I am enclosing copy of Ordinance No. 31285-010493 authorizing the Mayor to execute
an agreement between the Town of Vinton, the County of Roanoke, and the City of
Roanoke, relating to the boundary line between said governmental entities, directing
the City Clerk to cause a description of said boundary to be published as provided
by law, and directing that certain other actions relating to such boundary line be
taken as provided by law, as more partieulariy set forth in the exhibits attached to
a report of the City Manager under date of December 14, 1992. Ordinance No.
31285-010493 was adopted by the Council of the City of Roanoke on first reading on
Monday, December 14, 1992, also adopted by the Council on second reading on
Monday, January 4, 1993, and will take effect ten days following the date of its
second reading.

AN ORDINANCE authorizing the Mayor to execute an agreement
between the Town of Vinton, the County of Roanoke, and the City of
Roanoke relating'to the boundary line between said governmental
entities, directing the City Clerk to cause a description of such
boundary to be published as provided by law, and directing that
certain other actions relating to such boundary line be taken as
provided by law.
WHEREAS, the Council deems it necessary in order to further
the public health, safety and welfare to relocate portions of the
boundary line between the City of Roanoke, the Town of Vlnton and
the County of Roanoke, in accordance with the provisions of $15.1-
1031.1 through S1031.3 of the Code of Virginia (1950), as amended
("State Code"); and
WHEREAS, relocation of the boundary line between such
governmental entities in the areas proposed will permit more
effective and efficient delivery of municipal services; and
WHEREAS~ the City Manager has recommended to the Council
establishment of a new boundary line at certain points between the
City of Roanoke, the Town of Vlnton, and the County of Roanoke, as
set out in his-.rel~ort dated December 14, 1992, to this Council; and
WHEREAS, the Town of Vlnton and Roanoke County, through their
respective administrations, have agreed to the boundary relocation
as set forth in the City Manager's report dated December 14, 1992,
to this Council; and
WHEREAS, the Council concurs in the recommendation of the City
Manager as set forth in his report dated December 14, 1992.
THEREFORE, BE IT ORDAINED by the Council of the City of
Roanoke'that:
1. The Mayor and the City Clerk be, are hereby are,
authorized to execute and attest, respectively, an agreement,
between the City of Roanoke, the Town of Vlnton, and the County of
Roanoke, in form approved by the City Attorney, establishing a new
boundary line at certain points between said Jurisdictions as more
particularly described in the exhibits attached to the City
Manager's report dated December 14, 1992, all of which is
incorporated by reference herein.
2. The boundary line set forth in said agreement shall be
described by metes and bounds.
3. Upon the agreement being duly executed by the Mayor for
Roanoke City, the Mayor of the Town of Vlnton, and the Chairman of
the Board of Supervisors for the County of Roanoke, said executions
to be authorized by appropriate measures passed by the respective
Jurisdictions, the City Clerk is directed to cause the description
of such aforesaid boundary line to be duly published as required by
S15.1-1031.2 of the State Code.
4. Upon execution of the agreement between the governing
bodies and publication of the agreed upon relocation boundary line
in accordance with law, the City Attorney is authorized to petition
the Circuit Court of one of the affected Jurisdictions to relocate
the boundary line in accordance with the exhibits attached to the
City Manager's report dated December 14, 1992.
5. Upon entry of an order by the Circuit Court establishing
the new boundary line, the City Clerk is directed to forward a
certified copy of such order to the Secretary of the Commonwealth.
6. The Mayor and City Attorney are authorized to take, or
cause to be taken, such other actions, and to execute other
documents as may be required by law to effect the change in the
boundary line as set forth herein.
7. The City Clerk is directed to forward an attested copy of
this ordinance to the Town Clerk of the Town of Vinton and the
Clerk of the Board of Supervisors for Roanoke County.

Subject:
Resolution 816, from the Town of Vinton, on
behalf of William P. Vinyard, Jr., requesting
a certain adjustment of the boundary between
Roanoke City and the Town of Vinton, pursuant
to the provisions of Section 15.1-1031.1
through 1031.3 of the Code of Virginia (1950),
as amended.
i. Background:
Resolution adopted by the Town of Vinton requesting a
certain adjustment of the boundary between the City and
the Town of Vinton was submitted on behalf of William P.
Vinyard, Jr. (see Exhibit 1). The adjustment requested
by the Town of Vinton on behalf of Mr. Vinyard is
described as the "Proposed boundary" (see Exhibit 2).
William P. Vinyard, Jr.~ owns a parcel of land which is
bisected by the boundary between the City and the Town of
Vinton. The portion of the parcel within the City's
boundary is Official Tax No. 7010202. Mr. Vlnyard wishes
to subdivide the parcel into nine lots for construction
of single family dwellings. Four (4) of the proposed
lots would be split by the boundary line currently
dividing the City and the Town of Vinton (see Exhibit 2).
Location of the City's corporate boundary line prohibits
the City from approving Mr. Vlnyard's proposed
subdivision, as Section 31-68(f) of the City Code
provides that: "No lot in a subdivision shall be divided
by a city or county boundary line."
Subdivision plat submitted by Mr. Vinyard to the City for
review and approval proposes, among other things the

III.
Vinyard Park (Official Tax No. 7010201) is tax exempt and
for the most part lies within the limits of the 100 year
floodway and flood plain. The land is thereby restricted
to specific uses such as parks, recreation, parking, etc.
Boundary line between the City and the Town of Vinton, at
two locations to the west of the area currently requested
for adjustment, and at a location east of the area
currently requested for adjustment, also divides existing
lots and structures (see Exhibit 3):

Official tax numbers listed in the above item nos. 6 and
7 represent the portion of lots located within the City.
The portion of those lots which are located in the Town
of Vinton are identified by County tax numbers.
Revenues from the above listed properties are, in some
cases, divided between the jurisdictions.
The above-cited residential dwellings are the only
inhabited structures known to be divided by the City's
corporate boundaries.
Mr. Billy Wise of 427 Eighth Street (Midway) appeared
before the Commission and objected to the fact that the
proposed boundary adjustment would place his house
totally within the jurisdiction of the City of Roanoke.
Planninq Commission concurred with the staff
recommendation with the single exception that Mr. Wlse's
property at 427 Eighth Street be excluded and allowed to
remain within the Town of Vinton.

