Dear Mrs. Bowles and Gentlemen:
Just in case you didn't see the enclosed article in
the Virginia Municipal League newsletter, I thought I might
present it to you and ask that it be made a part of the
record of the consent agenda at the next regular meeting of
Roanoke City Council.
I would be in favor of the voters of the City of
Roanoke leading an initiative throughout the Commonwealth of
Virginia that would restrict our General Assembly from
imposing any mandate on local government unless, as was done
in Louisiana, one of the following has occurred:
1. the local government has agreed to abide with the
mandate, or
2. the state has agreed to provide funds to pay for
the mandate, or
3. the state has given the local government authority
to raise revenues to cover the cost of the mandate, or
4. the legislature has voted to impose the mandate by
two-thirds majority of both houses.
As you can see from the article, the amendment in
Louisiana, however, does not apply to local school systems,
to existing mandates, to laws requested by individual
political subdivisions, to benefits for police officers and
firefighters, or to new laws regarding crimes, or laws in
compliance with federal standards.
This is a remarkable achievement in redefining the
balance of power between state and local governments, and
Virginia should fall into step. For the last seven years
I've heard Council members complain about the mandates that
are handed down from Richmond, without any source of revenues
to finance them. I believe it's time for the voters of the

City of Roanoke to stand up and let our legislators know that
this continued practice of "moneyless mandating" is no longer
acceptable.

I am very pleased to present to you a copy of the audited
Financial Report for the City of Roanoke Pension Plan for the year
ended June 30, 1991.
The financial strength of this system is attributed to City
Council as you have so wisely chosen to fund the system fully as
the Actuary recommends each and every year and not chosen the easy
way out to solve other problems by underfunding the System, as so
many states and cities across the country have chosen to do. You
are to be highly commended for the devotion you place in our
System.
This report is extremely informative and contains valuable
information about your System. I am grateful to my retirement
staff and to the very dedicated Board of Trustees that you chose to
appoint.

to work with the City Planning Department in an effort to address all concerns raised
by residents of the area.

