Subject: Request for Public Hearing On Proposed 1994-1995
Community Development Block Grant Program
I. Background:
City of Roanoke receives an annual entitlement from the
U.S. Department of Housing and Urban Development (HUD)
in the form of a Community Development Block Grant
(CDBG).
HUD representatives informed City staff that Roanoke's
CDBG entitlement will be $2,276,000 for the City's
fiscal year 1994-1995, an increase of $200,000 over FY
94 funding. Additionally, revenue is estimated to be
available from the following sources for FY 95:
$603,100 estimated program income generated from
prior CDBG programs, and
$64,767 transferred from prior grant entitlement
years.
$617,034 in estimated carry-over funds will be
available for continuing projects.
Two public meetings have been held to hear citizens'
recommendations, on February 1, 1994 and April 21, 1994.
II. Current Situation:
Council will be briefed by City Manager on May 2,
at regularly scheduled City Council meeting, on
recommended activities for the FY 1994-1995 CDBG
program.

Citizen participation requirements call for an evenin9
public hearing by City Council prior to submission of
CDBG Statement of Objectives (application) to HUD.
City is required by HUD to publish Draft Statement of
Objectives in the newspaper. A summary version will
appear in the Neighbors section of The Roanoke Times and
World News and in the Roanoke Tribune on Thursday, April
26, 1994.
III. Recommendation:
Recommend City Council schedule Community Development Block
Grant public hearing on May 9, 1994, at 7:30 p.m. in Council
Charmbers.

SUBJECT: Control of Design of New Buildings
Dear Mayor and Members of Council:
Recently, a group of residents of the City presented a petition of concern to City Council
regarding the design of some single-family houses that have been built recently in certain parts of the
City. These citizens asked that City Council consider actions to regulate the design of such houses.
Among the issues involved in consideration of this item are 1) preservation of the value of
houses in existing neighborhoods; 2) the aesthetic compatibility of new construction with existing
buildings; and 3) the justification for the City to use its police powers to control the design of new
construction.
Generally, the better maintained an area is, the higher the property values are, the stronger the
private real estate market is, and the higher quality any new development is likely to be. Such is true
because the developer can obtain an acceptable return on the additional expense of that quality.
The City makes many efforts to keep our neighborhoods strong and well-maintained, to protect the
value of investments made already by their residents and to keep them attractive for additional private
investment. Among these many efforts are the activities of the Roanoke Neighborhood Partnership,
neighborhood development grants and mini-grants, COPE units, excellent neighborhood schools, Code
enforcement, and housing subsidy programs.
The City is allowed to regulate the type and intensity of uses (zoning, business licensing,
etc.), the condition of buildings as that condition relates to health and safety (building codes, fire
codes), and aesthetics and style of construction in areas of historic significance which would be
destroyed irrevocably by incompatible design (H-land H-2 zoning districts).
In response to citizens' concerns regarding the design of infill construction in areas not
designated as historic, the 1993 General Assembly expanded further the City's authority to control the
style of new construction and rehabilitation. This authority is limited to neighborhoods which:
a. are identified specifically in the Comprehensive Plan as having either historic
or unique architectural value; and
b. are included in designated Conservation Areas, Rehabilitation Districts, or
Redevelopment Areas (of which a map is attached); and
c. for which the City adopts specific design standards to apply to construction or
rehabilitation.
City staff is currently working toward completing the required design standards, making necessary
amendments to the Zoning Ordinance, and updating the Comprehensive Plan to identify target areas.

In neighborhoods like Preston Park, Raleigh Court, Wasena, Forest Park, Prospect Hills, and
all but a few of our oldest neighborhoods, which do not fall within the categories set forth above, the
City has no authority to infringe directly on an owner's prerogative to build on his property, to his
taste, as long as the construction complies with applicable safety and zoning codes.
In the absence of authority to impose such controls, the role left for the City is to provide
encouragement and positive incentives to owners and contractors to build attractively. This has
included reimbursements of certain development costs through the CDBG-funded Vacant Lot
Homesteading Program. The federal funding of that program however allows it to apply only to
nonprofit agencies building houses for low-moderate income residents. The City Attorney has advised
that the City may not use General Fund revenues to make loans or grants to individuals or for-profits.
Beyond such direct subsidies, City staff works with citizens and builders to encourage high quality
design.
Please be assured that we continue to search for ways the City can offset some of a builder's
costs to help facilitate attractive, quality developments. Some concepts toward that end are being
examined for the plan to encourage new upscale housing, to be presented to Council in June.

