Council Member Wyatt inquired about the status of a report of the
City Manager with regard to exploring other alternatives of
recognizing firefighters, police officers, water and sewer employees,
and others in regard to holiday leave; and to provide information on
the cost to the City to compensate those employ¢c~ who work holidays
at the rate of time and one-half.
With Council's concurrence, the City Manager advised that a report
will be submitted to Council during fiscal year 1996-97 budget study.

Council Member Bowles advised that the U. S. Department of
Housing and Urban Development Megu Cities Project has rated
Center in the Square as one of 25 national HUD winners for its
innovative approach to urban revitalization; and requested that the
City Attorney prepare the proper measure commending Center in

CONSTITUTION OF VIRGINIA
Article X, Section 2. Assessments. - All Assessments of real estate and tangible personal
property shall be at their fair market value_, to be ascertained as prescribed by law.
"Fair market value" defined. - The fair market value of property is the price which it will bring
when it is offered for sale by one who desires, but is not obliged, to sell it, and is brought by one
who is under no necessity of having it.
Article X, Section 4. Property segregated for local taxation; exceptions. - Peal Estate, coal
and other mineral lands, and tangible personal property, except the rolling stock of public service
corporations, are hereby segregated for, and made subject to, local taxation only, and shall be
assessed for local taxation in such manner and at such times as the General Assembly may
prescribe by general law,

58.1-3201. What real estate to be taxed; amount of assessment; public service corporation
property. - All real estate, except that exempted by law, shall be subject to such annual taxation
as may be prescribed by law.
Alt general reassessments or annual assessments in those localities which have annual assessments
of real estate, except as otherwise provided in 58.1-2604, shall be made at 100 percent fair
58.1-3259. Failure of county or city to comply with law on general reassessment of real
estate. - If any county or city fails to comply with the provisions of this article requiring a general
reassessment of real estate periodically in such county or city by omitting such general
reassessment in the year required by this article, or failing to comply with the provisions of 58.1-
3201 requiring ass~smant at 100% fair market value, the Depa~'tment, upon receiving proof of
such delinquan~y, shall notify the Comptroller, whereupon the Comptroller shall withhold from
such county or city the payment of its share of the net profits of the operation of the alcoholic
beverage control system as provided for by 4-2~ until such time as the provisions of 58.1-3201
have been complied with in such county or city.
58.1-3261. Annual assessment of real estate in certain other cities and counties. - 6. Chapter
584 of the Acts of Assembly of 1964, approved March 31, 1964, authorizing provision for

of more than 92,000 and less than 110,000.

Section 32-40. Annual assessments generally. - The assessor shall assess annually for
taxation all real estate in the city_ not exempted fi.om taxation by the Constitution and general
laws of Virginia and not assessable for taxation by the state corporation commission, as provided
by law. In so assessing, the assessor shall include all lands, buildings, structures and
improvements thereon and all fights thereto and interest therein, and he shall have the power to
do any and all things necessary to assess such property.
Section 32-45. When assessment to be completed; how parcels entered on assessment
records. - Every_ assessment of real estate shall be completed by the last day of Februar3' of
each year. Every parcel of real estate shall be entered separately upon the assessment records in
the name of the owner thereof or in the name of the owner of any interest therein, in accordance
with the provisions of general law.
Section 32-46. Effective date of assessments. - Every_ assessment made bv the assessor shall
be effective for tax purp_ oses on the first day of July of the tax year ne~ f~Howing the
completion of the assessment, and taxes for the tax year shall be extended thereon by the
commissioner as provided by general law.
Section 32-47. Change of nssessment - Notice and hearing. - Whenever any assessment is
changed, the assessor shah _~ive notice thereof and hold a hearing there,.-, in accord with the

Dear Members of Council:
Limiting my discussion to the first factor, the ratio study results are used to compute the
estimated true value of all taxable real estate in each locality. This estimate is simply the
assessed values on each locality's land book divided by the loeality's median assessment/sales
ratio as computed by the annual Department of Taxation ratio study. This calculation yields
the estimated true value of all taxable real property in that locality.
It is the estimated true value of taxable real property that is used in the formula. In a phone
conversation with Richard Kelly of Roanoke City Schools, he suggests that other factors
remaining constant, the higher the estimate of true value of taxable real property compared
with other localities, the lower the mount of state aid.
I wish to emphasize, it is the estimate of true value of taxable real property that is used in the
formula and not the sales ratio. To illustrate the effect of the ratio on the computation of
true values I would offer two examples: ( Formula is assessed value divided by sales ratio
equals estimated true value).
At your February 20, 1996 meeting, Ms. Wyatt and Mr. White raised a question concerning
the Department of Taxation ratio study and its use in the computation of Basic School Aid.
Basic School Aid is distributed by a relatively complex formula based on both need and tax
effort to insure that all.localities can finance the major cost of the Standards of Quality in the
State. There are three basic factors used in comparing the relative ability of a locality to
,provide resources, (1)tree values of real. estate and public service corporations, (2)individual
income levels, and (3)the amount of sal.es that are subject to the State's general sales and use
tax.

As you can see from this illustration, given a constant tax brae, the lower the sales ratio the
higher the estimated true values, and in turn iowen the amount of the basic school aid.
This is an oversimplification of how real prope~ values figure into the school aid formula.
It assumes all factors remnini~ constant, the tax b~e, income levels, sales taxes, and
population.

distribution formula uses this amount am a tool to measure the taxable
capacity in the localities.
Perhaps it would be beneficial to briefly describe the basic school
aid formula in Virginia. This state formula for distributing funds to
localities has been designed to help finance the obvious, major costs
which are necessary for es:abliehing the Standards of Quality in the
State. The first step in this process concerns the General Assembly's
mandate of a specific standard of quality cost per pupil per year that
mus= be spent in each locality. This cost is derived by calculating the'
required number of instructional, administrative and support personnel
based on Board of Education guidelines and computing :he cost of these
requirements on e statewide cost per pupil basis. This cost per pupil
figure is multiplied by ~he Average Daily Membership (ADM) to obtain the
total required Standards of Quali~y ($OQ) cost for each locality. The
cos: ppr ADM has been calculated at $2,044 in fiscal year 1986-87 and
$2,254 in fiscal year 1987-88. From this required cost for each
locality a sub:faction is made for the amount of sales tax distributed
to the locality, for the calendar year in which the school year began,
based on school age population. This resulting figure yields the amount
of spending that upon application of the composite index formula
de:ermines the ex:mnt of state aid.

