Dear Mayor Bowers and Members of Council:
Subject: Briefing Regarding the Rental Certificate of Compliance Program
I. Background:
Virginia law was changed in 1994 to allow the City to require vacant rental units in
certain parts of the City to be inspected before they could be rerented.
Several groups from the community asked the City to develop such a program in
early 1995. City administration and representatives of the Roanoke Regional
Housing Network coordinated a series of public workshops from mid-1995 to mid-
1996 that resulted in the rental certificate of compliance program approved by City
Council in June 1996.
C. Intent of the rental certificate of compliance program generally is to:
1. Reduce the number of unsafe living conditions in rental properties, and
Encourage good preventative maintenance practices to preserve good quality
rental housing.
Certificate of compliance pro,am is designed to accomplish these by inspections of
rental units every two years with the cooperation of the property owner. If the owner
chooses not to have his property inspected, he/she is not allowed to rerent it when it
becomes vacant until it is inspected. The program provides incentives for the
property owner to have the inspection made voluntarily on the two-year schedule.
E
Initiation of the program in the first selected area. namely Elm Avenue SW (see
attached map), was announced in September, with inspections beginning in October.
The areas of part of Orange Avenue NW and Bullitt and Jamison Avenue SE were
announced as the next areas to which the program would apply.
II. Current Situation:
A. Activities since adoption of the program have focused on:

Basic preparation for administration of the program, including in-house
planning, equipment, procedures, and preparation of informational material
about the program;
Hiring and training of personnel for program operations. Two additional
Building Maintenance Code inspectors and a part-time secretary were hired.
Testing and evaluation of procedures and systems.
a. The first area was approached as a pilot phase, to develop and refine
procedures before up-to-speed implementation of the program.
Inspections in the Elm Avenue SW area were "team inspections",
with most or all of the inspectors and a fire marshall. This allowed
all inspectors to observe the same conditions and discuss the
appropriate action. As a result, the discretion necessarily reserved to
inspectors will be exercised with consistency.
b. A complete new data system has been designed to handle the massive
amount of inspections and information to be generated and managed.
The system will not be fully functional until the personnel involved
are on a computer network. Integration of this in-the-office system
with in-the-field inspections will continue to be refined as the
program operations develop and intensify.
The inspections "sweep" of the Elm Avenue area is nearing completion. Experience
in this area as of the drafting of this report has been as follows:
An estimated 354 housing units are in the Elm Avenue target area, of which
at least 39 are owner-occupied and not subject to the program.
Approximately 315 units have been identified as apparently not owner-
occupied and subject to the inspections program.
a. 163 units~ (52%) have been inspected or otherwise addressed
· 65 units (40%) passed and were issued Certificates of
Compliance.
· 79 units (48%) were found to have violations and were issued
Temporary Waivers, allowing the units to remain rented
while repairs are made.
· 18 units (11%) were issued Certificates of Exemption from
inspection, as being in large apartment complexes where at
least 10 units were inspected and passed.
· 1 unit (1%) was condemned as unsafe and unfit for
occupancy.
b. 31 units (10%) are scheduled for inspection.

Owners of 41 units (13%) have refused inspections. The exterior of
these buildings will be checked to determine whether repair orders
for the outside conditions are in order. The interior of the units will
be required to be inspected upon their vacancy.
For 51 units (16%), attempts are continuing to make arrangements
with the owners for inspections, or the inspections are being delayed
pending significant developments with the property, such as resale or
rehabilitation.
Approximately 30 units are of unknown status, due to no response
from the owners. The exteriors of these also will be inspected to
determine whether repair orders for the outside conditions are in
order.
Although initial inspections are expected to be completed on Elm Avenue in
February, there is significant follow-up work to be done over the next 4-6 months,
as repairs needed are made and Certificates of Compliance are issued, and
TemporaD' Waivers expire and further action to pursue repairs is required. These
follow-up actions will be pursued by individual inspectors.
Building inspectors are working in three-inspector teams for the time being, as an
intermediate step to performing program inspections individually.
The program's application to the next two areas of Orange Avenue NW and Bullitt
and Jamigon Avenue SE has been announced. Property owners have been notified,
inspections will begin in March, with completion of those two areas expected around
the end of April.
Procedures are being adjusted based on the experiences on Elm Avenue. It is
expected that the data system, a computer network, and redesigned materials will
make the program more efficient, relying heavily on the inspectors handling
paper~vork in the field rather than in the office. Evaluations and refinements in
operations procedures will continue to be on-going.
It is important to note that while the new rental inspections program has been
initiated, routine code enforcement activities continue throughout the City, such as
condemnations of vacant buildings, demolitions, and responding to complaints.

Valley. We are endorsed by The Hotel Roanoke & Conference Center, The
Roanoke Valley Convention & Visitors Bureau, Center In The Square, and
Roanoke Electric Steel. This project is designed to inform the public about
every aspect of living in The Roanoke Valley and includes links to every web
site in the area, articles of interest, and an easy to navigate interface.

and Traffic, to change the prorated license tax for licenses issued
on the first day of March through May 31; and adding new S20-34.1,
Same - Refund, of Article II, Vehicle Licenses, of Chapter 20,
Motor Vehicles and Traffic, to provide for the refund of the
license tax in the amount of one-half of the license tax upon sale
of any vehicle prior to December 1, and surrender of a used or
unused decal on or prior to January 31; and providing for an
emergency.

