The City Manager was requested to report to Council within two
weeks as to the status of repayment of $200,000.00 of Henry
Street RevitzliTafion funds previously loaned to Total Action
Against Poverty for asbestos abatement at the Dumas Hotel; and
the City Manager was further requested to report to Council as
expeditiously as possible with regard to the request of the Henry
Street Revival Committee for reinstatement of the $200,000.00
to be used, in part, to fund architectural renderings for needed
public improvements to the Henry Street area.

A Resolution commending and expressing appreciation to
faculty and students of the College of Architecture and Urban
Studies of Virginia Polytechnic Institute & State University for
their valuable services in preparing a revitalization strategy for
the Henry Street area within the City of Roanoke.

Housing Authority; and transfer of funds in connection
therewith.

A report recommending execution of a Reciprocal Agreement

Mayor Bowers, members of Roanoke City Council, City Manager
Herbert, administrative officials, citizens and friends of the City
of Roanoke, it is indeed a pleasure to be with you once again this
afternoon to talk about one of my favorite subjects -- Henry
Street.
Ten years ago, I stood before you as the Mayor of this great city
and recommended the revitalization of Henry Street as part of my
State of the City Address. I said that by working together, we can
bring the best back to Henry Street; the best food, the best music,
the best business establishments, the best planned developments,
the best entertainment and the best celebrations.
It is hard for me to believe that time has passed so quickly.
that 10 year period much has been accomplished:
Over
Most of the land in the original Henry Street project
area has been acquired by the Roanoke Redevelopment and
Housing Authority.
Many blighted structures have been demolished.
Total Action Against Poverty has constructed a new Music
Center in the former Dumas Hotel.

The Henry Street Festival of Jazz brings thousands of
people back to Henry Street each year for fun, food and
entertainment.
Several comprehensive planning studies have been
undertaken most recently by students and faculty members
from Virginia Tech.
Finally, over the past year, the Henry Street Committee
has worked to develop a detailed mission statement for
the committee and a design concept to guide the future
development of Henry Street.
Today, I stand before you as the Chairman of the Henry Street
Revival Committee to say that I am still excited about the future
of Henry Street. However, until recently, there has been little
incentive for new businesses to locate or invest in the Henry
Street area. With the renovations of the Hotel Roanoke and a new
Conference Center a short distance away and the pending
improvements to Wells Avenue and Second Street, Henry Street is
once again becoming attractive as a location for new businesses and
related activities.
Public improvements such as appropriate historical lighting, new
sidewalks and street trees are needed to help make the Henry Street
area more appealing for prospective new businesses and investors,
to help make the area more attractive for existing residents and
visitors passing through the area, and to tie the Henry Street
area, both physically and visually with the surrounding

neighborhood and the other major development projects planned
under construction in the 'area.

We are here this afternoon to ask for your support of our request
for CDBG funding so that the necessary architectural plans and
renderings can be developed to guide the installation of the needed
public improvements. The funds we are requesting ($200,000.00)
were previously approved for public improvements in the Henry
Street area but were loaned in 1991 to TAP to assist with asbestos
abatement of the Dumas Hotel. We need these funds to continue the
revitalization of Henry Street.
I would conclude by thanking all of you for your time. On behalf
of the Henry Street Revival Committee, I would also like to thank
the many students and faculty members from Virginia Tech (Ms. Wendy
Jacobson and Ms. Zorica Budic) for their excellent presentation
this evening and their assistance with preparing this exciting new
plan for Henry Street.

A RESOLUTION commending and expressing appreciation to faculty and students
of the College of Architecture and Urban Studies of Virginia Polytechnic
Institute & State University for their valuable services in preparing a
revitalization strategy for the Henry Street area within the City of Roanoke.
WHEREAS, the Henry Street Revival Committee of the City of Roanoke, under
the chairmanship of the former Mayor, Dr. Noel C. Taylor, has for several years
been attempting to develop a revitalization strategy for the Henry Street area,
an area of particular cultural and historical significance within the City;
WHEREAS, students from the College of Architecture and Urban Studies of
Virginia Polytechnic Institute & State University, under the able leadership of
faculty members, Wendy R. Jacobson and Zorica D. Budi~, have conducted a
demographic, land use and property value analysis of the area; conducted a survey
of Gainsboro neighborhood residents; studied the attributes and characteristics
of the Henry Street area; developed principles and objectives for future
development in the Henry Street area; and presented a development concept, based
upon the principles and objectives, that includes proposals for land use, public
space and built form;
WHEREAS, the revitalization strategy developed by faculty and students of
the College of Architecture and Urban Studies and contributed to the Henry Street
Revival Committee was ably presented, thorough and creative and professional in
all respects; and
WHEREAS, this Council desires to commend the faculty and students involved
in this public-spirited project and to express the appreciation of this Council
to those faculty and staff for their valuable contribution to the advancement of
the Henry Street area of the City;
THEREFORE, BE IT RESOLVED by the Council of the City of Roanoke as follows:
1. City Council adopts this resolution as a means of expressing its
commendation and appreciation to those faculty and students of the College of
Architecture and Urban Studies of Virginia Polytechnic Institute & State
University who prepared and contributed a revitalization strategy for the Henry
Street area of the City of Roanoke.
2. The City Clerk is directed to forward an attested copy of this

Allocation of Virginia Housing Parmership Funds; Amendment to Contract
with RRHA; Allocation of HOME Funds to Rental Rehabilitation Program
I. Background
Rental Rehabilitation Program assists the rehabilitation of existing substandard multi-
family properties in older neighborhoods of the City (Attachment 1).
City has made funds available for a portion of the rehabilitation from HOME, CDBG,
or other federal funds. At times these funds were supplemented by additional
allocations from the State or the Virginia Housing Development Authority (VHDA).
II. Current Situation
Virginia Department of Housing and Community Development (DHCD) has allocated
$250,000 from the Virginia Housing Partnership Fund (VHPF) to the City for the
"Rehabilitation Loan Program" for small rental properties through December 31,
1994.

