weekly newspapers. It is an outsider's view of what has been accomplished
through our downtown planning processes dating back from 1979 through 1995.
We continue to receive rave reviews from both our own residents as well
as visitors to the Roanoke area. I look forward to the timely completion of the
pedestrian bridge, which will complete the current phase of the downtown
project.
Please know that we are beginning the process of selecting the
architectural and engineering firms for the rallside linear walk and are continuing
to discuss with the Virginia Museum of Transportation the city's challenge grant
of $812,000.

Roanoke
Last weekend, we visited downtown Roanoke. We were there for the
Virginia Press Association's advertising conference and had not been there
in a good eight or ten years.
Roanoke has less resources, less surrounding population and less archi-
tecture than Richmond. It has no Main Street Station, no MCV, no State
Capitol or no State Library (oops, Library of Vh'ginia) to anchor downtown.
It has no residential districts nearby of the scope of the Fan or Church Hill.
But last Friday night, downtown, the town was lively. It had that certain spirit
that amusing cities have, something that did not appear to be there ten years ago.
A few points:
1. Richmond is very spread out. Roanoke is not. Shockoe Bottom and the
Financial District, both successful, are far from each other. Shockoe Bottom
is busy at night, while the Financial District goes dead after five. Meanwhile
Friday Cheers happens many many blocks away, then dies. Patrons must
drive to get to the restaurants.
But in Roanoke, banks are near the "Festival Park" near the FLrst Union
building where outdoor concerts happen every Friday night in the sprin$ The
newly-renovated Hotel Roanoke is just across the ttaln tracks.
Richmond is like the cocktail paxty host who has the jazz band in one room,
the food in the other, the beer on thc porch, the host in the kitchen and the bar-
tender in the hall. If there ama't tons of people around, k seems like a lame par t~.
2. In Roanoke, the Greyhound braes go downtown, not out on the Boulevard. So
when buses arrive in Roanoke on their way to Tennessee, riders drive right
through the middle of town, with bands playing to the right at their Friday
concert. Plus, buses are concentrated in a downtown transport center. It is
all very European. (The cabs are yellow, too.)
3. Roanoke is clam. Richmond is dea2n but could be cleaner.
4. Roanoke Feds ~w. Not that Richmond doesn't have new parts.
Somehow, Roanoke seems newer.
5. Roanoke's First Union building has spirt. Most of the new buildings built in
downtown Richmond in the last decade have been boring. But the pointed,
almost gothic top to the First Union building electrifies the Roanoke skyline.
6. Doumtown Roanoke is diverse. There are redneck restaurants near to
Italian restaurants near to cutesy gift shops.
7. The neon dos aregreat. Forget the Mill Mountain star. The neon attrac-
tions in Roanoke are the Dr. Pepper and the H & C coffee signs that light
up the skyline of Roanoke, right smack in the midi:lie of downtown.
Richmond has some of the best, most historic, signs in the wodd. But the he
FFV and C.ESaner signs are away from downtown.
8. The Hotd Roanoke renovation is fantastic. From the restored knotty pine bar
to the ballrooms, the hotel looks better than even While ancient, the hotel
appears, at the same time, fresh and new again. There is no empty nostal-
gia in the renovation--the doormen are in Bermuda shorts, and couldn't be
friendlier. The front courtyard furniture even looked like it was from
Richmond's McKinnon & Harris. ,We plan to go back,
All of this comparison is not meant to make Richmonders pessimistic.
Instead, they indicate that Richmond has a giant downtown, and we must
do better to link the pieces of it together. It is not only what you have but
how you present it.

Chairman Nelson Harris and I have spoken this morning about the news article
involving the development of an ice rink in our area.
At the outset, we certainly hope that plans for the ice rink can continue to go
forward at the proposed Northside High School location in Roanoke County.
However, if for one reason or another the development of the rink in the County is
not feasible at this time, then we would jointly request that the School Board and the
Council ask the Superintendent and the City Manager to investigate the possibility
of the placement of the rink at a City school site or other City owned property.
We are quite aware of the importance of developing this practice rink for our Valley's
economic development efforts, as well as the Roanoke Express and the Youth Hockey
League. Certainly, if the City can be of any assistance in offering a site, we want
to make that offer known.
We respectfully request that this item be placed on the agenda of the next meeting
of the Council and School Board, respectively, and thereafter be referred to the
City Manager and the Superintendent for review and immediate recommendation.

REQUEST TO MEMBERS OF
ROANOKE CITY COUNCIL
FOR AN ORDINANCE AUTHORIZING AND IMPLEMENTING
A PERCENT FOR THE ARTS PROGRAM FOR THE CITY OF ROANOKE
Numerous localities in Virginia including Charlottesville,
Richmond, Virginia Beach, Alexandria, Chesapeake and Portsmouth
together with 27 states have adopted Percent for the Arts Programs.
In most of these programs, a percentage of the budget for capital
improvement projects is designated by ordinance to be used for the
inclusion of art or an artist in the capital project. As the cultural
center of Southwest Virginia, the City of Roanoke needs to build upon
its past efforts to include the arts as an integral part of life in
our city.
The City of Roanoke Arts Commission requests that the City
Council adopt an ordinance which would provide that 1% of the budget
of all capital improvement projects will be dedicated to either the
acquisition of art for that project and/or the incorporation of an
artist in the design portion of the project. This program would be
administered by the City of Roanoke Arts Commission. To a certain
extent the City is currently engaged in some level of funding for arts
in its capital improvement projects, i.e., Hotel Roanoke-Convention
Center, the Wells Avenue project and the Airport.
The reasons for this request and the benefits that the City will
receive from its investment are numerous and include:
(1) An overview and visual continuity of art in the appearance
of the City.
(2) Destination points and experiences for tourists.

(4) Fostering development of the arts
Roanoke's position as a center for the arts,
Enhancement of the livability of the City and the pride of

continue to have a dynamic impact on the economic viability of the

The City of Roanoke Arts Commission respectfully requests that
the members of City Council adopt in principle the concept of a
Percent for the Arts Program and direct the City Manager to work with
the Arts commission to appoint a committee consisting of city
employees and members of the arts and business communities which will
meet and formulate an ordinance for a Percent for the Arts Program
which will include provisions to achieve the above-stated reasons for
the Program as well as incorporating safeguards to insure the
appropriateness of the art to be included in the project as well as
financial considerations and guidelines for administration of the
Percent for the Arts Program funds.

Dear Ladies and Gentlemen:
As you are aware, Section 17(b) of the contract between the City of Roanoke, Roanoke
County, and the Airport Commission requires any capital expenditure over $100,000 be approved by
the Council of the City of Roanoke and the Board of Supervisors of Roanoke County.
This letter is to respectfully request that Roanoke City Council adopt a resolution approving
the capital expenditure by the Roanoke Regional Airport Commission of approximately $191,000
necessary to acquire one all wheel drive dump truck with a twenty-two foot (22') snow plow blade
and slip-in hopper/spreader which will add to the efficiency of our snow removal operations, and
complete our snow removal equipment acquisition program. A federal grant is expected in June
which would reimburse the Commission for 90% of the cost of the acquisition and State funds have
already been received to pay for the remaining 10% of said cost. Therefore, the City will not be
responsible for any part of the purchase price.
If you require any further information, I would be happy to supply it.

Subject: Purchase of Truck and Blade for Airport
Snow Removal
You will have received the attached request dated May 19,
1995 from Ms. Jacqueline L. Shuck, Roanoke Regional Airport
Commission (Commission) Executive Director, for Council's
approval to expend approximately $191,000 to purchase the subject
equipment. This vehicle is one of two vehicles approved by the
Roanoke Regional Airport Commission at its May 17, 1995 meeting.
One vehicle was approved by Council as part of the approval of
the 1994-95 Airport Operating and Capital Budgets and is
currently under the federal AIP grant program.
This second truck, and the subject of Ms. Shuck's request,
is part of the Commission's plan to upgrade the Airport's ability
to combat snow and ice storms as have been witnessed the past few
years.
This purchase will not involve any City funding. I
recommend approval as required by the agreement between the City,
Roanoke County, and Commission whereby the Commission was
created.

