CERTIFICATION OF EXECUTIVE SESSION. (7-0)
Adopted Resolution No. 30914-031692 authorizing appropriate City officials
to pursue a claim against the County of Roanoke for delinquent charges for
surplus bulk water purchased by the County, pursuant to the 1979 water
contract. (7-0)
Reappointed Clifford A. Hammer to the Fair Housing Board.
Mr. Ray W. Barbour, 686 Montrose Avenue, S. E., advised that the 1988-
1992 Capital Improvements Program, page 84, allocates $1 million for
modernization and renovations to Momingside Elementary School, and
inquired as to the projected date for the proposed improvements. The Mayor
requested that the matter be referred to the Roanoke City School
Administration for appropriate response.

Mr. Barbour expressed concern that the Police Department has forced certain
criminal elements (prostitutes and homosexuals) fxom the downtown area to
the Tazewell Avenue, S. E. area which is a residevtial neighborhood, and
suggested that such activities bc moved to an industrial district, such as
Norfolk Avenue, S. W., bctwcen 12th Street and the railroad crossing lcoding
to the American Bridge Company property.
Mr. William W. Jones, 2904 Bradley Street, N. E., complained about noise
and illegal parking activities in connection with a race car owned by an
individual residing in a house next door to his residence. The matter was
referred to the City Manager for investigation and report to Council.

Proposal
On behalf of its general membership, the board of directors of
the WILLIAMSON ROAD AREA BUSINESS ASSOCIATION, Inc. (otherwise
known as "WRABA") hereby respectfully petitions the members of
the ROANOKE CITY COUNCIL=
To authorize the establishment of a primary service district,
subject to Virginia State Code 15.1-18.3, to be known as the
WILLIAMSON ROAD AREA SERVICE DISTRICT for the purpose of provid-
ing to the Williamson Road area "additional or more complete
services of government than are desired in the city as a whole".
Boundaries of said district shall be as shown on the accompanying
map and shall represent the area subject to a special tax as-
sessment and entitled to receive benefits thereof.
To assess an additional tax of .1% (10 cents per $100) of as-
sessed value over and above the current rate of $1.25 per $100 on
all taxable real property within the boundaries of the newly
created service district.
To designate WRABA as its agent in receiving funds and carrying
out certain functions, subject to an approved workplan, necessary
to provide such services.
Boundaries
The area for consideration begins at the intersection of Orange
Avenue and Williamson Road and extends north on Williamson Road
to the Roanoke City limits at Malvern Avenue.
The WILLIAMSON ROAD AREA BUSINESS ASSOCIATION, INC. is a non-
profit business association comprised of active business leaders,
retired persons and other interested individuals who work, live
or have an interest in the northwest section of Roanoke Virginia.
Mission
The mission of the WILLIAMSON ROAD AREA BUSINESS ASSOCIATION
(WRABA) is to promote and encourage improvements in organization,
design, promotion and economic development in the Williamson Road
area and to function as:
* A forum for local business people to discuss common
problems, programs and goals.
* A unified voice to represent the local business communi-
ty.
* An assembly to hear speakers and receive information on
topics of current interest.
* A public information service to inform the Roanoke Valley
of Williamson Road area activities.
* An action group to pursue specific projects.
* A focal point of contact for interested investors, de-
velopers and business people.
Membership
Those eligible for membership are:
1 - Persons who own and/or operate area businesses.
2 - Representatives of area churches or schools.
3 - A liaison from the Williamson Road Action Forum.
4 - Those persons who manifest an interest in the
association and its objectives.
Present membership is approximately 150 members.

History
The WILLIAMSON ROAD AREA BUSINESS ASSOCIATION (WRABA) is an
outgrowth of the Williamson Road Action Forum which was organized
in 1980 by area citizens who shared a common desire to see their
community improved. The image of the Williamson Road area needed
improvement as did such conditions as poor storm drainage and
traffic problems. The citizens united to collectively make their
concerns known to the City of Roanoke officials and the city
listened. In 1981 the WILLIAMSON ROAD AREA BUSINESS ASSOCIATION
(WRABA) was formed to work with the Action Forum to carry forward
the cooperative work already begun between the citizens and the
city.
In 1984 these two organizations approached the city for assist-
ance in planning for future improvements and growth along Wil-
liamson Road - Roanoke Valley's "Main Street". Everyone realized
that Williamson Road would soon reach a turning point in its
development due to its position as a major connector between a
revitalized downtown on the south and a new major retail shopping
mall Valley View on the north. It was felt that all those in-
volved should join forces to shape an improved image of the
Williamson Road area.
After six (6) months of workshops, meetings and planning sessions
between city officials, citizens groups, business leaders and
professional urban design consultants a final repot was issued in
January of 1985 which made several observations and recommenda-
tions. The WRABA immediately endorsed and began working on sever-
al of the recommendations in the report and today can point with
pride to many accomplishments and improvements which have oc-
curred since then.

