WHEREAS, Curtis Blair, a Senior guard on the University of Richmond Basketbail Team, has been selected the Colonial Athletic Association's College Basketball Player of the Year; WHEREAS, Mr. Blair, who was a member of the 1988 Patrick Henry High School State Group AAA Championship Basketball Team, led the University of Richmond Spiders in scoring and was second in the Conference in scoring average with 20.5 points per game; WHEREAS, Mr. Blair scored in double figures in every game this season with one exception and had his high game with 35 points against an outstanding Georgia Tech team; and WHEREAS, Mr. Blair scored 1576 points in his career at the University of Richmond placing him sixth on the School's ail-time scoring list; THEREFORE, BE IT RESOLVED by the Council of the City of Roanoke as foliows: 1. WHEREAS, Russell Turner, a Senior center on the Hampden-Sydney College Basketball Team, has been chosen to the first team of the 1992 National Association of Basketball Coaches Division III All-America Basketball Team; WHEREAS, Mr. Turner, who was a member of the 1988 Patrick Henry High School State Group AAA Championship Team, is also the 1992 Old Dominion Athletic Conference Player of the Year in Basketball; WHEREAS, Mr. Turner is also Hampden-Sydney,s career leader in points (2271), field goals made, free throws made, blocked shots and scoring average; and WHEREAS, Mr. Turner has achieved a grade point average of 3.561 and has also been honored as a first team GTE Academic All-America; THEREFORE, BE IT RESOLVED by the Council of the City of Roanoke as follows: 1. City Council adopts this resolution as a means of expressing its commendations to Russell Turner for his achievements, academic and basketball, which bring great honor to himself, his family, his College and his native City. 2. The Electoral Board recommends that the Tinker Precinct currently at Thrasher Park Recreation Center be permanently moved to the new No. 14 Fire Station located on Mecca Street, N. E., off Rt. 460. This location will provide more accessibility to the elderly and handicapped. The new facilities will also be more accommodating for our Officers of Election as well as the voters. This change would be effective for the November 3, 1992, Presidential Election. Also, due to the renovation of Virginia Heights School during the 92-93 school year, it will be necessary for us to temporarily move the Raleigh Court No. 1 precinct to the No. 7 Fire Station on Memorial Avenue, S. W., for the November 3, 1992, Presidential Election and return to the school for the next scheduled election which is November 2, 1993. Villa Heights Rec Center - $15,000 CDBG funds to make Villa Heights Rec Center at 2750 Clifton Ave 554 handicapped accessible. 5. Limited Critical Repair - $300,758 ($250,758 CDBG funds) Grants and no-interest loans to low and moderate income property owners city wide for critically needed repairs to their homes and rental properties. 2. Private Rehab Loan Program - $692,680 ($92,680 CDBG funds) a loan program to purchase and rehab single family homes city wide. 3. Operation Paintbrush - $51,085 CDBG funds to paint the exteriors of 11 houses of low and moderate income families in Belmont, Hurt Park, Melrose-Rugby and Mountain View neighborhoods. 4. Ho~e Ownership Assistance - $436,153 ($53,653 CDBG funds) will provide support costs for a program of low interest loans for low income families, in conservation and rehabilitation areas, to purchase and rehabilitate homes with funds from other sources. 5. Neighborhood Stabilization & Enhancement Program (NSEPtion) $491,521 ($141,521 CDBG funds) Program combines strict code enforcement and rehabilitation incentives to improve houses in concentrated target areas of Mountain View neighborhood. 6. Gainsboro Enhancement - rehabilitation - $114,605 in CDBG funds to move and rehabilitate or reconstruct up to 6 houses in Gainsboro neighborhood. 7. Mod Rehab SRO Project - $12,658 CDBG funds to support a TAP project of single-room occupancy units for iow income individuals. 8. Rental Rehabilitation - $227,363 ($27,363 in CDBG funds) provides subsidies for rehabilitation of rental property in conservation areas and rehabilitation districts. 9. Owner-occupied Rehab - $341,285 ($48,785 in CDBG funds) to facilitate the rehabilitation of owner-occupied houses city-wide. Code Enforcement: 1. Code Enforcement - $72,512 in CDBG funds - Provides salaries and support costs for two building inspectors to enforce the Building Maintenance Code in all conservation and rehabilitation areas. Historic Preservation: 1. Architectural Design Assistance - $12,009 in CDBG funds to provide schematic design assistance to eligible H-1 and H-2 property owners in the Downtown Historic District and Southwest Historic District. 