WHEREAS, Section 17.(b) of the contract between Roanoke
County, the City of Roanoke and the Roanoke Regional Airport
Commission provides that the Commission shall prepare and submit
for approval any proposed capital expenditure exceeding $100,000.00
to benefit five or more future accounting periods; and
WHEREAS, by letter dated May 19, 1995, a copy of which is on
file in the Office of the Clerk to the Board, the Roanoke Regional
Airport Commission has submitted a request that the County approve
a certain capital expenditure by the Commission for the purchase of
an all wheel drive dump truck with a twenty two foot (22') snow
plow blade in the total amount of $191,000.
THEREFORE, BE IT RESOLVED by the Board of Supervisors of
Roanoke County, Virginia that this Board hereby approves the
capital expenditure by the Roanoke Regional Airport Commission of

Subject: Council Briefing - Zoning Administration and Enforcement
I. Background:
Purpose of this correspondence is to provide you with an update of the
status of the City of Roanoke's zoning administration and enforcement
effort since this activity was transferred to the Department of Planning and
Community Development in July, 1993. This briefing will also include an
overview of some of the new enforcement procedures and initiatives that
have been or will be initiated in the near future.
Study prepared at the request of the City administration by the Institute for
Public Management in 1990 recommended several initiatives which have
been implemented to improve the City's development review and zoning
enforcement process.
Separation of the Building Commissioner/Zoning Administrator
position into two distinct and separate positions housed in two
separate departments gradually took place over two years. The
Building Commissioner, Ronald H. Miller, remained in the position
responsible for the administration of the Building Inspections
Department and Evelyn D. Dorsey, former City Planner in the
Planning Department, was appointed as the Zoning Administrator.
As part of this reorqanization, the following specific duties and
responsibilities were transferred to the Department of Planning and
Community Development:
Zoning enforcement and administration - involves receiving,
investigating, documenting, and following prescribed legal
(court) measures to correct or remedy such zoning code
violations throughout the community;

Serving as agent and technical support staff to the City
Board of Zoning Appeals - involves evaluating, receiving and
processing applications for variances, special exception use
permits, and zoning code interpretations; scheduling and
facilitating public hearings; preparing and maintaining all
records, minutes and orders of the Board.
Review of all basic development plans for single family and
duplex construction as well as minor residential, commercial
and industrial development additions; reviewing and
processing all sign permit applications with necessary liability
insurance documentation; updating and maintaining liability
insurance sign files; preparing zoning verifications for
Commissioner of the Revenue's Office for use in the
issuance or renewal of business licenses. Also serve as
enforcement and reporting agent to FEMA regarding the
enforcement of the City's floodplain development
regulations.
Through the Roanoke Neighborhood Partnership,
participating in the continuing public education program by
making presentations to various neighborhood, business and
civic groups regarding zoning and its enforcement
procedures.
II. Current Situation:
Operational chanqes resulted in the transfer of two (2) zoning inspectors
(formerly assigned to the Building Inspections Department), the hiring of a
full time secretary for the Zoning and Development Division and the
reclassification of a planning technician position to a zoning coordinator
position. In January of this year, another zoning inspector trainee position
was added to this division as a result of a position transfer within the
Public Works Directorate. Currently, the zoning division consists of a total
of six (6) positions, including 1 zoning administrator; 1 zoning coordinator;
2 zoning inspectors and 1 zoning inspector trainee and 1 secretary.
Locational chanqes were also made with respect to the entire department;
in order to expedite the "one-stop" shop development review and approval
concept. The Department of Planning and Community Development was
moved from the 3rd floor to the 1 st floor of the Municipal Building to
facilitate the close working relationship and convenience to customers of
the Building Inspections Department and the Planning, Development
Review and Zoning Department respectively. The departments were also

integrated into the computerized Building Permit and Inspection System in
addition to being connected to the Treasurer's Office so that applications
for various types of reviews and zoning or development permits could be
quickly processed and issued.
New enforcement procedures have been initiated as part of the
reorganization to improve the City's responsiveness to zoning violations:
"Instant" 10 day notice of zoning violation was created which
enabled the zoning inspector to immediately leave a written, official
notice to the property owner or tenant of the violation on the
premises. This "instant" notice left in the door of the property on
which the violation occurred and enables the property owner to call,
discuss and make arrangements for voluntary compliance without
the necessity of staff sending a certified letter, waiting 10 days for
response or property recheck and then negotiating with the
property owner on steps towards compliance and possibly citation
to court for legal action to require compliance. This procedure has
resulted in approximately 30% compliance or violation correction
without the additional time delay, costs or legal court action.
Documentation and file preparation has been revised and
improved. Zoning complaints are now received directly by one of
the zoning inspectors in this department and are logged manually
as well as in the computerized building and inspections system
without going through other City departments (i.e., the Citizens'
Request for Services Office) and then being transferred to this
office. This procedure has resulted in more efficient handling of
complaints by having someone familiar with the Code to be able to
discern what is a zoning violation and what is not and familiar
enough with the City organization to transfer that complaint to the
appropriate departments for response in a short period of time. For
the calendar year of 1994, 1029 complaints were called in by
citizens and processed through this system. Furthermore, a new
complaint/referral and inspection system has been created and
facilitated with the COPE units of the Police Department and has
been used to set up special task force enforcement efforts within
target areas of the community. During the calendar year 1994, 127
violations were referred by the COPE units.
Documentation of violations involve the use of colored photographs
and sometimes video tapes, based on the severity of the violation,
for use in court action. An inspection "checklist" has also been
created and added to the file to ensure that all required steps in the

enforcement process as well as documentation, i.e., copies of
notices, certified letters, photographs, property ownership
information and all other pertinent information, is included in the file
for court presentation. Files are now listed by address and tax map
number in lieu of property owner name for ease in cross
referencing by all enforcement inspections departments (i.e.,
Building/Housing, Health, Trash and Weeds).
Preliminary consultations with the Commonwealth Attorney prior to
court appearance has improved the communication, court
appearance presentation and conviction rate once legal
proceedings are underway. Durin(~ calendar year 1994, 109 zoning
violation cases were processed through the court system.
The conviction rate and penalties assessed are up approximately
70% from the pre-1993 era. For example, in 1992, a typical zoning
violation of outdoor storage (the keeping of miscellaneous items
outside of a building) in a residential area often resulted in a $25.00
fine, suspended if cleared up within 30 days after initial court
appearance. Now, a first time offense is usually a $250.00 fine with
the case being set aside for one (1) year if the violation has been
corrected by the date of court and is not repeated during the course
of that one year. If the violation still exists at time of court, some
fines have been as high as $500.00 in addition to a court order to
have the violation cleared up within 72 hours or face 3 days in jail
for contempt of court.
Informational meetings with neiqhborhood and business groups
have also assisted in code enforcement and voluntary compliance.
Once citizens are made aware of what comprises a zoning
violation, often they will correct the violation before a formal
complaint has been filed. Many neighborhood groups have also
designated Development Review Teams that coordinate with the
zoning and planning staff on zoning and development issues.
Roanoke Neiqhborhood Partnership Eyesore Alert Proqram, where
neighborhood organizations identify priority zoning and other Code
violations, assist with zoning enforcement by canvassing their
area, documenting the violations and forwarding their observances
to the Neighborhood Partnership Office. Furthermore, zoning tours
are scheduled and held with zoning enforcement staff resulting in
better communication and coordination between both parties.