Goals - Service District Proposal
Goal #1
To provide a forum for local businesses to discuss common prob-
lems, programs and goals and to provide a unified voice to repre-
sent the interests of the Williamson Road business community, and
to develop and coordinate a comprehensive commercial revitaliza-
tion strategy for the Williamson Road area.
Suggested activities/projects:
1 - Need to improve existing relationship between WRABA and the
Williamson Road Action Forum in order to provide a coordinated
effort in area projects/improvements.
2 Continue efforts
and, if possible,
automobile emphasis
to minimize negative affects of "cruising"
turn these into positives, ie. market the
- car shows, rallies, etc.
Goal #2
To market a positive, unified image of Williamson Road as a
center of activities, goods and services to residents, shoppers,
tourists and potential investors.
Suggested activities/projects:
1 - Classify existing businesses and determine what types succeed
in the area - auto dealerships, banks, restaurants, etc.
2 - Develop calendar of special events and notices of new busi-
nesses providing unique goods or services.
3 - Direct mailer/flyer program to other parts of the Roanoke
Valley announcing coordinated sales events.
4 - Capitalize on the importance of the automobile as a commodity
in the area's commercial activity - Car shows, driver education-
al seminars for the elderly, drive-in restaurants (1950's style),
etc.
5 - Encourage local residents to support area businesses

7 - Determine missing goods/services and recruit new businesses
to the area.

8 - Work on cruising problem - one-way streets, outdoor concerts,
car shows, curfew, etc.

1 - Adopt-a-block program where a business is responsible for
cleaning up trash, cutting weeds, etc.
2 - Work on problem of chain-link fences installed too near the
street.
3 - Recognition program with awards for businesses who improve
the appearance of their property.
4 - Work on a sign ordinance enforcement program and suggest use
of design catalog for new or remodeled buildings.
5 Low-interest loan program for physical improvements only, as
well as new business startups.
6 - Possible use of VPI's school of architecture or municipal
planning department as a pilot project.
7 - Trash receptacles.
8 - Bus stop covers.
9 - Get city to improve public property - curbs, sidewalks, etc.
10 - Get city to enforce ordinances on abandoned cars, weeds,
etc.
11 - Work on cruising problem.
12 - Try to discourage new "adult homes" and work for possible
relocation of existing ones.
13 - Utility pole setback.
14 - Landscape completion at Breckenridge School.
15 - Christmas decorations.

Goal #4
To %m~rove the economic appeal of the Williamson Road area by
retaining and strengthening existing businesses; by recruiting
new businesses to diversify the existing business mix and fill
vacant buildings thereby increasing investor confidence.
Suggested activities/projects:
1 - Encourage city officals/departments to recommend the William-
son Road area to new business prospects.
2 - Ask the city for some latitude (variance, tax consideration)
for requiring a new "certificate of occupancy" when new business-
es go into older buildings.
3 - Develop a resource list of services (painting, lawn mainte-
nance, accounting, etc.) for out-of-town property owners.
4 - Low-interest loan programs.
5 - Have city building department refer new business owners to
WRABA so that the design catalog might be discussed in the early
stages of the business planning.
6 - Get the city's economic development department to recommend
the Williamson Road area for possible location sites instead of
always referring to the southwest portion of the city. Present
150 foot zoning on Williamson Road needs to be deeper.
7 - Provide technical assistance to new startup businesses.
8 Recruit new businesses which "fill the gap" of missing
goods/services.
9 - Work on cruising.
10 - Adult homes.
11 - Develop services to be shared - accounting, lawn services,
marketing/advertising, secretarial pool, etc.
12 - Low-interest loan programs.
13 - Develop "commercial pockets" to attract unique businesses.
14 Work on traffic flow. Revive idea of 581 ramp onto 10th
street.

