appropriation of $75,000.00 from the 1993-94 Capital Maintenance
and Equipment Replacement Fund, to be used for the repair of weather
related damages to the roof at Persinger Hall, Patrick Henry High
School.

A report recommending an extension of pay benefits for an
employee of the Police Department.

A report recommending authorization to submit street inventory
additions to the Virginia Department of Transportation for
approval by the Commonwealth Transportation Board to enable
State maintenance payment eligibility.

A report recommending acceptance of the bid submitted by
S. R. Draper Paving Company for all work necessary to repave
Main Street, S. W., on a unit price basis, in the amount of
$79,353.50; and transfer of funds in connection therewith.

A report recommending acceptance of the bids submitted by
Berglund Chevrolet, Inc., in the amount of $210,511.05, and
Federal Signal Corp., in the amount of $14,685.00, for
providing police automobiles and emergency lights to be
mounted on said automobiles.

A report recommending acceptance of the bids submitted by
Baker Brothers, Inc., in the amount of $79,745.00, for providing
one new articulating loader, and $56,785.00, for providing one

Works Equipment Co., in the amount of $11,646.00, for
providing two new vacuum leaf loaders.

I. BACKGROUND
The Fifth District Employment and Training Consortium
(FDETC) was awarded Title III carry-over funding from the
July 1, 1992 to June 30, 1993 Program Year (PY) to serve
dislocated workers.
1. Planned programs include on-the-job training,
classroom training, customized training, remedial
education and job placement activities.
B. The FDETC was awarded additional Title III funding from

the Governor's Reserve Fund to serve dislocated workers,
providing those services previously listed.
The FDETC was awarded Title II-A carry-over funding from
PY 1992-93 to provide the full range of programs and
services as listed above.

The FDETC was granted permission to transfer Title II-B
and II-A funds to the Title II-C Program, for the
provision of previously outlined programs and services.
City of Roanoke is the grant recipient for FDETC funding.
City Council must appropriate the funding for all grants
the FDETC receives.

Governor's Employment and Training Department (GETD) sent
the FDETC Notice of Award (NOA) # E-02 in the amount of
$55,831.00 in Title III carry-over funding for the July
1, 1993 to June 30, 1994 PY.

GETD sent the FDETC NOA # E-03 in the amount of
$150,000.00 in Title III Governor's Reserve funding for
PY 1993.
C. GETD sent the FDETC NOA # 94-03-03 in the amount of
$64,552.00 in Title II-A carry-over funding for PY 1993.

GETD sent the FDETC NOA # 94-03-04 permitting a transfer
in the amount of $98,198.00 from Title II-A and II-B
programs to Title II-C for PY 1993.

A RESOLUTION extending the pay benefits provided for by
Resolution No. 4748 for a certain employee of the Police
Department.
WHEREAS, Resolution No. 4748, adopted February 28, 1936,
provides that police officers and fire fighters absent from duty
because of disabling injuries incurred in the llne of duty shall
suffer no loss in compensation for sixty days;
WHEREAS, by Resolution No. 4748, Council has voluntarily
established a local benefit for the City's Police Officers and Fire
Fighters, and eligibility for such benefit is determined solely by
the terms of Resolution No. 4748, not by the Workers' Compensation
Act or related law;
WHEREAS, Resolution No. 4748, requires that extension of
benefits provided for by such resolution beyond sixty days shall be
only upon authority of Council; and
WHEREAS, Sgt. William Moser of the Police Department has
previously been determined eligible for such benefits, and by
Resolution No. 31359-030193 dated March 1, 1993, Council has
extended such benefits through August 31, 1993; and
WHEREAS, by report of February 7, 1994, the City Manager has
recommended that benefits available to such employee be extended
until June 30, 1994.
THEREFORE, BE IT RESOLVED by the Council of the City of
Roanoke as follows:
1. Sgt. William Moser of the Police Department shall be
entitled to the difference between his base pay and any sums
received pursuant to the Workers' Compensation Act until June 30,
1994, or until such officer is able to return to duty as a police
officer, or until such employee is no longer classified as a police
officer, whichever occurs first.
2. Such employee shall under no circumstances receive
payments from the City, including Workers' Compensation benefits,
in excess of his regular base pay as a police officer.
3. The City Manager shall be authorized to terminate the
benefits provided for by this resolution should it be established
by report of a licensed physician that said employee is able to
return to duty at a police officer's regular base pay.