Aa we have previously mentioned the state share of school aid funds
is de:ermined through the use of a composite index which is based on a
formula that attempts to identify the relative ability of each locality
to provide resources for financing a program of quality education.
the formula shows that a particular locality has relatively less fiscal
ability, tha~ locality will receive a greater share of state assistance
in bearing the costs of elementary-secondary education. If, on the other
hand, a locality appears to have a. higher than average capacity to
provide resources for financing education (relative to the other localities)
that locality will receive a smaller share of state aid.
There are three basic factors used in comparing the relative
abili:y of the localities to provide resources for the 1986-88 biennium.
These factors are:
(1) true values of real estate and Rublic service corporation
(1986 calendar year) as provided by the Virginia Department of
Taxa:ion;
(2) individual income level (1986 calendar year) as determined by
the Tayloe Murphy [nati:ute a: the University of Virginia; and
(3) amount of sales which are subject to the State's general sales
and use tax (1986 calendar year).

The composite index of local ability-to-pay is based on the above
three items. The true values constitute 50 percent of the index,
individual income tax &0 percent, and taxable sales I0 percent. Of
course, :o compare each locality the three fac:ors must be adjusted to
place localities on the same basis. The composite index formula is
adjusted by 2 factors. First, the above three factors are adjusted by
average daily membership (ADM). For example, a locality's true value is
divided by that locality's ADM :o yield true value per ADM. This is
divided by the true value of the entire Commonwealth divided by the ADM
in the Commonwealth. If the locality has a larger amount of true value
per ADM :ban the state as a whole, then the value 'is greater than 1.
This means that the locality has a greater fiscal capacity relative :o
other localities and thus, the locality will receive a smaller portion
of state aid than if the value were less than 1. Of course, a value
less than 1 indicates that the locality has less true value per ADM than
the state average, thus, less capacity and, therefore, the state will
grant a relatively larger portion of aid. This same procedure is
carried out for personal income and taxable sales. The ADM portion of
the index is given a weight of 2/3.
The three factors are also adjusted by population. That is, a
locality's value per capita is divided by the state's true value per
capita. (The per capita adjustment counts 1/3.) As before, if a
locality has a grsater amount of true value per capita than the state
the locality has a greater fiscal capacity than the average (therefore
the ratio will be greater than 1) and the locality will receive less of

a share of state aid. On the other hand, if the locality were "poorer,"
less true value per capita than the State, the ratio would be less than
1 and the locality would receive a greater share of state aid. This
same basic procedures is used for the personal income factor and taxable
sales factor. The next step is the addition of 2/3 of the ADP! composite
index and 1/3 of the per capita composite index. The total is then
divided in half to obtain the composite index of local capacity to pay.
(The average locality will have a value of.S). This value is then
applied to the required SOQ cost less the sales tax to determine the
local share that the locality will have to come up with (required local
expenditure). The implication, of course, is that the lower the

composite index the lower the local share of expenditure.

It is important to emphasize the implications of this composite
index. That is, what factors could change the composite index and
therefore the share of state aid the locality would receive. First, we
must note that the index is a relative measure~ The measure compares
all of the localities. Thus, the index for a locality could change due
to changes in other localities. Second, the composite index is obviously
affected by changes in the three factors. And finally, the composite
index is influenced by changes in ADM and population both at the local
and state level.
The ratio study also seYves a number of people under its public
information function. Some of these functions are performed volun:arily
by the Department of Taxation while some are required by statute.
Section 58.1-207 does give the responsibility as well as broad latitude
to t~e Department of Taxation to publish related statistics. These
statistics are published in the department's annual Assessment/Sales
Ratio Study.
Some of the atatis~ica include a computation of the average effective
true tax ra~a in each county and city. The effeo~ive true tax rate
expresses the tax rate per $100 of true value (fair market value) and is
a mamma of comparing the real estate tax on similar properties in
diffe=en~ taxing jurisdictions. In addition to computing an overall
median assessment/sales ratio the report presents the ratios for six

City Council has made a commitment to enhancing its communication with the citizens of
Roanoke and accordingly asked that the following concepts be researched:
Broadcasting the Roanoke City Council meetings on the government/education access
channel, RVTV, Channel 3.
Developing a system that would allow the City Council agenda and reports to be placed
on a computer system, accessible by electronic mail
Communicating directly with citizens through the concept of a ~ published in the
dally newspaper.
I'd like to report back to you on each of these concepts.
Cablecasting City Council Meetings
One recommendation to enhance communication is to cablecast City Council meetings on RVTV,
Channel 3, the government/education access channel for Roanoke, Roanoke County and Vinton.
The ability to broadcast live was negotiated through the 1991 Cable TV Franchise Agreement
with Cox Cable, whereby an insertion point is located in the City Council Chambers that can feed directly
to Cox Cable. In addition, the city helps fund the operations staffat RVTV through a portion of the
franchise fees, and this staffwill record and cablecast the meetings at no additional cost to the city.
The following are my recommendations to City Council:
Cablecast the regular 2 p.m. meetings of City Council, as well as the 7 p.m. public
hearings live on RVTV.