2. Downtown Historic Facade Improvement Grants - $70,000 project ($35,000 in CDBG funds) - Rehabilitation matching grant assistance up to $5,000 to property owners in H-1 Downtown Historic District for facade improvements. 3. Coca-Cola 108 Loan Repa~ament -$529,873 - These funds will pay the eighth of ten annual repayments to HUD of the $3,015,000 borrowed by the City for the Coca-Cola UDAG. 2. Deanwood/Shaffer's 108 Payment - $196,435 in CDBG funds to pay the final annual repayment to HUD of the $922,300 borrowed for development of the Deanwood Expansion area and Shaffer's Crossing Industrial area. 3. Deanwood Addition - $25,424 CDBG funds to complete acquisition of a ten-parcel tract of less than one acre fronting on Orange Avenue near Williamson Road. 4. Shaffer's Crossing Industrial Park - $56,152 CDBG funds for continuing acquisition and development of Phase I of the designated Shaffer's Crossing Redevelopment Area. 5. Hotel Roanoke 108 loan interest payment - $85,000 for the first installment of interest on $6,000,000 loan used in renovation of Hotel Roanoke at 19 North Jefferson Street. 6. WHEREAS, it is the policy of this Council that City fees for special services should approximate the cost of such services; WHEREAS, many of the fees, rates, assessments and charges levied by the City for processing of applications, inspections, licenses and other services have become outdated; and WHEREAS, this Council is desirous of revising many fees, rates, assessments and charges of the City to ensure that all such charges are equitable, up-to-date and easily accessible to the public. THEREFORE, BE IT RESOLVED by the Council of the City of Roanoke that: 1. The fees, rates, assessments and charges set out in the City Manager's report, including the Exhibits A and B, dated May 11, 1992, are hereby ADOPTED and established to be effective on and after July 1, 1992. 2. The Fee Compendium of the City, maintained by the Director of Finance and authorized and approved by the City Council by Resolution No. 30789-111891, adopted November 18, effective as fees, rates, Resolution. 1991, of that date, shall be amended to reflect the new assessments and charges established by this 3. This Resolution shall have no effect as to any fee, rate, penalty, assessment or charge which may be legally established only after public notice and/or hearing. 4. Background: In the fall of 1989, the City employed David M. Griffith & Associates, LTD, to conduct a review of user fees charged in various departments. As a result of the study, the "Fee Compendium" establishing certain fees, rates, assessments and charges levied by the City was revised and adopted by Council on November 18, 1991 by Resolution No. 30789 - 111891. II. Current Situation: In order to keep the fee schedule up-to-date in comparison with other surrounding jurisdictions and to recoup more of the costs to the City for specific services provided by the Building Department that were not included in the previously mentioned "Fee Compendium" revision, the following seven (7) user fees are being proposed for increase or enactment. III. Issues: A. Cost of providing specific services. B. Revenue generation. IV. Alternatives. City Council approve the following proposed fee schedule increases. Current Fee Proposed Fee BZA applications $60.00 (variances and special exception permits) $75.00 The study conducted by David Griffith & Associates, LTD, previously suggested that the fees be increased to $235 for a variance request and $294 for a special exception request. The fee was increased from $30.00 to $60.00 in November, 1991. (Salem - $125.00; Roanoke County - $190.00 plus cost of legal ad; and Botetourt County - $75.00) 2. Building Permit (Current Fee) $6.00 (Proposed Fee) $2 .oo Proposal is to increase minimum building permit fee for structures with a valuation of $3,000 or less; this rate change would also bring the City in line with fee charged by surrounding jurisdictions listed above (Salem ~ $25.00, Roanoke County - $25.00, and Botetourt County - $5.05 per $1,000 valuation). 3. Elevator Inspection Fees $50.00 $75.00 Proposal is to increase elevator recertification inspection fee to recoup a greater portion of the actual man hour costs attributed to the various Building Code tests required to maintain an elevator in operation. A typical elevator recertification requires approximately 3 hours of the inspector's time at an (total) hourly rate of $26.55 = $79.66 actual service cost. 4. UpgradinR Electrical Services Fees Graduated Scale Graduated Scale Proposal is to revise a portion of the fee schedule for the upgrading of existing electrical services in buildings based on the electrical amps of the service and the costs of materials. This proposal would place the fees charged more in line with the cost of the type of job (residential, co~nercial or industrial) as well the materials used. See attachment labelled Exhibit A for proposed revision in fee schedule. 