4% interest, 15-year loan directly to property owners.
Properties will be 1-10 unit rental properties.
State funds $2,500 to $15,000 per unit for rehabilitation.
State's funds must be matched dollar for dollar from CDBG or HOME funds
of the City.
Units must be rented to low-moderate income tenants (60% of median family
income, $21,120 for a family of three) for ten years or the term of the loan.
State funds will be matched with an equal amount ($250,000) from the City's HOME
allocation. The financing to the property owner for rehabilitation then will be one-half
loan from the State, one-half grant from the RRHA from City HOME funds. The
$250,000 of the City's HOME flmds require a 12 1/2% ($31,250) "local" match,
which will be provided by the low interest rate of the VHPF funds.
Implementation of the Program requires:
Execution of the Administrative Agreement with DHCD to accept the
$250,000 allocation of VHPF funds (Attachment 2).
Execute an amendment with the Redevelopment and Housing Authority for the
administration of the Program on the City's behalf (Attachment 3).
Allocate $250,000 of HOME funds to match VHPF funds.

Time Homebuyers (035-052-5301-5231) to an account to be established by the
Director of Finance for the Rental Rehabilitation Program.
Authorize the City Manager to execute an amendment to the HOME contract with
RRHA to be approved as to form by the City Attorney, for the administration of the
Program.
Consistency with policies of the City would be met, specifically the CHAS.
Priority V of the CHAS calls for improvements to rental property using
HOME funds and allocations from the Virginia Housing Partnership Fund.
Assistance to first-time homebuyers and for rehab of owner-occupied homes
could be accomplished with 1994 HOME funds, to be received this spring.
Impact on community revitalization would be positive. Approximately 30
units in twelve properties in older neighborhoods would receive $500,000 of
improvements. Preference is expected to be given to vacant and condemned
buildings, concentrated in eligible Enterprise Zones and neighborhoods of
special interest, e.g. Gainsboro, Gilmer Avenue Conservation Area, Old
Southwest, Neighborhood Stabilization and Enhancement Program area
(NSEPtion) in Mountain View.
Cost to the City is nothing in General Funds, as $250,000 is from HUD and
$250,000 is from DHCD. The DHCD loans will generate the required
$31,250 in local match for the HOME funds.

Consistency with established policies of the City would not be met, including
the CHAS.
Impact on community revitalization would be negative, as $500,000 would not
be available for improvements to property probably unlikely to be repaired
without such subsidies.
Cost to the Cit~ would be nothing initially. HOME funds would be used
elsewhere, but the City's total match requirement of approximately $117,000
would be more difficult to meet in order to access the $1.1 million of 1993
and 1994 HOME funds.
V. Recommendation
A. ·
Authorize the City Manager to execute the Administrative Agreement with DHCD, to
be approved as to form by the City Attorney, to accept the allocation $250,000 of
Housing Partnership funds in support of the Rental Rehabilitation Program.
Amend the 1993 HOME program description to transfer $200,300 from Rehab of
Owner-Occupied Houses (035-052-5301-5230) and $49,700 from Assistance to First-
Time Homebuyers (035-052-5301-5231) to an account to be established by the
Director of Finance for the Rental Rehabilitation Program.
Authorize the City Manager to execute an amendment to the HOME contract with
RRHA to be approved as to form by the City Attorney, for the administration of the

LOCAL ItOU$1NG REIIABILITATION PROGRAM
ADMINISTRATIVE AGREEMENT
This Agreement is entered into as of this day of , 19 , by and
between the Virginia Department of Housing and Community Development (DHCD) and City of
Roanoke hereinafter referred to as "Local Administrator."
The Local Housing Rehabilitation Loan funds (hereinafter referred to as the "Funds") which are
the subject of this Agreement are authorized under the Virginia Housing Partnership Fund Act. The
Funds are subject to and this Agreement incorporates by reference, the terms, guidelines and
regulations set forth in the Program Guidelines, as revised from tim to time, and the laws of the
Commonwealth of Virginia. Also incorporated by reference in this Agreement is the Administrators
Program Application including certifications, resolutions and agreements contained therein.
The Local Administrator shall initiate the Activities as required by this Agreement and described
in the Administrators' Program Application and the Program Guidelines, beginning January 1, 1994,,
unless special conditions require additional action on specified activities before proceeding with that
activity.
The Local Administrator will complete the work as required by this Agreement and described
in the Administrators' Program Application, and the Program Guidelines, within 12 months from the
execution of this Agreement, or more specifically on or before December 31, 1994.
In reliance upon the Application and associated documents, the Department agrees, upon
execution hereof, to provide the Administrator a reservation of funds in the amount of $250,000 to
undertake the project activities approved and set forth herein.
The Administrator agrees to comply with all of the terms and conditions of this Agreement and
its Application, in its administration of this program. The Administrator further agrees to monitor.
oversee and report on the use of the funds under this Agreement. The Local Administrator shall
furnish, regularly and in such a form as DHCD may require, repons concerning the stares of project
activities. Such report shall be submitted in the form and manner as prescribed by DHCD. The
Local Administrator will make available all d, ocuments, records and other program information
requested by the Department.
The Local Administrator shall hold the Conunonwealth of Virginia, DHCD, its agents and
employees harmless from any and all claims and demands based upon or arising out of any ac,ons
by the Local Administrator, its employees, agents or contractors.
The Local Administrator shall remain fully obligated under the provisions of this Agreement
notwithstanding its designation of any subsequent or third parties for the undertaking of all or a part
of the Activities covered by this Agreement.