study time limitation has not expired, the petitioners have a concern which they
would like to bring to the attention of Council.
Mr. Bradley T. Sneed, Co-petitioner, 3535 Wright Road, S. W., advised that
the Wright/Creston/Rosewood Association has worked with the City since October,
1988, in an effort to resolve the treffie situation. He stated that on November 25,
1991, he received a communication f~om City Planning staff suggesting that a
community advisory committee meeting be held, during which meeting, he discovered
that members of the advisory committee were selected at random by the Planning
Department. He further stated that it is felt that the advisory committee does not
reflect a true representation of the sentiments of the neighborhood because one of
the co-petitioners and co-president of the neighborhood association, Dennis R.
Gatens, was not invited to participate in the advisory committee meeting, therefore,
this action does not respond to Council's instructions in August that residents be
kept fully informed as progress of the City's study proceeds.
Mr. Sneed referred to a meeting which was held earlier in the evening in which
the Advisory Committee was given basically two alternatives by City Planning staff
to study; viz: "Alternative No. 1 - Close Creston Avenue, S. W., on May 1, 1992,
for a temporary period of six months". He pointed out that if such action is not
taken until May 1992, the process will have taken over four years, which is too long
to study one specific neighborhood. He pointed out that the closure point indicated
by City Planning staff on a map attached to a document under date of December 10,
1991, is at the intersection of Creston Avenue and Strother Road, S. W., advising
that it is interesting to note that of the approximately 3,000 cars per day traveling
through the neighborhood, Strother Road carries about ten per cent or 300 ears.
He stated that "Alternative No. 2, as follows, could be a workable solution: "Remove
double solid lines and replace with white lines at the outer edges of road pavement,
install additional stop signs at appropriate intersections, and score or roughen
pavement on the steep section of Rosewood Avenue and Strother Road." He added
that removing the double solid lines and replacing them white lines at the outer
edges of road pavement are good points, however, inasmuch as there are no
sidewalks, crosswalks would be of no use. He further added that controlled
entrances at Spring Street, scoring pavement on the steep section of Rosewood
Avenue and Strother Road, and installing new stop signs are all good points;
however, the one thing that has not been addressed, which is one of the major
concerns of residents, particularly on Wright Road, is the excessive speed of traffic,
and none of. the alternatives proposed by City staff addresses speeding traffic. He
stated that under the contingency measures set forth by the City, temporary closure
of Creston Avenue at Rosewood Avenue would be done only if the other measures do
not work, a traffic choker at the intersection of Rosewood and Sweetbriar Avenues
if all other actions do not work, and traffic chokers along Wright Road at appropriate
locations if traffic does not slow down. He explained that stop signs and realigned
intersections may eliminate some of the traffic flow, however, the greatest fear of
residents at this ,,time is that while eliminating some of the traffic flow, nothing is
being done to control the speed of traffic. He stated that residents have problems
with what has been proposed by the City even though it is felt that the City may be
on the right track, however, it appears that a majority of residents are being
ignored in their request inasmuch as they are of the opinion that the streets should
be closed. He explained that it is felt that the proper alternatives are not being
explored by the Planning Department.
Mr. Bowman advised that their primary reason for appearing before Council
pertained to the Citizens Advisory Committee, the six person group previously
alluded to by Mr. Sneed, who were selected in an attempt to arrive at representation
of what the City Planning staff perceived as the various factions in the
neighborhood. He stated that the City Planning staff has requested the Advisory
Committee to take the alternatives abovedescribed by Mr. Sneed into the
neighborhood, door to door, and endeavor to sell the neighborhood on the
alternatives. He further stated that as this group of six people go through the
neighborhood, residents react because they are angry about the alternatives
inasmuch as there is a perception that the alternatives will not address the problem,
and residents become angry at the messenger because of the message they carry,
therefore, rather than working toward compromise, which will be necessary in order
to ultimately reach a solution, the City has, in fact, sent six persons into the
neighborhood and in effect sowed the seeds of strife. Therefore, he noted that the
area will end up with not only a traffic problem, but an interpersonal relationship
because neighbors will be angry with each other. He stated that the relief they seek
from Council is that City Planning staff be instructed to recommend an alternative
which they believe is the best supportable alternative in order to address the matter
of traffic and the problem of speeding for presentation to the neighborhoods at a
public hearing in accordance with normal procedures that comport with due process,
rather than having an ad hoc committee canvass the neighborhoods.
Mr. Sneed expressed concern over how the problem will be addressed before
a viable solution is found, advising that certain residents previously offered a
suggestion to City Planning staff which has not been included as one of their
alternatives; viz: temporarily close the entire street system for a period of six
months which will serve to break the habit of people using the neighborhood as a
short-cut, and provide the City with an opportunity to determine exactly where
displaced traffic will go, as well as installation of traffic monitors on Overland Road
to determine ff closure will create a tremendous problem on another City residential
street. He stated that temporary closure will give the City time to design and
implement the best possible solution for the neighborhood, advising that he could not
under~tand why it should take another six months to a year to reach the end result.
He pointed out that in the past two weeks, not counting the accidents that have gone
unreported to the Police Department, six accidents have occurred. He requested
that something be done at least temporarily to provide relief while residents continue
to work with the City to arrive at the right solution which will be fair to everyone
involved. ·
Mr. John R. Mariles, Chief of Community Planning, advised that from listening
to representatives of the neighborhood organization, there seems to be some
misunderstanding about the objectives of the staff appointed advisory committee.
He stated that the primary objective of the advisory committee is to provide City
staff with input or 'feedback regarding various options that are under consideration
and not just the three alternatives listed on the document referred to by Mr. Sneed.
Secondly, he stated that the advisory group has been requested to go into the
neighborhoods and discuss with residents some of the options that are under
consideration and provide City staff with feedback as a result of their dialogue. He
added that the City is not endorsing any one option or asking the advisory committee
to endorse any particular option. He advised that Mr. Sneed, one of the co-
petitioners, is a member of the Advisory Committee, and members were selected to
represent a cross section of different view points in the community. He pointed out
that at this point, it is anticipated that there will be at least one additional meeting
with the Advisory Committee after which City staff will hold a community-wide
meeting at one of the schools in the neighborhood before submitting a
recommendation to the City Planning Commission for formal public hearing, followed
by a recommendation to City Council at a formal public hearing.
Mr. Harvey advised that he did not want Council to be placed in the position
of being traffic engineers, however, he was of the opinion that Council should have
a report within a reasonable period of time with regard to recommendations of City
staff as to decreasing the speed of vehicles and/or installation of stop signs. He
stated that citizens of the area want the traffic slowed down and if there is anything
the City can do in the interim, measures should be implemented. He requested that
Council be furnished with a report within two weeks as to temporary measures
proposed by the City administration to alleviate problem.
Mr. Bowers spoke in support of the City administration reporting back to
Council with certain interim measures proposed to be taken by the next regular
meeting on Monday, December 16, 1991.
Mr. Sneed advised that the City has proposed an excellent method to slow
down the speed of vehicles thro~ugh implementation of something that has never been
done before known as a "speed controlled option" which is a raised piece of pavement
approximately four inches high, slanted approximately one car length long and one
car length wide so that vehicles coming in opposite directions will be forced to slow
down as they come through, one vehicle at a time.
The Mayor advised that the type of discussion presently taking place should
be held with City administrators and neighborhood representatives in order to
compile meaningful solutions and recommendations for action by Council. He stated
that the Council meeting is not the time that should be used to hammer out nuts and
bolts types of decisions; that he recognized that a problem exists, however, Council
could not solve the problem this evening and a good starting point would be to
involv~leaders of the community with City Planning staff to determine if there can
be a kind of agreement on a procedure in order to deal with the problem. He stated
that Council wishes to be fair with everyone involved and arrive at a kind of
compromise and a solution that would be somewhat tolerable and acceptable, while at
the same time addressing the problem. The Mayor suggested that Mr. Bowman and
community, leaders meet with City Planning staff to address all concerns, and
requested that the City Manager receive all comments and suggestions, that the City
Clerk provide the City Manager with a summary of remarks made by Messrs. Bowman
and Sneed and that the City Manager take the responsibility of working with the
Planning Department to see if the matter can be addressed in a more forthright
manner by involving leadership of the community in order to reach a meaningful
solution that will bring about a sense of togetherness, as well as an alternative that
wi]] be pleasing to a majority of the community while at the same time solidifying the
community.

