Program
I. Back~
Bo
Refuse collection and disposal is a basic service which the
city provides to its citizens. Expenditures in the current
fiscal year are expected to exceed $4 million.
Refuse collection servic~ is provided once a week to
approximately 36,000 city households.
Curbside/alleyside refuse collection is a program offering
collection to residents either at the street in front of, or
at the alley in rear of their home for pick up by city
crews.

Curbside/alleyside refuse collection proqra%l', was developed
by the Solid Waste Management staff. The following five (5)
committees were organized to address issues of the new
program.:
Routinq Committee. Developed a new routing plan for
curbside/alleyside refuse collection program.
Physically Unable/Premium Service Committee
Identified, investigated and provided the necessary
forms for citizens requesting this service.
Public Information Committee. Provided public
information to citizens, news-media, staff, etc.
concerning curbside/alleyside refuse collection
program.
Personnel Committee Work with affected solid waste
management employees that will be transferred to other
city departments.

Code Committee. Update the current ordinances for all
solid waste management programs.
Current Situation:

Curbside/alleyside refuse collection proqram was implemented
on June 7, 1993.
Fo
Residential refuse collection crews were reduced from 4 to 3
person crews. Positions reduced will be through attrition.--
There are a total of 1~8 Sanitation Workers and ~ Motor
Equipment Operator I positions affected.
Go
Residential refuse collection routes were reduced from 16 to
1--4 routes. Routes were designed to equal work loads eve-~ly
among crews. Factors taken into consideration were terrain,
proximity of houses, alleys vs streets, number of households
per route, etc.
Physically unable refuse collection servicn is currently
being provided at no cost to 825 residential customers who
are unable to bring their own household waste to the street
or alley due to physical limitations.
Premium refuse collection servicn is currently being
provided for a fee to 4--3 residential customers who are
~-able to carry their trash to the street but wish
to continue receiving backyard service.
Solid Waste Manaqement Department has identified 165 private
roads/driveways that are utilized for refuse collection
service. The department is securing owners signature on a
form agreement, approved by the city attorney, releasing the
city from liability for damages to private property while
performing this service.
Proqram cost savinqs for refuse collection budqe~ is
estimated to be $402,000.00 annually resulting from reduced
labor cost and equipment needs. A portion of these savings
will be used to offset the state mandated recycling program,
and the net reduction will be $260 000.00 as of January 1,
1994. '

A RESOLUTION expressing the desire of this Council that the
City of Roanoke be the site for the 1996 Annual Meeting of the
Virginia Municipal League.
WHEREAS, by 1996, restoration of the 330-room Hotel Roanoke
and construction of an adjoining 90,000-square foot Conference
Center will be completed;
WHEREAS, the City of Roanoke offers a unique blend of
shopping, entertainment, cultural attractions and a sense of place
born of authentic history;
WHEREAS, the City of Roanoke has completed Downtown
Revitalization, including among other things, a cultural center for
all of western Virginia known as Center in the Square, a renovated
Market Street, an Intermodal Transportation Center, new shops and
parking facilities;
WHEREAS, the Roanoke Neighborhood Partnership is a model for
promoting citizen involvement to implement neighborhood improvement
projects and revitalization;
WHEREAS, this City is desirous of serving as the host of the
1996 Annual Meeting of the Virginia Municipal League (VML);
THEREFORE, BE IT RESOLVED by the Council of the City of
Roanoke as follows:
1. This Council hereby officially expresses its desire to
host the 1996 Annual Meeting of VML.
2. The Mayor and the City Manager or their designees are
hereby authorized to make an appropriate presentation on behalf of
the City to the Time and Place Committee of VML at the 1993 Annual
Meeting of the VML to be held in Richmond, Virginia.
3. The City Manager is authorized to execute any forms
required by VML to be completed by a locality desiring to be
considered as a conference site.

upon form approved by the City Attorney, Amendment No. 1 to the
City's contract with Mattern & Craig, Inc., dated December 13,
1991, in order to provide additional engineering services in
connection with the design and construction administration of the
Roanoke Centre for Industry and Technology Water Storage Tank.
2. Such Amendment shall provide for the services set forth in
the City Manager's report to Council dated October 4, 1993, and the
cost of those additional services shall not exceed $88,975.00, with
the total contract amount not to exceed $288,975.00.

SUBJECT: WATER FACILITIES
ROANOKE CENTRE FOR INDUSTRY AND TECHNOLOGY
I. Backqround:
The City of Roanoke provides public water service to the
Roanoke Centre for Industry and Technology (RCIT).
Customers are connected to a water distribution system
that is supported by an existing water tank located in
Statesman Industrial Park. This tank is supplied by
water from the Carvins Cove and Falling Creek water
plants. Due to the location and elevation of this tank,
under certain operating conditions water supply to fringe
areas in RCIT is marginal.
II. Current Situation:
A preliminary enqineerinq study previously authorized by
City Council on July 26, 1993, has been completed. This
study recommends the City construct an elevated storage
tank in the Roanoke Centre for Industry and Technology in
order to improve fire flows and system pressures. The
estimated cost of the proposed 500t000 gallon tank is
$1.2 million, including construction and engineering
costs. This estimated cost for a tank of this size is
relatively high, due primarily to poor foundation
conditions at the available site. Alternative sites were
evaluated during the preliminary engineering phase but
were found to be unsuitable.
The services of Mattern & Craiq~ Inc. are being provided
to the City of Roanoke under the terms of an Agreement
for Professional Services dated December 13, 1991. This
agreement provides for engineering design services for
roadways and utilities located in the addition to the
Roanoke Centre for Industry and Technology. This
agreement covers services up to a maximum contract limit
of $200,000.00. The current contract value is
$184,497.00. Execution of this contract amendment will
raise the maximum contract limit to $288~975.00.

