1. Call to Order - Roll Call. Council Member Bowers was
absent.
The Invocation was delivered by The Reverend David A. Kirk, Pastor,
Northminster Presbyterian Church.
The Pledge of Allegiance to the Flag of the United States of America
was led by Mayor Noel C. Taylor.
Council Member Bowles presented a proclamation declaring
Wednesday, March 11, 1992, as "A Day of Prayer" for the Honorable
Noel C. Taylor, Mayor.

3. A report recommending acceptance of additional funds, in the
amount of $110,329.00, from the U. S. Department of Justice,

4. A report recommending execution of revised lease agreements
between the City and the Commonwealth of Virginia,
Department of General Services, and the City and the General

recommending acceptance of the bids submitted by Magic City
Motor Corporation to lease to the Sheriffs Department one full

category for personal property taxation of general aviation
aircraft.
The City Manager, along with a representative of Council
to be designated by the Mayor, was requested to meet
with the Commissioner of Revenue to determine if he
will reconsider his decision to change the assessment
procedure. The City Manager was further requested to
report to Council by Monday, March 23, 1992.

WHEREAS, the Honorable Noel C. Taylor has served the City of
Roanoke since 1970 in the capacities of Council Member, Vice-Mayor,
and Mayor; and on June 30, 1992, he will complete his fourth term as
Mayor; and
WHEREAS, because of health conditions, on January 28, 1992, Mayor
Taylor announced that he does not intend to seek another term as Mayor
of the City of Roanoke; and
WHEREAS, Mayor Taylor is people-oriented and person-centered. His
entire life has been devoted to helping people. He is known for his
enthusiasm, his dedication, and his ceaseless energy. Whenever
someone is in need, he has rallied around their cause and offered a
helping hand. No task has been too large and no problem has been too
small. His ministry has been extended to not only the members of the
High Street Baptist Church, but to the entire citizenry of the City of
Roanoke; and
WHEREAS, more than eight hundred members of the High Street Baptist
Church will conduct a twenty-four hour Prayer Vigil, commencing at
12:01 a.m. on Wednesday, March 11,1992, and continuing until 12:00
midnight, during which time members of the congregation will ask the
Lord to lay His healing hand upon our Mayor that he might overcome his
health problems and experience a complete and rapid recovery.
NOW, THEREFORE, we, the undersigned Members of the Roanoke City
Council, in conjunction with the members of the High Street Baptist
Church, do hereby proclaim Wednesday, March 11,1992, as
A DAY OF PRAYER
for our Mayor, the Honorable Noel C. Taylor, and call upon all citizens
of the City of Roanoke to lift their voices in prayer for the full and
speedy recovery of our beloved Mayor.
We respectfully request that the congregations of all churches in the
City of Roanoke remember Mayor Taylor in prayer on this special day
as a token of the love and high esteem in which he is held by all citizens
of the "Star City."

SUBJECT:
Flood Plain Regulations
At the regular City Council meeting on Monday, January 13, 1992. a
public hearing was held on amendments to the zoning ordinance in regard to
flood plain regulations. Mr. Ren T. Heard spoke, not in opposition to the
proposed amendments but with two suggestions for revisions to specific
provisions.
Council adopted the overall flood plain regulations, and referred
Mr. Heard's suggestions to the City administration for further consideration.
At the present time, Planning staff is drafting language which would
address these latest suggestions. The Ordinances and Names Subcommittee of
the Planning Commission will then consider the proposals and make a
recommendation to the full Commission. If the Commission feels that the
zoning ordinance should be amended to include these latest suggestions, it
will be necessary that a public hearing be scheduled, likely at the
Commission's April meeting. Final recommendations to City Council would then
be made in May.
If the Commission does not feel that the zoning ordinance should be
amended at this time for these particular suggestions, their recommendation to
Council could possibly be included on an April agenda.
This communication is intended to keep Council advised of the status of
this matter.