IV. Alternatives:

ADprove certain and specific adjustments of the existinq
boundary lines between the City and the Town of Vinton~
and authorize the Mayor to execute an agreement with the
Town of Vinton to relocate the portion of the boundary
between those jurisdictions as set forth in the attached
Exhibit Nos. 4 and 5, and subject to certain
contingencies as outlined in Section V. of this report.

3. Maintenance responsibilities/costs:
Boundary line adjustments will effect very
little change in the responsibilities for
maintenance of public facilities such as

streets, water lines, sewer lines, storm
sewers, etc.
Recommended boundary line adjustments will
provide the following benefits:
(1)
Adjustments will enable Roanoke County to
establish and include Vinyard Park as a
part of the County park system.
(2) Inclusion of Vinyard Park within the
boundaries of Roanoke County will also
enable the County to provide more
efficiently for the proper maintenance of
the facility and for the proper
dedication, acceptance and maintenance of
its proposed access road consistent with
the requirements of Section 33.1-223(d)
of the Code of Virginia (1950), as
amended.
(3) Potential liability issues related to
future accidents occurring on the subject
access road into the park would be
eliminated.
Convenience/inconvenience to affected property
owners:
Boundary line adjustments will eliminate the
need for individual properties to be
separately assessed and taxed by the City of
Roanoke, Roanoke County and the Town of
Vinton.
Adjustments will clarify Jurisdictional
responsibility for the timely provision of
public services to property owners.
Adjustments will enable Mr. Vinyard and the
Roanoke County Board of Supervisors to utilize
their properties in a more appropriate and
productive manner.
A number of the property owners that would be
affected by this recommended boundary change
have expressed a preference that their
properties be allowed to remain within the
limits of the town of Vinton.

5. Relationship to the comprehensive plan:
Adjustment of the City's existing corporate
boundaries as proposed on Exhibit 4 would
constitute an amendment to the City's
comprehensive plan, as provided for in Section
15.1-456 of the Code of the Commonwealth of
Virginia (1950), as amended.
Recommendation is consistent with the intent
of the comprehensive plan that lots should not
be divided by a city or county boundary line.
ADDrove certain and specific adjustments of the existinq
corporate boundary line between the City and the Town of
Vinton and authorize the Mayor to execute an agreement
with the Town of Vinton and Roanoke County, or other
necessary documents, to relocate the portion of the
boundary between those jurisdictions as set forth in
Exhibit 2 of this report_~ said agreement to be approved
as to form by the City Attorney; to authorize the City
Attorney to initiate appropriate legal proceedings, upon
the execution of said agreement, in accordance with the
requirements of Section 15.1-1031.1,__et- seq., of the
Code of Virginia of 1950, as amended, and to authorize
the City Clerk to cause the description of such boundary
line, as agreed upon, to be duly published as required by
Section 15.1-1031.2 of the Code of Virginia of 1950, as
amended.
Public safety and protective services. Adjustment
would enable the owner of tax parcel no. 7010202
(see Exhibit 2) to create four (4) additional lots
for residenuial use. Lots would be located
entirely within the Town of Vinton. All public
services would be provided by Roanoke County.
Residences at 427 Eighth Street, 1802 Dale Avenue
and 434 Eighth S=reet would, however, remain
divided by tke existing corporate boundary line.
Division could cause future safety problems.
Impact on City's total assessments and revenues.
Tax parcel 7010i02 (see Exhibit 2) is valued at
$1,000. Change ~n land values and revenues would
be insignificant. City would relinquish a small
amount of revenue from four building lots for
single-family residences.
Maintenance responsibilities/costs. Change in
maintenance responsibilities would be negligible.

to the access road into Vinyard Park would remain.
4. Convenience/inconvenience to affected property
owners. Street serving the proposed four (4) new
lots is located in Vinton. Provision of all public
services for these four lots by the County would be
more convenient for the future owners of the lots.
Relationship to the comprehensive plan would not be
an issue.
Recommend that City Council deny the applicant's request
to adjust the existinq, corporate boundary line between
the City of Roanoke an~ the Town of Vinton.
Public safety and protective services would not be
an issue.
Impact on total assessments and revenues would not
be an issue.
Maintenance respc, nsibilities/costs would not be an
issue.
Convenience/inconvenience to affected property
owners. Denial would prohibit the owner of tax
parcel no. 7010202 from using and developing his
property as single family residences.
Relationship to the comprehensive plan would not be
an issue.
Recommendation:
The Planning Commission by a vote of 6-0 (Mr. Bradshaw absent)
recommends that City Council approve Alternative A thereby
approving certain and specific adjustments of the existing
boundaries between the City and the Town of Vinton, and
authorizing the Mayor to execute an agreement with Roanoke
County and the Town of Vinton to relocate the portion of the
boundary between those juri.~dictions as set forth in Exhibit
Nos. 4 and 5 of this report, said agreement to be approved as
to form by the City Attorney; to authorize the City Attorney
to initiate appropriate legal proceedings, upon the execution
of said agreement, in accoraance with the requirements of
Section 15.1-1031.1, et. se~, of the Code of Virginia of
1950, as amended, and to authorize the City Clerk to cause the
description of such boundary line, as agreed upon, to be duly
published as required by Secuion 15.1-1031.2, of the Code of

The Town of Vinton has been approached by Mr. William P. V'myard, Ir., requesting that the
Town of Vinton consider adjusting the botcg, dary line between the City of Roanoke and Town
of Vinton. The area specifically affected is a parcel of land owned by Mr. Vinyard whi/h
· ~. sWaddles the boundal~ line west of Berkley Road on the southerly side of the Norfolk a~d
Western Railway. Mr. Vinyard has subdivided the parcel, known as Berkley Court, with I~e
boundal~ line between the City of Roanoke and Town of Vinton effectively bisecting lots 4, 5,
and 6 and a small portion of lot 3; whereas, the remainder of Berkiey Court ~ in the Town
of Vinton.
In response to the request received from Mr. Vinyard, Vinton Town Council adopted Resolution
No. 816 at their meeting held on Tuesday, February 18, 1992, requesting that the City of
Roanoke consider adopting a resolution reflecting its agreement to this boundary change.
Attached is a copy of Resolution No. 816 and the subdivision plat of Berkley Court which we
would respectfully request that you present to the City Council. If the Roanoke Cit~ Council
agrees with this boundary change, I have been directed to post and advertise the description of
the relocated boundary line in accordance with § 15.1-1051.2 of the 1950 Code ofl~rginia, as
amended, and the Town Atlm'ney is directed to petition the Circuit Court of Roanoke City in
accordance with § 15.1-1051.$ of the 1950 Code of Wrginia, as amended.