IT ORDAINED by the Council of the City of Roanoke that:
Section 20-29, Proration of tax, of Article II, Vehicle
of Chapter 20, Motor Vehicles and Traffic, of the Code of
the City of Roanoke (1979), as amended, is hereby amended and
reordained to read and provide as follows:
§20-29. Proration of tax.
License taxes may be prorated only in the following
manner: one-half of the tax shall be collected when the
license is issued during the period beginning on the
first day of December in any year and ending on the last
day of February in the same license year, and one-quarter
of such tax shall be collected whenever such license is
issued on or after the first day of March in the same
license year.
2. Article II, Vehicle Licenses, of Chapter 20, Motor
Vehicles and Traffic, of the Code of the City of Roanoke (1979), as
amended, be and is hereby amended and reordained by the addition of
the following section:
ARTICLE II. Vehicle Licenses.
S20-34.1. Same - Refund.
Any owner of a vehicle subject to the license tax of
this article who sells, transfers, or otherwise disposes
of such vehicle prior to December 1 and does not transfer
the license plate, tag, or decal, as authorized by §20-
34, may surrender such used or unused decal to the
Commissioner of the Revenue on or before January 31 of
the same tax year. Upon surrender by any license
taxpayer of a used or unused license plate, tag or decal
and proper application to the Commissioner of the
Revenue, a refund in the amount of one-half of the
license tax shall be sent to the owner of the vehicle at
the time such license plate, tag or decal was issued.
3. In order to provide for the usual daily operation of the
municipal government, an emergency is deemed to exist, and this
ordinance shall be in full force and effect upon its passage.

Subject: Vehicle Decal Fees and Refunds

The City of Roanoke prorates the personal property assessment and processes
refunds on vehicles when taxpayers change residence or vehicles are disposed of.
All vehicles owned by taxpayers in the City of Roanoke are required to display a
City decal. The proration and refund of property tax is based on purchase, sale,
and situs dates. For private passenger vehicles, the City decal is purchased for an
annual fee of $20 and displayed by June 1 of each year or within 30 days of
acquiring situs in the City. Ifa vehicle is purchased on or after December 1 and
before March 2, the City Code provides for the proration of the purchase price of
the decal to be $10 for private passenger vehicles. If the purchase date is between
March 2 and May 31 the cost is $6.67 for private passenger vehicles. Effective
January 1, 1994, the annual decal fee changed from $15 to $20 for private
passenger vehicles. Prior to January 1, 1994, the decal fee for private passenger
vehicles purchased between March 2 and May 31 was $5.00.
Current Situation:
When a taxpayer disposes of a vehicle prior to December 1, there is currently no
provision for the refund of any portion of the decal fee. The City Code provides
for the prorated purchase price of the decal but not for the prorated refund ora
decal fee.
When a taxpayer acquires a vehicle between March 2 and May 31, they must
purchase a current year City decal for one-third of the annual decal fee ($6.67 for
private passenger vehicles).

City Council authorize a partial refund of the personal property decal fee of one-half if a
vehicle is sold or otherwise disposed of before December 1 and the decal is surrendered to
the Commissioner of the Revenue's Office on or before January 31 of the same tax year.
Also, City Council authorize the decal fee for vehicles purchased between March 1 and
May 31 change from one-third of the annual decal fee ($6.67 for private passenger
vehicles) to one-quarter of the annual decal fee ($5.00 for private passenger vehicles). This
will provide a more consistent decal fee policy. The revenue loss to the City is estimated
to be minimal (less that $2,000 a year), while the taxpayer goodwill earned by this certainly
will spread to all areas of City government. An immediate effective date would be
appropriate.

Recommendation:

surrender of the decal on or before January 31 of the same tax year; and, change the decal
fee for vehicles purchased between March 1 and May 31 from one-third of the annual decal
fe.e ($6.67 for private passenger vehicles) to one-quarter of the annual decal fee ($5.00 for
private passenger vehicles). An immediate effective date would be appropriate.

The City of Roanoke prorates the personal property assessment and processes
refunds on vehicles when taxpayers change residence or vehicles are disposed of.
All vehicles owned by taxpayers in the City of Roanoke are required to display a
City decal. The proration and refund of property tax is based on purchase, sale,
and situs dates. For private passenger vehicles, the City decal is purchased for an
annual fee of $20 and displayed by June 1 of each year or within 30 days of
acquiring sims in the City. Ifa vehicle is purchased on or after December 1 and
before March 2, the City Code provides for the proration of the purchase price of
the decal to be $10 for private passenger vehicles. If the purchase date is between
March 2 and May 31 the cost is $6.67 for private passenger vehicles. Effective
January 1, 1994, the annual decal fee changed from $15 to $20 for private
passenger vehicles. Prior to January 1, 1994, the decal fee for private passenger
vehicles purchased between March 2 and May 31 was $5.00.
Current Situation:
When a taxpayer disposes of a vehicle prior to December 1, there is currently no
provision for the refund of any portion of the decal fee. The City Code provides
for the prorated purchase price of the decal but not for the prorated refund ora
decal fee.
When a taxpayer acquires a vehicle between March 2 and May 31, they must
purchase a current year City decal for one-third of the annual decal fee ($6.67 for
private passenger vehicles).

City Council authorize a partial refund of the personal property decal fee of one-half ifa
vehicle is sold or otherwise disposed of before December 1 and the decal is surrendered to
the Commissioner of the Revenue's Office on or before January 31 of the same tax year.
Also, City Council authorize the decal fee for vehicles purchased between March 1 and
May 31 change from one-third of the annual decal fee ($6.67 for private passenger
vehicles) to one-quarter of the annual decal fee ($5.00 for private passenger vehicles). This
will provide a more consistent decal fee policy. The revenue loss to the City is estimated
to be minimal (less that $2,000 a year), while the taxpayer goodwill earned by this certainly
will spread to all areas of City government. An immediate effective date would be
appropriate.

Recommendation.:
City Council approve the attached ordinance refunding personal property decal fees in the
amount of one-half upon the sale or disposal of a vehicle before December 1 and the
surrender of the decal on or before January 31 of the same tax year; and, change the decal
fee for vehicles purchased between March 1 and May 31 from one-third of the annual decal
fee ($6.67 for private passenger vehicles) to one-quarter of the annual decal fee ($5.00 for
private passenger vehicles). An immediate effective date would be appropriate.

