ATTEST: this City Clerk Feb~ary 7, 1994 Honorable Mayor and City Council Roanoke, Virginia Members of Council: SUBJECT:Funding for the Fifth District Employment and Training Consortium I. BACKGROUND The Fifth District Employment and Training Consortium (FDETC) was awarded Title III carry-over funding from the July 1, 1992 to June 30, 1993 Program Year (PY) to serve dislocated workers. 1. Planned programs include on-the-job training, classroom training, customized training, remedial education and job placement activities. B. The FDETC was awarded additional Title III funding from II. the Governor's Reserve Fund to serve dislocated workers, providing those services previously listed. The FDETC was awarded Title II-A carry-over funding from PY 1992-93 to provide the full range of programs and services as listed above. Do The FDETC was granted permission to transfer Title II-B and II-A funds to the Title II-C Program, for the provision of previously outlined programs and services. City of Roanoke is the grant recipient for FDETC funding. City Council must appropriate the funding for all grants the FDETC receives. CURRENT SITUATION Governor's Employment and Training Department (GETD) sent the FDETC Notice of Award (NOA) # E-02 in the amount of $55,831.00 in Title III carry-over funding for the July 1, 1993 to June 30, 1994 PY. B o GETD sent the FDETC NOA # E-03 in the amount of $150,000.00 in Title III Governor's Reserve funding for PY 1993. C. GETD sent the FDETC NOA # 94-03-03 in the amount of $64,552.00 in Title II-A carry-over funding for PY 1993. Do GETD sent the FDETC NOA # 94-03-04 permitting a transfer in the amount of $98,198.00 from Title II-A and II-B programs to Title II-C for PY 1993. III. ISSUES IV. A. Program Operations B. Funding C. Timing ALTERNATIVES Appropriate the FDETC's additional funding totallinq $270,383.00, approve the transfer of $98,198.00 and increase the revenue estimate by $270,383.00 in accounts to be established by the Director of Finance. Program Operations Existing activities will continue, planned programs will be implemented and new programs will be initiated by FDETC's Policy Board and Private Industry Council. 2. Funding Funds are available from the Grantor agency at no additional cost to the City. Timing - Immediate action will allow programs to be implemented and completed within planned time frames. B. Do not appropriate the FDETC's fundinq totalling $270,383.00 or the transfer of $98,198.00. Program Operations - Planned programs to serve participants would be delayed and new programs will not be implemented. Funding - Not a factor. (However, underexpenditure of allocated funds could result in loss of these monies to another locality.) 3. Timing - Delay will cause late start-up of programs and underexpenditure of available funds. V. RECOMMENDATION Approve Alternative A which would appropriate the FDETC's fundinq totallinq $270,383.00 and increase the revenue estimate by $270,383.00 in accounts to be established by the Director of Finance, as well as allow the transfer of funds between titles. VIRGINIA A RESOLUTION extending the pay benefits provided for by Resolution No. 4748 for a certain employee of the Police Department. WHEREAS, Resolution No. 4748, adopted February 28, 1936, provides that police officers and fire fighters absent from duty because of disabling injuries incurred in the llne of duty shall suffer no loss in compensation for sixty days; WHEREAS, by Resolution No. 4748, Council has voluntarily established a local benefit for the City's Police Officers and Fire Fighters, and eligibility for such benefit is determined solely by the terms of Resolution No. 4748, not by the Workers' Compensation Act or related law; WHEREAS, Resolution No. 4748, requires that extension of benefits provided for by such resolution beyond sixty days shall be only upon authority of Council; and WHEREAS, Sgt. William Moser of the Police Department has previously been determined eligible for such benefits, and by Resolution No. 31359-030193 dated March 1, 1993, Council has extended such benefits through August 31, 1993; and WHEREAS, by report of February 7, 1994, the City Manager has recommended that benefits available to such employee be extended until June 30, 1994. THEREFORE, BE IT RESOLVED by the Council of the City of Roanoke as follows: 1. Sgt. William Moser of the Police Department shall be entitled to the difference between his base pay and any sums received pursuant to the Workers' Compensation Act until June 30, 1994, or until such officer is able to return to duty as a police officer, or until such employee is no longer classified as a police officer, whichever occurs first. 2. Such employee shall under no circumstances receive payments from the City, including Workers' Compensation benefits, in excess of his regular base pay as a police officer. 