WHEREAS, the common boundary line between the Town of Vinton
and the City of Roanoke comes through Berkley Court, an approved,
platted residential subdivision lying primarily in the Town of
Vinton; and
WHEREAS, a small portion of lot 3, and portions of lots 4, 5
and 6 in Berkley Court, now lie in the City of Roanoke, while the
remainder of Berkley Court lies in the Town of Vinton; and
WHEREAS, the bisection of the aforesaid lots by the said
boundary line renders them unbuildable and, accordingly, diminishes
their value greatly; and
WHEREAS, under present circumstance their potential to
generate public revenue can never be realized, and their bisection
into separate jurisdictions is detrimental to good land use
policies; and
W~EAS, an adjustment of the boundary line between the Town
of Vinton and the City of Roanoke to correct this problem would
result in an increase in the Town's area by 0.3784 acres, as shown
on the attached plat and description; and
~, The Code of Virginia permits the relocation of
boundary lines between political subdivisions (§15.1-1031.1 et
seq.) when they agree to do so;
NO~TW~FO~, BE IT P~OLVEDby the Town Council Of the Town
of Vinton, Virginia, that:
1. The relocation of the boundary between the Town of Vinton
and the City of Roanoke be relocated so that all of lots 3, 4, 5
and 6 in Berkley Court Subdivision will lie in the Town of Vinton,
as shown on the attached plats and description.
2. A true copy of this resolution be forwarded to the City
Manager of the City of Roanoke with the request that City Council
resolution reflecting its agreement to this boundary
adopt a

IN THE COUNCIL OF THE CITY OF ROANOKE, VIRGINIA,
AN ORDINANCE authorizing the Mayor to execute a certain
agreement between the Town of Vinton, County of Roanoke, and the
City of Roanoke relating to an adjustment of the boundary line
between the Town of Vinton and the City of Roanoke adjacent to an
approximately 24 acre parcel of land (Official Tax No. 7030101)
adjoining the Bali Hai Subdivision, in the vicinity of Olney Road;
authorizing the City Attorney to initiate appropriate legal
proceedings; authorizing the City Clerk to cause a description of
such boundary to be published as provided by law; and providing for
an emergency.
WHEREAS, as made and provided by law, the governing bodies of
the Town of Vinton, County of Roanoke, and the City of Roanoke
should cause to be prepared an agreement between said governmental
entities for the purpose of establishing the true boundary line
between such governmental entitLes as set forth in the Planning
Commission's report dated October 12, 1992, to this Council, and in
accordance with the provisions of S15.1-1031.1 through §1031.4 of
the Code of Virginia (1950), as amended ("State Code"), the
original of which agreement shall be filed in the Office of the
City Clerk; and
WHEREAS, the option relating to the establishment of the
boundary line between the Town of Vinton and the City of Roanoke is
set out in the Planning Commission's report dated October 12, 1992,
to this Council; and
WHEREAS, in light of all of the information provided to it,
the Council finds that the establishment of the boundary line
between the Town of Vinton and the City of Roanoke as requested by
Petitioner is in the best interest of the City of Roanoke.
THEREFORE, BE IT ORDAINED by the Council of the City of
Roanoke that:
1. The Mayor be, and hereby is, authorized to execute all
appropriate documents, including a certain agreement, between the
Town of Vinton, County of Roanoke, and the City of Roanoke, in form
approved by the City Attorney, establishing as a portion of the
true boundary line between said jurisdictions the line described in
the report dated October 12, 1992, from the Planning Commission to
this Council, and the City Clerk is directed to attest and seal
said documents and agreement.
2. The City Attorney is authorized to initiate appropriate
legal proceedings, upon the execution of said agreement, in
accordance with the requirements of S15.1-1031.1, et seq., of the
State Code.
3. The City Clerk be, and hereby is, authorized to cause the
description of such aforesaid boundary line to be duly published as
required by §15.1-1031.2 of the State Code, and the Mayor and City
Attorney are authorized to cause to be taken such other actions and
proceedings as may be required by law in the premises.
4. In order to provide for the usual daily operation of the
municipal government,

adjustment of the corporate boundary between the
City of Roanoke and the Town of Vinton, pursuant to
the provisions of Sec 15.1-1031.1 through 1031.3 of
the Code of Virginia (1950) as amended.
I. Background:

Resolution adopted by the Town of Vinton requesting that
the City agree to a certain adjustment of its existing
corporate boundary line was submitted on behalf of the W.
E. Cundiff Co., Inc., a firm specializing in real estate,
building and development, that, at that time, owned a
certain tract of land located within the City of Roanoke.
The subject tract of land has since been conveyed to A.
H. Overbay and Anne Huffman.
Be
Land, according to a recent survey, consists of a 24 acre
tract of undeveloped land lying within the City, but
situated adjacent to the existing Bali Hai Subdivision
which is located within the Town of Vinton. This tract
of land is currently shown on all City maps as a 35 acre
tract. This acreage was based on an older survey.
Ce
Two sections of platted, but undeveloped street rights-
of-way, extend from a nearby Vinton street (Olney Road)
to the subject property boundaries.

Future access to this tract of land, due to topographical
constraints, would be available only by accessing public
streets in the Town of Vinton.
Preliminary subdivision plat proposing the subdivision
and development of this tract of land was submitted to
the City for review approximately one year ago. Plat
proposed the extension of a public street through the

property and the subdivision of the tract into 19 smaller
residential lots (see attached sketch plat).
II. Current Situation:

Planninq Commission reviewed the request made by
resolution 820, at its regular meeting of September 2,
1992.
W. E. Cundifft Co.t Inc., the initial owner of the
subject 24 acre tract had expressed a desire to develop
the land for residential use and had further expressed
the desire that such development be a part of the Town of
Vinton.