Mr. Bowers inquired if it was the intent of the Mayor that an interim report
would be submitted by the City Manager at the next regular meeting of Council on
Monday, December 16, 1991, inasmuch as Council would not meet again until January
6, 1992; whereupon, the Mayor advised that it was his thinking that a week would
not give the City Manager sufficient time to address the concerns.
Mr. Bowers moved that the City Manager be requested to report to Council at
the next regular meeting on Monday, December 16, 1991, with regard to the
placement of stop signs and recommended measures to reduce the rate of speed of
vehicles on an interim basis while the study of various alternatives by the City
Planning department continues.
The Mayor called for a second to Mr. Bowers motion.
There being none, the Mayor declared the motion lost for lack of a second, and
advised that the matter would be referred to the City Manager for report to Council
as soon as possible.

The Wright-Creston-Rosewood Association came before Council on
August 12, 1991 regarding the association's petition to close
Wright Road, Creston Avenue, and Rosewood Road, S.W. On that date,
Council directed the city planning commission to conduct a six-
month study of the traffic problem on the three streets,
considering all strategies for alleviating the problem. Council
also directed the planning commission to keep the petitioners
informed of the progress of the study.
Much of the six-month study period has now passed and the
petitioners have received little information regarding the progress
of the study. Therefore, as counsel for the association, I
request, on behalf of the petitioners, that the planning commission
or the professional planning staff be directed to provide an
interim update of the progress of the report at the December 9,
1991 Council meeting. The petitioners also request an opportunity
to speak at the December 9, 1991 meeting.

