 25, 1991. The following amendment was proposed by the petitioner: Section 36.1-25, by creating the following term to read as follows: Animal Shelter: A use in which the principal activity is the temporary housing of domestic animals which are stray, abandoned, abused, neglected or placed there for adoption or disposal of in a manner regulated by the Virginia Comprehensive Animal Laws. Mr. Mark St. Clair, a local veterinarian and member of the Board of Directors of the SPCA, appeared before the Commission. Mr. St. Clair informed the Commission that Mr. Tom Wright was no longer with the SPCA. He further stated that the SPCA intended to add a small addition to their existing building to accommodate the increased number of animals picked up in their service areas but found out in the present zoning district, they were not permitted to expand. He then informed the Commission that they were also made aware that the animal shelter was not a use defined in the zoning ordinance. Mr. St. Clair stated that the proposed amendment is to set forth a definition of their activity on the property and to provide for their use as a special exception in the HM zoning district. No one appeared before the Commission to speak in opposition to the proposed amendment. Mr. John Bradshaw, Chairman of the Planning Commission Ordinance and Names Subcommittee, informed the Commission that in the interest of time and responding to the urgent needs of the SPCA, the Subcommittee recommends approval of the proposed amendment as presented. III. Alternatives: City Council approve the proposed ordinance amendment. SPCA would be permitted to expand its building to meet its current service demands for temporary housing of domestic animals picked up by local animal control agencies. SPCA operations and activities conducted on the site would be a recognized and defined use in City zoning ordinance. B. City Council deny the proposed ordinance amendment. SPCA will not be permitted to expand its building to accommodate the additional service demands of the Roanoke Valley; alternative sites and facilities would have to be pursued. Roanoke City Council Page 3 SPCA would continue to be a legal nonconforming use at its current location and its operations and activities would continue to be an undefined use in accordance with the City zoning ordinance. IV. Recommendation: The Planning Commission, by a vote of 6-0 (Mr. Sowers absent), recommended that City Council approve the proposed amendment to the City's zoning ordinance. The proposed amendment would legally recognize an activity that serves the public interest and would permit that operation to expand to accommodate the service demands in the Roanoke Valley. I. Background: Marshall Avenue, is requested for closure from Franklin Road, S.W. to 4th Street, S.W. First Baptist Church owns all of the land and properties abutting both sides of this section of Marshall Avenue. Section of Marshall Avenue extending from Franklin Road, S.W. to 5th Street, S.W., has served as a westbound, one-way street for many years. Master Plan for First Baptist Church was reviewed by city staff in 1986. At that time, church representatives investigated the possibility of closing Marshall Avenue from Franklin Road to Fourth Street, S.W. Based on the preliminary information available, city staff advised the church that it appeared closing the street may be feasible due to the fact that the stzeet was utilized by 1,000 or less vehicles per day, and the existing street intersection at Franklin Road was too close to the Third Street signalized intersection. First Baptist Church did not file an application for street closure at that time. Application for closure was received on May 14, 1991. Plannin~ Commission reviewed the subject request at its regular meeting of June 5, 1991. Opposition to the requested closure was expressed by Ms. Petie Brigham on behalf of the Board of Directors of Old Southwest, Inc. Ms. Brigham's comments related to the observation that the subject closure would not provide any public benefit. The only gain, in her opinion, would be to First Baptist Church to increase the church's parking capacity. Ms. Brigham also expressed the concerns of Old Southwest Inc., that the subject closure would increase traffic on Day Avenue, a highly residential street with many resident children. Mr. Michael LeVan (310 Darwin Road, SW) commented that he was not opposed to the closure of Marshall Avenue but he was concerned about an adjacent alley that adjoined his property. City staff has reviewed the request and the Planning Commission concurs with staff determination that changes have occurred in downtown plans and related thoroughfare areas during the past four (4) years. Implementation of Focus '89, Viaduct closing and construction of the 2nd Street connection (scheduled for early 1992) with Orange Avenue, N.E., ('U.S. Route 460) as a segment of the new loop-road system, will funnel additional traffic into the Franklin Road area. Master Plan for Franklin Road/Elm Avenue has been developed and was endorsed