JENNINGS, as Employee Of The Year in the Public Works directorate. WHEREAS, the Director of Public Works has instituted a program to recognize the services and contributions of one of the directorate's employees by designating an Employee Of The Year; WHEREAS, David H. Jennings is a Crew Leader in the Recreation/Grounds Maintenance Department and has been employed by the City on a permanent basis since August 1, 1978; WHEREAS, Mr. Jennings is assigned to the Central Business District which includes the Market and First Union Tower Building area; WHEREAS, Mr. Jennings is and has always been a very conscientious employee, and most recently initiated an informal program with farmers and merchants in the Market and First Union Tower Building area whereby special needs are met for the events and holidays that take place in this area; WHEREAS, Mr. Jennings has not used any sick leave since August 1989 and is commended for his attendance; WHEREAS, Mr. Jennings is considered an asset to his department, the merchants, visitors and customers of the Central Business District; and WHEREAS, Mr. Jennings has been selected as the Public Works directorate's Employee Of The Year for 1993-94. THEREFORE, BE IT RESOLVED by the Council of the City of Roanoke that this Council adopts this means of recognizing and commending the excellent service rendered to the City by DAVID H. UNIT BICYCLE PATROL The Roanoke City Police Department Community Oriented Policing E~fort began its Bicycle Patrol on March 01, 1994. The three officer Bicycle Patrol provides highly maneuverable, speedy, and discreet police response, and increased public perception of police presence in the neighborhoods they patrol and in public housing areas. Bicycle patrols are highly maneuverable as bicycle officers can ride through narrow passageways, jump street curbs and gutters, climb or descend stairs, and mount or dismount with minimal difficulty. Bicycle patrols offer fast response times to crimes in progress in housing areas. They are often minutes quicker that officers on foot or motor vehicle patrol. Bicycle patrols are discrete since mountain bikes are motorless and largely noiseless, which allows officers to approach much closer to suspected crime areas. Bicycle patrols are a big hit with residents. Local youths also find the officers easy to talk to and more approachable. All of these factors combine to make bicycle patrols an innovative and useful law enforcement tool in public housing and neighborhood settings. Police officers on bicycles are able to approach crime scenes from more strategic angles, more swiftly, quietly and less noticeably than their uniformed colleagues. By arriving earlier to the crime scene, bicycle patrol officers freeze the situation earlier, stopping the flight of criminal suspects, and enabling better identification of suspects involved. Beyond the crime enforcement value, bicycle patrols have created unexpected positive public relations benefits improving relations between the bicycle officers, residents and youths. Early indications from this new concept shows many early success stories. The improved police relations with residents an~ youth within the neighborhoods they patrol is a major success. More people are willing to talk with bicycle patrol officers than the uniformed patrol motor vehicle officers insulated behind steel and glass. This fact is readily observable on the bicycle officers daily patrols. With the increased mobility and silent capability of the bicycles, officers have noticed an increase in "on-view" arrest. ROANOKE CITY POLICE DEPARTMENT C.O.P.E- UNIT BICYCLE PATROL The ~dvantages of the use of police mountain bicycles in the C.~.P.E. Unit are many. Officers have noticed quicker response times, bikes can go more places than a car or van, arrest by officers have increased, surveillance and drug enforcement along with other criminal investigations are found to be easier; ride- and-bust are possible; bicycle patrols are quieter and come upon more crimes in progress; bike patrols can freeze situations quicker than regular motor patrols enabling safer and more controlled operations; and, kids can relate to bicycle officers better (kids ask more questions, kids love bikes, kids like the officers uniforms, kids are more apt to approach a bike officer than a motor vehicle officer). These advantages as well as many more have been experienced by cur bicycle patrol officers. We have found the use of bicycles to be very beneficial to all aspects cf our daily patrol. I. Background: The (RRHA) administers a variety of CDBG funded programs including projects associated with the Gainsboro Conservation/Redevelopment Plan. A Contract for Services with the RRHA for the administration of these activities in the current fiscal year was approved by City Council on September 13, 1993, by resolution No. 31689-091393 and City Council has approved Amendment 1 to this contract on February 22, 1994, by resolution No. 31870-022294. C. A program addressed in the current contract is the Gainsboro Enhancement Pro~ect II To assist the City with a project to relocate the residential structures currently located at 42 and 56 Wells Avenue behind the Hotel Roanoke to a nearby street prior to the realignment of Wells Avenue. This activity includes acquiring nearby sites, removing asbestos, physically relocating the structures, and other related activities. This project was originally recommended by the Roanoke City Planning Commission as part of the Commission's review of the Wells Avenue Redevelopment Project and has neighborhood support. II. Current Situation: ae Bids for the relocation of the two structures located at 42 and 56 Wells Avenue were opened by the RRHA on March 24th. One bid was received. The RRHA staff negotiated the contract bid to a lump sum of $130,000. Additional funds in the amount of $17,000 are needed by the RRHA in order to execute the contract to relocate the structures located at 42 and 56 Wells Avenue, N.E. prior to May 31, 1994. Program income which will be returned to the city will be generated by the sale of these two structures after relocation. C. An amendment to the CDBG Contract with the RRHA is necessary to increase the RRHA budget for the Gainsboro Enhancement II from $152,400 to $169,400 for site III. IV. preparation and relocation costs for the structures currently located at 42 and 56 Wells Avenue. Issues A. Cost to the City B. Fundin9 C. Timing D. Timing is important. The Gainsboro Enhancement II Project must be completed prior to the realignment of Wells Avenue scheduled to begin May 31, 1994. Compliance with applicable regulations is assured through contract review and project monitoring by the City's Office of Grants Compliance. Do not authorize the City Manager to execute the CDBG contract amendment with the RRHA and to transfer the needed funds. 