Subject:
Request of Wright/Creston/Rosewood Association for
an interim update on the Planning Commission's
study and recommendation for the control of
excessive traffic in the Wright Road/Creston and
Rosewood Avenues, S.W. Community.
The Wright/Creston/Rosewood Association has requested an
interim update on the progress of a report and study requested by
Council at its meeting of August 12, 1991. The subject report and
study concerns certain traffic conditions existing in the Wright
Road/Creston and Rosewood Avenues, S.W. Community. In providing
Council with the requested update I feel that it would be
beneficial to provide you with a brief explanation of the City's
past and current actions related to the subject study.
In response to complaints and petitions from the residents of
this community, the Office of Community Planning held a public
meeting at the Fishburn Park Elementary School on May 6, 1991. The
residents of the community were notified of the time, place and
date of this meeting. The purpose of the meeting was to inform the
community at large of a proposal by certain residents (Wright-
Creston-Rosewood Association) to file an official petition to close
Creston and Rosewood Avenues. The meeting revealed that the
community was divided on the issue of closing these streets. A
petition was subsequently filed by the Wright-Creston-Rosewood
Association requesting that the City close Creston and Rosewood
Avenues.
The petition was evaluated by the City Planning staff and the
Planning Commission in the course of a public hearing on July 3,
1991. The Planning Commission recommended that the request for
closure be denied and further recommended that it be referred back
to the Commission for study, report and recommendation of
alternative strategies for the control of excessive residential
traffic in this and other residential communities of the City.
City Council, at its August 12, 1991, evening meeting, concurred
with the Commission's recommendations that the matter be referred
back to the commission for study, report and recommendation. The
final results and recommendations of the study were to be presented

to Council within a period of six months from the date of Council's
action on the matter.
Since that time, the City Planning staff and the
transportation committee have been reviewing the existing traffic
conditions and gathering additional traffic counts, in an effort to
determine the points of origination and destination of the traffic
passing through the community on a daily basis. Various traffic
control measures, including closure, have been studied as to the
feasibility and efficiency of their application in this particular
traffic-related situation.
In reviewing this specific residential traffic problem, the
City staff is also simultaneously formulating for Council's
consideration, a standard policy and procedure for the control of
residential traffic within residential neighborhoods and
communities of the City at large.
The City staff has, in recent weeks, established an advisory
committee made up of individual residents from within the
community. The purpose of the committee is to keep the community
informed of the City's progress and of the nature of possible
options and alternatives to the existing traffic problems. The
City staff met with this committee on November 25~ 1991. A number
of possible traffic control options (attached) were presented to
the committee for distribution to residents within the community.
This information included a background summary of the problem at
hand, and a request for comments and suggestions from the
respective residents.
The advisory committee and City staff are scheduled to meet
again on December 9, 1991, at 6:00 p.m., to review further options
and proposals. It is anticipated that a final public meeting
within the community will be held in early January to discuss final
recommendations to the Planning Commission. The Planning
Commission's study, report and recommendations, which will include
the community's input, opinions and considerations will be
presented to Council prior to the expiration of the six (6) month
study period requested by Council at their August 12, 1991,
meeting.

commuter traffic wdh a 'cut-through" route. Individual streets,
in combined form. are currently being used by commuter
traffic as a thoroughfare

traffic is approximately 1,800 vehicles per day,
c. Point of entry and exit of cut-through traffic occurs as follows:

Traffic turning left from Colonial Avenue onto Wright
Road accounts for two-thirds of all traffic entering the
community from Colonial Avenue (see attached
diagram #~3 ).

Traffic turning left from Rosewood Avenue onto
Brambleton Avenue accounts for approximately two-
thirds of all traffic exiting the community from
Rosewood avenue onto Brambleton Avenue.

Traffic turning right from Brambleton Avenue onto
Rosewood Avenue accounts for approximately two-
thirds of all traffic entering the community from
Brambleton avenue.

Traffic turning right from Wright Road onto Colonial
Avenue accounts for approximately two-thirds of all
traffic exiting the community from Wright Road (see

Study revealed that emergency services would be impacted if the
street connections were closed in a manner that would prevent
access to such service vehicles.
Problem Assessment/Cause,~
The existing traffic problems in this community are the result of a number of events
that occurred over a considerable period of time. More recent events related to
increased land development in the immediate and surrounding areas has resulted
in this street system becoming a familiar and customary cut-through thoroughfare
for commuter traffic. The foremost factors influencing these conditions are as
follows:

Original subdivisions at lower Brambleton Avenue and at upper elevated
Colonial Avenue allowed a street connection between developing
subdivisions.
Tanqlewood Mall and Virqinia Western Community Colle,'~,-, as major factors
influencing traffic movement in the area.

and surrounding areas.
Absence of any other properly aligned street of sufficient width to provide an
adequate connector street between the major thoroughfares of Brambleton
Avenue and Colonial Avenue.