by the Planning Commission in January 1991. Master plan encourages new development in the area including development serviced via Marshall Avenue. Franklin Road widening project will result in a solid median for Franklin Road in the vicinity of Marshall Avenue and Third Street, thereby creating an improved intersection with Marshall Avenue. Downtown Service District was recently expanded to include the north side of Marshall Avenue from Franklin road to Fifth Street. Property on the north side of Marshall in zoned C-3, Central Business District. Marshall Avenue currently serves as an access connector to Franklin Road Members of Council July 8, 1991 Page 3 and the downtown. It is the intent that maximum economic development opportunities for commercially zoned property be encouraged and sustained in this area. E. Marshall Avenue from Fourth Street to Fifth Street is currently one-way and would have to be modified to allow two-way traffic if the street section between Franklin Road and Fourth Street were closed. Existin~ street pattern is presently effective in providing convenient access to properties on Marshall Avenue and in providing an alternative traffic route for east-west vehicles exiting the downtown CBD. Closure of street connection to Franklin Road would decrease future development potential of the area between Fourth Street and Fifth Street. III. Issues: A. Public interest. B. Franklin Road Master Plan. C. Economic Development opportunities. D. Effect on First Baptist Church. E. Land use. IV. Alternatives: City Council deny the application from First Baptist Church to close and vacate the subject section of Marshall Avenue, S.W. Public interest. Traffic patterns will be altered in the downtown and related thoroughfare areas by the new loop-road connection with Orange Avenue/U.S. Route 460. Franklin Road will be impacted with additional traffic. Major north-south traffic flow from U.S. 460 (Orange Avenue) into the downtown area is currently via Williamson Road to Elm Avenue and Jefferson Street. New road to be constructed beginning in 1992 connecting U.S. 460 (Orange Avenue) to Second Street, S.W. in the downtown area will provide an accelerated mode of access from U.S. 460/Orange Avenue, N.E. to Franklin Road, S.W. The Virginia Department of Transportation (VDOT) studies related to the design and construction projects for the new 2nd Street connection to Orange Avenue/U.S. 460 E., and the widening of Franklin Road, projects an increase in average daily traffic volumes (ADT) as follows: Members of Council July 8, 1991 Page 4 2nd Street~ S.W. Current (1988-89) ADT Volumes on 2nd Street, S.W., at Salem Avenue, S.W. 4,500 Pro~ected (design year 2010) ADT Volumes on 2nd Street, S.W., at Salem Avenue, S.W. 20,700 Increase in ADTs 16,200 Franklin Road, S.W. Current 1988-89 ADT Volumes on Franklin Road, S.W., between 3rd Street, S.W. and Elm Avenue, $.W. 9,500 VPD Projected (design year 2010) ADT Volumes on Franklin Road, S.W., between 3rd Street, S.W. and Elm Avenue, S.W. 14,000 VPD Increase in ADTs 4,500 The above projects are based on various types of data. The final and actual average daily traffic volumes may be higher or lower. Good planning practices should anticipate and provide for the maximum probabilities. Intersectional outlets (public streets) to provide for the needs of east and westbound traffic from this section of the Franklin Road corridor could play an important role in minimizing the impact of any increased traffic load along the new Franklin Road thoroughfare. Franklin Road Master Plan would be followed. Future development opportunities would be enhanced. Maximum economic development opportunities for con~uercially zoned land would be encouraged. Maintenance of street grid pattern would promote convenient access and improve development options. Properties located on the south side of Marshall Avenue are currently zoned commercial, C-1 (Office district) and properties located on the north side of Marshall Avenue are currently zoned commercial C-3 (Central Business District). Proximity and access for these commercially zoned properties to the new Franklin Road thoroughfare will significantly Members of Council July 8, 1991 Page 5 increase the potential for new cormmercial development of properties fronting on Marshall Avenue between 4th and 5th Streets. Effect on First Baptist Church. Church plans rely to some extent on the closure of this section of Marshall Avenue. The plan requires additional parking areas and expresses concern for church-related pedestrian safety. (Franklin Road/Elm Avenue corridor master plan ultimately recommends the construction of an additional parking structure accessed from Marshall Avenue.) Denial of the request will result in an inconvenience to First Baptist Church by denying the church the use of the land within the public right-of-way. Land use. Properties on Marshall Avenue would retain street frontage on Marshall Avenue and access to Franklin Road. Public street frontage and proper access to a major thoroughfare will have a positive