Engineering Services to be Provided:
1. Preliminary design of the proposed 500,000 gallon
elevated Storage tank, associated water pipe lines,
foundations, and operating controls.
2. Final Design to include final design plans,
specifications, and bid documents.
3. Provide construction administratio~ during construc-
tion of the proposed tank, including shop drawing
review, pay request review, and Oversight of the
construction activities.
Mattern & Craiqt Inc. has agreed to perform the work
listed above for a fee in the amount of ~88,975.00.
Issues in Order of Importance:
Enqineering concerns in establishing a reliable but cost-
effective 'method of improving water service to the
Roanoke Centre for Industry and Technology.
Schedules to provide timely design, bidding, and
construction of the proposed tank.
Funding for the proposed contract amendment is available
from the Water Plant Expansion Bonds 1992, account number
002-056-8366-9189.
IV. Alternatives:

A RESOLUTION endorsing the proposal to build a visitor center

WHEREAS, a considerable amount of vehicular traffic annually
travels past the Roanoke Valley exits on the Blue Ridge Parkway;
and
WHEREAS, downtown Roanoke, only a short distance from the Mill
Mountain exit, is the home to Center in the Square, the Virginia
Museum of Transportation, the Historic Farmers Market, the Roanoke
Valley Visitors Center, numerous commercial locations, and over a
dozen special events and festivals highlighting various aspects of
our community and our quality of life; and
WHEREAS, the City of Roanoke contains numerous other
commercial, historic and cultural attractions and districts; and
WHEREAS, the National Park Service, operator of the Blue Ridge
Parkway, and the County of Roanoke have proposed the creation and
siting of a visitors center on the Parkway to consist of a facility
of approximately 11,000 square feet providing interpretive and
informational assistance for travelers along the Blue Ridge Parkway
in Virginia; and
WHEREAS, the preferred site of both of these groups is on the
south side of the Roanoke River approximately four miles north of
the Blue Ridge Parkway exit leading to Mill Mountain and ultimately
downtown Roanoke via the local directional sign matrix system which
was installed in September, 1991; and
WHEREAS the proposed Blue Ridge Parkway visitor center will
provide information on recreational opportunities available
throughout the region, as well as a 150 seat auditorium for audio-
visual media, exhibit space, administrative offices, restrooms, a
picnic area, and sufficient parking; and
WHEREAS, the siting and building of such a facility at the
proposed location would enhance greatly the experience of motorists
travelling along the Blue Ridge Parkway as well as the development
of the entire Roanoke Valley, including the City of Roanoke.
THEREFORE, BE IT RESOLVED by the Council of the City of
Roanoke that this Council endorses the proposal to build a visitor
center on the Blue Ridge Parkway near the Mill Mountain exit and
furthermore offers its support through whatever means necessary and
available to further the realization of this proposal.
BE IT FURTHER RESOLVED that the City Clerk is directed to
forward attested copies of this resolution to the Honorable John W.
Warner, United States Senator, the Honorable Charles S. Robb,
United States Senator, the Honorable Robert W. Goodlatte, Member,

This is an excellent idea, and ties in very well with our "tourism initiative." With
several million people travelling up and down the Blue Ridge Parkway, it would be
an excellent opportunity for Roanokets activities to have a visitors center at that
intersection to inform and entice trevellera into the City. This project can benefit
Mill Mountain Zoo, the Transportation Museum, Center In The Square, and all the
other activities available for visitors and residents alike here in Roanoke.

the Board of Downtown Roanoke incorporated supporting and
encouraging the effort to establish a new (staffed) visitors center on
the Blue Ridge Parkway at a site already proposed by Roanoke
County and the National Parks Service. Downtown Roanoke
Incorporated, as a local economic development organization,
realizes the significant economic and marketing impact this would
have on the downtown area as well as the entire Roanoke Valley
if such a facility were built. As a result, it is our intent to join with
the other organizations and local governments which have
endorsed and are working to implement this proposal.
Through this correspondence, we hope to make you aware of this
tremendous opportunity for the Roanoke Valley and the ongoing

WHEREAS, the Roanoke Valley Regional Cable Television
Committee has, after utilizing the procurement procedure known as
competitive negotiation, recommended that the three franchising
authorities served by Cox Cable Roanoke, Inc. (City of Roanoke,
Town of Vinton and Roanoke County) retain the law firm of Moss &
Barnett as special counsel to assist the franchising authorities in
cable television rate regulatory matters before the Federal

1. The City Attorney is hereby authorized to retain the law
firm of Moss & Barnett to provide legal services relating to
obtaining the necessary certification from the Federal
Communications Commission to regulate the rates for basic cable
service, to review financial information submitted by Cox Cable
Roanoke,
Inc., in connection with rate regulation and to assist the
City in other cable television rate regulatory matters.
2. The City Attorney shall be authorized to execute any
required agreement with Moss & Barnett upon necessary and
appropriate terms.
3. The cost of legal services provided by Moss & Barnett
shall be shared by the City of Roanoke, the Town of Vinton and
Roanoke County on a pro rata basis in accordance with the number of