At Roanoke City
Council was addressed
lighting plans for the
Council's meeting on December 16, 1996,
by Ms. Evelyn Bethel regarding the street
2nd Street/Gainsboro Road project.
At this meeting, City Council approved a recommendation to
install decorative (period) lighting on the new Gainsboro Road
bridge instead of the previously planned cobra-head lighting.
Funds in the amount of $228,000 were appropriated for these
decorative lights as well as the cobra-head lights needed for the
remainder of the project. The desire to have decorative lighting
on the bridge is consistent with efforts to include decorative
lighting on other recent bridge construction projects such as
Memorial Avenue, Jefferson Street and Walnut Avenue.
The request from Ms. Bethel was to continue the decorative
lighting through the residential portion of the 2nd Street/
Gainsboro Road project (Loudon Avenue to Harrison Avenue). The net
increase to install the requested decorative lighting is estimated
at $200,000 (see Attachment A). Our present policy is to provide
decorative lighting in our Central Business District and on major
public bridge facilities. If the City were to set a standard for
decorative street lighting on new roadway projects, the decorative
lighting costs could easily reach .$2.5 million for the twelve (12)
new lane miles of roadway on Peters Creek Road Extension and
Brandon Avenue Widening.
It should be noted that in a limited number of locations,
decorative lighting is used in Roanoke. Our inventory revealed
that there are five (5) subdivisions (Lakewood, Monterey Hills,
Sherwood Forest, Wellington and Windsor Place) which have a grand
total of 28 decorative street lights, all of which are maintained
by America--~ Electric Power. Installation of the lights was at the
expense of the developers of these subdivisions.

In an effort to reserve decorative lighting for the
enhancement of bridge projects, and due to the estimated additional
costs, it is not recommended that the decorative lighting be
extended to the remainder of the Gainsboro Road project. It should
be noted that this project does include the construction of 850
feet of new brick sidewalks along each side of Gilmer Avenue east
of Jefferson Street. This $50~000 neighborhood enhancement is
being funded at 100 percent City expense. Also, an additional
$205,000 in VDOT and City funding is being spent on landscaping
items along Gainsboro Road from Orange Avenue to the new bridge
which includes an Historic Gainsboro sign for the corner of
Gainsboro Road and Wells Avenue (identical to the existing sign on
Wells Avenue at Commonwealth Avenue). The enhancements included in
this project will create a streetscape that should please City
Council and the citizens of Roanoke.

A RESOLUTION authorizing the City Manager to submit a street
inventory for State maintenance payment eligibility to the Virginia
Department of Transportation (VDOT), upon forms prescribed by VDOT
for approval by the Commonwealth Transportation Board, in order to
ensure the City's eligibility for State maintenance funds.
WHEREAS, the Code of Virginia (1950), as amended, establishes

I. Backqround:
Code of Virginia establishes the eligibility criteria of
localities for receiving funds from the Virginia
Department of Transportation (VDOT) for street
maintenance. It specifies two functional classifications
of highways (Principal/Minor Arterials and
Collector/Locals) and establishes a base payment rate per
lane mile for each classification of roadway. These
rates are adjusted annually by VDOT based upon a
statewide maintenance index of unit costs for labor,
equipment and materials used by VDOT on roads and
bridges.

City eligibility for fiscal year 1996-97 is approximately
$7,308,127 in street maintenance payments from VDOT.
These funds are used for many maintenance expenditures
that the City incurs for streets, sidewalks, curb and
gutter, traffic signals, bridges, signs and pavement
markings.
II. Current Situation:
Inventory additions need to be submitted to VDOT prior to
April 1, 1997, in order to be eligible for payment for
the next fiscal year. These additions are to be
submitted on VDOT forms with an accompanying resolution
from City Council.
City staff has found that the attached list of streets
should be submitted to VDOT before April 1, 1997, to
enable their eligibility for payment in the next fiscal

year. Approval of this addition to the street inventory
could add $112~881 at current year payment rates. These
changes include three (3) major roadway projects that are
nearing completion (Brandon Avenue Widening;
Peters Creek Road Extension Phase I; and 2nd St./
Gainsboro Road). Any roadway not completed by July, 1997
will be deferred by VDOT to the following fiscal year for
maintenance payment eligibility.

Keeping of Inoperative Vehicles, of Chapter 20, Motor Vehicles and
Traffic, of the Code of the City of Roanoke (1979), as amended, to
provide for regulation of inoperative vehicles in residential,
commercial or agricultural districts, and appropriate procedures
for the removal and disposition of unlawfully kept inoperative
vehicles; and providing for an emergency and an effective date.
BE IT ORDAINED by the Council of the City of Roanoke that:
1. Subsection (e) of ~20-118, Definitions; ~20-121, Removal
of inoperative vehicles; S20-123, Appeals; and adding new ~20-124,
Penalties, of Article V, Keeping of Inoperative Vehicles, of
Chapter 20, Motor Vehicles and Traffic, of the Code of the City of
Roanoke (1979), as amended, are hereby amended and reordained to
read and provide as follows:
Chapter 20. Motor Vehicles
ARTICLE V.
and Traffic
Keeping of inoperative vehicles.
S20-I18. Definitions.
For the purposes of this article, the following words
and phrases shall have the meanings given herein:
(e)
Shield from view or shielded from view: Completely
precluding visibility of the subject vehicle from
all adjacent streets, alleys and properties, by
placing the vehicle within: (1) a fully enclosed
building or structure, or (2) an area completely
enclosed either by a solid, rigid, opaque fence
composed of standard fencing materials or by a
landscaped arrangement of non-deciduous trees,
sufficient in height, spacing, density and
circumference. The placing, draping or securing of
a tarpaulin, or other non-rigid cover, over or
around an inoperative vehicle shall not be
sufficient to comply with the requirements of this
article.
§20-121. Removal of inoperative vehicles.
(a)
An owner of any inoperative vehicle on any property
which is zoned for residential, commercial or
agricultural purposes, or the owner of any such
property upon which such an inoperative vehicle is
located, shall bring such vehicle into compliance
with the requirements of this article within ten
(10) calendar days of the date of notice to the
owner of such inoperative vehicle, and the owner of
the property upon which such inoperative vehicle is
located, that such vehicle is in violation of this
article. The notice shall (1) reasonably describe
the subject inoperative vehicle, and reference this
article; (2) state that any owner of such
inoperative vehicle or property on which such
inoperative vehicle is located may appeal the City
Manager's decision that the vehicle is in violation
of this article by filing a Notice of Appeal with
the City's Planning and Community Development
Department; (3) state that failure to comply with
the requirements of this article may result in the
removal and disposal of the vehicle; and (4) state
that such removal and disposal may be at the
expense of the owner of such inoperative vehicle or
the owner of property upon which such vehicle is
located.
(b)
Whenever an owner of any such inoperative vehicle,
or an owner of any property upon which such vehicle
is located, fails to bring such inoperative vehicle
into compliance with the requirements of this
article within ten (10) calendar days of such
notice, the City Manager may order such vehicle to
be removed from the property.
S20-123. Appeals.
(a) Any person aggrieved by a decision of the city
manager in connection with the administration or
enforcement of this article may appeal such decision by
filing a written notice of appeal with the city's
department of planning and community development within
ten (10) calendar days of such decision. Any such notice
of appeal shall state the following in writing:
(1) The order, requirement, decision or
determination which is the subject of the
appeal;
(2) The date of the decision; and
(3) The reason(s) for the appeal.
(b) Upon receipt of an appeal by the City's Department
of Planning and Community Development, the City Manager
shall designate a person, or panel of persons consisting
of an odd number of persons, who did not participate in
making the determination under review to hear the appeal.
(c) The appeal shall be heard as soon as possible after
the filing of the appeal, but in no event more than ten
(10) business days after the filing of the appeal, unless
the appeal officer, or panel, and the aggrieved person
agree to an extension of the ten-day deadline.
(d) The appeal officer, or panel, shall announce any
decision within five (5) business days after the hearing,
unless the appeal officer, or panel, and the aggrieved
person agree to an extension of the five-day deadline.
The appeal officer, or panel, shall have authority to
affirm, modify or reverse the City Manager's decision,
including the authority to order appropriate relief under
all circumstances.
(e) Extension of deadlines pursuant to this section
shall extend any other deadline within this article by an
equal number of business or calendar days, as
appropriate.
(f) Any appeal filed under the provisions of this
section shall stay enforcement of the order until such
appeal has been reviewed and decided.