Monday, April 25, 1994
Clarence R. Martin, 155 Huntington Boulevard, N. E., Roanoke, Virginia. I am the
new president of the Roanoke City Retirees Organization. I am here on behalf of
the retirees. We are asking that when you vote on the budget in May for 1994-95,
if you would vote to give us permanent pay raises. We need for our pension
checks to increase over the years due to the high cost-of-living, and health
insurance has gone up so high. We need your help. We have 1,I00 retirees and
some are only drawing $500.00 - $600.00 a month. The pension checks have got
to be increased to keep up with the cost-of-living. We gave the City 25 to 40
years of our life and we need for you to look after us a little bit more. We would
really appreciate it. Since I became president, we have 180 members. Like I said
before, we have 1,100 retirees and we h~,ve 571 who live in the City. We are
trying to organize more and are trying to get more done for the retirees. We are
asking you that when you vote for the 1994-95 budget, you will give us permanent
pay raises and also in the future, we would like to have permanent pay raises. I
appreciate you letting me talk to you.
MAYOR BOWERS: Thank you, Mr. Martin. Thank you for being considerate of
our time as well. May I also at this time remind the Members of Council, our
Administration and our citizens that there is a budget public hearing this evening
at 7:00 p.m., at William Fleming High School Auditorium. Thank you Mr. Martin

Subject: Cash Assets Forfeited to the
Roanoke City Commonwealth Attorney's
Office
I. Back~round:
In an effort to better fund law enforcement efforts to fight
crime, particularly drug crime, in 1986 the Federal government
adopted a system of asset forfeiture whereby forfeited assets,
under certain conditions, could be returned to local law
enforcement agencies, police and prosecutors, for use in their
fight against crime.
In July, 1991, Virginia asset forfeiture statute, which
generally is patterned after the Federal statute, took effect
providing that forfeited criminal assets may be returned to
local police and prosecutors for use in the fight against crime.
Periodically, assets seized as evidence are ordered forfeited
by the local courts to the police or the Office of the
Commonwealth,s Attorney to be used for criminal law enforcement
efforts.

In August, 1991, a grant fund account for cash assets forfeited
to the Office of the Commonwealth,s Attorney was established
with an appropriation of $25,000.
II. Current Situation:
Since August, 1991, the Office the Commonwealth,s Attorney has
expended the $25,000 originally appropriated.
Revenues collected through April 13, 1994, for this grant are
$33,573 and were deposted in account 035-035-1234-7107. Current
revenue estimate is $25,000. Funding received in excess of the
extimated revenue totals $8,573 and need to be appropriated at
this time.
In order to facilitate receipt and distribution of these funds,
as well as protect the public's confidence through systematic
accounting, City Council action is requested to authorize the
Department of Finance to continue the grant fund accounts
through which the Commonwealth may deposit and disperse funds.

A RESOLUTION granting authority to apply for disaster relief
and to provide assurances required in connection with such disaster
relief.
BE IT RESOLVED by the Council of the City of Roanoke that:
1. Diane S. Akers, Budget Administrator, is hereby
authorized to execute for and on behalf of the City of Roanoke, a
public entity established under the laws of the State of Virginia,
an application and to file it in the appropriate State Office for
the purpose of obtaining certain Federal financial assistance under
the Disaster Relief Act or otherwise available from the President's
Disaster Relief Fund.
2. The City of Roanoke, a public entity established under
the laws of the State of Virginia, hereby authorizes its agent to
provide to the State and to the Federal Emergency Management Agency
(FEMA) for all matters pertaining to such Federal disaster
assistance the assurances and agreements set forth in the
attachment to the April 25, 1994 report of the City Manager to this
Council.