3. The City Manager shall be authorized to terminate the benefits provided for by this resolution should it be established by report of a licensed physician that said employee is able to return to duty at a police officer's regular base pay. ATTEST: City Clerk. February 7, 1994 '94 ~-,~I -2 Honorable David A. Bowers, Mayor and Members of City Council Roanoke, Virginia Dear Members of Council: SUBJECT: Extension of Pay Benefits I. BACKGROUND: Council Resolution No. 4748 of February 28, 1936, established a policy for payment of a salary supplement to injured employees in the Fire and Police Departments for a period of sixty days. The intent of the salary supplement was to ensure that a police officer or firefighter will receive his full salary if an accident occurs on the job and causes the employee to lose time from work. Be Sqt. William Moser of the City of Roanoke's Police Department suffered significant job related injuries on January 23, 1991 in a vacant building when he fell through an open floor covered with plastic, and into the basement. The accident was accepted by the City Workers' Compensation program. City Council approved supplemental salary payments to Sgt. Moser because it was clear he would qualify for the benefit by being unable to work after sixty days. II. CURRENT SITUATION: A rehabilitation plan to bring Sgt. Moser back into the work environment was designed by a rehabilation therapist retained by the City. The plan was reviewed by Sgt. Moser and his doctors prior to implementation. Be Sqt. Moser beqan modified duty in July 1992. He is currently working in the City's warehouse doing computer data entry. Ce Sat. Moser has filed a lawsuit in the Circuit Court for the City of Roanoke against various parties involved in ownership and renovation of the building in which the accident occurred. It is the contention of Sgt. Moser that the defendants knew or had reason to know of the unreasonably dangerous condition of the premises and they failed to take steps to prevent the accident. Members of Council Page 2 The local court recently ruled that the lawsuit does not state a valid claim against the defendants because of a doctrine of law known as the "Fireman's Rule" which, in very general terms, exempts the owner of real property from liability for injuries to police officers or fire fighters who come on the premises to perform a public function. Sgt. Moser's attorney has advised that he intends to appeal this decision. It will be several months before the Supreme Court of Virginia will decide whether to accept the appeal or not. If Sgt. Moser's appeal is accepted, a final decision in the case could take several additional months. Dt Rehabilitation throuah modified duty ended in January 1993. Vocational training will continue at the warehouse through June 30, 1994 to allow Sgt. Moser to complete an extensive physical therapy program. Authorization to extend salary supplements needs to be approved by City Council. Continuing salary supplements until June 30, 1994 will permit the vocational program to be implemented and evaluated. III · ISSUES) ae Employee Morale Cost Council Resolution No. 4748, dated February 28, 1936 IV. ALTERNATZVES: Authorize salary supplements for Sgt. Moser to continue until June 30, 1994. 1. Employee morale will not be affected. Personnel cost in the Police Department will continue to be overstated because the salary supplements are deducted from the department's personnel account. The workers' compensation account is not effected by the salary supplements. Pay for workers' compensation will continue to be paid by the City as required by the Code of Virginia Section 65.2-502. 3. Compliance with Resolution No 4748 would be possible. Members of Council Page 3 Be Do not authorize Sgt. Moser's salary supplements to be paid until June 30, 1994. 1. Employee morale will be negatively affected. Personnel costs will be reduced by the difference between the amount paid through worker's compensation, as required by the Code of Virginia, and gross salary. ComDliance with Resolution No 4748, dated February 28, 1936 would not be possible. RECOMMENDATION= Council concur with Alternative A and authorize payments until June 30, 1994 or until such employee returns to a normal job function, whichever shall first occur. A RESOLUTION authorizing the City Manager to submit a street inventory for State maintenance payment eligibility to the Virginia Department of Transportation (VDOT), upon forms prescribed by VDOT for approval by the Commonwealth Transportation Board in order to ensure the City's eligibility for an increase in State maintenance funds. WHEREAS, the Code of Virginia (1950), as amended, establishes eligibility criteria for localities for receiving funds from VDOT for street maintenance purposes; and WHEREAS, inventory additions are required to be submitted to VDOT prior to April 1, 1994, in order to be eligible for payment for the next fiscal year. THEREFORE, BE IT RESOLVED by the Council Roanoke that the City Manager additions to VDOT for approval Board in order to ensure the State street maintenance funds, as set forth in the City Manager's report and its attachments, dated February 7, 1994. ATTEST: of the City of is authorized to submit inventory by the Commonwealth Transportation City's eligibility for additional City Clerk. Roanoke, Virginia February 7, 1994 Honorable David A. Bowers, Mayor and Members of Council Roanoke, Virginia Dear Members of Council: SUBJECT: Street Inventory for State Maintenance Payment Eligibility I. Background: Code of Virginia establishes the eligibility criteria of localities for receiving funds from the Virginia Department of Transportation (VDOT) for street maintenance. It