2. Rebroadcast the meetings at 7 p.m on the Thursday after each meeting.
3. Initiate the cablecasting of Council meetings at the 2 p.m. meeting on May 20.
The city's Public Information Office and RVTV staff will work with members of City Council
to conduct sessions to help Council members in understanding how the shows will be presented, camera
placement, etc. As mentioned earlier, there will be no additional cost to the city budget for these
operations.
E-Mail and Computerization of Council Agendas
City Council has asked the administration to explore the potential for electronic mail and
computerization of City Council agendas. A staff team is being formed to assist with this work as part
of the technology appropriation made by City Council on January 16. Team members will meet with
members of Council to help clarify and define City Council's needs as related to the agenda, as well as
other benefits of this system.
In addition to assisting Council members with receiving Council agendas and/or reports
electronically, the team will also look at making such reports more readily accessible to the media and
the citizens.
City Page
The city's Public Information Office has researched the idea ora City Page. As recommended
to City Council, R ' '
oanoke s C~ty Page would be space purchased twice a month, on the Friday after each
City Council meeting in the Roanoke Times. It would also appear in the 2nd and 4th Thursday of the
month in the Roanoke Tribune. The goal of this communication forum would be to:
1. Improve citizens' understanding of city services, programs and goals.
2. Consolidate city informational advertising into one area.
Establish a regular, written communication forum that can be relied upon to keep
citizens up-to-date on city business.
4. Increase citizen involvement in city government.
Each City Page would include one lead story on an important city development, program or
service, along with numerous short items such as trash collection changes, bulk item pickup procedures,
tax deadlines, opportunities to serve on city boards, and a monthly feature highlighting Roanoke
achievements (water rate comparisons, school system accolades, unemployment statistics, major
awards, etc.)
According to information provided by the City County Communication and Marketing
Association and other local governments, communities across the country are exploring ways to provide
factual, straight forward information about government services and activities. Some governments

publish monthly citizen newsletters mailed to the homes of all citizens, others publish inserts in the
daily newspaper, others purchase air time on radio stations, and others use the City Page Concept. (A
copy of the City Page from Phoenix, A.Z, Winston-Salem, N.C., and Charlotte, N.C. is attached.) As
the media tend to focus only on the "big issues," the City Page will be able to highlight important
services and benefits that often do not rise to the level that captures media attention. A side benefit
of this publication is that it will allow Roanoke to market its services to over 121,000 households that
subscribe to the Roanoke Times and/or Roanoke Tribune who live in this region and beyond.
I recommend beginning this publication on May 24, 1996, as a one-year pilot project, with an
opportunity to review its effectiveness prior to the FY '97-'98 budget. The May '96 start-up will allow
time to hire a part-time staffmember to write the stories, negotiate contracts with the Roanoke Times
and the Roanoke Tribune, and develop the page format and design. The per-issue cost would be
approximately $1,850 for the newspaper space, plus the salary for the part-time employee, estimated
at $1,000 per month. Funding is available in the current budget to cover costs for May and June. The
annual cost of the publication and salary, approximately $56,000, would be included in the
recommended budget for fiscal year 1996/97.
In conclusion, the three projects detailed in this letter offer the opportunity to follow City
Council's leadership initiative to improve communications with citizens. The first two projects have
been timed to occur in May, at the recommendation of Council members. I believe all three will offer
new opportunities for citizens to be informed and involved in the work of Roanoke City government.
I would ask City Council's guidance on whether the recommendations, as set forth in this letter,
should be pursued.

School Board Request for the Appropriation of
School Funds and CMERP Funds
We have reviewed the attached request to appropriate funding for the
School Board. This report will appropriate funding for two grants in the School
Fund. These grants are funded with 100% federal funds.
This report also appropriates $219,626 from the School portion of the
Capital Maintenance and Equipment Replacement Program. The CMERP funds will
be used for the purchase of furniture and equipment for Jackson Middle School,
repairs to building and equipment resulting from inclement weather, and the
replacement of roofs at Fishbum Park Elementary School and at the Addison Middle
School auditorium. This is the sixth appropriation of the School Boards FY95
CMERP funding of $2,394,036. This will leave an unappropriated balance of
$412,948.
We recommend that you concur with this request of the School Board.

As the result of official School Board action at its February 6 meeting~ the Board respeccl'ully
requests City Council to appropriate $219,626.00 from the 1995-96 Capital Maintenance and
Equipment Replacement Fund. The proceeds will be used for the purchase of furniture and
equipment for Jackson Middle School, for repairs to buildings and equipment damaged as a result of
inclement weather, and for the replacement of roofs at Fishburn Park Elementary School and
Addison Middle School.
Appropriations are requested for the following school grants:

language arts and mathematics instruction for students in targeted schools. The program is one

Northwest Recreation Club, Inc., by counsel, states as
follows for its petition for a resolution supporting the
exemption from real estate taxation of the property of Northwest
Recreation Club, Inc., pursuant to Article X, Section 6(a) (6) of

1. Northwest Recreation Club, Inc., a Virginia non-stock,
not-for-profit, corporation, is the owner of certain real
property located at 1529 Williamson Road, N.E., being Lots 6, 13,
14, and 15, Block 1, Survey No. 1, Oakland, and being Official
Nos. 3070707, 3070714, 3070715 and 3070716 on the appraisal maps
of the City of Roanoke, a plat showing the approximate boundaries
of said property being attached hereto.
2. The Petitioner maintains on said property a building
used for offices and meeting facilities for Northwest Recreation
Club, Inc., an organization with the following purposes:
A. To promote and sponsor athletic activities among
the boys and girls of the community of Northwest
Roanoke and its environs.
B. To promote and sponsor such other activities, both
athletic and recreational, for the benefit of the boys

and girls of the community of Northwest and its
environs as may from time to time be deemed advisable.
C. To cultivate and encourage sportsmanship and fair

supervised competitive athletic events, as well as
providing educational assistance. Supervisors shall
bear in mind that the attainment of exceptional
athletic skill or winning of the games is secondary and
the physical and mental growth of the boys and girls is
of prime importance.
The facility is also used 8 to 10 evenings a month to conduct a
bingo game, the principal fund raiser for Northwest Recreation
Club, Inc.