Public education and dissemination of information has been
initiated through use of the local government access channel
(RVTV, Channel 3) with approximately 15 bulletins describing
typical zoning violations.
Formal traininq of the members of the Board of Zoning Appeals
was initiated in 1992. For the first time in the history of the Board,
all members and support staff attended and successfully completed
the Certified Board of Zoning Appeals Training Program sponsored
by VPI, the Virginia Citizen Planning Association and the Virginia
Department of Housing and Community Development. This
training program continues to provide members with the
background and skills necessary to perform their duties on the
Board and service to the community.
Total number of zoning violations reported by citizens, neighborhood
oraanizations, and other City departments and aqencie,~ resulted in an
increase in inspections of 51%, from 2,449 to 4,826, between 1991 and
1994.
Survey of neiqhborhood organizations conducted by Roanoke
Neighborhood Partnership staff in 1994 (attached) indicated that
enforcement of the City's zoning ordinance and other City Codes which
help eliminate "eyesores" and other blighting conditions in the City's
neighborhoods is a top priority. Specific concerns identified by
neighborhood leaders include: (1) storage of inoperative vehicles on
private property in residential neighborhoods; and (2) outdoor storage of
junk in residential areas. General concern was expressed regarding the
length of time required to bring violators requiring court action into
compliance with existing City Codes.
III. Recommendation:
More effective ordinances are needed to facilitate more efficient use of available
staff for zoning administration and enforcement.
To address the inoperative vehicle or "junk car" issue, other jurisdictions
throughout the Commonwealth were canvassed to determine: (1) if this was a
common concern; and (2) what had they done to address it. Many jurisdictions,
in response to recent enabling legislation, had adopted towing ordinances giving
the enforcement staff the authority (after proper notification) to remove vehicles
from private property and to be held in a secured storage area until either the
person remedied the violation or the City disposed of the vehicle. A draft towing

ordinance has been prpared by City staff and will be scheduled for your review at
the July 10 meeting of City Council.
With respect to "outdoor storage", the zoning ordinance was recently revised and
amended to set forth a clearer definition and the use districts in which this activity
is prohibited. As a result of recent court action, staff has been made aware that
these regulations need to be reevaluated again to address the storage of junk on
the front, side or rear porch of a home. Revisions to these code provisions will be
forwarded to City Council in the near future.
Finally, staff is preparing an amendment to the City's zoning ordinance which will
authorize the Zoning Division's inspectors to issue "tickets" for zoning violations
similar to tickets issued by the City's Police Department for traffic violations. The
authority to issue tickets will complement other enforcement activities and will
expand the options available to encourage compliance with the City's zoning
ordinance short of court action.
A "team approach" to enforcement of the City's land development regulations
and other Code requirements would be more effective in addressing more
serious problems. Quite often a single property may involve multiple Code
violations (Building Code, Zoning Ordinance, Health Code, etc.) requiring action
by a number of City departments to address the problem. The City
administration is currently evaluating the feasibility of creating a "neighborhood
impact team" involving representatives of selected City departments to meet on a
regular basis to exchange information and to more effectively coordinate
enforcement efforts involving more serious neighborhood eyesores and/or repeat
violators.
In closing, continued improvement of the administration and enforcement of the
City's zoning program will have decisive and long term effects on the City's future
growth and prosperity. As we clean up and improve the overall aesthetics of the
community, the potential for new infill development and property improvements
in residential, commercial and older industrial areas is greatly enhanced.
Representatives of the Department of Planning and Community Development will
present Council with information concerning the City's zoning enforcement efforts
at your meeting on June 12, 1995. We will welcome any questions you have
concerning the above information.

1994 Neighborhood Eyesore Survey
Report of Results
Purpose
The City is exploring ways to improved the way it deals with neighborhood eyesores.
The Neighborhood Eyesore Survey was intended to get an idea of the priorities under which
the City should address these issues so those high priority items are addressed first.
Method
The survey was administered at the Neighborhood Officer Appreciation Dinner held in
March of 1994. While the survey was far from scientific, its intent was to establish priorities
and not to provide a detailed analysis. Surveys were distributed to about 80 persons attending
of which 28 individuals (about 35%) responded. Individuals were from thirteen
neighborhoods. The survey consisted of three questions concerning neighborhood appearance
and how it was addressed by the neighborhood.
Priorities
Participants were asked to list the top eyesores which hurt the appearance of their
neighborhoods. Results are shown in Figure 1. The most often cited eyesores were vacant
lots and the associated weeds and trash (27%). Open storage of junk (15 %) and junk vehicles
(12 %), both zoning violations, followed as top eyesore problems. Dilapidated houses were
next on the list. Participants cited problems with poor maintenance of occupied housing (10%)
as well as vacant, boarded up houses (7%). Respondents felt that some decisions of the ARB,
BZA, and Planning Commission negatively affect neighborhood appearance.

Neighborhood Involvement
Respondents listed how their neighborhood organization addresses these problems. As can be
seen in Figure 2, the most common way to deal with eyesores is to turn them in to the city
either through the RNP's Eyesore Alert Program or directly to the appropriate departments.
Some neighborhoods make a policy of approaching the property owner directly and asking
them to correct the eyesore. Several neighborhoods sponsor regular neighborhood cleanups.
The responses from the Northwest Neighborhood Environmental Organization
(NNEO) demonstrate a comprehensive approach to deal with vacant houses and lots. NNEO
purchases dilapidated, vacant houses and rehabilitates them for purchase or rent by
low/moderate income families. If a structure is not suitable for rehabilitation, it is
demolished. Volunteer and hired workers maintain vacant lots in the neighborhood. Like

Improving City/Neighborhood Effectiveness
The survey asked how the City and neighborhood organizations could be more effective
in clearing eyesores from a neighborhood. Twenty-eight responses covered a range of
suggestions and grouped into three broad categories: (a) improved enforcement of City codes,
(b) neighborhood makes initial contact to address problem, and (c) improvement or change in
City services. It should be noted that there were many excellent suggestions to improve
effectiveness. With a relatively small number of responses (28), important suggestions were
listed as single responses.

Conclusion
The top concerns can be addressed, at least from the perspective of neighborhoods, by
strengthening codes and making enforcement more effective. There seems to be a frustration
that "hands are tied" and that enforcement often takes too long or no progress is made. Efforts
for improvement should be concentrated on vacant lot maintenance, outdoor junk storage,
inoperative vehicles, and building maintenance.
Neighborhoods see willing to participate, if they are not already in the process of
eliminating eyesores. This participation may be on different levels. People may identify
eyesores and either turn them in to the City for handling or they may make the initial contact
with the property owner. Still others take it upon themselves to actually physically remove
eyesores.
The purpose of the survey was met as neighborhoods could identified some of the top
eyesore concerns. Responses indicated that neighborhoods believe the City should work to
strengthen ordinances and enforcement as a strategy to address these concerns. Results also
give insight into how city/neighborhood partnerships can be used for effectively eliminating
eyesores.

year per state.
The City of Roanoke En.q neer ng Department has applied for funding of
some of its mapping activities under the Planning Assistance to States
Program. Representatives of the USACOE have stated that the City of
Roanoke can expect available funding in the amount of $100,000 in the
next year to support mapping activities.
The City of Roanoke, in coordination with the USACOE, has developed
a multiple year mapping program to provide the following map products
and associated total costs. The following figures include all
administrative costs of the USACOE.

each deed book is stored off-site.
D. A backun coov does not exist for 550 deed books which contain 300,000 pages and cover
the period from 1948 to 1965.
Vital information recorded in the deed books could be lo~t as a result of deterioration from
age and constant public use.
Direct microfilmine is not a viable ontion for creatine a backup copy due to the uncertainty
of successfully capturing an image of the contents of the deed books.
A backup coov can be created by ootically scanning the contents of each deed book and
transferring the optical image to microfilm.

Dear Mayor Bowers and Members of Council:
I. ~ on the subject in chronological order is as follows:
Workers' Corn ensation is defined exclusive remedy, under law, for all
covered employees for compensating injuries and occupational diseases
arising in the course of and within the scope of employment."
B. City is entirely self-insured for Workers' Compensation liability.
Funding has been budgeted for the current fiscal year to cover workers'
compensation wage and medical payments.
These types of fi'inge benefits are budgeted as a lump-sum in the non-departmeptal
category because annual charges for each department are difficult to accurately
project.
Current Situation is as follows:
Workers' compensation expenditurea for fiscal year 1994-95 are projected to be
$600,000. This information is based on actual expenditures through April 30,
1995 and projected expenditures for May and June, 1995 (see Attachment A).
Funding to cover FY 1994-95 Workers' Compensation claims is adequate and
needs to be allocated to departmental accounts from the non-departmental
category.

