The Invocation was delivered by Rabbi Jerome S. Fox, Beth Israel
Jewish Church.
The Pledge of Allegiance to the Flag of the United States of America
was led by Mayor David A. Bowers.

ANNOUNCEMENTS:
The Council will conduct interviews for the position of School Trustee on
Thursday, April 27, 1995, at 6:00 p.m., in the City Council Chamber.
The Council will hold a public heating on Monday, May 1, 1995, at
7:00 p.m., in the Exhibit Hall of the Roanoke Civic Center, with regard to the
City's fiscal year 1995-96 budget and tax rates.
Fiscal year 1995-96 budget study sessions have been tentatively scheduled
for the week of May 2 - 5, 1995, from 9:00 a.m. until 12:00 noon and from 1:00
until 4:00 p.m., as needed.
The Members of City Council and the School Board will meet in joint
budget study session on Tuesday, May 2 at 9:00 a.m. All budget study sessions
will be held in Room 306, Municipal North.
SPECIAL PRESENTATIONS:
Proclamation declaring Monday, May 1, 1995, as Tour DuPont Day in the
City of Roanoke.
PUBLIC HEARINGS:
Public hearing to receive the views of citizens regarding appointment of
Roanoke City School Board Trustees. Applicants are: C. Nelson Harris,
Martin D. Jeffrey and Melinda J. Payne.

study for consideration by Council.

appropriation of funds to certain School grants, and further requesting that

Equipment Replacement Fund be used to purchase furniture and
equipment for Wasena Elementary School and Patrick Henry High
School; and a report of the Director of Finance concurring in the requests
of the School Board.

WHEREAS, the Tour DuPont is the premier cycling event in North America with
professionals from seventeen countries; and
WHEREAS,
the 1995 Tour DuPont will offer its most balanced and second
longest course to date when it routes through the States of Delaware,
Virginia, North Carolina, and South Carolina on April 26 through
May 7; and
WHEREAS,
total distance for this year's Tour DuPont will be approximately
1,130 miles, and cyclists will be battling for $250,000. O0 in cash and
prizes; and
last year, more than two million spectators witnessed the Tour
DuPont, and approximately 200 million watched on regional,
national and international television during the 12 days of the 1994
event; and
WHE~,
Tour DuPont events scheduled in the Roanoke Valley are the
culmination of the hard work and dedication of numerous
indiv/&,,',ls, local gove.anent officials, sponsors and volunteers; and
WHEREAS, citizens of the City of Roanoke wish all sponsors and cycling
participants a safe and successful competition.

As the result of offlcial School Board action at its April 11, 1995 meeting, the Board

The attached budget information is being presented in
accordance with Section 5.9 of the October 12, 1991 Members Use
Agreement. As your representative, I served on the Roanoke
Valley Resource Authority Budget Committee and voted for approval
of the budget at the March 22, 1995 Authority meeting. Tipping
fees are projected to remain at their current level with the
charter member governments' credit reducing from $10.00 per ton
to $5.00 per ton. Also enclosed with the attached information is
a comparison of the 1995-96 budget with the projections made to
finance the capital improvement program and a financial statement
of operations for the first seven (7) months of the 1994-95
budget year.
This report is presented to you with the recommendation that
you grant your approval of the proposed fiscal year 1995-96
annual budget in the total amount of $10,394,950.

Dear Mr. Herbert:
On March 22, 1995, the Roanoke Valley Resource Authority approved its 1995-96 annual
budget. The budget totals $10,394,950 and represents a 5% decrease from the 1994-95 budget
total.
The Resource Authority will maintain the current disposal fees through June 30, 1996
of $50/ton for municipal waste and $55/ton for commercial waste. However, ~e disposal rates
will be increased to recover contracted costs for disposal.
As noted in the budget preface, the Resource Authority has had a very successful
beginning, which has allowed the current disposal fees to be maintained for several years and
we anticipate a bright future. Planning for future landfill consWaction, while maintaining rates
below those projected during financing, will be a goal for the coming years.
Again this budget year, the Resource Authority will be providing a charter member credit
on disposal charges at the rate of $5.00 per ton.
I am pleased to submit this annual budget in accordance with the Member Use Agreement
for the City Council's approval. Attached is a summary of the budget and a comparison of the
budget and the bond projections. A detailed budget is available if additional information is
needed.
The Roanoke Valley Resource Authority looks forward to our continued success serving
the City and the other charter members along with the residents and businesses of the Roanoke
Valley.

Subject: Privatization of Health Care Services at the City Jail.
on the subject is as follows:
The nrovision of health care services for inmates of the City Jail must be ensured by the
Sheriff in accordance with Section 53.1-68 of the Code of Virginia and the Minimum
Standards For Local Jails and Lockups. The Sheriff may be held liable for a federal civil
rights violation as a result of deliberate indifference to the health care needs of inmates.
The current method of health care service nrovision is "in~house", with a seven bed
medical unit staffed by employees of the Sheriff's Department/City Jail. The seven bed
medical unit is not classified as an infirmary because a registered nurse is not on staff.
Ancillary health care services are also provided and funded from the City Jail budget.
The medical unit is accredited by the American Correctional Association (ACA) and the
National Commission on Correctional Health Care (NCCHC).
Staffing for the provision of health care services includes a medical supervisor, six
paramedics, and a physician employed on a contract basis.
Ancillary health care services must be provided off-site more expensively because of the
lack of specialized care facilities and an infirmary. Ancillary health care services include:
1. ~ when required and recommended by the physician on-staff.
2. Dental services when the health of the inmate is in jeopardy.
3. Laboratory and radioloeical services when required and recommended by the physician
on-staff.
4. ~ such as obstetrics/gynecology, cardiology, neurology, and general
surgery when required and recommended by the physician on staff.
5. Provision of orescriDtion and over-the-counter drues.
The estimated FY 1995-96 cost for the continued provision of health care services in-house
is $521,449.