5. Plumbing Inspection Fees Graduated Scale Graduated Scale Proposal is to institute fees for inspection of roof drains, interceptors, backflow preventors, backwater valves, new water line installation and commercial building sewers (storm and sanitary), water lines and gas lines where permits are currently not issued nor fees collected but Members of City Council Page 3 May 11, 1992 inspection work is done by building department staff. The proposed fee schedule for these items have been set up on a cost basis similar to the line items that are currently charged through the mechanical and electrical fee schedules; this proposal also includes upgrading the current fee schedule for existing plumbing inspections as shown in attachment labelled Exhibit B. 6. Certificate of Occupancy (Current Fee) $14.00 (Proposed Fee) $25.O0 Proposal is to increase the flat fee charged for all COs issued by the Building Department; this rate change would place the City in a more comparable rate status with two other neighboring jurisdictions (Salem - $10.00; Roanoke County ~ $25.00 for business/industrial and $10.00 for temporary CO for residential). 7. Re-inspection Fees $10.00 $25.00 Proposal is to increase flat fee charged for re-inspections conducted by the various inspection staff members. Repeat inspections are often conducted due to partial completion of correction work orders or in cases when different subcontractors (on the same job sites) call in inspection requests for the same work where correction orders had been left undone. The purpose of this proposed fee increase is to recover part of the cost for such re-inspections. City Council disapprove the proposed fee schedule increases. Cost of providing services will continue to increase and an equitable balance between cost and revenue collected will not be achieved. Estimated revenue ~eneration from proposed fee increases as shown in Building Department budget package for Fiscal Year 1992-93 (approximately $23,650) would not occur. Consistency of fees for the parking garages located in the immediate market area and for the other parking garages will be improved. This improvement will promote a more even distribution of parkers within each garage. Reasonableness of fees will be maintained as, overall, the proposed parking garage fees represent only a modest increase from the current rates. In addition, the proposed parking garage fees are comparable to the fees being established by the Roanoke Redevelopment and Housing Authority and the Greater Roanoke Transit Company for similar parking structures. And finally, it is well within reason to charge a monthly reserved parking fee that is approximately 120% of the monthly un-reserved parking fee when, contractual obligations aside, this is the amount of revenue that would be generated from each parking space if it were not reserved. Timing will permit implementation of the proposed parking garage fees by the July 1, 1992 effective date. City Council not approve the proposed parking garage fees as denoted within Alternative A, but instead refer the matter to budget study. Transportation Fund budget proposed for FY 91-93 will not be balanced. Balancing the Transportation Fund budget will ultimately require either approval of parking garage fees that are comparable to the fees proposed, or approval of an increase in the General Fund subsidy to the Transportation Fund. Consistency of fees will not be improved. The distribution of parkers within each garage will not change as a result of the parking garage fees unless the fees charged for use of each garage, especially the three garages located within the immediate market area, become more consistent. Reasonableness of fees, while not presently an issue, has the potential to become an issue in the event an increase in the General Fund subsidy to the Transportation Fund is chosen in lieu of an increase in the parking garage fees. 4 o Timing will delay balancing of the Transportation Fund budget until such time as Council might approve otherwise or address the matter in budget study. The Pay Plan adopted by this Ordinance shall remain in effect until amended by Council. 