What other options should be considered?
Options-Purpose/effect
The realignment of certain intersections ~s necessary in order to restore the
original intersectional alignments. Removing and realigning pavement in
these areas will restore "T" intersections which will require vehicles to stop
at such intersections. This will eliminate the existing non-stop movement
from Wright Road to Sweetbriar Avenue by commuter traffic.
Additional stop signs will provide an increased margin of safety for motorists
and pedestrians and will also serve to delay the movement of traffic through

the area. Commuter traffic will be inconvenienced anct delayed by required
stops at the newly aligned intersections.
Diagonal diverter at the intersection of Sweetbriar and Rosewood Avenues
will force through traffic to travel a greater distance to gain access to the
major thoroughfares. It will, in effect, lengthen this cut-through, making it
less desirable as a "short-cut."
Controlled entrances at the private street (Spring Street) will eliminate this
as a public street access. Elimination of spring street in conjunction with
option C will lengthen the distance through the community.
Double yellow line gives the impression that this street system is a part of
the state's seconOary highway system, This impression promotes higher
speeds. Removal and replacement with white lines at outer edges of
pavement on both sides will have the opposite effect.
Painted crosswalks at specific intersections will make motorists more
conscious of the residential nature of the area.
Permanent closing of Creston Avenue as referenced in ~ G., above,
would be a viable option only if the prior temporary closure provided the
desired effect.
The temporary closure at Creston Avenue is an option to be employed as
a means of altering or changing the existing habits of cut-through traffic. It
would also serve as a means of allowing the residents ample time to.
experience and determine the overall benefits and/or disadvantages of street
closure at this point in the community.
Scoring or "roughening" of the pavement on the steep section of Rosewood
Avenue is recommended as a means of reducing excessive spinning ancl
sliding of vehicles in bad weather conditions.
Permanent closure of Creston anc~ Rosewood Avenues would eliminate all
cut-through traffic. Closure woul(~ also restrict community access.
Installation of signalization at the Overland Road intersections with Colonial
and Brambleton Avenues wil~ ~ncrease the efficiency of Overland Road as
a major connector street between the thoroughfares.

Grant No. 6592 - $64,048.00 for the 1991-92 Flow Through program
to provide aid for the education and guidance of handicapped students. The
program will be one hundred percent reimbursed by state and federal funds.

A RESOLUTION expressing the City's intent to donate its real
estate interest in current regional landfill property to the United
States government for the proposed Roanoke River Parkway, upon
certain terms and conditions.
WHEREAS, the City of Roanoke has been requested to donate its
interest in current regional landfill property to the United States
government for the Roanoke River Parkway right-of-way in connection
with the proposed Explore Project; and
WHEREAS, the City of Roanoke, together with the County of
Roanoke and the Town of Vinton, have entered into an agreement for
establishment of the Roanoke Valley Resource Authority for the
construction and operation of the Smith Gap Landfill.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Roanoke that the City hereby expresses its desire that the Roanoke
Valley Regional Solid Waste Management Board explore alternatives
to seek an alternative that is equally acceptable or preferred in-
lieu-of utilization of "Area A" in the event the current landfill
operational area is utilized to capacity prior to the new Smith Gap
site becoming operational; and
BE IT FURTHER RESOLVED that this Council hereby expresses its
willingness and intent to donate its interest in such areas of the
current regional landfill property as are needed for the right-of-
way for the Roanoke River (Explore) Parkway, once the current
landfill is no longer in active service and properly closed and the
Smith Gap site is operational, providing the proposed right-of-way
does not encroach upon any area previously used to dispose of solid
waste or present unacceptable environmental liabilities; and
BE IT FURTHER RESOLVED that any quitclaim deed of transfer of
the City's property interest for such right-of-way contain such
language as deemed appropriate by the City Attorney to indemnify
the City from any claim resulting from the donation of such
property interest; and
BE IT FINALLY RESOLVED that the City Clerk is directed to
forward a copy of this resolution to Congressman Jim Olin, the
Roanoke County Board of Supervisors, the Town of Vinton Town
Council, the Roanoke Valley Regional Solid Waste Management Board,
and Mr. Robert Baker, Regional Director, United States Department
of the Interior.

I. Background:
Commitment to donate real estate interest for the Roanoke River
(Explore) Parkway as it is proposed to cross the current regional
landfill has been sought for some time by federal officials from
the three jurisdictions holding title to the landfill property.

