and deliver two new trucks and bodies for use by the Street
Maintenance and Traffic Engineering Departments.

and Western Railway Company providing the City the right to

As you know, the three year terms of Marilyn L. Curtis, M. Wendy O'Neil an'd *
James M. Turner, Jr., as Trustees of the Roanoke City School Board will expire on
June 30, 1994.
Section 9-20, Selection of Candidates for Public Interview, of the Code of the City
of Roanoke (1979), as amended, provides that on or before April 20, Council shail,
by public vote, select from the field of candidates those candidates to be accorded
the public interview for the position of School Board Trustee and all other candidates
shali be eliminated from the selection process. The number of candidates to be
granted the interview shall not exceed three times the number of positions available
on the School Board, should there be so many candidates.

Subject:
Feasibility of Reporting Costs of
Unfunded Mandates
I. Background:
Council Member Howard E. Musser requested during the
December 17, 1993 regular Council meeting for a review
by the Fiscal Year 1994-95 budget process of the
feasibility of providing Council with figures as to
what percentage of sales tax and the utility tax is
directly related to unfunded mandates, both at the
federal and state levels.
Meeting of utility~ billing and Computer Information
Service personnel was held on January 10, 1994 to seek
to define and discuss the issue.
Further conversation with Council Member Musser
clarified his intent to seek the feasibility of
developing a mechanism to inform our citizens of how
much of our utility rates and our sales tax revenue is
tied to a state and/or federal mandate.
II. Conclusions:
Approximately 100% of our cost for sewer service and
75% of our cost for water service are attributable to a
state or federal mandate. Additionally, the Executive
for Business Affairs for the Roanoke City Schools
advises that approximately 100% of sales tax revenue
received from the state is tied to the standards of
quality for education as set by the state.
Council would undoubtedly continue to fund many, and
likely most, of the priorities for water and sewer
utility services and those aspects of the standards of
quality for education that the community wanted and
could afford even if they were not mandated.
C. A definition of service level would have to be made by
Council, likely through community workshops or other

mechanisms, to determine the cost differential between
what Council and the community desires versus what cost
of service is mandated by the state and federal
governments.
Water and sewaqe service billing system would not have
room for any reporting were it developed. A separate
notice could be developed and mailed at a cost of
approximately $12~000 plus staff time.
III. Recommendation:
Ail members of Council are aware that so many of the
costs we incur are due to unfunded state and federal
mandates. The task of distinguishing between those
costs we would incur and those we would not if they
were not mandated would be quite lengthy and
potentially subject to much debate.

A RESOLUTION providing for the establishment of a community
policy and management team for the City of Roanoke pursuant to the
Comprehensive Services Act for At-Risk Youth and Families;
appointing the membership of such team; providing for the powers
and duties of such team; designating legal counsel and a fiscal
agent; and providing for an effective date.
WHEREAS, the Comprehensive Services Act for At-Risk Youth and
Families, enacted by the 1992 Session of the General Assembly,
requires each city of the Commonwealth to establish a community
policy and management team in order to receive funds pursuant to
such Act; and
WHEREAS, it is the intention of this Council to establish the
required team and appoint its membership by this resolution;
THEREFORE, BE IT RESOLVED by the Council of the City of
Roanoke as follows~
1. A community policy and management team for the City, as
required b]f the Comprehensive Services Act for At-Risk Youth and
Families enacted by the 1992 Session of the General Assembly, is
hereby established for the City of Roanoke. Such tea~ shall be
known as the Roanoke Interagency Council ("Councll-~

serve aa fiscal agent for the Council.
4. The Clty Attorney of ~ho C~ty of Rolnoke ahab1 serve aa
general commel and legal advisor to the Council.
5. The Council shall manage the cooperative effort within
the City to better serve the needs of troubled and at-risk youths
and their families and to maximize the use of State and community
resources. To accomplish this purpose, the Council shall have the
powers, duties and rel~onllbllities set forth in $2.1-752, Code of
Virginia (1950), as amended.
6. Pursuant to S2.1-751, Code of Virginia (1950), as
amended, Persona who serve on the Council shall be immune from any
civil liability for decisions made about the appropriate services
for a family or the proper placement or trsatmaent of a child that
comes before the Council, unless it shall be proven that such
person acted with malicious intent. Persons serving on the Council
who do not represent a public agency shall file a statement of
economic interests as se*: out in S2.1-639.15 of the State and Local
Government Conflict of Interests Act ($2.1-639.1 e__t se__e.q~..
7. This resolution shall be retroactive to January 1, 1993.

I have reviewed the attached request to appropriate
funding for the School Board. This report will appropriate
$238,755 from the School portion of the CMERP funds for the repair
of the roofs at Patrick Henry High School, Hurt Park Elementary
School, and Round Hill Primary School. This is the final
appropriation of the School Boards FY93 CMERP funding of
$1,227,920.
I recommend that you concur with the request of the
School Board.

I. Background
Capital Maintenance and Equipment Replacement
Proqram has identified the need to replace two (2)
Stake Body Trucks. One (1) unit for Street
Maintenance and One (1) unit for Traffic
Engineering.
Specifications were developed, and along with
Request for Quotations, were sent to nineteen (19)
vendors that are currently listed on the City's bid
list. A public advertisement was also published in
the Roanoke Times and Roanoke Tribune.
Inquires were made with the Roanoke City Schools
and Roanoke Redevelopment and Housing Authority.
No vehicles of this type are currently needed by
either organization.
Bids were received, after due and proper
advertisement, until 2:00 p.m. on March 11, 1994,
at which time all bids appropriately received were
publicly opened and read in the Office of the
Manager of General Services.

A. Four (4) Bid responses were received. Bid

RAILROAD AGREEMENT
JEFFERSON STREET PEDESTRIAN UNDERPASS
I. Background:

Carvins Cove Filter Plant Improvement includes expansion
of the Filter Plant at Carvins Cove (Phase I) and the
installation of over 70,000 linear feet of waterline from
Carvins Cove to the Crystal Springs Pump Station (Phase
~).
Previous authorization from City Council includes
Railroad Permits at Hollins Road and 13th Street needed
for Phase II Waterline Installations.
II. Current Situation:
A. Contract B-2 of the Phase II Waterline Installation
includes an interconnect from north to south Jefferson
Street in the vicinity of the Hotel Roanoke. To ease the
construction under the railroad, staff and consultant
propose to install the interconnect (24-inch water line)
in the closed pedestrian underpass.
The original agreement for the underpass calls for the
Norfolk and Western Railway Company and the City of
Roanoke to share in ownership and maintenance. Proposed
agreement (attached) from Norfolk and Western calls for
the city to take full ownership in the closed underpass.

