universally as the American flag. The Pledge of Allegiance has become just as enduring a statement
about our nation as the flag it honors; it is an affirmation of our shared beliefs and national spirit.
The "Pause for the Pledge" is a call for Americans everywhere to join in reciting the Pledge of
Allegiance at 7 p.m. EDT on Flag Day. Conceived in 1980 by the National Flag Day Foundation in
Baltimore, this annual event has gained widespread support from the President and Congress, from state
and local leaders, and civic, business, service, and educational groups nationwide. The "Pause for the
Pledge of Allegiance" was made an official Flag Day ceremony by an Act of Congress in 1985.

Subject: Capital Improvement Program Development Process
I have attached for your review a document entitled "Suggested Schedule for Capital
Improvement Program" that has been prepared by the City Manager, in consultation with the City
Attorney as to legal requirements, and reviewed with me. This document details the sequence of
activities that must take place in order that City Council might (1) adopt a new capital
improvement program to be primarily funded with general obligation bonds and (2) hold a voter
referendum (special election) on the issuance of these bonds in connection with the November 8,
1994, general election. By holding the referendum on November 8th, we will commit to funding
in a timely way the necessary capital improvements approved by our citizens, and avoid the
inconvenience and expense of holding a special election on an alternate date.
This is a very inflexible, bm workable, schedule if City Council commits the necessary time
and effort to making it work. There are several state legal requirements which regulate why the
process must flow as it is described in the attachment:
Special election - voter referendum - Section 24.2-682, Code of Virginia (1950), as
amended, requires the Circuit Court to enter the order for a special election, i.e. the voter
referendum, at least 60 days prior to the election. If the referendum is to be held on
November 8th, then the order must be entered by September 8th. After the court order is
entered, the special election must still be approved by the United States Department of
Justice under the Voting Rights Act.
Also, Section 24.2-612 requires that absentee ballots in any general or special election be
delivered to the registrar at least 45 days prior to the date of the election. There must also
be some additional lead time to allow checking of ballot proofs and printing of the ballots,
so a 60 day lead time for the delivery of absentee ballots is quite likely.
Issuance of general obligation bonds - Section 15.1-171.1 requires that City Council must
hold a public hearing before adopting any ordinance authorizing the issuance of bonds.
Section 15.1-504 requires that the public hearing be advertised once a week for two
consecutive weeks prior to the date of the public hearing.
City Council's new meeting schedule requires the holding of any public hearings on the
second Monday of each month at 7:00 p.m. Unless City Council calls a special session for
the required public heating on the issuance of bonds, the only possible date for the hearing
is August 8th. The designated date for public hearings during September is September
12th, which falls after the 60-day cutoffdate for the entry of a court order by the Circuit
Court for the special election. And the designated date for public hearings in July is July
1 lth, which does not allow adequate time for the two weekly advertisements of the public
hearing at~er City Council agrees on the content of the capital improvement program and
the amount of bonds necessary to adequately fund it.
Because of the stated legal requirements, I strongly suggest to you that this schedule must
be followed very closely if City Council desires to adopt a new capital improvement program,
fund it through the issuance of general obligation bonds, and submit the issuance of such bonds to
voter approval via referendum on November 8th, 1994. City Council's active involvement in the
process would consist of the following activities on the dates indicated:
Individual introductory briefings by City staff during the week of June 27th through JuN
1st - these briefings will be approximately 2 hours in length and will be scheduled at your
convenience by the City Manager's office. These briefings will be held in the City
Manager's Conference Room.
A City Council capital improvement program development workshop with City staffon
Tuesday, July 5th, that will begin immediately following City Council's organizational
meeting at 2:00 p.m., and continue until approximately 5:00 p.m. This meeting will be
held in Room 306, Municipal North.
Adoption of a resolution endorsing the pro~ects to be included in the capital improvement
program and the amount of general obligation bonds to be submitted to voter approval at
City Council's regularly scheduled meeting on Monday, July 1 lth, at 10:00 a.m.
Participation in a public hearing on the issuance of bonds on Monday, August 8th, at 7:00
p.m. After the public hearing, City Council must adopt ordinances authorizing the
issuance of bonds and the holding of the special election to insure a November 8th, 1994
referendum.
Please review this schedule prior to the regularly scheduled meeting of City Council on
Monday, June 13th, and advise me of any concerns that you may have. It is my intention to
submit this schedule for adoption by City Council as part of the consent agenda on that date.

City Council requested the City Treasurer, Director of Finance, Commissioner
of the Revenue, and City Manager to review the feasibility of receiving real estate
taxes in installments, with more emphasis on changing the April 5 due date, and
consideration of quarterly payments on real estate taxes.
Real estate taxes are billed in two installments, due October 5 and April 5, of
each fiscal year. These payment dates were established in 1981 when the City
changed the real estate assessment year from calendar to fiscal year to coincide with
the fiscal year budget. In addition, the City also changed from quarterly to
semiannual real estate tax payments. Various factors were considered when these
changes were put into effect. Under the quarterly payment system property owners
were mailed an annual tax bill. Property owners that pay directly to the City
Treasurer, rather than through escrow companies, had to remember to make their
quarterly payments. The City believed that customer service would be improved if
the property owners were mailed a bill when taxes were due. Processing and
mailing approximately 42,000 tax bills involves considerable administrative effort and
approximately $10,000 in postage for each mailing. Taking this into account, City
Council concurred that two installments were preferable.
The following factors were considered when establishing the payment dates:
Periods of heavy cash outflow for property owners, e.g., vacations,
beginning of school year, Christmas, other tax due dates;
Property owners typically receive tax refunds from state and federal
returns that may be used to help pay other taxes; and
Cash flow needs of the City.
There are in excess of 42,000 parcels of real estate in the City of Roanoke.
The taxes on 40% of these parcels are paid by escrow companies that receive
monthly payments from property owners. The remaining 60% of parcels are paid

directly to the Treasurer by the property owner. There are approximately 25 property
owners who now make partial payments on their real estate taxes to the City
Treasurer. The Treasurer will accept partial advance payments from any property
owner who would like to do so.
The Committee recommends that all taxpayers be informed with their initial FY
1994-95 tax bill that they may make advance installment payments on their taxes.
(Copy attached as Exhibit I). This method allows taxpayers even more flexibility to
help accommodate their budgets. The Committee recognizes that some citizens who
do not make monthly mortgage and escrow payments may need the opportunity to
make advance partial payments of their real estate taxes as opposed to two
payments per year. Citizens will be informed of the availability of this service with a
notice to be included with the original real estate tax ticket mailing in August, 1994.
The Committee recommends that April 5 is an appropriate due date for the
second installment of real estate taxes. The April 5 due date was established to
allow reasonable time after the holiday season yet before the personal property due
date. State and Federal Tax deadlines that fall near this due date were also taken
into consideration. A majority of homeowners receive refunds from their state and
federal returns and have the option to increase payroll tax deductions or increase
quarterly tax payments. It is very difficult to identify dates within the calendar year
that do not coincide with other potential payment dates for the typical property owner.
The Committee further reiterates that by allowing citizens the ability to make partial
advance payments on their real estate taxes affords them a greater degree of
flexibility. Attempting to establish more due dates/deadlines creates more "conflict
resolution" situations for our citizens

I. Backqround
The Commonwealth's Attorney has the responsibility to
institute proceedings for the collection and satisfaction
of judgements issued in Courts of the Commonwealth.
§§19.2-348 & 19.2-349 Code of Virginia. To enhance
collection efforts, Sl-26 of Chapter 994 of the 1993 Acts
of Assembly authorizes the Commonwealth's Attorney and
the Locality to enter into a contractual agreement with
the Court system to establish and fund formal collection
programs.
The fundinq of the proqram is from costs collected and
the Locality shares on a 50-50 basis any revenue above
expenses with the State. No local funds are required for
the program.
By letter dated April 25, 1994, Robert N. Baldwin,
Executive Secretary of the Virginia Supreme Court, has
approved the establishment of a collection program in
Roanoke City. Copies of Donald S. Caldwell's letter
outlining the proposal and Mr. Baldwin's letter approving
same are attached for your review.