Grant monies totaling $80,000 have been allocated by the Roanoke
Redevelopment and Housing Authority (hereafter referred to as the
"Authority") to enhance Roanoke City Police C.O.P.E. (Community-
oriented Pohcing Effort) activities on property managed by the Authority.
Supplemental police service contract has been negotiated between the
City and the Authority to furnish police services in addition to baseline
police services at selected Authority locations.
Purpose is to create a drug_- and crone-free environment and to provide for
the safety and protection of the residents in its public housing
developments.
Most services in the Contract are already being performed by C.O.P.E.
officers. Additional services include acting as legal agents for the
Authority in the enforcement of Authority roles and regulations for ten-
ants and to assist or advise in the planning and implementation of other
grant-funded security programs within the Authority.

Contract Time Frame will be made retroactive to April 1, 1995,
and will be in effect for 24 months.

CONTRACT FOR THE PROVISION OF
SUPPLEMENTAL POLICE SERVICES
This Contract, made and entered into this __ day of 19
by and between the City of Roanoke Redevelopment and Housing A~thorit~
(hereinafter called the "Authority',) and the City of Roanoke (hereinafter
called the "City") is for the provision of specific police services
associated with the Authority,s security programs.
WHEREAS, the Authority desires to contract with the City for additional
police services to create a drug- and crime-free environment and to provide
for the safety and protection of the residents in its public housing
developments; and
WHEREAS, the City, by and through its police department, desires to
assist in the effort by providing effective police services at selected
Authority locations as agreed upon by the Authority and the City of Roanoke;
NOW, THEREFORE, the Authority and the City agree as follows:
ARTICLE I
Scope of Services
SECTION ONE: SERVICES PROVIDED BY THE CITY
"The City agrees to furnish services to the Authority pursuant to this
agreement, which services are in addition to baseline police services, and
which will provided by the City through police department personnel, both
police and civilian, hereafter referred to as "Assigned Personnel". The City
agrees that it will not reduce its current level of police services to the
public housing developments, particularly in the areas of community policing,
patrol, criminal investigations, records, dispatch and special operations
during the term of this Contract.
The manner and method of performance of services is specified in Article
IV, Plan of Operations.
The duties and extent of services of the Assigned Personnel shall
include, but shall not be limited to:
The City, by and through its police department, will provide a minimum
of 15 police officers to perform specialized patrols to enforce all
state and local laws and the Housing Authority Rules specified in this
Contract. Sworn officers shall at all times remain part of, subject to
and in direct relationships with the police department's chain of
command and under police department rules, regulations and standard
operation procedures.

SERVICES PROVIDED BY THE CITY (Continued)
The City agrees to assign police officers to the targeted areas during
specific periods of time identified by research conducted by the COPE
Unit and agreed upon by the Authority as high crime or high workload
periods in the designated areas.
The City agrees that the police department will employ a community
policing concept and that the police department's Crime Prevention Unit
(or other unit whose primary responsibility is to develop and maintain
communications with residents) will assist in developing or enhancing
crime preventions programs in the public housing communities.
The City agrees to collect and provide workload data in the Authority's
public housing developments.
It is further agreed that to the extent necessary, the Assigned
Personnel will appear as witnesses in the Authority's administrative
grievance procedure, civil dispossessory hearings, or other civil or
criminal court proceedings where the issue includes criminal or quasi-
criminal conduct in or near public housing developments involving any
resident, member or a resident's household, or any guest or guests of a
resident or household member.

Without limiting any of the foregoing, the City agrees that with respect
to the services to be performed by any police personnel in accordance
with this Contract, the appropriate police department Patrol Commander
or Supervisor will meet with resident leadership and management
representatives of the Authority on a routine basis for the purposes of
reviewing the enforcement and prevention efforts and planning for future
changes or modifications anticipated by this Contract. These meetings
shall occur at least quarterly.
The City agrees that a policy and procedures manual exists to regulate
police officers' conduct and activities and all officers assigned to
Authority areas have met the Department's mandated training in the
content of those manuals.
The City agrees that it will provide the Assigned Personnel with such
basic equipment as may be necessary and reasonable in order to allow the
police officers to carry out the duties anticipated under this Contract.
Any additional automobiles, motor vehicles, bicycles or other equipment
requested by the Authority will be furnished at the expense of and shall
remain the property of the Authority. The Authority and City may
mutually agree to lease equipment or vehicles.
The police department will provide at a minimum sixteen (16) hours of
training on community relations and interpersonal communications skills
to all assigned officers.

The police department shall designate a command officer as the
Administrative Liaison Officer, who will work in concert with the
Executive Director of the Authority or that official,s designee.
The Administrative Liaison Officer will perform the following duties:
Coordinate the dissemination and processing of police and
security reports, provide supervisory assistance, and
coordinate in resolving problems or in carrying out the
provisions of this Contract;
Establish and maintain an ongoing line of communications with
Beat/Zone Commanders and other police personnel;
Prepare quarterly progress reports and evaluations of services
requested and provided under this Contract for review by the
Executive Director, the Police Chief, appropriate Deputy
Chiefs and Beat/Zone Commanders and identified community
representatives;
Initiate and monitor ongoing lines of communication with
resident leaders to effectively employ the community policing
concept and to address in a timely manner concerns raised by
community leaders;
5. Coordinate security workshops and training seminars for
identified residents;
6. Assist or advise the planning and implementation of other
grant-funded security programs within the Authority; and
7· Establish a clearly defined process for reporting non-
emergency criminal activities.
The City will at all times provide supervision, control and direction of
work activities and assignments of police personnel, including
disciplinary actions. It is expressly understood that the police
department shall be responsible for the compensation of the officers and
all employee benefits, as well as any injury to officers, their
property, or the City's property while on the Authority,s property.

Department of Criminal Justice Services (DCJS) of the Commonwealth of
Virginia

The city will provide copies of citizen complaint forms to be utilized
by any resident wishing to complain about police actions.
SECTION TWO: SERVICES PROVIDED BY THE AUTHORITY
The Authority will provide training of residents, Authority on-site
management staff and the Assigned Personnel with workshops on community
policing and crime prevention issues associated with public housing.
This shall include, but not be limited to, training in the following:
1o Crime prevention and security responsibilities;
2. Community organization/mobilization against the causes of and
precursors to crime;
Drug awareness and control;
4 o
Orientation and familiarization with the public housing communities
for the assigned officers; and
Orientation to the lease contract, and lease compliance enforcement
procedures and policies.
Accommodations - The Authority will provide suitable space to be used
at each site targeted for additional police services as needed.

officers are hereby authorized to give criminal trespass warnings to any
persons found in violation of said rules or regulations, i.e., to give
notice to any violators that their entry on the property or premises is
forbidden, and to arrest or cause the arrest and prosecution of any
violators, when appropriate.
The City, through its police officers, is hereby empowered as the agent
of the Authority to enforce the following Authority rule or regulation:
The tenant and any visitors to Authority property and premises
shall refrain from, and shall cause their households to refrain
from parking vehicles in any area other than legal parking areas
designated by Authority management.
With regard to the forgoing rule or regulation, the City's police
officers are hereby authorized to have removed any and all vehicles
found parked in violation of said rule or regulation, pursuant to
established City procedure for impounding vehicles.
The City, through its police officers, is hereby empowered as the agent
of the Authority to enforce such additional Authority rules and
regulations and perform such other duties as shall be specified in any
addenda attached hereto or incorporated herein now or in the future.
Nothing herein contained shall be construed as permitting or authorizing
police officers to use any method or to act in any manner in viola5ion
of law or of their sworn obligation as police officers.

ARTICLE III
Communications, Reporting and Evaluation
A. Communications
Access to Information
The City agrees that the Authority will have access to all public
information which in any way deals with criminal activity in any of
the housing units under the Authority,s control. It is further
agreed that the City police department will provide to the
Authority information of such incident reports, arrest reports or
other public documents which substantiate actual or potential
criminal activity in or connected with the public housing
developments. This information will be provided at no cost by the
City police department on a regular basis in accordance with
specific procedures that have been or will be established.
Reports concerning arrests of juveniles shall only be reported to
the Authority on the basis of an existing court order allowing such
release.
B. Reporting

The Authority shall be given access to review cumulative figures of
the daily work logs which are completed by each assigned officer at
the end of each shift.
2. Media Coordination
The police department will promptly relay to the Executive Director or
her designee information related to any major crime or incident that
occurs on Authority property, preferably before the media is informed,
or as soon as possible thereafter.