Resolution adopted by Vinton Town Council, cites the
following reasons as Justification for the inclusion of
this tract of land into the boundaries of the Town of
Vinton:
1. The land adjoins Bali Hai subdivision which is
located in the Town of Vinton.
City access to the property for fire, police and
emergency vehicles can be provided only by
accessing public streets through the Town of
Vinton.
Water, sewer and other utility services cannot be
provided to this property from the City of Roanoke
without an inordinate expenditure of public funds.
It would be more convenient for children living in
any future development on the subject property to
attend Vinton public schools.

City of Roanoke, on April 11, 1977, approved a similar
request made by the residents of Catlett Drive, N.W., to
adjust the City's common boundary with the City of Salem
(see attached map "Catlett Drive"). Adjustment was
justified on the premise that the existing boundary line
arbitrarily divided residential structures.
City administration, in response to Resolution 816 from
the Town of Vinton, is currently recommending that City
Council approve a similar boundary line adjustment that
will result in a change and relocation of approximately
40 acres of land from within the City to the Town of
Vinton. The City's recommendation on this request is
based on the following justification:

Thirty three acre tract belongs to the County Board
of Supervisors.
Tract is being developed by the county as a county
park and is to be maintained by the county as a
part of its public park and recreational system.
Smaller tracts and structures involved were divided
by earlier annexation lines in an ambiguous manner
very similar to that of the above-mentioned Catlett
Drive structures and properties. Adjustment of the
City's boundary line was determined, in the above
cited instance, to be justified, as necessary, in
order to facilitate proper land use and safety
standards.

A. R. Overbay and Anne Huffman, current owners of the
subject tract of land, were in attendance at the meeting.
Mr. Overbay stated that he and Ms. Huffman would like to
see the tract become a part of the Town of Vinton.

C. Inconvenience for property owners.
D. Inconvenience for future residents of property.

lines as shown on the attached Map A.
1. Justification for boundary line adjustment.
The request to alter the subject boundary line
is made on the premise that although this
tract of land is located in the City, it can
be accessed only through the Town of Vinton.
There are various other tracts of land located
on the perimeter of the City's boundaries that
presently can be served only by accessing
streets within the county or Salem. There are

also various tracts of land located within the
County and the City of Salem that can be
served only by accessing Roanoke City streets
(see attached example list). This, in itself,
would not appear to be sufficient
justification for the City to relinquish its
jurisdiction over such tracts and thus deprive
itself of potential revenues that may in the
future be generated by such lands.
Adjacent properties located on a portion of
Gates Lane, S.E., (within the City of Roanoke)
can be accessed only by way of Vinton Streets.
Properties situated at the terminus of Gatling
Lane, Flanders Lane and Bainbridge Drive,
N.W., can be accessed only by way of the City
of Salem street system (see attached
Comparative Property Locations).
Public services~ police~ fire emergency services,
water and sewer.
Public services such as police, fire and
emergency services would be provided in the
same manner as that provided to any of the
other numerous properties that are located
within the City but are, and have been for
many years, accessed by streets that lie
outside of the City's corporate boundaries.
Extension of City sanitary sewer lines to this
tract of land would require considerable
expense. The property, however, cannot be
served by sewer lines from within the Town of
Vinton due to existing topographical
constraints. Tract would in all probability
be developed with individual septic tank
systems. The property can be served by water
lines from the City of Roanoke or the Town of
Vinton.
Inconvenience to the property owner. Development
of the subject tract of land as it is currently
situated would not be hindered by reason of its
location within the City of Roanoke or by reason of
the existing location of the City's corporate
boundary. The property owner would not be
inconvenienced in any future endeavor to develop
the property by reason of its location.
4. Inconvenience to future residents of the property.
Future residents of this tract would not be

inconvenienced by reason of the property location
or by reason of the existing location of the City's
corporate boundary.
5. Revenuer existinq and potential.
Subject tract of land is currently assessed at
a value of $35,000.
b. Tract currently generates $427.50 in annual
revenue.
Land is currently vacant. If developed into
multiple lots as proposed by the previously
mentioned preliminary subdivision plat into
multiple lots for single family residences
having an average value of $75,000, the land
and development could generate an approximate
$17,812 in annual revenues.
Relationship to the comprehensive plan. Adjustment
of the City's corporate boundary line as requested
would be inconsistent with the intent of the City's
comprehensive plan. This tract of land is
identified in the comprehensive plan's housing
development strategy as an area of potential new
residential development.

Approval of the request on the basis of the reasons
given for this specific adjustment could be deemed
a precedent for relinquishing similar tracts of

taxes would be paid to Roanoke County and the Town
of Vinton.
Relationship to the comprehensive plan. Approval
would, in effect, delete a tract of land identified
in the comprehensive plan's housing development
strategy, as an area of potential new residential
development.
Recommendation:
The Planning Commission, by a vote of 5-0 (Messrs. Bradshaw
and Sowers absent) recommends that City Council approve
Alternative A thereby denyinq the request to adjust certain
corporate boundary lines between the City of Roanoke and the
Town of Vinton as requested by Resolution 820, and as shown on
the attached Map A. This recommendation is based on the
following conclusions:
The existing location of the City's corporate boundary,
in relation to the location of the subject property,
would not prevent the City of Roanoke from providing a
normal level of safe and timely public services to any
future residents that may reside within the property.
The existing location of the City's corporate boundary in
this instance does not in anyway hinder, restrict or
inconvenience the current owner of the property in any
exercise of its ultimate development.
The request as currently made for this boundary
adjustment appears to be made on the basis of a
preference of the property owner that any future
development of the property be located in the town of
Vinton. Adjustment of the City's corporate boundaries
should be determined only on the basis of public safety
and practical land use issues.
Adjustment of the City's corporate boundaries for the
reasons as requested could be deemed a precedent for
future requests to be made for the City to cede or
relinquish any one or more of a number of similar tracts
of land so located on the perimeter of the city's
corporate boundaries.