The Department reserves the right to modify, amend, or terminate this Agreement any time
during the terms of this Agreement due to failure of the Local Administrator to comply with the
terms and conditions of this Agreement and other Program Documents set forth herein.
FUNDS DISBURSEMENT AND REPORTING:
A. Funds Disbursement:
Disbursement will be made by VHDA for approved loans only. Once the disbursement is
made the Local Administrator must establish and administer an escrow account for each
individual loan. Adequate accounting shall be maintained to identify funds escrowed.
B. Reporting Requirements:
The Administrator agrees to submit quarterly reports during the project term. Reports are
due the 15th of the month following the end of each calendar quarter.
This Agreement is hereby executed by the Parties on the date set forth below their respective

This AMENDMENT, entered into this day of 1994, by and between the
CITY OF ROANOKE (Grantee) and the CITY OF ROANOKE REDEVELOPMENT AND
HOUSING AUTHORITY (Subgrantee).
WHEREAS, the GRANTEE and the Subgrantee have, by a Contract for Services under the
HOME Program, dated , 1993 contracted for the provision of certain services by the
Subgrantee in relation to the implementation of the City's HOME Program; and
WHEREAS, by Resolution No. , adopted , 1994,
City Council has, and by Resolution No. , adopted , 1994, the
Commissioners of the City of Roanoke Redevelopmem and Housing Authority have authorized the
execution of this amendment to the Contract dated ,1993, such amendment to provide
for the continued administration of the HOME Program.
NOW, THEREFORE, the Grantee and the Subgrantee do mutually agree to amend the
Contract, effective , 1994, as follows:
Part I, Section b, to read as follows:
Rental Rehabilitation - The Subgrantee shall administer a Rental Rehabilitation
Program as developed by the Grantee and Subgrantee, and detailed in Attachmem B.
Such program shall consist of rehabilitation subsidies provided by the Subgrantee to
rental property owners, from HOME funds allocated to the program, supplemented by
funds allocated by the Virginia Department of Housing and Community Development
(DHCD) from Virginia Housing Partnership Funds (VHPF). The Subgrantee shall
process applications, oversee the rehabilitation, hold any deeds of trust from the
Grantee's HOME funds, and monitor the projects after rehabilitation in accordance
with the requirements of 24 CFR 92.504 (e) (1). The total of all such grants of
HOME funds to be made in Fiscal Year 1993-94 shall not exceed $429,975, of which
$55,599 had been set up or committed as of June 30, 1993; supplemented with
$250,000 of VHPF funds allocated by DHCD.
The Agreement shall remain unchanged in all other terms and provisions.

WHEREAS, the City of Roanoke ("City") has installed traffic
signal preemption equipment at certain intersections with the City;
and
WHEREAS, the County of Roanoke and the Town of Vinton desire
that certain of each's fire and rescue vehicles be permitted to
utilize the traffic signal preemption equipment of the City;
THEREFORE, BE IS RESOLVED by the Council of the City of
Roanoke as follows:
1. The City Manager is hereby authorized, for and on behalf
of the City to enter into Reciprocal Agreements between the City of
Roanoke and Roanoke County and the City of Roanoke and the Town of
Vinton, providing that certain fire and rescue equipment of the
County of Roanoke and the Town of Vlnton shall be permitted to
utilize traffic signal preemption equipment with the City of
Roanoke.
2. Such agreement shall provide for mutual indemnification
and shall be approved as to form by the City Attorney.

OPTICOM
I. Back~
The Emerqency Vehicle Traffic SiGnal Preemption Pro~ra~ (also
known as OPTICOM) consists of mechanisms that enable emergency
vehicle operators to temporarily gain control of any traffic
signal that is equipped with OPTICOM. When activated, the
emergency vehicle is given a green light along the emergency
response route. This results in a more effective, reliable,
and safer priority movement of emergency vehicles at
signalized intersections.
If a signal is already green, the traffic control unit holds
the green light until the emergency vehicle clears the
intersection. If the signal display is red, the OPTICOM
system directs the traffic signal control unit to provide a
green light, thus clearing stacked up traffic, before the
emergency vehicle arrives at the intersection.
City of Roanoke began using OPTICOM in 1986. It is
anticipated that OPTICOM will be in place at 84 of the City's
131 traffic signals by the end of 1993, with p~ans to continue
installing OPTICOM at virtually all of the City's traffic
signals.
Fire trucks are presently the only City emergency vehicles
equipped with the OPTICOM devices which are needed to gain
control of traffic signals. W~nile the OPTICOM system is most

