ITEMS RECOMMENDED FOR ACTION: A report recommending that a public hearing be scheduled for Monday, November 9, 1992, at 7:30 p.m., to hear public comments on proposed amendments to the 1992-93 Community Development Block Grant program. Concurred in the recommendation. A report recommending execution of two contracts with The Salvation Army for payment of services delivered to citizens of the City of Roanoke by the organization's Abused Women's Program and Homeless Program. Adopted Resolution No. 31217-102692. (7-0) A report recommending execution of contracts with Real Estate Acquisition Management Specialists to assist the Right-of-Way Agent in the acquisition of real estate interests needed in support of the Roanoke River Flood Reduction Project, Peters Creek Flood Reduction Project, Second Street/Gainsboro Road Street Improvement Project, and Carvins Cove Improvement Project, Phase II. Council Member Harvey requested that the City Manager report to Council with regard to the City's practice of waiving certain rental fees at the Roanoke Civic Center for organizations utilizing the facility in thc name of charity. The City Manager was requested to provide Council with a briefing on Monday, November 2, 1992, in regard to unkempt sidewalks, vacant houses and weed-filled lots in the area of Gilmer Avenue and 12th Street, N. W., as described in a newspaper article that appeared in the Monday, October 26, 1992, edition of the Roanoke Times & World- News. Bowers, Mayor and Members of Roanoke City Council Roanoke, VA 24011 Dear Members of Council: As the result of official School Board action at its October 6, 1992 meeting, the Board respectfully requests City Council to appropriate funds to the following school grants: Grant No. 6504 - $3,500.00 for the Juvenile Detention Home program to provide funds for the salary and expenses of the two educational coordinators at the detention home. The program will be one hundred percent reimbursed by state funds. Grant No. 6754 - $6,820.00 for the Adult Basic Education program to provide funds for the education of adults who have not completed high school. The program will be reimbursed by federal funds. Grant No. 6901 - $4,700.00 for the Hurt Park Tutorial Program to provide for an after school tutorial program at Hurt Park Elementary School. The program is one hundred funded by the Department of Education and Central Fidelity Banks, Inc. Summer School Program - $90,993.00 for the summer school program. Summer school enrollment was higher than anticipated resulting in an increase in teacher and transportation cost. State monies will provide for the additional funding. Richard L. Background: City Council approved the CDBG FY 1993 budget and Statement of Objectives on May 11, 1992 by Resolution No. 30508-051192. City Council authorized a subgrantee agreement with the Roanoke Redevelopment and Housing Authority by Resolution No. 31167-082492 to implement the CDBG programs. II. Current Situation: City's Housing Development Office has requested transfer of $100,000 from the City's HOME funding allocation to the CDBG Critical Home Repair program; and transfer $100,000 from CDBG Critical Home Repair to the Downpayment Assistance Program. This would not eliminate any program, or change the level of funding for either. However, it would be a change in revenue source which would allow an easier implementation of both programs due to regulatory restrictions on the HOME program funds; and would require an amendment to the agreement with the Housing Authority. Citizen participation requirements call for an evening public hearing to amend the CDBG program and budget to make substantial changes to any CDBG activities or programs. Presentation of amended FY 1993 CDBG program and budget to include the changes in Critical Home Repair and Downpayment Assistance program will be made to City Council on November 9, 1992. III. Recommendation: It is recommended that City Council authorize a public hearin~ to be held on November 9, 1992 to hear public comments on the proposed amendments to the 1992-1993 Community Development Block Grant program. City Attorney, through a written opinion, dated April 23, 1986, stated that the City may contract with The Salvation Army, a church, or sectarian institution, as long as the contract is for the care of indigent sick or injured persons, and payment of City funds under any contract does not exceed the fair market value of services rendered. Citizens Services Committee recommended an appropriation of $22,600.00 for Fiscal Year 1992 - 1993 to be used for either program, and City Council concurred in the recommendation. Salvation Army rec$~ests that the $22,600.00 be divided between the Abused Women's and Homeless Programs as follows: 1. $12,600.00 for the Abused Women's Program. 2. $10,000.00 for the Homeless Program. Provide beds for men, women, and their dependent children who are City residents during the period covered by this contract. Provide food, shelter, vocational guidance, individual counselling, and job placement assistance to a program monitored by the Department of Human Resources to individuals placed in the program as a result of this contract. Provide requested reports to the Department of Human Resources, which will include: 1. Information on services given. 2. Number of City residents served. 3. Assurance that verification is on file that residents for whom the City of Roanoke is billed were residents of the City of Roanoke prior to entering the shelter. 