IV. Alternatives:
A. Alternative A:
Authorize the City Manaqer to execute an agreement with
Norfolk and Western Railway Company in a form approved by
the City Attorney to install a waterline in the Jefferson
Street Pedestrian Underpass, to assume ownership of the
underpass with certain conditions and to indemnify the
railroad of liability related to the operation of a City
facility on railroad property.
Ownership in the underpass by the City will change
from an equal share by the City and Railroad to full
ownership by the City with a one time permit cost of
$2~100.00.
Maintenance will become the sole responsibility of
the City, while annual inspections will be performed
by the Railroad and City.
Leqal concerns are the shift of shared liability and
maintenance of the underpass to sole liability by
the City. The current agreement calls for the
removal of the underpass if abandoned. The removal
of the underpass, were it to occur, would
necessitate the relocation of existing utilities
within and around the underpass. Most of these
utilities are incidental to the underpass per se.
The City would also be required to indemnify the
Railway for any claims resulting from the City's use
or operation of the underpass.
B. Alternative B:
Do not authorize the City Manaqer to execute the
agreement with the Norfolk and Western Railway Company.
Ownership would remain equally divided between the
City and the railroad. Installation of the
waterline would be subject to continued
negotiations.
2. Maintenance and inspections will continue to be
shared by the City and railroad.
Leqal concerns about delaying the contractor will
become a major concern if the City must reopen
negotiations with the railroad.

NOW, THEREFORE, for and in ccasid~atica of the payment of a

($2,100.00) and of the covenants bereirk%fter m~4~, Railway hereby permits and
grants Licensee, i~sofar as Railway has th~ right to do, without waz=~nty and
subject to all encumbrances, covenants and easements to which Railway's title
may be subject, the right to use and to occupy so r~/ch of Railway's pz~uerty
as may be necessa~ for the Facilities, upon the followi~ ten~s and
ccnditic~s:
1. Licenses will cc~struct and maintain the Facilities, at its
e~pense, in such a manner as will not interfere with the operatic~s of Railway
or er~nger persc~s or pau~erty of Railway, and in accordance with (a) plans
and specificatic~s (if any) s~ c~ sa/d print (s) and any other
specificatic~s pr~scribed by Railway, (b) a~plicable gov~,ental regulatic~s
or laws, and (c) applicable specificatic~s adopted by the American Railway
Engineering Associatic~ when not in conflict with plans, specificaticns or
rec~atic~ m~ltio~ in (a) a~d (b) above.
2. Ir~ofar as the law of the O~L%/,-,uwealth of Virginia permits,
Licenses hereby aw=ues to ir~,~fy and sav~ haxmless Railway, its officers,
agents and e~Nployees, frcm and acja/nst any and all liability, claims, losses,
d~ges, expenses (includ/n~ attorney's fess) or costs for personal injuries
(includir~ ~th) and/or prcl~ damage to whcmsoever or whatsoever occurring
wkich arises in any manner f~ the installatic~, maintenance, operatic~,
presence or ~,o~-~1 or the fa~]%~re to p~u~_rly install, maintain, operate or
a~cve th~ Facilities, unless such losses, dama~s or injuries shall be caused
solely by the negli~s~ce of Railway.
3. Licensee assuzes all responsibility for any enviz'~,~ental
obligatic~s inposed urger applicable laws, rec3ulatic~s or ordinances relatir~
to the ir~tallatic~ of the Facilities and/or to any cc~t~c~atic~% of any
pzuperty, water, air or wzuundwater arising or resulting f£u~L Licensee's
permitted operatic~s or uses of Railway's p~uperty pursuant to this Agre~rent.
In a~l~4 tic~, Licensee shall ~btain any necessary pennits to install the
Facilities. Insofar as the law of ~ C~onwealth of Virginia pennis,
Licensee agrees to ir~--~,]ify and hold harmless Railway f~u,~ and against any
and all liability, fines, penalties, claims, demands, costs (iu~ludir~
attozT~=~S' fees), losses or lawsuits brought by any person, c~%~%ny or
gc~e~tal e~tity relatir~ to cc~tam/natic~ of any p£c1~_rty, water, air or
~auundwater due to the use or presence of the Facilities. It is agreed that
this ir~-~,city provisic~ extends to any cleanup costs related to Licensee's
activities upon Ra~]way, s p£c~erty and to any costs related to cleanup of the
Facilities or to other p~uperty caused by the use of the Facilities.
4. (a) Prior to oa'mPJu~are~t of installatic~ or m~ntenance of
the Facilities or entry en ~ailway's p£c~_rty, Licensee or its ccntrector
shall procure and ~4ntain durin~ the course of said installatien or
maint~r~nce, a policy of ~:=~_ral liability /nsurance, cc~tain/ng products and
cu~leted cperatic~s and cc~%trect~l liability coverage, with a ccmbined
sir~le limit of not less than $1,000,000 for each occu~=~e. Licensee or its
cc~tractor also sh~ll procure and maintain ~,~n~ the course of said
installatic~, maintenance or entry en Railway's p£o~erty a Ra~road Protective
c~ined single limit of $2,000,000, each occurrence, and $6,000,000 in the
ac3grecjate. The /nsurance required herein shall be of such form and cc~tent as
may be acceptable to Ra4 lway. Evidence of such insurance (a certificate of
ins/Jz-dnce for the ~p~ral liability /nsurance policy and the original policy
of Railroad Protective Liability Insurance) must be furnished to and approved
by the Manager ~ce, NorfoLk Southern Corporatic~, 110 Franklin Road, S.
E., Roanoke, Viz~inia 24042-0022, prior to c~%~e~lt of inst~llatic~ or
m~nter~nce of the Facilities or entry en Railway's p£c~_rty.
(b) The insura~e rec~,~ed herein shall not limit the
liability assumed by the Licensee under this ;~jreerent.
(c) In lieu of the insu~nce r~qu/~-e~.nts above, Licensee
may provide to ~lway a certificate of self-insurance in such anounts ar~ in
such form as are satisfactozy to Railway.
5. The details of the Facilities to be /nstalled and m~4ntained
shall be at tl~ cptic~ of Licensee, and subject to the approval of Che chief
engineerin9 officer of ~a~]way. In case of failure of Licensee to do the work
as herein specified, Railway reserves the right to z~[o~e the Facilities f~ULL
P~ilway's p~-~,,~ees at the expense of Licensee, and to term/hate this Agreement
upc~ ten (10) days' written r~tice.