City Code (1979) as amended.
Back~round:
City Council. on January 1. 1996. adopted an ordinance amending and reordaining
Chapter 20, Motor Vehicles and Traffic, of the City Code (1979) as amended.
Ci_ty Ordinance, generally referred to as the city's "Inoperative Motor Vehicle
Ordinance" provided for regulations to govern the manner in which certain motor
vehicles may be kept on properties zoned for residential, commercial or agricultural
purposes within the city.
Inoperative Motor Vehicle Ordinance provides, among other things, authorization
for the City Manager to remove (tow) any inoperative motor vehicle from any such
property ,whenever the owner thereof, fails, at~er reasonable notice has been given,
to bring such vehicle into compliance with the requirements of the ordinance.
Enfomement of the ordinance commenced on May 1, 1996. Since that time, 1200
inoperative vehicle violations have been cited and processed by city forces. Owners
of the affected properties and vehicles in 1140 of these violations have voluntarily
moved, shielded, or othenvise brought their inoperative vehicles into compliance
with the legal requirements of the ordinance. The city has so far been forced to tow
(remove) a total of only 60 inoperative vehicles
~ however, failed to provide for certain contingencies that
were not anticipated during the study and preparation of the ordinance.

II. Current Situation:
Ino_nerative Motor Vehicle Ordinance as currently set out in Article V, of Chapter
20 in the City Code needs to be amended to provide for the following:
Prohibition on the use of tam_ aulins (tam_s) and covers to shield violations
(vehicles) fi.om view, as a means of complying with the requirements of the
ordinance
Fines in an amount designed to encourage compliance with the ordinance
and thereby discourage, at, er reasonable notice has been given, the denial of
access to the premises through secured fences, the tethering of guard dogs,
or the otherwise blocking of the City's efforts to cite violations or remove
inoperative motor vehicles.
B. Amendments will effect the following changes:
Proposed amendment to section 20-118 (definitions) will prohibit the us~
of tarnaulins (tarp~) or other covers as a means of complying with the
requirements of the ordinance.
Proposed amendments to section 20-121 (removal of inoperative vehicles)
will decrease the time period allowed for owners to comply with the
requirements of the ordinance fi.om the current 15 days tO 10 days and
simplify notice requirements under the ordinance.
Proposed amendment to section 20-123 (Appeals) will len~hen the time
period within which an appeal may be filed by any person aggrieved by a
decision of the City Manager in connection with the administration or
enforcement of the ordinance.
Addition of Section 20-124, (Penalties) will increase the amount of fines that
may be imposed upon violators who fail to comply with the requirements of
the ordinance after reasonable notice has been given.

1. Uniform enforcement of the Inoperative Motor Vehicle Ordinance:
Amendments will enable the city to enforce the ordinance and
encourage compliance in a fair and equitable manner.
Enforcement will extend to properties where access has previously
been denied or blocked.
2. Aesthetic effect oftarnaulins and covers:
Current ordinance does not prohibit the use of tarps and covers as
a means of complying with the requirements of the ordinance.
Neighborhood organizations and the general public have lodged
numerous complaints with the city for allowing violators to use tarps
and covers as a means of complying with the requirements of the
ordinance.
3. Inconvenience to owners of affected properties and vehicles:
Current regulations provide owners of the affected properties and
vehicles with adequate remedies and reasonable alternatives to
comply with the requirements of the ordinance.
Under the provisions of the ordinance, violations can be abated
by the owners of the affected properties or vehicles by simply
placing the vehicle within an enclosed buildin~ or within an area
of the property that is enclosed by a solid opanue fence or an area
enclosed by an arrangement of landscaned trees, provided that all
such enclosures are sufficient to preclude visibility of the
inoperative vehicle from all adjacent streets, alleys, and surrounding
properties.
Owners also have the option of bringing the vehicle into compliance
with the licensing laws of the Commonwealth of Virginia, by
restoring the vehicle to an operable condition, obtaining valid
license plates or valid inspection dec01~ for the vehicles. Owners

vehicles.