3. Pursuant to S2-68, Code of the City of Roanoke (1979), as amended, effective July 1, 1992, the City Manager shall promulgate and cause to be distributed among the officers and employees of the City a Classification Plan, consisting of a plan of classification assigning a pay grade and pay range in accordance with this Ordinance and class code to each position in the classified service of the City. 4. A merit increase in the amount of 3.0 percent of annual base salary shall be provided each officer or employee achieving satisfactory review of service on his merit review date under merit evaluation procedures promulgated by the City Manager; provided, however, when any such merit increase would cause an officer or employee to exceed the maximum annual pay range applicable to such officer's or employee's position on June 30, 1992, or July 1, 1992, such officer or employee shall receive a merit increase only in such amount as will not exceed the maximum pay range for such officer's or employee's position on June 30, 1992, or July 1, 1992, whichever is greater. The merit review date for all officers and employees shall be July 1, 1992. 5. In order to provide a continuum between minimum and midpoint of each pay range based on days of service in current job, an officer or employee whose base salary does not exceed the midpoint of the pay range after the merit increase provided for in paragraph 4, shall be placed in the pay range at his salary after - 3 - the three percent merit increase or in accordance with the interpolation formula set out below, whichever is greater: Interpolated Salary = Minimum + (days of service in current job up to 2,556 / 2,556) X (Midpoint - Minimum). AS in the case of the merit increase, a satisfactory review of service on July 1, 1992, is required in order to receive the benefits of interpolation. 6. If after the merit increase provided for by Paragraph 4 any officer's or employee's salary is below the applicable minimum for his pay range, such officer's or employee's annual base salary shall be adjusted to the applicable minimum effective July 1, 1992. 7. The Code of the City of Roanoke (1979), as amended, is hereby amended and reordained by the addition of the following new subsection (f) to §22.1-45, Early service retirement allowance, of Chapter 22.1, Pensions and Retirement: §22.1-45. Early service retirement allowance. *** (f) Benefit calculation rule for council members on or after June 30~ 1992. For purposes of subsection (b) (but not the minimum benefit under subsection (d)), a member shall have his benefit amount calculated under subsection (b) at any time he is a council member on or after June 30, 1992 on a basis which treats his actual membership service as of such time as being multiplied by a factor of two (2). Any such benefit amount determined on the basis of the service crediting provisions of this subsection shall be payable without the reduction provided for in subsection (b). 3. In order to provide for the usual daily operation of the municipal government, an emergency is deemed to exist, and this ordinance shall be in full force and effect upon its passage. 4. The subsections of the Code of the City of Roanoke added by this ordinance shall automatically be deemed repealed as of the sunset date described below and, except as otherwise provided below, shall have no force and effect on and after the sunset date. For purposes hereof, the sunset date is the effective date as to the City of Roanoke Pension Plan of regulations under §401(a)(4) of the Internal Revenue Code now or hereafter issued by the United States Department of Treasury which would cause the qualification of said Plan under S401(a) of the Internal Revenue Code to be adversely affected because of the operation of subsections added by this ordinance. Therefore, I am attaching for the consideration of Council two opinions from Wallace M. Starke, Esquire, a pension law expert with Mays and Valentine of Richmond. The first opinion, dated May 6, 1992, holds that the "two for one" service credit rule does not violate minimum participation rules of the Internal Revenue Service and will not before June 30, 1995, violate non-discrimination rules of the Internal Revenue Service. Importantly, Mr. Starke opines that adoption of the benefits should not cause the City of Roanoke Pension Plan (the "Plan") to lose its tax qualified status. The second opinion, dated May 8, 1992, relates to the "sunset" clause applicable to each ordinance. The "sunset" is the effective date as to the Plan of the Department of Treasury's promulgation of regulations under S401(a)(4) of the Internal Revenue Code which would adversely affect qualification of the Plan. Mays and Valentine has approved the "sunset" language incorporated in the two ordinances. Those letters generally concluded that the effective date of those rules as to the City of Roanoke Pension Plan would be the plan year beginning July 1, 1993. On February 11, 1992, the IRS issued Announcement 92-29 (a copy of which is enclosed) which delayed the effective date of the final regulations under IRC Section 401(a)(4), but not IRC Section 401(a)(26), until the plan year beginning July 1, 1995 in the case of the