A RESOLUTION accepting the bid made to the City by Delta
Graphics, Inc., for furnishing and delivering 500 folding chairs
for the Civic Center; and rejecting all other bids made to the
City.
BE IT RESOLVED by the Council of the City of Roanoke that:
1. The bid of Delta Graphics, Inc., made to the City,
offering to furnish 500 folding chairs for the Civic Center,
meeting all of the City's specifications and requirements therefor
for the total bid price of $16,475.00, which bid is on file in the
Office of the City Clerk, is hereby ACCEPTED.
2. The City's Manager of General Services is hereby
authorized to issue the requisite purchase order therefor,
incorporating into said order the City's specifications, the terms
of said bidder's proposal and the terms and provisions of this
resolution.
3. Any and all other bids made to the City for the aforesaid
work are hereby REJECTED, and the City Clerk is directed to notify
each such bidder and to express to each the City's appreciation for
such bid.

I. Background
Folding Chairs, which are priority
replacement items for the Civic Center, are
required to provide necessary seating on the
Floor of the Coliseum for every major event.
The required units are to be constructed of
heavy guage metal, appropriately reinforced
and braced to insure maximum safety and
durability. These units are not permanently
attached to the floor and are subject to
abuse.
September 15, 1992 specifications were
developed and were, along with request for
quotation, sent to five (5) vendors currently
listed on the City's Bid List. A public
advertisement was also published in the
Roanoke Times and World News on September 17,
1992.
Bids were received, publicly opened and read
after due and proper advertisement, at 2:00
P.M. on September 28, 1992 in the Office of
the Manager of General Services.
D. Two (2) bid responses were received. Bid
tabulation is attached.

Habitat for Humanity of Roanoke proposes to develop a 5-acre tract
of property in northwest Roanoke at the east end of Kellogg
Avenue, N. W., into 18 building lots.
City has been requested to install a 4-inch water line in Kellogg
Avenue, N. W., to serve the 5-acre tract. A copy of this request

You know better than I that one of our prime needs in our
City is providing decent and affordable housing to all of
our residents. Habitat for Humanity in the Roanoke Valley's
sole mission is just that.
Our best estimate is that 1,000 of our resident families
live in substandard housing, but do not have the resources
to acquire standard housing. We are making this possible
for dozens of families. We plan to do much more and have
the volunteer labor to do so. What we lack, are building
lots and funds to purchase building materials.
We have an option on a five acre tract in northwest Roanoke
at the east end of Kellogg Avenue. We hope to subdivide
this land into 18 building lots. Unfortunately city water
service to this tract is via a 2 inch water line.
We most respectfully request that the City of Roanoke
install a 4 inch water service line in Kellogg Avenue to
serve this five acre tract. From there it will be
economically feasible for us to develop single family
building lots.
Our city has helped our work in many ways, but there is much
more we can do together. Your early favorable response
surely would be appreciated, as we need to continue our home
building.

WHEREAS, by Ordinance No. 31041-060892 this Council ratified
the emergency award of a contract to Payne Construction Company for
the demolition and removal of the orchestra shell at the Civic
Center.
WHEREAS, Payne Construction Company, Inc. has submitted a
request for final payment under the contract including incentive
payment for early completion.
WHEREAS, the contract as originally ratified by Council did
not authorize incentive payment for early completion.
THEREFORE, BE IT ORDAINED by the Council of the City of
Roanoke that:
1. The portion of the May 29, 1992 contract with Payne
Construction Company, Inc., providing for an incentive payment for
early completion of the project to the extent of $23,000.00 is
hereby RATIFIED, as more particularly set forth in the report of
the City Manager to this Council dated September 28, 1992; and the
Director of Finance is hereby authorized and directed to make
requisite payment to said contractor pursuant to the contract.
2. In order to provide for the usual daily operation of the
municipal government, an emergency is deemed to exist, and this
ordinance shall be in full force and effect upon its passage.

I. Backqround of project is as follows:
City Council received two bids from stage equipment
contractors for this project on May 11, 1992. Neither
firm was registered in Virginia as a Class A Contrac-
tor.
On May 26~ 1992 City Council rejected both bids, recog-
nized the need to procure the work on an emergency
basis, and authorized the City Manager to negotiate and
execute a contract with a qualified General Contractor
who in turn would employ a qualified stage equipment
sub-contractor with experience of working with similar
acoustical enclosures who would demolish the Civic
Center Auditorium Acoustical Enclosure. The alterna-
tives at that time were (1) remove the acoustical
enclosure to free up the stage space it was resting
upon; or (2) lose the Miss Virginia Pageant which was
to start July 1, 1992.
City Council, on June 8, 1992, in accordance with
Section 41 of the City Charter, ratified a contract in
the amount of $95~800.00 with Payne Construction
Company, Inc., a general contractor.

Current Situation:

Contract documents included a provision for an $800.00
per day incentive for early completion. The project
was completed on July 16 and the contractor has
submitted a request for final payment including incen-
tive payment for early completion.

approval, a final payment in the amount of $23,000.00.