II. Current Situation

In attempting to collect judgements, the Commonwealth's
Attorneys office is forced to use secretarial staff to do
this duty as an additional responsibility. While the
return for this effort is very good, this situation
provides no oPPortunitY to receive fundinq to invest in
imDrovin~ the collection effort.
The Locality currently has no means to receive a portion
of state fine and costs assessed and collected.
III. Issues
Approve contract between Roanoke City General District
Court and the Roanoke City Commonwealth's Attorney for
the cost collections program.
Fundinq for the collection program will be recovered from
costs collected.
IV. Alternatives

Dear Don:
I am writing in response to your request of March 9, 1994
regarding the modification of your existing collection process.
We have reviewed the proposal submitted by your office and the
Roanoke City General District Clerk's Office. It appears this
proposal will provide enhancements to the current method of
collection. Our office will approve this proposal as long as the
conditions previously discussed and outlined below are met.
The basic procedures agreed upon by all parties are as
follows:
Collection efforts are made on 90 day and over past
due accounts: (the clerk will continue to give a
list of such accounts to the Commonwealth's Attorney
for institution of collection procedures)
Money subject to collection is received from the
defendant by the clerk's office through the existing
automated financial system;
o
The General District Court Clerk's Office determines
collection revenue received from the 90 day and over
past due accounts on a daily basis from the Receipts
to Collection Accounts Report (BU003) (State and
Local);
o
The General District Court Clerk would determine the
percentage fee for collections to be subtracted
from the local or state fines and journal voucher to
the appropriate revenue holding account.
The Management Information System Department
recommends the use of Revenue Account Code 404 -
Collection Account Receipts. These funds will be
transmitted to the Roanoke City Director of Finance
on a weekly basis.
The Clerk of the General District Court then
distributes the appropriate portion of the remaining
money collected to the State and Locality by check
using forms 270 and DC-14 to the Circuit Court as is
the current weekly closeout procedure.
The Locality pays the actual expenses of the
Commonwealth Attorney's Collection Program from the
percentage fee received from the General District
Court and then divides the remaining funds 50/50
between the Locality and the State. The remaining
portion due the State is remitted to the Circuit
Court Clerk.
Procedures are to be established to document the
actual expenses incurred by the Commonwealth
Attorney's Office for submission to the City of
Roanoke Director of Finance.
A written contract shall be established containing
these procedures with the stipulation of termination
of the contract for any reason whatsoever by any
party to the contract.
The proposed contract shall be reviewed and approved
by the Supreme Court of Virginia, Office of the
Executive Secretary and the Office of the Auditor of
Public Accounts.
10.
Once review and approval has been received, the
contract shall be signed by the Roanoke City
Commonwealth Attorney, the Clerk of the City of
Roanoke General District Court, and the Director of
Finance for the City of Roanoke.

In anticipation of our meeting scheduled for March 30, 1994,
I thought I would write a letter to apprise you of the nature of
our idea and provide you an opportunity to consider it because I
truly believe that, if afforded the opportunity to try this idea,
it can be shown to be a more effective, cost-efficient way for a
governmental unit to collect court costs. The hurdle is to be
given the opportunity to prove this by deviating from the procedure
suggested by the Auditor.
In reviewing the following information, please bear in mind
that this proposal has been reviewed by and is acceptable to the
Roanoke City General District Clerk's Office. As you may know,
these two offices have and do work well together and have collected
a significant amount of money by cooperation and innovation.
In essence, the proposal is to establish a collection program
which mirrors the current collection practices of private and
governmental collection programs except that the Clerk of the
General District Court would actually (1) receive the money paid
into the court and (2) determine and pay over the appropriate
percentage of state and local money to the locality collection
fund.

The General District Court Clerks Office and this Office feel
that the merit of this proposal lies in the fact that:
(1) it incorporates an existing asset to receipt the
money collected (the clerk's office as opposed to
the hiring of additional personnel by a collection
agency) with minimal additional workload for the
Clerk's staff;
(2) upon receipt of the money it allows the Clerk to
immediately provide the debtor with a receipt and
Operator's License Reinstatement Form (DC-30)
without any delay;
(3) it provides the State a clear audit trail;
(4) it eliminates the possibility of embezzlement or
fraud beyond the clerk's office;
(5) it eliminates the necessity to bond additional
personnel to handle money;
(6) it provides a simple method to determine total
dollar amounts collected as well as the percentage
to go to the locality collection fund by
utilization of the existing Court's computer based
financial system; and
(7) it avoi'ds governmental waste of resources by
eliminating unnecessary duplication of accounting
work.
The basic procedure can be outlined as follows:
(1) Collection efforts are made on 90 day and over past
due accounts; (the clerk will continue to give a
list of such accounts to the Commonwealth's
Attorney for institution of collection procedures)

This contract, made and entered into this day of

Roanoke City General District Court, the Commonwealth's Attorney
for the City of Roanoke, and the City of Roanoke provides as
follows:
1. PURPOSE: The purpose of this contract is to outline the
proper proceedings to be instituted for the collection and
satisfaction of delinquent accounts and interest thereon subject to
collection by the Commonwealth's Attorney. Court-ordered payment
of restitution to the victims of crimes and monies collected by the
Department of Taxation under the Set-Off Debt Collection Act are
excluded from the terms of this contract.
2. EFFORTS: The Commonwealth's Attorney shall make
reasonable and diligent efforts by lawful means to collect all
delinquent accounts.
3. ASSIGNMENT OF CONTRACT: This contract shall not be
assignable by the Commonwealth,s Attorney, in whole or in part.
However, private legal counsel may be retained for the assistance
of collection efforts on individual cases when the debtor is
located in a jurisdiction outside the City of Roanoke if, in the
opinion of the Commonwealth,s Attorney, this would be cost
effective. Such a subcontract must be reduced in writing by the
Commonwealth,s Attorney. Any legal counsel retained in such a case
must be located in the state in which the debtor is found and be
subject to the rules and regulations promulgated by the Executive
Secretary of the Supreme Court of Virginia, the Auditor of Public
Accounts, and the Attorney General. This provision does not
prohibit the use of other lawyers or nonlawyer staff in the
Commonwealth's Attorney office.
4. AMENDMENTS: This contract is subject to amendment at any
time by provisions approved by the parties, the Office of the
Attorney General and the Office of the Executive Secretary of the
Supreme Court upon reasonable notice. Further, the parties
understand that there may be legislative changes which may
necessitate alteration of this contract.
If any such alteration is unacceptable, any party to the
contract may terminate the contract as provided in paragraph 6 of
this contract.
5. ADHERENCE: The Commonwealth's Attorney covenants that he
will at all times abide by current guidelines then in force and
effect as they are agreed upon, promulgated and/or amended by the
Office of the Attorney General and the Office of the Executive
Secretary of the Supreme Court.
6. TERMINATIONS: The parties to this contract have the
right to terminate this contract upon six months notice for any
reason whatsoever.
8. FUNDING AND DISBURSEMENT: The Commonwealth's Attorney
Cost Collection Unit shall be funded from a percentage of the money
collected, such percentage herein after referred to as the
"collection fee". This collection fee shall be 35% of the
delinquent accounts collected by the Commonwealth's Attorney Cost
Collection Unit and paid to the General District Court Clerk
pursuant to paragraph 13.
9. FORM OF REFERRAL: By statute (Va. Code § § 19.2-340 and
19.2-349), all unpaid fines, costs, and penalties constitute a
judgment in favor of the Commonwealth for which "execution may
issue thereupon in the same manner as upon any other monetary
judgment." Therefore, the clerk of court will provide to the
Commonwealth's Attorney the automatically generated Listing of
Unpaid Fines & Cost report of delinquent accounts. The
Commonwealth's Attorney will not be provided the case files or
copies of the files on a routine basis.
10. REFERRAL PERIOD: All delinquent accounts shall be
transferred to the Commonwealth's Attorney until the accounts are
collected in full.
11. SETTLEMENT OF CLAIMS: The Commonwealth's Attorney has no
authority whatsoever to compromise or otherwise settle any case for
less than the amount of the judgment plus any accrued interest.
12. DEFINITION OF DELINQUENT ACCOUNT: Delinquent account is
defined as all fines, costs, forfeitures, and penalties which are
delinquent more than ninety days.
13. RECEIPT OF MONEY COLLECTED: The General District Court
Clerk's office shall receive money subject to collection through
the existing automated financial system.
14. DETERMINATION OF COLLECTION FEE: The General District
Court Clerk's office shall determine the collection fee, as defined
above, received from the delinquent accounts on a daily basis from
the Receipts and Collection Accounts report. The Clerk shall then
subtract the collection fee from the collection revenue received
and make journal vouchers to the appropriate revenue holding
account. The collection fees will be transmitted to the Roanoke
City Director of Finance on a weekly basis. The remaining
collection revenue received is distributed to the State and
Locality using the current weekly closeout procedure.
15. FUNDING OF COLLECTION PROGRAM: The collection program
established herein shall be funded using the collection fees.
Roanoke City shall pay the actual expenses with the collection fees
received from the Clerk's office. Roanoke City shall maintain
distinct records of the collection fees received and the actual
expenses of the collection program. Roanoke City shall report
annually to the Commonwealth's Attorney regarding the expenses of
the collection program and the collection fees collected, such
report shall be due no later than 45 days after the annual
accounting period. Simultaneously therewith, Roanoke City shall
divide the collection fees remaining after the payment of the
collection program~& actual expenses equally between the Locality
and the State. The portion due the State shall be remitted to the
Roanoke City Circuit Court Clerk.
16. INSPECTION AND RETENTION OF RECORDS: The Commonwealth's
Attorney expressly agrees to allow inspection and audit at any time
by the Auditor of Public Accounts of all records and files
pertaining to accounts referred under this contract. The
Commonwealth's Attorney further expressly agrees to retain the
records of transactions under this contract for a period of no less
than five years.
17. CIVIL LIABILITY:

18. APPLICABLE LAW AND COURTS: This contract shall be
governed in all respects by the laws of the Commonwealth of
Virginia and any litigation with respect thereto shall be brought

shall comply with any applicable federal, state and local laws and
regulations.
19. POSTAGE METER, ETC.: The Commonwealth's Attorney Cost
Collection Unit will provide a postage meter, to be located in the
Clerk's office, adequate for use by the Clerk, for all Court
mailings as well as for the Collection Unit's mailings. Provision
may also be made for other court expenses related to this contract.
20. OBLIGATION OF CLERK: The Clerk shall have no obligation
to provide services to the Collection Unit not specifically
required by this contract. The Collection Unit staff shall have
access to the Clerk's records to obtain information in addition to
that provided by the Clerk.
As used in this contract:
--"Accounts" means all individual listing of unpaid
fines, costs, penalties, and interest provided by the
court.
--"Forms" means official forms approved by the office of
the Attorney General and the Supreme Court of Virginia
and printed by the Office of the Executive Secretary of
the Supreme Court of Virginia;
--"Instructions" means the printed official directions
for completing and distributing official forms. These
instructions will be printed by the office of the
Executive Secretary of the Supreme Court of Virginia and
distributed through the Clerk.
--"Clerk" means the Clerk of the General District Court
for the city of Roanoke and his staff.

Dear Members of Council:
As the result of official School Board action at its June 7, 1994 meeting, the Board
respectfully requests City Council to appropriate funds to the following school grants:
Grant No. 6236 - $158,000.00 for the 1994-95 Chapter II program to provide funds for
the improvement of instructional services in the school district. The program will be reimbursed
by federal funds in the amount orS114,361.00 with a local match of $43,639.00.
Grant No. 6304 - $876,795.00 for the 1994-95 Governor's School program to provide
instruction in science and math to high school students. The program will be supported by state
funds in the amount of $340,955.00, a local match of $304,040.00, and $231,800.00 from tuition
collected from participating school districts.
Grant No. 6305 - $141,978.00 for the 1994-95 Family ERA program to provide for a
family-school partnership to promote family education and student readiness and achievement.
The program is one hundred percent reimbursed by federal funds.
Grant No. 6445 - $76,763.00 for the 1994 Summer Youth Employment program
to provide training and hands-on experience for building trades students. The program will be
one hundred percent reimbursed by federal funds.
Grant No. 6511 - $37,432.00 for the 1993-94 Flow Through program to provide aid for
the education and guidance of handicapped students. The program will be reimbursed one
hundred percent by state and federal funds.
Grant No. 6520 - $860,000.00 for the 1994-95 Flow Through program to provide aid for
the education and guidance of handicapped students. The program will be one hundred percent
reimbursed by state and federal funds.

Grant No. 6767 - $119,970.00 for the 1994-95 Adult Basic Education program to provide
funds for the education of adults who have not completed high school. The program will be
reimbursed by federal funds in the amount of $97,370.00 with a local match of $22,600.00
Grant No. 6768 - $167,567.00 for the 1994-95 Apprenticeship program to provide
on-the-job and classroom vocational instruction for students in the apprenticeship program.
Revenue will be provided by state funds and fees paid by participants.
Grant No. 6769 - $318,535.00 for the 1994-95 Perkins Act program to provide funds for
vocational instructors and equipment. The program will be one hundred percent reimbursed by
federal funds.

Subject: 30-inch Sewage Line Leak within Basement Wall
Approximately six (6) months ago we repaired a 90 foot run
of 48 inch sewer pipe as it passed underground and passed through
two (2) structural wall sections.
Last week, another line, namely a 30-inch cast iron raw
sewage pump discharge line began leaking within a basement wall
section. Repairs to this line will entail cutting out a section
of the line outside the wall, installing a blind flange, applying
plastic coating to the damaged section, then installing a spool
piece section to put the pump and line back in service. This
work has been initiated under the emergency work provisions of
the City Code due to the possibility of this section of line
completely failing (rupturing) rather than just leaking.
Estimated repair cost is $20,000-$25,000. A detail report
will be provided to Council after repairs are made.

AN ORDINANCE amending the Code of the City of Roanoke (1979),
as amended, by enacting new S30-9.1, Sidewalk obstructions, to
delegate to the City Manager the authority to issue permits for
movable sidewalk obstructions under certain terms and conditions;
and providing for an emergency.
BE IT ORDAINED by the Council of the City of Roanoke
follows:
as
§30-9.1. Sidewalk obstructions.
The city manager shall be authorized to issue permits
to authorize placement of tables and chairs upon
designated portions of sidewalks in the public right-of-
way of any area of the city zoned C-3, Central Business
District. Such permits may be issued to the owner or
owners, or lessee or lessees, of the property contiguous
to the sidewalk area designated for such tables and
chairs on the following terms and conditions:
(1) Such permits shall be revocable at the pleasure of
the city manager. Upon revocation of a permit and notice
to the permittee, the city manager shall be authorized to
remove any such tables and chairs previously permitted to
remain in the public right-of-way and dispose of the
same.
(2) The issuance of such permits shall be conditioned
upon the permittee's agreement to indemnify and hold
harmless the City, its officers, employees and agents,
from all claims, demands, damages, actions, causes of
action, or suits of any kind whatsoever, either at law or
in equity, including any claim for court costs or
attorney fees, for theft, damage to property, injury to

person, or death, arising out of the construction,
maintenance, operation or removal, of any such
obstruction.
(3) The issuance of such permits shall be conditioned
upon the permittee's, or their grantee's or successor's
in interest, maintaining general public liability
insurance, naming the City, ~ts officers, employees and
agents, as additional insureds with respect to the
construction, maintenance, operation, or removal, of any
such obstruction in such policy limits as the City's risk
manager shall deem appropriate.
(4) Application for all of such permits shall be made on
forms provided by the City and shall be approved as to
form by the city attorney.
(5) The city manager may promulgate additional terms or
conditions applicable to any or all of such permits
issued.
(6) Upon the issuance of any permit under this section,
the city manager shall specifically designate the portion
or portions of public sidewalk upon which tables and
chairs may be placed.
(7) Nothing contained in this section shall be construed
to relieve any permittee, or his grantee or successors in
interest, from liability for any negligence or
recklessness with respect to the placement or maintenance
of tables and chairs or any other exercise of the
privileges authorized by such permit.
2. In order to provide for the usual daily operation of the
municipal government, an emergency is deemed to exist, and this
ordinance shall be in full force and effect upon its passage.

