A report recommending execution of an agreement with the
Town of Vinton authorizing the Town's fire trucks to use
OPTICOM equipment at City traffic signals, subject to a
reciprocal agreement by the Town of Vinton.

A report recommending transfer of $100,000.00 in connection
with traffic signalization at the intersection of Colonial Avenue

agreement with Total Action Against Poverty for the
Transitional Living Center, which would provide for a five-

the State Water Control Board with regard to high treatment

A report of the committee appointed to tabulate bids received for
demolition and removal of the acoustical enclosure at the Roanoke
Civic Center Auditorium, recommending that both bids received be
rejected; and that the City Manager be authorized to take certain

A communication from A. E. Mitchell and Co., Inc., protesting the
rejection of their proposal was referred to the City Manager and City
Attorney for response.
A report recommending ratification of certain agreements with the
Roanoke Valley Resource Authority, and acknowledging issuance of
the Authofity's Solid Waste System Revenue Bonds, Series 1992.

Ordinance No. 31016, on second reading, waiving the standard rental
fee for use of certain City facilities for Roanoke Festival in the Park,
and granting certain concession rights in conjunction with such event.

Inquiries and/or comments by the Mayor and Members of City
Council.
A proposal of Mayor-Elect Bowers with regard to holding a Roanoke
Economic Summit on July 1 was referred to the Chairman of the
Economic Development CommL~sion and the City Manager for report
and recommendation to Council.
Vacancies on various authorities, boards, commissions and committees
appointed by Council.
10. OTHF~R HF. ARINGS OF CITIT~.NS:
Ms. Pamela Hultquist, representing the PTA of Garden City Elementary
School, commended the Manager of the Department of Parks and Recreation
for his efforts in making Garden City Park more accessible to students and
for the overall condition of the park.

The regular meeting of the Council of the City of Roanoke will
be held on Tuesday, May 26, 1992, at 7:00 p.m., in the Gymnatorium
at the Garden City Elementary School, 3718 Garden City Boulevard,
S.E. Citizens are invited and encouraged to attend the Council
meeting, as well as an informal discussion hour at 6:00 p.m., to
talk with the Mayor, Members of City Council, the City Manager and
City staff with regard to matters of mutual interest and concern.

School Board Request for the Appropriation of Grant
Funds and Closeout of Grants
I have reviewed the attached request to appropriate grant
funding and to close out grants for the School Board. This
report will appropriate state funding for one grant for Fiscal
Year 1992-1993. The request to close grants is necessary since
the grant programs have been completed.
I recommend that you concur with this request of the
School Board.

Dear Members of Council:
As the result of official School Board action at its May 12, 1992
meeting, the Board respectfully requests City Council to appropriate $54,988
for Special Education Aides for the 1992-93 school year for the self-
contained Educable Mentally Retarded classes. Funds have been made
available from the state.
The Board further requests City Council to approve the closeout of 48
completed grants for a net decrease in appropriation of 951,149.00 as the
result of changes in programs according to the level of participation by
eligible students.

A RESOLUTION authorizing a Reciprocal Agreement between the Town of
Vinton and the City of Roanoke providing for certain of the Town of Vinton's fire
equipment to utilize the traffic signal preemption equipment within the City of
Roanoke and for certain of the City of Roanoke's fire equipment to utilize the traffic
signal preemption equipment within the Town of Vinton.
WHEREAS, the Town of Vinton ("Town") has installed traffic signal
preemption equipment at certain intersections within the Town, and the City of
Roanoke ("City") has installed traffic signal preemption equipment at certain
intersections within the City; and
WHEREAS, the Town and the City each desire that certain of eaeh's fire
equipment be permitted to utilize the traffic signal preemption equipment of the
other;
THEREFORE, BE IT RESOLVED by the Council of the City of Roanoke as
follows:
1. The City Manager is hereby authorized, for and on behalf of the City,
to enter into a Reciprocal Ag~'eement between the Town and the City, providing that
certain fire equipment of the Town shall be permitted to utilize treffie signal
preemption equipment within the City and that certain fire equipment of the City
shall be permitted to utilize traffic signal preemption equipment within the Town.
2. Such Agreement shall provide for mutual indemnification and shall be
approved as to form by the City Attorney.