Re: Designation of Applicant's Agent Relative to Declaration of Emergency
Dear Members of Council:
I. Background
Governor Allen declared a state of emergency to exist in the Commonwealth as a
result of the ice storm of February 8, 1994. Subsequently, a Presidential
Declaration for public assistance only was received for the State of Virginia.
On March 21, 1994, City Council passed Resolution No. 31928-032194
authorizing emergency powers to the City Manager as Director of Emergency
Services, the Director of Finance as the City's Fiscal Agent and the Budget
Administrator as the Applicant's Agent.
Current Situation
Federal/State Damage Survey Inspection Team visited City of Roanoke for
damage assessment on April 1 and April 7 and 8, 1994. Damage Survey Reports
are anticipated to be completed for Roanoke by April 29, 1994.
Designation of Applicant's Agent Resolution (FEMA Form 90-63, MAR 81~
attached ) must be completed and sent to the Federal Emergency Management
Agency, District Field Office in order to apply for Federal disaster relief funding.
This resolution provides Applicant Assurances of compliance with FEMA
requirements, and requirements including OMB's Circulars No. A-95 and
A-102 and FMC 74-4 as they relate to the application, acceptance and use
of Federal funds for this Federally assisted project.
The applicant also provides assurances as listed on back of attached
Designation of Applicant's Agent Resolution (FEMA Form 90-63,
MAR 81).
llI. Recommendation
City Council adopt the attached resolution afffirming the designation of Diane S.
Akers, Budget Administrator as Applicant's Agent for the City of Roanoke for
executing and submitting appropriate documentation and information regarding
federal and state reimbursement.

A RESOLUTION supporting alignment of the Transamerica
Transportation Corridor in close proximity to the Roanoke Valley.
WHEREAS, the Intermodal Surface Transportation Efficiency Act
of 1991 identified, in Section 1105, the Transamerica
Transportation Corridor as a high priority corridor on the National
Highway System;
WHEREAS, the Transamerica Transportation Corridor is conceived
as a transcontinental route extending from Norfolk, Virginia, to
Los Angeles, California, and generally being located between 1-70
to the north and 1-40 to the south (which are, at places, separated
by distances of up to 350 miles);
WHEREAS, the Virginia Department of Transportation is
participating with eleven other states and the Federal Highway
Administration in a steering committee to examine the feasibility
of the Transamerica Transportation Corridor;
WHEREAS, the study being undertaken seeks to identify and
evaluate multimodal transportation options and intermodal linkages
for the 21st Century within this transportation corridor; and
WHEREAS, the Roanoke Valley is a major population center not
adequately served by an east-west interstate system, and location
of the Transamerica Transportation Corridor in close proximity to
the Roanoke Valley would improve access to our region which has the
largest population, medical and financial centers, as well as the
largest airport, in western Virginia and thereby strengthen both
interstate and intrastate commerce;
THEREFORE, BE IT RESOLVED by the Council of the City of
Roanoke as follows:
1. City Council hereby endorses alignment of the
Transamerica Transportation Corridor in close proximity to the
Roanoke Valley and, specifically, on an alignment that would
generally follow U.S. Route 460 from Norfolk to Lynchburg and then
on to Roanoke and points westward.
2. The City Clerk is directed to forward an attested copy of
this resolution to the Honorable John W. Warner, Member, United
States Senate; the Honorable Charles S. Robb, Member, United States
Senate; the Honorable Robert W. Goodlatte, Member, House of
Representatives; the Honorable J. Brandon Bell, II, Member, Senate
of Virginia; the Honorable A. Victor Thomas, Member, House of