The Sheriff's Department receives reimbursement from the Commonwealth of Virginia for
personnel costs in the amount of $12.464 for each of the six paramedics. The Common-
wealth of Virginia also provides an $8 00 per diem allowance for each inmate for general
jail expenses and an additional $6.00 per diem allowance for state responsible inmates sixty
(60) days after final sentencing.

The orivatizati0n of health care services is being considered as the result of:
1. Recruitment and retention ~roblern~ associated with health care staff working in a
corrections facility environment. During the past year, five of the seven medical staff
members have been replaced due to resignations.
2. The risine cost of off-site services, especially hospital care, as the result of the seven
bed medical unit not being classified as an infirmary. Services, such as intravenous
feeding and treatment for serious infections, that could be provided on-site in the
seven bed medical unit must be done off-site via hospital care at a higher cost.
Liability exposure associated with the provision of health care services. Approximately
17 of the 19 pending lawsuits against the Sheriff's Office are related to health care
services.
Revised NCCHC accreditation standards require the implementation of quality
improvements for continued accreditation. In lawsuits, some federal courts use
NCCHC accreditation as a measure to determine if adequate health care is being
provided. At a minimum, the revised NCCHC standards will require the following
improvements at the City Jail:
a. The provision of a dental screening within thirty (30) days of intake and a dental
examination within ninety (90) days of intake. Dental services are currently
provided only in emergency cases when the health of the inmate is in jeopardy.
b. The availability of a mental health professional to address the mental health
needs of the inmates.
c. The implementation of a quality improvement program and a methodology for
assessing the quality of services provided.
5. Health care provision is a hieMv s~eclali?od riehl which requires expertise in the
management of health care service delivery.
6. A number of localities, statewide and nationwide, have I~rivatiz~l the provision of
health care services in an attempt to increase the quality of services provided, ensure
continued accreditation, and reduce the level of primary risk exposure.
A study erou~ was established to examine the cost and feasibility of privatizing the
provision of health care services at the City Jail. The feasibility of enhancing the in-house
delivery of health care services was also examined.

A reauest for Dronosals (RFP) was mailed on January 9, 1995 to private providers of
correctional health care. A public advertisement was also published in the Roanoke Times
and Roanoke Tribune.
Formal nroDosals were received in the Office of General Services on February 15, 1995
from five correctional health care oroviders. An evaluation committee reviewed the
proposals and interviewed all providers that submitted a proposal. Proposals were received
from the following providers:
1. Correctional Care
2. Correctional Healthcare Solutions, Inc.
3. Correctional Medical Services, Inc.
4. Correctional Physician Services, Inc.
5. Prison Health Services, Inc.
Correctional Medical Services. Inc. (CMS) has been ranked first in accordance with the
requirements of the procurement section of the Code of the City of Roanoke. In Virginia,
CMS currently provides health care services at the Albermarle/Charlottesville, Alexandria,
Arlington County, and Virginia Beach correctional facilities.
A contract between the Sheriff and CMS for the provision of health care services at the
City Jail needs to be executed by May 1, 1995 to enable CMS to begin the required
transition and start-up activities so that service delivery can commence on July 1, 1995.

measures such as the use of the on-site infirmary, centralized utilization review of
hospital serviees, negotiated discounted rates for off-site services, and third-party
provider billing.
Cost will be $620.756. Cost is $99.307 more than the anticipated FY 1995-96
expenditure for current in-house health care services at the Jail, but $62.101 less than
the cost to provide enhanced services in-house (Alternative B).

in recruiting health care staff to work in a corrections environment.

8. Impact on em~lovees will be minimized by the following measures:
a. The chief corrections paramedic and assistant chief corrections paramedic are
sworn deputy sheriffs and will be transferred into vacant sworn positions. Both
employees will be compensated with a continuity bonus of 2.5 % of annual salary
for continued service during the evaluation and transition period.
b. Three corrections paramedics will be hired by CMS at current salary levels and
comparable benefits for a minimum of one year as mandated by the contract. All
three employees will be compensated with a continuity bonus of 2.5% of annual
salary for continued service during the evaluation and transition period.
c. The remaining two corrections paramedic positions are occupied by employees
recently hired on a full-time temporary basis and will be given first hire
consideration as mandated by the contract. These employees will not be entitled
to the continuity bonus due to their temporary status.
d. The net impact will be a reduction of seven full-time equivalent Sheriff's
Deoartment positions.
9. Contract term~ will contain the following provisions:
Time of Performance and Renewal
The initial term of this agreement will be one year commencing July 1, 1995
and ending June 30, 1996. The Sheriff will have the option to extend the
contract for additional one year terms, up to a maximum of five years including
the initial one year term.
b. Cost Increases
Annual cost increases will be capped at the lesser of the annual increase in the
Medical Care Component of the Consumer Price Index, or 5%.

BACKGROUND
A. The 23-A Judicial District Court Service Unit had been
funded for the Juvenile Drug Dealer's Intervention
Program through a grant from the State Department of
Youth & Family Services.
Fundinq from the State Department of Youth and Family
Services for this program was discontinued by the State
Department of Criminal Justice Services June 30, 1994.
Roanoke City submitted an application and received
funding from the Anti-Drug Abuse Act of 1988 for a
Juvenile Drug Dealers' Intervention Program from the
State Department of Criminal Justice Services. The
amount of $38,625 was awarded for the program year
beginning July 1, 1994 and ending June 30, 1995 to
continue the program.
II. CURRENT SITUATION
The Juvenile Drug Dealer's Intervention Proqram is
currently meeting the needs of a special population of
individuals convicted of trafficking drugs. The program
provides intensive supervision, treatment, and
surveillance for Juvenile Drug Dealers and their
families. The program is designed to serve up to 10
juveniles.
The Department of Criminal Justice Services notified the
city of Roanoke of federal funds available on a
competitive basis for continuance of this program.