City of Roanoke Pension Plan. What this means is that the prior IRS "automatic" approval operating policy (which in May, 1989 was announced as being revoked for non-discrimination benefit testing for plan years beginning in and after 1989) is effectively being continued until the plan year beginning in 1995. Thus, it appears that the "2-for-l" service credit rule might be extended for service, compensation and benefit calculations up through .June 30, 1995 under the City's Pension Plan without violating IRC Section 401(a)(4). I have briefly reviewed the IRS final regulations dealing with IRC Section 401(a)(26) (relating to the min/mum participation rule). I am of the opinion that a "2-for-l" service credit rule is not prohibited under the minimum participation rule as applied to the City's Pension Plan so long as it is applied only to Council m~mhers and Council appointed officers who served on or before June 30, 1993 (including those who served at any time before the date of adoption of an ordinance amending the Pension Plan -- if that is desired) and/or who serve during a specified period while the "2-for-l" service credit rule is effective. In summary, ~ am of the opinion that an amendment to the City's Pension Plan which adds a "2-for-l" service credit rule which will provide a doubling of the regular benefit prior to, and a minimum benefit equal to double the regular benefit at, a "sunset" date (which is June 30, 1995 or any other date as of which a uniform benefits non-discrimination requirement will become effective for the Pension Plan) on more or less the same basis as was done in June, 1989 should not cause the Pension Plan to lose its tax qualified status. (a) On and after June 26, 1989, the city manager, city attorney, director of finance, municipal auditor, director of real estate valuation and city clerk (hereinafter referred to as "council-appointed officers") and their successors shall be members of the City of Roanoke Pension Plan. Any council-appointed officer who was a member of the employees' retirement system on June 30, 1984, shall remain a member of the employees' retirement system. On and after July 1, 1992, any payment by the City to the ICMA Retirement Corporation Deferred Compensation Plan ("ICMA") on behalf of any such Director shall terminate. To the extent and only to the extent that Ordinance no. 24839, adopted September 10, 1979, requires a contribution to ICMA on behalf of any such Director and precludes any such officer from participation in the City of Roanoke Pension Plan, Ordinance No. 24839 is superseded by this Ordinance. 5. AN ORDINANCE amending S22.1-44, Normal service retirement, §22.1-45, Early service retirement allowance, and §22.1-62, Retirement and service retirement allowance qenerally, of Chapter 22.1, Pensions and Retirement, relating to participation of certain City officers in the City of Roanoke Pension Plan and establishing certain terms and conditions of such membership; providing for an emergency and effective date; and providing for the sunset of this ordinance should certain existing or future regulations under the Internal Revenue Code promulgated by the United States Department of Treasury regarding the qualification of public sector pension plans become effective. BE follows: 1. IT ORDAINED by the Council of the City of Roanoke as The Code of the City of Roanoke (1979), as amended, is hereby amended and reordained by the addition of the following new section (i) to ~22.1-44, Normal service retirement, of Chapter 22.1, Pensions and Retirement: §22.1-44. Normal service retirement. (i) Benefit calculation rule for council-appointed officers on or after June 30~ 1992. For purposes of subsection (c) (but not the minimum benefit under subsection (g)), a member shall have his benefit calculated under subsection (c) at any time he is a council-appointed officer (as defined in §22.1-4.1) on or after June 30, 1992 on a basis which treats his actual membership service as of such time as being multiplied by a factor of two (2). 2. The Code of the City of Roanoke (1979), as amended, is hereby amended and reordained by the addition of the following new subsection (g) to S22.1-45, Early service retirement allowance, of Chapter 22.1, Pensions and Retirement: §22.1-45. Early service retirement allowance. (g) Benefit calculation rule for council-appointed officers on or after June 30~ 1992. For purposes of subsection (b) (but not the minimum benefit under subsection (e), a member shall have his benefit amount calculated under subsection (b) at any time he is a council-appointed officer (as defined in ~22.1-4.1) on or after June 30, 1992 on a basis which treats his actual membership service as of such time as being multiplied by a factor of two (2). Any such benefit amount determined on the basis of the service crediting provisions of this subsection shall be payable without the reduction provided for in subsection (b). 