SUBJECT: Transamerica Transportation Corridor
I. Background:
City Council, at its meeting on Monday, January 3, 1994,
received and filed a communication from the Honorable
Mayor, David A. Bowers, in regard to the 1-66
Transamerica Highway. This was referred to the City
Manager for consideration and any appropriate
recommendation to City Council.
In April, 1989 an organization known as the Regional
Commerce and Growth Association (representing 18 counties
in the southeast Missouri area) convened a meeting in St.
Louis, Missouri to determine interest in, and support of,
a coast to coast highway to be called 1-66. Consensus of
the representatives from the seven midwestern states
attending was unanimous approval for the concept and
support. Formed from this meeting was the 1-66 Project,
Incorporated, an organization to promote and raise funds
for the proposed interstate.
In July, 1989, legislation started a fast track through
the United States Congress toward funding for a project
feasibility study.
Lobby efforts began in 1990 and proved successful by the
fall of 1990, with a $1,275,000 appropriation to conduct
a feasibility study for the 1-66 Project.
In August, 1991, the firms of Wilbur Smith Associates and
Howard Needles Tammen & Bergendoff were selected to
conduct the study.
The Intermodal Surface Transportation Efficiency Act of
1991 (ISTEA) further identified in Section 1105 this
Transamerica Transportation Corridor (TTC), as it is now
known, as a high priority corridor on the National
Highway System (NHS). According to ISTEA, the
justification for having a "high priority corridor"
listed is that:

The construction of the interstate highway system
connected the major population centers of the nation
and greatly enhanced economic growth in the United
States.
Many regions of the nation are not now adequately
served by the interstate system or comparable
highways and require further highway development in
order to serve the travel and economic development
needs of the region, and
The development of transportation corridors is the
most efficient and effective way of integrating
regions and improving efficiency and safety of
commerce and travel and further promoting economic
development·
Transamerica Transportation Corridor (TTC) is perceived
as a transcontinental route extending from Norfolk,
Virginia to Los Angeles, California, and generally
located between 1-70 to the north and 1-40 to the south
(which are separated by distances up to 350 miles). This
study area is primarily rural and is situated generally
between most of the major U.S. urban areas (see attached
map).
Virginia Department of Transportation (VDOT} agreed to
participate with eleven (11) other states and the Federal
Highway Administration on a steering committee to examine
the feasibility of the TTC. The other states include
Arizona, Arkansas, Colorado, Illinois, Kansas, Kentucky,
Missouri, New Mexico, Oklahoma, Utah, and West Virginia.
Seven (7) other states potentially could be affected by
the TTC. These are California, Indiana, Maryland, Ohio,
Nevada, Tennessee, and Texas·
Feasibility study of this TTC is not a traditional
h~qhway feasibility study or a detailed highway location
study resulting in the identification of specific
alignments. It is intended to be exploratory in nature
and have a futuristic vision (30 to 50 years in the
future)·
The goals of the study are to identify and evaluate
multimodal transportation options and intermodal linkages
for the 21st Century within this transportation corridor.
The study is investigating whether another Interstate
highway is needed and is feasible from an engineering,
social, economic, environmental, and institutional

perspective. In addition to looking at traditional
highway options, the study is examining the feasibility
of evolving technologies, such as high-speed rail,
magnetic-levitation systems (magi.v), and intelligent
vehicle highway systems (IVHS).
The Study Team is composed of both public sector and
private sector participants. The public sector is
represented by the 12 states, the U.S. Department of
Transportation, and the Volpe National Transportation
Systems Center.
The consultant team, as noted previously, includes Wilbur
Smith Associates (the prime contractor) and Howard
Needles Tammen & Bergendoff (the principal
subcontractor), both internationally-respected
transportation planning firms. In addition, the team
includes a variety of technical specialists -- University
of Kentucky Transportation Center; Haugen Associates,
specialists in transportation technologies;
Transportation Associates, a Native American firm; Price
Waterhouse, a large financial/management firm; Dr. David
Forkenbrock, Director of the Public Policy Center and a
transportation economist at the University of Iowa; and
Dr. Ben Allen, an economic professor and freight
transportation/logistics specialist at Iowa State
University.
Current Situation:
A. Four (4) technology alternatives have been selected for
further study:
1. Technology Alternative A: Upgraded Highway
The main features of this alternative are:
Built to Interstate standards
Includes basic level of IVHS technologies
Longer combination trucks accommodated
2. Technology Alternative B: Upgraded Rail
This alternative features:
Tilt train technology (like the X2000 Amtrak is
testing)
Speeds ranging from 125 mph to 135 mph