SUBJECT: Extension of Pay Benefits
I. BACKGROUND:
Council Resolution No. 4748 of February 28, 1936,
established a policy for payment of a salary
supplement to injured employees in the Fire
and Police Departments for a period of sixty
days. The intent of the salary supplement
was to ensure that a police officer or
firefighter will receive his full salary if an
accident occurs on the job and causes the
employee to lose time from work.

Sqt. William Moser of the City of Roanoke's Police
Department suffered significant job related injuries
on January 23, 1991 in a vacant building when he fell
through an open floor covered with plastic, and into
the basement. The accident was accepted by the
City Workers' Compensation program. City
Council approved supplemental salary payments
to Sgt. Moser because it was clear he would
qualify for the benefit by being unable to
work after sixty days.
II. CURRENT SITUATION:
A rehabilitation plan to bring Sgt. Moser back into the
work environment was designed by a rehabilation
therapist retained by the City. The plan was reviewed
by Sgt. Moser and his doctors prior to implementation.

He is currently working in the City's
warehouse doing computer data entry.

Sat. Moser has filed a lawsuit in the Circuit Court for
the City of Roanoke against various parties involved in
ownership and renovation of the building in which the
accident occurred. It is the contention of Sgt. Moser
that the defendants knew or had reason to know of the
unreasonably dangerous condition of the premises and
they failed to take steps to prevent the accident.

The local court recently ruled that the lawsuit does
not state a valid claim against the defendants because
of a doctrine of law known as the "Fireman's Rule"
which, in very general terms, exempts the owner of real
property from liability for injuries to police officers
or fire fighters who come on the premises to perform
a public function. Sgt. Moser's attorney has advised
that he intends to appeal this decision. It will be
several months before the Supreme Court of Virginia
will decide whether to accept the appeal or not. If
Sgt. Moser's appeal is accepted, a final decision in
the case could take several additional months.

Rehabilitation throuah modified duty ended in
January 1993. Vocational training will continue at
the warehouse through June 30, 1994 to allow Sgt. Moser
to complete an extensive physical therapy program.
Authorization to extend salary supplements needs
to be approved by City Council. Continuing salary
supplements until June 30, 1994 will permit the
vocational program to be implemented and evaluated.

Dear Members of Council:
SUBJECT: Street Inventory for State Maintenance
Payment Eligibility
I. Background:
Code of Virginia establishes the eligibility criteria of
localities for receiving funds from the Virginia
Department of Transportation (VDOT) for street
maintenance. It specifies two functional classifications
of highways (Principal/Minor Arterials and
Collector/Locals) and establishes a base payment rate per
lane mile for each classification of roadway. These
rates are adjusted annually by VDOT based upon a
statewide maintenance index of unit costs for labor,
equipment and materials used by VDOT on roads and
bridges.
City eliqibility for fiscal year 1993-94 is approximately
$6~489~873 in street maintenance payments from VDOT.
These funds are used for many maintenance expenditures
that the City incurs for streets, sidewalks, curb and
gutter, traffic signals, bridges, signs and pavement
markings.
II. Current Situation:
Inventory additions need to be submitted to VDOT prior to
April 1, 1994, in order to be eligible for payment for
the next fiscal year. These additions are to be
submitted on VDOT forms with an accompanying resolution
from City Council.
B. City staff has found that Blue Hills Circle, N.E. (as
shown on the attached form) should be submitted to VDOT
before April 1, 1994, to enable its eligibility for
payment in the next fiscal year. Approval of this
addition to the street inventory could add $4~055 at
current year payment rates.

IV. Alternatives:
Authorize the City Manager to submit the attached form to
the Virginia Department of Transportation for approval by
the Commonwealth Transportation Board to enable State
Maintenance Payment eligibility.
Maintenance payments from VDOT could increase by as
much as $4,055 with the State's approval of this
street.
Timing is important inasmuch as this list must be
submitted to VDOT (Salem Resident Engineer) by April
1, 1994.
Do not authorize the City Manager to submit the attached
form to the Virginia Department of Transportation for
approval by the Commonwealth Transportation Board to
enable State Maintenance Payment eligibility.