Subject: Sidewalk Cafe's
I. Background:
Chapter 30~ Streets & Sidewalks, of the Code of the
City of Roanoke, includes provision regulating
obstructions to the public streets, alleys, sidewalks,
and gutters of the City.
Sidewalk sales are permitted in the Downtown Service
District under limited circumstances approved by City
Council in 1989.
II. Current Situation:
Downtown Roanoke~ Inc. (DRI), on behalf of downtown
restaurateurs, has requested permission from the City
to allow sidewalk tables and chairs on which to serve
food and beverages (non-alcoholic).
B. Key provisions of the request include the following:
1. Applications would be made through DRI.
Tables and chairs would be located in an area
extending no more than three feet (3 ft.) from
adjoining restaurants, and leave no less than
three feet (3 ft.) of unobstructed area for
pedestrians.
3. Furniture design would be approved by DRI.
At the end of the business day, all sidewalk
furniture would be removed from the public
sidewalk or securely chained to the adjoining
building.

5. No alcoholic beverages would be served.
III. Issues:
Trash would be frequently monitored and removed
from the area.

We
City Council authorize the City Manager to permit
sidewalk tables and chairs in the Downtown Service
District under guidelines to protect the City's image
and public safety (as set forth in Section V).
Economic Development will be enhanced as downtown
Roanoke becomes an even more inviting location for
tourists, visitors, and daily patrons.
Public Liability is protected through the
requirement for insurance to be provided by any
restaurateur desiring to locate tables and chairs
on public sidewalks adjoining their establishment.
City Council not authorize the City Manager to permit
sidewalk tables and chairs in the Downtown Service
District under guidelines to protect the City's image
and public safety.
Economic Development opportunity may be missed due
to the additional commercial activity which might
otherwise be stimulated by the atmosphere of
sidewalk cafe's.
2. Public Liability will be moot.
Recommendation:
City Council approve Alternative "A~" thereby authorizing
the City Manager to permit the location of tables and chairs
adjoining restaurants in the Downtown Service District under
the following terms and conditions:
the entire area occupied by such street furniture may
.extend no further than three (3) feet from the
adjoining building and in no case shall remaining
unobstructed sidewalk width be less than five (5) feet

between such furniture and any other permanent sidewalk
amenity such as street trees, trash receptacles,
benches, street light standards, or traffic control
devices
all sidewalk furniture must be removed from the public
right-of-way each day after business hours, or secured;
no furniture shall be anchored to the public sidewalk
City reserves the right to approve the design of all
street furniture
no alcoholic beverages shall be served or consumed on
public right-of-way
permittee shall indemnify and hold harmless the City,
its officers, agents, and employees, from any and all
claims, injuries, or damages to persons or property
which may result from the location of such street
furniture; the permittee shall present evidence of
public liability insurance in an amount established by
the City's Risk Management Officer
the permittee shall frequently monitor the area for
garbage, trash, refuse, other waste materials, and
adequate sidewalk clearance
the City Manager shall be authorized to promulgate such
other rules and procedures appropriate to implementing
such use of the public sidewalks.

The Commonwealth of Virqin]a was in the process of
finalizing their changes to the soil and erosion controls
and storm water management which went into effect January
1, 1993. Roanoke County then completed their plan review
in the first week of January and the notice to proceed to
the contractor was issued to start construction on
January 19, 1993.
There have been four (4) aDDroved chanqe orders to date
with the contract total of $13~663~569.78 and 805
consecutive calendar days.
The oriqinal contract amount, contained the sum of
$259,280.00 to cover the cost of items that would be
uncovered during the course of construction that were not
specifically addressed in the contract documents; but,
once discovered, could be replaced while the other work
was being accomplished.
II. Current Situation:
A. The following chanqes to the contract need to be
approved.

Leak repairs and other work around two 30" pipe
sleeves at the west end of the filter building. The
turbidity of the water would increase drastically
whenever it rained which had been happening for some
time (more than 6 months). It was discovered that
the concrete wall around these pipe sleeves had
cracked and was letting ground water infiltrate into
the effluent channel at the filters. This meant
uncovering the west end of the filter building to
make the required repairs.
Cost of repairs:
$ 17~625.00
Because of the regulations of the Health Department,
this work has already been completed.
Replace four (4) 20" valves at the existing Aeration
Basins. $ 17~784.12
These valves were not scheduled to be replaced. One
of the valves stuck in the open position and the
flow of water to the basin could not be controlled.
We discovered that the part required to repair the
valve can not be purchased because the valve is
obsolete (1945 Vintage).
Additional 16" butterfly valve at the new backwash
water storage reservoir. $ 5~000.00
The original backwash reservoir and the new
reservoir are side by side and connected with a 16"
ductile iron pipe. However, no valve was provided
in the connecting piping. To isolate either tank,
for any purpose, requires that the valve be
installed.
4. Continuous chlorine residual monitorinq system:
$ 29r250.22
This is required by a new regulation that you must
monitor the water continuously for chlorine residual
before it goes into the delivery system. The price
includes a house to protect the monitoring
equipment, controls, piping, etc.

5. Place aluminum toe boards on existing walkways at
basin handrails: $ 15,110.21
This is also a new requirement to keep operators or
visitors from kicking debris into the treatment
basins.
TOTAL OF CHANGES:
$ 84,769.55
NO ADDITIONAL TIME OF CONSTRUCTION IS REQUIRED.
Ail proposed change order item prices have been reviewed by
the design team and have been approved as being within range
of anticipated costs; see letter attached.

to remodel a plant built in 1945 and added to in
1954 it was anticipated that items would be
encountered during the time of construction that
would have to be repaired or replaced and therefore
a sum was included in the contract price for such
repair/replacement.

Reject the issuance of Change Order No. 5 and do not
authorize the additional work as described above.
Enqineerinq concerns would not be met in a timely
fashion. Most of what is proposed will either have
to be done now or in the near future. It is more
prudent to perform the work now than to interrupt
the plant operation again with another contractor.
To date there has not been a service interruption
caused by the construction.
Fundinq would not be encumbered for the additional
work. The lump sum total in the original bid would
remain the same.
3. Time of completion would remain the same.
Recommendation is that City Council take the following
action:
A. Concur with the implementation of Alternative "A".

Authorize the City Manager to issue Change Order No. 5 to
the contract with Crowder Construction Company in the
amount of $84~769.55 and -0- consecutive calendar days
additional construction time. The total contract amount
of $13~663~569.78 would not change. The contract

A RESOLUTION supporting United States Senate Bill 1634
authorizing local governments to exercise solid waste flow control.
WHEREAS, solid waste flow control ordinances are one means by
which local governments may protect disposal revenues in order to
finance and implement solid waste management plans, thereby
assisting local governments in meeting their responsibility to
protect public health, safety and welfare; and
WHEREAS, a recent Supreme Court decision has placed the
constitutionality of local flow control measures in question; and
WHEREAS, federal legislation is needed to preserve solid waste
flow control as an option for local governments; and
WHEREAS, the City of Roanoke is a Charter Member Jurisdiction
of the Roanoke Valley Resource Authority ("Authority"), a regional
entity which has recently permitted and constructed a transfer
station, solid waste disposal facility and a rail system to
transport waste from the transfer station to the solid waste
disposal facility; and
WHEREAS, although the Authority is not currently dependent
upon flow control measures to accomplish the repayment of the
bonded indebtedness incurred to pay for its facilities, the
Authority supports preserving the option of future flow control
measures so that local government solid waste management plans can
be lawfully and effectively financed and implemented; and
WHEREAS, United States Senate Bill 1634 specifically
authorizes the use of solid waste flow control by local
governments;
THEREFORE, BE IT RESOLVED by the Council of the City of
Roanoke as follows:
1. City Council endorses United States Senate Bill 1634 and
similar legislation to be introduced in the United States House of
Representatives which specifically authorizes the use of solid
waste flow control by local governments.
2. The Clerk is directed to forward attested copies of this
resolution to the Honorable John W. Warner, United States Senator,
the Honorable Charles S. Robb, United States Senator, and the
Honorable Robert W. Goodlatte, Member, House of Representatives.