6. If Ra4lway shall make any c~s, alteraticms in or
additicns to the line, wz;,~, tracks, structu_~es, ~, installaticms or
works of P~]way at or near the Facilities, Licensee shall, at its own cost
and expense, upon thirty (30) days' notice in writing fr~n Railway, make such
chancjes in the locatic~ and character of the Facilities as, in the cpinicm of
the chief engineering officer of Railway, shall be necessary or a~p~riate to
acc~L,Ludate any cc~structicm, improv~rents, alteratic~s, chanc3~s or mdd~ticms
of Railway.
7. Licensee will notify Rm~]way prior to the installaticn and
placing in service of cathodic protectic~ in order that tests Fey be cc~cted
~ Railway's si~%al, c~,Lunlcaticms amd other electz~,~c systems for possible
interference. If the Facilities cause degrm~ti~ of t/~ signal,
c~,~unicaticms or other elect£~ic facilities of Railway, Licensee, at its
e~pense, will relocate the cathodic protectic~ amd/or modify th~ Facilities to
th~ satisfactic~ of Railway so as to eliminate such deMz,,~tic~. Such
modificaticms may incl,~, without limiting the g~r~rality of the foregoir~,
pr~vid/ng m~ tior~l shield/rig, reactances or other coz~=ctive mmmmures deemed
necessary by Rm~]way. This provisic~ applies to the existing signal,
cu~,Lunicatic~s and elect£c,~ic equifxnent of Ra~]way and to any signal,
c~,,~unicaticms or elect£c~Lic equilm~nt which Railway may install in the
future.
8. If Licensee fails to take any corrosive ~ requested
by Railway in a timely manner or if an ~R-~zW~-y situatic~ is presented which,
in the Railway's judm3ment, requires immediate z=l~airs to the facilities,
Railway, at Licensee's expense, may ur~ke such coz~=ctiv~ m~zr~s or
repairs as it deems necessary or desirable.
9. Notwithstam~n~ any other p~visicm of this Agr~arent, it is
u~d~rstood, awL=ed and cove~k'unted t_hat Licensee accepts this ~=nt as a
mere license and ass~nms all risk of d~3e to its p~u~_zty by reason of its
occupatic~ of the p~,~ses herein described caused by ar~ defects t_herein or
business cc~%~cted thereon, whether caused by the neglig~%ce of Railway, its
officers, a~e~ts or ~,~loyees, or ot_h~_~wiee, and Licemsee, insofar as the law
of the C~,~a~wealth of vizujizlia permits, hereby ir~ifies Railway, its
officers, agents, ar~ ~,~loyees, fzu~ ar~ a~//lst any such liability for said
10. Railway shall furnish, at the cost of Licensee, labor and
materials to support its tracks a~d to protect its traffic dur/r~ the
installatic~L r~nter~nce, £~m~r, r~m~=wal or fa%ur-al of the Facilities.
11. It is further agreed betweem the parties that the p~=,~ses
shall be used by Lic~mee only for the Facilities and for no other purpose
without the written permissicm of the chief engineerin~ officer of Railway.

12. Licer~ee shall give Railway seventy-two (72) b~xlrs' advance
notice (or less in case of em~ncies) of any work to be performed cn the
p~-~L,~ses of Railway. Licensee awz~es to pay any costs incurred by Railway for
the purpose of protectic~ and inspectic~ cc~si~ed necessary by Railway
durin~ installatic~, ma/nte~ance, cperaticn, m0dificatic~, £eplacenent and/or
~Lcval of th~ Facilities.
13. Licensee shall not assign this Agreemnt without the written
cc~sent of Railway.
14. The word "P~ !way" as used h~rein shall incl,~ any other
c~Lpany whose property at the aforesaid locatic~ way be leased or operated by
Railway. Said term also shall incl,~ Railway's officers, a~lts and
m~ployees, and any pal-e~ c~any, subsidiary or affiliate of Railway and
their officers, age.ts and e',~loyees.
15. If Licensee shall ~iolate any of its covenants in this
Agreerent, Railway may terminate th~ sa~e by serving upon Licensee te~ (10)
days' written notice of its electic~ so to do; prcvid~_, b~wever, t-hat unless
this A~z~me~t is terminated as a result of a violation of a covenant of
Licensee, as aforesaid, this a~z=~ment will ~dn in full force ar~ effect
subject to terminatic~7 by Railway upc~ sixty (60) days' written r~tice of
Railway's electic~ so to do, c~ly upon the occurma%ce of any c~e or more of
the follcwin~ events:
(a) If Licensee shall abar~ the use of the Facilities; or
(b)
If Railway shall be required by any gov~z~l,~ntal aut/mority having
jurisdictic~ in t/~ prenises to ~ove, relocate, recc~struct or
discc~tinue cperatic~ of its railroa__d at t/~ afo~tior,~d
location; or
(c)
If ~ requi£~L~ts of Railway, in the judcsment of its
SuperinteDd~nt, shall n~cessitate a chan~3e in locatic~ or
elevatic~ of its railroad at the locatic~ of the Facilities which
might effectively prohibit the use of th~ Facilities; or
(d)
If, in the judgment of the Superinte~n~=nt of P~]way, the
m~nte~ance or use of tb~ Facilities unduly interferes with the
cperatic~ and m~ntenance of th~ facilities of Railway or with
px~se~t or futur~ ~se of said p~ui~_rty by Railway, its lessees,
affiliates, successors or assigns.
Licensee also shall hav~ t_he right to term/hate th_is A~t by
servin~ upon Railway sixty (60) days' written notice of its electic~ so to do.
Upon the e~piratic~ of the tim~ specified in any notice of terminatic~ given
hereur~l~, this A~jreema~t shall terminate, and Licensee will, at its expense,
r~%ove the Facilities f~u~ th~ property of Ra~ ]way and restore said p~uperty