Residents and neighborhood organizations will continue to
complain about the city allowing violators to use tarps and covers to
comply with the requirements of the ordinance.
Continued use and increase of tarps and covers in residential yards
of neighborhoods and communities across the city, will have an
overall negative effect on property values and the general landscape
of the city at large.
Inconvenience to owners of affected nrot~erties and vehicles would not be an
issue.

residue property identified as Official Tax No. 1020716 associated
with the Franklin Road and Elm Avenue Intersection Improvement
Project, Project No. 0221-128-102, PE-101, RW-201, C-501
("Project"), subject to certain terms and conditions; and providing
for an emergency.
WHEREAS, by Ordinance No. 29579, adopted May 22, 1989, the
City requested that VDOT acquire all rights-of-way necessary for
the Project and convey said rights-of-way to the City at the
appropriate time;
WHEREAS, said Project was completed in November, 1992, with
the exception of the omitted portion of the Project area located on
the southwest corner of the Franklin Road and Elm Avenue;
WHEREAS, in 1993, the City acquired at no cost from VDOT 1.028
acres of residue property from the completed portion of the said
Project; and
WHEREAS, title to the residue parcel of the omitted portion of
the Project remains in the name of the Commonwealth of Virginia.
THEREFORE, BE IT ORDAINED by the Council of the City of
Roanoke that:
1. The City Manager is authorized to request the Virginia
Department of Transportation to convey at no cost to the City the
residue property identified as a 0.111-acre parcel, bearing
Official Tax No. 1020716, associated with the Franklin Road and Elm
Avenue Intersection Improvement Project, Project No. 0221-128-102,
PE-101, RW-201, C-501 ("Project"), subject to a satisfactory
environmental review, as more particularly set forth in the report
to this Council dated February 18, 1997. The instrument conveying

Dear Mayor Bowers and Members of City Council:
I. Backqround:
City Council, at its meeting on June 17, 1985,
unanimously approved Resolution No. 27729, which
requested that the Virginia Department of Transportation
(VDOT) program a project to widen Franklin Road from
Third Street, S.W. to Elm Avenue. This project, which is
consistent with the 1995 Roanoke Valley Transportation
Plan, was subsequently included for funding in VDOT's
Six-Year Highway Improvement Program.

City Council, at its meeting on May 22, 1989, approved
the location and major design features of the proposed
project as presented at the March 28, 1989 Public Hearing
(Ordinance No. 29579).
Commonwealth Transportation Board approved the location
and major design features of the proposed project on
July 20, 1989.
The majority of the project was completed in 1992.
However, prior to construction, it became necessary to
omit a portion of the project area located on th~
southwest corner of the Franklin Road/Elm Avenu~
intersection which was the location of a convenience
store and gasoline station. The issue of responsibility
for proper removal and disposal of underground storage
tanks and contaminated soil found at this property needed
to be addressed prior to VDOT's purchase of this
property. VDOT and the Department of Environmental
Quality (DEQ) and the property owner have now resolved
this issue, thereby allowing that portion of the project
to proceed.

II. Current situation:
Bids for construction to complete the intersection work
were received by VDOT. The Commonwealth Transportation
Board awarded a contract to H & S Construction Company,
Inc., Roanoke, Virginia, on January 16, 1997, in the
amount of $311~561.75. A sketch of the project is
provided on Attachment I.
B. Features of this project include:
Improvement of the turninq radius on the southwest
corner of the intersection. This radius will be
identical to the other three (3) corners of this
intersection improved in 1992.
2. Addition of a right turn lane on the eastbound
Elm Avenue approach to Franklin Road.
Addition of pavement width on Franklin Road from
Elm Avenue to Mountain Avenue (a distance of
300 feet). This will enable two (2) through lanes
of traffic to travel south on Franklin Road through
the Elm Avenue intersection and then merge into one
lane as it proceeds further south. Old Southwest,
Inc. previously opposed allowing two (2) southbound
lanes all the way through Old Southwest on
Franklin Road (from Elm Avenue to U.S. Route 220
on-ramp). However, Old Southwest, Inc. has been
advised of this project and has not opposed the
merging of two-lanes into one lane at this
location.

Allow riqht-turn-on-red for southbound
Franklin Road at Elm Avenue which has been
restricted to date due to current location of
traffic signals.
Demolition of the convenience store building. The
Architectural Review Board approved, at its
November 14, 1996 meeting, an application for a
"certificate of appropriateness" to demolish this
structure, which is located in an historic
district.

III.
Creation of residue property (0.111 acres) on the
convenience store site purchased by VDOT (Tax
No. 1020716). Ownership of this residue is of
interest to the City of Roanoke. In 1993, the City
acquired from VDOT the 1.028 acres of residue from
the completed Franklin Road project. This was done
to have control of real estate to help insure
future implementation of the 1990 Franklin Road/
Elm Avenue Master Plan. City should request that
VDOT donate the residue to the City, subject to
satisfactory environmental review and
identification of a specific use for the property.
Provision for the contractor to close Elm Avenue to
all traffic from Franklin Road to 4th Street~ S.W.
for one (1) weekend (dates to be determined). This
is necessary due to the installation of a storm
drain at a depth of 15 feet across Elm Avenue.
Advance publicity of this closure will be
coordinated between VDOT and the City.
City must execute the attached
(Attachment II) before
H & S Construction Company, Inc.
City-State Agreement
VDOT will allow
to begin construction.
City share of the cost for this project (preliminary
engineering, right-of-way, and construction) is estimated
at $15,171.95. The third page of Attachment II shows the
cost sharing ratios to be used on this project. A
contingency of $774.68 is needed, bringing the total
funds needed to $15~946.63.

IV. Alternatives:
City Council authorize the City Manager, in a form

State Agreement on behalf of the City; and approve a
measure requesting VDOT to donate residue property to the
City.