Granted comm~itments, in the form of resolutions, have been
provided by Roanoke County and the Town of Vinton. Note the
attached copy of the resolution by Roanoke County.

Wait and see approach has been used as I discussed this matter
with federal officials since, until October 23, 1991, the City had
no agreement for future solid waste disposal.
Do
Explore Pro.~ect briefing was provided to Council on October 31,
1991 by Dr. Rupert Cutler. Dr. Cutler explained the current
status and expectations of Explore.
Agreement to use the Smith Gap Landfill and other accompanying
documents were approved by City Council and executed on October
23, 1991.
Desire for con~nitment from the City is still being expressed by
federal officials.

Proposed right-of-way is generally along the top or west of the
ridge running through the middle of the property. The right-of-
way would pass through what is known as "Area A", the unused and
currently unpermitted portion of the landfill property.

III. Alternatives:
A. Council pass a resolution embodying the following provisions:
Roanoke City Council desires the Roanoke Valley
Regional Solid Waste Management Board to explore
alternatives to seek an equal or preferred financial
alternative in lieu of the utilization of "Area A"
should the current operational area net have
sufficient life to last until the new Smith Gap site
is operational.
ii.
Roanoke City Council express its willingness and
intent to donate its interest in such areas of the
current regional landfill property as are needed for
the right-of-way of the Roanoke River (Explore)
Parkway, once the current landfill is no longer in
active service and properly closed and the Smith Gap
site is operational, providing the proposed right-of-
way does not encroach on any area previously used to
dispose of solid waste or present environmental
problems.

Any quit claim deed of transfer of property interest
for the right-of-way contain such language as deemed
appropriate by the City Attorney to indemnify the
City from any claim resulting from the donation of the
right-of-way.
Use of "Area A" will be avoided if a better option is found;
however, avoidance of Area "A" cannot be guaranteed at this
time.

Disturbance of areas previously used for solid waste
disposal will be precluded.
3. Indemnification will be provided as appropriate.
Conflicts with landfill traffic and structures should not
occur if the donation occurs after the landfill is closed.
5. Indication of support for the Parkway and Explore Project
will be provided.

to act on this matter.
Recox~nendation: Council pass a resolution in support of the Parkway

Waste Management Board, and Mr. Robert Baker, Regional Director, United

AN ORDINANCE accepting the bid of Western State Insulation
Company, a division of National Service Industries, Inc., for
removal and proper disposal of the floor tiles and mastic at the
National Guard Armory, upon certain terms and conditions, and
awarding a contract therefor; authorizing the proper City officials
to execute the requisite contract for such work; rejecting all
other bids made to the City for the work; and providing for an
emergency.
BE IT ORDAINED by the Council of the City of Roanoke as
follows:
1. The bid of Western State Insulation Company, a division
of National Service Industries, Inc., in the total amount of
$16,705.00, for the removal and proper disposal of the floor tiles
and mastic at the National Guard Armory, as more particularly set
forth in the December 9, 1991 report of the City Manager to this
Council, such bid being in full compliance with the City's plans
and specifications made therefor and as provided in the contract
documents offered said bidder, which bid is on file in the Office
of the City Clerk, be and is hereby ACCEPTED.
2. The City Manager or the Assistant City Manager and the
City Clerk are hereby authorized on behalf of the City to execute
and attest, respectively, the requisite contract with the
successful bidder, based on its proposal made therefor and the
City's specifications made therefor, said contract to be in such
form as is approved by the City Attorney, and the cost of said work
to be paid for out of funds heretofore or simultaneously
appropriated by Council.
3. Any and all other bids made to the City for the aforesaid
work are hereby REJECTED, and the City Clerk is directed to notify
each such bidder and to express to each the City's appreciation for

Background:
Bids, following proper advertisement, were
publicly opened and read aloud before City Council
on November 11, 1991, for the Asbestos Abatement -
Floor Tile and Mastic - National guard Armory.
Floor tile will be removed and properly disposed
of under this contract. A second contract will be
issued later to replace the floor tile.
Eight (8) bids were received with Western State
Insulation Company, a division of National Service
Industries, Inc., of 5305 Hollins Road, Roanoke,
Virginia 24019, submitting the low bid in the
amount of $16~705.00 and ten (10) consecutive
calendar days.
Existing floor tiles were damaged by the company
filming "What About Bob" (Disney Studios). Disney
has donated funding for the removal of the floor
tile and future replacement.
Issues in order of importance are:
Compliance of the bidders with the requirements of
the contract documents.