3. The Code of the City of Roanoke (1979), as amended, is hereby amended and reordained by the addition of the following new subsection (f) to ~22.1-62, Retirement and service retirement allowance qenerally, of Chapter 22.1, Pensions and Retirement: §22.1-62. Retirement and service retirement allowance generally. (f) Minimum benefit for council-appointed officers on or after June 30, 1992. Notwithstanding the regular amount of benefit calculated under subsection (c) or and as an alternative to the minimum benefit provided for under subsection (e), a member who is a council-appointed officer on or after June 30, 1992 shall be entitled to a minimum benefit equal to his benefit calculated under the ESRS as of the date he last is a council-appointed officer as though he were a member of the ESRS and not a member of the ERS. Any such minimum benefit determined pursuant to this subsection shall be payable without any reduction otherwise applicable under §22.1-63(a) where such minimum benefit is payable as an early service retirement allowance. municipal ordinance In order to provide of the usual daily operation of the government, an emergency is deemed to exist, and this shall be in full force and effect upon its passage. The subsections of the Code of the City of Roanoke added by this ordinance shall automatically be deemed repealed as of the sunset date described below and, except as otherwise provided below, shall have no force and effect on and after the sunset date. For purposes hereof, the sunset date is the effective date as to the City of Roanoke Pension Plan of regulations under §401(a)(4) of the Internal Revenue Code now or hereafter issued by the United States Department of Treasury which would cause the qualification of said Plan under S401(a) of the Internal Revenue Code to be adversely affected because of the operation of any of the subsections added by this ordinance. Based on existing regulations, the sunset date would be July 1, 1995. As of the sunset date, the benefit provided by this ordinance for each affected member shall be calculated under the provisions of this ordinance as of the day before the sunset date, and such benefit shall be treated as a minimum benefit for the member under the City of Roanoke Pension Plan. The retirement allowance payable on account of certain members of the City of Roanoke Pension Plan being defined in Paragraph 2 infra who retired prior to July 1, 1991, shall effecsive July 1, 1992, be increased by three (3) percent of itself. 2. Such lump sum payment shall be made on or before July 31, 1993. 4. In order to provide for the usual daily operation of the municipal government, an emergency is deemed to exist, and this ordinance shall be in full force and effect on July 1, 1992. Schlanger Cost of Living Raise for Retirees - FY93 and FY94 Certain members of the city of Roanoke Pension Plan have not received a permanent cost-of-living adjustment since July 1, 1989, as Ordinance No. 29558, dated May 8, 1989, provided the supplemental benefits be provided as a permanent cost-of-living payment effective July 1, 1989, and a lump sum payment as of July 1, 1990. As you are aware, no cost-of-living adjustment was provided last year (FY91) due to the City's financial position. Certain retirees have requested that future COLA's be made permanent as they felt that a one-time payment is good for one year but does not help them for future years. However, other retirees have informed us that they like the one-time payments as that provides them with a lu~np sum that would be spent for a major purchase or they have the alternative of budgeting the amount over the twelve month period. After much study and consideration, we recommend the following to you= That effective July 1, 1992, and payable July 31, 1992 a permanent increase shall be made to a member.s or surviving spouse's Honorable Mayor and Members of City Council May 6, 1992 Page 2 annual retirement allowance who retired as of July 1, 1991 and that meets the following criteria= Any member retired under normal service with at least 10 years of creditable service; or Any member retired on non-occupational disability with at least 10 years of creditable service or any member retired on occupational disability, regardless of service; or 3. Any member retired under early service retirement, vested service retirement; or 4. Any surviving spouse of a member who was entitled to a benefit, provided that the deceased member would have qualified under (1), (2), or (3) above; or Any member retired under Chapter 2, Police and Fire Pensions prior to January 1, 1946, or the surviving spouse of