beneficial for fire trucks due to their size and limited
maneuverability, it has become apparent that the OPTICOM
system is also appropriate for rescue vehicles. By providing
a green light in advance of a rescue vehicle's arrival at a
signalized intersection, other traffic can be cleared out of
the rescue vehicle's path, thereby providing a quicker
response and smoother patient transport to a hospital. Also,
motorists that are able to flow with the green light to clear
the way for rescue vehicles would experience less stress.
December 21, 1993, Town of Vinton adopted a reciprocal
a~reement which would allow fire and rescue vehicles to
utilize OPTICOM traffic signal pre-emption equipment in either
jurisdiction. Vinton's Town Manager, on behalf of Town
Council, requested that the City of Roanoke enter into an
agreement with the Town of Vinton which would allow Vinton
First Aid Crew vehicles to utilize OPTICOM signal emitters to
control traffic signals within the City corporate limits
during emergency rescue runs.
January 11, 1994, Roanoke County adopted a similar reciprocal
a~reement which would allow fire and rescue vehicles to
utilize OPTICOM traffic signal pre-emption equipment in either
jurisdiction. Roanoke County's Administrator, on behalf of
the Board of Supervisors, requested that the city of Roanoke
enter into an agreement with Roanoke County which would allow
Roanoke County's fire and EMS vehicles to utilize OPTICOM
signal emitters to control traffic signals within the city
corporate limits during emergencies.
II. Current Situation:
Roanoke County has equipped nine (9) of its traffic signals,
four (4) fire vehicles, and two (2) EMS vehicles with traffic
pre-emption equipment identical to that used by the City of
Roanoke.
Emergency response~ by Roanoke County emergency equipment will
primarily involve major routes through the City to access
Roanoke Memorial, Community Hospital, and moving from one area
of Roanoke County to another area of the County via Roanoke

City. This will include Franklin Road, Roy Webber Expressway,
Elm Avenue, Brambleton Avenue and Williamson Road and Orange
Avenue.
Cit of Roanoke by reciprocal agreement, desires to be able
to use its OPTICOM equipment to gain control at Roanoke
County,s signals during the few incidents that are likely to
occur.
Primary Routes Throuqh Roanoke County by City emergency
equipment will primarily involve Route 419 between the
intersections of Franklin Road and Melrose Avenue.
E. Roanoke City and Town of Vinton already have a reciprocal
agreement for fire trucks only.
F. Roanoke City Department of Emerqencv Medical Service,~ is in
the process of equipping nine vehicles (7 ambulances, one
crash truck and one EMS supervisor's vehicle) in order to use
the OPTICOM traffic signal pre-emption system. This equipment
is proposed to be purchased with CMERP funds and be functional
in August 1994.

staffs and authorized by the three governing bodies.
Cost to the City would be zero.
Cancellation, each locality would retain the right to
terminate policy/agreement governing use of equipment if
misuse of equipment occurs.
Various localities utilizin~ OPTICOM as multiple aqencies wer,,
surveyed to determine problems associated with traffic safety,
maintenance and misuse of equipment. They are Virginia Beach,
Virginia; Lynchburg, Virginia; Radford, Virginia; St. Paul,
Minnesota and Denver, Colorado. The survey revealed that
there was no record of traffic accidents, no known maintenance
problem nor has there been a reported case of misuse of
equipment resulting from multiple jurisdictions or departments
utilizing OPTICOM.

I. Background:
Traffic Enqineerinq Division goals include the
maintenance of City traffic signs to help assure vehicle
and pedestrian safety. In any one year, the Traffic
Engineering Division's Sign Shop fabricates up to 5,000
new traffic signs which includes signs needed to replace
those missing or damaged, new signs for improved traffic
control and signs for driver information.
Time needed to produce certain signs can require as much
as 30 minutes each for signs that are currently
hand-lettered. This includes specialty signs for traffic
advisories (which are frequently needed to warn motorists
of road work) and street name signs (which are frequently
vandalized or stolen).
II. Current Situation:
Automatic Sign Makinq System provides computerized
ability to prepare sign layouts, and reduces the time
necessary to fabricate a sign to a fraction of the time
it takes manually (to as little as five (5) minutes per
sign).

after due and proper advertisement, until 2:00 p.m. on
Friday, January 21, 1994, at which time all bids so
received were publicly opened and read in the Office of
the Manager of General Services. Three (3) bids were
received and reviewed by a staff committee consisting of

Roupe, Manager of General Services; and William L.
Stuart, Manager, Streets & Traffic. The low bid in the

making system that was available at that time.
Recent price reductions in a technically superior
sign making system (which is the system that was
bid) created an affordable alternative. The ~3~500
above the original estimate was determined to be an
acceptable expenditure as it maximizes the City's
investment in this type of equipment, and is
available from other CMERP funds related to Streets
& Traffic Department items that cost less than the
CMERP estimate.
Time of installation specifies that this system
shall be fully functional no later than ten (10)
days after delivery.