effect on the future development and land use potential for the abutting properties. City Council approve the application to close and vacate the subject section of Marshall Avenue, $.W. Public interest. A clear assessment of the overall effect of pending street and right-of-way changes that are to occur in this area in the near future, cannot be made at this time. Closure of this section of Marshall Avenue, S.W., at this time could result in a future inconvenience to the public. Franklin Road Master Plan could be implemented; however, development opportunities in the northwest quadrant of Franklin Road would be reduced. Future land use would most likely be limited to surface parking. Economic development opportunities for the con~nercially zoned area between Fourth Street and Fifth Street would be greatly reduced due to the loss of direct access from the CBD. Downtown Service District revenues could be less due to the effect on development potential. Street grid system altered. Closure could result in disinvestment in properties between Fourth and Fifth Street. 4. Effect on First Baptist Church. Closure would be consistent with church plans. Members of Council July 8, 1991 Page 6 Land use: Se Closure would leave approximately 28 separate parcels of land owned by First Baptist Church landlocked without required street frontage. City has existing water, sewer, and storm drain lines within the right-of-way. Appalachian Power Company has facilities within the public right-of-way. de Roanoke Gas Company has a gas line within the public right-of-way. Closure, if effected, should be made subject to the following conditions: ae That the applicant agrees to prepare and submit to the City for review and approval, a proper subdivision plat, combining thereon all properties that would otherwise be landlocked by street closure. Plat should provide for all necessary easements for utilities, both public and private. That if the above-cited plat is not submitted, approved by the City and recorded in the Office of the Clerk of Circuit Court, within a period of one year from the date of any ordinance effecting such closure, said ordinance will become null and void with no further action by City Council being necessary. V. Recommendation: Planning Commission defeated a motion to approve the request by a vote of 4-2 (Messrs. Bradshaw and Claytor voting for the motion; Messrs. Buford, Price, Ferguson and Jones voting against the motion; and Mr. Sowers absent); thereby recommending that City Council aDDrove Alternative "__A" denying the applicant's request to close the subject section of Marshall Avenue, S.W. Recommendation is based on the following conclusions: ae Pending street changes will result in an increase in traffic on this section of Franklin Road. Closure would decrease development potential of commercial (C-3) and office district (C-l) properties situated on Marshall Avenue between 4th and 5th Streets. Members of Council July 8, 1991 Page 7 Public streets should be closed only when it can be accurately verified that the public at-large has no current or future need for such a public street. Ownership of properties abutting such a public street should not be a consideration for closure. Current traffic data for traffic origin and dispersal to and from Marshall Avenue was not available to the Commission at the public hearing. Percentage of Marshall Avenue traffic that was church-related could not be verified. It would be in the best interest of the public, both from an economic and traffic management standpoint, to retain this section of Marshall Avenue, S.W., as a public street connector from Franklin Road, $.W., until current and pending changes in the downtown thoroughfare areas have been completed and the proper needs of the public have been accurately established. A copy of the resolution is attached. 3) The new sanctuary of the Church presently under construction will displace most of the available parking area on Church property immediately to the wast of the main facilities. The Church has for years relied upon this space, together With its property on the south side of Marshall Avenue S.W. from Franklin Road S.W. to the vicinity of 4th Street S.W., to provide parking for members of the Church in attending worship services and other activities in the Church and in the Family Life Center, and for patrons of its Day Care Center operated in the north wing of the Church on Luck Avenue. As the Church is a "downtown# Church, with members and visitors attending from throughout the Roanoke Valley, and beyond, adequate parking is crucial. The portion of Marshall Avenue S.W. covered by this Application will be used in part to replace the lost parking area and to provide adequate access to the main entr~:e of the new sanctuary. 