1. Cost to the City will be the cost of the demolition of these two structures. Funding would not be expended on relocation, but on demolition. This would not generate program income to be returned to the city. Timing could be adversely affected. The project would not be completed by May 31st. This would affect the Virginia Department of Transportation's ability to complete the Wells Avenue Project within the March 1995 time frame. Section 20-28, Same - tax imposed~ of the Code of the City of Roanoke (1979), as amended, is hereby amended and reordained to read and provide as follows: Sec. 20-28 Same - tax imposed (o) Notwithstanding the provisions above, upon receipt of an application on a form prescribed by the commissioner of revenue and receipt of written evidence from (i) one of the armed forces that an applicant for the annual motor vehicle license was a prisoner of war and was honorably discharged, if not currently a member of the armed forces, or (ii) Roanoke Emergency Medical Services, Inc. or any successor organization that an applicant for an annual motor vehicle license is a member of such organization who regularly responds to calls or regularly performs other duties for such organization in accordance with regulations prescribed by the City Manager, the annual motor vehicle license shall be issued with no tax being assessed. Issuance of such free license shall be limited to passenger vehicles and pickup or panel trucks as defined in section 46.2-100, Code of Virginia. No individual shall be issued a free license under this subsection for more than one vehicle. In the case of an emergency medical services volunteer, the required application and information shall be provided to the commissioner of revenue not later than February 15th of each calendar year, and such exemption shall apply only to the applicant's motor vehicle which is regularly used by such volunteer to respond to calls. Any person who is not a person described in this subsection and who willfully and falsely represents himself as having the qualifications to obtain the free annual license shall be guilty of a traffic infraction punishable by a fine of not more that one hundred dollars ($100.00). 2. Section 32-104, Levied~ rated of the Code of the City of Roanoke is hereby amended and reordained by the addition of the following new subsection: Sec. 32.107, Levied; rate (b)(7) Notwithstanding the provisions above, upon receipt of an application on a form prescribed by the commissioner of revenue and receipt of written evidence from Roanoke Emergency Medical Services, Inc., or any successor organization that an applicant for exemption is a member of such organization who regularly responds to calls or regularly performs other duties for such organization, in accordance with regulations prescribed by the City Manager, the personal property tax on one motor vehicle which is regularly used by such volunteer to respond to calls shall be exempt from taxation. Any individual who qualifies for waiver of fees or taxes under the provisions of this ordinance and who has paid such fees or licenses for the 1994 calendar year, shall, upon application and proof of qualification for such waiver, receive a refund of such fees or taxes which have been paid for the 1994 calendar year. BACKGROUND Roanoke Emergency Medical Services. Inc. (REMS) was formed December 10, 19~9 when Roanoke and Williamson Road Life Saving Crews merged in a cooperative effort to strengthen the volunteer system. _Qo_S.t.~ff~ for city residents are provided through volunteer pre-hospital emergency medical providers. Recruitment and retention efforts to maintain appropriate volunteer manning levels continue to be difficult. Economic changes, increased exposure to infectious disease, violence toward EMS providers and significant training requirements result in a decline in volunteer resources statewide, the City of Roanoke being no exception. State Code 58.1-3506 Section 13 allows local governments to waive personal property tax and decal fees for volunteer EMS providers who regularly respond or perform other functions for a volunteer EMS agency. Incentives are needed to attract and retain volunteers to provide this service. Retention is a major issue as skill proficiency increases with time. II. CURRENT SITUATION REMS membership has steadily declined from 110 volunteers in 1989 to 86 in 1994. This decline in volunteer participation results in an increased cost to the city to provide this essential service. Twenty-three (23) volunteers "actively" participate and would meet requirements to receive incentives. 