A RESOLUTION accepting an offer of certain Emergency Shelter
Grant Program funds (ESGP) made to the City by the United States
Department of Housing and Urban Development; and authorizing
execution of the City's acceptance of the aforesaid grant offer and
agreement, on behalf of the City, to comply with the terms and
conditions and requirements of said Department pertaining thereto.
BE IT RESOLVED by the Council of the City of Roanoke as
follows:
1. The City of Roanoke does hereby accept the offer made to
said City by the United States of America, Department of Housing
and Urban Development, under date of February 12, 1992, of a grant
of Federal funds under Subpart B of 1987, 42 U.S.C. 11301 (1988),
and other provisions of federal laws and regulations, amounting to
$41,000 in funding to be used for operation and maintenance of
facilities for the Roanoke area homeless population as set out and
described in the City's application for said funding made as Grant
No. S-92-MC-51-5005 by said Department, upon all of the terms,
provisions and conditions therein set out, a copy of the aforesaid
offer to which is attached the Grant Agreement and HUD funding
approval forms, and the terms, provisions and conditions, upon
which said grant is made being on file in the Office of the City
Clerk and being expressly incorporated herein by reference.
2. The City Manager, or Assistant City Manager, be and is
hereby authorized and directed to execute, for and on behalf of the
City, written acceptance of the City on the proper forms, thereby
agreeing on behalf of the City, to comply with the terms and
conditions of the aforesaid Grant Agreement, applicable law and
regulations and all requirements of the United States Department of
Housing and Urban Development, now or hereafter in effect,
pertaining to the assistance provided.
3. Upon execution of the City's acceptance of said offer and
execution of agreement to the terms and conditions incorporated
therein, the original and one copy of the aforesaid document shall
be forthwith forwarded to the Richmond Area Office of the
Department of Housing and Urban Development, together with attested
copies of this resolution, and one executed copy shall be retained
by the City Clerk, for the City.

SUBJECT: EMERGENCY SHELTER GRANTS PROGRAM GRANT AWARD ALLOCATION
I . BACKGROUND
A. For the past five years, City Council has accepted Emergency
Shelter Grants Proqram grant awards allocated under the
Stewart B. McKinney Homeless Assistance Act from the U.S.
Department of Housing and Urban Development to provide
services to the homeless.
B. City appropriated the funds from all five qrant awards to an
Emergency Shelter Resource Fund enabling local non-profit
organizations to apply for financial support to improve and/or
maintain the quality of shelter facilities and services.
C. Council concurred with the recommendations submitted by the
City Manager's Follow-Up Task Force on Homelessness:

II. CURRENT SITUATION
A. FY 1992 Emerqency Shelter Grants Program appropriations
remained the same, nationally, as 1991 levels, resulting
in the City's share remaining level at $41,000.
B. An Emergency Shelter Grants Proqram qrant allocation of
$41,000 for FY 1992 has been awarded to the City of Roanoke
by the U.S. Department of Housing and Urban Development.
C. These funds, allocated under the Department of Housinq and
Urban Development - Stewart B. McKinney Homeless Assistance
Act, must be used to provide assistance to the homeless.
D. The City's Emergency Shelter Resource Fund will provide the
avenue for distributing these funds to local shelter providers
serving the needs of the homeless.
E. City will invite applications from all local shelter providers
to ensure the most cost beneficial use of these funds.
F. Follow-Up Task Force on Homelessness will review proposals
and advise the City Manager on which proposals to recommend
to City Council for funding.
III. ISSUES
A. Impact on Services in the City.
B. Cost to the City.
C. Timing.
IV. ALTERNATIVES
A. Authorize the City Manager to accept the Emergency Shelter
Grants Program grant award of $41,000 from the U.S. Department
of Housing and Urban Development and appropriate funds to an
account to be established in the Grant Fund by the Director of
Finance and increase the revenue estimate in the Grant Fund.
1. Impact on Services in the City would be positive, through
the provision of additional funds to be used for the
operation and maintenance of facilities and services
available to the area's homeless population.
2. Cost to the City would be nothing since no additional City
funds are required.
3. Timing is important in order to ensure that the grant
award is not recovered and reallocated by the Department
of Housing and Urban Development. Funds must be obligated
within 180 days of February 12, 1992, (by August 10,
1992) .
B. Do not authorize the City Manager to accept the Emergency
Shelter Grants Program grant award.
1. Impact on Services in the City could be negative if
assistance for the operation and maintenance of shelter
facilities is not available from other sources.
2. Cost to the City would be the loss of a valuable source of
funds for the community, and possible increased demand on
other funds for providing services to homeless persons.
3. Timing would not be an issue.
V. RECOMMENDATION
It is recommended that City Council adopt Alternative A which
would:
1. Authorize the City Manager to execute the necessary documents
accepting the FY 1991 Emergency Shelter Grants Program grant
award.
2. Appropriate $41,000 for the Emerqency Shelter Grants Proqram
to an account to be established in the Grant Fund by the
Director of Finance and increase the revenue estimate in the
Grant Fund.