Since 1981 The WILLIAMSON ROAD AREA BUSINESS ASSOCIATION (WRABA)
(a non-profit, voluntary membership organization) has attempted
to address the focus areas shown above, but its effectiveness
has been extremely limited by budgetary constraints and by its
many other functions in representing the area to the community at
large.
As envisioned, WRABA would retain its basic structure as a non-
profit, voluntary membership organization carrying out its tradi-
tional functions. The additional funds generated by the service
district designation added to current and projected increased
membership dues, would provide the organization with funds
necessary to address many of the goals listed above.
Benefits to Property Owners
Property owners within the district will benefit in a variety
ways, ranging from the intangible to the tangible as follows:
* A more attractive and vital business district.
* Increased rent levels.
* Higher property values.
* Better prospects for improved tenant retention.
* Attraction of upscale customers.

FROM ORANGE AVENUE NORTH TO THE ROANOKE CITY LIMITS
We are working on the creation of a Special Service District that will be base funding for
this Association, under the direction of the City of Roanoke, Virginia.
The enclosed sheets describe what is involved as concerns a Special Service District.
If you need more information please call our office.
A number of businesses have already agreed to assist this important plan that will be
beneficial to all property owners in our corridor of the City.
Our Association is almost eleven years old and we have accomplished a lot but our best is
yet to be. We have seen the completion of three parks, an $18 million dollar floor/storm
drainage project, the creation of an Ordinance that put the Massage Parlors out of busi-
ness and a long list of other accomplishments too numerous to mention here.
Please join our on-going efforts to work for and with you in helping to hold property
values high and create a better area for merchandising your interests in products and
services by signing the enclosed form and returning it to our Association.
We have an open meeting.., on the Special Service District, March 12th at 6:30 pm in
the Preston Park Recreation Center, located at 3137 Preston Avenue NW.

Proposal
The WILLI~3~SON ROAD AREA BUSINESS ASSOCIATION (WRABA) will soon
ask the Roanoke City Council to establish, pursuant to State
Code, a primary Williamson Road Area Service District (within the
boundaries shown on the attached map) and to designate WRABA as
the City's agent in receiving funds and carrying out certain
functions, subject to an approved work plan, through the use of
these funds.

Fundinq
Service Districts are funded by an additional tax on all taxable
real property within the boundaries defined. We are proposing an
additional .1% (10 cents per $100) of assessed value over and
above the current $1.25 per $100.
WRABA
Since 1981 The WILLIAMSON ROAD AREA BUSINESS ASSOCIATION (WRABA)
(a non-profit, voluntary membership organization) has attempted
to address the focus areas shown above, but its effectiveness
has been extremely limited by budgetary constraints and by its
many other functions in representing the area to the community at
large.
As envisioned, WRABA would retain its basic structure as a non-
profit, voluntary membership organization carrying out its tradi-
tional functions. The additional funds generated by the service
district designation added to current and projected increased
membership dues, would provide the organization with funds
necessary to address many of the goals listed above.
Benefits to Property Owners
Property owners within the district will benefit in a variety of
ways, ranging from the intangible to the tangible as follows:

* Higher rent levels.
* Higher property values.
* Better new prospects for better tenant retention.

A. BUILDINGS:
Jefferson High School Renovation - This project,
being carried out by the Jefferson Center
Foundation, has progressed to the point where
bidding for Phase I improvements is anticipated
April, 1992.

B. PUBLIC SCHOOLS:
Replacement of Heatinq Systems - The heat
transmission system at Fleming High School
was replaced at a cost of $290,000.00.
Replacement of the boilers at William Fleming
High School is currently being bid at an
estimated cost of $140,000.00. The work is
expected to be completed by December, 1992.
Removal of Asbestos - 42% of the allocated
funding, or $1,400,000.00, has been expended
for asbestos removal throughout the system.
The remaining $1~900~000.00 will be expended
over the next two (2) years.
Secondary School Modernization - The
$270,000.00 allocated has been committed to
necessary engineering studies. An
architectural/engineering firm has been
chosen, but a contract has not yet been
negotiated.
C. STORM DRAINS:
Peters Creek Flood Reduction Project - This
multifaceted project consists of five (5)
parts all aimed at reducing the flooding
along Peters Creek.
Part 1 consists of creek channelization.
The work will consist of widening the
creek channel starting at a point 1/2
foot above normal water level and
extending back from each side of the
creek for a distance that will be most
beneficial.