any such member. Out of a total number of 1,097 receiving benefits as of April 30, 1992, 893 general employees, or 81%, would be eligible for this increase under the above guidelines. The total annual increase in retirement allowances would be $147,241 or an average annual retirement allowance increase of $164.88. A 3% permanent COLA is estimated to cost $1,100,000 funded actuarlally over 20 years. We have also received our actuarial rate for the fiscal year beginning July 1, 1992. The rate has increased from last year's rate of 12.39% to 12.50%, reflecting the impact of the voluntary retirement program. We also recommend that for the fiscal year beginning July 1, 1993, that a 3% lump sum payment be made July 2, 1993, to certain members of the City of Roanoke Pension Plan who meet the same above criteria. This 3% lump sum payment will be based on their new monthly benefit effective July 1, 1993. This increase will cost approximately $160,000 and would be funded from any year-end balance at the end of flscal year 1993 before any CMERP funds are designated. Ordinance No. 31005-051192 - provides for a permanent cost of living raise effective July 1. 1992 of 3% for certain retirees. I believe the categories for those who are eligible are equal to previous years. One interesting point is the fact that the ordinance was drafted to specifically exclude those retirees who retired under our early out program. Their effective date of retirement was July 2, 1991 and thus are not eligible for this permanent COLA. Paragraph 3 provides for a lump sum payment effective July 1, 1993 for those eligible in the categories listed under paragraph 2. The "early out" program retirees wil% be eligible for the lump sum payment but only on their retirement allowance - not on their incentive payment. City Council has agreed to partially fund the permanent COLA at the end of this fiscal year by transferring $250,000 directly from the General Fund to the Pension Plan prior to the determination of any FY92 fund balance. City Council has also agreed to fund the entire actual cost of the lump sum payment to be granted on July 1, 1993 from any year end balance at the end of fiscal year 1993. Ordinance No. 31003-051192 - this ordinance extends the "2 for 1" program which per past ordinance was a frozen benefit as of 6/30/89. The ordinance extends it to 6/30/95 per Section ~ - and will automatically extend should the IRS extend the date again. This is for Council-appointed officers. John Thompson' May 27, 1992 Page 2 Ordinance No. 31001-05119~ - extends the "2 for 1" program for City Council members in the same fashion as for Council-appointed officers. Ordinance No. 31002-051192 - provides that the Director of Human Development (James Ritchie) and the Director of Public Safety (George Snead) be placed back into the Retirement System effective 7/1/92 and credited with all past service. Prior to this they received deferred compensation in lieu of the Retirement System credit. No contribution will be made on their behalf to fund their past service. Where any hotel has entered in to a written contract prior to May 11, 1992, which contract provides for room rental to transients at a fixed price which includes all taxes, then each room rental under such contract shall be subject to a tax at the rate of four (4) percent of the total amount paid for such rental. 3. WHEREAS, the Appalachian Regional Commission (ARC) was formed in 1965 to enhance the economic development and the quality of life of the people in the Appalachian area of the United States; and WHEREAS, ARC, through its federal, state and local partnership, has pursued its mission in a very effective manner by supporting local economic development projects and could be of great assistance.to the City of Roanoke in its economic development efforts; and WHEREAS, the City of Roanoke has significant economic linkages with the counties and cities in the ARC region of western/southwestern Virginia and southeastern West Virginia, and recognizes the need to approach economic development from a regional perspective; and WHEREAS, the ARC region currently includes three counties adjacent to and having close economic and social ties with the City of Roanoke; and WHEREAS, the City of Roanoke's ability to promote industrial growth within this region of the Commonwealth of Virginia could be greatly enhanced by participation in the Appalachian Regional Commission. NOW, THEREFORE, BE IT RESOLVED as follows: 1. The City of Roanoke, Virginia requests Sixth District Congressman Jim Olin to pursue the inclusion of the City of Roanoke in the membership of the Appalachian Regional Commission. 