GRANT AGREEMENT - LOCAL GOVERNMENT GRANTEE
EMERGENCY SHELTER GRANTS PROGRAM
This Grant Agreement is made by and between the United States
Department of Housing and Urban Development (HUD) and the City of
Roanoke, the Grantee.
The grant which is the subject of this Agreement is authorized
by Subtitle B of Title IV of the Stewart B. McKinney Homeless
Assistance Act, 42 U.S.C. 11301 (1988), as amended (the "Act").
The grant is further subject to the statutory program amendments
made by Section 832 (b), (c), (d), and (e) (1) and (2) of the
National Affordable Housing Act, Pub. L. 101-625, and to HUD's
regulations at 24 CFR Part 576, as now in effect and as may be
amended from time to time, which are incorporated as part of this
Agreement.
Also incorporated as part of this Agreement are the
application, and the certifications submitted to the Secretary by
the applicant. The grantee further certifies that it is following
a current housing affordability strategy which has been approved by
HUD.
In reliance upon the application and certifications, the
Secretary agrees, upon execution of the Grant Agreement, to provide
the Grantee grant funds in the amount provided in the attached HUD
Funding Approval form, which constitutes a part of this Agreement.
The grant is made subject to any special conditions in the Funding
Approval form.
The Grantee agrees to comply with all applicable laws and
regulations in distributing funds provided under this Grant
Agreement and to accept responsibility for ensuring compliance by
subrecipient entities to which it makes funding assistance
hereunder available.
The Grantee further agrees to comply with the provisions of
the environmental requirements of 24 CFR Part 58 as applicable
under Section 104 (g) of the Housing and Community Development Act
for 1974 with respect to funds provided under this Grant Agreement.

SUBJECT: Loan with Total Action Against Poverty (TAP) for
Henry Street Music Center
I . Background:
A. City Council authorized a loan of CDBG funds to TAP in
the amount of $212,000 for asbestos removal and other
improvements to the Henry Street Music Center by
Ordinance No. 29922-2590 on February 5, 1990.
B. Loan was to be repaid in two years at no interest.
C. By Agreement dated February 9, 1990, TAP agreed to
provisions of loan, and that loan would be payable in
full in two years.
D. CDBG funds loaned to TAP were oriqinally intended for
public improvements as part of the Henry Street Revival
plans.
II. Current Situation:
A. On February 6, 1992, City's Grants Monitoring
Administrator reminded TAP's Executive Director that
loan was due.
B. TAP responded that they were unable to repay the loan at
this time and requested loan be forgiven or extended for
five (5) years at same terms.
III. Issues:
A. Impact on TAP's programs.
B. Impact on Henry Street Redevelopment plans.
C. Federal regulations.
D. Cost or revenue to the City.

IV. Alternatives:
A. Authorize the City Manager to execute a Note and Deed of
Trust extending the term of the loan to TAP for five
years; at no interest; due and payable at the end of
that time.
1. Impact on TAP's programs would be positive,
allowing TAP time to complete the Music Center, and
to accumulate resources to repay the loan.
2. Impact on Henry Street Redevelopment plans would be
neutral, since the City will probably not be in a
position to construct public improvements on Henry
Street until after other construction plans in the
area have been completed.
3. Federal regulations would be complied with, as long
as TAP completes the Music Center, and the jobs
benefiting low and moderate income persons are
created.
4. Cost or revenue to the City. There would be no
cost if TAP repays the loan. There would be no net
revenue if no interest is charged.
B. Authorize the City Manager to forgive loan and to notify
TAP and HUD that the loan will be considered to have
been a grant and is no longer expected to be repaid.
1. Impact on TAP's programs would be positive,
allowing TAP to complete the Music Center, and to
no longer have this liability on their accounts.
2. Impact on Henry Street Redevelopment plans would be
negative in the long run. Other funds would have
to be found to construct pUblic improvements as
part of the Henry Street Redevelopment plan.
3.
Federal regulations would be complied with.