OF ROANOKE WOULD NOT CONTINUE TO SIMPLY ISSUE PERMITS

CIENT WAITING PERIOD SO THAT THE CITY AND OTHER VARI-
OUS HOUSING INTERESTS WOULD HAVE AN OPPORTUNITY TO
EXPLORE ALTERNATIVES.
ONE OF THE STATED GOALS OF THE NETWORK IS TO

TATE, COORDINATE, ENCOURAGE AND SOLICIT COOPERATION AND
COMMUNICATION," OR IN SOME OTHER MANNER.
I HAVE BEEN TOLD THAT THE CITY UNDER CURRENT
ORDINANCES HAS NO ALTERNATIVE BUT TO ISSUE PERMITS WHEN
REQUESTED. IF THIS IS TRUE, THEN THESE ORDINANCES
SHOULD BE CHANGED SO THAT THE CITY'S TRUE INTENTIONS

1. The City Manager be, and he is hereby authorized, for and
on behalf of the City to execute a Real Estate Option on real
estate located at 642 Elm Avenue, S.W., currently owned by Mary S.
Martin, as more particularly set out in and attached to the City
Manager's report to Council dated October 12, 1992, a copy of which
is on file in the Office of the City Clerk, upon approval of the
form of the Option by the City Attorney, and upon such other terms
and conditions as are provided therein.
2. In order to provide for the usual daily operation of the
municipal government, an emergency is deemed ~o exist, and this
ordinance shall be in full force and effect upon its passage.

Execution of Real Estate Option
at 6t~2 Elm Avenue SW under the
Homeownership Assistance Program
I. Background:
Homeownership Assistance Program has been developed to enhance
homeownership opportunities within the City. The Program provides
resources for purchase, purchase and rehabilitation, downpayment
and closing cost assistance, and education to facilitate homeownership,
especially for those of low and moderate income. Financial assistance
is provided by the Virginia Housing Development Authority (VHDA), the
Virginia Department of Housing and Community Development (DHCD), and
HUD through Community Development Block Grant (CDBG) and HOME funds.
Financial assistance includes both low interest loans and grants.
Certain targeted, vacant, substandard properties are marketed by the
City for purchase and rehabilitation by homebuyers using resources
available through the Program. The Program is administered jointly by
the City and the Roanoke Redevelopment and Housing Authority, as
outlined in the City's current contract for services with RRHA.
Real estate options were selected as the best wa), to allow the City to
market the targeted properties. These options define the property
owner's and the City's responsibilities under the Program, establish a
purchase price for the property, and allow the City to access and
market the property for sale to qualifying low and moderate income
purchasers in the Program through assignment of the real estate option
to the buyer. This provides for a direct sale of the property from the
current owner to the purchaser selected through the Program. The City
itself wilt not exercise any option and will not actually purchase any
property in the Program. Should the City be unable to find a buyer for
the property, the real estate option would be allowed to expire.
Council previousl), authorized the City Manager to execute options with
individual owners of numerous properties to be included in the
Homeownership Assistance Program.
II. Current Situation:
Real estate option has been executed by the owner of a vacant single-
famil)' home, with specific provisions outlined in Attachment A. Housing
Development Office staff have determined that the offered price is reasonable
to allow the house to be included in the Program.

with the owner of the property is necessary to allow this property to
be marketed through the Program.

A. Authorize the City Manager to execute the real estate option as outlined
in Attachment A~ to be approved as to form by the City Attorney,
with the owner of this property selected for the Homeownership
Assistance Program.
1. Cost to the City would be $1.00 for the option.
Consistency with established housing plans and policies of the City
will be met as an additional homeownership opportunity will be
provided to low-moderate income households. Owner occupancy and
rehabilitation of an additional vacant substandard house will
provide significant contribution toward stabilization and rejuve-
nation within the neighborhood.
Timing is such that prompt execution of this option will allow
immediate marketing of the house. If a buyer is found Council
will be asked to approve assignment of the option to qualifying
purchaser under the Program at a later date.
B. Do not authorize the City Manager to execute the real estate option as
outlined in Attachment A~ with the owner of this property.
1. Cost of the City can be recognized as lost opportunity cost.
Consistency with established housing plans and policies of the City
will not be met as a homeownership opportunity will not be provided
to low-moderate income households in the Southwest quadrant of the
City, and a vacant substandard house likely will remain so.
3. Timing would not be an issue.

Adopt Alternative A, thereby authorizing the City Manager to execute
the real estate option as outlined in Attachment A, to be approved as to
form by the City Attorney, with the owner of this property selected
for the Homeownership Assistance Program.

I. Background:
In 1987, Governor Baliles initiated a Literacy Pro~ram
for inmates incarcerated in the Virginia Department of
Corrections. This program was intended to reduce
recidivism among inmates by encouraging inmates to obtain
a G.E.D. level of education and thereby increase their
abilities to obtain jobs once released from custody.

Since fiscal year 1988-89, federal ~rant funds have been
made available to local jails to provide educational
programs for inmates at the local level. The Roanoke City
Jail has received these grant funds for the past 4 fiscal
years to employ a part time teacher necessary to provide
an educational program to the inmates in the Roanoke City
Jail so they may obtain a G.E.D. level of education.

For the past four years, the educational program serving
the inmates in the Roanoke City Jail has proven
successful. Utilizing a paid part time teacher in
addition to community volunteers from St. Gerard's
Catholic Church, the First Baptist Church, Hollins
College, and others, the jail has been able to provide
quality educational opportunities to inmates within the
jail.
1. A total of 429 inmates have been enrolled in the
educational program since fiscal year 1988-89.
A total of 107 inmates have completed the
educational program while incarcerated in the
Roanoke City Jail. Of these inmates, 59 inmates
were tested by the State Department of Education
and received their G.E.D. certificates while still
incarcerated in the Roanoke City Jail and 11 more
inmates are presently waiting to be tested.