4. Reports as required by the monitoring staff of the Citizens Services committee. CO~PENSATIONAND SCIERDULE OF PAYMENTS The City of Roanoke agrees during this contract period to pay the Contractor $20.00 per day per bed for City residents up to a total not to exceed $10,000.00 in total for the year for services under the conditions set forth herein. Payments will be made upon receipt of a Bo properly executed and approved invoice on a monthly schedule. Contractor shall submit such invoice at the end of each month. The City of Roanoke reserves the right to withhold funds for services if it is determined that the services identified in Section I of this contract are not being provided in a professional, acceptable manner. III. CITY LI~BILITY The Contractor acknowledges that the City of Roanoke shall not be responsible for any actions of Contractor's employees or designated representatives of the program. In the event of any litigation which may arise as a result of the Contractor's operation of this program, the Contractor agrees to assume the risk and/or liability for the cost of any such litigation including, but not limited to, payment of damages or attorney fees to the plaintiff and hold the City of Roanoke harmless therefrom. The Contractor also acknowledges and agrees that it will provide its own legal representation and bear the cost of the same. The Contractor also acknowledges and agrees that the City shall not be obligated to provide insurance coverage, either commercially or self supplied for the Contractor. Nothing contained herein shall be deemed an expressed or implied waiver of the sovereign immunity of the City of Roanoke. Co Neither the Contractor, its employees, assigns, or subcontractors shall be deemed employees of the City of Roanoke or of the Department of Human Resources while performing under this agreement. IV. NON-DISCRIMINATION During the performance of this contract, the Contractor agrees as follows: The Contractor will not discriminate against any subcontractor, employee, or applicant for employment because of race, religion, color, sex, disability, or national origin, except where religion, sex, disability, or national origin is a bona fide occupational qualification reasonably necessary to the normal operation of the Contractor. The Contractor agrees to post in conspicuous places available to employees and applicants for employment notices setting forth the provisions of this non-discrimination clause. The Contractor in all solicitations or advertisements for employees placed by or on behalf of the Contractor will state that such Contractor is an equal employment opportunity employer. Co Notices, advertisements, and solicitations placed in accordance with federal law, rule, or regulation shall be deemed sufficient for the purpose of meeting the requirements of A and B above. V. GENEI~L p][%OVISIONS ao Nothing in this contract shall be construed as authority for either party to make commitments which bind the other party beyond the scope of this contract. VI. CANCELLATION CLAUSE This contract shall remain in full force and effect until cancelled by either party giving the other party 30 days written notice of cancellation. Any such notice of cancellation shall be in writing and sent by certified mail (return receipt required) to the City of Roanoke, Director of Human Resources, Room 356, 215 West Church Avenue, S.W., Roanoke, Virginia 24011 in the case of the City; and to the Captain, The Salvation Army, P. O. Box 1631, Roanoke, Virginia 24008 in the case of The Salvation Army. No payment will be made for expenses incurred or services rendered after receipt of notice except those expenses incurred prior to date of termination that are necessary to curtailment of operations under this contract. The Contractor is hereby informed that failure to comply with any of the above conditions shall constitute grounds upon which the City of Roanoke may terminate this contract and/or discontinue payments after 30 days notice to the Contractor. Co If this action is taken, the Director of Human Resources will notify the program in writing by certified mail. VII. RELIGIOUS ORGANIZATION ao It is recognized that the Salvation Army is a religious organization, and as such, agrees that religious programs and orientation shall not be mandated for residents, but may be made available at the resident's request. No such program or orientation will be funded in whole or in part with funds provided pursuant to this contract. After interviewing several respondents to a published advertisement, approval to hire two (2) individuals was given on December 10, 1990, for real estate acquisition of Peters Creek, 2nd Street/Gainsboro Road, and Roanoke River for two (2) years. II. Current Situation: III. A. Full-time and ~art-time "Professional Coordinators" were advertised on October 9, 1992 in the Roanoke Times and World News. Staff received two (2) resumes on October 14, 1992. The resumes received were from John M. Bowman and Luther N. Nicar, the two individuals who have been employed in this position since December 1990. Beverly Enterprises is a conduit through which the property will be transferred to the Lemons. A Faison affiliate, Faison & Associates, will lease and manage the project for a term of fifteen years. Faison RRHA October 26, 1992 Honorable Mayor and Members of City Council Roanoke, Virginia Re: Reciprocal Operating Agreement - Dominion Tower Downtown North Development Project Dear Mrs. Bowles and Gentlemen: On October 19, 1992, I received a letter from Henry J. Faison requesting that the City consent to a waiver of a condition in the Reciprocal Operating Agreement ("REA") dated September 16, 1991 which governs the maintenance, repair, replacement and operation of the Dominion Tower, parking garage and adjacent improvements. Section 11.4 of the REA provides that Faison Roanoke Office Limited Partnership ("Faison") may not sell any interest in Dominion Tower for a period of two years or until the building is 90% leased, whichever occurs first. It is my understanding that the building is currently 87% leased. In his letter of October 19, 1992, Mr. Faison advised that he has received an offer for the sale of 50% of the building. Subsequent to the sale, the 50% interest would be leased back to Faison. Faison would remain liable on the debt encumbering the property. The proposed transaction cannot occur unless the City and the Roanoke Redevelopment and Housing Authority agree to waive the