OVERFLOW MEASURING
Background on the subject in chronological order is as follows:

City Council approved the employment of Malcolm Pirnie, Consulting
Engineers, of Newport News, Virginia, at its October 10, 1994 meeting,
for engineering services in connection with the renovation and expansion
of the Water Pollution Control Plant with Mattern & Craig, Inc. as their
associates. Notice to proceed was issued for January 2, 1995.
On March 2, 1995, Malcolm Pirnie, Mattern & Craig, Inc., and City
personnel met with the Department of Environmental Quality (DEQ). The
concept was presented in the meeting, that in the expansion of the
Water Pollution Control Plant, the concentrations of various pollutants
allowed to be discharged at the plant remain the same and that credit be
given at the plant for reducing pounds of pollutants discharged during
sewer system overflows. This reduction would be accomplished by the
trunk line construction on Tinker Creek and Roanoke River which will
eliminate some or all of the overflow. The Commonwealth of Virginia
Department of Health (DOH) was also presented the same concept and
they agreed with DEQ. Each department, however, requested that the
City of Roanoke should quantify and qualify the amount of sewer system
overflow following extended periods of rainfall.
Mattern & Craig, Inc. was employed by the City of Roanoke for the
Roanoke Sewershed Implementation Plan overflow measuring for the sum
of $200,000. The measurement of this overflow and establishing the
amount of solids should be an addition to this contract. The original
contract amount is $200,000.
II.
Current Situation is as follows:
Mattern & Craig, Inc. is under contract with the City of Roanoke for the
Roanoke Sewershed Implementation Plan (inflow and infiltration). This
contract needs to be extended to do the following:

The City of Roanoke will locate four (4) manholes that have
known overflows during extended rain periods. (Manholes will
have to be in areas other than streets.)
Mattern & Craiq, Inc. will fabricate containment structures on top
of these manholes that will capture the overflow and direct it
through meters that will measure total overflow. The City will
provide the meters to Mattern & Craig, Inc., and they will install
and monitor.
Mattern & Craig, Inc. will provide automatic samplers for each
manhole. The samples will be collected weekly, or after extended
rainfall, as often as necessary. Samples will be delivered to the
laboratory at the Water Pollution Control Plant for analysis of
amount of solids present in the composite samples. Period of
quantity measurement and solids samplings will be three months.
Meters are to be maintained in working condition at all times
during this period.
Cost of the monitoring for three months is as follows:

by the other localities participating in the Water Pollution Control
Plant expansion project.

3. Time of completion of the study is 90 consecutive calendar days.
Reject the issuance of Amendment No. 1 and do not authorize the
additional work as described above.
Engineering concerns would not be met in a timely manner. The
Water Pollution Control Plant expansion would not get credit for
the overflow solids that now flow untreated down the river. The
plant design capacity would have to be increased to treat the
added loading.
2. Funding would not be encumbered at this time.
Time of completion would not increase if either alternative is
approved. This work will be accomplished at the same time the
original contract is being accomplished.
Recommendation is as follows:
City Council concur in alternative "A" and take the following actions:
Authorize the City Manager to issue Amendment No. 1 to the Roanoke
Sewershed Implementation Plan overflow measuring contract with
Mattern & Craig, Inc. in the amount of $29,180 and 90 consecutive
calendar days. The total contract would then become $229,180.
Transfer $10,884 from Sewage Fund account number 003-056-8465-
9001 to a new Sewage Fund account to be established. Appropriate
$18,296 to the same account from funds to be provided by other
jurisdictions, and establish accounts receivable accounts in the same
amount.

Subject: COYNER SPRINGS WATER SYSTEM
Backqround on the subject in chronological order is as follows:

The City owns and operates a nursing home and two juvenile homes
located in Botetourt County.
Drinking water service to these facilities has been provided by a spring
as the water source. The Virginia Department of Health (VDH) has
determined that the spring may be influenced by surface water. This
potential for contamination requires that the City evaluate water
treatment or alternative drinking water sources for the existing facilities.
Current situation is as follows:
Advertisement for qualified engineer ncl consultants was placed in the
January 29, 1995 edition of the Roanoke Times & World News and the
January 26, 1995 edition of the Roanoke Tribune.
B. Three consultants were invited for interviews held on March 2, 1995.

Following presentations and interviews of all consultants, Mattern and
Craiq, Inc. was selected as the best qualified consultant to prepare plans
and specifications to support construction of a public water main to the
Coyner Springs facility.
Mattern & Craig, Inc. has submitted a lump sum proposal in the amount
of $23,100 for the proposed work.

Alternatives in order of feasibility are as follows:
A. Extend public water mains to the facility. This alternative would involve
extending an existing County-owned water main located on Route 460
approximately 5,500 feet to the site. This alternative will provide
adequate quantity and quality of drinking water at a fixed cost. The
selection committee considered this alternative to be the most feasible
long-term solution. The proposed contract with Mattern & Craig, Inc.
will provide for the design of the water main.
Capital cost of constructing a public water main is approximately
$250,000. Staff will negotiate possible cost sharing with
Botetourt County.
Maintenance cost for the water main will be zero. The line is
proposed to be owned and maintained by Botetourt County. It is
anticipated that the City will purchase water from Botetourt
County. The cost of purchasing water will be a long-term expense
for the facilities being operated at Coyner Springs.

Service will be improved. A public water main will provide
adequate and reliable water service to City-owned facilities·

Provide treatment of the existinq water sourcP.. This alternative would
most likely provide a micro-filtration system.
Capital cost of this system is expected to be in the range of
$75,000 to $100,000.
Maintenance cost of this system will require a qualified operator
and therefore would incur long-term operation and maintenance
expenses.
3. Service will be unchanged.
Funds are available in the Utility Line Services Fund previous year
retained earnings to pay the cost of the professional services
agreement.
Develop new water sources. This alternative would involve drilling a
well. Wells may be subject to the same surface water influence as
springs· Several unknown factors accompany the well alternative·
These are water quality, quantity and cost. These factors cannot be
adequately addressed prior to drilling the well.
Capital cost is subject to site conditions and is unknown at this
time. Order of magnitude cost are in the range of $50,000 to
975,000 for well system. Treatment cost, if required, will be
comparable to the treatment alternative.
Maintenance cost of this system may require a qualified operator
and therefore would incur long-term operation and maintenance
expenses.
Service will not be improved. Water quality and quantity are
uncertain. Wells are also subject to surface water contamination.