Downtown Luck Avenue Improvements - This
project consists of installation of a relief
storm drain running from 2nd Street, S.W. at
the outlet of the new storm drain facilities
being installed as part of the VDOT Franklin
Road Widening project, along Luck Avenue,
S.W. to Church Avenue,S.W. and finally to
Lick Run near the intersection of Campbell
Avenue and Williamson Road, S.E., for the
purpose of rerouting stormwater runoff away
from the Campbell Avenue storm drain system
thus reducing chronic flooding in the
downtown area.
Final construction plans are complete
and project was bid earlier with a low
bid of around $2,000,000.00.
Plans have been revised to reduce
project cost and have been re-advertised
with bids due on March 2, 1992. Current
estimated cost is $1,350,000.00.
Statesman Industrial Park - This project
consists of installation of a stormwater
detention basin and a storm drainage system
in the Statesman Industrial Park with curb
and gutter to be added through property owner
contributions.
Final construction plans for the project
are complete.
Property and easement acquisition
underway with environmental site
assessments being conducted now.
Phase I, consisting of construction of
the detention basin is scheduled for
construction in May 1992. Phase II,
consisting of the storm drainage system
is scheduled to begin construction in
August 1992.

1. The City Manager be, and he is hereby authorized, for and
on behalf of the City to execute a Real Estate Option on real
estate located at 1819 Melrose Avenue, N.W., currently owned by Roy
R. Pollard, Jr., as more particularly set out in and attached to
the City Manager's report to Council dated March 16, 1992, a copy
of which is on file in the Office of the City Clerk, upon approval
of the form of the Option by the City Attorney, and upon such other
terms and conditions as are provided therein.
2. In order to provide for the usual daily operation of the
municipal government,

Execution of Real Estate Option
at 1819 Melrose Avenue NW, under
the Home Purchase Assistance Program
$220~000 from the Virginia Department of Housing and Community Develop-
ment's Single Family Rehabilitation and Energy Conservation Loan Program~
and $2q0~000 in Community Development Block Grant (CDBG) funds were
allocated to the Home Purchase Assistance Program by City Council on
3une 26, 1989, allowing the City to provide loans to low-moderate income
households agreeing to buy and repair approximately 18-20 certain ident-
ified substandard houses. The Program is administered jointly by the City
and the Roanoke Redevelopment and Housing Authority (RRHA), as outlined
in the City's current contract for services with RRHA.

Real Estate Options were selected as the best way to allow the City to
implement the Home Purchase Assistance Program. These Options define
the property owner's and the City's responsibilities under the Program,
establish a purchase price for the property, allow the City to access
the property, and market the property for sale to qualifying low and
moderate income purchasers in the Program through assignment of the
Real Estate Option. This provides for a direct sale of the property
from the current owner to the purchaser selected through the Program.
The City will not exercise any Option and will not actually purchase
any property in the Program. Should the City be unable to find a buyer
for the property, the Real Estate Option would be allowed to expire.
Council previously authorized the City Manager to execute Options with
individual property owners of several properties to be included in the
Home Purchase Assistance Program.
Il. Current Situation:
Real Estate Option has been executed by the owner of a vacant single
family home located at 1819 Melrose Avenue, NW (Attachment A) (City
assessment $15,200). Option is offered at $20,000. Housing Development
staff has determined that the offered price is reasonable to allow the
home to be included in the Program.
Council authorization to the City Manager to execute Real Estate Option
(Attachment A) with the owners of the property is necessary to
allow this property to be marketed through the Program.

Effect on housing conditions will be positive as an additional
home-ownership opportunity will be provided to low-moderate
income households. Owner occupancy and rehabilitation of a
vacant substandard house will provide significant contribution
toward stabilization and rejuvenation within the neighborhood.
3. Timing is such that prompt execution of this Option will allow
immediate marketing of the house.
B. Do not authorize the City Manager to execute Real Estate Option at
1819 Melrose Avenu% NW~ (Attachment A)~ to be approved as to form
by the City Attorney~ with the owners of this property selected for
the Home Purchase Assistance Program.
1. Cost of the City can be recognized as lost opportunity cost.
Effect on housing conditions will be negative, as a homeownership
opportunity will not be provided to low-moderate income house-
holds in the Northwest Quadrant of the City.

THIS REAL ESTATE OPTION (hereinafter referred to as
"Option"), made this 7th day of February, 1992r by and
between Roy R. Poilard~ 3r. (hereinafter referred to as
"Grantor"), and the CITY OF ROANOKE, VIRGINIA (hereinafter referred
to as "Grantee").