The City and the Authority agree that any evaluation shall include:

It is further agreed that the City will provide comparable crime
information for the City as a whole to facilitate the evaluation to
include what proportion of activities City-wide occur on Authority
property.
ARTICLE IV
Plan of Operations
The City and the Authority shall prepare a detailed plan of operations
for use in elimination of drug-related crime. The purpose of the plan
is to specify the manner and method of performance by which each of the
services identified is to be administered.
The plan of operations will minimally specify the following:
Service goals and minimum performance criteria (e.g., definition of
what is to be achieved and the expected benefits or outcomes that
will be derived);
2. Staffing levels;
3· Responsibilities of key personnel;

Organization and resources, to include personnel, equipment, in-
kind support, etc.;
5. Hours of operation, to encompass schedules of major tasks and
activities; and

Community interface to evidence the methodology by which resident
involvement will be gained and maintained during the term of this
Contract.
The plan operations will be prepared for review and acceptance within
thirty (30) days from the date of execution of this Contract by both
parties. It is understood that the Authority may request reasonable
modification to the initial plan of operations as it deems appropriate.
The Authority must approve the plan in order for payment to begin.
If during the term of the Contract either party desires to amend the
scope of the plan of operations, either party may request such an
amendment via written notification to the other. The Executive Director
of the Authority and/or the Chief of Police shall provide final
determinations regarding the establishment of an amendment to the plan
of operations.
ARTICLE V
Term of Contract
The term of this Contract shall be for two

The Authority will reimburse the City for services specified in this
Contract in a total amount not to exceed forty thousand dollars

The Authority shall reimburse the police department on a quarterly
basis, upon receipt of performance of the proposed services and evidence
of authorized expenditures. The billing period will be retroactive to
April 1, 1995.
C. The City shall provide the following documentation in requesting
reimbursement:
Copies of Certified Payroll Time Reports documenting names,
employee identification, hours worked in public housing
developments, supervisory approval of the report, and supervisory
verification of the necessity for any overtime worked.
Copies of receipts for other allowable communications and other
miscellaneous expenses shall be subject to pre-approval, and shall
be accompanied, at the time of reimbursement request, by a brief
explanation of the expense incurred.
Ail requests for reimbursement are subject to the approval of the
Executive Director, or that official's designee, and the Authority shall
thereafter make payment of the approved amount within thirty days of
receipt of the request for reimbursement.
ARTICLE VII
Termination
This agreement may be terminated, at any time and for any reason by either
party hereto, upon the giving of thirty (30) days written notice to the
other party. Such notice shall be deemed to be given if sent by certified
mail, return receipt requested, to the address specified in Article VIII.
The termination shall become effective upon the expiration of thirty days
from the date of the said notice.

Any notices required pursuant to the terms of this Contract shall be
sent by United States Certified Mail, return receipt requested, to the
principal place of business of each of the parties hereto, as specified

Mayor and Members of Council:
I. Background
The demand for HIV/Aids related services is growing in
Roanoke City.
In 1989t 36 patients with HIV/Aids were known to
the Health Department. As of January, 1995, over
600 patients have sought services through the
HIV/Aids Program.
Roanoke City Health Department is one of twenty-
two designated anonymous test sites in Virginia.
The clinic is open every Monday from 3 p.m. to 6
p.m. HIV testing is offered at no charge. In
1990 - 578 were tested, 1991 - 820 were tested,
1992 1,399 were tested, 1993 - 922 were tested,
1994 853 were tested.

The Aids Council of Western Virginia has provided case
management services in the past to several patients
within Roanoke City. However, their updated service
plan states client services will be phased out.
The responsibility for client services will rest in the
HIV/Aids Program at the Roanoke City Health Department.
Services will be provided to clients from jurisdictions
to be served including Roanoke City, Roanoke County,
City of Salem, Botetourt County, Craig County and
Allegheny County in the Fifth Planning District.
II. Current Situation
The Roanoke City Health Department was awarded a grant
for $32~000 in 1993 from the Bureau of Sexually
Transmitted Disease/Aids with the Virginia Department
of Health to address case management service needs.
This grant was again awarded to the Roanoke City Health
Department for $35~000.
The Roanoke City Health Department has a limit on the
number of full-time classified state positions to
establish this position.

either party to make commitments which will bind the other party
beyond the Scope of Service contained herein. Furthermore, RAHD
shall not assign, sublet, or subcontract any work related to this
Agreement without prior consent of the Bureau of STD/AIDS. This
Agreement is subject to appropriation or allocations by state
government.
TERMINATION:
1. This Agreement may be cancelled by either party by giving
30 days written notice to the other, or
2. This Agreement shall be cancelled automatically in the
event state government fails to appropriate or allocate sufficient
funds for the purpose of continuation of this Agreement.
3. In the event of breach by RAHD of this Agreement, the
Bureau of STD/AIDS shall have the right immediately to rescind,
revoke, or terminate the Agreement. In the alternative, the Bureau
of STD/AIDS may give written notice to RAHD specifying the manner
in which the Agreement has been breached. If a notice of breach is
given and RAHD has not substantially corrected the breach within 30
days of receipt of the written notice, the Bureau of STD/AIDS shall
have the right to terminate this Agreement.
INTEGRATION AND MODIFICATION:
This Agreement constitutes the entire Agreement between RAHD
and the Bureau of STD/AIDS. No alteration, amendment or
modification in the provisions ofthis Agreement shall be effective
until it is reduced to writing, signed by the parties, and attached
hereto.
Signature of this Agreement by both parties constitutes mutual
agreement to all terms and conditions provided herein.

SUBJECT:
Funding for the Fifth District Employment and Training
Consortium
BACKGROUND
City of Roanoke is the qrant recipient for Fifth District
Employment and Trainin~ Consortium (FDETC) fundina. City
Council must appropriate the funding for all grants and
other monies the FDETC receives.
II.CURRENT SITUATION
A. Governor's Employment and Traininq Department (GETD) has
sent to the Consortium Notices of Award and adjustments
for programs which include on-the-job training, work
experience, job related education, classroom training,
job placement activities, and remedial education in the
following amounts:
Title II-B Summer Youth - $352,410.00.
(Notice of Award 95-03-05), will be used to provide
work experience and remedial education to
approximately 376 youth. (An additional award of
$97,916.83, is to be distributed by the GETD after
July 1, 1995.)
Title II-B Summer Youth Carry In Allocation from
program year 1994, $55,397.00. (Notice of Award
94-03-09).
Title III-F (Dislocated Workers) $22,000.00.
(Notice of Award E-05), will be used to supplement
current allocations for tuition expense.

Virqinia Employment Commission has notified the
Consortium of a $15,000.00 award for the 4th
quarter of PY 1994 Profiling Project. These funds
will be used to serve approximately 33
individuals. These individuals will be assessed
as being in need of intensive reemployment
services and/or retraining in order to return to
gainful employment.
Jurisdictions in the Fifth Planning District, (which
include the cities of Roanoke, Salem, Clifton Forge, and
Covington, as well as the Counties of Roanoke, Alleghany,
Botetourt, and Craig), were requested by the FDETC to
contribute a total of $23,018.23, to offset the agency's
administrative costs. To date, allocations totalling
$10,762.00 have been confirmed from four of the
participatingjurisdictions,(Botetourt,Covington,Roanoke
County and Salem) Contributions of $1,603.99 received
from Alleghany and $250.00 received from Craig County
will bring the total jurisdictional allocation to
$12,615.99.