SUBJECT: REQUEST FROM THE TOWN OF VINTON REGARDING OPTICOM
I. Background:
The Emergency Vehicle Traffic Signal Preemption Program
(also known as Opticom) consists of mechanisms that
enable emergency vehicle operators to temporarily gain
control of any traffic signal that is equipped with
OPTICOM. When activated, the emergency vehicle is given
a green light along the emergency response route. This
results in a more effective, reliable, and safer priority
movement of emergency vehicles at signalized intersec-
tions.
If a signal is already green, the traffic control unit
holds the green light until the emergency vehicle clears
the intersection. If the signal display is red, the
OPTICOM system directs the traffic signal control unit to
provide a green light, thus clearing stacked up traffic,
before the emergency vehicle arrives at the intersection.
City of Roanoke began using OPTICOM in 1986. It is
anticipated that OPTICOM will be in place at 80 of the
City's 135 traffic signals by the end of 1992, with plans
to continue installing OPTICOM at virtually all of the
City's traffic signals.
Fire trucks are the City's only emergency vehicles
equipped with the OPTICOM devices which are needed to
gain control of traffic signals. The size and limited
maneuverability of large fire trucks makes the OPTICOM
system most beneficial. To also equip the other numerous
police and rescue vehicles in the City would increase the
possibility of competing demands at signalized
intersections.
II.
Current Situation:
A. Town of Vinton is presently equipping three (3) of its
traffic signals and two (2) fire trucks with traffic
signal preemption equipment identical to that used by the
City of Roanoke. Vinton's Town Manager, on behalf of
Town Council, has requested that the City allow Vinton
emergency vehicles to utilize the OPTICOM equipment in

its emergency vehicles to control traffic signals within
the City of Roanoke during emergency responses (limited
only to fire trucks).
Primary route throuqh Roanoke by Vinton fire trucks would
involve northbound Gus Nicks Boulevard to Orange Avenue,
then either turn right to reach Alt. U.S. Route 220 or
turn left to reach Plantation Road, then north to the
Hollins community.
City of Roanoke, by reciprocal agreement, desires to be
able to use its OPTICOM equipment to gain control at
Vinton's traffic signals, during the few instances that
this is likely to occur.
Agreement, including mutual indemnification and hold
harmless clauses, would need to be developed by City and
Town staffs and authorized by both governing bodies.

TRAFFIC SIGNALIZATION AT THE INTERSECTION
OF COLONIAL AVENUE AND OVERLAND ROAD, S.W.
I. Background:
Traffic Signalization at the intersection of Colonial
Avenue and Overland Road, S.W., is a location justified
for signalization in the City of Roanoke.
Be
City Council, at a regularly scheduled meeting on
February 10, 1992, endorsed several traffic control
measures as an alternative to barricading the Wright
Road, Creston Avenue and Rosewood Avenue corridor.
Ordinance No. 30869-021092 directed the City Manager to
implement certain traffic control measures, one of which
is the signalization of Colonial Avenue and Overland
Road, S.W.
II. Current Situation:
Traffic signal plans are presently being developed. Upon
completion, these plans will enable the City to begin
material requisitions for items such as the traffic
signal controller and cabinet, as well as galvanized
poles with mast arms which usually require five (5)
months for fabrication and delivery. Related underground
conduit and pole base work will need to be contracted
out.
Schedule for completion of the entire traffic signal
installation is presently expected to occur in November,
1992.
Fundinq in the amount of $100~000 needs to be established
in a capital account to enable the above referenced
purchases and future contracts.

Program grant from the U.S. Department of Housing and Urban
Development in the amount of $808,635 ($161,727, annually)
to assist with operating costs for the Transitional Living
Center.

and pledges to match the Supportive Housing Demonstration
Program grant by November 15, of each funding year.

Impact on TAP program would be negative, requiring an

I. Back~round:
Attached is a draft of a proposed Consent Special Order currently
being negotiated between City staff, staff of the other local
jurisdictions who receive sewage treatment services at the City's
Sewage Treatment Plant, and the staff of the Virginia Water
Control Board (VWCB).
This Consent Special Order is the result of high sewage treatment
flows (and rainfall) going back to 1989 as well as the VWCB's
desire for us to increase our pre-treatment efforts, particularly
enforcement on qualifying industries.
Alternatives to the Consent Special Order are varied, but all are
potentially unpleasant. These alternatives include any of the
following:
1. A hearing before the Board of the VWCB
2. Potential fines
3. Curtailment of new sewer service extensions
Requirement that we immediately begin the $46~000~000 sewage
facility expansion program
Certain requirements are included in the Consent Special Order
which can be met with the cooperation of the other jurisdictions.