4. EXERCISE Of OPTION. This Option shall be deemed validly
and effectively exercised if notice of the exercise hereof is either
sent by certified mail to Grantor at 130 Sycamore Avenue, NE, Roanoke,
VA 24012, or delivered in person to Grantor, on or before
the expiration date and time of this Option. Notice of such exercise
which is given by certified mail shall be deemed effective when depo-
sited in the mail as aforesaid. For the period that this Option is
effective, neither Grantor nor Grantor's employees, agents, tenants or
.representatives shall use or alter the Real Estate in a manner which
would adversely affect its use by Grantee, and Grantor shall not sell,
encumber, or otherwise transfer or dispose of the Real Estate to any
other party. The exercise of this Option shall result in Grantor
selling and conveying the Real Estate to Grantee, and Grantee purchas-
ing and accepting the Real Estate from Grantor, for the amount of
the Purchase Price, subject to the terms and conditions contained in
this Option. Grantee reserves for it and its successors and assigns
the right to terminate this Option at any time for cause or no cause
at all, either before or after the assignment of this Option.
5. FAILURE TO EXERCISE OPTION. If Grantee does not exercise
this Option, Grantor shail have no rights or claims agains~ Grantee.
6. INSURANCE. Upon execution of this Option, Grantor shall
maintain general liability insurance on the rea] estate during the

after the exercise of this Option by Grantee, Grantee~ or its agents

veying, engineering, soil borings, appraisals, estimates of repairs
and other tests and acts deemed necessary by Grantee to satisfy
Grantee that the Real Estate is suitable for the uses and purposes
intended by Grantee and is suitable for the Home Purchase Assistance
Program (hereinafter referred to as the "Program"). All such tests
and acts shall be performed at reasonable hours and at Grantee's cost
and expense. In addition, Grantee shall be entitled to publicize
the Real Estate for sale~ endeavor to identify a purchaser for the
Real Estate, place a "For Sale" sign on the Real Estate, show the
property to prospective purchasers~ and take other reasonable and
appropriate action deemed necessary by the Grantee to sell the Real
Estate. Under no circumstances shall this section create any rights
in the Grantor or impose any obligations upon the Grantee.
8. REAL ESTATE MAINTENANCE. Grantor shall maintain the Real
Estate and adjoining sidewalks and watkways in a safe and attractive
manner during the term of this Option~ and in the event of the exer-
cise of this Option, until the date of closing.

9. RISK OF LOSS. Grantor shall bear. any risk of loss of the
Real Estate during the term of this Option, or, in the event of the
exercise of this Option, until the date of dosing.
10. ASSIGNMENT. Grantee may assign this Option by written noti-
fication to Grantor. Grantor shall not assign this Option, unless
approved in writing by Grantee, and Grantee's approval of such an
assignment ma)' be withheld for any reason or no reason at all. If
the Grantor assigns this Option, all references in this Option to
the Grantor shall apply to the assignee. If the Grantee assigns this
Option, all references in this Option to the Grantee shall apply to
the assignee. In the event of an assignment by either the Grantor or
the Grantee, no claim may be asserted against the assignor based upo%
arising out of, or related to this Option.
11. PURCHASE PRICE. The purchase price for the Real Estate shall
be Twenty Thousand and NO/100 Dollars ($20~000.00).
12. PAYMENT OF PURCHASE PRICF. The purchase price for the Real
Estate shall be payable at closing.
13. CLOSING. If this Option is exercised, closing of the sale
of the Real Estate shall be held within sixty (60) days of the date
on which Grantor receives notice of Grantee's exercise of this Option,
or as soon therealter as may be practically possible. Closing shall
be held in Room 170, Municipal Building, 215 Church Avenue, Roanoke,
Virginia, or at some other location selected by the City and mutuatly
satisfactory to the parties. At closing, Grantor shall execute,
acknowledge, and deliver to Grantee, a general warranty deed,
with modern English covenants of title, in form satisfactory and
acceptable to the Grantee, conveying the Real Estate to Grantee,
free and clear of all liens, tenancies, encumbrances, material
defects, and exceptions, other than current taxes, and any other
matters that may have been approved by Grantee in writing after
examination of title. Said deed shall be prepared at Grantor's
expense. Grantor shall pay grantor's tax, and all documentary,
transfer, and excise taxes imposed upon that conveyance. Grantor
shall execute and deliver a non-foreign affidavit to Grantee at
closing in the form required by Section 1~ of the Internal Revenue
Code; otherwise, Grantee will withhold a portion of the [~urchase Price
and remit the same to the Internal Revenue Services for the account of
Grantor as required by law. Grantor also shall execute, acknowledge,
and deliver any of the instruments, documents, and assurances required
or requested by Grantee or a title insurance company in order to con-
summate this transaction and effect the conveyance of the Real Estate
to Grantee as herein provided, including, without limitation, a yen-
dot's affidavit in form satisfactory and acceptable to Grantee's coun-
sel. Possession of the Real Estate shall be delivered to Grantee at
the closing, in the same condition as it now is, ordinary wear and
tear only excepted, free and dear of the rights or claims of any
other party. AIl warranties and representations o! Grantor, and any
covenants and obligations of Grantor hereunder which remain unper-
formed upon dosing, shall survive the closing.