Transfer of Appropriations for Employee Fringe Benefits
The fiscal year 1994-95 General Fund included funds in the
nondepartmental category for payment of termination (vacation) leave and
unemployment wages. These types of employee fringe benefits are budgeted at
estimated amounts in the nondepartmental category because annual charges for each
department are difficult to accurately project. The actual costs are charged to the
applicable department in anticipation of budget transfers to cover these costs.
The attached budget ordinance transfers funds between departments and
from the nondepartmental category to the applicable departmental budgets. A
summary of the total transfers in the attached budget ordinance is as follows:

Appropriations Transfer of Internal Service Funds Charges Funds
The City of Roanoke's Internal Service Funds account for certain services
provided to departments of the General Fund. The service providing departments
within the Internal Service Funds recover their costs by charging the receiving
departments.
Budgeted funds for internal services are allocated in each fiscal year's
budget throughout the various departments based on estimated usage. Usage usually
varies from the original estimates. Each fiscal year at this time it is necessary to
make appropriation transfers between several of the departments to provide sufficient
funds for internal services for the remainder of the fiscal year. These transfers do not
increase the original overall budget, but only reallocate amounts between
departments.
The attached budget ordinance will accomplish the required transfers.

Closeout of Community Development Block Grant Year
(B-92-MC-51-0020)
The Community Development Block Grant program is accounted for on
the City's financial records by program year. Three years are currently appropriated.
HUD allows localities to determine the number of CDBG program years
to retain on their records. Reprogramming these funds allows the City to maintain a
minimum number of program years on its records. The earliest Community
Development Block Grant year (B-92-MC-51-0020) may be closed by reprogramming
the unspent funds in this program year to the next subsequent program year, (B-93-
MC-51-0020). These unspent funds totaling $244,147 will be appropriated to the
same activities for which they are currently appropriated.
Recommendations:
Transfer unspent funds of $ 244,147 to Community Development Block
Grant year B-93-MC-51 -0020 as shown on the
accompanying budget ordinance.
· Close Community Development Block Grant year B-92-MC-51-0020.

I. Backqround on the subject in chronological order is as follows:
LR-5 Sewer Replacement is part of the City of Roanoke's ongoing
Infiltration/Inflow (1\1) program as required by Special Consent Order
dated August 10, 1992.
Proiect was properly advertised and bids were publicly opened and
read aloud by D. Darwin Roupe, Manager of General Services, on
Tuesday, May 9, 1995, for Lick Run Sewer Replacement Project LR-5.
Six (6) bids were received with J. P. Turner and Brothers,
Incorporated, submitting the Iow bid in the amount of $246,055.00.
Sewer Replacement Proiect LR-5 will reduce the groundwater
infiltration into the sewer system.
II.
Current situation is as follows:
A. Sewer replacement proiect has been bid and now needs to be
constructed.
B. Project consists primarily of replacinq 2,800 feet of sewer line along
its existing alignment and profile and restoring all disturbed areas to a
satisfactory condition. The project is located within the Fairland Lakes
area.

IV, Alternatives in order of feasibility are as follows:
Authorize the City Manager to execute a unit price contract in a form
approved by the City Attorney, with J. P. Turner and Brothers,
Incorporated, in the amount of $246,055.00 with 150 calendar days
for completion with a project contingency of $25,000.00 and
$5,000.00 for interfund billing for contract administration and
inspection.
Cost is 9.8% higher than the Engineer's estimate but was
competitively bid and is considered reasonable.
Fundinq is available in the Sewer Fund Retained Earnings
account.
Do not authorize the City Manaqer to execute a contract with J. P.
Turner and Brothers, Incorporated.
1. Cost would be based on future bids.
Funding would remain in the Sewer Fund Retained Earnings
Account.
V. Recommendation is as follows:
City Council concur in Alternative "A" and take the following actions:
Authorize the City Manager to execute a unit price contract with J. P.

AN ORDINANCE to amend S36.1-3, Code of the City of Roanoke
(1979), as amended, and Sheet No. 308, Sectional 1976 Zone Map,
City of Roanoke, to rezone certain property within the City.
WHEREAS, Berglund Chevrolet, Inc., has made application to the
Council of the City of Roanoke to have the hereinafter described
property rezoned from RM-1, Residential Multi-family, Low Density
District, to C-2, General Commercial District; and
WHEREAS, the City Planning Commission, which after giving
proper notice to all concerned as required by S36.1-693, Code of
the City of Roanoke (1979), as amended, and after conducting a
public hearing on the matter, has made its recommendation to
Council; and
WHEREAS, a public hearing was held by City Council on said
application at its meeting on May 8, 1995, after due and timely
notice thereof as required by S36.1-693, Code of the City of
Roanoke (1979), as amended, at which hearing all parties in
interest and citizens were given an opportunity to be heard, both
for and against the proposed rezoning; and
WHEREAS, this Council, after considering the aforesaid
application, the recommendation made to the Council by the Planning
Commission, the City's Comprehensive Plan, and the matters
presented at the public hearings, is of the opinion that the
hereinafter described property should be rezoned as herein
provided.
THEREFORE, BE IT ORDAINED by the Council of the City of
Roanoke that S36.1-3, Code of the City of Roanoke (1979), as
amended, and Sheet No. 308 of the Sectional 1976 Zone Map, City of

I. Back~round:
Request from Berglund Chevrolet, Inc., represented by Daniel F. Layman,
Jr., attorney, that property located on Maddock Avenue, beating Official
Tax Nos. 3080812-3080814, inclusive, be rezoned from RM-1,
Residential Multifamily District, Low Density District, to C-2, General
Commercial District.
Purpose of the rezoning request is to place the subject lots into a zoning
classification that would permit the expansion of the adjoining automobile
dealership business onto the property. Previously rezoned lots have been utilized
as an automobile storage lot. The existing single family residences will be
relocated by the applicant to other residential areas within the community.
B. Petition to rezone was filed on March 10, 1995. Petition was unconditional.
Planning Commission and City Council approved a similar rezoning request from
the applicant for two (2) lots on the north side of Maddock Avenue in May and
June of 1994. Previous rezoning request for lots on Maddock and Noble Avenues
were approved in 1973, 1979, 1985, 1993 and 1994.
Planning Commission public hearim, was held on April 5, 1995. Mr. Dan
Layman, attorney for the petitioner, summarized the application. Mr. Layman
indicated that the petitioner was withdrawing from consideration for rezoning, the
two lots fronting on Noble Avenue, designated as Official Tax Nos. 3080803 and
3080804. Mr. Layman said that the applicant would like to complete the closure
of Maddock Avenue and rezone the remaining three lots on Maddock Avenue to
commercial.
In response to a question from Mr. Chfisman, Mr. Layman indicated that curb
and gutter along Noble Avenue would be addressed by the City as part of the site
plan review process. In response to a question from Mr. Butler, Mr. Layman

indicated that the two lots requested for rezoning on Noble Avenue were
withdrawn in response to staffconcerns. Mr. Layman indicated that Berglund
would try to acquire the remaining lots on Noble Avenue and come back to the
Commission at a later date.
Mr. Maflles gave the stalTreport indicating that most of the staffs concerns were
related to the lots requested for rezoning on Noble Avenue. Mr. Marlles stated
that staff was recommending approval of the rezoning of the three lots on
Maddock Avenue.
First Amended Petition to Rezone was filed on April 19, 1995, deleting the two
lots on Noble Avenue from consideration.
II. Issues:
Zoning of the subject property is RM-1, Residential Multifamily, Low Density
District. The surrounding zoning patter in the area is as follows: to the north
along Noble Avenue is RM-1, Residential Multifamily, Low Density District; to
the south is C-2, General Commercial District; to the east and west are a
combination of RM-1 and C-2.
Land use of the subject area is currently three (3) single family residences.
Surrounding land uses in the area are as follows: to the north along Noble
Avenue are single family residences; land uses to the east and west include the
existing automobile dealership and a City fire station.
Access to the property is from the two adjoining public streets, Noble and
Courtland Avenues. Given the proposed development of the three lots as part of
the adjoining automobile sales dealership, no traffic impacts are anticipated.
Potential traffic impact from possible C-2 uses has not been determined.
Neighborhood organizations are the Williamson Road Action Forum and the
Williamson Road Area Business Association. The Planning Department notified
both organizations in writing of the rezoning request and as of the writing of this
report no comments have been received by this Department. The Planning
Department has received calls from property owners expressing the following
concerns: (1) possibility of noise; (2) possibility of additional access driveway
onto Noble Avenue; (3) exterior lighting; and (4) landscaping and buffering of
proposed use from adjacent residential neighborhood. Neighborhood concerns
were addressed when the petitioner withdrew from consideration the two lots
(Official Tax Nos. 3080803 and 3080804) fronting on Noble Avenue that were
originally part of this rezoning request.
E. Comprehensive Plan recommends that:

Zoning of the subject property would be C-2, General Commercial
District, unconditional, and the proposed use and development of the three
lots as part of the adjoining automobile sales dealership would be allowed
to take place.
Land use would become part of the adjoining automobile dealership
business.
Access and traffic. Access to and from the site would be by way of Noble
Avenue and Courtland Avenue. No traffic impacts are anticipated from
the proposed incorporation of the three lots into the adjoining automobile
sales facility.
4. Comprehensive Plan issues as set forth would be addressed.
B. City Council deny the rezoning request.
Zoning of the subject property would remain RM-1, Residential
Multifamily, Low Density District. The proposed expansion of the
adjoining commercial activity onto this property would not be allowed to
occur.
2. Land use would remain the same.
3. Access and traffic would not be an issued.