AGREEMENT BETWEEN THE CITY OF ROANOKE
AND VIRGINIA DEPARTMENT OF TRANSPORTATION
The City of Roanoke, Commonwealth of Virginia, hereinafter referred to as
ROANOKE, and the Commonwealth of Virginia, Department of Transportation,
hereinafter referred to as the DEPARTMENT, hereby agree as follows:
The DEPARTMENT will prosecute a project for the
improvement of 0.058 mile of Franklin Road within I
ROANOKE from Elm Avenue, Station 31 + 99.94 to 0.058
Mile S. Elm Avenue, Station 35 + 05.00 and designated as
Route 221, Project 0221-128-102, PE-101, RW-201, C-501.
ROANOKE approves the plans as designed and requests the
DEPARTMENT to submit the project with recommendation
that it be approved by the Commonwealth Transportation
Board and agrees that if such project is approved and
constructed by the DEPARTMENT, ROANOKE, thereafter, at
its own expense, will maintain the project, or have it
maintained, in a manner satisfactory to the DEPARTMENT or
its authorized representatives and will make ample provision
each year for such maintenance.
ROANOKE agrees that after construction of the pro, ject, or
any part thereof, it will not permit any reduction in the number
of or width of traffic lanes, or any additional median
crossovers and enlargement of existing median crossovers,
or any alterations to channelization islands, without the prior
written approval of the DEPARTMENT.
Parking will be prohibited at all times on both sides of this
project and appropriate NO PARKING signs shall be erected.
The signs shall conform to the standards as shown in the
current edition of the Manual on Uniform Traffic Control
Devices. I
ROANOKE agrees that the location, form and character of
informational, regulatory and warning signs, curb and
pavement or other markings and traffic signals, installed or
placed by any public authority, or other agency, shall conform
to the standards as shown in the current edition of the
Manual on Uniform Traffic Control Devices or be subject to
the approval of the DEPARTMENT.
ROANOKE agrees that the location and installation of utility
poles, lighting standards, traffic signal poles or any other
facility installed or placed within the right of way by any public
authority, or other agency, shall conform to VDOT Land Use
Permit Manual or be subject to the approval of the
DEPARTMENT.
ROANOKE agrees to comply with Title VI of the Civil Rights

Act of 1964 and the Virginia Fair Employment Contracting
Act, Section 2.1-374 through 2.1-376 of the Code of Virginia
(1950), as amended.
ROANQKE agrees to comply with all applicable federal, state
and local rules, regulations and statutes when work is
performed on this project with municipal forces or its agent at
project expense.
ROANOKE agrees to participate in the actual cost (~f this

Subject:
Virginia Abandoned Housing Clearance Fund
I. Background:
Vacant residential buildings in the City have been identified frequently and
consistently as a ma_lot concern to City residents and neig-hborhood~. Significant
amounts of General Funds and federal funds are dedicated to them by City Council
each year, including a total of $142,983 for demolition in the current fiscal year.
Much more is allocated for repairs to buildings to prevent their deterioration and
demolition.
1996 Vir_e/nia General Assembly appropriated $500.000 for the Abandoned Housing
~, "to provide financial assistance for acquisition, demolition, or
clearance of abandoned housing."
Funds must be used on currently unoccupied residential structures being addressed
through conservation or redevelopment plans, spot or drug blight removal plans: or
as unsafe buildings under the Building Maintenance Code. The state intends to use
the funds primarily to support projects with plans for productive reuse that will result
in a noticeable impact in a specific area.
D. Roanoke is one of twelve (12) communities eligible for program funding.
Funding of up to $100.000 per locality will be awarded competitively based on
applications received by February 28, 1997.
Funds received must be matched at the rate of one dollar locally from federal, local,
or private sources for every two dollars received from the state. Any funds spent on
work directly associated with an affected property since July 1, 1996 would qualify
as matching funds.
Each application must include a resolution from City Council designating the
applicant for the locality. Eligible applicants could inclu~le nonprofit organizations,
the redevelopment authority, or similar organizations.

Several potential projects or areas of activity exist which a grant from the program
could assist, although none are known that appear to be an extremely good fit with
the guidelines and priorities for the state funding. However, some may be refined
or adjusted to stand a fair possibility for approval.

Authorize the City Manager to prepare and submit an application to the Virginia
Department of Housing and Community Development for up to $100,000 on behalf
of the City for the Virginia Abandoned Housing Clearance Fund.
Impact on health, safety, welfare and community conditions will be positive,
as any funds received from the state may be used to relieve hazards, blight,
crime, and other problems stemming from vacant houses, through demolition,
redevelopment, or repair and reuse.
Cost to the City will be limited to the requirement for matching funds.
Matching funds may be from local, federal, or private funds used on the
project, and must equal at least one-half of the state funds received (e.g.
$30,000 of match if $60,000 allocated by the state). Depending on the
project, the application will provide for match either from:
Private funds allocated to the project, e.g. conventional financing for
renovation; or
Funds already allocated by the City Council for eligible activities,
e.g. demolition funds ($150,000 of CDBG funds and $25,000 of
General Funds have been allocated for demolition in the current fiscal
year); or
Funds allocated by City Council for the coming fiscal year from
federal funds or General Funds, e.g. for demolition. The application
will be made subject to allocation of these funds by City Council.

Timing is such that the resolution for the City to apply for program funds
must be adopted prior to the application being submitted by February 28,
1997. If the state approves the application and offers a grant to the City,
Council will be asked to consider accepting the funds in a specific action at
that time.
Do not authorize the City Manager to submit an application for the Virginia
Abandoned Housing Clearance Fund.
Impact on health_ safety, welfare and community conditions would not be
improved by the loss of the possibility of up to $100,000 in additional
financing to relieve hazards, blight, crime, and other problems stemming
from vacant houses.
Cost to the City. would be nothing directly, unless a project for which state
funds could have been received would proceed with funds from the City~
Matching funds would not be an issue~

Recommendation is to concur in Alternative A, thereby authorizing City Manager to prepare

BE IT RESOLVED by the Council of the City of Roanoke as follows:
1. All bids received by the City for four new refuse cabs/chassis and four new
refuse bodies (Bid No. 96-6-43) are hereby REJECTED.
2. The City Clerk is directed to notify all bidders and express to each the City's
appreciation for said bids.
3. The City Manager is authorized to procure used trucks and related equipment
to be used in connection with the residential solid waste collection program, such
procurement to be in accord with Chapter 23.1, Procurement, Code of the City of Roenoke
(1979), as amended.