Authorize the Roanoke Valley Drug and Alcohol Abuse Council to utilize
remaining Community Development Block Grant (CDBG) funds from a
previous 1994-95 CDBG Agreement in the current 1995-96 CDBG
program year.
As part of the HUD Entitlement Consolidated Plan a_nplication, approved by
Council on May 8, 1995, by Resolution No. 32476-050895, City Council
authorized a grant of $10,000 in CDBG funds for FY 1995-96 for the Roanoke
Valley Drug and Alcohol Abuse Council and its committees.
City Council approved the execution of an Agreement with the Roanoke Valley
Student Trouble Center, Inc. for funding to provide staff support to the Drug
Council and its committees utilizing $26.000 in CDBG funds in Account No. 035-
094-9439-5209 available from the 1994-95 allocation of Community
Development Block Grant (CDBG) fimds by Resolution No. 32099-071194 on
July 11, 1994.
Amendment No. 1 continued the Agreement through August 15. 1995 and was
executed administratively on June 22, 1995.
A remaining balance of $10.732 exists in the CDBG Account No. 035-094-9439-
5209.

A temporary_ city employee has been hired to serve as staff for the Drug Council
utilizing the $10.000 in 1995-96 CDBG funds.
The Roanoke Valley Drug and Alcohol Abuse Council has requested by letter
$8.618 in ftmds remaining in the previous 1994-95 CDBG Agreement for the
Drug Council and its committees to be utilized for special training workshops,
related expenses and operating expenses of the Drug Council and its committees
(See Attachment A).

training workshops to the community beginning March 1996.

community.
Compliance with applicable regulations is assured. The amendment will
be approved as to form by the City Attorney. Project monitoring is
provided by the Office of Grants Compliance staff.

As Chair of the Roanoke Valley Drug and Alcohol Abuse Council, I would like to formally request that
the portion of the 1994/95 Community Development Block Grant funds allocated to the Council that were
not utilized be made available to the Council for the current fiscal year (1995/96).
As you are well aware, funding for the Council was dramatically decreaaed this year due to a shortage
of CDBG funds for administrative purposes. The entire $10,000 grant is being used to pay for staff
support for the Council. Therefore, we would like to request that $8618 from fiscal year 1994/95 be
made available for the operational costa and special projecta outlined in the enclosed budget. (The
amount requested has been amended from the original request submitted in October 1995 based on staff
canvassing the various costa involved.)
These carry-over funds are vital to allowing the Council to continue to address its mission of creating a
community standard that drug and alcohol abuse will not be tolerated. Thank you for your consideration

Subject: Explore Park Funding (Council Report//96-03)
Dear Mayor Bowers and Members of Council:
The request from Explore Park for a fiscal year 1995-96 contribution was referred to me for
consideration and evaluation. City Council provided funding in the amount of $25,000 to Explore Park
in fiscal years 1994-95 and 1995-96. Explore Park has requested a contribution in the amount of $40,000
for the current fiscal year.
The attached Council Report recommends a contribution to Explore Park in the amount of
$25,000 for the current fiscal year using general fund contingency as the funding source. In previous
years, salary lapse (unexpended funds budgeted for salaries) was used as the funding source. At this point
in the fiscal year, salary lapse is not an adequate funding source because we have not met our budgeted
salary lapse commitment. It is anticipated that we will meet our budgeted salary lapse commitment by
the end of the third quarter.
I do not think that it is prudent to recommend increasing our contribution to Explore Park at this
time for several reasons. First, we are in the process of identifying the cost of responding to the January
and February snowfalls. Based on the available funding allocated for snow removal, the anticipated
reimbursement from the federal government, and potential recovered cost revenue, we will probably need
to use general fund contingency to pay for $231,315 in expenses associated with the January snowfall.
Information on the cost of responding to the February snowfall is being compiled.
Second, fiscal year 1996-97 funding requests from Explore Park and other cultural organizations
will be evaluated by the Cultural Services Committee. Cultural organizations who currently receive
contributions from the City of Roanoke will move under the Cultural Services Committee umbrella at
their current funding level for fiscal year 1996-97 contributions. This is being done in an attempt to ease
the transition to a new procedure and methodology to evaluate funding requests from cultural
organizations.
I think that it would be unfair to increase our contribution to Explore Park prior to moving them
under the Cultural Services Committee umbrella when we did not increase our contribution to any cultural
organization that was allocated funding during the current fiscal year. Cultural organizations will be able
to compete for possible funding increases in fiscal year 1996-97.

Ten years after having been conceived by a remarkably creative and generous
group of local businessmen Including the late ]ack Hancock, the late Horace Fralln,
George Canledge Sr., and T. A. Carter, Virginia's Explore Park is on the cusp of long-
term success. I'm convinced that the II~t we see at the end of the tunnel is not the
headlight of an onrushing locomotive about to flatten our embryonic project, but the
dawn of a new era of flnandal stability and popular acceptance for what will soon be a
malor tourist destination, education cemer, and source of revenue for all the local
governments in the region,
The support of the City of Roanoke has helped make possible our progress to date,
and we thank you for it.
On Saturday, April 6, Explore will re-open to the public for I~s third season of
operation. I hope you will visit us on opening weekend.
To date we have autacted over 50,000 visitors to our new IIv'mg history museum
and nature center. One third of them have been school children accompanied by their
teachers. More school children fTom Roanoke have 'v'~l Explore than from any other
jurisdiction including Roanoke County. The experience they have at Explore cannot be
duplicated anywhere nearby: At Explore Park they learn through hands-on use of tools
familiar to their great grandfathers and great grandmothers how people survived on the
Virginia frontier and how dependant people are on fertile soil, clean water, healthy
livestock and other bounties of nature. Unique educational programming probably b
Explore's current principal contribution to the quality of-life of our community.
But about one third of Explore's vblton have been travelt~ on the Blue Ridge
Parkway, and here is where the park's poiemJai future main value to the cornmunlty lies-
as a stimulus of tourism-based economic activity here. Just as the Hotel Roanoke brings
more visitors downtown, so will Explore Park stop vacationers o~ the parkway and direct
them to Center in the Square, the ¥1r~lnla Transportation Museum, and other city
attractlom, accommodatlom, and sen~lces.