Personal Property Tax for Motor Vehicles - Change in
Reporting to Commissioner and Due Date
I. Background:
Proration of personal property tax began January 1, 1991. Proration
calculates personal property tax for the period of time that the vehicle
has a tax situs (date tax is assessable by City) in the City of Roanoke.
City Code currently reauires that a motor vehicle owner declare such
property with the Commissioner of the Revenue within thirty days of
property registration date with State Department of Motor Vehicles
('°DMV") for an assessment on such property. Thereafter, the tax is due
and payable to the City Treasurer within sixty days of such registration
date or May 31 of the tax year, whichever occurs later. Failure to comply
with either of these dates results in penalty and interest added to the
account.
All personal property tax shall be paid prior to ssuance cfa City decal.
The City Code currently requires the decals to be purchased within thirty
(30) days of acquisition of tax situs or May 31, whichever occurs later.
II.
Current Situation:
Owner or ourchaser of property must declare such property with
Commissioner of the Revenue within thirty (30) days after property
registration date with DMV.
Tax becomes due and payablQ within sixty days from property
registration date or May 31 of the tax year, whichever occurs later.
Failure to pay tax by due date results in penalty and interest calculations.

March Financial Report
This financial report covers the period July through March of the 1994-95
fiscal year. The following narrative discusses revenue and expenditure trends to date.
REVENUE
Total General Fund revenues reflect an increase of 4.18% over fiscal year
1994 on a year-to-date basis. This is an increase of nearly 83.5 million. Variances in
specific categories of revenue are as follows:
General Property Taxes, the largest category of general fund revenues, are approximately
$657,000 or 2.10% over that of FY94. This is a reflection of the anticipated growth in
real estate taxes.
Other Local Taxes are up 5.96%, adding 81,748,000 to General Fund revenues. Most
local taxes have shown slight to moderate increases, and a few categories have shown
significant increases. The City has received nearly 81.0 million of additional business
license tax revenue over FY94 due to increased business license return auditing
implemented by the Commissioner of the Revenue. Another increase is in state sales tax
revenue, up 6.70% since FY94. The prepared food and beverage tax has grown more than
8150,000 since FY94 due to an expanded economy and new restaurant business within
the City. Motor vehicle license tax is up, aided by the placement of a Commissioner of the
Revenue station at the DMV office and the no-decal parking ticket program. Utility taxes
are the only local tax reflecting a decline due to a much milder winter season in 1995 that
has lowered this tax.
Fines and Forfeitures reflect a 32.22% increase over FY94 due to a significant increase in
General District Court fines resulting from a more aggressive collection approach, increase
in caseload, and the new policy of accepting payments by credit card. Court judgment
collection fees of 845,000 have also been collected in FY95 by the newly established Cost
Collections Unit.
Grants-in-Aid Commonwealth is up 3.12%, adding 8558,000 to General Fund revenues.
This is partially due to the quarterly remittance of state recordation tax which will be
collected all of FY95 but was collected only the latter half of FY94. Revenue from rental

car tax and shared expenses has increased in FY95 as well due to the change from cash
to accrual-based accounting. Street maintenance categorical aid is also up, in line with
budgeted increases.
Grants-in-Aid Federal Government is up significantly due to winter storm reimbursement of
$245,000 in FY95 compared to $57,000 in FY94. FEMA reimbursements are also up
slightly in FY95.
Miscellaneous Revenue has increased 88.94% due to an increase in surplus property sales
proceeds coupled with other miscellaneous revenue accruals.
Internal Services revenue is up 14.71% or $157,000 due to increases in billings by street
maintenance, building maintenance, grounds maintenance, and engineering.
EXPENDITURES AND ENCUMBRANCES
Expenditures and encumbrances for the General Fund are up 7.01% over the last fiscal
year. Variances in specific categories are explained as follows:
Judicial Administration expenditures have increased 6.76% or $177,000. Equipment
purchases by the Clerk of the Circuit Court, Juvenile and Domestic Relations Court Clerk,
and Sheriff's Departments have contributed to this. Increased CIS billings have also been
incurred by the Clerk of the Circuit Court and Commonwealth's Attorney. The
Commonwealth's Attorney Cost Collections Unit, with expenditures of approximately
$36,000, is a new department in FY95.
Public Works expenditures have increased $1,351,000 or 9.19%. Street paving costs have
increased $278,000 on a year-to-date basis due to timing differences in the performance
of annual street paving. This is expected to approximate the FY94 level by year end. Solid
Waste Management's fees for professional services have increased nearly $400,000 due
to timing differences in payments to the Roanoke Valley Resource Authority for landfill
charges. Conversely, the department's salaries and wages costs have declined by
$100,000 due to a reduction in employees, its costs for equipment rental have also
dropped. Expenditures for equipment purchases in the Communications department have
risen as some previously leased equipment was purchased. Expenditures in Parks
Maintenance for building maintenance and project supplies have increased due to the
renovation of several City parks. The Building Maintenance department has incurred
increased fleet rental and maintenance costs, costs to maintain City property, and air
conditioning expenses.