(1) Petitioner Berglund Chevrolet, Inc. is the owner of
three (3) lots in the City of Roanoke located on the north side
of Maddock Avenue, N.E. between Williamson Road and Courtland
Road, bearing City of Roanoke Official Tax Nos. 3080812, 3080813,
and 3080814. A portion of City Appraisal Map Sheet 308 showing
these lots is attached to this petition as Exhibit A.
(2) Pursuant to Section 36.1-690, Code of the City of
Roanoke (1979), as amended, petitioner requests that parcels
3080812, 3080813, and 3080814 be rezoned from RM-1, Residential
Multifamily, to C-2, General Commercial District, so that
petitioner may extend its motor vehicle dealership business, now
conducted on nearby property, to those lots.
(3) Petitioner believes that the requested rezoning will
further the intent and purpose of the City's Zoning Ordinance and
Comprehensive Plan by continuing the logical extension of an
existing C-2 district, in accordance with intentions previously
made known to the City. The three subject lots are among a small

group of lots that form a peninsula of residentially zoned land
extending between a Light Manufacturing district on the west
(site of the City garage) and a Commercial (C-2) district on the
east, site of petitioner's existing facility. A number of lots
in this same area were rezoned at petitioner's request in
December 1993 and June 1994, in order to make possible the
expansion of its facilities now in progress. Since that
rezoning, petitioner has acquired additional lots and wishes to
include them in its expanded dealership facility.
(4) Squeezed as they are between industrial and commercial
districts, these lots are better suited to commercial than
residential use. The requested rezoning will therefore continue
the logical extension of a commercial district as earlier begun,
and in doing so assure the continued viability of a major
business operation.
(5) Attached to this petition as Exhibit B is a list of the
names and addresses of the owners (other than Berglund Chevrolet
and the City of Roanoke) of all lots immediately adjacent to or
across a street from the property to be rezoned, together with
the Official Tax Number of each lot.
W~EREFORE, petitioners request that the parcels bearing City
of Roanoke Official Tax Nos. 3080812, 3080813, and 3080814 be
rezoned from RM-1 to C-2 in accordance with the provisions of the

(1) Petitioner Berglund Chevrolet, Inc. is the owner or
contract purchaser of three (3) lots in the City of Roanoke
located on the north side of Maddock Avenue, N.E. between
Williamson Road and Courtland Road, bearing City of Roanoke
Official Tax Nos. 3080812, 3080813, and 3080814, and of two (2)
lots located on the south side of Noble Avenue, N.E., also
between Williamson Road and Courtland Road, bearing Official Tax
Nos. 3080803 and 3080804. A portion of City Appraisal Map Sheet
308 showing these lots is attached to this petition as Exhibit A.
(2) Pursuant to Section 36.1-690, Code of the City of
Roanoke (1979), as amended, petitioner requests that parcels
3080812, 3080813, 3080814, 3080803, and 3080804, be rezoned from
RM-1, Residential Multifamily, to C-2, General Commercial
District, so that petitioner may extend its motor vehicle

dealership business, now conducted on nearby property, to those
lots.
(3) Petitioner believes that the requested rezoning will
further the intent and purpose of the City's Zoning Ordinance and
Comprehensive Plan by continuing the logical extension of an
existing C-2 district, in accordance with intentions previously
made known to the City. The five subject lots are among a small
group of lots that form a peninsula of residentially zoned land
extending between a Light Manufacturing district on the west
(site of the City garage) and a Commercial (C-2) district on the
east, site of petitioner's existing facility. A number of lots
in this same area were rezoned at petitioner's request in
December 1993 and June 1994, in order to make possible the
expansion of its facilities now in progress. Since that
rezoning, petitioner has acquired additional lots and wishes to
include them in its expanded dealership facility. Petitioner is
advised that Mr. and Mrs. Bo J. Webb, who own parcels 3080805 and
3080806 lying between lots owned by petitioner, do not wish to
have their lots rezoned at this time but have no objection to
having commercially-zoned lots on both sides of these.
(4) Squeezed as they are between industrial and commercial
districts, these lots are better suited to commercial than
residential use. The requested rezoning will therefore continue
the logical extension of a commercial district as earlier begun,
and in doing so assure the continued viability of a major
business operation.

(5) Attached to this petition as Exhibit B is a list of the
names and addresses of the owners (other than Berglund Chevrolet)
of all lots immediately adjacent to or across a street from the
property to be rezoned, together with the Official Tax Number of
each lot.
WHEREFORE, petitioners request that the parcels bearing City
of Roanoke Official Tax Nos. 3080812, 3080813, 3080814, 3080803,
and 3080804 be rezoned from RM-1 to C-2 in accordance with the
provisions of the Zoning Ordinance of the City of Roanoke.

AN ORDINANCE permanently vacating, discontinuing and closing
certain public right-of-way in the City of Roanoke, Virginia, as
are more particularly described hereinafter.
WHEREAS, Berglund Chevrolet, Inc., filed an application to the
Council of the City of Roanoke, Virginia, in accordance with law,
requesting the Council to permanently vacate, discontinue and close
the public right-of-way described hereinafter; and
WHEREAS, the City Planning Commission, after giving proper
notice to all concerned as required by S30-14, Code of the City of
Roanoke (1979), as amended, and after having conducted a public
hearing on the matter, has made its recommendation to Council; and
WHEREAS, a public hearing was held on said application by the
City Council on May 8, 1995, after due and timely notice thereof as
required by S30-14, Code of the City of Roanoke (1979), as amended,
at which hearing all parties in interest and citizens were afforded
an opportunity to be heard on said application; and
WHEREAS, it appearing from the foregoing that the land
proprietors affected by the requested closing of the subject public
right-of-way have been properly notified; and
WHEREAS, from all of the foregoing, the Council considers that
no inconvenience will result to any individual or to the public
from permanently vacating, discontinuing and closing said public
right-of-way.
THEREFORE, BE IT ORDAINED by the Council of the City of
Roanoke, Virginia, that the public right-of-way situate in the City
of Roanoke, Virginia, and more particularly described as follows:
That certain 150' portion of Maddock Avenue, N.W.,
extending in a westerly direction from Williamson Road,
N.W., between Official Tax Nos. 3080901, 3080903, 3080812
and 3080814,
be, and is hereby permanently vacated, discontinued and closed, and
that all right and interest of the public in and to the same be,
and hereby is, released insofar as the Council of the City of
Roanoke is empowered so to do with respect to the closed portion of
the right-of-way, reserving however, to the City of Roanoke and any
public utility, including, specifically, without limitation,
providers to or for the public of cable television, electricity,
natural gas or telephone service, an easement for sewer and water
mains, television cable, electric wires, gas lines, telephone
lines, and related facilities that may now be located in or across
said public right-of-way, together with the right of ingress and
egress for the maintenance or replacement of such lines, mains or
utilities, such right to include the right to remove, without the
payment of compensation or damages of any kind to the owner, any
landscaping, fences, shrubbery, structure or any other
encroachments on or over the easement which impede access for
maintenance or replacement purposes at the time such work is
undertaken; such easement or easements to terminate upon the later
abandonment of use or permanent removal from the above-described
public right-of-way of any such municipal installation or other
utility or facility by the owner thereof.
BE IT FURTHER ORDAINED that the closure of the above-described
right-of-way is conditioned upon applicant's submitting to the
City, receiving approval of, and recording a subdivision plat,