2. An active member is defined as follows: An individual who consistently and routinely meets the expectations of membership which consist of pulling a duty shift (12 hour shift every 6th day) and attending the monthly business and training meetings, (or) An individual who serves in an administrative volunteer position for REMS. Example: Operations Officer, President, Vice President, etc. Other localities orovide various incentives to strengthen recruitment and retention of volunteers. Examples of incentives include free vehicle decal, waiving personal property tax on one (1) vehicle per volunteer and retirement program based on years of service. Background: Bids were received by City Council at its May 2, 1994 meeting. These bids were publicly opened and read aloud for Asphalt Concrete Overlays and Pavement Profiling of Various Streets Within the City of Roanoke. Three (3) bids were received and referred to the bid committee for review and report back to Council. The iow bid, in the amount of ~1t163~168.30 was submitted by Adams Construction Company. Alternate No. 1 (raising manholes), was bid at ~49t500.00, and Alternate No. 2 (paving Civic Center parking lot) was bid at ~249~820.00, amounting to a total bid of ~1~462~488.30. City Council, at its October 1, 1979 meeting, directed the Administration to give "every consideration" to maintaining a 20-year paving cycle on City streets. The 20-year paving cycle requires that 57 lane-miles be paved each year within the City of Roanoke. (See Attachment I.) Ce Street condition investigated by Streets & Traffic Department indicates that 77 lane miles of streets are rated in the "A" category. This category includes streets which are identified as being in the greatest need of resurfacing. These determinations are based upon professional field judgement which examines the extent of various types of pavement deterioration such as cracking, rutting, and raveling. Of this, 57 lane miles were included in the work put out for bids. Civic Center Parking Lot has not been repaved since initial construction approximately 25 years ago and is cracking badly. Funding sources totaling ~1~480t000 are listed on Attachment II and would provide a contract of ~1~462.488.30 for 42~550 tons of asphalt and a ~17~511.70 contingency for replacement of vehicle detectors (wire loops embedded in the pavement surface at signalized intersections) that will be destroyed as a result of the pavement profiling needed under this paving program. The paving contract will enable the resurfacing of 57 lane miles of streets, the loop road around the City i)mbers of City Council Page 2 Nursing Home, and the Roanoke Civic Center Parking lot at prices contained tn the iow bid shown on Attachment III. One of the funding sources is the Fiscal Year 1994-95 Paving Program monies tn the amount of ~650t000. Therefore, the proposed contract ts based upon funds included in the Fiscal Year 1994-95 budget adopted on May 9, 1994. However, contract expenditures prior to June 30, 1994, can be pa~d from the currently available FY 93-94 funds· II. Issues: A. Background: Pu _rpose of the rezoning request is to place the existing florist shop into a conforming zoning district classification and to provide for the establishment of a video rental store or other appropriate activity. Ms. Dorsey presented the staff report and recommendation. She informed the Commission that the property was developed under the provisions of the 1966 zoning ordinance and until the adoption of the current (1987) zoning ordinance, the use of this industrially zoned property for commercial purposes was permitted. She further stated that the current ordinance does not provide for the expansion of non-conforming uses and that rezoning the property to a commercial district would be in keeping with the current land use of the property and development of the general area. Issues: Zoning of the subject property is LM, Light Manufacturing District. The surrounding zoning pattern in the area is as follows: to the north, east and west is LM, Light Manufacturing District and to the south, across Brandon Avenue, is C-2, General Commercial District (Towers Shopping Center). Land use of the subject property is currently a florist shop with vacant tenant space in the western portion of the building. Surrounding land uses are as follows: to the immediate north and east, are vacant, undeveloped lots; to the west is a mixture of highway oriented commercial uses, such as a service station, a dry cleaners, and two fast food restaurants; to the south is Towers Shopping Center with a variety of service and retail commercial uses. Access to the subject property is easily provided from the adjoining public street, Brandon Avenue. No traffic impacts axe anticipated from the continued use and proposed use of a portion of the property for commercial purposes. Utilities are existing and of adequate capacity to accommodate the existing as well the proposed use of the building. No further development of the subject property is proposed. E. No neighborhood organization exists for this area. F. Comprehensive Plan recommends that: Commercial development be carefully evaluated to ensure minimal conflict with residential areas and to promote good land use. III. Alternatives: A. City. Council amir.ye the rezoning request. Zoning of the subject property would become C-2, General Commercial District. The existing florist shop operation would become legal, conforming and the proposed use of the vacant portion of the building for general commercial purposes would be allowed to occur. 2. Utilities are available and of sufficient capacity to continue to serve the existing as well as any future commercial activity on the property. Access to the property is easily provided by the adjoining public street, Brandon Avenue. No additional off-street parking area or alteration to the site is proposed at this time. No residential neighborhood would be affected by the rezoning of this property. Since the property was originally developed under the previous zoning ordinance (1966) for commercial purposes, there would be no impacts on any adjoining commercial or industrially zoned properties by the placing of this property into a conforming zoning classification. 