2. BACKGROUND: Appalachian Reqional Commission (ARC) was created by Congress in 1965 as a mechanism for building a better economy and quality of life for the people of the Appalachian region. The Virqinia portion of the ARC encompasses 21 counties, the easternmost is Pulaski and to the north Covington and Clifton Forge. Participation in the ARC was rejected in the 1960's by officials in Roanoke because the perceived poor image of being associated with Appalachia. II. CURRENT SITUATION: Appalachian Regional Commission continues to fund a number of programs. Over the last few years funds from ARC have been used to support the solid waste recycling effort in the Allegheny Highlands, special vocational programs as Jackson River Vocational School, special literacy programs in the Allegheny Highlands, site improvements for the Covington Industrial Park and Allegheny County Industrial Park. ARC funds have been used in other Virginia communities to fund geographic information systems, childcare centers, water/sewer line expansion and industrial access roads. Conqressman Richard Boucher has introduced leqislation to amend the Appalachian Regional Development Act to include Montgomery County in the Appalachian Region. Fifth Planninq District Commission has been working with Congressman Olin to submit a similar resolution which would consider Roanoke Valley governments for inclusion in the Commission area. Members of Council May 11, 1992 Page 2 Roanoke City governments would not meet the criteria that is normally used to qualify a community in the region. They are: Per capita market income no greater than 67% of the U.S. average. Property rate at 150% of the U.S. average or greater. Three year unemployment at 150% of the U.S. average or greater. Eo Fifth Planning District Commission staff, in conversations with the ARC staff, have been led to believe that although Roanoke Valley governments don't meet those criteria, a successful argument could be made about the link between the Roanoke Valley and those counties in Western Virginia that do qualify. That is, what happens in the Roanoke Valley can have a dramatic effect on those Appalachian Region communities. Fifth Planning District Commission has asked Roanoke Valley governments to pass a resolution that would support Congressman Olin's efforts to get Roanoke Valley governments included in the ARC. III. ISSUES: A. Timing. B. Benefits. IV. ALTERNATIVES: Recommend Roanoke city Council pass the attached resolution in support of Congressman Olin's effort to pursue the city of Roanoke's membership in the Appalachian Region Commission. Timing is important in that Congressman Olin will be appearing before the House Public Works Committee on May 14, 1992. Benefits would be, if he succeeds in getting Roanoke Valley governments included, to make us eligible for a variety of grant programs for which we are not now under consideration. Image problems and concerns associated with being a part of ARC are not as much an issue today as they were Members May 11, Page 3 of Council 1992 20-25 years ago. Major cities in the ARC include Huntsville and Birmingham, Alabama; Charleston, West Virginia; portions of Atlanta, Georgia; portions of Lexington, Kentucky; Pittsburgh, Pennsylvania; Asheville and Winston-Salem, North Carolina; Greenville and Spartanburg, South Carolina and Chattanooga and Knoxville, Tennessee. Do not support the attached resolution in support of Congressman Olin's effort to pursue our jurisdiction membership in the Appalachian Region Commission. RECO~ENDATION: Recommend Alternative A. Morgan (the Developer), requesting the Authority to issue up to $4,600,000 of its revenue bonds or notes (the Bonds) to assist the Developer (or a corporation of which he is the majority stockholder or a limited partnership of which he or such a corporation is the general partner) in the acquisition, rehabilitation and equipping of a 168-unit apartment complex (the Facility) located at 100 Kimball Avenue in the City of Salem, Virginia and known as Mount Regis Village Apartments. Notice of such hearing was published on April 27, 1992 and May 4, 1992 in the Roanoke Times & World- News. The public hearing was held at the Authority's office, 2624 Salem Turnpike, N.W., Roanoke, Virginia. At the meeting those persons interested in the issuance of the Bonds or the location and nature of the Facilities were given the opportunity to present their views. The public comments, if any, received at the meeting are summarized in the exhibit attached hereto. After such hearing, the Authority voted to recommend the approval of the Bonds to the City Councils of the City of Roanoke, Virginia and the City of Salem, Virginia (collectively, the Councils). Accordingly, the Authority hereby recommends to the Councils that they approve the issuance of the Bonds, as required by Section 147(f) of the Internal Revenue Code of 1986, as amended.