Guideway
This alternative is distinguished by the following
features:
a. Considers both high speed rail and maglev
b. Design speeds from 125 mph in mountainous
terrain to over 300 mph in flat terrain
c. Electrically-powered trains on primarily new
alignments
Analysis corridors have been selected (from the initial
range of potential study corridors) for each of the four
technology alternatives.
The three analysis corridors are matched with a
technology (or technologies) that will be evaluated for
feasibility. The analysis corridors (each is about 50
miles wide) are representative only -- they are purely
for analysis purposes and are not meant to represent
specific alignments.
The analysis corridors combined with their respective
technologies (upgraded highway, conventional rail, super
highway, and very high speed fixed guideway) will be the
subject of the forthcoming feasibility assessment. This
will be followed by study conclusions, with the final
report scheduled for submission to the Steering Committee
by mid-1994.
1-66 Project~ Incorporated continues to promote this
project by seeking support from the communities along the
TTC's study area, and will lobby the 1994 U.S.
Congressional session to secure funding for the
design/build portion of 1-66 with route specific
language. They believe that all states through which

March Financial Report
Attached is the monthly financial report for March. Several categories of
revenue and expenditures have variances compared to year-to-date amounts for the
same period last year that deserve comment.
REVENUE
Total General Fund revenues have a positive variance of 6.1% over fiscal year
1993 on a year-to-date basis. This is very close to the overalt anticipated increase in
revenues in the fiscal year 1994 adopted budget. Variances in the specific categories
of revenue are as follows:
General Property Taxes are up 4.13% over last year and are in line with our current
year's estimates.
Other Local Taxes are up 7.22% for the entire category, but there are several revenue
sources within this category that are performing well. Utility consumer taxes are up
approximately 12%, most of which is from eJectrical usage related to the extremely
hot summer of 1993. Sales tax revenue is up an encouraging 9.2% over last year's
collections, reflecting an improving economy and outperforming the budget estimate
by 4.7%.
Permits, Fees and Licenses are up 36.10% over last year. This is attributable
primarily to increased building related permits.
Revenue from Use of Money and Property reflects an increase of 45.82%. Although
investment earnings from idle cash are down, we are receiving increased rent from the
State for space occupied by Social Services in Municipal North.

Grants-In-Aid-Federal Government is down 44.38% from last fiscal year. The City
received flood damage reimbursements of approximately $116,000 in fiscal year
1993, which accounts for this noticeable variance. The City received $56,500 this
fiscal year for reimbursements related to the snow storm last March. The significant
difference in these unanticipated revenues creates the negative variance.
Miscellaneous Revenue reflects a negative variance of 65.31% due to the timing of
collections for insurance recoveries, and payment in lieu of taxes and sales of surplus
City equipment.
Internal Services revenues are up 5.83% over fiscal year 1993. This increase is due
partially to increased rates effective at the beginning of the fiscal year, but primarily
due to increased engineering work related to Water Fund projects.
EXPENDITURES
Expenditures for the General Fund are up slightly (.02%) over the last fiscal year. On
a year to date basis, one less payday has occurred this fiscal year compared to last.
This accounts for the fact that we have spent only slightly more than in fiscal year
1993. Variances in specific categories are explained as follows:
Public Works expenditures are down 8.24% compared to fiscal year 1993. Although
the current year paving contract is approximately the same as last year, the timing of
payments is such that approximately $150,000 less has been spent on a year-to-date
basis. Aisc, equipment purchases for Streets and Traffic, Parks Maintenance and
Solid Waste Management are significantly less this year than last. This is partially due
to timing of purchases of equipment and is expected to even out somewhat as we
approach the end of the fiscal year. Last year, the City also purchased its telephone
system in the Communications budget.
Health and Welfare expenditures are up 5.15%, primarily due to Comprehensive
Services Act expenditures which were partially accounted for in other categories in
the prior year.
Parks, Recreation and Cultural expenditures reflect an increase of 4.67% over fiscal
year 1993. Most of this increase is due to a current year contribution of $123,350
to the Hotel Roanoke Conference Center Commission. The $50,000 contribution in
fiscal year 1993 was paid from the Capital Projects Fund instead of the General Fund.