2 4) The Trustees have been advised that the planned Franklin Road S.W. widening and improvement project includes a median strip prohibiting traffic north bound on Franklin Road S.W. from turning left onto Marshall Avenue S.W., but, unless Marshall Avenue S.W. is closed pursuant to this Application, the plans will allow traffic south bound on Franklin Road S.W. to turn right onto Marshall. If Marshall Avenue is not closed at its intersection with Franklin Road S.W., the increased traffic that 'i~variably follows street wideningand improvement projects will present an even greater potential danger to pedestrian traffic crossing from the parking area on the south side of Marshall Avenue, particularly to children attending ~e Day Care Center. 5) The Trustees do not anticipate that property owners of Marshall Avenue west of 4tA~ Street S.W., or the general public, will be inconvenienced or otherwise adversely affected by the closing. The unclosed portion of Marshall Avenue between 4th Street and 5th Street S.W. will remain accessible to vehicular traffic from the mast (downtown) by way of Luck Avenue S.W. and 5th Street S.W. and Elm Avenue S.w. and 4th Street S.W. O1~ South~st, Inc., is not without appreciation for this project, either, illustrating First Baptist's obvious committment to the City of Roanoke· Many of our churches threaten to move to the suburbs if they are not allowed to demolish buildings and pave green spaces for the sake of parking. First Baptist is obviously here to stay. We fail to see, however, any PUBLIC benefit in the closing of Marshall Avenue. The only gain would be to First Baptist for their own ~ . .. p NG: Millions are to be spent in the Franklin-Elm widening project to improve traffic flow to and from downtown through Old Southwest. It makes absolute%y no sense to cut off one of the existing avenues of traffic flow. Closing Marshall will throw additional traffic onto Day Avenue, which is highly residential with many young children, unlike Marshall at that end, which is little more now than parking lots owned by First Baptist. Much of the new Day Avenue traffic will come, in fact, from First Baptist, who demolished two homes on Day Avenue in December 1990, for the purpose of ingress and egress for their Marshall Avenue parking lots, with th? Marshall closing in mind. Before you make a decision on First Baptist's request, I recommend that each of you, as well as First Baptist's ~lanners,.read a new book which is available at Books, Strings & Things. A~ERICA'S DOWNTOWNS, just published by the National Trust for Historic Preservation, assesses the effectiveness of courses of action in 10 inner cities: Atlanta, Boston, Cincinnati, Denver, Jersey City, Philadelphia, Roanoke, St. Paul, San Francisco and Seattle. Unfortunately, if each business and church in downtown Roanoke and Old Southwest were given free rein to do whatever they desired about parking for their employees, customers or members, each would tear down the other, as well as eventually pave every park and greenspace, for their own private surface parking lots. . . W~ have ~ade too muc~ progress in Roanoke - and are acnlevlng national recognition for it - to allow our businesses and churches to be myopic about parking. They must look at the bigger picture - the longterm good of the community at large. WHEREAS, by Ordinance No. 16941, adopted April 4, 1966, City Council dedicated 25.68 acres of City owned property known as Strauss Park to public park and recreational use; WHEREAS, the westerly half of Strauss Park consisting of 14.773 acres of steeply sloping land has not been used for public park or recreational purposes, and it is not anticipated that such property will be needed in the future for such'uses; WHEREAS, City Council has previously approved an alignment for the Peters Creek Road Extension Project, such alignment being more particularly described in the attachment to the City Manager's report dated July 8, 1991, and such alignment would cause the pro- posed highway to pass through the 14.773 acres of Strauss Park described in the preceding paragraph; and WHEREAS, it is the intent of City Council to permit use of a portion of the westerly 14.773 acres for public highway construc- tion purposes which use advances the public health, welfare, safety and convenience to a greater degree than continued use of such property for public park and recreational uses; THEREFORE, BE IT ORDAINED by the Council of the City of Roanoke as follows: 1. With respect to the 3.8 acres of Strauss Park included within the westerly 14.773 acres, which 3.8 acres are needed for construction of the Peters Creek Road Extension Project, and which 3.8 acres are more particularly described in the City Manager's report, dated July 8, 1991, Council declares that such real pro- perty is not necessary or desirable for public park or recreation- al use and that it is in the public interest that such property should be used for highway construction purposes. Council, there- fore, releases the dedication of such property to public park and recreational uses imposed by Ordinance No. 16941, adopted April 4, 1966, declares such property surplus to the City's needs for public park or recreational purposes and concurs in and authorizes the use of such 3.8 acres of real property for highway construc- tion purposes. 