to the conditic~ existing prior to the cc~structi~ of the Facilities; or, in
default thereof, Railway may, in ~itic~ to any other legal £~Ledy it may
have, £~7-ov~ the Facilities a~d restore the conditic~l of the pzu%.erty at the
expense of Licensee.
16. Licensee ag==es to assu~e ~p and maintenance of
underpass and further agrees to an ar~,~l /nspecticn of the structure by both
Norfolk and Western Railway Cu~m~y and City of Roar~ke persc~_l.

Carvins Cove boat rental was contracted out June 1,
1988 thru September 30, 1992.
Boats were owned by concessionaire and fees were
established through contract agreement.
II. Current Situation:

Boats have been purchased by the Water Department for
purpose of boat rental at Carvins Cove. Oars and
flotation devices are also available as part of the
boat rental fee.

Public demand has required purchase of boats for
rental. Additionally, there are instances when a
citizen will bring his privately owned motor to place
it on a rented boat. These motors must be inspected.

February Financial Report
Attached is the monthly financial report for February. Several categories of
revenue and expenditures have variances compared to year-to-date amounts for the
same period last year that deserve comment.
REVENUE
Total General Fund revenues have a positive variance of 7.28% over fiscal year
1993 on a year-to-date basis. This is very close to the overall anticipated increase in
revenues in the fiscal year 1994 adopted budget. Variances in the specific categories
of revenue are as follows:
General Property Taxes are up 6.67% over last year and are in line with our current
year's estimates.
Other Local Taxes are up 8.69% for the entire category, but there are several revenue
sources within this category that are performing well. Utility consumer taxes are up
approximately 11%, most of which is from electrical usage related to the extremely
hot summer of 1993. Sales tax revenue is up an encouraging 8.6% over last year's
collections, reflecting an improving economy and outperforming the budget estimate
by 4.2%.
Permits, Fees and Licenses are up 31.64% over last year. This is attributable
primarily to increased building related permits.
Revenue from Use of Money and Property reflects an increase of 41.07%. Although
investment earnings from idle cash are down, we are receiving increased rent from the
State for space occupied by Social Services in Municipal North.

Grants-In-Aid-Federal Government is down considerably from last fiscal year. The City
received flood damage reimbursements of approximately $116,000 in fiscal year
1993, which accounts for this noticeable variance. The City received $56,858 this
fiscal year for reimbursements related to the snow storm last March. The significant
difference in these unanticipated revenues creates the negative variance.
Miscellaneous Revenue reflects a negative variance of 74.98% due to the timing of
collections for insurance recoveries, and payment in lieu of taxes and sales of surplus
City equipment.
Internal Services revenues are up 8.71% over fiscal year 1993. This increase is due
partially to increased rates effective at the beginning of the fiscal year, but primarily
due to increased engineering work related to Water Fund projects.
EXPENDITURES
Expenditures for the General Fund are up slightly (.38%) over the last fiscal year. On
a year to date basis, one less payday has occurred this fiscal year compared to last.
This accounts for the fact that we have spent only slightly more than in fiscal year
1993. Variances in specific categories are explained as follows:
Public Works expenditures are down 8.53% compared to fiscal year 1993. Although
the current year paving contract is approximately the same as last year, the timing of
payments is such that approximately $150,000 less has been spent on a year-to-date
basis. Also, equipment purchases for Streets and Traffic, Parks Maintenance and
Solid Waste Management are significantly less this year than last. This is partially due
to timing of purchases of equipment and is expected to even out somewhat as we
approach the end of the fiscal year. Last year, the City also purchased its telephone
system in the Communications budget.
Health and Welfare expenditures are up 11.68%, primarily due to Comprehensive
Services Act expenditures which were partially accounted for in other categories in
the prior year.
Parks, Recreation and Cultural expenditures reflect an increase of 2.00% over fiscal
year 1993. Most of this increase is due toa current year contribution of $123,350
to the Hotel Roanoke Conference Center Commission. The $50,000 contribution in
fiscal year 1993 was paid from the Capital Projects Fund instead of the General Fund.

Community Development expenditures are up 12.48% for fiscal year 1994 due to a
reorganization and transfer of two employees from other departments into the
Planning Department.
Transfer to Debt Service Fund reflects a 3.29% increase due to timing differences of
funding provided to the Debt Service Fund.
Nondepartmental expenditures are down 11.46% compared to last year. This
reduction relates to the timing of transfers of operating subsidies and capital project
funding from the General Fund to other funds.
The School Fund and Enterprise Funds are on target with the adopted budgets without
significant variances, Variances warranting comment will be explained as they occur
throughout the fiscal year. I would be pleased to answer any questions that City
Council may have concerning the Monthly Financial Report.