BE IT RESOLVED by the Council of the City of Roanoke that:
1. The bids submitted by Magic City Motor Corporation to
lease one (1) new full size automobile at a monthly rental rate of
$379.98 per month, and one (1) new eight passenger window van at a
monthly rental rate of $439.76, each for a term of 48 months, is
hereby ACCEPTED.
2. The City's Manager of General Services is hereby
authorized and directed to issue any required purchase orders for
the lease of such vehicles, and the City Manager or the Assistant
City Manager is authorized to execute, for and on behalf of the

A. Requested Automobile and Window Van are

Subject: Personal Property Taxation of General Aviation
Aircraft
I. Background:
A. Concern regarding a new method of personal property taxation of
general aviation aircraft was expressed by Mr. Jim Hopkins, et aI,
to City Council at its February 3, 1992 meeting.
B. Method of taxing airplanes and evaluation of the new method of
taxation on the economic activity of the airport was referred for
study, report and recommendation of City Council.
C. Coordination and information, preparatory to submitting this
report, has been obtained from:

2. The Honorable Jerome S. Howard, Jr., Commissioner of Revenue
3. Ms. Jacqueline Shuck, Airport Executive Director
4. Mr. John Hinkle, Tower Chief at Roanoke Regional Airport
II. Facts - The following facts are germane to this report:
A. The attached report from the City Attorney discusses assessment of
aircraft and the authority of City Council to establish aircraft
as a separate classification of personal property with a rate of
taxation different from that applicable to personal property in
general.
B. Establishment of Personal Property Tax rate: Page 16 of the
adopted Resource Allocation Plan (annual budget) for fiscal year
1991-92 identifies the Personal Property Tax rate at $3.45 per
$100 of assessed value.
C. Assessment of personal property is the responsibility of the
Commissioner of Revenue pursuant to the authorities discussed by
the City Attorney. Establishment of assessed value is
accomplished by the Commissioner of Revenue in accordance with the

appropriate provisions of the State Code as hereinafter
identified.
D. Total estimated revenue from personal property taxes for Fiscal
Year 1991-92 is $13,400,000 with personal property tax revenue
estimated from aircraft being $233,000.
E. Jeopardizing our Radar Service Area should not be a concern since
this possibility is extremely improbable.
F. Reclassification of Control Tower and reduction of the number of
persons employed at the Tower on any particular shift as a result
of loss of aircraft operations is possible, however. As a matter
of record, total aircraft operations and instrument aircraft
operations for the past four (4) years are as follows:

G. Declining trend in general aviation interest on a national level
has been a concern to the airport industry for the past few years.
Publication authors and seminar speakers have mentioned the
following as possible concerns:
1. Personal time commitment required to obtain and sustain a
pilot license with its different ratings.
2. Cost of obtaining pilot training.
3. Cut back in military pilot training.
4. Cost of aircraft acquisition.
5. Cost of fuel.
6. Cost of FAA required maintenance.
7. Ever-increasing cost of insurance in our litigation oriented
society.
8. Cost of hangaring and securing an aircraft.
9. Additional equipment requirements from FAA, such as
transponders.