I am writing to you as Chairman of the Roanoke Valley Resource Authority to update
you on recent developments regarding flow control.
As you know, flow control ordinances are normally used by local governments to protect
disposal revenues by requiring that all solid waste generated within a particular jurisdiction be
delivered to the governmental disposal facility. You are also aware that, to date, the Charter
Member lurisdictions have not relied upon flow control measures. It is my understanding that
you are also aware of increasing private competition and disposal opacity in Virginia.
On May 16, 1994, the United States Supreme Court decided C.A. Carbone. Inc. v. Town
of Clarkstown, a case which involved a challenge to flow control measures. It is my
understanding from the Authority's legal counsel that this decision may be applied to render
current flow control measures unconstitutional. It is further my understanding that in light of this
decision, unless the United States Congress adopts legishtion specifically authorizing local flow
control, all future local government flow control measures may be considered unconstitutional
and invalid.
It is likely that lobbying efforts in Congress on flow control will intensify. The National
Association of Counties, the National League of Cities, and the Solid Waste Association of
North America are supporting $. 1634, which wonid authorize local flow control. The Authority
has previously placed our congressional representatives and the Charter Member Jurisdictions
on notice of the need for federal legislation preserving flow control as an option for local
governments.
As downward pressure on tipping fees increases, flow control may prove to be a useful
option to have available in the future. Following the Carbone decision, it may be in the
Authority's interests to consider additional efforts in support of federal flow control legislation.
On behalf of the Authority, I request that the Charter Member Jurisdictions also consider

Grant to operate an job training camp program for
youth (teens) ages 12 -15 years old.
The need for the Dro~ram was expressed during the
Teen Summit meetings of 1992 because teens felt
that there was "nothing to do" and the majority of
them were too young to get jobs.
A Summer Job Trainin~ Camp was offered during the
summer of 1993 with FOCUS funds. The goal was to
enroll 40 youth to complete the program, however,
due to a large interest, 62 youth were given the
opportunity to learn about the world of work. The
program was a great success.
The trainin~ camp provided opportunities for the
teens to learn about the world of work through
classroom training which includes but is not
limited to: role playing, speakers, career
exploration, and goal setting, etc.

Funding, in the amount of $30,342.45, was
transferred in May, 1994 from the Project FOCUS
grant to the office on Youth for the implementation
of the job training camp program.

Funds were transferred from the Project FOCUS grant

been providing job related training opportunities.

SUBJECT: Virginia Summer Food Service Program Grant Application to the U.S. Department
of Agriculture
I. BACKGROUND
The U.S. Department of A~riculture (USDA) has solicited applications from
municipalities to participate in the 1994 Virginia Summer Food Service Program.
The ~uroose of the program is to provide nutritionally balanced, healthy meals
to children, ages 1 through 18, of low-income families (less than 185% of
poverty) during the Summer months of 1994.
Cost reimbursements are made to program sponsors (City of Roanoke), by the U.
S. Department of Agriculture, at a rate of approximately $1.36 per meal
consumed by a participating eligible youth.
$15,245.00 has been allocated by City Council in the 1994-95 budget to the
Director of Human Development to support the staffing and administration of this
program.
The Virginia Summer Food Service Program is similar in concept to the National
School Lunch Program and the participants' eligibility is comparable to that used
to determine eligibility for free, or reduced price, meals during the school year.
Roanoke operated this program last year serving approximately 1,310 eligible
youth daily at thirteen feeding locations in the City. Approximately 39,000 meals
were consumed during the entire Summer.
Roanoke City Schools sponsored a similar program in 1985 and has elected to
provide food service this year.
The need for this program and potential operational plans were originally
explored and developed by a task force of the City Manager's Human
Development Steering Committee. Agencies represented included the Department
of Social Services, the Fifth District Employment and Training Consortium
(FDETC), with the assistance of City Parks and Recreation, Roanoke
Redevelopment and Housing Authority, and Total Action Against Poverty.

The U. S. Department of Agriculture is supportive of efforts by the City of
Roanoke to continue this program and has expressed its interest in providing
whatever supportive assistance necessary to accomplish the program's objectives.
II. PRESENT SITUATION
A grant application for the Virginia Summer Food Service Program has been
prepared by the Fifth District Employment and Training Consortium, on behalf
of the City of Roanoke, for consideration by the U. S. Department of Agriculture
for funding this Summer, for the period June 20 through September 2, 1994.
(Notice of the grant award is expected by June 14, 1994.
1,335 daily meals, are proposed for youths participating at these sites:
Jamestown Housing Project, Indian Village Housing Proiect, Hurt Park Housing
Project, Lincoln Terrace Housing Project, Landsdowne Housing Project,
Bluestone Housing Project, YMCA Family Center, Hunt Manor Housing Project,
YMCA (at Westside Elementary), Ruffner Middle School, and Housing Authority
off-site center - Copper Hill, Virginia (Apple Ridge Farms). It is estimated that
over 38,000 meals will be served through this project.
The eleven proposed feeding locations reflect both the success of last year's
program and the broad need existing for such a program for needy youth in the
City.
The Directorate of Human Development is proposed to administer the project
through interagency agreements with the FDETC, Office on Youth and Roanoke
Redevelopment and Housing Redevelopment and Housing Authority (RRHA); an
informal written agreement with the Depattment of Social Services, and a contract
with Roanoke City Schools to prepare and deliver the meals, daily, to the project
sites.

fifty-four (54) meal service days, between June 20 and September 2, 1994
(Monday through Friday).
F. All costs reimbursable by the U. S. Department of Agriculture are based upon the
number of meals consumed by eligible youth participants.

of this program. There will be no additional cost to the City,
since remaining expenses are reimbursable through the USDA or
budgeted through FDETC funds.
Need for Food Services in the Community - Need is wide-spread
and project will accommodate targeted efforts, to provide
nutritionally balanced meals to 1,335 needy youths, daily.
Effective and Efficient Delivery of Services - Interagency
agreements with DSS, FDETC, Office on Youth, and RRHA, and
a contract with Roanoke City Schools will promote both the
effective and efficient delivery of services, to Roanoke City
residents, whom the project is designed to assist.
Do not endorse the grant application; and
1. Do not accept grant award from the U.S. Department of Agriculture;
a. Cost to the City - No direct cost impact to the City.
b. Need for Food Services in Community - Need will continue,
without program of intervention for 1,335 youths.

I. Background
Capital Maintenance and Equipment Replacement
Proqram has identified the need to acquire an X-Ray
Inspection System to enhance court security and
Emergency Breathing Apparatus for use in the City
Jail.
Requested X-Ray Inspection System will provide a
method of inspection of hand-carried baggage,
packages and mail. The existing security devices,
walk through units, primarily detect metal objects.
The X-Ray unit will provide additional security as
it will detect weapons, narcotics, explosives and
other dangerous items through an advanced image
process. The requested unit will be used in
conjunction with existing units to provide a
maximum protection to the Courts, its officers and
citizens.
Aprilt 1994 specifications were developed and along
with request for quotations were sent to nine (9)
vendors of X-Ray Security Systems and three (3)
vendors of Emergency Breathing Apparatus. A public
advertisement was also published in the Roanoke
Times and Roanoke Tribune.
Bids were received after due and proper
advertisement and were publicly opened and read in
the Office of the Manager of General Services. Bid
tabulations are attached.
II. Current Situation
Ail bids received were evaluated by representatives
of the City Sheriff's Department and General
Services.
State contracts were reviewed. No state contract
currently exists on this type of equipment.

WHEREAS, numerous changes have been made to the Code of
Virginia (1950), as amended, regarding bingo and raffle operations
during the 1994 Session of the General Assembly;
WHEREAS, this Council desires to incorporate these changes in
the Code of the City of Roanoke (1979), as amended; and
WHEREAS, this Council desires to empower the Director of
Finance to continue to effectively administer and monitor bingo and
raffle operations;
THEREFORE,

read and provide as follows:
ARTICLE II. GAMBLING.
S21-66. Bingo qames and raffles; definitions.
The following words shall have the following
meanings:
"Bingo" means a specific game of chance played with
individual cards having randomly numbered squares ranging
from one (1) to seventy-five (75), in which prizes are
awarded on the basis of designated numbers on such cards
conforming to a predetermined pattern of numbers selected
at random. Such cards shall have five (5) vertical rows
headed respectively by the letters B.I.N.G.O., with each
row having five (5) randomly numbered squares.
"Building" means a structure located on a single lot
enclosed by a continuous exterior wall regardless of the
configuration of the interior walls.