AN ORDINANCE authorizing a lease between the City of Roanoke
and Roanoke City Mills, Inc., for the lease of certain airspace
over Jefferson Street in the City, for a term of sixty (60) years.
WHEREAS, the City has, by advertisement published once a week
for four consecutive weeks in a paper of general circulation
published in the City, publicly invited bids for lease of certain
airspace over Jefferson Street in the City for a term of sixty (60)-
years;
WHEREAS, one bid for the lease of such airspace was received
when bids were publicly opened at the Council meeting held on March
14, 1994;
WHEREAS, the bid of Roanoke City Mills, Inc., to lease such
airspace for a term of sixty (60) years commencing on April 8, 1994
and ending on April 7, 2054, for a one-time rental payment in the
total amount of $750.00, and upon other terms and conditions set
out in the lease incorporated by reference in the bid, was publicly
opened at the Council meeting on March 14, 1994; and
WHEREAS, at such Council meeting, a public hearing was held at
which all persons were accorded a full and fair opportunity to
comment with respect to the proposed lease of such air rights; and
WHEREAS, Council found the bid of Roanoke City Mills, Inc. was
the highest and best bid made to the City for such airspace, and
Council is desirous of accepting this bid.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of
Roanoke as follows:
1. The bid of Roanoke City Mills, Inc. to lease certain
airspace over Jefferson Street, in the City, such airspace being
more particularly described in the bid of Roanoke City Mills, Inc.,
a copy of which is on file in the Office of the City Clerk, for a
term of sixty (60) years, commencing on April 8, 1994 and ending on
April 7, 2054, for a one-time rental payment of $750.00, to be paid
prior to April 8, 1994, and upon certain other terms and conditions
set out in the lease and incorporated by reference and the bid of
Roanoke City Mills, Inc., is hereby ACCEPTED.
2. The City Manager and City Clerk are hereby authorized,
for and on behalf of the City, to execute a written lease between
the City and Roanoke City Mills, Inc. for such airspace, such lease
to be in a form approved by the City Attorney.
3. The City Clerk is directed to forward an attested copy of
this ordinance to Donald L. Mennel, President, Roanoke City Mills,

Roanoke City Millst Inc. has been in business in
the 1700 Block of South Jefferson Street for many
years. It is currently owned by Mennel Milling Co.

The location of the business to date has been
entirely on the east side of Jefferson Street with
some parking on the west side directly across the
street.
C. The structure closest to the east side of the
street, known as the Scale Building, is used both
as the point where the grain is delivered to the
mill by trucks and also the point where the
processed flour is loaded out into trucks. This
causes conflicts interrupting the smooth operation
of the mill's processes, as the building will only
permit one-way access, one truck at a time.
Mill property is landlocked. Ail property on the
east side of Jefferson Street is completely
developed. Property on the west side of the street
remains the only area for mill expansion. To
remain in business and expand to meet current
contracts, the mill must fully utilize all
properties it owns.
To meet customer and qovernment requirements, mill
may unload grain from rail cars at rear of mill but
may not load out finished product in that area
because of unsanitary rodent and insect-infested
adjoining property, thus, load out processing and

storage facilities must be established west of
Jefferson Street. Long, narrow, configuration of
that property forces mill to request waiver of
setback requirements in order to utilize as much of
the property as possible. At approximately six (6)
feet back of the street right-of-way line and
seventeen (17) feet back of the curb line, this
will place the structure much further back than the
Feed Mill structure on the northerly end of the
property east of the street.
II.
Current Situation:
A request to permit the installation of a pipe
bridqe across South Jefferson Street, 17 feet 9
inches above the highest point on the street
surface (which exceeds the minimum standard height
required by City and VDOT) from the Scale Building
directly across the street to a new Flour Load-out
Building on the west side of Jefferson Street (see
attached information) has been received from
Roanoke City Mills, Inc. (see attached letter).
The pipe bridqe is to be of metal construction and
will be completely enclosed. It will contain pipes
for transfer of flour as well as a maintenance
walkway. It will be 64.5 feet long, 7.0 feet wide,
and 8.0 feet high. Exterior cladding material will
be metal siding in a color suitable to the
neighborhood group.
Ma~or hiqhwa¥ setback line of 25 feet from westerly
right-of-way line of Jefferson Street must be
waived by City Board of Zoning Appeals (BZA).
Application for a variance has been submitted.
1985 Major Arterial Highway Plan showed Jefferson
Street in "Not to be Improved" status relative to
widening. Project is conditioned upon receiving a
variance from BZA, or City Council.
Rezoninq is not an issue in this situation.
Properties on both sides of Jefferson Street are
zoned, HM, Heavy Manufacturing.

Initial meeting with neighborhood qroup, Neighbors
in South Roanoke, was held on June 10, 1993 to
discuss the potential visual impact of the
structure on travelers on South Jefferson Street.
This meeting resulted in scheduling a subsequent
meeting for June 28, 1993, to include general
neighborhood representation (see attached letter).
Suggestions by neighborhood group and City for
beautification of area have been accepted by
Roanoke City Mills as follows:
Loading docks on the east side of street will
be angled to improve truck access and traffic
congestion.
New concrete curbs, sidewalks~ and driveway
entrances will be installed by Roanoke City
Mills on the west side of the street.
Ail driveways will be paved on the west side
of the street by Roanoke City Mills.
Architecturally decorative treatment will be
applied to the space between the new flour
load-out structure, it's driveways, and the
sidewalk.
Structure and bridge will be sheathed in
materials that conform as closely as possible
to neighborhood desires.
Potential lease must be advertised and successful
bidder is to be required to reimburse City for the
full cost of advertising for the lease of those air
rights for a term of sixty (60) years. Bid for
license payment is recommended to be a one-time fee
of not less than $500.00. This value was
established by applying the value per square foot
of surrounding properties to the 7.0' x 60.0'
footprint of the bridge over the street.
Advertisement and a public hearing are required for
lease of air rights over City right-of-way. City
must advertise for bids for the lease of air rights

once a week for four (4) successive weeks in two
(2) newspapers with local circulation. In
addition, prior to authorizing lease by ordinance,
City must advertise a public hearing on the
proposal once a week for two (2) successive weeks,
hearing to be held not less than six (6) nor more
than twenty-one (21) days after date of second
advertisement.
Staff recommends authorization of a lease for this
structure including provisions for removal of
structure should use terminate, structure be
allowed to deteriorate unreasonably, or be damaged
to the point that owners did not wish to repair it.
Successful bidder must obtain a performance bond
naming the City as the obligee or insured party in
the event lessee does not demolish or remove
structure as required in lease. Bond to be in the
initial amount of $30~000.00. The amount of the
bond to be reviewed every five (5) years and
adjusted as necessary by mutual agreement of the
parties. Successful bidder to also be responsible
for utilities, maintenance, and lighting of bridge.