Community Development expenditures are up 13.22% for fiscal year 1994 due to a
reorganization and transfer of two employees from other departments into the
Planning Department.
Transfer to Debt Service Fund reflects a 3,29% increase due to timing differences of
funding provided to the Debt Service Fund.
Nondepartmental expenditures are down 11.79% compared to last year. This
reduction relates to the timing of transfers of operating subsidies and capital project
funding from the General Fund to other funds.
The School Fund and Enterprise Funds are on target with the adopted budgets without
significant variances. Variances warranting comment will be explained as they occur
throughout the fiscal year. I would be pleased to answer any questions that City
Council may have concerning the Monthly Financial Report.

I. BACKGROUND:
Invitation to bid was advertised on February 20, 1994.
A non-mandatory pre-bid conference was held on March 1,
1994.
Bids, following proper advertisement, were publicly
opened and read aloud before the City Council on March 7,
1994.
Three (3) bids were received with Adams Construction
Company submitting the low bid in the amount of
$235~570.00 and one hundred twenty (120) consecutive
calendar days.
The work consists of grading, paving, sanitary sewer,
storm drains and landscaping improvements to the property
located on Hollins Road just north of Orange Avenue.
City Council authorized the appropriation of $99,196 in
CDBG Program Income to the Roanoke Redevelopment and
Housing Authority (RRHA) account 035-093-9330-5131 by
Resolution number 31870-02294 on February 22, 1994.
II. CURRENT SITUATION:
A. Low bid exceeded available funding ($108,000) by 118%.
City staff entered into negotiations with the low bidder,
Adams Construction Company, to reduce the overall cost by
eliminating a sanitary sewer under the Norfolk-Southern
Railroad, 500 1.f. of storm sewer, portions of
landscaping, grading of detention basin and restoration.
Each of these items will be constructed as additional
lots are sold in the future. (See Attachment A.)

contributions of Mr. Taubman as a successful businessman, humanitarian, civic
leader and philanthropist. Resolution No. 31961-042594 was adopted by the Council
of the City of Roanoke at a regular meeting held on Monday, April 25, 1994.
The Members of Council requested that I express deepest regrets and sympathy at
the passing of Mr. Taubman.

A RESOLUTION memorializing the late Arthur Taubman.
WHEREAS, the members of this Council have learned, with
sorrow, of the passing of Arthur Taubman, a Roanoke business and
civic leader in Boca Raton, Florida on March 15, 1994;
WHEREAS, Mr. Taubman purchased three Advance Stores and moved
to Roanoke in 1932, and under his leadership the chain of
automobile parts stores grew to 372 stores with annual sales that
are reported to make it the tenth largest automobile parts chain in
the nation;
WHEREAS, in addition to being a successful businessman, Mr.
Taubman was known as a humanitarian and civic leader;
WHEREAS, during World War II, when Nazi Germany had overrun
most of Europe, Jewish refugees seeking to escape to the United
States required an affidavit promising financial support, and Mr.
Taubman signed about five hundred such affidavits;
WHEREAS, in Roanoke commencing in 1960, Mr. Taubman was a
member of an influential group that, working behind the scenes,
peacefully integrated public facilities, and in Roanoke in 1966,
Mr. Taubman received the first Brotherhood Award of the National
Conference of Christian and Jews;
WHEREAS, Mr. Taubman was also a founding member of the Roanoke
Symphony and the predecessor agency of United Way and served as
State President of B'nai B'rith and Roanoke Valley Chairman of the
United Jewish Appeal; and
WHEREAS, City Council desires to take special note of the
passing of Arthur Taubman, successful businessman, humanitarian,
civic leader and philanthropist;
THEREFORE, BE IT RESOLVED by the Council of the City of
Roanoke as follows:
1. City Council adopts this means of recording its deepest
regrets at the passing of Arthur Taubman and extends to Mrs. Grace
Ann Weber Taubman, his widow, and their children, Nicholas Taubman
of Roanoke and Stephanie Low of New York City, the sympathy of this
Council and that of the citizens of this City.
2. The City Clerk is directed to forward an attested copy of
this resolution to Mrs. Taubman and the surviving children.