10. "Federal luxury tax" cost.
11. "Product liability" laws and the cost associated therewith.
Note, the impact of local property taxes has not been a topic of
much, if any, discussion relating to national trends. It has been
reported by FAA that General Aviation Traffic is expected to grow
0.4%/yr. in the next 10 years with the growth being mainly in
corporate type aircraft but zero growth in single engine piston
type aircraft. Also, the cost of operating a single engine piston
type aircraft is reported to have increased 83% over the past 12
years.
H. Number of aircraft operations is influenced by many factors,
including those previously mentioned. Additional factors can be
the status of the national, state, regional and local economy, the
presence or absence of airport facilities in general, training
facilities in particular, success of the travel industry, and loss
of comradery as the result of ever-increasing airport security
requirements, to mention a few.
I. Ability to influence the number of aircraft operations and the
amount of general aviation activity on a local level is generally
limited to the following two minor factors:
1. Commission - Cost of hangaring and securing an aircraft.
2. City - Rate of local tax levy and establishment of assessed
value.
III. Identification Issues: There are four issues to be considered as
follows:
A. Method of taxin2 airplanes
1. Method of assessing value
2. Tax rate
B. Impact of local property tax assessment on aircraft on the overall
economic activity at the airport.
C. Impact of local property tax assessment on the number of occupied
flight service tower operating hours.
D. Taxation as a method of providing revenues to provide services in
general.

IV. Discussion of Issues:
A. Method of taxing airplanes:
1. Method of assessing value: As pointed out by the City
Attorney in his report, the Commissioner of Revenue may
assess aircraft by means of a recognized pricing guide or a
percentage of the original cost. In recognition of the slow
depreciation in value of aircraft, the Commissioner of
Revenue decided in 1990 that the more realistic method of
establishing fair market value for aircraft was to change
from the percentage method to the pricing guide method
(Aircraft Digest Blue Book). The Commissioner of Revenue
intended to phase in the new method starting with new
aircraft acquisitions in 1991.
2. Tax rate for personal property may be uniform for all
classifications of personal property or may be different for
each of the State-authorized classifications, including
aircraft.
B. Impact of local property tax assessment on aircraft on the overall
economic activity at the airport: As itemized in Section I(G) and
I(H), many factors influence the general economic activity of the
airport. Any factor that increases the cost of owning and
operating an aircraft has an adverse effect, however immeasurably
small, on the overall economic activity at the airport. The
impact of local taxes is immeasurable but is obviously negative.
C. Impact of local property tax assessment on the number of occupied
air traffic control tower operating hours: Like the impact on the
overall economic activity, the impact of local taxes is
immeasurably small but must be considered negative.
D. Taxation as a method of providing revenues to provide services in
general: No one likes taxes in general. Assessing a specific fee
for a specific service is easier understood. Taxes in general are
used to support those government functions which do not lend
themselves to the process of assessing a service fee. Council is
limited by the Commonwealth of Virginia in its abilities to tax
and must use these options available to provide revenues for the
general health and welfare of its citizens. Tax incentives,
however, where permitted, have been generally accepted as a means
of promoting investment in property and economic growth.
IV. Recommendation: I recommend Council take the following steps:
A. Ask the Commissioner of Revenue to immediately use the Aircraft
Digest Blue Book in establishing the assessed value for all
taxable aircraft.

B. Establish aircraft as a separate classification of Personal
Property Tax with a separate tax rate of $1.78 per $100 assessed
value, which rate is estimated to produce the same amount of
annual revenue as the previous percentage of original cost method.
The effective date for the new rate is recommended to be with all
tax bills mailed for calendar year 1992, e.g. retroactive to
January 1, 1992.
This establishment of special category Personal Property Tax Rate will
accomplish the following:
1. Apply the recognized theme of tax incentives to reduce the
local tax cost to aircraft owners and encourage aircraft
being based in Roanoke.
2. Reduce the negative impact, however small, that local taxes
have on the overall airport economic activity and hours of
occupied air traffic control tower operations.