"Calendar day" means the period of twenty-four (24)
consecutive hours commencing at 12:01 a.m. and concluding
the following 12:01 a.m.
"Calendar week" means the period of seven (7)
consecutive calendar days (as defined above) commencing
at 12:01 a.m. on Sunday and ending at 12:01 a.m. the
following Sunday.
"Instant Bingo" means a specific game of chance
played by the random selection of one or more
individually prepacked cards, with winners being
determined by the preprinted appearance of the letters
B.I.N.G.O. in any prescribed order on the reverse side of
such card.
"Jackpot" means a bingo card played as a part of a
bingo game defined in this section in which all numbers
on the card are covered, each number being selected at
random, and with no more than one free or "wild" number.
"Landlord" means any person or his agent, firm,
association, organization, partnership, or corporation,
or employee thereof, which owns and leases, or leases any
premise devoted in whole or in part to the conduct of
bingo games, and any person residing in the same
household as a landlord.
"Organization" means any one of the following:
(1)
A voluntary fire department or a voluntary rescue
squad or auxiliary unit thereof which has been
recognized by an ordinance or resolution of City
Council as being a part of the safety program of
the City;
(2) An organization operated exclusively for religious,
charitable, community or educational purposes;
(3) Association of war veterans or auxiliary units
thereof organized in the United States; or
(4) A fraternal association operating under the lodge
system.
"Raffle" means a lottery in which the prize is won
by (i) a random drawing of the name or prearranged number
of one (1) or more persons purchasing chances or (ii) a
random contest in which the winning name or preassigned
number of one or more persons purchasing chances is
determined by a race involving inanimate objects floating
on a body of water, commonly referred to as a "duck
race". However, nothing in this article shall prohibit
an organization from using the State Lottery Department's
Pick-3 number as the basis for determining the winner of

a lottery. For purposes of this definition, "raffle"
shall include determining the winner of a lottery by use
of prepackaged pull-tab devices which are devices made
completely of paper or paper products with concealed
numbers or symbols that must be exposed by the player to
determine wins or losses and may include the use of a
seal which conceals a number or symbol that has been
designated in advance as a prize winner including but not
limited to pull-tab devices commonly known as a tip
boards or seal cards.
S21-68.
Requirement of issuance of permit; where
valid; duration; permits subject to
regulations.
(a) Prior to the iSSuance of any permit, the
applicant organization shall meet each of the following
requirements:

Except for recently established volunteer fire and
rescue companies or departments, as defined in this
article, the organization shall have been in
existence and met on a regular basis in the City of
Roanoke, City of Salem, County of Roanoke or Town
of Vinton for a period of at least five years
immediately prior to applying for a permit. The
organization shall have a membership consisting of
at least fifty percent (50%) residents of the
Commonwealth and shall furnish a complete list of
its membership, identifying permanent place of
residence for each member, in order for the local
governing body to ascertain the percentage of
Virginia residents. In no case shall the
organization apply for or receive more than one
permit. However, this requirement shall not apply
(i) to any lodge or chapter of a national or
international fraternal order or a national or
international civic organization which is exempt
under S501(c)(3) of the United States Internal
Revenue Code and which has a lodge or chapter
holding a bingo permit issued in accordance with
the Code of Virginia anywhere within this
Commonwealth, or (ii) where the Director of Finance
provides for the issuance of a bingo or raffle
permit for school sponsored activities to booster
clubs which have been operating for less than five
years, and which have been established solely to
raise funds for school-sponsored activities in
public schools which are less than five years old.
A permit shall be valid only in the City and only
at the locations designated in the permit
application. However, a permit may be issued to an
organization which relocates its meeting place on a
permanent basis from one jurisdiction to another
and complies with the requirements of subsection
(1) of this section and provided further that the
organization was the holder of a valid permit at
the time of its relocation. An organization which
has obtained a permit under this article to conduct
a raffle may sell raffle tickets both in and out of
the City and may conduct its drawing either in the
jurisdiction in which a majority of the tickets
were sold or in the City, except that pull-tab
devices as defined in §21-66 used as part of a
raffle may be sold only upon the premises owned or
exclusively leased by such organization and at such
times as it is not open to the public, except to
members and their guests.
(3)
The organization shall be operating as a nonprofit
organization and shall have always been operated in
the past as a nonprofit organization and shall have
been in existence as a nonprofit organization for a
period of at least five years immediately prior to
seeking a permit as hereinafter provided.
§21-69. Frequency, duration, and conduct of bingo
qames.
(c) The sponsoring organization shall accept only
cash or, at its option, checks in payment of charges or
assessments for players to participate in bingo games or
raffles. However, no organization shall accept postdated
checks in payment of any charges or assessments for
players to participate in bingo games. No organization
or any person on the premises shall extend lines of
credit or accept any credit or debit card or other
electronic fund transfer in payment of any charges or
assessments for players to participate in bingo.
S21-70. "Instant binqo".
(d) No organization shall sell an "instant bingo"
card to any individual below eighteen years of age.

premises; records; independent accounting
procedure.

(h) Any organization which ceases to exist or
ceases its bingo or raffle operations must file all
financial reports, disclosures, and audit fee payments
within thirty (30) days of ceasing operations, and on a
quarterly basis until all its bingo or raffle funds have
been disbursed.
§21-73 Prohibited practices.
In addition to those other practices prohibited by
this article, the following acts or practices shall also
be prohibited under the provisions of this article:
(e) Except for persons employed as clerical
assistants by organizations composed of or for deaf or
blind persons, only bona fide members of any such
organization who have been members of such organization,
as reflected on the organization's list of members filed
with the Director of Finance for at least ninety days
prior to such participation, shall participate in the
management, operation or conduct of any bingo game or
raffle. Notwithstanding the foregoing, employees of
corporate sponsors of a qualified organization may
participate in the management, operation or conduct of
one raffle per year. The spouse of any such bona fide
member or a fire fighter or rescue squad member employed
by a political subdivision with which the volunteer fire
fighter or rescue squad member is associated may
participate in the operation and conduct of a bingo game
or raffle if a bona fide member is present.
(g) No landlord shall, at bingo games conducted on
the landlord's premises, (i) participate in the conduct,
management, or operation of any bingo games; (ii) sell,
lease or otherwise provide for consideration any bingo
supplies, including, but not limited to, bingo cards,
instant bingo cards, markers, or other game pieces; or
(iii) require as a condition of the lease or by contract
that a particular manufacturer, distributor or supplier
of bingo supplies or equipment be used by the
organization. If equipment or services are included by
a landlord in any lease or contract, the lease or
contract shall itemize the amount attributable to the
rent of the premises, equipment, and each service to be
provided by the landlord.

The provisions of this subsection shall not
apply to any charitable organization conducting bingo
games on their own behalf; provided, the organization
owns the premises where such bingo games are held.
(h) No person shall participate in the operation of
bingo games or pull-tab raffles for more than one
organization in any one (1) calendar year. A calendar
year shall run from January 1 through December 31.
(i) No person shall manage, operate or conduct
bingo games or raffles if, within the past five (5)
years, he has been convicted of a felony or a crime
involving moral turpitude, or has operated a bingo game
or raffle in violation of state law or local ordinance.
(j) No organization shall enter into any contract
with or otherwise employ or compensate any member of that
organization regarding the sale of bingo or raffle
supplies or equipment.
(k) No organization shall award any bingo prize
money or any merchandise valued in excess of the
following amounts: (i) no bingo door prize shall exceed
twenty-five dollars ($25.00), (ii) no regular bingo or
special bingo game shall award a prize in excess of one
hundred dollars ($100.00), (iii) no instant bingo prize
for a single card shall exceed five hundred dollars
($500.00), and (iv) no bingo jackpot of any nature
whatsoever shall exceed one thousand dollars ($1,000.00),
nor shall the total amount of bingo jackpot prizes
awarded in any one calendar day exceed one thousand
dollars ($1,000.00).
(1) Except as provided herein, no organization
shall award any raffle prize valued at more than one
hundred thousand dollars ($100,000.00). The one hundred
thousand dollar ($100,000.00) limitation shall not apply
to a raffle conducted no more than once per calendar year
by an organization qualified as a tax-exempt organization
pursuant to S501(c)(3) of the Internal Revenue Code for
a prize consisting of a lot improved by a residential
dwelling where one hundred percent (100%) of the moneys
received from such a raffle, less deductions for the fair
market value for the cost of acquisition of the land and
materials, are donated to lawful religious, charitable,
community, or educational organizations specifically
chartered or organized under the laws of the Commonwealth
and qualified as a S501(c)(3) tax-exempt organization.
The award of any prize money for any bingo or raffle
shall not be deemed to be part of any gaming contract
within the purview of ~11-14, Code of Virginia (1950), as
amended.