l#. GRANTEE UNABLE TO CLOSE SAI. F. The terms of this Option
notwithstanding, should Grantee be unable or unwilling for any reason
to close on the sale of the Real Estate, including being determined
ineli§ible for the Home Purchase Assistance Program by the Virginia
Housing Development Authority, after the exercise of this Option,
this Option shall terminate without any liability incurred by Grantee,
Grantee's assigns, successors, administrators, executors, officers,
agents, employees, or any and aJl of Grantee's predecessors in inte-
rest of this Option, if any.
l.S. GRANTOR UNABLE TO CLOSE 5A/.F. If Grantor fails to close
on the sale of the Real Estate for any reason, Grantor shall pay
Grantee and its assigns, and all of Grantee's predecessors in inte-
rest of this Option, if any, all costs incurred, including costs
incurred in the arrangement of the rehabilitation and financing for
the sale of the Real Estate.
16. INDEMNITY. Grantor shall indemnify and hold Grantee,
its officers, agents, employees, successors, assigns, executors
and administrators, and any and ail of Grantee's predecessors in
interest of this Option, if any, harmless from any and all claims,
damages, losses, expenses, costs and attorney fees, as a result
of, arising out of, or relating to the performance by Grantee under
this Option.
17. TAXES. At closing, Grantor shall be responsible for and
pay all real estate taxes upon the subject Real Estate to be pro-
rated as of the Date of Closing.

18. SUCCESSORS. The parties agree and fully understand
that this Option shall be binding upon the parties, their heirs~
successors, assigns, executors and administrators.
19. ENTIRE AGREEMENT. This Option contains and constitutes
the entire agreement of the parties regarding the subject matter
hereof~ and there are no other agreements, writteo or oraI~ between
the parties affecting the subject matter hereof. No amendment of
this Option shall be effective unless the same is made Jn writing and
signed by the parties hereto.
20. THIRD PARTY. This Option creates no rights in any party,
except Grantor and Grantee.
21. DETERMINATIONS~ FINDINGS AND CONCLUSIONS. All determina-
tions, findings and conclusions made by Grantee under this Option
shall be made in the sole and absolute discretion of Grantee, and
Grantor shall have no rights~ claims or causes of action against
Grantee~ its officers, agents~ employees, successors, assigns~ exe-
cutors and administrators, and any and all of Grantee's predecessors
in interest of this Option, if any~ for Grantee's determinations~
findings and conclusions.
22. NOTICES. Notice of exercise of this Option shall be given
in the form attached as Exhibit B and in the manner set forth in this
Option. AIl other notices, requests or other correspondence relating
to this Option shall be sent by certified maJJ, postage prepaid, by
each party to the other party hereto at the addresses specified below
or at such other address as a party may by written notice give as the

I. BACKGROUND

Enhanced 9-1-1 Emeraencv Telephone System was activated
by the city of Roanoke on October 5, 1987.
City Contracts with Chesapeake and Potomac Telephone
Company of Virainia to provide equipment necessary for
selective routing of Emergency 9-1-1 calls to the
appropriate Valley Emergency Communications Center and
the display of citizen address information.
Public acceptance is demonstrated by high usage of the
Emergency 9-1-1 Telephone System. A total of 139,197
calls were processed thru the system during FY 90/91.
II. CURRENT SITUATION
city of Roanoke has been notified by C&P Telephone that
past bills were underestimated. Under the State
Corporation Commission Tariff, equipment charges are
based on the total number of telephone subscriber lines
located in the city. Initial billing reflected the City
as having 43,000 subscriber lines whereas in actuality
there were 52,000 individual telephone lines when the
system was turned on, which has resulted in an
underbilling for services the City has received.
Documentation of Company Policy on file at the State
Corporation Commission restricts retroactively billing
for undercharges to three years prior to discovery of
this error. The current number of subscriber telephone
lines is 56,000 for which the City is required to pay the
fee for services.