WHEREAS, on April 1, 1993, the Federal Communications
Commission ("FCC") adopted a Report and Order and Further Notice of
Proposed Rule-Makinq, in MM Docket No. 92-266, implementation of
sections of the Cable Television Consumer Protection and
Competition Act of 1992, Rate Regulation, FCC No. 93-177, released
May 3, 1993, effective September 1, 1993 ("FCC regulations"), which
describes a comprehensive process whereby franchising authorities
may regulate the rates charged by existing cable television
operators for the basic service tier;
WHEREAS, the FCC procedure allows franchising authorities to
seek certification from the FCC and thereafter regulate the rates
charged by cable operators for the basic service tier;
WHEREAS, the City of Roanoke, Virginia ("City"), as franchising
authority, has reviewed the FCC certification process and
applicable FCC forms and determined that it has the legal authority
and financial capability to exercise rate regulation under the
FCC's regulations;
WHEREAS, the City,
has determined that it
with assistance from qualified advisors,
is in the best interests of the City, its
residents, and cable television subscribers to exercise the
regulatory authority afforded franchising authorities under the
FCC's regulations; and
WHEREAS, the City has determined that its best interests are
served by moving forward in an expeditious manner seeking
certification from the FCC to regulate the basic cable service tier
to avoid potential rate increases which may result in higher
overall rates charged to cable television subscribers within the
City;
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Roanoke, Virginia, as follows:
1. The City Manager is hereby authorized to execute and
submit all applicable forms to the FCC to seek certification for
regulation of the basic service tier.
2. No further action or approval by City Council shall be
required for execution of any and all appropriate forms to be
submitted to the FCC for regulation of the basic service tier.
3. The City Clerk is directed to transmit an attested copy
of this Resolution to Gretchen Shine, Vice-President/General

Dear Council Members:
The Cable Television Consumer Protection and Competition Act
of 1992 became effective December 4, 1992. This Act was passed
overwhelmingly by the House and Senate and became effective after
Congress voted to override the President's veto.
Pursuant to the Act, the Federal Communications Commission
("FCC") was given six months to adopt regulations as to rate
regulation of cable television. Under the Act and the FCC's
regulations, the City, as franchising authority, may obtain
authority to regulate rates for "basic cable service" if it is
determined that there is no "effective competition" for the City's
franchisee (Cox Cable Roanoke, Inc.). In order to exercise its
authority with respect to "basic cable service", the City must
submit to the FCC a certification form (Form 328). The first date
on which the City could have submitted Form 328 was September 1,
1993 (not a deadline, but merely the first date upon which Form 328
could be submitted).
The Roanoke Valley Regional Cable Television Committee has met
and recommends that each of the franchising authorities served by
Cox Cable Roanoke, Inc., submit Form 328 to the FCC. The reasons
why this action is recommended are as follows:
The FCC's rate freeze order which became
effective April 5, 1993, will expire on
November 15, 1993. Thereafter, cable
operators may increase rates to the extent
they are not subject to rate regulation.
2. A minimum of 30 days will be required to
achieve FCC certification and, thereafter, the

City must adopt rate regulations consistent
with the FCC's regulations prior to initiating
rate regulation.
3. Since rates may only be reduced to the FCC
benchmark or ten percent below September,
1992, rates, (whichever is the lesser
reduction) and since the FCC's rate freeze
will expire on November 15, 1993, a delay in
filing for certification may result in higher
rates.
If the City obtains certification from the FCC to regulate the
rates for the basic service tier, it will control not only the rate
for that tier of service, but also the ancillary equipment used to
receive that tier of service. This equipment includes converter
and remote control rentals; additional outlet charges;
installation, disconnection and reconnection charges; as well as
any charges for changing tiers of service.
Through filing of the Form 328, the City certifies that it has
the resources to administer cable rate regulations and the legal
authority. Certification of the City becomes automatic unless the
FCC denies certification within 30 days from receipt of the City's
application, within 120 days of certification, the City must adopt
an ordinance relating to rate regulation. This ordinance will
provide for opportunities for hearings of interested persons;
protection of confidential information of the cable operator; time
limits in conformity with FCC regulations; and use of the benchmark
method of rate analysis unless the cable operator makes a cost of
service submission.
Please note that the rate regulation submission recommended by
the Regional Cable Television Committee relates only to the "basic
service" tier. The City does not have the right to regulate rates
for "other cable programming services" (the expanded tier of
service). Rates for the expanded tier of service may be regulated
by the FCC if the FCC receives a complaint from a subscriber or the
franchising authority. Whether the City should submit a complaint
to the FCC that the rates charged for the expanded tier of service
are "unreasonable" will be considered at a future meeting of the
Regional Cable Television Committee, and no recommendation is made
with respect to the expanded tier at this time. In summary, basic
service tier rates may be regulated by the City if the City follows
established procedures to obtain this authority, and expanded tier
rates may be regulated by the FCC upon complaint. Premium and pay
per view channels will remain unregulated.

To assist the franchising authorities (City of Roanoke,
Roanoke County and the Town of Vinton) in the complicated process
of rate regulation under the Cable Act, the Committee recommends
the retention of special counsel. Special counsel would assist the
franchising authorities in obtaining certification to regulate
basic tier rates and in reviewing the cable operator's response and
rate calculations.
Utilizing the procurement method known as competitive
negotiation, the Cable Television Committee solicited proposals
from law firms having expertise in cable regulation and received
seven proposals. Three firms were interviewed, and based on these
interviews, the Committee recommends the retention of Moss &
Barnett. Moss and Barnett specializes in cable television issues
and represents municipalities across the country, including the
cities of Norfolk, Hampton, Charlottesville and Virginia Beach and
the Town of Blacksburg. Of the firms interviewed, it is the
opinion of the Committee that the firm of Moss & Barnett was not
only the most experienced in cable television matters, but is it is
also believed that this firm will provide the most cost effective
services as a result of efficiencies achieved in connection with
representation of many municipalities. The firm's fee would be
split between the City of Roanoke, Roanoke County and the Town of
Vinton on a pro rata basis according to the number of cable
television subscribers in each jurisdiction.
In summary, the Committee recommends that City Council (1)
adopt the attached resolution authorizing filing of Form 328 with
the Federal Communications Commission to obtain authority for the
City to regulate basic cable television service and (2) adopt the
second attached resolution authorizing the retention of Moss &
Barnett to assist the three franchising authorities in rate
regulation issues.