Both the parkway spur and the restaurant will be completed and opened In April of
1997.
Near the tavern will be a new welcome center {with Information on dry attractlom
and services) and several rebuilt 150-year-old log cabim senang as high-quality overnight
accommodations. Also on the drawing boards are an education center--the Jack Hancock
Center, to be built with private ~fts from friends of the late CEO of Roanoke Electric
Steel-and a small conference center hosting environmental conflict resolution sessiom,
pro[esslonal continuing education courses, and teacher In-service t~aining programs. In the
more distant future is the Lewis and Clark Expedition-theme zoo of North American
wildlife, to be bulk on our Bedford County land on the north side of the Roanoke River.

But to get through the current fiscal year unscathed we need your help today.
Thanks to broad-based poll1~al support we currently obtain 40 percent of our
operating budget from the Commonwealth of Virginia. That $400,O00*per-year grant,
which we've received since July 1, 1994, apparently will be renewed for another two
years by the current se~lon of the General Assembly in Richmond. The string attached to
that genermity is that it must be match dollar for dollar In advance by funds from other
sources, public and private.
So far this rrscal year we've been able to match the state's $3],333 monthly
payment on a timely basis with locally rabed funds. An important component of this
match was the $ ! SO,000 grant we received this year Rom Roanoke County. Private gifts
channeled to the Virginia Recreational Facir~les Authority from the River Foundation have
made up $30,000 of our operating budget so far this Itscal year, with more to come
from thb private source, and we've earned about $45,000 this year through admbslon
ticket and ~ift sales. School districts have helped, as well.
But as my lett~s to each of you last week indicated, we're Still about $40,000 shy
of hitdng our operating income budget target on the line item, 'Oty and school
We are in dire need of about that much in city support to stay on an even keel.
I assure you we are scrubbing our budget continually to save money. We have
reduced staff and are postponing maintenance of our valuable hlstorlc structures and
scrimping on Important advertising opportunities because we/re under budget on the
Income side. The good new~ b we're paid prac~ally all those suppliers to whom we
owed money a year a~o. Our expenses are not exceeding our income, on a month-to-

A RESOLUTION supporting the location of a Visitor's Information Center near the Blue
Ridge Parkway.
WHEREAS, the local governments and groups interested in promoting economic
development and tourism in the Roanoke Valley have long endorsed the construction of a major
tourist visitor information center close to the Blue Ridge Parkway; and
WHEREAS, an ad hoc advisory committee comprised of representatives of the National Park
Service, Roanoke County, City of Roanoke, City of Salem, Town of Vinton, Roanoke Valley
Convention and Visitors Bureau, Fifth District Planning Commission, Salem-Roanoke County
Chamber of Commerce, Roanoke Regional Chamber of Commerce, Friends of the Blue Ridge
Parkway, the Virginia Division of Tourism, and Virginia's Explore Park recently concluded that the
Visitor's Information Center should be built on the site on the south side of the Roanoke River
adjacent to the Roanoke River Parkway, near the former baler building located on the now closed
regional landfill, and referred to as Site number 5 in the City Manager's report to this Council dated
February 20, 1996.
BE IT RESOLVED by the Council of the City of Roanoke that:
1. The Council of the City of Roanoke endorses the proposal to build a Visitor's
Information Center at Site number 5 near the Blue Ridge Parkway and further offers its support to
further the realization of this project.
2. The City Clerk is directed to forward attested copies of this resolution to the
Honorable John W. Warner, United States Senator, the Honorable Charles S. Robb, United States
Senator, the Honorable Robert W. Goodlatte, Member, United States House of Representatives,

BACKGROUND
A. ~ Roanoke City Council and Roanoke County Board of
Supervisors held a joint meeting to discuss areas of cooperation.
B. As a result of the .ioint meeting an ad-hoc committee was formed to review
five proposed sites for a visitor's information center.
C. ~ was regional with valley governments, organizations and
tourist venues represented.
D. Councilwoman Linda Wyatt was appointed to serve on the committee by the
Mayor to represent City Council.
E. Phillip F. Sparks. Chief of Economic Development was appointed by the City
Manager to represent the City administration.
CURRENT SITUATION

D. Congressman Robert L. Goodlatte's office is researching potential funding
sources from previously reprogrammed funds.
E. The National Park Service is reseamhing a fast-track approach to bring Site #5
into compliance with Final Environmental Impact Statement (FEIS) that
evaluated each of the sites considered.
F. Cost estimates for the visitor's information center are being developed.

As you are aware, Dr. Harry Nickens, Roanoke County Supervisor for the Vinton
Magisterial District, chaired an ad hoc Visitor Center committee to determine a preferred site.
Representatives from the National Park Service, Roanoke County, the City of Roanoke, the City
of Salem, the Town of Vinton, the Roanoke Valley Convention and Visitors Bureau, Fifth
Planning District Commission, Friends of the Blue Ridge Parkway, the Virginia DMsion of
Tourism and Explore Park agreed on the need for a visitor center along the Parkway and came
to a consensus that site #5 was the preferred site. Site #5 is the former baler building site along
the currently under construction Roanoke River Parkway.
Discussions confirmed that the clear purpose of the visitor center was to serve as a place
where Blue Ridge Parkway visitors could receive orientation, education and information. This
is generally within the original scope and intent of the Final Environmental Impact Statement
(FEIS) approved in 1992. While other plans have been considered, it was clear that the Record
of Decision could be re-visited with this purpose in mind to consider the steps necessary to
change the Record of Decision from Site #3 (Hammond Site) to Site #5 (Roanoke River
Parkway Site near the former baler building).
The group requested support in the form of resolutions from the organizations
represented on the committee. Enclosed are copies of resolutions we have received to date.
Holidays and weather caused some delays and there may be some additional resolutions to follow
in the future.