IN THE COUNCIL OF THE CITY OF ROANOKE, VIRGINIA
AN ORDINANCE to amend and reordain S32-104, Levied; rate, Code
of the City of Roanoke (1979), as amended, to add a new subsection
(d) imposing and levying tangible personal property tax at the rate
of $1.78 per $100 of fair market value for certain aircraft
established as a new classification for purposes of tangible
personal property taxation.
BE IT ORDAINED by the Council of the City of Roanoke as
follows:
1. Section 32-104, Levied; rate, Code of the City of Roanoke
(1979), as amended, is hereby amended and reordained to read and
provide as follows:
S32-104. Levied; rate.
(a) For the purposes stated in S32-16, there is
hereby imposed and levied, and there shall be collected,
for each tax year, a tax upon all vehicles without motive
power, used or designed to be used as manufactured homes
as defined in S36-85. 3, Code of Virginia (1950), as
amended, and classified in S58.1-3506 of the Code of
Virginia, at the rate established by S32-16 for all real
estate and improvements thereon not expressly exempt from
taxation and not the property of a public service
corporation.
(b) For the purposes stated in S32-16, there is
hereby imposed and levied, and there shall be collected,
for each tax year, a tax at the rate of three dollars and
forty-five cents ($3.45) on everyone hundred dollars
($100.00) of fair market value of the following
classifications of tangible personal property:
(1) Upon all tangible personal property
classified and defined in S58.1-3503, Code of
Virginia (1950), as amended, except such

household goods and personal effects as are
hereinafter provided to be exempt from
taxation pursuant to subsection (c) of this
section and certain aircraft which shall be
taxed at a different rate pursuant to
subsection (d) of this section.

(c) The classes of household goods and personal
effects defined and classified in subparagraphs (1), (2),
(3), (4), (5), (6), (7), (8) of paragraph A of S58.1-
3504, Code of Virginia (1950), as amended, when owned and
used by an individual or by a family or household
incident to maintaining an abode, shall be exempt from
the tax levied and imposed by this section.
(d) For the purposes stated in S32-16, there is
hereby imposed and levied, and there shall be collected,
for each tax year, a tax at the rate of one dollar and
seventy-eight cents ($1.78) on everyone hundred dollars
($100.00) of fair market value for (1) aircraft having a
maximum passenger seating capacity of no more than 50
which are owned and operated by scheduled air carriers
operating under certificates of public convenience and
necessity issued by the State Corporation Commission or
the Civil Aeronautics Board and (2) all other aircraft
not included in (1) and flight simulators.
2. This ordinance shall be in full force and effect
retroactive to January 1, 1992.

Dear Mrs. Bowles and Gentlemen:
At the City Council meeting of February 3, 1992, Council heard
concerns from representatives of the general aviation community as
to the assessment for personal property taxation of aircraft having
a situs at Roanoke Regional Airport, Woodrum Field. In this
regard, I have been requested to render my opinion as to whether
City Council may lawfully levy personal property tax on aircraft at
a rate different from that levied on tangible personal property in
general. I am pleased to provide this opinion for Council's
benefit in considering this public policy issue.
QUESTION PRESENTED
May City Council lawfully levy personal property tax on
aircraft having a tax situs in the City at a different rate from
the rate established for tangible personal property in general?
ANSWER
Yes.
FACTS
The Commissioner of Revenue formerly assessed aircraft by
means of a percentage or percentages of original cost. Recently,
the Commissioner has begun to assess aircraft by means of a
recognized pricing guide. This change in assessment methodology
has resulted in higher assessments for aircraft owners and,
accordingly, higher tax bills. As a result, some aircraft owners

have reportedly moved their aircraft from Roanoke Regional Airport,
Woodrum Field, to other airports.
DISCUSSION OF LAW
Section 2(1), Roanoke City Charter, bestows upon City Council
the general power of taxation. This section authorizes City
Council to raise annually by taxes and assessments such sums of
money as the Council deems necessary for the purposes of the City
and in such manner as Council shall deem expedient, in accordance
with the Constitution and laws of the Commonwealth and the
Constitution and laws of the United States. Section 58.1-3500,
Code of Virginia (1950), as amended, provides that tangible
personal property, such as aircraft, is segregated for and made
subject to local taxation only.
Section 58.1-3503 of the State Code divides all tangible
personal property into eighteen (18) categories (not
classifications for rate purposes) for purposes of assessment. One
of the categories of tangible personal property is aircraft which,
according to the State Code, shall be valued by means of a
recognized pricing guide or a percentage or percentages of original
cost. Section 58.1-3503.A.13. Subsection B of S58.1-3503 provides
that the methods of valuing tangible personal property may differ
among the separate categories; assessment methodology must,
however, be uniform within each category and whatever methodology
is utilized must reasonably be expected to determine actual fair
market value. Within the guidelines of the State Code, the
Commissioner of Revenue determines the assessment methodology to be
applied to tangible personal property having its situs for purposes
of taxation within this City, and the Commissioner extends the
assessment to each item of tangible personal property. See S38,
Roanoke City Charter.
While assessment of tangible personal property is a
responsibility of the Commissioner of Revenue, it is the
responsibility of City Council to establish the applicable tax
rate. As to tangible personal property, subsection (b) of S58.1-
3506 provides that City Council may ordain a different tax rate for
each classification of personal property enumerated in S58.1-3506
of the State Code. Within S58.l-3506, the following two
classifications of aircraft are enumerated: (1) "Aircraft having
a maximum passenger seating capacity of no more than 50 which are
owned and operated by scheduled air carriers operating under
certificates of public convenience and necessity issued by the
State Corporation Commission or the Civil Aeronautics Board;" and
(2) "All other aircraft not included in subdivision A.2 [above] and
flight simulators". Section 58.1-3506.A.2. and 3. The only