Winter Snow and Ice Storms 1993/94

Ma_ior snow and ice storms occurred in the Roanoke Valley on December
20, 25, 27, 1993 January 3, 17, 28, 1994, February 10, 1994 and March
3, 1994. These storms deposited nearly 28 inches of snow and ice
accumulation at the Roanoke Regional Airport.
Depletion of salt supplies after the January 17, 1994 snow storm resulted
in the utilization of 904 tons of abrasives on City streets during the
storms that occurred on January 28, February 10 and March 3, 1994.
Major ice storms that occurred on February 10 and March 3, 1994
caused extensive tree damage on private properties and public rights-of-
ways.
Current Issues:
City employees continue to struggle with the clean-up efforts of abrasives
on streets and sidewalks, tree debris along rights-of-way and in City
parks, and associated accumulation of litter and bulk items on our
streets, alleys and public properties. Some crews are addressing the
normal seasonal assignments of ballfield preparation and patching
potholes, while others attempt to deal with the storm debris and bulk
items which accumulated along roadsides and alleys while we were
dealing with snow and ice storms. All personnel axe working extra
hours daily and weekends with the clean-up efforts.
Aoproximately 31.895 hours of regular time and 13,395 hours of
overtime has been or will be expended plowing and spreading salt and
abrasives on streets, sweeping abrasives from streets, removing tree and

other debris placed on City rights-of-ways and properties, mulching tree
debris and keeping equipment in service, etc. This estimated salary cost
is approximately $ 461.381. Through these efforts, it is anticipated that
all debris clean-up will be completed within four (4) weeks, weather
permitting. Mulch from wood chips is available to City residents, free of
charge, from our Public Works lot at the coruer of Courtland Road and
Carver Avenue, not far from the Civic Center.
Severe winter weather and reu_uired clean-up efforts has or will cause
approximately 28,677 hours of regular time normally spent on patching
potholes, repairing road shoulders, repairing sidewalks, cleaning up
parks, picking up litter, preparing ball fields, landscape planting and
maintenance, removing bulk items and cleaning alleys, etc. to be delayed
beyond normal schedule. Citizens patience and cooperation will allow us
to complete the clean-up expeditiously and continue to provide the
normally expected high level of services.
Approximately 3.384 tons of rock salt and abrasives have been used on
streets and bridges. The value of these products has been more than
$ 100.268.
Approximately 2.000 tons of rock salt needs to be purchased to fully
replenish salt supplies at a cost of approximately $ 74.000.
Rental equipment has or will operate more than 1.056 hours. Cost of
fuel, parts, rental and supplies is estimated at $19.000. This is needed
to rent a tub grinder to chip brush into mulch. Otherwise, this debris
would have to be deposited in the landfill at an additional cost for
disposal.
G. Total cost to the City for snow/ice abrasives, chemicals, tree and other
debris removal efforts this winter season is estimated at $ 580,649.

Temporary_ Employee Wage Accounts can be returned to an
appropriate level of funding to handle the need for temporary
employees to assist in cleaning debris from City streets and other
normal seasonal work.
Overtime Wage Accounts can be returned to an appropriate level of
funding to cover expenditures which have already been made for
snow and ice removal and to handle the need for employees to
work late evenings and weekends cleaning debris from City streets.
Rental Accounts can be returned to an appropriate level of funding

WHEREAS, from time to time, the City of Roanoke has sustained serious
natural disasters which have endangered life and property and have caused
substantial damage; and

a local or state emergency or upon a presidential declaration of emergency, the City
Manager as Director of Emergency Services poses and holds those powers, functions
and duties prescribed by the Code of Virginia (1950), as amended, the City of
Roanoke Charter of 1952, the Code of the City of Roanoke (1979), as amended, and
the Emergency Operations Plan approved by this Council in order to further the
public health, safety and welfare, address the needs of the people of the City of
Roanoke and mitigate the effects of such emergency.
2. The City Manager is hereby authorized for and on behalf of the
City to execute applications for Federal and State public aid and assistance as is
necessary and proper to meet this emergency and to provide to Federal and State
agencies for all matters relating to Federal and State disaster assistance the
assurances and agreements required by the Federal Emergency Management Agency
and other agencies of State and Federal governments.
3. The Director of Finance is hereby designated as the City's fiscal
agent to receive, deposit and account for Federal and State funds made available to
the City to meet the emergency declared by this resolution, and the Budget
Administrator is hereby designated as the City's agent for executing and submitting
appropriate documentation and information regarding federal and state
reimbursement for this emergency.
4. This resolution shall be effective retroactive to January 1, 1994,
and shall continue in effect unless and until repealed or amended by this Council.

State and Federal Assistance Relative to
Declaration of Emergency
Dear Members of Council:
I. BACKGROUND
Governor Allen declared a state of emeraencv to exist in
the Commonwealth as a result of the ice storm of February
8, 1994. Subsequently, a Presidential Declaration for
public assistance only was received for the State of
Virginia.
Sixty-three localities in the State of Virqinia have been
included in the Presidential Declaration. The city's
application is still pending; however, the Federal
Emergency Management Agency (FEMA) has indicated a
decision should be made in the near future.
C. Localities were included in the declaration based on
damaae estimates and impact on community. This
particular declaration was due in part to costs incurred
by the Virginia Department of Transportation.
II. CURRENT SITUATION
City's cost relative to the February ice storm is
estimated at $550,000 which includes an approximate
$350,000 for Roanoke City Schools; however, some of these
expenses will not be eligible for reimbursement.

FEMA re~ires that certain designations be made by local
governments in order to be eligible for federal funding

A. city Council adopt a resolution affirming the following
designations effective January 1, 1994 to continue in
full force until such time as changed by City Council for
any future declaration of local emergency, state
emergency or Presidential declaration for which the city
may become eligible for state and federal assistance.