I enclose three documents prepared by Donald S. Jack &
Associates, Inc. and Richard L. Williams, Consulting Engineers,
for the proposed Roanoke City Mills flour load-out facility
currently being considered by the Water Resources Committee and
the Board of Zoning Appeals. The rendering shows the load-out
facility and pl~e bridge across Jefferson Street and the site
plans show the Roanoke City Mills proposal and a site plan with
existing City setbacks. I am enclosing legal size as well as
"plat size" documents for your convenience.
Roanoke City Mllls is landlocked. All of the property that
has become available on the east side of Jefferson Street has
been purchased and Reserve Avenue and Victory Stadium block
expansion to the south. Carillon and Virginia Scrap Iron & Metal
Company own the remainder of the property adjacent to Roanoke
City Mills and neither will discuss a sale. Carillon indicates
it might leelm an area for truck parking after it has completed
its current construction.
At the present time Roanoke City Mills is in the process of
reviewing its flour mill facility in reaction to a significant
increase in bueAness and in response to more stringent industry
and governme~tal standards for milling operations. To continue
at its present location, Roanoke City Mills must improve its
loadihg and unloading facilities both as to sanitation and

the existing flour mill can best be described as a Jungle and,
while government regulation and customer demand will allow grain
to be unloaded on the adjacent railroad siding, flour cannot be
shipped by rail because of the condition of the adjacent
property. Accordingly, Roanoke City Mills must receive all grain
and ship all flour transported by truck from the existing scale
building. Only one truck can use the scale building at a time
and it takes approximately ninety minutes to load a flour truck
from this facility. This not only hinders Roanoke City Mills'
ability to do business but creates a traffic problem along
Jefferson Street when grain shipments are received by truck. The
proposed load-out facility will separate the receipt of grain
from the shipping of flour and will load a truck with flour in
approximately fifteen minutes. The proposed facility will
consist of a precast concrete facia tower containing four storage
tanks which will be accessed and loaded by four to six flour
conveying pipes located in a pipe bridge leading from the
existing flour mill across Jefferson Street.
Roanoke City Mills is approaching the modernization of its
facility from a number of different perspectives. First, the
general appearance, sanitation and efficiency of the existing
facility must be improved. Extensive renovation has taken place
within the flour mill during the past 18 months and the exterior
of the office on the east side of Jefferson Street has-been
painted. The flour mill is scheduled to be painted next year and
a contract has been let to completely remove and renovate the
front of the "mattress factory" at the southeast end of the
Jefferson Street Bridge. The existing feed mill storage building
on the west side of Jefferson Street has been painted and a mural
is being placed on the side of the building adjacent to the
grassy area along Reserve Avenue.
The proposed flour load-out facility will not only be more
attractive, sanitary, and efficient than the existing facility
but will be safer both from an employee and traffic perspective.
The driveway through the load-out facility that is not concrete
will be hard surfaced and a non-organic architecturally
decorative treet~aent will be placed between the load-out facility
and Jefferson Street. Roanoke City Mills will construct new
concrete curbs, sidewalks and driveways along the length of the
property on the west side of Jefferson Street as shown on the
site plan. With appropriate variances, the remainder of the
property on the west side of Jefferson Street can be configured
to allow truck parking along the northern side of the existing
feed mill storage building and for the construction of a new
flour packing line and warehouse building. A variance is

required because the existing alley will not accommodate truck
access to the parking area and the proposed flour load-out
facility will block access if it complies with the existing set
back and is not located as shown on the site plan proposed by
Roanoke City Mills.
Pedestrian and vehicular traffic flow and safety are prime
objectives in the proposed reconfiguratton of Roanoke City Mills.
On the east side of Jefferson Street the bag loading dock area
adjacent to the existing office and warehouse will be redesigned
as shown on the site plan to allow tractor trailers to back into
the loading docks at an angle and thus not restrict traffic along
Jefferson Street. The flour load-out facility on the west side
of the street should be located adjacent to the right-of-way as
shown on the site plan in order that trucks will not have to make
sharp turns £n and out of the facility. Of course, the capacity
of the new facility will move trucks through in fifteen minutes
rather than an hour and a half, separate the delivery of grain
and the shipment of flour by truck and change the traffic flow so
that trucks delivering grain will go north on Jefferson Street
and trucks loading flour will go south on Jefferson Street. The
pipe bridge across Jefferson Street from the existing mill to the
flour load-out facility will serve not only to transfer flour to
the load-out facility but will be constructed so that employees
can cross Jefferson Street through the pipe bridge and thus
provide an additional pedestrian safety feature.
A number of specifics included in the Roanoke City Mills
proposal should be addressed. For example, the set back for the
flour load-out facility proposed by Roanoke City Mills is
approximately six feet from the property line, seventeen feet
from the curb line of Jefferson Street and is further from the
curb line of Jefferson Street than the front of the existing feed
mill storage building. From a construction standpoint, if the
load-out facility is located as depicted on the site plan showing
the City required setbacks, a bridge support will be required
near the curb line of Jefferson Street which is assumed will be
less &ttrect~vm than the actual load-out facility. Roanoke City
Mills will bier the cost of curb, gutter, sidewalk and parking
lot improvements shown on the site plan.
After consultation with its customers and reflection on
modern flour mill operation, Roanoke City Mills must insist on
non-organic~decorative materials adjacent to the flour load-out
facility. Modern sanitation requires flour be absolutely free of
cont~inants and even the smallest area of organic material will

attract insects which would be drawn to the flour and, once in a
load of flour, could contaminate an entire baking facility.