limitation on Council's authority to levy a different rate of tax
on the classifications of tangible personal property established by
S58.1-3506 is that rates of tax for the classifications established
by S58.l-3506, such as the two classifications of aircraft, shall
not exceed that applicable to the general class of tangible
personal property.

located in the City of Roanoke for the consideration of $210,000.00
upon the terms and conditions set forth in the report to this
Council from the City Manager dated March 2, 1992, is hereby
accepted with all costs incident to the transfer of title to such
land with the exception of the seller's tax to be paid for by the
purchasers.
2. The Mayor and City Clerk are hereby authorized to execute
and attest, respectively, on behalf of the City of Roanoke, an
appropriate special warranty deed of conveyance of this property to
Thor Construction Company and the City Attorney shall be authorized
to tender such deed to the purchasers upon appropriate payment to
the City of the $210,000.00 purchase price.

Subject: Surplus City-owned property -
Old Valley Metro Bus Barn
I. BACKGROUND
A. Oriqina1 Va11ev Bus Garaqe and associated parcels (see
attached map marked in yellow) became surplus property to
the city when the new office and maintenance facility
opened in 1990.
B. citv Council authorized the sale of surplus Valley Metro
property by the Office of Economic Development, through
negotiation, on September 11, 1989.
C. Underqround storaqe tanks were removed from property in
1991. Environmental Protection Agency (EPA) and Virginia
Water Control Board (VWCB) regulations were applicable to
the removal. Beginning with a contract award to UEL
Enterprises in December, 1990, through final contaminants
soil removal and disposal in september, 1991 a total of
$354,997 was expended to remove the tanks and
contaminated material. The city requested reimbursement
in the amount of $287.500 on November 12, 1991, from the
Commonwealth of Virginia Underground storage Tank Clean
Up Fund. To date, no further action has been required by
the VWCB. The VWCB has not responded to our request for
reimbursement nor our report of site clean up.
II. CURRENT SITUATION
A. Propertv has been marketed for sale by the Office of
Economic Development for approximately 30 months.
B. written offer of $210.000 has been received by Kit Kiser
from Alton B. prillaman, representing Thor Construction
Company. (See attached written offer.)
C. Anticipated proceeds of $206.826 were appropriated as
local match for new Valley Metro buses and related
equipment. Accounts Receivable (#008-1272) was
established in the amount of $206.826.

any further action regarding the clean up of any
contaminants from previously leaking underground storage
tanks.

yield the greatest benefits to the city is met.

and appointing Willard N. Claytor as Director of Real Estate
Valuation, such amendment changing the effective date of Mr.
Claytor's election appointment from April 1, 1992, to March 23,
1992.
BE IT RESOLVED by the Council of the City of Roanoke as
follows:
1. Paragraph 1 of Resolution No. 30879-021092, is hereby
amended to provide that Willard N. Claytor shall be elected and
appointed as Director of Real Estate Valuation for the City of
Roanoke effective March 23, 1992.
3. Paragraphs 2, 3, 4 and 5 of Resolution No. 30879-021092
shall be unaffected by the amendment to Paragraph 1 and remain in
full force and effect.