(m) Any bingo game in which all the gross receipts
from players for that game are paid as prize money back
to the players shall not be subject to the limitations of
subsection (j) of this section, but there shall not be
more than one (1) such game per calendar day of play and
the prize money from any such game shall not exceed one
thousand dollars ($1,000.00).
(n) No person shall participate in the management,
operation or conduct of any bingo game or raffle if,
within the preceding five years, he has been convicted of
a felony or crime of moral turpitude. Further, no person
shall participate in the management, operation or conduct
of any bingo game or raffle if that person, within the
past five years, has participated in the management,
operation, or conduct of any bingo game or raffle which
was found by a local permitting authority or by a court
of competent jurisdiction to have been operated in
violation of state law or local ordinance.
(o) No raffle shall be conducted in conjunction
with bingo sessions nor shall raffle drawings be held or
raffle tickets or chances sold at, during or between
bingo sessions.
(p) An organization using or selling bingo or
raffle supplies, including instant bingo supplies, which
have been tampered with in any way, including seals
broken on packets, or the tampering with bingo or raffle
supplies by the organization shall result in the
revocation of a permit.
(q) No prize shall be awarded to the winner of a
bingo game or raffle other than as advertised by the
organization.
2. In order to provide for the usual daily operation of the
municipal government, an emergency is deemed to exist, and this
ordinance shall be in full force and effect on and after July 1,
1994.

Changes in the Bingo and Raffle Ordinance
Numerous changes were made to the Code of Virginia regarding bingo and
raffle operations as a result of the 1994 legislative session. These changes will go
into effect on July 1,1994. The highlights of those changes are outlined as follows:
Previously certain organizations had to have been in existence and met
on a regular basis for at least two years prior to applying for a permit.
This will be changed to five years.
Organizations sponsoring bingo games may accept cash or checks as
payment for players to participate in bingo games. Language was
added to provide that postdated checks may not be accepted and that
lines of credit may not be extended. Additionally, credit or debit cards
or other electronic fund transfers may not be used as payment for
charges to participate in bingo games.
The sale of instant bingo cards to anyone below sixteen years of age is
now prohibited. The age limit will be raised to eighteen years of age.
In addition to the definitions of organization, bingo, raffle, instant bingo,
and jackpot, the definition of a landlord will be added. A landlord will be
defined as any person or his agent, firm, association, organization,
partnership, or corporation, or employee thereof, which owns and
leases, or leases any premise devoted in whole or in part to the conduct
of bingo games, and any person residing in the same household as a
landlord.
Employees of a corporate sponsor of a qualified organization will be
allowed to participate in the management, operation or conduct of one
raffle per yea~'.

6. Landlords will be prohibited from the following:
Participating in the conduct, management, or operation of any
bingo games;
Selling, leasing or otherwise providing for consideration any bingo
supplies;
Requiring as a condition of a lease that a particular manufacturer,
distributor or supplier of bingo supplies be used by the
organization.
Further, an addition to §21.71 of the Code of the City of Roanoke is
recommended concerning organizations that discontinue their raffle or bingo
operations with unspent proceeds which should be reported until all have been
properly spent. Currently, an organization with unexpended cash balances could
cease its bingo or raffle operations and they would not be required to report whether
those cash proceeds were ever spent for charitable purposes. Therefore, we
recommend a provision stating that organizations which either cease to exist or
cease their bingo or raffle operations must file reports on a quarterly basis until all
cash proceeds have been properly spent. This will allow us to monitor and to ensure
that all bingo or raffle proceeds are indeed spent for charitable purposes.
it is important that we be consistent with the Code of Virginia especially in the
matter of bingo games and raffles. In order to accomplish these changes, the
attached ordinance amends certain sections of the City Code relating to bingo and
raffle operations. Adoption of these amendments will allow us to continue to
effectively administer bingo and raffle operations in compliance with state laws.
Accordingly, I recommend to you adoption of the proposed ordinance.

SUBJECT: Closeout of Community Development Block Grant Year
(B-91-MC-51-0020)
The Community Development Block Grant program is accounted for on
the City's financial records by program year. Three years are currently appropriated.
HUD allows localities to determine the number of CDBG program years to
retain on their records. Reprogramming these funds allows the City to maintain a
minimum number of program years on its records. The earliest Community
Development Block Grant year (B-91-MC-51-0020) may be closed by reprogramming
the unspent funds in this program year to the next subsequent program year, (B-92-
MC-51-0020). These unspent funds totaling $176,024 will be used for the same
activities for which they are currently appropriated.
Recommendations:
· Transfer unspent funds of $176,024 to Community Development Block
Grant year B-92-MC-51-0020 as shown on the accompanying budget
ordinance.
· Close Community Development Block Grant year B-91-MC-51-0020.

Appropriations Transfer of Internal Service Funds Charges
The City of Roanoke's Internal Service Funds account for certain services provided
to departments of the General Fund. The service providing departments within the internal
Service Funds recover their costs by charging the receiving departments.
Budgeted funds for internal services are allocated in each fiscal year's budget
throughout the various departments based on estimated usage. Usage usually varies from
the original estimates. Each fiscal year at this time it is necessary to make appropriation
transfers between several of the departments to provide sufficient funds for internal
services for the remainder of the fiscal year. These transfers do not increase the original
overall budget, but only reallocate amounts between departments.
The attached budget ordinance will accomplish the required transfers. I recommend
it for your approval.

Transfer of Appropriations for Employee Fringe Benefits
The fiscal year 1993-94 General Fund included funds in the nondepartmental
category for payment of life insurance, termination (vacation) leave and unemployment
wages. These types of employee fringe benefits are budgeted at estimated amounts in
each department or in the nondepartmental category because annual charges for each
department are difficult to accurately project. The actual costs are charged to the
applicable department in anticipation of budget transfers to cover these costs.
The attached budget ordinance transfers funds between departments and from
the nondepartmental category to the applicable departmental budgets. A summary of the
total transfers in the attached budget ordinance is as follows:

AN ORDINANCE to readopt and reenact the Code of the City of
Roanoke (1979), as amended; and providing for an emergency.
WHEREAS, by Ordinance No. 25043, adopted April 7, 1980, this
Council adopted and enacted a new code for the City of Roanoke
entitled the Code of the City of Roanoke (1979) (hereinafter
sometimes referred to as the "City Code");
WHEREAS, said Code, as amended, contains certain provisions
which incorporate by reference portions of the Code of Virginia
(1950), as amended, (hereinafter "State Code");
WHEREAS, from time to time, certain of these State Code
sections which are incorporated by reference in the City Code have
been amended by the General Assembly;
WHEREAS, such amendments are a matter of public record which
are set forth in the Acts of Assembly and supplements and
replacement volumes of the State Code; and
WHEREAS, it is the desire of this Council that those
provisions of the City Code which adopt by reference State Code
provisions shall be fully consistent with enactments of the most
recent Session of the General Assembly;
THEREFORE, BE IT
Roanoke that:
1. The Code of
ORDAINED by the Council of the City of
the City of Roanoke (1979), as amended, a
copy of which is on file in the City Clerk's Office, consisting of
Chapters 1 through 36.1, each inclusive, is hereby readopted and
reenacted. Such Code amendments heretofore and hereafter adopted
shall continue to be known as the Code of the City of Roanoke
(1979), as amended.
2. With respect to sections or provisions of the State Code
incorporated by reference in the City Code, Council recognizes any
amendments made to such sections or provisions of the State Code by
the most recent Session of the General Assembly and hereby
expresses the intent and ordains that such amendments to sections
or provisions of the State Code incorporated by reference in the
City Code shall be included in the City Code verbatim as enacted by
the most recent Session of the General Assembly.
3. In order to provide for the usual daily operation of the
municipal government,

Re: Reenactment of City Code
Dear Mayor Bowers and Council Members:
Since 1982, City Council has reenacted and recodified the City
Code on an annual basis in order to properly incorporate in the
Code amendments made by the General Assembly at the previous
Session to State statutes that are incorporated by reference in the
City Code. This procedure ensures that the ordinances codified in
our Code incorporate the current provisions of State law.
Incorporation by reference is frequently utilized in local
codes to preclude having to set out lengthy provisions of State
statutes in their entirety. In addition, the technique ensures
that local ordinances are always consistent with the State law as
is generally required.
The procedure whereby a local governing body incorporates
State statutes by reference after action of the General Assembly
has been approved by the Attorney General. See Report of the
Attorney General (1981-1982) at 272. I recommend that Council
adopt the attached ordinance to readopt and reenact the Code of the
City of Roanoke (1979). If the attached ordinance is not adopted,
City Code sections incorporating provisions of the State Code
amended at the last Session of the General Assembly may be
impermissibly inconsistent which could result in the dismissal of
criminal prosecutions under such City Code sections.