Thank you for attending the NEIGHBORS in SOUTH ROANOKE membership meeting on
Monday, June 28, 1993 at South Roanoke United Methodist Church.
Per your request, included in this letter are recommendations of NEIGHBORS in SOUTH
ROANOKE regarding the MINNEL MILLING Company; Roanoke City Mills, expansion
project.
First, it is of our opinion that we have a true corporate citizen; more than good listeners to
our concerns.
Second, it was mutually agreed that the traffic patterns around the Mill should change. The
Trucks should enter their parking areas across from the main building through the alley.
This would alleviate traffic congestion on S. Jefferson Street. The city might help here in
providing a harder surface alley. The parking lot next to the railroad track has excess gravel
that is moved from the parking by the trucks onto the sidewalks. This is a hazard to
walkers and runners. It is also a waste of gravel. A harder surface for the parking lot next
to the tracks would alleviate alot of gravel on the sidewalk.
Third, we proposed, and it was agreed, that the connecting bridge should be re-engineered.
One idea is to allow the walkway to have half way up the structure a visually opaque siding.
This would encourage employee usage of this walkway by employees, reduce potential
pedestrian traffic problems, and decrease the need for additional security.
Fourth, Additional green is needed along S. Jefferson and on the existing plant sig We
recommend the city rework the sidewalks and curbs. Trucks NOT BE ALLOWED TO
ROLL OVER THE CURBS and the grassy area (currently now with a little dirt) be
revitalized and planted with grass. MENNEL MILLS should include in their design of the
new 8 story tower a green grass area and possibly some shrub plantings.
NEIGHBORS in SOUTH ROANOKE is aware of the rodent problem created by the
overgrowth of the property to the rear of the mill. Rats travel in the sewers. Rats are
noticed, by walkers, joggers and persons in their backyards at night. The dumpster at Crystal
Spring School is frequented by rats which might be coming from this area. There is also a
has also been a cat haven in this area. Stray cats live and multiply in this area. MENNEL
Mill can not do anything to correct this problem for the neighborhood because they do not
own the property.
NEIGHBORS in SOUTH ROANOKE appreciates the cities efforts to encourage Roanoke
City Mills to work with the neighborhood group. John Gibson, general Manager, seems to
be genuinely interested in our concerns. The neighborhood is delighted Roanoke City Mills
chose to expand its facility in Roanoke. We look forward to working together to enhance
this area to benefit both the neighborhood transitional area between downtown and the
residential area and the corporate image of MENNEL MILLS.

cooperetively with the city and Mennel Mill to develop an expansion
project that meets the neighborhood's and business' needs.
On June 10, you, Beverly Lambert, Don Reid, Sonny
DeVeaux, John Gibson and I met to ~eview the proposed plans,
discuss neighborhood concerns and identify next steps. Neighbors
in South Roanoke will sponsor a neighborhood meeting to ~eview the
plans and Kaln neighborhood input. You a~ to notify the
neighborhood of the meeting scheduled for June 28, 7:30 P.M. at
South Roanoke Methodist Church. Sonny and John will ~ep~esent
Mennel Mill, b~ng the plans and rsnder/ngs, and discuss planned
-~i,~tenance and additional changes ag~eed upon on June 10.
Cum~ently, Mennel Mill is scheduled to remove the plywood and
br/ck in the windows at the old matt.~ess facto~r, the br/ck building
located before the docks. Additio~,~ily, the warehouse across from
the mill is scheduled for painting this month.
Mennel Mill p~poses to build a steel building with pr~cast
concrete on the west side of Jefferson along with a walkway 4- 6 feet
wide and 8 feet tall which will connect the existing and proposed
bufldtnge. The new building is needed to load and unload bulk
supplies. The new building will previde quicker unloading (in about
15 ~wutee) and reduce the interruptions of traffic flow on Jefferson
Steeet. The walkway will house 4 pipes, p~ovide space for operation
and maintenance of the pipes, and provide a walkway for employees
to ge f~om the existing and proposed building.

After much discussion, Mennel Mill agreed to the following:
Extension of the one-way proposed asphalt drive to accommodate one
waiting truck;
Planting of gr~ss in the area between the street and sidewalk on both
sides of Jefferson Street;

Maintenance of the grsvel away from the sidewalk and street at the
existing building and within 4 years to repair the broken sidewalk
and build a wall beyond the sidewalk to keep the gL~vel on the drive;
Repair and improve the sidewalk along the current parking lot to
bear the traffic and weight of the trucks, asphalt of the truck drive,
continuing asphalt to the south warehouse building which will remove
the gravel to appro~ra~tely 20 feet from the street, planting of
greener~ along the proposed drive the street;
Building setback of appro~m~tely 16 - 20 feet from Jefferson Street;
6. Provide samples of colors and trim for the w~lkway;

March 28, 1994
MR. CRAWFORD: Honorable Mayor Bowers and Members of Roanoke City
Council, three years ago this month the City saw the need to approve pre-hospital
care for the citizens of Roanoke. Two engine companies, Engine Four and Engine
Eleven, accepted this new service and responsibility for the citizens of Roanoke.
Twenty-four firefighters completed the necessary training to become emergency
medical technicians in the City's first basic life support engines. The firefighters
accepted the additional work, responsibility, dangers and risks. With the additional
responsibility of service, I have been receiving a stipend pay of $100.00 a month.
I was told that this was an experimental program and the program would be
evaluated at or near the end of the three year program. I, as a firefighter, ask that
this arrangement also be put in the form of a written agreement between the City
and us. However, I was told at that time, that we were all gentlemen and
gentlemen did not need a written agreement and this was not necessary. It is
obvious now though that no such evaluation is going to take place or that the
program or the stipend pay is either not going to take place, so let me summarize
the program for you. I started as a first responder in the program two years ago

with two engine companies, Engine Four and Engine Eleven. The Fire Department
now has six engines on line as first responders. We started with 24 firefighters
trained and to date, we have 150 firefighters trained as EMT's, shock trauma,
cardiac techs and paramedics. Response time for the Department of Emergency
Services has greatly been improved. In many instances, the Fire Department has
been able to completely handle the call, which allows the City's ambulances to stay
free for other emergencies. There are several instances where early resuscitation and
defibrillation of our patients has given that citizen a second chance. I feel that you
as Council Members should feel good about this because you took the initial steps
to improve this pre-hospital care to the citizens of Roanoke. However, I feel that
the success of this program may now and in the future be in great danger. We
have tried to resolve these issues through the City offices, with no success. This
is why we have come to you, as Council Members, asking for your help. Every
firefighter that has taken the EMS training has a stipend and it should become a
permanent part of our pay. We have also suggested to you, by letter, several areas
that needed secure funding for these additional services. More than half the United
States emergency services systems are based in the Fire Departments. First
responders such as us in our program boost those percentages greatly. I also have
information to show that many departments do pay incentives for their firefighters