This is a Special Ordor (the "Order"), issued by the ~tste Water
Control Board {the "Board") under the authority o~ Sections
62.1-44.15(aa)-($d) of the Code of virginia to the City of
Roanoke (referred to below es "Roanoke").
Roanoke owns and operates a Wastewater treatment facility known
as the Roanoke Regional Sewage Treatment Plant. The Roanoke
Regional Sewage Treatment Plant discharges treated effluent to
the Roanoke River which is in the Roanoke River Basin. The
wa~tewater treatment facility ia the subject of VPD~S Permit No.
VA0025020 (the "Permit") which was issued to Roanoke by the Board
effective F~bruary 2, 19U9.
The Roanoke Regional Sewage Treatment Plant exceeded its
permitted discharge Of 35 MGD for 3 consecutive months thereby
violating section 4.1 of the Board's Permit Regulation. To
address the inflow and infiltration (the "Iai") which has
resulted in the excessive flows, a Consent Special Order was
issued to Roanoke on October 3, 1990 which required compliance
with a schedule for Iai re~uotion.
Roanoke substantially complied wit~ the requiremcnts of the
October 3, 1990 Consent Special or,er, however, influsnt ~lows to
the Roanoke Regional Sewage ~reatment Plant still periodically
exceed 95% of its design capacity. Overflowm from the sewer
collection uystem due to Iai have also been re~orted.
In order to insure that Roanoke continues tO addL'ess its
excessive flows in an appropriate manner, the Board orders and
Roanoke agrees to comply with the schedule of corrective actions
in Appendix A attached hereto.

15, 1991 and prior;

required parameters (resulting in significant
noncompliance status).

1992 citing the following violations at the Roanoke
Regional Sewage Treatment Plant which occurred on December
30, 1991 and prior;

Order:

Although Roanoke does not completely concur with the reasons for
the NOVs, in order that Roanoke may come into compliance with its
VPDES permit's pretreatment requirements as expeditiously as
possible, and as a way of addressing the requirements of the NOVs
recited above in · manner acceptable to both parties, the Board
orders and Roanoke agrees to comply with the list of requirements
in Appendix B attached hereto.
Roanoke agrees to be bound by any dates indicated in this Order
which may precede the date of execution of this order by the
Executive Director.
Roanoke waives its rights to service of, a hearing on, written
findings of fact and conclusions of law in support of, end Judicial
review of this Order. Roanoke further agrees that the Board may
cancel this Order in its sole discretion upon thirty days written

APPENDIX A
Submit to the State Water Control Board,s West Central
Regional Office for review, a system-wide aewershed
evaluation plan. The Sewershed evaluation plan shall
incorporate at least 8 monitoring points from which dry and
wet weather flow are to be collected. The data from these
monitoring points shall be used in developing and
prioritizing I&I corrective action projects and for
quantifying their success.
In addition, all plans and specifications submitted to the
State Water Ccntrol Board regarding proposed new connections
or sewer line extensions shall include actual flow
monitoring 4ate which justifies downstream sewer capacity
and treatment plant capacity.
The sewershed evaluation plan shall be submitted as soon as
possible, but no later than June $0~ i**2.
Submit, for State Water Control Board Executive Director
approval, an approvable list of proposed I&I corrective
action projects. The goal of the combined corrective action
projects shall be the reduction of monthly average influent
flows to less than 95% of the STP's permitte~ ~esign flow
and the elimination of I&I related system overflows within
one year of the issuance of this Order. Plans for achieving
this goal shall take into account any proposed new
connections and their associated input.
The proposed I&I corrective action projects and their
schedules of implementation shall be due as soon as possible
but no later than December X, 1992.
Upon approval of the i&I corrective action projects and
their schedules of implementation, the corrective action
projects shall be incorporated herein by reference as an
enforceable part of this Order.
Corrective action projects may be substituted, deleted or
modified only after the written approval of the Board's
Executive Director. Upon Executive Director approval, the
proposed substitutions, or modifications to the I&I
corrective action projects shall be incorporated herein by
reference as an enforceable part of this Order.
Submit a report quantifying the success of the corrective
action projects upon their completion but in no case later
than Ju~ $~, 1993 and annually thereafter. The annual
reports shall contain a 1let of I&I reduction projects for
the upcoming year, which, upon approval by the Board's
Executive Director, shall be incorporated herein by
reference as an enforceable part of this Order.