Parks, Recreation and Cultural expenditures have increased 6.12% or $224,000. This is
substantially caused by an increase in cultural contributions. The largest single increase
is to the Hotel Roanoke Conference Center Commission ($276,500 in FY95 versus
$123,350 in FY94), but there have also been increased contributions to the Downtown
Service District, Regional Economic Development Agency, Explore Park and the Science
Museum of Western Virginia. A decrease in Recreation expenditures resulting from higher
reimbursements for the use of facilities offsets increases in Library expenditures for capital
outlay and personal services.
Community Development expenditures are up 16.20% or $115,000 due to a new position
and the transfer of existing positions into the Department of Planning and Community
Development.
Transfers to the Debt Service Fund are up 11.49% or $792,000. Although the overall debt
service requirements of the City remain fairly consistent from year to year, timing
differences in the transfers to this fund have caused a fluctuation on a year-to-date basis.
Transfers to the School Board are up 6.88%, or approximately $1,746,000, due to an
overall increase in the amount funded the School Board combined with timing differences
in the transfers on a cumulative basis.
Nondepartmental expenditures, consisting mainly of transfers to other funds, have
increased 90.24% or $1.9 million. Budgeted increases in transfers to these funds account
for some of this, but the increase is mostly due to transfers being made earlier in FY95 than
in FY94. Transfers to the Capital Projects Fund are up nearly $1.5 million due to earlier
project commencement dates in FY95. Fleet Management has received $265,000 in FY95
but received none in the prior year through March, while the Transportation Fund has
received $170,000 less this year than in FY94. Transfers to the Nursing Home have also
increased $82,000, and slight increases in the transfers to the City Information System,
Civic Center and Grant Funds have occurred. Funding provided to the City Pension Plan
has increased from approximately $175,000 to $350,000.

awarding a contract therefor; authorizing the proper City officials to execute the requisite contract
for such work; rejecting all other bids made to the City for the work; and providing for an emergency.
BE IT ORDAINED by the Council of the City of Roanoke as follows:
1. The bid of Montgomery KONE Inc., which includes Additive Bid Item Numbers 1 and
2, to modernize and upgrade the three elevators in the Municipal Parking Garage, in the total amount
of $233,388.00, as more particularly set forth in the April 24, 1995, report of the City Manager to
this Council, such bid being in full compliance with the City's plans and specifications made therefor
and as provided in the contract documents offered said bidder, which bid is on file in the Office of the
City Clerk, be and is hereby ACCEPTED.
2. The City Manager or the Assistant City Manager and the City Clerk are hereby
authorized on behalf of the City to execute and attest, respectively, the requisite contract with the
successful bidder, based on its proposal made therefor and the City's specifications made therefor,
said contract to be in such form as is approved by the City Attorney, and the cost of said work to be
paid for out of funds heretofore or simultaneously appropriated by Council.
3. Any and all other bids made to the City for the aforesaid work are hereby REJECTED,
and the City Clerk is directed to notify each such bidder and to express to each the City's appreciation
for such bid.
4. In order to provide for the usual daily operation of the municipal government, an
emergency is deemed to exist, and this ordinance shall be in full force and effect upon its passage.

Backqround on the subject in chronological order is as follows:
Construction on the Municipal Parking Garage was completed circa 1976. The
Garage includes three elevators within two stair/elevator towers. These
elevators, with over fifteen years of service, are mechanically outdated, require
almost continual maintenance and are aesthetically deficient.
Current Situation:
A.
Invitation to bid for modernization of elevators was advertised in Roanoke
Times &World News and Roanoke Tribune on or about February 12, 1995.
A non-mandatory pre-bid conference was held on March 2, 1995.
Separate quotations were requested from six mechanical contractors to
provide work deleted from the elevator bid package. It was felt that the
mechanical work could be better provided under a separate contract rather
than by the elevator contractor.

Bids to upgrade elevators, following proper advertisement, were publicly
opened and read aloud before the Manager of General Services on March
14, 1995. Two (2) bids for elevator work were received with Montgomery
KONE Inc. of Greensboro, North Carolina submitting the Iow bid in the
amount of $233,388.00 with two hundred sixty-four (264) consecutive
calendar days as the time for completion. Additive Bid Item Nos. 1 and 2
are included with the base bid. The decision was made not to accept
Additive Bid Item No. 3 to provide a computer monitor package because it
was not an essential component to the operation/maintenance of the
elevators.

Bids for the related mechanical work were publicly opened and read aloud
before the Manager of General Services on March 23, 1995. Three bids for
this work were received with S. J. Conner & Sons, Inc. of Roanoke
submitting the Iow bid in the amount of $4,800.00. Subsequent to receipt
of bids, it was learned that S. J. Conner & Sons, Inc. had not included all
work required by the bid documents and consequently this bid was deemed
non-responsive. The lowest responsive bid was received from Hardy
Plumbing & Heating Corp. in the amount of $5,800.00.
The work required under the elevator package consists of removing the
existing drive system,, door operators, and car/signal control systems;
removal of existing floor, wall and ceiling finishes and replacing these with
new components/systems (Additive Bid Item No. 1); and, replacement of
existing traction (hoist) cables (Additive Bid Item No. 2). The work under
the mechanical package includes the replacement of existing window type
air-conditioners with new packaged heating and air conditioning units in
each of the two machine rooms to provide proper environmental/
temperature controls for the new elevator equipment.
II1. Issues in order of importance are as follows:
A. "Service Excellence" to those who use the Parking Garage.
B. Compliance of bidders with the requirements of the contract documents.
C. Total amount of the Iow bids.
D. Funding for the project.
E. Time of Completion.
IV. Alternatives in order of feasibility are as follows:
Award a contract for elevator modernization to Montgomery KONE Inc. in
accordance with the contract documents. Issue a purchase order for
mechanical work to Hardy Plumbing & Heating Corp. in accordance with the
documents prepared for that work.

"Service Excellence" will be enhanced because modernization project
will greatly improve performance and efficiency of elevators.
2. Compliance of bidders with the requirements of the contract
documents was satisfied.
Total cumulative amount of the two bids is higher than anticipated,
however, given the changes described in the scope of work, the
amount is acceptable. (The estimate to modernize the elevators was
obtained from an elevator vendor who ultimately did not bid the
project. The estimate was based on reconditioning existing equipment
and not upgrading that equipment to increase response times and
overall improve the efficiency of the elevator system.)
Fundinq for both projects was identified under 1994-1995 Capital
Maintenance & Equipment Replacement Program ($108,105.00),
Transportation Fund Retained Earnings ($61,895.00), and Materials
Control Retained Earnings ($91,208.00).
Time of completion to upgrade elevators is two hundred sixty-four
(264) consecutive calendar days, which is acceptable. Time of
completion of mechanical work will easily fall within the elevator time
frame.
B. Reiect all bids and do not award a contract at this time.
1. "Service Excellence" will be diminished because elevators will
continue to operate poorly.
Compliance of the bidders with the requirements of the contract
documents would not be an issue.
Amount to execute this work would probably increase if rebid at a
later date.
4. Fundinq would not be encumbered at this time.
5. Time of completion would be extended,