6. Comprehensive Plan issue as set forth would be followed. B. City_ Council deny the rezoning request. Zoning of the property would remain LM, Light Manufacturing District and the use of the property as a florist shop would be allowed to continue as a non-conforming use. No additional commercial establishments would be allowed to occupy the vacant portion of the building on the property and any change of use from the existing florist shop to some other similar retail/service use would require a special exception permit to be granted by the Roanoke City Board of Zoning Appeals. Land use would remain a commercial building currently housing a retail florist shop with vacant tenant space available for any use that is permitted by right or through special exception permit in the LM, Light Manufacturing District. 3. Access would not be an issue. Neighborhood would remain unchanged and the existing florist shop or any other similar commercial establishment approved by the Board of Zoning Appeals, would be allowed to operate in accordance with the zoning ordinance provisions governing non-conforming uses and structures. 5. Recommendation: The Planning Commission, by a vote of 6-0 (Mrs. Duerk absent for the vote) recommended approval of the requested rezoning finding that the request is a logical extension of the adjoining commercial district located to the south of the property and that given the original and current use of the property, coupled with the physical constraints of the site (size, shape and location of lot), the property is more suitable for commercial development than for light industrial purposes. I. Backeround: Public alley as reo_uested for closure is shown on City appraisal map//241 as situated in block 21, Map of Runnymeade Corporation. Alley extends between 27th and 30th Streets for a distance of approximately 880 feet. Alley is undeveloped and has never been used as a secondary means of access to abutting properties. Portion of alley ri~,ht-of-way abutting lots 15 through 18 and 31 through 34 is currently fenced and is being used by the applicant for private access, loading and parking purposes. Aoolicant recently purchased lots 31 through 34 from the Roanoke Redevelopment and Housing Authority (RRHA). The need to close the entire length of the alley was discussed at that time. RRItA, as a result, agreed to pay the cost of having a required subdivision plat prepared and recorded in order to effect total closure of the alley. II. Current Situation: Auulication requesting the closure of a portion (209 feet) of the subject alley was received by the Secretary to the Planning Commission on February 25, 1994. City staff contacted applicant's counsel and requested that the application be amended to include the closure of the remainder of the alley right-of-way. Amended petition was filed on March 18, 1994. Mr. Terry further stated that even though the RRI-IA had agreed to pay for the subject subdivision plat, in his opinion there was no state or City requirement for the recording of a subdivision plat. Roanoke Gas Company also has a facility in this alley fight-of-way. Creation of a dead-end alley. Applicant has requested closure of the entire length of the alley. State law provides that in general, upon the vacation of a street or alley, title to the land within such street or alley reverts or vests to its centerline or otherwise, in the owners of the respective abutting properties. Official closure and vacation of the alley will change the legal status of the land within the alley from a publicly-owned right-of- way to a privately-owned parcel of land. Land within the subject alley will subsequently be divided between the applicant and the RRI-IA. Acquiring title to the land will not be legally sufficient to establish a new division line. City subdivision ordinance in Section 31-6(a), provides that "no person shall divide or subdivide, or cause a subdivision to be made, by deed or map, of any tract of land within the corporate limits of the City as the same may, from time to time, be established according to law, except in conformity with the provisions of this chapter." Subdivision plat should be required by the City as a means of providing for the appropriate and necessary disposition of the land within the vacated fight-of-way and the legal establishment of new property lines. Relationship to the com~)rehensive plan. The applicant's request is consistent with the intent of the comprehensive plan that available land should be used in the most appropriate manner. Abutting land owners can utilize the land within the alley right-of- way in a more efficient manner. B. Deny the applicant's request to close and vacate the subject alley. 1. Community impact. a. Applicant will be unable to use the land within the alley right-of- way in connection with the future use of his business enterprise. b. Alley will remain as an unproductive and undeveloped strip of land between any future enterprises that may develop in this block. 2. Traffic impact. Denial will have no impact on the issue of traffic. 3. Utilities within the right-of-way. Denial will have no impact on existing utilities. 4. Creation of a dead-end alley will not be an issue. 5. Land use. Denial would be inconsistent with sound planning practices and principles on land use. 6. Relationshin to the comprehensive ulan. Denial would be inconsistent with the intent of the comprehensive plan. Allowing the alley to remain in a useless and unproductive state would be contrary to the intent of the comprehensive plan. Recommendation: Planning Commission, by a vote of 6-0, recommends that City Council approve Alternative "A" thereby approving the applicant's request to close and permanently vacate the alley, subject to the following conditions: A. The applicant shall submit to the City for its review and approval, receive approval of, and record in the offico of the Roanoke City Circuit Court, a subdivision plat, providing for the following: 1. The disposition of the land within the right-of-way to be vacated, in a manner consistent with the requirements of Chapter 31, Subdivisions, of the Code of the City of Roanoke (1979), as amended.