Evaluate industrial users and POTW monitoring data from 1991
in terms of criteria for Significant noncompliance as
defined in 40 CFR Part 403.8 (f)(2) (vii). Publish the names
of those industries determined to be in significant
noncompliance in the largest daily newspaper in the
municipality and initiate appropriate enforcement action
against such industrial users. Minimum level of enforcement
for violators in significant noncompliance shall consist of
an administrative Order with a compliance schedule,
including provisions for monetary Penalties if the final
compliance date is not achieved. The preceding shall be
accomplished as soon as possible but no later than
July 1, 1992.
In accordance with Section 7.7 (B)(1) of ~FR 680-14-01,
submit local ordinance and local limits for formal approval
by the State Water Control Board's Executive Director. This
submittal shall be submitted es soon as possible, but no
later than July 15, X992.
Correct the Enforcement Response Plan (the "ERP,,) to conform
with 40 CFR Part 403.8 (f)(5) in accordance with the
comments outlined in correspondence dated March 11, 1992

Backqround:
On January 13~ 1992, following a performance of
the Roanoke Symphony, the stage crews were
returning the Acoustical Enclosure to its stored
position when they heard a peculiar noise and
immediately they stopped the lifting mechanism of
the Acoustical Enclosure. The Enclosure settled
down until it was resting on the stage floor and
at the wall where it is hinged. Upon inspection
it was found that two of the five sheaves used for
the storage lifting hoist and cables had pulled
loose from their structural support beam.
A local architectural/enqineerinq firm was
employed to examine the Acoustical Enclosure to
determine if it created a hazard. The firm
determined that it did not present a safety hazard
as it was but they did recommend that the ceiling
leaf of the enclosure be tied to the back wall,
which was done.

The City of Roanoke employed the consulting firm
of ARTEC, Theater Consultants, a nationally
recognized firm, to advise the City as to what
should be done with the Acoustical Enclosure. The
primary user of the Enclosure, the Roanoke
Symphony, concurred with the selection of this
consultant. Since the Enclosure was one of the
early designs for Acoustical Enclosures and the
Symphony was not pleased with its acoustical
qualities, the consultants recommended the removal
of the existing shell, by a firm familiar with
this type of stage equipment, and then consider a
replacement. Since the Enclosure is resting on
the floor some twelve feet (12') off the back wall
it will restrict the Miss Virginia Pageant and
could impact other events if not removed prior to
July 1, 1992.

Contract documents were mailed to known stage
rigging firms as recommended by the consultant.
Because of the estimated cost of the work, the
contract documents also required a Class "A"
contractors license in the State of Virginia.
Bids, following proper advertisement, were
publicly opened and read aloud before City Council
on May 11, 1992, for the Demolition and Removal of
the Acoustical Enclosure at the Civic Center
Auditorium.
F. Two (2) bids were received with A. E. Mitchell and
Co., Inc. of Falls Church, Virginia submitting the
apparent low bid in the amount of $67~720.00.
Time of completion was specified as July 1, 1992.
Issues in order of importance are:
Compliance of the bidders with the requirements of
the contract documents.

Alternatives are:
Council reject both bids, declare an emergency,
negotiate and award contract with a qualified
contractor.

comply with the requirements of the
contract documents as follows:
A. E. Mitchell and Co., Inc. indicated
an inability to post a performance and
payment bond. They will not guarantee
the specified completion date of July 1,
1992 unless they were told to commence
by May 25, 1992 at the latest and that
access to the work area could be
guaranteed as shown by the schedule of
events contained in the contract
documents. Of the ten projects
submitted as references for similar
work, only one was a compound rigging
installation, for a light batten and not
an acoustical enclosure.

Custom Rigqing Systems, a division of
Harris-Johnson Industries, Inc., is the
firm that originally fabricated the
Acoustical Enclosure. At the time, they
worked as sub-contractors for the
general contractor that constructed the
Civic Center. They are not registered
as Class "A" contractors in Virginia
because they have worked with General
Contractors, which is their normal
procedure of operation.
Time of completion may extend beyond July 1,
1992 for the entire shell, however, the
critical center portion is to be removed by
July 1, 1992.
Fundinq is available from insurance
reimbursements for fire damage at the Civic
Center. These funds are available in
Accounts Receivable account number 005-1118.
Reject both bids and rebid project.
Compliance of the bidder with the
requirements of the contract documents would
not be an issue.
Time requiremetns will not be met; may again
fail to get any responsive bids.
3. Fundinq will remain in accounts receivable.
Recommendation to City Council is as follows:
A. Reject both bids as non-responsive.
Declare, based upon the recommendation of the
Director of Public Facilities, that an emergency
exists since the project was advertised, and no
qualified bid was received which would allow
completion of the removal in order to make the
Auditorium available to the public within a
reasonable time frame.
Authorize the City Manager to negotiate and
execute a contract with a qualified general
contractor who in turn will employ a qualified
stage rigging sub-contractor with the experience
of working with similar Acoustical Enclosures to
Demolish and Remove the Civic Center Auditorium
Acoustical Enclosure in accordance with the
contract documents as prepared by the City
Engineer for a sum not to exceed $90~000.00.