BE IT ORDAINED by the Council of the City of Roanoke that:

definitions.
For the purpose of the regulations prescribed in this
division, certain terms and words used herein shall be
defined as follows:
Base Flood Elevation: The Federal Emergency Management
Agency designated 100 year water surface elevation with
a two (2) foot freeboard added.
Historic Structure: For the purpose of this subsection
only, any structure that is:
Listed individually on the National Register of
Historic Places or preliminarily determined by the
Secretary of the Interior as meeting the
requirements for individual listing on the National
Register;
Certified or preliminarily determined by the
Secretary of the Interior as contributing to the
historical significance of a district on the
National Register of Historic Places or a district
preliminarily determined by the Secretary to
qualify as a National Register Historic District;
Individually listed on the Virginia Landmarks
Register or determined eligible by the Virginia
Department of Historic Resources for such Register;
or
Individually listed on the City inventory of
historic places or as determined eligible for such
inventory by the Roanoke City Architectural Review
Board.
Substantial damaqe: Damage of any origin sustained by
a structure whereby the cost of restoring the structure
to its before damaged condition would equal or exceed
fifty (50) percent of the market value of the structure
before the damage occurred.
S36.1-362. Establishment of floodplain areas.
For the purpose of the regulations prescribed in this
division, there are hereby created various floodplain
areas subject to inundation by waters of the 100-year
flood. The basis for the delineation of the floodway and
the flood-fringe shall be the flood insurance study for
the City of Roanoke prepared by the Federal Emergency
Management Agency, Federal Insurance Administration,
dated July 2, 1992, and as amended. A copy of the flood
insurance study, city drainage standards and accompanying
maps, as amended, shall be filed in the offices of the
city clerk and the city engineer. The floodplain areas
shall consist of the following:

(e) In the floodway, no encroachments, including fill,
new construction, substantial improvements, rehabilita-
tion of substantially damaged structures and other
development, shall be permitted unless the applicant,s
professional engineer demonstrates through hydrologic and
hydraulic analyses performed in accordance with Standard
engineering practices that the proposed encroachment
would not result in any increase in the 100-year flood
elevation. The requirements of section 36.1-364,
paragraphs (d) and (f), shall apply to encroachments
permitted by this section.
S36.1-365. Permitted uses.
In the floodway, the following uses and activities
shall be permitted as principal uses provided that they
are in compliance with the provisions of the underlying
zoning district and provided that they do not require
structures, fill, or storage of materials and equipment
within the floodway which may cause any increase in flood
height and velocity:

City of Roanoke Flood Plain Ordinance was revised on January 21, 1992 (Ord. No. 30839-
012192) in order to: (1) bring the City's existing flood plain regulations into conformance with
recent federal requirements promulgated by the Federal Emergency Management Agency (FEMA);
(2) qualify the City of Roanoke for discounts on flood insurance rates; and (3) improve the
internal organization and structure of the current ordinance.
Flood Plain determinations are revised periodically by FEMA after passage of time or in response
to additional floods.
Current Situation:
FEMA has requested additional revisions to the City's flood plain regulations. Specifically, the
City needs to modify its definitions of historic structures and base flood, and to add a definition
of substantial damage. In addition, any reference in the City's ordinance to substantial
improvement shall include substantial damage. Lastly, permitted uses in the flooding district
should result in n.~o increase in flood elevation.
Revised flood lain data was advertised in the Roanoke Times & World News in December, 1992.
The City must use the new flood plain maps by October 1, 1993. The current ordinance provides
for the use of January 1, 1984, and as amended, maps. Therefore, the new flood plains delineated
by the new flood plain maps will become effective on October 15, 1993, even without Council
action on the ordinance.
Planning Commission public hearin~ on the proposed amendments was held on Wednesday,
September 1, 1993. Mr. John Peters with the City's Engineering Department summarized the
proposed amendments. Mr. Peters noted the proposed amendments were required by the FEMA
as a c°ndition for the City's continued participation in the flood insurance program. No members
of the punic spoke in opposition to the proposed amendments.

Pursuant to the provisions of §15.1-431, Code of Virginia

Funds and CMERP Funds
I have reviewed the attached request to appropriate
funding for the School Board. This report will appropriate funding
for two grants in the School Fund. These grants will be funded
with federal funds and fees.
This report will also appropriate $498,500 from the
School portion of the CMERP funds for the purchase of instructional
computers at Virginia Heights Elementary School and the middle
schools, Magnet School alterations, facility maintenance and
acquisition of the modular Health Clinic building. This is the
first appropriation of the School Boards FY93 CMERP funding of
$1,030,912. This will leave an unappropriated balance of $532,412.

As the result of official School Board action at its September 7, 1993 meeting, the Board
respectfully requests City Council to appropriate funds to the following school grants:
Grant No. 6517 - $5,005.00 for the 1993-94 Transitional Services program to provide
materials to ensure a smooth transition for handicapped students entering the school system. The
program will be reimbursed one hundred percent by federal funds.
Grant No. 6913 - $2,807.00 for the SAT Preparation program for 1993-94 to provide funds
from student fees for instruction to prepare students for the Scholastic Aptitude Test.
The Board further requests the appropriation of $498,500.00 from the 1993-94 Capital
Maintenance and Equipment Replacement Fund. The funds will be used for the purchase of
instructional computers at Virginia Heights Elementary School and the middle schools, for Magnet
School alterations, for facility maintenance, and for the acquisition of the modular Health Clinic
building.