RESOLUTION 010996-3 SUPPORTING THE LOCATION OF
THE BLUE RIDGE VISITORS CENTER ON THE ROANOKE
RIVER PARKWAY
WHEREAS the local governments and groups interested in
promoting economic development and tourism in the Roanoke Valley
have long endorsed the construction of a major tourist visitor
information center adjacent to the Blue Ridge Parkway between the
parkway's intersections with U.S. 220 and State Route 24; and
WHEREAS the National Park Service's planning and environmental
impact assessment process associated ~ith construction of the
Roanoke River Parkway included detailed consideration of
alternative locations for such a visitor center and resulted in the
identification of the "best" two sites for this purpose, one on
private property on the north side of the Roanoke River east of the
parkway near the Roanoke River bridge and the other on public land
on the south side of the river ton former regional landfill
property); and
WHEREAS the evolution of the plans for the Roanoke River
Parkway resulted in a change in the new parkway's final location
from the north side of the river to the south side of the river,
leaving the privately owned visitor center site on the north side
of the river inaccessible without the construction of another road
connection to the Blue Ridge Parkway, while the publicly owned
visitor center site on the south side of the river will be easily
accessed as soon as construction of the Roanoke River Parkway, now

under construction, is completed; and
WHEREAS an ad hoc advisory committee comprised of
representatives of the National Park Service, Roanoke County, City
of Roanoke, City of Salem, Town of Vinton, Roanoke Valley
Convention and Visitors Bureau, Fifth Planning District Commission,
Salem-Roanoke County Chamber of Commerce, Roanoke Regional Chamber
of Commerce, Friends of the Blue Ridge Parkway, the Virginia
Division of Tourism, and Virginia's Explore Park recently has
concluded that the Blue Ridge Visitor Center should be built on the
site on the south side of the river adjacent to the Roanoke River
Parkway.
THEREFORE BE IT RESOLVED by the Board of Supervisors of
Roanoke County, Virginia as follows:
1. That the Board of Supervisors endorses the committee,s
recommendation for construction of the Blue Ridge Visitor Center on
the Roanoke River Parkway, and supports prompt construction of this
visitor center at this site; and
2. That the Clerk to the Board transmit this resolution to
the members of the United States Congress who represent Roanoke
County together with a covering letter acknowledging that the cost
of building and operating such a center will be the joint
responsibility of the federal government and local entities; and
3. That the Clerk to the Board forward copies of this
resolution to the other Roanoke Valley governing bodies requesting
that the adopt a similar resolution; and
4. That the Board of Supervisors supports provision of
interim visitor center services in a building eventually destined
for another use within Virginia's Explore Park.
On motion of Supervisor Nickens to adopt the resolution, and
carried by the following recorded vote:

I. Background on the subject in chronological order is:
An informal meeting of the Roanoke City Council with Beverly T. Fitzpatrick, Jr.,
Executive Director, The New Century Council, was held on Monday, October 23,
1995. Mr. Fitzpatrick outlined the visioning process used by theNew Century

II. Current situation is:
The New Century Council has requested that the City of Roanoke become a
formal partner by accepting the seven major vision statements adopted by New
Century Council volunteers and approved by the New Century Council Board (a
copy of the seven vision statements is attached), and by working with the New
Century Council to achieve that vision. Agreement with the 150+ detailed
strategies developed during the visioning process is not necessary.
As a partner, the City may then nominate representatives to serve on the seven
vision implementation committees.

At the New Century Steering Committee meeting on November 8, 1995, we adopted a new
structure to move The New Century Council forward. It creates a very inclusive role for
citizens and organizations throughout the region.
The new structure, as recommended by the Continuity to Assure the Reality of the Vision
Committee, places great emphasis on involvement by Partner organizations. These are current
groups, like yours, who are well established in the New Century Region. They have been
named by our 1,000+ volunteers as organizations whose participation is appropriate to bring
the vision to reality. The list of possible Partners is a compilation of all groups recommended
in the document that people feel should play a role in making our preferred future come true.
To be a Parmer, an organization must accept the seven major vision statements adopted by
our volunteers and approved by our Board. We have enclosed a copy of the seven vision
statements for your review. As a Parmer, it is not necessary for you to agree with all 150+
detailed strategies. Each Partner will have the oppommity to nominate representatives to
serve on our seven vision committees. Seven out of the ten members on each committee will
be from Parmer organizations throughout the New Century Region.
Between now and February 15, our first priority is to determine which organizations will
formally approve the seven visions and become Partners in moving the region forward. We
would like to formally ask your Board to become a Partner organization. It would mean a lot
to this effort to have the City of Roanoke working with us to make the region better for all
our citizens.
Our goal is to move forward, naming our committees and our Partners by February 1996. If
you are willing to participate in this leadership effort, please complete the enclosed "Partner
Organization Participation Record" and return it to our office by January 30. Timing is
important, and we do not want anyone to be left out who would like to be a Partner.

SUBJECT: Street Inventory for State Maintenance
Payment Eligibility
Dear Mayor Bowers and Members of City Council:
I. Backqround:
Code of Virqinia establishes the eligibility criteria of
localities for receiving funds from the Virginia
Department of Transportation (VDOT) for street
maintenance. It specifies two functional classifications
of highways (Principal/Minor Arterials and
Collector/Locals) and establishes a base payment rate per
lane mile for each classification of roadway. These
rates are adjusted annually by VDOT based upon a
statewide maintenance index of unit costs for labor,
equipment and materials used by VDOT on roads and
bridges.
City eligibility for fiscal year 1995-96 is approximately
$7,263,971 in street maintenance payments from VDOT.
These funds are used for many maintenance expenditures
that the City incurs for streets, sidewalks, curb and
gutter, traffic signals, bridges, signs and pavement
markings.
II. Current Situation:
Inventory additions need to be submitted to VDOT prior to
April 1, 1996, in order to be eligible for payment for
the next fiscal year. These additions are to be
submitted on VDOT forms with an accompanying resolution
from City Council.
City staff has found that the attached list of streets
should be submitted to VDOT before April 1, 1996, to
enable their eligibility for payment in the next fiscal
year. Approval of this addition to the street inventory
could add $2,460 at current year payment rates. These
changes have all occurred within the past year.