II. Current Situation:
Roanoke City School Division requested and received
approval for the continued funding of the Roanoke City
Jail's educational program for fiscal year 1992-93. This
"institutionalized adult plan" request was submitted
again as part of the Annual Program Application for adult
education under the State Adult Literacy and Adult
Education Act. These funds are administered by the Adult
Education Service of the State Department of Education
through local school divisions. (See attached letter
dated September 24, 1992.)
1. Federal funds not to exceed the amount of $15,000

have been approved to reimburse Roanoke City for
90% of the total cost to continue to pay a part
time teacher to operate the educational program in
the Roanoke City Jail for 52 weeks.
Roanoke City is required to provide a local 10%
cash match or $1,666.66 in order for the Roanoke
City Jail to continue to participate in this
program.
The total cost of the program will be $16,666.66.
The program cost will not exceed $15,000.00 from
the State Department of Education plus a $1,666.66
local cash match.
Issues:
Continuation of a staffed educational program in the
Roanoke City Jail to sufficiently meet the educational
needs of the inmates.
B. Funding.
IV. Alternatives:
A. City Council authorize the Director of Finance to
increase the revenue estimate for FY 1992-93 by
$16,666.66 and appropriate this amount to the accounts
established in the Grant Fund (Personal Services
Temporary Employee Wages and FICA) for this program.
Continuation of a staffed educational program in
the Roanoke City Jail to sufficiently meet the
educational needs of the inmates would be
accomplished.
Members of City Council
Funding of the $16,666.66 would be accomplished with the
receipt of $15,000.00 in federal funds and with a local
cash match of $1,666.66 in funds paid to the City of
Roanoke from the Roanoke City Jail's Canteen Fund. There
would be no actual cost to the City of Roanoke for this
program.
City Council not authorize the Director of Finance to
increase the revenue estimate for FY 1992-1993 by
$16,666.66 and appropriate this amount to Grant Fund for
Roanoke City Jail's educational program.
Continuation of a staffed educational program would
not be possible and the Roanoke City Jail's
educational program would revert to utilizing an
all volunteer staff which has proven in the past to
lack certain expertise, stability, and continuity.
2. Funding for the Roanoke City Jail's educational
program in the amount of $16,666.66 would be lost
by the City of Roanoke.
V. Recommendation:
City Council concur with Alternative "A" by authorizing
the Director of Finance to:
Establish revenue estimate in the Grant Fund by the
amount of $15,000.00 in federal funds and $1,666.66
in local cash match to be paid by the Roanoke City
Jail's Canteen Fund.
Establish the required expenditure accounts in the
Grant Fund - Personal Services (Temporary Employee
Wages and FICA) in the amount of $16,666.66.

Bid award and Appropriation of Funds for Replacement of
Communications Controller - Bid Number 92-7-108
Dear Mayor and Members of Council:
I. Background:
The Department of City Information Systems (CIS) provides
information system services to all municipal departments many of
which are located remotely from the Municipal Complex.
Access to computer information is provided to these remote locations
by a Communication Controller. This piece of equipment, with it's
associated software, allows display terminals and personal computers
to receive information over phone lines.
Our current Communications Controller needs to be replaced. This
equipment is over 9 years old and has become outdated; it will no
longer process newer versions of software. Support services for
the software running on the current equipment are to be dropped
effective December 31, 1992.
Bid Specifications for the hardware were developed and sent to 18
vendors on July 31, 1992. A public advertisement was published in
the Roanoke Times and Roanoke Tribune.
II.
Current Situation:
Bid responses were received, after due and proper advertisement,
until 2:00 p.m., on August 31, 1992, at which time, all bids so
received were publicly opened and read in the Office of the Manager
of General Services. The following companies responded to the bid:
Federal Data Corporation, Meridian Leasing Services, MLC Group
Inc, International Business Machines Corporation.
All bids were evaluated in a consistent manner by representatives
of Public Works, CIS, and General Services. (See attachment A -
Bid Tabulation).
Do
Training on the equipment for City Information Systems personnel,
which is a requirement stated in the bid, was not included in the
responses from Federal Data and Mari~i~u Leasing. Vendors could
propose their own training, or at their option, have the City obtain
it from a separate source. Quotations for this training were
received from three vendors and the lowest cost was used in the bid
tabulation.
IBM is the lowest bidder for a total first year cost of $47,844. This
price includes shipping, installation, and training. In addition IBM
was the only vendor who proposed new equipment, which includes
a one year warranty. All other vendors proposed used equipment
which does not include a warranty period. The cost to operate the
equipment over it's expected life is the same for all vendors after
the first Fear, therefore life cycle costing beyond the first year was
not calculated.
Other Project Cost not included in this bid include a reduction in
the cost of the lease price of the software required to operate the
equipment in the amount of $3,156 annually. Also the hardware
maintenance on the new Communication Controller is $310 less per
year. These savings apply regardless of which vendor's proposal
is chosen.

Pursuant to our telephone call please find a number of briefing documents for the
Lake Gaston project. Included are the following:
Lake Gaston Project Briefing Document dated June 11, 1992. This is a brief
overview of the project including the current status, previous history of the
project and a discussion of alternatives.
Water Supply System Status Report dated October 1991. This is a report
which describes the serious water supply shortage in the City of Virginia
Beach. The City of Norfolk has rationed Virginia Beach to no more than 30
mgd on an annual basis. This is exclusive of any drought related reductions.
Norfolk has had to restrict the amount of water supply to Virginia Beach to
as Iow as 15 mgd in the past. The City's normal unrestricted water demand
would be an annual average of 33 mgd. The City is currently under
permanent water use restrictions and a limited moratorium on new
connections and extensions of the water system. This is the sixth time in
the last 15 years which Virginia Beach has had to restrict, ration, or
otherwise call on its citizens to artificially reduce water demand. I am aware
of no other jurisdiction anywhere that has had such frequent and severe
water shortage problems.
A Technical Response to the June 1992 Boyle Engineering Report dated July
27, 1992. This report provides a factual and technical rebuttal to a report
prepared by Boyle Engineering for the state of North Carolina.