RUNAWAY HOMELESS YOUTH GRANT, NUMBER 03CY0269/05
I. BACKGROUND
Crisis Intervention Center (Sanctuary) had previously
operated with a waiting list for services. This grant
has provided for Outreach services impacting one
hundred and thirty-five families since January 1990.
The waiting list has been virtually reduced from as
many as twenty to an average of six or less depending
on the rate of crisis calls.
Three full-time staff positions provide outpatient and
early intervention services for diversion from court
involvement or entering into residential and out-of-
family placement.
II. CURRENT SITUATION
Proqram Grant~ Number 03CY0269/05, has been received
for a fifth year in the amount of $83,322.00 for the
City of Roanoke's Crisis Intervention Center's Outreach
Program. Funds are for use September 1, 1993 through
August 31, 1994.
Total grant project period is renewed for three years
(September 1, 1992 through August 31, 1995)
City in-kind contribution of $8,332.20 will be for the
management time (present Sanctuary staff), clinical
supervision and office space (support services only, no
direct dollars from the City).
D. Proqram Grant will continue to be utilized as follows:
Three staff positions~ an Outreach Counselor I,
Group Home Counselor II, and a Social Worker Case
Aide. Funds are provided in the grant to upgrade
the Social Worker Aide to a Counselor I, the
Counselor I to a Counselor II, and the Counselor
II to a Counselor III due to increase in these
positions' responsibilities.
III. ISSUES
Staff will continue to provide outreach services,
including individual and family counseling, group
counseling, structured recreational educational
activities, and referral to existing services at
Sanctuary and elsewhere in the community.
3. Accomplishments in 1992-1993 include:

Weekly youth education/support groups
Regular participation in school - student
support teams
Special art therapy projects including the
Norwich Community Mural on Roanoke Avenue,
Downtown Learning Center Children's Mural,
and the current mural project.

case management/parent aide team.

Authorize the City Manager to execute required
documents to accept the United States Department of
Health and Human Services' Runaway and Homeless Youth
Program Grant, Number 03CY0269/05 and appropriate
$83,322.00 Grant Fund.
Cost. There would be no cost to the City except
for in-kind contribution.
Need for Services. The continued acceptance of
this grant would permit improvements in the
delivery of services, as well as continuing to
offer services to the number of families which
Sanctuary is currently unable to serve.
Do not authorize the City Manager to accept the United
States Department of Health and Human Services' Runaway
and Homeless Youth Program Grant, Number 03CY0269/05.
1. Cost. The City would incur a loss of revenue.
Need for Services. Should the grant not be
accepted, there would be loss of positive
enhancement and continued stress on the services

Backqround
A. The demand for HIV/Aids related services
Roanoke City.
is growing in
In 1989~ 36 patients with HIV/Aids were known to
the Health Department. As of June 1, 1993, 434
patients have sought services through the HIV/Aids
Program. Of those, 136 have died, 298 are alive.
The number of clients tested for HIV is growing
rapidly. The Roanoke City Health Department is
one of twenty-two designated anonymous test sites
in Virginia. The clinic is open every Monday from
3 p.m. to 6 p.m. HIV testing is offered at no
charge. 1990 - 578 were tested, 1991 - 820 were
tested, and 1992 1,399 were tested.
The Aids Council of Western Virqinia has provided case
management services in the past to several patients
within Roanoke City. However their updated service
plan states client services will be phased out.
The burden of client services will rest in the HIV/Aids
Program at the Roanoke City Health Department.
II. Current Situation
The Roanoke City Health Department has been awarded a
grant for $32,000 from the Bureau of Sexually
Transmitted Disease/Aids with the Virginia Department
of Health to address case management service needs.
The Roanoke City Health Department has a limit on the
number of full-time classified state positions to
establish this position.

1. Services to citizens - case manaqement services

management.
3. Supervision - the Health Department will supervise
this position.
4. Funding - The Health Department will reimburse the
City 100 percent of salary and benefits. Position
will be terminated when funding is depleted.
B. Do not approve restricted Health Counselor position.
Services to citizens - some citizens would not
receive case management services.
Benefits to the Health Department - Over-worked
staff and low morale is the results of growing
demand without adequate staff support.
Supervision - not an issue.
Funding - potential loss of grant funds to
City Health Department.