V. Recommendation is as follows:
City Council concur with Alternative A, and take the following actions:
Authorize the City Manager to enter into a contractual agreement, in a form
acceptable to the City Attorney, with Montgomery KONE Inc., in the
amount of $233,388.00 and two hundred sixty-four (264) consecutive
calendar days to modernize and upgrade the three elevators in the
Municipal Parking Garage in accordance with the contract documents, and
approve funding for a purchase order to Hardy Plumbing & Heating Corp.
to provide the packaged heating and air-conditioning units in the amount of
85,800.00.
Authorize the Director of Finance to transfer the following funding from
CMERP ($108,105.00) and Materials Control Retained Earnings
($91,208.00) into a new Transportation Fund account established for this
work. Appropriate $61,895.00 from Transportation Fund Retained Earnings
into the same account. The breakdown below provides for a contract
contingency of approximately three percent (3%), $250.00 in advertising
expenses already incurred, and for services provided by the Office of City
Engineer.

and described as Official Tax Nos. 6472001 and 6472002, be rezoned
from RM-2, Residential Multi-family, Medium Density District, to LM,
Light Manufacturing District, such rezoning to be subject to certain
conditions proffered by the petitioner.
I. Back~,round:
Purnose ofrezoning request is to place two (2) lots, comprising 1.46 acres, into a
zoning classification that would permit the expansion of the adjoining heating
and air conditioning business onto the property. Expansion would include: (1)
construction of 5,000 square foot metal building for the purpose of storing
inventory and parts; and (2) additional parking spaces necessary for employees
and visitors to the business.
Petition to rezone was filed on February 9, 1995, and an amended petition was
submitted on February 24, 1995, prior to the Commission's public hearing on
March 1, 1995. The following conditions were proffered by the petitioner:
"That the property will be developed in substantial conformity with the
site plan prepared by Gifford O. Vernon, AIA, dated 2/8/95, a copy of
which is attached hereto as Exhibit "C", subject to any changes required
by the City during site plan review."
"The building, as shown on the attached site plan (Exhibit "C") will be of
the same design, height, color, and materials as the existing brown, metal,
pre-engineered building currently located on the property to the rear of the
corporate offices."

"There will be no outside storage or display of materials or inventory on
the site."
4. "There will be no additional advertising signage on the site."

trees as possible, will be established and maintained on the site along the
southerly and westerly property lines and will be supplemented where
necessary with pines or other evergreen trees or shrubs in order to provide
effective visual screening from the adjoining golf course as well as Route
581."
"That if no building permit has been issued and no construction
commenced within three (3) years fi.om the date of final rezoning
approval, the zoning shall revert to RM-2 without further action by City
Council."
"That the building to be constructed by Petitioner will be used for storage
of heating and air conditioning parts and supplies and for parking."
Plannin~ Commission public hearing was held on Wednesday, March 1, 1995.
Mr. David C. Helscher, attorney, appeared before the Commission on behalf of
the petitioner and briefed the Commission as to the purpose of the rezoning
request. Mr. Helscher stated the rezoning was being requested to allow for
additional parking as well as a warehouse to accommodate a greater parts
inventory for the heating and air conditioning business. Mr. Helscher then
reviewed the visual issues which led to the petitioner proffering additional
conditions in the amended petition: the appearance of the warehouse, outdoor
storage, signage and buffering/screening along the southerly and westerly
property lines.
Mr. Marlles presented the staff report. He informed the commission that
appearance of the property fi.om 1-581 had been a key issue in the original
rezoning and that since staffs initial concerns relative to that, specifically,
building appearance, outdoor storage, screening, and signage, had been addressed
in the amended petition, staffwas recommending approval of the rezoning.
Mr. Talevi asked Mr. Helscher if he would be willing to revise the language in
proffer #4 to read, "There will be no signs on the site other than directional
signs." Mr. Helscher said that would be satisfactory. Based on Mr. Helscher's
suggestion that the words" and for parking" in proffer #7 be crossed out to clarify
its meaning, Mr. Talevi advised Mr. Helscher that the wording should be revised
and submitted as part of a second amended petition.

There were no additional questions or discussion on the part of the Commission
and no one from the audience appeared before the Commission to speak on behalf
of, or in opposition to, the request.
Seconded amended netifi0n was filed on March 6, 1995. The folloWing revisions
to the conditions were made:

Proffer #7: "That the building to be constructed by the Petitioner will be

north, south and west is Residential Multi-family, Medium Density District,
RM-2; immediately to the east and across 1-581, is Light Manufacturing, LM. To
the north, a natural ridge separates the existing residential uses from the subject
property.
Land use surrounding the currently vacant subject property is as follows: to the
north and east is 1-581; to the west are apartment buildings; immediately to the
south is a golf course and farther south are apartment buildings.
Access to the property is currently by way of Highland Farm Road, the Frontage
Road and Peters Creek Road and would not change if the rezoning is approved..
Building appearance would be substantially similar to the existing building at the
back of the property - a pre-engineered, one-story structure with metal fi.me and
roof and of the same color.
Buffering of the property would be required by City's zoning ordinance because
the proposed Light Manufacturing- zoned land would be contiguous to
residentially zoned property on north, west and south.
Existing vegetation currently screens subject property from multi-family
residential uses and golf course to west and south. Petitioner has indicated that all
of the vegetation not in the building footprint would be left on site and that
additional landscaping would be considered if needed to screen the building.

advertising purposes.

heating and air conditioning business would be allowed to take place.
Land use would be a light industrial activity in keeping with future land
uses anticipated for the area adjoining 1-581. Residential uses to the west
and south would be buffered and to the north would be protected by
changes in elevation.
Access to and from the site would be provided by way of the existing
parking lot and no additional access points would be required.
Building appearance would be substantially similar to the existing,
pre-engineered building.

multi-family residential units and golf course.