A Technical Response to the January 1992 Leitner Study dated March
1992. This is also a technical and factual rebuttal to a report prepared on
behalf of the State of North Carolina. Both the Leitner Study and the Boyle
report were prepared by North Carolina for use in the Coastal Zone
Management Act proceedings which turn on whether or not there are better
and more environmentally acceptable alternatives to the Lake Gaston
project. North Carolina's position is simple: any other alternative,
regardless of its consequences, is better than the Lake Gaston project.
North Carolina is advocating alternatives now that it has opposed in the past
and will oppose in the future.
Published rulings from the Fourth Circuit Court of Appeals in Richmond,
Virginia and the Federal District Court in Raleigh, North Carolina. As these
judicial opinions demonstrate, the State of North Carolina has never been
able to provide any evidence whatsoever for any of its claims of alleged
impacts.
There is no way that the Lake Gaston project will have any affect on the City of
Roanoke. Claims by opponents that the City's project will result in more stringent
discharge requirements upstream are illogical and sophomoric. Many jurisdictions
upstream and downstream of the proposed withdrawal use the waters of the
Roanoke River Basin for water supply. The argument that Virginia Beach's use will
somehow trigger more stringent discharge requirements makes no sense. In its
local consent agreement with Brunswick County, Virginia Beach agreed not to seek
or lobby for any discharge requirements or water quality controls any different than
those established for the other waters of the state pursuant to state and federal
law.
Arguments by opponents that Virginia Beach's project will somehow prevent other
projects is not supported by North Carolina's own studies. In June 1991, North
Carolina prepared a report entitled "Roanoke River Basin Water Use Investigation"
prepared for the North Carolina Striped Bass Study Management Board. That
report was North Carolina's best effort to date to document extensive additional
water demands in the Roanoke River Basin. Even given the fact that it assumed
oenerous growth rates for every possible water use in the Roanoke River Basin,
North Carolina was able to justify additional ~ uses of only
approximately 70 mgd (in addition to the 60 mgd withdrawal proposed by Virginia
Beach) during the next 30 years. If you are familiar with the volumes and flows of
the Kerr/Gaston/Roanoke Rapids system, you will know that 130 mgd is totally
insignificant even during drought periods.

The lowest average monthly flow in the lower Roanoke River since Kerr Reservoir
was built is 2,000 cfs. Lower daily flows do occur in the winter but these are
strictly for the convenience of hydropower operations and do not relate to
hydrologic capability. North Carolina and the RRBA long ago agreed and admitted
in court that Virginia Beach's project will ngt affect the FERC mandated minimum
daily flows (2,000 cfs in the summer time, 1,000 cfs in the winter time) which are
required at Roanoke Rapids Dam. North Carolina's own modeling, as well as that
of Virginia Beach, has demonstrated that Virginia Beach's project will not affect
the lowest daily or lowest weekly flows in the system. Opponents to the project
compare the proposed withdrawal (93 cfs) to Iow daily flows even though the
project will not affect those flows. A check of USGS flow records will
demonstrate that those Iow daily flows occur sandwiched between days of much
higher flow which one would expect as a result of the hydropower peaking
operations.
The only documented water problem downstream of Roanoke Rapids Dam is
flooding. The lowest monthly flow in the lower Roanoke River is 4 times that of
the Potomac River or the James River under the same conditions and both those
basins have populations far greater than that of the Roanoke. While opponents of
the Lake Gaston project have sophisticated and polished arguments, they have
never been able to back them up with any specifics, something which would be
easy to do if there were any substance to their allegations.
I would hope that the City of Roanoke, which is an urban center that has suffered
water shortages in the past, would understand Virginia Beach's plight. I would
hope that your city would not pass a resolution adverse to the interests of
southeast Virginia without at least considering both sides of the issue.
Jurisdictions in the Commonwealth of Virginia need to cooperate with each other
to solve these and other pressing public problems, not take sides in what is
obviously a politically motivated controversy.

is simple, but not
the politics of it
THE PROJECT designed to
bring a maximum of 60 million gal-
lons a day of fresh water from Lake
Gaston to South Hampton Roads is
a textbook case of the vast impedi-
ments now inherent in realizing any
plan touching upon the environ-
ment, especially when it requires
intergovernmental cooperation.
If you wish to learn why Ameri-
ca has ceased to be a can-do, low-
cost producer, it will pay to study
the vicissitudes of the city of Vir-
ginia Beach in trying to achieve a
relatively simple solution to an en-
during water shortage.
In view of the importance of
South Hampton Roads to the econ-
omy of Virginia and the defense of
the nation, you might think that
state officials would be leading the
charge to lift this project off the
drawing board.
Gov. Douglas Wilder has pten-
ly of time to devote to his dream of
seeing the Washington Redskins
play a handful of home games a
year in Alexandria rather than a few
miles across the Potomac River --
but precious little time, apparently,
for something as significant as as-
suring a dependable source of water
for the state's fastest-growing cities.
Considering some of the boon-
doggles sold by the Army Corps of
Engineers in cahoots with addled-
brained local politicians and gim-
let-eyed developers, people are
right to be wary. But the Lake Gas-
ton project would divert just over 1
percent of the 5 billion gallons of
water, on average, flowing each day
through the Roanoke River system
toward Albemarle Sound and the
Atlantic Ocean.
The state of North Carolina
has been the chief opponent of the
projecL but Southside Virginia has
also been restless.
Considering the modest impact
of diverting such a small amount of
water, it seems that arguments
come down to the customary clam-
or against any change that appears
to take something from "us" to
benefit "them."
But who actually owns those 5
billion gallons, originating over a
vast riparian system, is another
matter. Surely, it doesn't belong ex-
clusively to those living within ear-
shot of the rippling streams, and
several courts have said exactly
that.
While the legitimate fears of
the-local people should be given
high priority, the overall good of
the commonwealth must be the
overriding consideration.
One who has tried to point the
way toward a solution is Del. Lewis
Parlor, D-Mecklenburg. He offered
a co~promise, enacted at the 1992
General Assembly, to sanction the
diversion of the water, provided
that ¥irglnia Beach agrees to pay $1
million a year compensation to 10
Sou. thside communities. This was
contingent upon their withdrawing
all lawsuits. Virginia Beach agreed
to make the payments, but some on
the other side refused to accept the
bargain.
Rep. L. F. Payne of the
Southside 5th Congressional Dis-
trict has now weighed in against the
project. One wonders if L. F. stands
for '~Let's Fool'em," because
Payne's objections seem nonsensi-
cal outside the domain of demagog-
ism.
He says, for instance, that if
Virginia Beach is allowed to with-
draw the water, the city will be able
"to dictate water-use policy to lo-
calities throughout Southside."
How exactly the governor and Gen-
eral Assembly, not to mention the
state Water Control Board, would
allow that to happen wasn't speci-
fied.
Payne's more serious argu-
ment, if you can call it that, is that
diversion of the water might inter-
t~re with future economic develop-
ment. Indeed it might, in the year
2392. But does he really believe
that, meanwhile, the vast Atlantic
requires this tiny drop of excess
water more than the people of
Hampton Roads?
In pouring hundreds of
millions into improving U.S. 58
across Southside, the entire state is
making an investment in its future.
That money is coming mainly from
citizens in more populous and af-
fluent areas such as Virginia Beach,
and I don't hear them complaining.
Ironically, 58 terminates at the
oceanfront in Virginia Beach, and
one of the main arguments used in
promoting this massive investment
was to tie the weak economy of
Southside with the strong economy
of Hampton Roads.
The $206-million project is it-
self not all that complicated. The
water would be drawn from Lake
Gaston and pass through an 85-
mile pipeline with the help of only
two pumping stations. Half the
length of the pipeline would be on
abandoned railway right-of-way,
and virtually all the needed proper-
ty has been acquired.
After studying the issue for
nine years, the Corps of Engineers
issued a permit in 1984. Of course,
that decision only opened the flood-
gates of litigation, and appeals to
every federal agency that might be
able to land a harpoon in the proj-
ect.
When the U.S. Court of
peals upheld the ruling of the lower
court validating the construction
permit, North Carolina attacked
the project under the Coastal Zone
Management Act. The National
Oceanic and Atmospheric Admin-
istration has recently held a hear-
ing, and U.S. Secretary of Com-
merce Barbara Franklin has
promised a decision on this front by
the end of the year.
It would take this entire news-
paper to catalog the milestones in
the case, but the conclusion of the
U.S. Court of Appeals for the
Fourth Circuit in upholding the
original permit appears cogent.
"There is no longer any controver-
sy,'' the judges said, "concerning
either the environmental effects on
the Roanoke River, or the need for
a new supply of water in Virginia
Beach, in both absolute terms and
relative to the needs of northeast-
ern North Carolina."
There are doubtless many argu-
ments that can be conjured up on
the opposing side, but we might
measure their significance by the
impact the water draw will have on
the Kerr Reservoir during periods
of drought. While the Kerr nov,
fluctuates by as much as 22 feet up
and down to control flooding, the
proposed water withdrawal would
decrease its level by no more than 3
inches in times of drought. The ef-
fect on adjoining Lake Gaston
would at all times be imperceptible.