providing for the disposition of the land within the right-of-way,
to be vacated, in a manner consistent with the requirements of
Chapter 31, Subdivision, of the City Code, and providing for the
retention of appropriate easements, together with the right of
public passage over the same,
repair and general maintenance
exist within said right-of-way;
for the purpose of construction,
of any and all utilities that may
submitting and receiving approval
of a comprehensive development plan providing thereon for all
landscaping buffers and screening areas as may be required by the
City to establish and maintain an appropriate separation between
the commercial and residential land uses in the immediate area;
submitting a subdivider's agreement in a form acceptable to the
City Attorney, and a performance guarantee in an amount deemed
sufficient by the Agent to the Planning Commission to provide for
the installation of all landscaping and drainage improvements as
may be required by the proposed development plan; and in the event
these conditions have not been met and the said plat has not been
recorded in the Office of the Clerk of Circuit Court within twelve
(12) months from the effective date of this ordinance, this
ordinance shall become null and void with no further action by City
Council being necessary.
BE IT FURTHER ORDAINED that the City Engineer be, and he is,
directed to mark "permanently vacated" on said public right-of-way
on all maps and plats on file in his office on which said right-of-
way is shown, referring to the book and page of ordinances and
resolutions of the Council of the City of Roanoke, Virginia,
wherein this ordinance shall be spread.
BE IT FINALLY ORDAINED that the Clerk of the Council deliver
to the Clerk of the Circuit Court of the City of Roanoke, Virginia,
a certified copy of this ordinance for recordation in the Deed
Books of said Clerk's Office, indexing the same in the name of the
City of Roanoke, Virginia, as Grantor, and in the name of Berglund
Chevrolet, Inc., and the names of any other parties in interest who
may so request, as Grantees.

Request from Berglund Chevrolet, Inc., represented by Daniel F. Layman,
Ir., Attorney, to close and vacate a 150' section of Maddock Avenue, N.W.
I. Background:
Aoolicant. Ber~,lund Chevrolet, Inc., is an automobile dealership located at 1825
Williamson Road, N.W. Over the course of the past 20 years, Berglund, as a
major commercial enterprise, has been expanding its operations in the Williamson
Road area.
Ext~ansion over the past 10 years has been moving in a southeasterly direction
from the rear of Bergiund's principal building at 1824 Williamson Road toward
Courtland Avenue, N.W.
Residential district (RM-1) is located in this area, bounded by Noble Avenue on
the north, Thurston Avenue on the south, and Courtland Avenue on the west.
Land acquisition and expansion by Berglund has reduced this narrow corridor of
residential uses to 5 lots and dwellings (see attached Map A).
Land uses in the area shown on Map A as blocks C and D have been in a steady
state of transition for a number of years.
Maddock Avenue. N.W. originally extended from Williamson Road to Courtland
Avenue, N.W. Berglund expansion has requested the closure of this street in
separate segments.
City Council has previously adopted 3 seoarate ordinances effecting the closure
of a total of 575 feet of Maddock Avenue. Maddock Avenue, N.W., currently
extends in an easterly direction from Courtland Avenue, N.W., for a limited
distance of 150' (see attached Map A).

Residential district fronting on Maddock Avenue consists of 5 single family lots
and dwellings. Applicant has acquired and now owns all of the existing
residential properties on the remaining section of Maddock Avenue, N.W.
Aoplicant has also submitted a request to the City for the rezoning of this
narrowly compressed residential district on Maddock Avenue.
Comprehensive development plan. subdivision plat and appropriate bonds have
been submitted and filed with the City as required by the city's land development
regulations.

a. All properties abutting the section of Maddock Avenue to be
vacated will be combined to provide appropriate and required
street frontage.
b. Development plan will be required to provide all landscaping and
screening buffer areas.
6. Relationship to the comprehensive plan:
a. Expansion of this commercial area from Williamson Road to
merge with the Light Manufacturing (LM) district on the west side
of Courtland Avenue would be consistent with the intent of the
comprehensive plan.
b. The comprehensive plan provides for and encourages the
appropriate separation of incompatible land uses. Maintaining this
limited street section with 3 residential lots, between two large and
more intensive land uses (C-2 and LM) would be inconsistent with
the comprehensive plan.

Denial would be inconsistent with the intent of the comprehensive

City would retain a section of public street for future maintenance
to serve 3 lots that are owned by a single commercial entity.
V. Recommendation:
Planning Commission, by a vote of 5-0 (Mrs. Coles and Mr. Bradshaw absent)
recommended that City Council approve the applicant's request to close and vacate the
described section of Maddock Avenue, N.W., subject to the following conditions:
The applicant shall submit to the City for its review and approve, receive approval
of, and record with the Clerk of Circuit Court, a subdivision plat with said plat
providing thereon for the following:
The combination of all properties that would otherwise be landlocked by
the requested closure or otherwise disposing of the land within the right-
of- way to be vacated in a manner consistent with law.
The retention of appropriate easements together with the right-of-public
passage over the same, for surface and subsurface installation and
maintenance of any and all existing utilities that may be located within the
public right-of-way.
The applicant shall submit to the City and receive approval of a comprehensive
development plan providing thereon for all landscaping buffers and screening
areas as may be required by the City to establish and maintain an appropriate
separation between the commercial and residential land uses in the immediate
area.

The applicant shall submit to the City, a subdivider's agreement in a form
acceptable to the City Attorney, and a performance guarantee in an amount
deemed sufficient by the Agent to the Planning Commission to provide for the
installation of all landscaping and drainage improvements as may be required by
the proposed development plan.
If the above conditions have not been met within a period of 12 months from the
date of the adoption of the ordinance providing for the closure of the subject
right-of-way, then said ordinance shall become null and void with no further
action by City Council being necessary.

(1) Berglund Chevrolet, Inc. ("Petitioner") applies to have
a portion of Maddock Avenue, N.W., in the City of Roanoke,
Virginia, permanently vacated, discontinued, and closed pursuant
to Section 15.1-364, Code of Virginia, and Section 30-14, Code of
the City of Roanoke (1979), both as amended. The portion of
Maddock Avenue to be closed lies adjacent to and west of the
portions of Maddock Avenue (totalling 575 feet) closed by City
Council in February, April and December 1993, and lies between
the lots bearing City of Roanoke Official Tax Nos. 3080901 and
3080903 on the south and 3080812 and 3080814 on the north. It is
shown cross-hatched on the copy of a portion of City of Roanoke
Appraisal Map Sheet 308 attached to this Application as
Exhibit A. This application would, if approved, complete the
closure of Maddock Avenue between Williamson Road and Courtland
Road.
(2) Petitioner has recently acquired the lot designated by
Official Tax No. 3080814, already owned those designated by
Official Tax Nos. 3080901, 3080902, and 3080903, and has

contracts to purchase the lots designated by Official Tax Nos.
3080812 and 3080813. Petitioner would accordingly now like to
incorporate the 150-foot remainder of Maddock Avenue into its
commercial development between williamson and Courtland Roads, as
there will be no property owners other than Petitioner along
Maddock and therefore no further need for any portion of Maddock
to remain available for public use.
(3) Following closing of the transactions by which
Petitioner will acquire lots 3080812 and 3080813, expected to
occur by the end of March 1995, there will be no property owners
other than Petitioner affected by the requested street closing.
For that reason, no list of adjacent property owners is attached
to this-application.
WHEREFORE, Berglund Chevrolet, Inc. respectfully requests
that the above-described portion of Maddock Avenue, N.W., be
vacated, discontinued and closed by the Council of the City of
Roanoke in accordance with Section 15.1-364, Code of Virginia,
and Section 30-14, Code of the City of Roanoke, both as amended
to date.