RM2. A map of the property to be rezoned is attached hereto as
Exhibit "A." This purchase agreement is subject to the approval of
this rezoning petition as evidenced by the Petitioner's offer and
The Fairways Group's acceptance, copies of which are attached
hereto as Exhibit "B."
Pursuant to § 36.1-690, Code of the City of Roanoke (1979), as
amended, the Petitioner requests that the said property be rezoned
from RM2 District to LM District, subject to certain conditions as
set forth below, for the purpose of expansion of the existing
business located at 2343 Highland Farm Road, NW, City of Roanoke,
immediately adjacent to the lots which are the subject of this
rezoning petition. This expansion will include: (1) construction
of a 5,000 square foot metal building for purpose of storing
inventory and parts used in conjunction with the existing Newbern-
Trane business of installing, maintaining and repairing heating and
air-conditioning equipment at commercial/industrial/educational
facilities throughout southwest Virginia; and (2) additional
parking spaces necessary for the employees of and visitors to the
Newbern-Trane facility.

(2) The building, as shown on the attached site plan (Exhibit
"C"), will be of the same design, height, color, and
materials as the existing brown, metal, pre-engineered
building currently located on the property to the rear of
the corporate offices.
(3) There will be no outside storage or display of materials
or inventory on the site.

(4) No signs other than directional signs will be used on the
site.
A buffer of at least thirty (30) feet, incorporating as
many of the existing trees as possible, will be

supplemented where necessary with pines or other
evergreen trees or shrubs in order to provide effective
visual screening from the adjoining golf course as well
as Route 581.

date of final rezoning approval, the zoning shall revert
to RM2 without further action by City Council.
(7) That the building to be constructed by Petitioner will be
used for storage of heating and air conditioning parts

(5) A buffer of at least thirty (30) feet, incorporating as
many of the existing trees as possible, will be
established and maintained on the site along the
southerly and westerly property lines and will be
supplemented where necessary with pines or other
evergreen trees or shrubs in order to provide effective
visual screening from the adjoining golf course as well
as Route 581.
(6) That if no building permit has been issued and no
construction commenced within three (3) years from the
date of final rezoning approval, the zoning shall revert
to RM2 without further action by City Council.
(7) That the building to be constructed by Petitioner will be
used for storage of heating and air conditioning parts
and supplies and for parking.
Attached hereto as Exhibit "D" are the names, addresses and
tax numbers of the owner or owners of all lots or property
immediately adjacent to and immediately across a street or road
from the property to be rezoned.
W~EREFORE, the Petitioner requests that the above-described
tracts be rezoned as requested in accordance with the provisions of

The Petitioner, Newbern Properties, L.P., has contracted to
purchase from The Fairways Group, formerly U. S. Golf Properties,
L.P., certain land in the City of Roanoke containing approximately
1.46 acres, more or less, located on Lot 1, Block 20, and Lot 2,
Block 20, Tuckawana Circle, NW. Said tracts are currently zoned
RM2. A map of the property to be rezoned is attached hereto as
Exhibit "A." This purchase agreement is subject to the approval of
this rezoning petition as evidenced by the Petitioner's offer and
The Fairways Group's acceptance, copies of which are attached
hereto as Exhibit "B."
Pursuant to § 36.1-690, Code of the City of Roanoke (1979), as
amended, the Petitioner requests that the said property be rezoned
from RM2 District to LM District, subject to certain conditions as
set forth below, for the purpose of expansion of the existing
business located at 2343 Highland Farm Road, NW, City of Roanoke,
immediately adjacent to the lots which are the subject of this
rezoning petition. This expansion will include: (1) construction
of a 5,000 square foot metal building for purpose of storing
inventory and parts used in conjunction with the existing Newbern-
Trane business of installing, maintaining and repairing heating and
air-conditioning equipment at commercial/industrial/educational
facilities throughout southwest Virginia; and (2) additional
parking spaces necessary for the employees of and visitors to the
Newbern-Trane facility.
The Petitioner believes the rezoning of the said tracts of
land will further the intent and purposes of the City's Zoning
Ordinance and its comprehensive plan, in that it will allow an
existing business to enlarge and improve its existing facilities.
The Petitioner hereby proffers and agrees that if the said
tracts are rezoned as requested, that the rezoning will be subject
to, and that the Petitioner will abide by, the following

AN ORDINANCE permanently vacating, discontinuing and closing
certain public right-of-way in the City of Roanoke, Virginia, as
are more particularly described hereinafter.
WHEREAS, John G. Rocovich, Jr., Trustee of QLC Land Trust,
filed an application to the Council of the City of Roanoke,
Virginia, in accordance with law, requesting the Council to
permanently vacate, discontinue and close the public right-of-way
described hereinafter; and
WHEREAS, the City Planning Commission, after giving proper
notice to all concerned as required by S30-14, Code of the City of
Roanoke (1979), as amended, and after having conducted a public
hearing on the matter, has made its recommendation to Council; and
WHEREAS, a public hearing was held on said application by the
City Council on April 10, 1995, after due and timely notice thereof
as required by S30-14, Code of the City of Roanoke (1979), as
amended, at which hearing all parties in interest and citizens were
afforded an opportunity to be heard on said application; and
WHEREAS, it appearing from the foregoing that the land
proprietors affected by the requested closing of the subject public
right-of-way have been properly notified; and
WHEREAS, from all of the foregoing, the Council considers that
no inconvenience will result to any individual or to the public
from permanently vacating, discontinuing and closing said public
right-of-way.
THEREFORE, BE IT ORDAINED by the Council of the City of
Roanoke, Virginia, that the public right-of-way situate in the City
of Roanoke, Virginia, and more particularly described as follows:
That remaining section of the cul-de-sac at the end of
Wynne Road, which adjoins Electric Road, S.W.,
be, and is hereby permanently vacated, discontinued and closed, and
that all right and interest of the public in and to the same be,
and hereby is, released insofar as the Council of the City of
Roanoke is empowered so to do with respect to the closed portion of
the right-of-way, reserving however, to the City of Roanoke and any
public utility, including, specifically, without limitation,
providers to or for the public of cable television, electricity,
natural gas or telephone service, an easement for sewer and water
mains, television cable, electric wires, gas lines, telephone
lines, and related facilities that may now be located in or across
said public right-of-way, together with the right of ingress and
egress for the maintenance or replacement of such lines, mains or
utilities, such right to include the right to remove, without the
payment of compensation or damages of any kind to the owner, any
landscaping, fences, shrubbery, structure or any other
encroachments on or over the easement which impede access for
maintenance or replacement purposes at the time such work is
undertaken; such easement or easements to terminate upon the later
abandonment of use or permanent removal from the above-described
public right-of-way of any such municipal installation or other
utility or facility by the owner thereof.
BE IT FURTHER ORDAINED that the closure of the above-described
right-of-way is conditioned upon applicant's submitting to the
City, receiving approval of, and recording a subdivision plat,