Award a lump sum contract to Western State
Insulation Company, a division of National Service

Tile and Mastic - National Guard Armory in
accordance with the contract documents as prepared
by the City Engineer's office.
Compliance of the bidders with the
requirements of the contract documents was
met.
2. Amount of the low bid is acceptable.
Fundinq for the project is available. A
check in the amount of $24,400.00, from
Disney Studios, has been deposited into
account number 001-020-1234-0865, damage to
City property.
4. Time of completion is quoted as ten (10)
consecutive calendar days which is
acceptable.
Reject all bids and do not award a contract at
this time.
Compliance of the bidders with the
requirements of the contract documents would
not be an issue.
Amount of the low bid would probably increase
if rebid at a later date.
3. Funding would not be encumbered at this time.
4. Time of completion would be extended.

A. Concur with the implementation of Alternative "A".
Authorize the City Manager to enter into a
contractual agreement, in form approved by the

disposal of the floor tiles at the National Guard
Armory in accordance with the contract documents
as prepared by the City Engineer's office in the
amount of $16,705.00 and ten (10) consecutive
calendar days.
ADDropriate $17,550 to Building Maintenance
Account 001-052-4330-3056, Outside Contractors
with a corresponding increase to the revenue
estimate for damage to City property, Account No.
001-020-1234-0865. This provides funding for the
contract amount of $16~705 plus a project
contingency of $845.00.

Background:
Bids, following proper advertisement, were
publicly opened and read aloud before City Council
on November 18, 1991, for the Floor Tile
Replacement - Assembly Hall & Kitchen - National
Guard Armory. A second contract will be issued
for the removal of the existing floor tile and the
proper disposal of it.
Two (2) bids were received with HF Interiors,
Inc., of 2101 Winston Avenue, S.W., Roanoke,
Virginia 24010, submitting the low bid in the
amount of $9,458.00 and sixty (60) consecutive
calendar days.
Existing floor tiles were damaged by the company
filming "What About Bob" (Disney Studios). Disney
has donated funding for the removal and
replacement of the floor tile.
Issues in order of importance are:
Compliance of the bidders with the requirements of
the contract documents.
B. Amount of the low bid.
C. Funding for the project.
D. Time of completion.

Alternatives are:
Award a lump sum contract to HF Interiors, Inc.,
of Roanoke, Virginia, in the amount of $9~458.00
and sixty (60) consecutive calendar days for the
tile replacement in the Assembly Hall and Kitchen
at the National Guard Armory in accordance with
the contract documents as prepared by the City
Engineer's Office.
Compliance of the bidders with the
requirements of the contract documents was
met.
2. Amount of the low bid is acceptable.
Fundinq for the project is available. A
check in amount of $24~400, from Disney
Studios, has been deposited into Account 001-
020-1234-0865, Damage to City Property. Some
of these funds will be used for a separate
contract for asbestos abatement of the floor
tile. Additional funding is available in the
Building Maintenance Department Account 001-
052-4330-3056, Outside Contractors.
Time of completion is quoted as sixty (60)
consecutive calendar days which is
acceptable.
Reject all bids and do not award a contract at
this time.
Compliance of the bidders with the
requirements of the contract documents would
not be an issue.
Amount of the low bid would probably increase
if rebid at a later date.
3. Fundinq would not be encumbered at this time.
4. Time of completion would be extended.
IV.
Recommendation is that City Council take the following
action:
A. Concur with the implementation of Alternative "A".

Authorize the City Manager to enter into a
contractual agreement, in form approved by the
City Attorney, with HF Interiors, Inc. for the
Floor Tile Replacement in the Assembly Hall and
Kitchen of the National Guard Armory in accordance
with the contract documents as prepared by the
City Engineer's office in the amount of $9~458.00
and sixty (60) consecutive calendar days.
Appropriate $6~850 to the Building Maintenance
Account 001-052-4330-3056, Outside Contractors,
with a corresponding increase in the revenue
estimate for Damage to City Property, Account 001-
020-1234-0865. An additional $3,100 is available
in Account 001-052-4330-3056. This provides total
funding of $9,950 for the contract amount of
$9,458 plus a contingency of $492.00.
D. Reject the other bid received.