SUBJECT: ESTABLISHMENT OF A RESTRICTED ELIGIBILITY WORKER
POSITION
Members of Council:
I. Background
II.
The Virqinia Department of Medical Assistance Services
(Medicaid) Proqram now provides that eligibility
workers may be outposted where recipients receive
services to assure that all citizens have an
opportunity to apply for Medicaid.
Virginia State Department of Medical Assistance
Services and State Department of Social Services have
designed a program to outpost eligibility workers.
The State Departments of Health and Social
Services have encouraged local Departments of
Health & Social Services to enter into an
agreement.
The Agreement specifies that the local Social
Services will place staff at the local Health
Department to work exclusively with Health
Department clients who may be eligible for
Medicaid.
Virginia State Code requires that Medicaid
eligibility be determined by Department of Social
Services, in keeping with Federal Social Security
Act.
Current Situation
A.
The Roanoke City Health Department has requested that
the Roanoke City Department of Social Services (DSS)
place an eligibility worker at the Health Department to
take applications and determine eligibility for
Medicaid.
B. The Health Department has no outposted Medicaid
Eligibility workers at this time.
III. Issues
A. Services to citizens.
B. Benefit to Health Department.
C. Benefit to the Department of Social Services.
D. Technical supervision and traininq.
E. Fundinq.
IV. Alternatives
Approve new qrant eliqibilit¥ position with DSS to be
placed in the Health Department. DSS must establish a
new position that will be available for the length of
the contract with the Health Department. The contract
would be for 12 months renewable each year upon
agreement of both parties. Position would be
classified as grant with full benefits.
Services to citizens - citizens requesting health
care services at the Health Department will be
able to apply for Medicaid at the same time as
applying for Health Department services, thereby,
making application more accessible to citizens.
This makes the process customer oriented,
convenient, with improved efficiently by providing
"one stop shopping" for eligibility and delivery
of service.
Benefit to Health Department. - provides that the
Health Department can maximize Medicaid revenue
because those patients who have not been getting
eligibility tested will have that done now at the
time of service.
Benefit to the Department of Social Services
Reduces DSS in-house workload. Provides another
eligibility worker at no cost to DSS.
4. Supervision and Traininq
Training~ technical supervision~ and quality
control monitoring of the outposted
eligibility worker's decisions would be
provided by the DSS. City could be adversely
impacted through ineligible payment for
Medicaid if worker is not properly trained
and monitored closely which is the case for
new eligibility workers.
b. Day to day supervision will be provided by
the Health Department.
5. Fundinq
The outpost eliqibility worker's salary and
benefits will be reimbursed by the Health
Department with no cost to the City.
The Health Department has access to a 50%
federal match by participating with the
Medicaid Program in outposting an eligibility
worker.
B. Do not aDDrove restricted Medicaid worker position.
Services to citizens - Citizens coming to the
Health Department for clinical care will have to
continue to work with a separate city department
in order to obtain Medicaid eligibility. Some
citizens may not apply for Medicaid benefits.

potential loss to expand staffing at no cost for

agreement and ancillary documents required to establish

FOR INFILTRATION/INFLOW (I/I) REDUCTION DESIGN
INC.
I. Background:
Consultant Enqineerinq Services approved at City
Council's regular meeting of March 8, 1993 included
various design services identified through the
infiltration/inflow (I/I) reduction studies. Hayes,
Seay, Mattern & Mattern, Inc. was selected for some
projects in the competitive negotiation process in
which Mattern & Craig, Inc. was selected for other
projects. At that time, specific projects for HSMM had
not been completely identified and prioritized.
B. Projects now identified are as follows:
Shaffers Crossing Sewershed, Project SC-9,
consists of replacement and/or repair of 950 feet
of 8" sewer line along Glenrose Avenue from
Golfside to Forest Park Boulevard.
Garden City Sewershed, Project GC-1, consists of
replacement and/or repair of 3,650 feet of 8"
sewer line extending from Yellow Mountain Road
through undeveloped land to Tipton Avenue.
Murray Run Sewershed, Project MR-2, consists of
replacement and/or repair of 2,860 feet of 18"
sewer line extending eastward from Sheffield
Avenue to Grace Avenue and just south of Brandon
Avenue.
II.
Current Situation:
A. Results of sewershed studies indicate that these three
(3) projects require implementation, therefore, the
agreement has been negotiated.

Murray Run Sewershed - Proceed with Phase I, II,
and III for Project MR-2.
Work is scheduled so as to stay within funding
limitations of $1,000,000 per year from 1993
through 1995 approved by City Council at its
regular meeting of Monday, November 23, 1992.
Consultant fee amount, following negotiations, is
$134,965.00. Fee is based on direct personnel
expenses times an overhead and profit multiplier
of 2.0 plus reimbursable expenses.
Documented flow data, accumulated as of July 1,
1993, indicate monthly infiltration/inflow (I/I)
reduction to the City sewer system of 11.7 million
gallons per month.
III.
Issues in Order of Importance:
Engineering concerns in maintaining the most cost-
effective (I/I) reduction program in accordance with
the three (3) year funding approved by City Council.
B. Reasonableness of engineering fee.
C. Available fundinq.
IV.
Alternatives:
City Council authorize the City Manager to execute an
engineering services agreement in a form suitable to
the City Attorney.

I. Backqround:
Consultant Contract awarded at City Council's regular
meeting of March 8, 1993 included various design
services identified through the sewershed infiltration/
inflow (I/I) reduction studies. The contract
anticipated subsequent phases to be based on prelimnary
design studies.
B. Current contract status is as follows:
1. Peters Creek Sewershed, Project PC-l, is in the
construction administration stage (Phase III).
2. Peters Creek Sewershed, Project PC-2, is in the
easement acquisition stage (Phase II).
3. Peters Creek Sewershed, Projects PC-3 and PC-4,
are now in the preliminary design stage (Phase I).
4. Mudlick Sewershed, Projects ML-1 and ML-2, are in
the preliminary design stage (Phase I).
II.
Current Situation:
Results of the sewershed studies indicate that
additional projects require implementation, therefore,
the agreement must be altered to meet the additional
requirements.
B. Chanqe Order No. 2 is described as follows:
Peters Creek Sewershed - Prepare plats for
easement vacations for PC-1. Existing easements
will no longer be needed upon completion of new
sewer mains.

Background:
A. City Council, at its regular meeting on September 14,
1992, authorized the award of an Engineering Services
Contract to Hayes, Seay, Mattern & Mattern, Inc. for
the replacement or repair of certain bridge structures
in various stages as directed by City staff. It was
anticipated that decisions of final plans and
construction would be based on preliminary design
studies.
Bridge structures and design phases were as follows:
1. Structure No. 1822 on Main Street crossing Roanoke
River for Phase I, Preliminary Design, with cost
estimate.
2. Structure No. 8064 on Ninth Street crossing
Roanoke River for Phase I, Preliminary Design,
with cost estimate.
Structure No. 8060 on Centre Avenue crossing an
unnamed branch for Phase I, Preliminary Design,
Phase II, Final Design, and Phase III, Contract
Administration.