WHEREAS, the School Board for the City of Roanoke, on the 14th
day of February, 1994, presented to this Council an application
addressed to the State Board of Education of Virginia for the
purpose of borrowing from the Literary fund $1,000,000.00 for
modernizing and improving the present school building at Wasena
Elementary School, to be paid in twenty (20) annual installments,
and the interest thereon at four percent (4%) paid annually.
BE IT RESOLVED that the application of the City School Board
to the State Board of Education of Virginia for a loan of
$1,000,000.00 from the Literary Fund is hereby APPROVED, and
authority is hereby granted the said City School Board to borrow
the said amount for the purpose set out in said application.
The Council of the City of Roanoke will each year during the
life of this loan, at the time it fixes the regular levies, fix a
rate of levy for schools or make a cash appropriation sufficient
for operation expenses and to pay this loan in annual installments
and the interest thereon, as required by law regulating loans from
the Literary Fund.

Bids, following proper advertisement, were publicly
opened and read aloud before City Council on February 28,
1994.
Three (3) bids were received with Acorn Construction,
Ltd., submitting the apparent low bid in the amount of
$144,890.00 and 150 consecutive calendar days. However,
on the morning of March 1, 1994, Acorn Construction, Ltd.
submitted his take-off sheet showing that in the
summation of his bid, the figure for labor had been
omitted. He requested in writing that he be permitted to
withdraw his bid according to Paragraph 11 "Withdrawal of
Bids" of the Instruction to Bidders. Paragraph 11.2 is
as follows:
"The Bidder shall give notice in writing, to the
City of Roanoke, of its claim of right to withdraw
its bid within two (2) business days after the
conclusion of the Opening of Bids as set forth in
part (l) of Sll-54.A of the Code of Virginia (1950)
as amended.
The lowest responsible bid was received from Breakell,
Inc., in the amount of $163~727.00 and 130 consecutive
calendar days.

Pro~ect consists of the providing and installing of two
(2) twenty-thousand (20,000) gallon fiber reinforced
plastic tanks (fiberglas with interior glass lining) for
storage of pickle liquor, foundation and related work, a
pump house with pumps and controls to feed the pickle
liquor into the early stages of sewage treatment. Pickle
liquor is a strong acid that is a bi-product of the steel
industry and used to remove phosphorous in the sewage
treatment process.

Breakell, Inc., for construction of Chemical Storage
Tanks and related work at the Water Pollution Control
Plant in accordance with the contract documents as
prepared by the City Engineer's office in the amount of
$163~727.00 and 130 consecutive calendar days.

WHEREAS, application has been made to the Council of the City

represented by Daniel F. Layman, Jr., attorney,
that a tract of land located on the south side of
the Norfolk & Western Railway tracks and a private
road, approximately 2,200 feet east of Berkley
Road, identified as Official Tax No. 7030102, be
rezoned from LM, Light Manufacturing District to
RA, Residential Agricultural District.
I. Backqround:
Purpose of the rezoning request is to provide for the
construction of a single family residence and to maintain
livestock on the subject property.

Petition to rezone was filed on January 3, 1994. No
proffers were offered by the petitioner.

Planninq Commission public hearinq was held on February
2, 1994. Mr. Daniel Layman, attorney, appeared before the
Commission on behalf of the petitioners, and summarized
the contents of the rezoning petition. Mr. Layman
informed the Commission that the subject property, given
the flood development restrictions, was not suitable for
industrial development and that the site adjoined other
agriculturally zoned property in the City. He then
informed the Commission that his client's intent is to
retire from up North and build a single family home on a
portion of the property elevated above the floodplain
restrictions and that they also desired to maintain some
livestock on the property.
Ms. Dorsey gave the staff report. She stated that out of
this 20.22 acre tract requested for rezoning,
approximately 14 acres is located in the floodway,
resulting in only 6 acres of land available for possible
development. Ms. Dorsey further informed the Commission
that due to the flood development restrictions on the
property, the area was not suitable for industrial
development and that the Office of Economic Development
supported the staff's position in recommending that the

property be down zoned to a agricultural classification
to conserve and protect this sensitive land area.
No one from the audience appeared before the Commission
to speak in favor or in opposition to the request.
Issues:
Zoning of the subject property is LM, Light Manufacturing
District. The surrounding zoning pattern in the area is
as follows: to the north and west is LM, Light
Manufacturing District; to the east is the Town of Vinton
corporate limits and to the south is RA, Residential
Agricultural District.
Land use of the site is currently vacant, undeveloped
property. Surrounding land uses are vacant, undeveloped
tracts with a county park/soccer field located to the
west of Berkley Road.

Utilities are partially available to the site. Sewer
service is available along the railroad tracks but no
public water is available. Flood development regulations
will be addressed and resolved during the site plan
review process for the construction of the proposed
single family residence and any accessory structures.
Access to the property is via an 18 foot wide private
road running parallel to the railroad tracks from Berkley
Road, approximately 2,200 feet to the west. Given the
proposed single family residential use of the property,
no traffic impacts are anticipated.
Industrial land in the City has been identified as a
valuable economic asset and should be protected. However,
due to the fact that the majority of the developable land
of the subject property lies within the floodplain, it is
not considered valuable for industrial development.
F. Comprehensive Plan recommends:
1. New development in flood plain areas be minimized;
Develop open space conservation areas to protect
natural resources and sensitive land;
3. Encourage appropriate infill development.