WHEREAS, the Roanoke Regional Cable Television Committee

Television Studio
I. Background:
City Council approved the Roanoke Reaional Cable Television
Committee Aareement on June 8, 1992.
B. Basic terms of the aoreement are as follows:
One of the Primary PurPoses of the Committee is to develop,
administer, and operate cable television educational and
institutional facilities and programming, as a joint and
cooperative undertaking of the City of Roanoke, County of
Roanoke, and Town of Vinton.
Capital ~nd operating costs of the Committee are to be funded
from two primary sources:
Capital grant funds provided under the franchise
agreement by Cox Cable Roanoke, Inc., for the purpose
of developing a studio and acquiring necessary
equipment, and
ODeratino funds provided by the City, County and Town
up to a maximum of one percent of the gross revenues of
Cox Cable Roanoke from each jurisdiction, based upon
such receipts for the last calendar year. Each locality
contributes a percentage of the total operating budget,
based on that Iocality's percentage of Cox Cable
subscribers.

OPerating budaet f~)r the Committee must be approved by the
City, County and Town governing bodies and the governing
bodies must appropriate funds to the Committee to support
necessary operating expenses.
II.
Current situation:
The Roanoke Reoi0nal Cable Television Committee recommended a_
fiscal year 1994-95 budder of $116,057 on March 2, 1994. Cost
increases are primarily in the following areas:
Rent. The Government and Educational Access Studio (RVTV)
is under construction at the Jefferson Center with an
anticipated move-in date of mid-June. Rent will be $26,600.
Temporary office space was previously being provided free of
charge at Patrick Henry High School.
The studio is beino constructed in the former shop area, behind
the Roanoke Police Academy offices. Renovations to the
space, estimated at $159,000 will be paid by the Jefferson
Center, leaving the capital grant from Cox Cable intact for
purchase of equipment for the studio.
Part-time HelD. As RVTV comes into full operation in the new
studio, it will expand its duties to include maintaining office
hours, producing and airing governmental meetings, maintaining
a schedule of on-air programming, and taking over total
production of the City's monthly tv show "The Roanoke City
Manager's Report," and its counterpart in Roanoke County.
Part-time production assistants will be hired to meet these
commitments.
Mileage. A vehicle will be purchased to use in transporting
equipment and personnel to and from location shoots. The
vehicle will be purchased with funds from the Cox Cable capital
grant, however mileage and minor maintenance will be covered
in the operating budget.
The total RVTV FY 1994-9~ oDeratino budget of $116,057 is
separated as follows based on the number of Cox Cable subscribers in
each locality:
Roanoke (57 percent) $66,153
Roanoke County (36 percent) $41,780
Vinton (7 percent) $ 8,124

The RVTV Qg_e~ budaet for 1993-94 was $99,802.
Approximately $91,000 will be expended by the end of the fiscal
year. The remaining balance, as per action previously approved by
City Council, will roll over into the station's own Capital Account for
future equipment purchases.
Durinq the current fiscal year. RVTV Droiects for the City have
included videos on the Sewage Treatment Plant Expansion, 1993
Summer Youth Programs, Roanoke Civic Center Hockey Setup,
Communications Department operations, as well as a video for the
Virginia Urban School League, and assisting VICA program students in
producing 2 videos. Assistance and video footage has also been
provided for the monthly TV Show, "Roanoke City Manager's Report."

SUBJECT: ABANDONMENT OF SANITARY SEWER EASEMENTS
PETERS CREEK SEWER REPLACEMENT PROJECT PC-1
I. Background:
ae
New sanitary sewer easements were required for
construction of a sanitary sewer inflow/infiltration
reduction project, making certain previous easements no
longer necessary.
New easements have been donated by property owners with
the understanding that the easements for the old sewer
line would be vacated when the sewer was abandoned.
The easements to be vacated are shown on the attached
plats. Property owners involved are Randel E. & Laura
Jean Tate, Dick A. Cook, Calvin R. Bell, Jr., Woodmen of
the World, and Brice Jr. and Mary Teresa Johnston.
II. Current Situation:
A. Construction is complete, the necessary new easements have
been obtained, and the old sewer line has been abandoned.
Existing sewer easements must be vacated by City Council.
The parcels involved are Tax Nos. 6120434 - 6120438,
6120443, 6140714, 6160633, 6120418 - 6120429, 6120417X,
and 6120430. All are shown on the attached plats.

V. Alternatives:
The Committee recommends that City Council authorize the
vacation of existing easements replaced by new easements
associated with the construction of the PC-1 Sewer
Replacement Project. (See attached plats.)
1. Need to vacate easements and remove unnecessary
encumbrances on these parcels will be met.
Property owners concerns to regain utilization of
their property will be met and the City will be
relieved of maintenance obligations.
B. Committee not recommend that City Council authorize the
vacation of existing easements.
1. Need to vacate easements and remove unnecessary
encumbrances on these parcels will not be met.
Property owners concerns will be the restricted use
of their property and the City will be responsible
for maintaining the old sewer line.

Recommendation: The Committee recommends that City Council
authorize the abandonment of the old sewer line and vacation
of easements which have been replaced by new easements
acquired by the City in connection with the construction of
the PC-1 Sewer Replacement Project as shown on the attached
map, in accordance with Alternative "A".

PRIOR TO CONSTRUCTION OF 2ND STREET/GAINSBORO ROAD PROJECT
I. Background:
Location and major design features of the 2nd Street/Gainsboro Road
Pro~ect were approved by City Council on August 9, 1993, by Resolution
No. 31622-080993.
~mendment NO. i to the contract between the City and the Roanoke
Redevelopment and Housing Authority (RRHA) provides for RRHA to
relocate the structure at 111 Wells Avenue. Following relocation,
RRHA will rehabilitate the structure as part of the Gainsboro
Professional Park. Title to the property at 111 Wells Avenue is held
by the City.

Current Situation:
A. RRHA has the responsibility for the project; therefore, title to the
property should be transferred to RRHA.
B. RRHA is responsible for the removal of friable asbesto~ as identified
by Virginia Department of Transportation (VDOT) asbestos study of this
structure and for the relocation of the structure.
A ~ortion of the subject property is needed to construct the proposed
2nd Street/Gainsboro Road Street Improvement Project. The property
should be conveyed to the RRHA subject to the condition that all
right-of-way and easements needed for the construction of the 2nd
Street/Gainsboro Road Street Improvement Project (as shown on the
attached sketch) will be conveyed back to the City of Roanoke without
cost. This conveyance will occur after the existing structure is
removed from the property.

IV. Alternatives:
The committee recommends that City Council authorize the City Manager
to execute the appropriate documents to convey fee simple title by
special warranty deed to the property known as 111 Wells Avenue, N.W.,
to the RRNA, in a form acceptable to the city Attorney. This
conveyance is subject to the condition that all right-of-way and
easements needed for construction of the 2nd Street/Gainsboro Road
Street Improvement Project (as shown On the attached sketch) shall be
conveyed back to the City of Roanoke without cost.
1. Need to convey title to the appropriate agency would be met.
2. Cost would be limited to the expense of deed preparation.
3. Timing is critical to avoid delays in construction of 2nd
Street/Gainsboro Road Project while structures are removed.
Committee does not recommend that City Council authorize the City
Manager to execute the appropriate document(s) conveying title to the
property at 111 Wells Avenue to RRHA, in a form acceptable to the City
Attorney.
1. Need to convey title to the appropriate agency is not met.
2. Cost is not an issue.
3. Timing may cause delays in construction of 2nd
Street/Gainsboro Road Project while structures are removed.
Recommendation: The Committee reconmlends that city Council authorize the