The City's 1996 general obligation public improvement bonds have been issued and
the proceeds are available for appropriation. Funding of 931,300,000 needs to be
appropriated to Capital Improvement Reserve group of accounts in the Capital Projects fund
"Public Improvement Bonds - Series 1996." The bond funds will be accounted for in this
group of accounts until City Council appropriates these funds to specific project accounts.
I recommend that City Council appropriate 931,300,000 of 1996 bond proceeds to
the Capital Projects fund account entitled "Public Improvement Bonds - Series 1996" as
follows:

By agreement with the City of Roanoke, the Roanoke Redevelopment and
Housing Authority (RRHA) administers a large segment of the City's Community
Development Block Grant Program. The Housing Authority receives program income
during the course of its administration of various projects by renting properties and
by receiving loan repayments from project area residents. The Housing Authority is

The Housing Authority has made payments to the City in the amount
of $345,547 from February 1, 1995 through January 31, 1996, for the following
program income:
$214,353 for the sale of land in Gainsboro, Deanwood, Shaft'ers Crossing
and on Wells Avenue.
$131,194 in other program income in excess of income previously
appropriated. Other program income is primarily received from loan
repayments and parking lot rentals.

Report and remittance, of Article IX. Admissions Tax, of Chapter
32, Taxation, of the Code of the City of Roanoke (1979), as
amended, to allow with written approval of the Director of Finance
or his designee remittance of admission taxes by the twentieth of
the month following the date of the event or on a quarterly basis;
and providing for an emergency.
THEREFORE, BE IT ORDAINED by the Council of the City of
Roanoke that:
1. Subsections (a) and (b) of S32-221, Report~ and
remittance, of Article IX. Admissions Tax, of Chapter 32,
Taxation, of the Code of the City of Roanoke (1979), as amended,
be, and is hereby, amended and reordained to read and provide as
follows:
Article IX. Admissions Tax.
§32-221. Report and remittance.
(a) The person collecting any admission tax under this
article shall make out a report, upon such forms and
setting forth such information as the director of finance
may prescribe and require, showing the amount of the
admission charge collected, exclusive of the federal tax
thereon, and the tax from the admissions for which he is
liable, and shall sign and deliver the same to the
treasurer, with a remittance of such tax. Such report
and remittance shall be made on or before the twentieth
day of each month covering the amount of tax collected
during the preceding month. Upon request of the person
collecting any admissions tax and the written approval of
the director of finance or his designee, the person
collecting any admissions tax may make such report and
remittance on the twentieth day of the month following
the date of the event.
(b) Any person operating a place of amusement or
entertainment whereat amusement or entertainment is
furnished regularly throughout the year may, upon written
application to, and with the written consent of, the
director of finance, or his designee, make reports and
remittances on a quarterly basis in lieu of the monthly
basis provided for in subsection (a) above. Such
quarterly reports and remittances shall be made on the
twentieth day of April, July, October and January in each
year, and shall cover the amounts collected during the
three (3) months immediately preceding the months in
which reports and remittances are required.
2. In order to provide for the usual daily operation of the
municipal government, an emergency is deemed to exist, and this
ordinance shall be in full force and effect upon its passage.

Subject:
Request to amend Code of the City of Roanoke regarding
collection of Admissions taxes
Section 32-221 of the Code of the City of Roanoke provides that
admissions tax remittance should be made "on or before the
twentieth day of each month covering the amount of tax collected
during the preceding month" or under certain circumstances on a
quarterly basis.
Billings and Collections collects all admissions taxes except for
events which have ticket sales handled by the Roanoke Civic
Center.
The Roanoke Civic Center reports taxes collected after the event
has been held, called "event settlement," rather than on the 20th
day of the month following the event, for events that may have had
season ticket sales or advance ticket sales. Taxes due are
calculated at event settlement as a practical matter and as standard
industry practice for civic centers.
Other persons responsible for remitting admissions taxes have
requested approval from Billings and Collections to remit payment
after the event has been held; and, in the case of season ticket
sales, payment may not always be on the 20th of the month
following ticket sales and collection of tax.

Municipal Audit conducted an audit on the Roanoke Civic Center
operations and noted that the City Code does not authorize tax
remittance after event settlement for advance ticket sales or season
ticket sales.

From an accounting and paperwork standpoint, it would be a great
inconvenience for both the Civic Center and some organizations to
remit Admissions Tax on a monthly basis rather than after the event
as part of event settlement. Administrative costs would also
increase if monthly remittance were required.