providing for the disposition of the land within the right-of-way,
to be vacated, in a manner consistent with the requirements of
Chapter 31, Subdivisioq, of the City Code, and providing for the
retention of appropriate easements, together with the right of
public passage over the same, for the purpose of construction,
repair and general maintenance of any and all utilities that may
exist within said right-of-way; and in the event these conditions
have not been met and the said plat has not been recorded in the
Office of the Clerk of Circuit Court within twelve (12) months from
the effective date of this ordinance, this ordinance shall become
null and void with no further action by City Council being
necessary.
BE IT FURTHER ORDAINED that the City Engineer be, and he is,
directed to mark "permanently vacated" on said public right-of-way
on all maps and plats on file in his office on which said right-of-
way is shown, referring to the book and page of ordinances and
resolutions of the Council of the City of Roanoke, Virginia,
wherein this ordinance shall be spread.
BE IT FINALLY ORDAINED that the Clerk of the Council deliver
to the Clerk of the Circuit Court of the City of Roanoke, Virginia,
a certified copy of this ordinance for recordation in the Deed

a certain portion of Wynne Road, S.W.
Portion of W_vnne Road. S,W., as requested for closure, was dedicated to Roanoke
County in 1956 as a part of a larger subdivision (see attached subdivision plat).
~ for the right-of-way of Route 419 separated the subject
portion of Wynne Road from the remainder of the original subdivision in 1963.
Section 0fWvnne Road. S.W., as requested for closure, was annexed into the City
in 1976.
Road section is undeveloped and is situated at a grade that is approximately 15 to
20 feet higher than any adjacent street. Road section currently serves as an
adjunct to the applicant's property.
II. Current Situation:
Apolicant desires to fully incomorate the land within this residual section of road
into the boundaries of his remaining property and to thereby remove and
eliminate this undeveloped (paper) roadway as an encumbrance upon his property
(tax nos. 5130511 through 5130515, inclusive). See attached subdivision plat.
City has no current or future plans to use this section of Wynne Road, S.W.
Limited size, location and grade of the road section renders it as an isolated and
impractical connection to any other adjacent City street.

properly effect changes in street and property lines.
Relationship to the comvrehensive plan. Request is consistent with the
intent of the comprehensive plan that available land should be used in the
most appropriate manner.

available land should be used in the most appropriate manner.

By a vote of 6-0 (Mr. Hill absent) the Planning Commission recommended approval of
Alternative A thereby recommending that City Council approve the applicant's request to
close and vacate the described section of Wynne Road, S.W., subject to the following
conditions:
The applicant shall submit to the City for its review and approval, receive
approval of, and record with the Clerk of the Roanoke City Circuit Court, a
subdivision plat, providing for the following:

subject right-of-way.
Ifa plat of subdivision is not approved by the City and recorded by the applicant
within a period of 12 months from the date of the adoption of the ordinanci~ for
the closure of the subject right-of-way, then said ordinance shall be null and void
with no further action by City Council being necessary.

THENCE along the east right-of-way of said Route 419,
S. 10 degs. 48' 53" W. 1.18 ft. to the POINT OF
BEGINNINg, being a point of curvature; thence with a
curve to the right having a radius of 40 ft. passing at
63.91 ft. of arc a found VDOT highway monument for a
total arc d/stance of 150.37 ft., having a delta o~ 215
degs. 23~ 09" and whose chord bears S. 10 degs. 48. 53"
W. 76.22 ft. to a point on the said east right-of-way
of ROute 419; thence along said east right-of-way N. 10
degs. 48. 53# E. 76.22 ft. to the POINT OF BEGINNING,
and containing 3,471 square feet as shown on a survey

John G. Rocovich, Jr., Trustee of QLC Land Trust, states
that the grounds for this application are as follows:
1. The Commonwealth of virginia property known as Virginia
Route 419, or Electric Road, adjoins the property to be vacated
on the West, and the Commonwealth of virginia can be notified of
this application by a notice addressed to Mr. J. A. Echols,
Resident Engineer, Virginia Department of Tran~portation, p. O.
Box 3071, Salem, VA 24153.
2. The applicant, John G. Rocovich, Jr., Trustee of. QLC Land
Trust, o~rns the property adjoining the property to be vacated on
all other sides.
3. The property to be vacated was dedicated as a street by a
subdivision plat recorded in Roanoke Cou~ty, Virginia in 1956.
In 1963, it was cut off from the remainder of Wy~ne Road by the
condemnation of the right of way for Route 419. Subsequently the
area was ~exed to the City of Roaxloke.
4. The ~xade of Route 419 is some 10 to 15 feet below the
~rade of W~-~ Road and WS~lne Road was therefore blockaded on the
west side of Route 419. The portion to be vacated has been
completely ~--ccesable from the portion of wy~-e Road lying on
the west of Route 419 since Route 419 was constructed. It is
unpaved and incL%stin~uishable on the ground from the remainder of
applicant' s resident/al property.
5. The applicant desires to have th/s paper street closed
so tha't the applicant can fully incorporate the property to be

WHEREFORE, John G. Rocovich, Jr., Trustee of QLC Land Trust