III. Alternatives:
A. City Council approve the rezoning request.
Zonina of the subject property would be RA,
Residential Agricultural District and the
construction of the single family residence would
be allowed.
Land use would become a single family residence
with possible accessory structures for the keeping
of livestock consistent with the overall rural
character of the area.

Utilities would not be an issue. Public sewer
service is available and given the acreage of the
subject property, a private well for water service
would be permitted through the Health Department.
Flood development regulations would dictate the
construction of the home and any accessory
structures.

Access to and from the property can be safely
provided by the existing private road connecting to
Berkley Road (a public street) as indicated on the
survey plat labelled Exhibit B, a part of the
rezoning petition.
Industrial land although not preserved for
industrial development, is appropriately developed
given its location and physical constraints of the
property.
6. Comprehensive Plan issues as set forth would be
followed.
B. City Council deny the rezoning request.
Zoninq of the subject property would remain LM,
Light Industrial District. The proposed use and
development of the property would not be allowed to
occur.
Land use would remain vacant, undeveloped property
and given the floodplain development restrictions
on the site, the property does not lend itself to
industrial development.

IV. Recommendation:
The Planning Commission, by a vote of 6 to 0, Mr. Price
absent, recommended approval of the rezoning request based on
the finding that the rezoning would be a logical extension of
the adjoining RA, Residential Agricultural District located to
the south of the property and that the location and physical
constraints of the site are more conducive for agricultural
development as an appropriate land use to protect the rural
character and environmental quality of the area than for
industrial type development purposes.

I. Backqround:
Aliqnment of project to extend Peters Creek Road from
Melrose Avenue, N.W., to Brandon Avenue, S.W., by
Virginia Department of Transportation (VDOT) was approved
by City Council at its meeting on March 5, 1990.
B. Acquisition of riqht-of-way for the project by VDOT is
currently underway.
C. Use of portions of City-owned Strauss Park was also
approved by City Council at its meeting on March 5, 1990.
Use of portion of frontage for public utility easement,
of future fire station site on Aerial Way Drive, S.W., by
Appalachian Power Co. (APCO) was authorized by City
Council by Ordinance No. 31759-110893.
II. Current Situation:
Request for use of several City-owned parcels for Peters
Creek Road Extension has been received from VDOT (see
attached Deeds and Maps).
Parcel 007, Future City Fire Station Site,
Official Tax No. 5200112, on Aerial Way Drive.
Includes an 0.078 acre permanent right-of-way
acquisition shown in red and an 0.060 temporary
construction easement shown in orange on the
attached map.

Land Transfer
Background:
Hollins Road~ N.E. bridge improvement originally
included curb and gutter along portions of Hollins
Road. As such, a lot known as Tax No. 3140813 was
purchased by the City at a cost of approximately
$540.00 for a drainage easement to Tinker Creek to
drain the roadway.
Excessive cost estimates necessitated the redesign
of the bridge project to eliminate the curb and
gutter along with narrowing the roadway design. With
the redesigned roadway, the lot previously purchased
for a drainage easement was no longer needed.
A severe drainage problem was encountered during
construction and a $1,200.00 Change Order was
prepared to compensate Waddell Brothers Co., Inc.
for the installation of a paved flume down the
roadway embankment.
II. Current Situation:
Waddell Brothers Co.~ Inc. has requested the City of
Roanoke transfer the lot purchased by the City known
as Tax No. 3140813 to their ownership rather than
pay them $1,200.00 for the paved flume previously
installed.
Tax No. 3140813 has no intrinsic value to the City
of Roanoke other than for the drainage easement that
was recorded on the property. Waddell Brothers Co.,
Inc., owns two (2) adjacent lots and plans to use
this lot to improve access to his current
operation. Current assessed valuations is
$2~000.00.

Narrow strip of City-owned park land between Bennington
Street and Roanoke River blocks access by Roanoke Gas
Company to an existing easement in Jamestown Plaza
Shopping Center.
II. Current Situation:
A. Gas service has been requested by Family Bible
Fellowship, which is located in Jamestown Plaza.
Request for easement 10 feet wide by 42.84 feet long
across City-owned property at the northerly end of
Jamestown Plaza has been received from Roanoke Gas
Company (see attached maps and easement document).
C. Appraisal of easement provided by Roanoke Gas Company
indicates a fair market value of $38.00 (see attached
appraisal).