2. BackMround: City Council, by Ordinance No. 16941 dated April 4, 1966, designated the name Strauss Park and dedicated it for public park and recreational use. Peters Creek Road Extension was programmed by the Virginia Department of Transportation (VDOT) in its Six-Year Improvement Program in accor- dance with City Council's request on June 17, 1985 (Resolution No. 27613). Ce City Council, at its meeting on March 5, 1990, approved an alignment for Peters Creek Road Extension which included the need for this road- way to pass through Strauss Park. (See Attachment A.) II. Current Situation: At Strauss Park is one of 56 parks in the City of Roanoke. Its 25.871 acres was acquired by the City in 1966 and lies on the westerly side of Westside Boulevard, just north of Shenandoah Avenue, N.W. (See Attachment B.) Peters Creek splits the park land into two tracts. Eastern half of Strauss Park contains 11.098 acres and includes the park's recreational facilities. This portion was purchased by the City from Wilmont Realty Corporation. This section was developed with HUD Open Space Grant Funds. Western half of Strauss Park contains 14.773 acres of steeply sloping terrain which has not been used, nor is it any longer needed for uae, as a public park. This portion was a gift to the City of Roanoke from Wilmont Realty Corporation for use as public park and public recreation area. Mr. Maury Strauss, former president of Wilmont Realty Corporation, has agreed in writing to release this property from the restriction that it be used as a public park and public recreation area to the extent necessary for highway right-of-way for construction of this project, in a release dated May 31, 1991. No federal or state funds had been utilized in the original acquisition or development of this portion of Strauss Park. Page 2 VDOT's Environmental Quality Division has requested, for the purposes of completing the Final Environmental Assessment, that City Council to the extent possible provide a resolution to convert the park land required for construction from public park and recreational use to highway right-of-way, based upon the alignment through the park which has been previously recommended. The estimated amount of park land to be converted to highway right-of-way is 3.8 acres for permanent right- of-way. An additional 3.0 acres will be needed for a temporary construction easement, which will revert to park property upon project completion. A 3.4 acre area of parkland will be separated from existing park facilities (area between Spanish Trace Apartments and proposed roadway), leaving 15.6 acres remaining to the east. III. Issues in order of importance: A. Park impact B. Highway requirements C. Time schedule D. Acquisition IV. Alternatives in order of recommendation: Ae City Council formally determine that the property in Strauss Park required for construction and highway right-of-way is no longer necessary for public park purposes. Park impact would require that the City pursue, through VDOT, miti- gation measures as part of the highway project to lessen the impact from sights and sounds created by the highway. Safety of park users will need to be considered and addressed. Topography of this area is very steep and unusable for recreational purposes in Strauss Park. No park area funded by federal funds is affected. 2. Highway requirements would be met. The use of the property would be consistent with highway needs. 3. Time schedule would not be delayed. Acquisition of park land by VDOT would be handled by quitclaim deed from the City in a mutually agreeable manner at such time as the transaction is necessary. Lease of farm land portion of property terminated on July 13, 1990 at Mr. Douthat's request. Lease of House and Cabin extended on a month- to-month basis at the time by Ordinance No. 30204-82790. Purchase Order No. 97350, dated November 21, 1990, employed the ser- vices of Eagle Valley Ranch, c/o Paul Umbarger, to provide labor and materials to curtail vegetation growth to 12 inches for the period November 15, 1990 thru June 30, 1991, with the stipulations that ven- dor will be permitted to graze livestock, mow hay or till crops on the property and will provide and maintain fencing to secure livestock and assume all liability for damage to and by his actions or actions of his livestock, machinery, equipment, employees and guests. P.O. may be cancelled upon 30 days notice. Eagle Valley Ranch agreed that when the term of Purchase Order No. 97350 expired they would accept a month-to-month lease similar to that given to Mr. Douthat. This involves installing, maintaining, moving, and removing fencing subject to lease termination or leased area revi- sion on a 30 day notice basis. II. Current Situation: A. I understand the big difference is Mr. Douthat had to maintain the fencing during the lease term but retained the right to remove the fencing under the original purchase agreement while you would need to restore secure stock fencing and maintain it subject to lease termination/area revision on a 30-day notice basis.