specifies two functional classifications of highways (Principal/Minor Arterials and Collector/Locals) and establishes a base payment rate per lane mile for each classification of roadway. These rates are adjusted annually by VDOT based upon a statewide maintenance index of unit costs for labor, equipment and materials used by VDOT on roads and bridges. City eliqibility for fiscal year 1993-94 is approximately $6~489~873 in street maintenance payments from VDOT. These funds are used for many maintenance expenditures that the City incurs for streets, sidewalks, curb and gutter, traffic signals, bridges, signs and pavement markings. II. Current Situation: Inventory additions need to be submitted to VDOT prior to April 1, 1994, in order to be eligible for payment for the next fiscal year. These additions are to be submitted on VDOT forms with an accompanying resolution from City Council. B. City staff has found that Blue Hills Circle, N.E. (as shown on the attached form) should be submitted to VDOT before April 1, 1994, to enable its eligibility for payment in the next fiscal year. Approval of this addition to the street inventory could add $4~055 at current year payment rates. III. Issues: A. Maintenance payments B. Timing Members of City Council Page 2 IV. Alternatives: Authorize the City Manager to submit the attached form to the Virginia Department of Transportation for approval by the Commonwealth Transportation Board to enable State Maintenance Payment eligibility. Maintenance payments from VDOT could increase by as much as $4,055 with the State's approval of this street. Timing is important inasmuch as this list must be submitted to VDOT (Salem Resident Engineer) by April 1, 1994. Do not authorize the City Manager to submit the attached form to the Virginia Department of Transportation for approval by the Commonwealth Transportation Board to enable State Maintenance Payment eligibility. 1. Maintenance payments from VDOT are not increased. 2. Timinq is not an issue. Recommendation is that City Council authorize the City Manager to submit the attached form to the Virginia Department of Transportation for approval by the Commonwealth Transportation Board to enable State Maintenance Payment eligibility. Ae Pavinq of Main Street, S.W. from Brandon Avenue to Wasena Avenue was originally planned for in the 1993 Paving Program due to the pavement condition. Water line construction in this portion of Main Street, as part of the overall Carvins Cove Water Transmission Line Project, necessitated that repaying Main Street be deferred to 1994. Neighborhood streets adjacent to Main Street which were also in need of paving were repaved in 1993 as a substitute for Main Street to make use of the quantities available in that paving contract. Current Situation Ae Tour DuPont bicycle race scheduled for May 9, 1994 incorporates this segment of Main Street in its route. The roadway condition, made worse by the waterline project, is presently unacceptable for a bicycle race. The May 9, 1994 race date occurs earlier than the annual paving contract start date (usually late-May to early-June). Be Bids for profiling and repaying Main Street, S.W. were received after due and proper advertisement, until 2:00 p.m., on January 20, 1994, at which time all bids so received were publicly opened and read in the Office of the Manager of General Services. Three (3) bids were received and reviewed by a staff committee consisting of William F. Clark, Director of Public Works, D. Darwin Roupe, Manager of General Services, and Robert K. Bengtson, P.E., Traffic Engineer. The low bid in the amount of ~79~353.50 was submitted by S.R. Draper Paving Company. Members of City Council Page 2 III. Issues: IV. A. Compliance of bidder with requirements of the contract documents B. Amount of low bid C. Funding for construction D. Time of completion Alternatives: ae City Council accept the lowest responsible bid~ based on unit prices bid, and award a contract to S. R. Draper Paving Company for all work necessary to repave Main Street, S.W. in the amount of $79,353.50. 1. Compliance of the bidder with the requirements of the contract documents was met. Amount of low bid is acceptable. Fundinq for construction needs to be transferred from the Capital Maintenance and Equipment Replacement Program (CMERP) Account to the Street Paving Account No. 001-052-4120-2010. City Council previously approved $350,000 in CMERP for the 1994 Street Paving Program. 4. Time of completion has been set in the project specifications as a fixed date of April 27, 1994. B. Reject all bids and do not award contract. 1. Compliance with requirements of contract documents would not be an issue. 2. Amount of low bid could be higher if bid at a later date. 3. Funding for construction would not be spent at this time. Members of City Council Page 3 Time of completion of work will be delayed, thereby leaving the condition of Main Street in an unacceptable condition. V. Recommendation: Ae City Council approve Alternative "A" and award the contract to S.R. Draper Paving Company on a unit price basis in the amount of $79t353.50. Transfer funding from the Capital Maintenance and Equipment Replacement Program (CMERP) to the Street Paving Account No. 001-052-4120-2010. C. Reject the other bids received.