Recent bridqe inspections of the First Street Bridge
over the N & W Railway (Structure No. 8002) indicate
that this bridge should be closed to traffic unless
certain repairs, exclusive of complete design for
replacement, be made at the earliest possible date.
This structure is currently being monitored at frequent
intervals and stress movements throughout the bridge
continue to accelerate.
Followinq proposals and neqotiations with City staff,
Hayes, Seay, Mattern & Mattern, Inc., has agreed to
amend their Agreement for Consultant Services dated
August 17, 1992, to perform the work for $7f800.00.
Amendment No. 1 will be in the form of a detailed
engineering report to confirm the specific repairs
necessary to maintain the integrity and safety of this
bridge that cannot be delayed until such time as the
Second Street Bridge is built. After the completion of
the Second Street Bridge, the First Street Bridge may
then be considered for full repair, closed, or limited
to pedestrian use.

I. Background:
City Council, at its regular meeting on September 14,
1992, authorized the award of an Engineering Services
Contract to Mattern & Craig, Inc. for the replacement
or repair of certain bridge structures in various
stages as directed by City staff. It was anticipated
that decisions on final plans and construction would be
based on preliminary design studies.
B. Bridqe structures for design phases were as follows:

the N & W railway for Phase I, Preliminary Design,
with cost estimate.

Structure No. 8061 on Hollins Road crossing Lick Run,
Phase I, Preliminary Design, is complete.
Structure No. 8052 on Craig Robertson Road crossing
Garnand Branch, Phase I, Preliminary Design, and Phase
II, Final Design, are complete, and Phase III, Contract
Administration, is underway.
Recent detailed investigations of the Jefferson Street
Bridge and the Hollins Road Bridge (Structures No. 8003
and 8061) indicate that these two (2) structures
require further implementation of Phases II and III,
designated as Amendment No. 1, in order to assure
continued safety to the traveling public.
Jefferson Street Bridge (Structure No. 8003) will
be designed as two projects as follows:
Project No. 1 (Priority) - Replacement and related
repairs of the pilaster and wingwall at the
southeast corner of the bridge. Work involves
laterally bracing the rotating wall with earth
anchors to prevent further rotation against the
pilaster and replacement of the pilaster which has
failed by transverse shear. Cost is estimated at
$150e000.
Project No. 2 - Necessary, minimal repairs to
remaining structure to secure another 15 - 20
years of safety integrity. Work involves pressure
sealing of cracked, open joints and the
installation of four (4) new transverse expansion
joints over the bridge piers to reduce impact
loads and moisture intrusion through the deck slab
to critical areas below. The estimated cost for
this work is $60~000. This work can be delayed
until funds become available.
Hollins Road Bridge over Lick Run (Structure No.
8061) consists of replacement of two (2) spans
across Lick Run and minimal necessary repairs of
masonry wall supporting spans 3 thru 8. Estimated
cost of the work is $250~000.

This bridge is scheduled for replacement as part
of the 13th Street widening project on the City's
portion of the Virginia Department of Transporta-
tion Urban Street Program. Due to funding
limitations, this work will probably not be done
for several years, and it is imperative to keep
the existing bridge in service until replaced due
to existing traffic and anticipated traffic
generated by the Roanoke Valley Resource Authority
Park Transfer Station under construction nearby.
Following negotiations with City Staff, Mattern &
Craig, Inc. has agreed to amend their Agreement for
Consultant Services dated August 6, 1992 with the City
of Roanoke to perform the work as Amendment No. 1 for
an amount of $138,500.00.

City of Roanoke Pension Plan - Cost-of-Living Raise
On May 11, 1992, City Council adopted Ordinance No. 31005-051192 which
provided a 3% lump sum payment based on annual pension to eligible members of the
City of Roanoke Pension Plan.
On July 2, 1993, 968 retirees received this increase based on the following
qualifications:
retired on or before June 30, 1992;
· earned 120 months (10 years) of creditable service before retirement
(except occupational disability); and
· spousal qualifications based on above requirements for employee/retiree.
This lump sum payment was a one-time cost of $188,000 to the Pension Plan.
In order to partially address the funding requirements of this increase, a one-time lump

sum payment of $160,000 was designated from the FY1993 year-end fund balance.
The attached budget ordinance appropriates $160,000 to the General Fund, account

LEASE
This DEED OF LEASE, entered into this day of
, 1993, by and between RICHARD E. HARMAN and
MARGARET P. HARMAN ("Lessor") AND CITY OF ROANOKE, a municipal
corporation organized and existing under the laws of the
Commonwealth of Virginia ("Lessee").

In consideration of the covenants and agreements herein
contained, Lessor hereby leases to Lessee, and Lessee hereby rents
and hires from Lessor, upon the terms and conditions herein set

forth, this lease shall continue thereafter, upon the same terms
and conditions and at the same rent, for successive rental terms of

BE IT RESOLVED by the Council of the City of Roanoke as
follows:
1. That the City Manager or the Assistant City Manager and
the City Clerk are hereby authorized, for and on behalf of the
City, to execute and attest, respectively, Amendment No. 1 to the
Agreement with Roanoke At Home, a Virginia limited partnership, and
Total Action Against Poverty in Roanoke Valley, Inc., in form
similar to Amendment No. 1 which is attached to the City Manager's
report dated October 4, 1993, to this Council, which amendment
provides for changing the priority of the City's secured interest
and extending the date of completion for the rehabilitation of the
five (5) subject structures.
2. The form of the amendment shall be approved by the City
Attorney.