Payment Eligibility
I. Backqround on this subject includes:
Code of Virqinia establishes the eligibility criteria of
localities for receiving funds from the Virginia
Department of Transportation (VDOT) for street
maintenance. It specifies two functional classifications
of highways (Principal/Minor Arterials and Collector/
Locals) and establishes a base payment rate per lane mile
for each classification of roadway. These rates are
adjusted annually by VDOT based upon a statewide
maintenance index of unit costs for labor, equipment and
materials used by VDOT on roads and bridges.
City eliqibility for fiscal year 1991-92 is approximately
$6~065~561 in street maintenance payments from VDOT.
These funds are used for many maintenance expenditures
that the City incurs for streets, sidewalks, curb and
gutter, traffic signals, bridges, signs and pavement
markings.
II. Current situation of this subject is:
Inventory additions need to be submitted to VDOT prior to
April 1, 1992, in order to be eligible for payment for
the next fiscal year. These additions are to be
submitted on VDOT forms with an accompanying resolution
from City Council.
City staff has found that the attached list of streets
should be submitted to VDOT before April 1, 1992, to
enable their eligibility for payment in the next fiscal
year. Approval of this addition to the street inventory
could add $69~747 at current year payment rates. These
include new streets, corrections to VDOT's current
inventory, and streets omitted from the VDOT inventory.

with Request for Quotations, were sent to
Fourteen (14) vendors currently listed on the
City's bid list. A public advertisement was
also published in the Roanoke Times and World

Bids were received, after due and proper
advertisement and were publicly opened at
2:00 p.m. on March 5, 1992 and read in the
Office of the Manager and General Services.

Background on the project includes:
New concrete sidewalkst entrancest curb and gutter
improvements are to be constructed throughout the
City as part of the 1988 Bond Referendum (see
Attachment A).
Two (2) projects, both in the downtown area
(including Jefferson Street, Luck Avenue, Kirk
Avenue, and Franklin Road) have been completed as
part of the 1988 Bond Referendum. This will be
the final project.
Bids were received by City Council at its February
24, 1992 meeting, publicly opened, and read aloud
for New Concrete Sidewalks, Entrances, Curb and
Gutter. Six (6) bids were received and referred
to the bid committee for review and report back to
Council.
Low bid, in the amount of $167~282.00 for the Base
Bid and $1~165.00 for the Alternate to the Base
Bid, was submitted by S. R. Draper Paving Company
and is considerably lower than the engineer's
estimate.
Contract amount, which will allow the City to
install additional curb and sidewalk is $65r175.00
more than the low bid total (including Alternate
No. 1). The low bid is 31% lower than the
engineer's estimate. The Engineering Department
has increased the appropriate quantities, as bid
on a unit price basis. Project specifications
state that the City reserves the right to add to
or to decrease the quantities listed in the Bid
Form in an amount that would not exceed 25 percent
of the total accepted Base Bid, without
renegotiattons of the unit prices. The Contractor
has agreed (see Attachment B) to add the
additional streets at the bid unit prices.

Thank you for your inquiry into the possibility of increasing the
quantities on the above referenced project.
After looking over the proposed streets to be added I find them
similar to those on the original quote on 2/24/92.
We will agree to add these streets, Campbell Ave., S.W. from loth
St. to 12th St., both sides; 8th St. one block South of Campbell
East side and West side as needed. Also short sections of curb
returns off Campbell Ave.
We agree to these increases at the same unit prices as our quote
of 2/24/92. However, we would expect the time to be increased by
the same percentage as the dollar value of the contract. Also some
adjustment needs to be made in the only lump sum item (seeding) to
cover additional bonding and actual topsoil and seeding.

SUBJECT: COMMONWEALTH BUILDING
LEASE REVISIONS
Dear Members of Council:
I. Backqround:
General Services Administration (GSA) leases approxi-
mately two-thirds of the second floor of the structure
for use by the U.S. Bankruptcy Court. The term of the
GSA lease states that it is to begin not later than
September 1, 1985, for a ten (10) year period, to
August 31, 1995. Lease also includes a 336 square foot
office on the first floor. Current rate per square
foot is ~9.55.
Commonwealth of Virqinia, Department of General
Services (DGS) leases the remainder of the structure,
including the other approximately one-third of the
second floor, for use by various state offices. The
term of the DGS lease is from July 1, 1985 through
June 30, 2005. Current rate per square foot is $8.51.
Lease Terms of both state and federal leases have
cancellation provisions. State (DGS) lease permits the
addition or removal of leasable space by mutual agree-
ment and also terminates automatically if the Legisla-
ture fails to appropriate funding. Federal (GSA) lease
provides for termination upon sixty (60) days written
notice after the first five (5) years.
Current annual revenue received from leases is
$394~353.82 (FY 90-91) which is used to amortize cost
of renovations to the building.
II. Current Situation:
State Departments on the second floor have already
vacated their spaces. These include the Department of
Education and the Alcoholic Beverage Control Board
(ABC). We were informed of these moves by the DGS. No
reason for the moves was given.