AN ORDINANCE accepting the bid of Breakell, Inc., for
alterations to Nos. 1, 4 and 9 Aeration Basins at the Water
Pollution Control Plant, upon certain terms and conditions, and
awarding a contract therefor; authorizing the proper City officials
to execute the requisite contract for such work; rejecting all
other bids made to the City for the work; and providing for an
emergency.
BE IT ORDAINED by the Council of the City of Roanoke as
follows:
1. The bid of Breakell, Inc, in the total amount of
$141,795.00, for the alterations to Nos. 1, 4 and 9 Aeration Basins
at the Water Pollution Control Plant, as more particularly set
forth in the October 12, 1992 report of the City Manager to this
Council, such bid being in full compliance with the City's plans
and specifications made therefor and as provided in the contract
documents offered said bidder, which bid is on file in the Office
of the City Clerk, be and is hereby ACCEPTED.
2. The City Manager or the Assistant City Manager and the
City Clerk are hereby authorized on behalf of the City to execute
and attest, respectively, the requisite contract with the
successful bidder, based on its proposal made therefor and the
City's specifications made therefor, said contract to be in such
form as is approved by the City Attorney, and the cost of said work
to be paid for out of funds heretofore or simultaneously
appropriated by Council.
3. Any and all other bids made to the City for the aforesaid
work are hereby REJECTED, and the City Clerk is directed to notify
each such bidder and to express to each the City's appreciation for
such bid.

Backqround:
City Council, at its September 28, 1992 meeting,
publicly opened and read aloud the bids received
for Alterations to Nos. 1, 4, and 9 Aeration
Basins at the Water Pollution Control Plant.
Five (5) bids were received with Breakell, Inc.
submitting the low bid in the amount of
$141,795.00 and 200 consecutive calendar days.
Work consists of the replacement of the air
delivery system in the Aeration Basins. Air is
delivered to provide oxygen to support the
biological treatment process of raw sewage
digestion. Current air application system
requires about three times as much air supply to
get the same amount of air into the raw sewage as
the new system. This contract also includes about
2,000 feet of 3" stainless steel pipe cooling
system for the 1,700 horsepower blower engine(s).
Issues in order of importance are:
Compliance of the bidders with the requirements of
the contract documents.
B. Amount of the low bid.
C. Fundinq for the project.
D. Time of completion.

Alternatives are:
Award a lump sum contract to Breakell, Inc., in
the amount of $141,795.00 and 200 consecutive
calendar days for Alterations to Nos. 1, 4, and 9
Aeration Basins and the Cooling System in Basin
No. 1 at the Water Pollution Control Plant in
accordance with the contract documents as prepared
by the Office of City Engineer.
Compliance of the bidders with the
requirements of the contract documents was
met.
Amount of the low bid of $141~795.00 is
acceptable. Last year's contract was
$99~250.00 for similar work and other tasks
but did not include the stainless steel
cooling system.
Funding for this project is available in the
Sewage Maintenance Account Number
003-056-3155-2048. A total amount of
$321,000.00 was approved in FY 93 budget for
maintenance of Sewage Plant Equipment.
4. Time of completion is acceptable.
B. Do not award a contract at this time.
Compliance of the bidders with the
requirements of the contract documents would
not be an issue.
Amount of the low bid would probably change
if re-bid at a later date.
3. Funding would not be encumbered at this time.
Time of completion would be extended. The
cooling system for the blower engine is
urgently needed and would be the first basin
to be emptied so construction could be as
soon as possible.
Recommendation is that City Council take the following
action.
A. Concur with the implementation of Alternative 'A'.

Authorize the City Manager to enter into a
contractual agreement, in form approved by the
City Attorney, with Breakell, Inc. of Roanoke,
Virginia, for Alterations to Nos. l, 4, and 9
Aeration Basins at the Water Pollution Control
Plant in accordance with the contract documents as
prepared by the Office of City Engineer in the
amount of $141~795.00 and 200 consecutive calendar
days.