I. Backqround:
Luck Avenue Storm Drain is a project included in
the approved 1990 Bond Referendum.
City Council, at its November 11, 1991, meeting,
received and publicly opened and read aloud bids
for the subject work.
C. Eiqht (8) bids were received.
Counts & Dobyns? Inc., the low bidder, has given
the City notice of its claim to withdraw its bid
due to mathematical errors.
Second bid, submitted by Branch Highways, in the
amount of $2t014,270.00 is 33% higher than the
engineer's estimate.
II.
Current situation is that City administration is
reviewing the overall project concept and the need to
provide an outlet for stormwater runoff from the
Franklin Road widening project. Staff will re-
advertise a revised project at a later date.

Issues:
A. Errors in low bid.
B. Amount of second bid.

A. Reject all bids, review project scope, and re-

1. Errors in low bid have been documented and

construct project as presently designed.
B. Award a unit price contract with certain reduced
or modified quantities to Branch Highways.

difficult using present design and plan to
cut this amount and still have a functional
project.

4. Funds for construction do exist for a reduced

all bids, reducing the scope, and readvertising the
project.

Mr. White asked the question of Mr. McQuade - Is the scope of the
City's Audit department in comparison with other cities of the
same size as the City of Roanoke. Mr. McQuade responded yes.

A motion was made by Mayor Taylor and seconded by Mr. Fitzpatrick
to receive and file the Comparative Cost Report Transmittal Form
as presented by Mr. McQuade. The motion was approved unanimously.
A motion was made by Mr. Fitzpatrick and seconded by Mr. Musser
and Mr. Harvey to receive and file the Letter of Recommendations
on Procedures and Controls (Management Letter) as presented by Mr.
McQuade. The motion was approved unanimously.
Mr. Fitzpatrick stated that he had noticed a lag time involving
the RACF security package. He wanted to know why there was such a
lag time in purchasing the package in 1991 and not making it
operational until late 1992. Mr. McQuade stated that it was due
to the time required to install and test the system.
3. Citizen Services Committee Audit Requirements
A motion was made by Mr. Fitzpatrick and seconded by Mrs. Bowles
to concur with Proposal A of the staff recommendation. After
considerable discussions, a motion was made by Mr. Harvey and
seconded by Mr. Musser to table the motion until the next Audit
Committee meeting. Mr. Harvey requested that Mr. Bird report back
with the number of agencies and dollar amount involved in this
change. The motion to table was approved unanimously.
4. School Board - Independent Contractor or Employee:
A motion was made by Mr. White and seconded by Mr. Fitzpatrick to
receive and file the briefing as presented by Mr. Bird. The
motion was approved unanimously.
School Activity Fund Audit Options~
A motion was made by Mr. White and seconded by Mayor Taylor to
concur with Mr. Bird's recommendation that the Municipal Auditing
department continue performing School Activity Fund Audits with
reduced costs. The motion was approved unanimously.
Mr. Fitzpatrick stated that he wants the audit department to
continue random testing on school activity funds. He feels that
it is very important. Mr. Harvey and Mr. Musser both stated that
they have confidence in the audit staff; however, they want the
audit staff to be careful and feel comfortable with the testing
done in the schools. Mr. Musser stated that times are tight, but
that is when you have to test more carefully.

A RESOLUTION fixing the date of a Special Meeting of the
Council of the City of Roanoke.
BE IT RESOLVED by the Council of the City of Roanoke that a
Special Meeting of the Council be held on the 10th day of December,
1991, at 11:30 a.m., for the purpose of receiving bids for the
purchase of $68,720,000.00 aggregate principal amount of general
obligation bonds of the City, consisting of $15,250,000.00
principal amount of General Obligation Public Improvement Bonds,
Series 1992A, and $53,470,000.00 principal amount of General
Obligation Public Improvement and Refunding Bonds, Series 1992B,
and considering a resolution accepting a bid for such bonds, fixing
the rates of interest to be borne by such bonds, approving an
Official Statement relating to such bonds, authorizing the
execution of a certificate relating to such Official Statement and
ratifying certain acts.