Recommendation is that City Council authorize the City

Pavinq of Main Street, S.W. from Brandon Avenue to Wasena
Avenue was originally planned for in the 1993 Paving
Program due to the pavement condition.
Water line construction in this portion of Main Street,
as part of the overall Carvins Cove Water Transmission
Line Project, necessitated that repaying Main Street be
deferred to 1994. Neighborhood streets adjacent to Main
Street which were also in need of paving were repaved in
1993 as a substitute for Main Street to make use of the
quantities available in that paving contract.
Current Situation

Tour DuPont bicycle race scheduled for May 9, 1994
incorporates this segment of Main Street in its route.
The roadway condition, made worse by the waterline
project, is presently unacceptable for a bicycle race.
The May 9, 1994 race date occurs earlier than the annual
paving contract start date (usually late-May to
early-June).

Bids for profiling and repaying Main Street, S.W. were
received after due and proper advertisement, until
2:00 p.m., on January 20, 1994, at which time all bids so
received were publicly opened and read in the Office of
the Manager of General Services. Three (3) bids were
received and reviewed by a staff committee consisting of
William F. Clark, Director of Public Works, D. Darwin
Roupe, Manager of General Services, and Robert K.
Bengtson, P.E., Traffic Engineer. The low bid in the
amount of ~79~353.50 was submitted by S.R. Draper Paving
Company.

I. Background
Capital Maintenance and EquiDment Replacement
Program has identified the need for Replacement of
Fifteen (15) Police Automobiles.
Bid Specifications were developed and, along with
request for quotations were sent to eleven (11)
vendors for Police Automobiles and five (5) vendors
for Emergency Light Systems. A public
advertisement was also published in the Roanoke
Times and Roanoke Tribune.

Bids were received after due and proper
advertisement and were publicly opened and read in
the Office of the Manager of General Services.
Five (5) bids were received on the Police
Automobiles and three (3) bids were received on the

I. Background
Capital Maintenance and Equipment Replacement
Proqram has identified the need to replace an
Articulating Loader, a Loader/Backhoe and Two (2)
Vacuum Leaf Loaders.
Specifications were developed and along with
request for quotations were sent to seventeen (17)
vendors for the Loader and Backhoe and to sixteen
(16) vendors for the Leaf Loaders. Public
advertisements were also published in the Roanoke
Times and Roanoke Tribune.
Both Roanoke City Schools and Roanoke Redevelopment
and Housing Authority were consulted prior to
securing bids.

advertisement. Ail bids were publicly opened and
read in the Office of the Manager of General

Appropriation of CDBG Program Income
Miscellaneous Proaram Income
The City has received the following additional program income:
· $7,011 in loan repayments received by the City under the Home
Purchase Assistance program.
$8,368 in other program income relating to loan repayments from
Roanoke Redevelopment and Housing Authority, demolitions, loan
repayments from the Northwest Neighborhood Environmental
Organization (NNEO) and interest earned on the CDBG float loan
to Fralin and Waldron and program income. This is the difference
between what was previously appropriated and actually received.
I recommend that City Council appropriate the total of $15,379 in program
income as follows:
· $7,011 to account 035-092-9240-5192, Unprogrammed CDBG-
Home Purchase Assistance Program loan repayments.
· $8,368 to account 035-092-9240-5189, Unprogrammed CDBG-
Other Income.
These amounts will be available for further appropriation transfers
community development purposes.

Dear Mrs. Bowles and Gentlemen:
Pursuant to Chapter 9, Education, of the Code of the City of Roanoke (1979), as
amended, establishing a procedure for the election of School Board Trustees, this
is to advise you that the terms of Marilyn L. Curtis, M. Wendy O'Neil, and James M.
Turner, Jr., wili expire on June 30, 1994.
Pursuant to Section 9-16 of the City Code, on or before February 15 of each year,
Council shall announce its intention to elect trustees of the Roanoke City School
Board for terms commencing July I through (1) public announcement of such
intention at two consecutive regular sessions of the Council and (2) advertisement
of such intention in a newspaper of general circulation in the City twice a week for
two consecutive weeks.
Section 9-17 of the City Code provides that applications must be filed in the City
Clerk's Office by March 10 of each year. Application forms will be available in the
City Clerk's Office and may be obtained between the hours of 8:00 a.m., and 5:00
p.m., Monday through Friday. Information describing the duties and
responsibilities of School Board Trustees will also be available.
Over the next four months, I will keep the Council informed as to the various steps
required to be followed throughout the selection process.