As a matter of customer service, Billings and Collections has
allowed organizations to remit taxes on a periodic basis and after
an event has been held which involved season ticket sales.
A change to the City Code to allow for tax remittance on the 20th of
the month following the date of the event with written approval from
the Director of Finance or his designee would allow continuation of
current, practical procedures and continue ease of collection.

execute a quitclaim deed, modification agreement, and other
necessary documents, in connection with correcting the legal
description of the parking deck levels in the First Union Tower
Building; authorizing acceptance of a deed conveying the correctly
described first three levels of the parking deck of the First Union
Tower Building to the City; and providing for an emergency.
WHEREAS, the ownership of the First Union Tower Building was
originally structured so that the City would own the lower three
levels of the parking deck, the Roanoke Redevelopment and Housing
Authority ("RRHA") would own the upper three levels of the parking
deck, and Faison Roanoke Office Limited Partnership ("Faison")
would own all property above and below the parking deck;
WHEREAS, Faison has conveyed undivided interests in part of
its interest in the First Union Tower Building and surrounding land
to Stephen W. Lemon, Barbara B. Lemon, Sarah L. Ludwig, William J.
Lemon, W. Tucker Lemon as Trustee of the W. Tucker Lemon 1990
Living Trust, and Blue Ridge Highlands, Inc. (the "Other Owners");
WHEREAS, a recent survey has revealed that the elevations used
to describe the levels of the parking deck were incorrect by six to
eight feet; and
WHEREAS, the City, RRHA, Faison and the Other Owners of the
First Union Tower Building desire to correct any error caused by
the incorrect legal descriptions of the levels of the parking deck.
THEREFORE, BE IT ORDAINED by the Council of the City of
Roanoke that:
1. The City Manager and the City Clerk are authorized to
execute and attest, respectively, on behalf of the City, the
appropriate quitclaim deed, in form approved by the City Attorney,
conveying (a) the City's interest in all property below the first
three levels of the parking deck of the First Union Tower Building
to Faison and the Other Owners and (b) the City's interest in all
property above the first three levels of the parking deck of the
First Union Tower Building to RRHA.
2. The City Manager and the City Clerk are authorized to
execute, seal and attest, respectively, on behalf of the City, a
Modification of the Reciprocal Operating Agreement dated September
6, 1991, by and among Faison, the City and RRHA to correct the
description of the levels of the parking decks.
3. The City Manager and the City Clerk are authorized to
execute, seal and attest, respectively, on behalf of the City, any
other documents necessary to correct the legal description of the
parking deck levels of the First Union Tower Building.
4. This Council hereby authorizes the acceptance, in form
approved by the City Attorney, of a deed conveying the first three
levels of the parking deck in the First Union Tower Building to the
City.

Dear Mayor Bowers and Council Members:
The First Union Tower Building, as originally developed by
Faison Roanoke Office Limited Partnership ("Faison"), was
structured so that the City would own the first three levels of
the parking deck, and the Housing Authority would own the upper
three levels of the parking deck. All property above and below the
parking deck is owned by the current owners of the Building.
When conveying the parking deck levels to the City and the
Housing Authority, the legal descriptions used were based upon the
elevations given by the surveyor. Upon reexamination of the survey
in anticipation of refinancing of the First Union Tower Building,
it has been determined that the original survey was incorrect. The
elevation of the parking levels is incorrect by 6 to 8 feet.
Consequently, all of the elevations as described in the deed
conveying the parking deck levels to the City and the Housing
Authority are incorrect. Counsel for Faison has requested the
City's assistance in correcting this matter.
In order to correct this matter, I recommend adoption of the
attached ordinance which will authorize the following action:
(1) The revision of the deed conveying the property to the
City using the correct legal description;
(2)
The conveyance by quitclaim deed of the City's interest
in the incorrectly described portions of the First Union
Tower Building; and
(3) A modification of the Reciprocal Operating Agreement.

It is my recommendation that Council authorize the appropriate City
officials to execute the necessary quitclaim deed and modification
agreement and authorize acceptance of the correctly described first
three levels of the parking deck in the First Union Tower Building.
This action by Council will ensure that the City's interest in
the first three levels of the First Union Tower Building parking
deck is correctly described, and that the refinancing may proceed.

leasable space of 46,161 sq. ft., the remaining 33,748 sq. ft. are
leased to the Commonwealth of Virginia under a lease due to expire
June 30, 2005.
Lease amendments providing for additional space and establishing the
term of the ten-year lease to expire February 1, 1996, have
subsequently been approved.
C. Lease extensions for five-year terms are provided for in the original
lease agreement.
Current Situation is as follows:
A. Lease will expire on January 31, 1996.
Maior renovations to the space, currently occupied by the Bankruptcy
Court has been requested by the GSA prior to extending the lease for
an additional five-year term. GSA is currently studying the needs of
the Bankruptcy Court in order to develop plans for such renovations.

Extension of lease for a one-year term, from February 1, 1996,
through January 31, 1997, has been requested by the GSA to allow
the renovations to be accomplished.
Lease rate will continue to be calculated as before, using a base rate
of $6.50 per square foot, plus the current adjusted operating cost of
$3.39 which will be readjusted when the February Consumer Price
Index becomes available.

Committee recommends that City Council authorize the appropriate
City officials to execute the Supplemental Lease Agreement in a form

stated above.
Need to retain tenant for space in Commonwealth Building is
met.
2. Timinq to renew lease prior to expiration of current lease, and
allow time to properly plan renovations is met.
Financial Impact to City is retention of lease revenue for one year
($122,755 for current year); and also the cost of any renovations
the City agrees to make.
Committee does not recommend that City Council authorize, the
appropriate City officials to execute the Supplemental Lease
Agreement in a form acceptable to the City Attorney, for a one (1)
year term, from February 1, 1996, to January 31, 1997, with the
lease rate to be calculated as stated above.

Dear Mary:
Please be advised that I intend to appear at the City
Council meeting session scheduled for 7:00 p.m. on
February 20, 1996, to request an additional extension for
presenting our appeal in the above-captioned matter. As you
may be aware, we have been successful in finding a party who
is interested in moving the two structures which are the
subject of the appeal. They have secured approval of the
Architectural Review Board for their Proposed plans.
However, they have yet to secure a building ~ermit and there
are a variety of things that could happen between now and the
proposed moving of those houses scheduled for some time in
the middle of March, 1996. Therefore, we feel that it is
prudent to preserve our rights to have this matter heard in
the event that some unforeseen circumstance should occur that
would prevent this party from carrying through on its plans
to move the structures.
I have spoken with Steve Talevi in the City Attorney's
Office about this matter, and he confirmed that it would be
necessary to make a personal appearance on February 20 to
request this extension.