PURPOSE OF APPRAISAL
The purpose of this appraisal is to estimate the market value of a proposed permanent
gasline easement. The Appraisal Institute defines the term market value as "The most
probable price in cash, terms equivalent to cash, or in other precisely revealed terms, for
which the appraised property will sell in a competitive market under all conditions
requisite to fair sale, with the buyer and seller each acting prudently, knowledgeably, and
for self-interest, and assuming that neither is under undue duress."
Fundamental assumptions and conditions presumed in this definition are:
1. Buyer and seller are motivated by self-interest.
2. Buyer and seller are well informed and are acting prudently.
3. The property is exposed for a reasonable time on the open market.
4. Payment is made in cash, its equivalent, or in specified financing terms.
5. Specified financing, if any, may be the financing actually in place or on terms generally
available for the property type in its locale on the effective appraisal date.
6. The effect, if any, on the amount of market value of atypical financing, services, or fees
shall be clearly and precisely revealed in the appraisal report.
PROPERTY RIGHTS APPRAISED
The appraisal of this property is predicated on the assumption that the title is in fee
simple, free and clear of all liens or assessments and that easements or land covenants
affecting the property have no objectionable clauses.
FRACTIONAL INTEREST APPRAISED
This appraisal report is limited to the fractional interest of the proposed permanent
easement.
SCOPE OF APPRAISAL
In recognition of the significance of the appraisal problem, the appraiser conducted a
diligent search for relevant market data. verified the data, and used it in the analys~s of
the appraisal problem and the development of the value estimate. The search for data
did not reveal all of the data which existed, but was believed to provide an adequate
amount of data to develop a reliable estimate of value for the subject property, and
represents all of the data that a reasonable search might uncover.
SCOPE OF APPRAISAL (Cont'd.)
The appraiser considered the use of three approaches to value: The Sales Comparison
Approach; the Income Approach; and the Cost Approach. One or more of the
approaches may not have been developed for the subject appraisal report, due to scarcity
or inadequate reliability of data. The reason for the appraiser's decision not to include
one or more of the three approaches to value is stated in the report.
The extent to which the appraisal report describes the appraisal problem, the property to
be appraised and the analysis and conclusions developed by the appraiser was determined
by the appraiser according to reporting guidelines which may have been specified by thc
client, and by the judgement of the appraiser, based on the function of the appraisaL.
Some of the data used in the development of the appraisal may not be included in the
report for the above reasons. All of the data used in the preparation of the appraisal
report is retained in the appraiser's files if required for future reference.
The appraiser cautions the reader of the appraisal report that the detail of the report may
have been determined by guidelines based on the function of the appraisal stated b~, thc

The highest and best use of the subject property is believed to be a continuation of its
present use which is green space between the street and the river.
DESCRIPTION OF THE LARGER PARCEL
The larger parcel (sometimes called the "whole property") is located on the west side ot~
the street in the 2100 Block of Bennington Street in the southeast section of the City of
Roanoke, Virginia. According to the real estate tax map this parcel fronts 1,989 feet+-
along the west side of Bennington Street and contains 4.88 acres. The west property line
appears to be the centerline of the Roanoke River.
A 20' wide sewerline easement runs through this site, in a direction generally parallel
Bennington Street.
The land surface is covered with natural growth trees, bushes, short ground cover and
grass.
This land parcel is further identified by Roanoke City Tax map Number 435117111,
according to information obtained by this appraiser.
DESCRIPTION OF THE PROPOSED TAKING
The proposed acquisition consists of a permanent easement 10.0' wide and 42.84 feet
length along the centerline of the proposed easement. This proposed easement
contain 428.4 feet of area and will be in the west portion of an existing 20' w~de ~ewcr
easement running in a northeast direction from the north boundary of land ident~tied by
Tax Map Number 4250104 and belonging to Billy H. Branch. The north boundary, ot the
proposed easement is the west side of Bennington Street. As previously stated the total
proposed permanent easement area is 428.4 square feet according to the informamm
furnished to this appraiser.

A RESOLUTION memorializing the late Dr. James D. McComas.
WHEREAS, the members of this Council have learned, with
regret, of the passing on February 10, 1994, of Dr. James D.
McComas, former President of Virginia Polytechnic Institute & State
University ("Virginia Tech");
WHEREAS, Dr. MCComas served as President of two other major
state universities, Mississippi State University (1976-1985) and
the University of Toledo (1985-1988), before he assumed the
presidency of Virginia Tech which he served from 1988 through 1993;
WHEREAS, under Dr. McComas' outstanding leadership, Virginia
Tech instituted a comprehensive program to attract merit scholars,
focused on building a university of international renown and took
steps to enhance the concept of public service among faculty and
students;
WHEREAS, in implementing Dr. McComas, vision of Virginia
Tech's public service role, Virginia Tech took over management of
the Graduate Center in Roanoke in 1988, and, in 1989, Virginia Tech
accepted from Norfolk Southern Corporation the donation of the
Hotel Roanoke, a landmark facility;
WHEREAS, in 1993, a Virginia Tech foundation broke ground on
reconstruction of the Hotel Roanoke, and the Hotel Roanoke
Conference Center Commission, a partnership between Virginia Tech
and the City of Roanoke, broke ground on a contiguous conference
center;
WHEREAS, the hotel and the conference center will serve as the
Cornerstone for an expanded graduate education center in the City
of Roanoke;
WHEREAS, under the visionary leadership of Dr. MCComas,
Virginia.s land-grant university and the major urban area in
southwest Virginia, the City of Roanoke, were drawn much closer
together; and
WHEREAS, this Council desires to take special note of the
passing of this dedicated public servant who was held in high
esteem by members of City Council and the citizens of this City;
THEREFORE, BE IT RESOLVED by the Council of the City of
Roanoke as follows:
1. Council adopts this means of recording its deepest
regrets at the death of Dr. James D. McComas, former President of
Virginia Polytechnic Institute & State University, and extends to
Mrs. Adele Stoltz McComas, his widow, the sympathy of this Council
and that of the citizens of the City of Roanoke; and
2. The City Clerk is directed to forward an attested copy of