at EMT levels. You, as Council Members, should ask yourself why we are not
using all City engines as First Responders then. The answer is money. The City
is currently paying 42 firefighters $100.00 stipend a month, leaving 110 firefighters
and seven engines not a part of the program. We feel that in the future Council
will be asked to add additional personnel to the Emergency Services Department
to meet the growing need and number of calls for emergency medical callers. The
question you need to ask yourself is, why do we continue to add personnel when
we already have personnel who are trained and ready to go? Furthermore, it is not
fair to the citizens of Roanoke to have areas that are receiving these services while
others are not. It is not fair to have southwest Roanoke to have these first
responder programs while areas around Station No. 5 do not. All citizens deserve
the same service and equal services. These issues must be addressed now and not
later. We encourage you to talk to the Fire Chief, who in his proposal also
recommended making the stipend a part of our permanent pay, as well as getting
the other engines on line. In closing, I, as a firefighter, have done my part and
stand ready to serve the citizens of this Valley. I ask that Council see that they do
their part and I thank you for this opportunity to address you with this issue which
is very important to us as firefighters and to me as a firefighter. We would also ask
you to take action that would resolve this issue now and not question this vital

service and putting it off any longer to the citizens of Roanoke. Honorable Mayor
and Members of Council, I thank you again for the opportunity to address this
issue. Thank you.
MAYOR BOWERS: Thank you Mr. Crawford. Are there any comments or any
discussion from Members of Council? May I say at the outset that I have had a
chance to speak with Mr. Crawford on the telephone about this issue and I am
pleased that you were able to come and address this concern to Council. To all of
our firefighters who are here today, let me first of all say how very appreciative we
are of the hard work that our employees always do for the citizens of our City. We
have some excellent services that we deliver to our citizens. I am not sure that I
hear that all the time. I wish it was more. Perhaps it is just the nature of our
society that we hear so many of the negative things, and so many of the things that
we do wrong, when we should be capitalizing on the positive things. We should
be addressing or trying to let everybody know of all the good things that we do.
Day in and day out the people of the Roanoke Fire Department literally do lay their
lives on the line in the line of duty to preserve our property and to protect our
citizens' lives. May I just say, and I will ask the Members of City Council to
please join me and the others in joining me in acknowledging your presence here

today and thanking you for the good work that you do, and I really mean that very
sincerely. Ed, likewise, I would say that I have had a chance to speak briefly about
the matter with the City Manager. I do not know whether the other Members of
Council would like to say anything, but if I might be permitted to say, I would like
to ask that this matter be forwarded over to the City Manager ... that would be your
request? ... to be sent to the City Manager for a timely report back to the City
Council. In that I know that there had been an earlier study that was in
conjunction with this. I am not sure that that has ever been fully addressed and so
as a part of the report back to the Council, I would like to see that that matter is
brought to our attention so that we can have a full report on the issue. I, for one,
do not mind telling you and I am not running for reelection this time, but I, for
one, do not understand why we do not have a merger between our fire and rescue
squad already. I was at the funeral home in Roanoke County last month, and I
looked over, there was a vehicle parked beside my car and I did not ... the emblem
on the vehicle was strange to me, so I got up a little bit closer to look at it and it
said, "Fire and Rescue, Roanoke County". I do not know why our neighboring
jurisdictions have been able to do those kinds of things and we have not been able

to do that here in Roanoke. But it seems like the trend across the nation is for a
merger of Fire and EMS, and certainly that would be something that I think we
ought to be moving ahead on very quickly in Roanoke.
MR. HARVEY: Mayor, may I ask the Manager something? Rest assured I am not
running for election either. Bob, will you have this report back by June 30?
MR. HERBERT: Oh yes. Mayor and Members of Council, I would not want to
mislead anyone in terms of saying that we will have the solution. I assume all our
employees involved know that we are now in the midst of a detailed analysis in
bringing in the doctors in the emergency rooms, volunteers, the firefighters are
participating in this process. I can answer most of your questions rather quickly,
but in terms of bringing back my best recommendation in terms of what the
solution is ... I think it would be ... I will be less than honest if I thought that I
could bring you that recommendation in 30 days. Everyone who participated in
this knows that we are heading for probably an October deadline to bring back the
formal recommendation which will be aimed at being implemented in fiscal year
1995-96 which is next fiscal year. Perhaps if we can do it right as soon as the
recommendation comes back, but this is going to be a very sizeable impact on the

General Fund of the City, not to also acknowledge that this is going to be a very
sizeable impact on the citizens of our community. This is really a very basic public
health, public safety, life safety issue affecting our community. If I was to say
anything less than that, I would bring back an incomplete recommendation.
MR. HARVEY: It would be my hope that you would come back with at least the
financial part of this. I know you want to wait until October, but I certainly would
like to have some input on the financial impact of this if that is at all possible.
MR. HERBERT: I hope Council understands that what we are talking about is the
perspective. There has not been any change in the current situation financially to
the people who are currently receiving the stipends. The question becomes what
is our long term solution because when we ultimately make the kind of change that
we are going to be faced with, it needs to work, work successfully and serve the
citizens. I think I need that information that is going to come out of this study and
recommendations of the Fire, EMS, emergency room people in order to really do
that.

MAYOR BOWERS: Mr. Manager, what did you just say about the stipends that
I maybe did not hear?
MR. HERBERT: One of the questions that came up, in all fairness to Mr.
Crawford as he generally described this matter to you, the stipends were to have
terminated on March 1. We believed that we would be through with the study in
order to make a decision in that time period. Now it looks like it is going to be
roughly October. The stipends that were to have been terminated, effective
March 1, have been continued and there will be sufficient funds in next year's
budget to continue them through until Council makes that ultimate decision in
terms of where you want to take this issue in terms of funding. So the stipends are
in place, and will continue in place for those who have been receiving it.
MAYOR BOWERS: Any other questions. Mr. Edwards.
MR. EDWARDS: Mr. Mayor, I want to echo what the Mayor said and what Mr.
Harvey said too. It seems to me though that we would need to get some of these

cost figures as part of the budget study for next year. Therefore, I ask the City
Manager if he could give us what he can in the way of cost estimates as soon as
he can with regard to the budget study for next year.
MAYOR BOWERS: Any other comments or discussion. If not, without objection,
the matter raised by Mr. Crawford will be referred to the City Manager for a timely
report back to Council and there is no objection with that? If not, there is no
objection, it is so ordered.