Bankruptcy Court desires more space and GSA has pro-
posed a lease revision that would include the entire
second floor in their lease. GSA has also agreed to
contract for their own remodeling, to be done with City
approval. GSA resists agreeing to Day to require its
contractor to be insured and bonded to protect the City
as required by law. In order to meet this requirement,
the City will arrange to Day the premiums for such
bonding and insurance.

Lease revisions requested by state (DGS) (attached)
have been reviewed by the City and are in the final
form acceptable to DGS and the City Administration.
Effective date to be March 15, 1992.
Lease revisions requested by GSA (attached) have been
reviewed by the City and are in the final form accept
able to GSA and the City Administration. Effective
date to be established as 150 days following the date
of execution of the lease agreement, providing time for
all alterations and renovations to the space to be
completed, ready for occupancy. For example, should
the space be released by the DGS on March 15, 1992, and
the GSA lease agreement be executed at that time, this
lease would be effective about August 12, 1992. Lease
rate to be the current $9.55 per square foot.
Permission to proceed directly to City Council with
this matter was granted by the Water Resources Commit-
tee at its regular meeting on September 23, 1991.

Impact on Pro~ected Revenue, based upon FY 90-91
lease fees, is a net annual loss of $948.20. This
is due to the State (DGS) giving up 4,855 square
feet of qross space and the federal (GSA) only
agreeing to pay for 4,227 square feet of net space.
In addition, during the 150 day period of
alteration and renovation of 4,227 square feet of
floor area (at $9.55 per square foot per annum) by
GSA, there will be an additional, one-time (FY 91-
92) loss of $16~820.00.
City Council not authorize the proposed exchange of
leased spaces between the DGS and GSA in the Common-
wealth Building.
1. Need by petitioning agencies not met.
2. Timinq to cut City's losses not met.
3. Impact on Pro~ected Revenue at least the loss of
revenue from space the DGS desires to vacate.
Recommendation: Council authorize the exchange of leased
properties between State (DGS) and federal (GSA) in accor-

C. The Government will complete all alterations, improvements
and repair required by this Supplemental Lease Agreement (SLA)
and prepare the premises ready for occupancy by the Government
within 150 days following the date of execution of the agreement.
When the Government has completed all such alterations,
improvements, and repairs, the Government shall inspect the new
space. Upon the successful completion of this acceptance
inspection the term of the expansion shall commence and continue
as part of the original Lease. Also upon acceptance of the
leased premises by the Government, the same shall be measured and
an increase in rental shall be provided to the Lessor.
Upon successful acceptance inspection by the Government, a
Supplemental Lease Agreement will be issued to the Lessor to
establish an effective date of the new square footage and the new
annual rental.
D. Prior to commencement of such work the city will be provided
all plans for approval. Upon completion of such alterations and
renovations the city shall inspect the renovations in conjunction
with the governments inspection.
E. Prior to any alterations, improvements or repairs on the
premises, the Government shall obtain an appropriate labor and
material payment bond in the total contract amount in form
acceptable to Lessor protecting Government and Lessor from any
and all claims for labor or material supplied to or on the
premises. The premium for such bond shall be paid for by Lessor,
not to exceed a maximum cost of two thousand dollars (2,000.00).

A RESOLUTION authorizing the appropriate City officials to
pursue a claim against the County of Roanoke for delinquent charges
for surplus bulk water purchased by the County pursuant to the 1979
water contract.
WHEREAS, pursuant to the provisions of the August 13, 1979,
contract between the City and Roanoke County, the City submitted
its usual and customary billing letter dated October 14, 1991, to
Roanoke County in the amount of $320,353.39 for appropriate charges
related to the purchase by the County of surplus bulk water; and
WHEREAS, the City's request for payment is based upon and
authorized by the specific language in the contract and is
consistent with prior billings which have been paid without protest
by the County since 1979; and
WHEREAS, despite repeated requests by the City and numerous
opportunities afforded to the County to discuss the basis for the
County's refusal to make payment under the contract, no reasonable
explanation or payment has been forthcoming.
THEREFORE, BE IT RESOLVED by the Council of the City of
Roanoke that the City Manager, the City Attorney, and any other
City officials are hereby authorized to take any and all action
necessary and appropriate to collect any delinquent charges owed to
the City by Roanoke County, such actions to include, without
limitation, submittal of the City's claim to the Roanoke County
Board of Supervisors and, if necessary, filing suit in
appropriate court on behalf of the City against the County.