Authorize the Director of Finance to appropriate
the negotiated amount not to exceed $90~000.00
from the Civic Center Accounts Receivable Fire
Insurance, account 005-1118, to a Capital Account
for this project to be entitled Acoustical
Enclosure Removal.

Ref: Demolition and Removal, Orchestra Shell at the Civic Center
Thursday May 21 I spoke with L. Bane Coburn, engineer for The City of Roanoke regarding
our proposal for the removal of the orchestra shell at the Concert Hall at the Civic Center.
Mr. Coburn made several comments regarding the reasons why our proposal was rejected
which have caused us to question the legitimacy of the decision process.
Our reasons for now protesting the rejection of our proposal are as follows:
A) A bond was required for a contract which offered no guarantees of access to the
site. In fact the bid document stated that the space was available on dates which were
in fact committed for performances.
B) Mr. Cobum questioned what were termed our references. Were he to have
contacted Wolf Trap Performing Arts Park he would have know that A.E. Mitchell &
Company built and installed one of the largest orchestra shells in the country.
Numerous other references are available upon request.
C) The only other response to the bid request was Harris Johnson Industries. This
company is not a Virginia Class A contractor as required under the terms of the bid.
We are requesting that the bid process be reviewed and that we be formally notified of the
final out come of this bid.

AN ORDINANCE waiving the standard rental fee for use of
certain City facilities for Roanoke Festival in the Park, and
granting certain concession rights in conjunction with such event.
WHEREAS, Council deems it appropriate to waive rental fees for
the events to be held on May 22, 1992, and May 29, 1992, to be
sponsored by Roanoke Festival in the Park and to grant certain
concession rights in conjunction with such events.
THEREFORE, BE IT RESOLVED by the Council of the City of
Roanoke that:
1. Roanoke Festival in the Park shall be authorized use of
Victory Stadium on May 22, 1992, and May 29, 1992, with waiver of
the standard rental fees for such events.
2. Such organization or its designee shall be authorized, in
conjunction with such events, to sell certain concessions as
approved in writing by the City Manager without payment of
commission.
3. The applicant organization shall furnish public liability
and property damage insurance contracts insuring the liability of
such organization with regard to such events on the dates indicated
above, in the minimum amount of $1,000,000.00 per occurrence and
$2,000,000.00 aggregate. The City, its officers, officials,
agents, employees and volunteers shall be named as additional
insureds on such policy or policies of insurance· and a certificate
of insurance reflecting such coverage shall be filed with the City
Clerk prior to May 22, 1992.
4. The applicant organization shall, and by execution of
this resolution, does agree to indemnify and save harmless the
City, its officers, officials, agents, employees and volunteers
from any and all claims, legal actions and Judgments advanced
against the City and for expenses the City may incur in this
regard· arising out of such organization's intentional acts or
negligent acts or omissions related to use of City facilities and
property.

BACKGROUND:
Festival in the Park will begin on May 21, 1992 and
continue through May 31, with events scheduled at Victory
Stadium on Fridays, May 22 and 29 at 7 p.m.
Festival in the Park is an annual event featuring arts,
crafts and entertainment, drawing thousands of people.
Victory Stadium has been requested for use by Roanoke
Festival in the Park with a waiver of the rental fee for
concerts and the granting of the concession rights and
commission.

Concession Droceeds and donations will be used by
Roanoke Festival in the Park, a non-profit, 501(c) (3)
organization, to continue to improve the event and make
it available to citizens at a reasonable cost.
II. CURRENT SITUATION:
Victory Stadium is available on the dates requested by
Roanoke Festival in the Park.
City Council authorization is required to waive rental
fees and to grant concession rights and commissions in
accordance with Resolution No. 24982.
General Liability Insurance must be provided by the
lessee to include bodily injury and property damage with
limits to be two million dollars general aggregate and