restriction contained in section 11.4 of the REA. Since Faison would remain the owner of 50% of the building and would continue to operate the entire building, I encourage City Council to consent to waiying the restriction of Section 11.4. Attached to this report is a resolution prepared by the City Attorney which would authorize the execution of any and all documents necessary to effect the City's agreement to waive the restriction on the sale of 50% of Faison's interest in the Dominion Tower. BE IT ORDAINED by the Council of the City of Roanoke that: 1. For the construction of the Carvins Cove Filter Plant Improvements, Phase I and II, including various waterlines needed by the City, the City wants and needs sixty-five (65) easements, together with tsmporary construction easements and rights of ingress and egress, and fee simple title to one (1) parcel of real estate, listed in an attachment to the report of the City Manager to the Water Resources Committee on this subject, dated October 26, 1992, on file in the Office of the City Clerk. The proper City officials are authorized to acquire for the City from the respective owners the necessary easements with appropriate ancillary rights with respect to the sixty-five (65) parcels and the fee simple title to one (1) parcel, for such consideration as the City Manager may deem appropriate, subject to the limitation set out below and subject to applicable statutory guidelines. 2. The City Manager is directed to offer on behalf of the City to the owners of each of the aforesaid parcels such consideration as he deems appropriate for the necessary interests, provided, however, the total consideration offered or expended to the owners of the parcels shall not exceed $180,000.00 without further authorization of Council. Upon the acceptance of any offer and upon delivery to the City of a deed, approved as to form and execution by the City Attorney, the Director of Finance is directed to pay the respective consid~ratlon to the owners of the interest certified by the City Attorney to be entitled to the conveyed, same. 3. Should the City be unable to agree with the owner of any real estate over which an easement is required or with the owner of the parcel to be acquired in fee simple or should any owner be a person under a disability and lacking capacity to convey real estate or should the whereabouts of the owner be unknown, the City Attorney is authorized and directed to institute condemnation or legal proceedings to acquire for the City the appropriate real estate. 4. In instituting or conducting any condemnation proceeding, the City Attorney is authorized to make motion on behalf of the City for entry of an order, pursuant to 925-46.8, Code of Virginia (1950), as amended, granting to the City a right of entry for the purpose of commencing the project. The Director of Finance, upon request of the City Attorney, shall be authorized and directed to draw and pay into court the sums offered to the respective owners. 5. The City Clerk is directed to mall a copy of this ordinance to each property owner identified on the list attached to the report of the City Manager to the Water Resources Committee, dated October 26, 1992. 6. In order to provide for the usual daily operation of the municipal government, an emergency is deemed to exist, and this ordinance shall be in full force and effect upon its passage. Backqround: Preliminary engineerinq study by Mattern & Craig, Inc., identified certain improvements needed at the Carvins Cove Filter Plant (Phase I) and to various waterlines (Phase II) needed to supply the City of Roanoke well into the next Century. Desiqn consultant constracts were awarded to Mattern & Craig, Inc., for Phase I improvements to the Carvins Cove Filter Plant and to Dewberry & Davis for Phase II improvements for 14 miles of waterlines from Carvins Cove to the Crystal Springs Pump Station. Final plans for Phase I and II are nearing completion and have been submitted to the State Health Department for appropriate approvals. The plans as submitted require 65 easements and one (1) parcel of real estate to allow for construction and maintenance on private properties. Water Resources Committee was briefed on the land acquisition needs of this project on September 28, 1992. II. Current Situation: City Council must authorize and fund the acquisition of real estate interest required for the two (2) projects. Need for the improvements to the Carvins Cove Filter Plant has been documented in the Preliminary Design Study by Mattern & Craig, Inc. Timinq to begin construction of the two (2) projects by this spring is extremely critical in order to avoid future water supply problems. Staff is anticipating an extremely ambitious acquisition schedule that cannot afford any delays. Cost to the City for 66 parcels is anticipated as follows: a. Appraisals: $ 40,000 b. Cooper, 58, grew up in the Galnsboro neighborhood, graduat- ed from the former Lucy Addison High School and joined the Air Force. He had two tours of duty in Vietnam and retired after 23 years. He came home to work for Pied- mont Airlines and later for thc Roanoke Central YMCA until his recent retirement. "You fight for people's rights in the military. You think every- body will be treated the same when you get home. But you find it isn't like that," Cooper said. Cooper complained about a double standard in a recent letter to the editor of this newspaper. William Clark, director of pub- lic works for the city, argued there is no double standard. Clark said the sidewalks near Cooper's house are covered with grass because no one mows or uses them. Because several nearby houses are vacant, there is no one to keep the grass mowed, Clark said. So the ~ass has taken over. In most neighborhoods, the residents mow the ~ass along side- walks and keep them neat, he smd. Foot traffic also helps prevent the sidewalks from becoming over- Clark said the city doesn't have enough maintenance workers to mow along all sidewalks.