Subject: Amendment to an Agreement with Total Action Against
Poverty and Roanoke At Home Limited Partnership
I. Background:
May 13, 1991, Council authorized allocation of $145,000
of Community Development Block Grant (CDBG) funds to
Total Action Against Poverty (TAP) as part of the
overall CDBG program budget by Resolution No. 30508-
51391.
September 23, 1991, Council authorized execution of an
agreement between the City and TAP, providing for the
loan of $145,000 to TAP for a period of 15 years at one
percent interest; by Resolution No. 30708-92391.
These funds were for the purchase of five vacant
and deteriorated structures which TAP intends to
rehabilitate into 12 apartments and rent to 43
formerly homeless individuals, (the "Section 8
Moderate Rehab SRO" project).

TAP has received a commitment for $500,000 from the
Virginia Housing Partnership Fund SHARE program toward
the project. Of this money, $150,000 is an energy grant
to TAP and $350,000 is a one percent interest loan for
15 years.
TAP intended to use the $350,000 for rehabilitation
of the structures.
Of the $150,000 energy grant $102,000 will be
contributed to the project and $48,000 will be a
loan to the project

The remaining funds for rehabilitation were to come
from various funding sources.
Loan to TAP is secured by a Purchase Money Deed of Trust
on each of the five subject properties.
January 11, 1993, Council authorized execution of
an agreement between City, TAP, and Roanoke At Home
("HOME"), a Virginia limited partnership, the
general partner of which is TAP, permitting the
transfer of the structures to HOME under certain
terms and conditions; Resolution No. 31304-011193.

One of the above referenced conditions is that HOME
execute Deeds of Trust in favor of the City and
that TAP remain liable on its Purchase Money Deed
of Trust.
One of the above referenced terms is that the Deeds
of Trust in favor of the City from TAP and HOME are
subordinated to Deeds of Trust in favor of the
Commonwealth for the $350,000 loan from the
Commonwealth to TAP.
E. Supportive services for the 43 individuals will be
provided by nine local service agencies including TAP,
Mental Health Services, VA Medical Center, Fifth
District Employment and Training Consortium, and City
Social Services.
Current Situation:
A.
NationsBank has agreed to provide rehabilitation funding
in the amount of $867,000.
At the conclusion of rehabilitation, the loan from
NationsBank will be paid off with private investment
money, for which no security is required, and loan
proceeds from the Commonwealth of Virginia ($350,000).
In addition, security for a loan from TAP to HOME for
$48,000 will be placed on the subject properties.
The rehabilitation loan, $867,000 from NationsBank, for
the project closed on September 30, 1993. NationsBank's
security, is second in priority behind the Deeds of
Trust in favor of the City. NationsBank has asked to be
first in priority.
The City Administration is willing to take second
position behind NationsBank during rehabilitation, and
third position behind the Commonwealth (for $302,000)
and TAP (for $48,000) after the work has been completed.
See attached letter dated September 28, 1993 (Attachment
B).
An amendment to the Agreement dated December 22, 1992,
and a subordination agreement will have to be executed
between the City, TAP, and the Roanoke At Home Limited
Partnership, permitting the subordination of the City's
Deeds of Trust.

other appropriate documents, all approved as to form by
the City Attorney.
Community development objectives would be met in
two ways:

Five vacant and deteriorated structures would
be rehabilitated and re-occupied.
43 formerly homeless single individuals will
have permanent housing with rent subsidies
provided by HUD.
Roanoke At HOME Limited Partnership and TAP will
remain liable on the aforementioned Notes until the
Notes have been satisfied.
Legal issues would be addressed by an amendment to
the loan agreement, similar in form to the attached
Amendment No. 1, meeting approval of the City
Attorney. Loan will remain secured by a Note and
Deed of Trust against the property.
Timing is critical since the closing on the loan
for the properties was held on September 30, 1993,
and the decision to subordinate the City's Deeds of
Trust to NationsBank needs Council approval.
Do not authorize the City Manager to execute said
Agreement, and other documents, between the City, the
Partnership and TAP.
Community development objectives would not be
addressed. Project cannot go forward as planned.
Financial liability would be problematic since
property has already been transferred. TAP would
remain liable on the Notes executed pursuant to the
Agreement authorized September 23, 1991, referenced
above.
3. Legal issues would have to be resolved.

Timing would not be an issue, but project would be
delayed further as alternative arrangements are
pursued.
Recommendation:
Recommendation is for Council to concur in Alternative A
which will authorize the City Manager to execute an amendment
similar in form to the attached amendment (Attachment A) to
the contract dated December 22, 1992, between the City, TAP
and Roanoke At Home Limited Partnership, a subordination
agreement, and other appropriate documents, all approved
as to form by the City Attorney.

completion of the construction, and the payment of
the indebtedness owed to Nationsbank, each of said
Notes, and the Deeds of Trust securing the same,
shall be no less than the third position in
priority to only a Deed of Trust executed in favor
of the Commonwealth of Virginia for permanent
financing for up to $350,000.00, and a Deed of
Trust executed in favor of TAP for up to $48,000.00
relating to an Energy Grant from the Commonwealth
of Virginia.
Paragraph 3 shall read as follows:
REHABILITATION:
The five (5) vacant structures shall be
rehabilitated into a maximum of fourteen (14)
clusters of SRO's consisting of a maximum of
four (4) persons per cluster, as detailed more
fully in the project design submitted to HUD
by the Roanoke Redevelopment and Housing
Authority and incorporated by reference into
this Agreement. Said rehabilitation shall be
completed, and permanent certificates of
occupancy shall be issued, on each of the five
vacant structures by December 31, 1994. All
SRO units so created shall be rented to low
and moderate income persons for a minimum of
five (5) years following completion of the
rehabilitation.
3. All other terms of the Agreement dated December 22, 1992,
shall remain in full force and effect.