I. Background on the subject in chronological order is:
May 13. 1996, City Council with the approval of the '96:97 Budget
approved the concept of automating Residential Solid Waste
Collection.
Specifications were developed and along with Request for
Quotation were sent specifically to Eighteen (18) equipment
vendors. A public advertisement was also published in The
Roanoke Times and The Roanoke Tribune.
Bids appropriately received were publicly opened and read at 2:00
p.m. on July 8, 1996 in the Office of Supply Management.
Bids reauested that prices submitted were to remain firm for a
period of Seven (7) months in order to allow for the comprehensive
study on the possibility of out-sourcing of residential solid waste
collections.
I1. Current Situation is:
Seven (7) bid responses were received. A tabulation of those
responses is attached.
All responses received were evaluated by representatives of the
following departments:

Bid evaluations are as follows:
1. Item #1 - 4 New Refuse Truck Cabs/Chassis.
The lowest bid. submitted by Mid-Atlantic Waste
Systems, Inc. as an alternate bid, took exception to
the requirement for the cab to be Iow entry. This
exception is substantial and cannot be waived as an
informality.
The second lowest bid submitted by Mid-Atlantic
Waste Systems, Inc., their base bid, took exception to
the requirement for the cab to be Iow entry and cam
type brakes instead of required disc brakes. These
exceptions are substantial and cannot be waived as
informalities.
The third lowest bid submitted by Fulton Trucks, Inc.
took exception to the requirement for the cab to be
Iow entry. This exception is substantial and cannot be
waived as an informality.
The lowest bid meeting specifications was submitted
by Crane Carrier Company. That bid price was
submitted at $79,767.00 per unit. This cost exceeded
the available Funding for this item. As allowed by the
Code and requested in the bid document,
negotiations were conducted with the lowest bid
meeting specifications in the attempt to get the item
within the amount available for the purchase. The
final negotiated price with Crane Carrier Company
was $78.167.00 per unit.
Item #2 - 4 New 24 Cu. Yd. Side Loading Refuse Bodies with
Hydraulic Operated Lifting Devices to be mounted on Item #1.
The lowest bid submitted by Mid-Atlantic Waste
Systems, Inc. did not include the requirement of the
Hydraulic Lifting Device. This exception is substantial
and cannot be waived as an informality.

The lowest bid meeting specifications was submitted
by Mid-State Equipment Company, Inc. at a cost of
$49.525.00 each. This cost also exceeded the
available Funding designated for this item. As
allowed by the Code and requested in the bid
document, negotiations were conducted with the
lowest bidder meeting specifications. The final
negotiated price for this item is $48.300.00 per unit.
December 19. 1996 representatives of City Council, Regional Solid
Waste Management Cooperation Team and City Administration
Staff met to discuss the process of obtaining the necessary
equipment for this project.
Regional Solid Waste Manaaement Cooperation Team emphasized
the value of used equipment available on the open market and the
savings to be realized with the purchase of used equipment instead
of new equipment.
Assurance is given by Fleet Management personnel that suitable
used equipment can be located and reconditioned to like new
condition.
Anticipated cost to purchase and recondition used equipment is
$40,000 to $50.000 per unit. This is substantially less than the
$126.500 per unit cost bid for new equipment.
Success has been realized in the purchase of used equipment.
The most recent is the purchase of a used Ready-mix Cement
Truck.

Alternatives in order of feasibility are:
City Council authorize the City Manager to locate and secure used
trucks and related equipment that would be appropriate to
accomplish the program of solid waste collection for residential
areas, at an estimated cost of $200,000.
Need. for the equipment is to allow for the implementation of
the solid waste collection program.
Compliance with specifications would not be a factor in this
alternative.
Timing is critical in order to locate, acquire and ready for
service the equipment addressed by this alternative. The
purchase and reconditioning of used equipment can allow
the residential solid waste collection program to be
implemented sooner.
Funding is available in the Capital Maintenance and
Equipment Replacement Program to provide for this
alternative.
City Council accept the lowest bids meeting specifications for
Refuse Collection Equipment as follows:
Four (4) New Refuse Truck Cabs/Chassis from Crane
Carrier Company for a cost of $78.167.00 per unit.
Four (4) New 24 Cu. Yd. Side Loading Refuse Bodies with
Hydraulic Lifting Device to be mounted on above Truck
Cabs/Chassis, from Mid-State Equipment Company, Inc. for
a cost of $48,300.00 per unit.
Need for the requested equipment is to allow for the
implementation of the new solid waste collection
program for residential areas.
Compliance with Specifications is met by the
providers identified in this alternative.
Timing is critical to allow for ordering and delivery of
the requested equipment need to implement the
program. Program implementation could be delayed
6-9 months due to the delivery of new equipment.

Bids to Purchase Automated
Refuse Containers,
Bid No. 96-7-33
I. Background on the subject in chronological order is:
May 13. 1996 City Council approved the concept of automating
Residential Solid Waste Collection.
Specifications were developed for Automated Refuse Containers.
These specifications along with Request for Quotations were sent
to Twenty-Three (23) vendors. A public advertisement was also
published in the Roanoke Times and Roanoke Tribune.
Bids appropriately received were publicly opened and read at 2:00
p.m. on August 29, 1996 in the Office of the Manager of Supply
Management.
II. Current Situation is:
Seven(7) bid responses were received. A tabulation of those
responses is attached.
All bid responses were evaluated by representatives of the
following Departments:
Public Works
Solid Waste Management
Management & Budget
Supply Management
Evaluations determined the need for the provider to assemble and
deliver the units would enhance the implementation of the program.

follows:

The lowest bid, submitted by Zarn, Inc. took exception to the
specifications regarding the handle on the cart. This is
substantial and cannot be waived as an informality. Two (2)
field test were conducted. In the first test the Zarn, Inc. unit
developed a stress crack in the bottom of the container, the
wheels flattened and a skid pad was broken. In the second
test, the Zarn cart lost its lid and showed significant cracks
and dents.
The second lowest bid, submitted by Otto Industries, Inc.,
took exception to the minimum load ratings required by the
specifications. This exception is substantial and cannot be
waived as an informality. The field tests conducted on the
Otto Industries, Inc. unit showed no significant damage.
The lowest bid meeting specifications is the bid submitted by
Toter, Inc. This unit also was tested with no significant
damage resulting. This unit also is the unit currently being
used by Roanoke County in its automated program. The bid
unit cost is $40.89 each for the 95 gallon container and
$38.89 each for the 64 gallon container.
Initially. fundin(~ for Solid Waste Management refuse collection
automation was to be provided from $357,000 in one-time health
insurance savings, $147,000 in personal services savings in the
Solid Waste Management department, $170,000 in life insurance
savings due to the waiver of premiums, the reallocation of $247,000
in fleet replacement funding, and $535,000 from existing General
Fund revenue.
The health insurance savings will not be available due to the
increase in the cost of health care. The personal services savings
in the Solid Waste Management will not be available due to the
delay in the implementation of automated refuse collection. With
the acquisition of used refuse collection vehicles, the cost of
equipment acquisition will be less than anticipated.

SUBJECT: Transfer of Funds from the Roanoke City Sheriff's Department to
the Juvenile Detention Home
I. BACKGROUND
Roanoke Juvenile Detention Home has recently been cited for numerous
serious violations of Standards relating to security, life, health, safety and
services. Certification by the State Department of Juvenile Justice wes at
stake because of these cited violations.
The condition of the facility has been areatlv improved and the cited
violations corrected through the team efforts of the Roanoke City
Sheriffs Department, the Building Maintenance Department and other
city employees.
Pooulation has been reduced to a manageable level through the
cooperative efforts and agreement with the Twenty-third Judicial
District Judges and the City Manager limiting services to other
jurisdictions.
The Deoartment of Juvenile Justice has reviewed the progress of the
facility and are assisting with development of program services.
City Council a[~oroved five new counselor positions which bring the
level of staff to juvenile ratio up to Standards for thirty or less
juveniles in the facility.
Expansion/Renovation of the Detention Facility is still eighteen (18) months
or more into the future. Plans for the expansion/renovation are in the
process with the Department of Juvenile Justice.
Some needs that affect security and safety issues cannot wait
eighteen (18) months. These deficiencies directly increase liability for
personal injury to both staff and juveniles in the facility.
New ec~uipment and up-grade of security is essential to the safe and
efficient operation of Detention in the immediate future, as well as
following the expansion/renovation project.

CURRENT SITUATION
EauiDment needs and Security Issues have been identified and agreed upon
by security knowledgeable personnel of the Sheriff's Department,
Department of Juvenile Justice and the Acting Superintendent. The facility
staff are in agreement that these other needs are critical to safety and
security at the facility.
The Detention Facility handles more violent and destructive juveniles
than in years past. The current population requires use of modern
equipment to control, monitor and secure these juveniles.
Some level of overcrowding will continue in order to serve the needs
of Roanoke City Juvenile Judges to protect the community and
provide for public safety. Even moderate overcrowding increases risk
of violent, assaultive behaviors.
Security eauipment needs include (1) replacement of cell doors and
corridor doom, (2) new keys and locks in security areas, (3) security
light fixtures in cells in order to see juveniles before opening cell
doors, (4) lockers for police weapons and personals to control
contraband, (5) steel screen to prevent escapes through kitchen, (6)
installation of a video surveillance system, (7) stainless steel mirrors,
(8) Photo ID Camera System, (9) Copier and (10) staff uniform
clothing (see Attachment "A').
The Roanoke City Sheriff's Deoartment has transferred $8.000 to the
Juvenile Detention Home for purchase of (1) a walk-through metal detector,
(2) hand held metal detector, (3) new steel beds, (4) portable stack beds for
overcrowding, and (5) a safe for juvenile's valuables.
Sheriff Hudson has assianed two deputies who have given support
services, provided technical assistance and helped with safety and
security.
Inmates from the Jail under direct supervision and removed from
juveniles by sight and sound have painted, cleaned and repaired
many areas of the facility.

Sheriff Hudson has .qenerously offered to transfer $92,555 to the Juvenile
Detention Home budget for purchase of the identified equipment listed on
Attachment "A".
These funds are provided from the Sheriffs Department Recovered
Cost Account.

V. RECOMMENDATIONS
Concur with Alternative "A' and authorize the transfer of $92,555 from the

001 024 3310 8005 with appropriate expression of gratitude to the Roanoke

Mr. Kiser opened the meeting, stating that the last Flood Plain Committee meeting was held
on January 19, 1994. He then introduced two new members to the committee, Lucian Y.
Grove and Dennis D. Tinsley, and stated there were still two vacancies on the committee. He
introduced Greg Reed, Project Engineer, who took the place of John Peters.
Mr. Kiser reviewed the background of the project with the committee stating the it began in
1969, the cost benefit ratio is now 1:1.12, in 1989 there was a bond referendum of $7.5
million, the Local Cooperative Agreement was executed June 25, 1990, last cost estimate for
project is $35 million with local share being $15 million which includes acquiring of
easements. He stated that since 1991 $1.3 million has been spent on environmental testing.
There are 190 parcels involved. Phase I environmental testing cleared all but 123 of them.
Phase IIA involved more testing and all but 59 were cleared. Phase IIB involved more testing
of the remaining 59 parcels. Elements involved are early warning system, which is complete;
flood proofing of Sewage Treatment Plant and Roanoke Memorial Hospital, which is
complete; Recreation trail element was cut from 10 miles down to 3.5 miles; other elements
include Relocation, Channel Widening, Real Estate, and disposal of hazardous waste.
The City met with Corps on January 16, 1997. There is $4 million worth of contaminated
material to dispose of, most of which is fill dirt. There is some that is contaminated but not
considered hazardous. This has to be treated some other way such as taken to a special
landfill or incinerator. Corps needs to get DEQ to approve plan of action. Parcels to be
acquired will have to be reappraised.

The question was asked if property assessments on the flood plain had gone up. Mr. Kiser
stated that property assessments would be at fair market value.
It was brought out that 10 sites out of the 190 have contaminated materials. It was stated that
the old borrow site at the airport was a proposed disposal site of non-contaminated waste.
By March there should be a plan of action to submit to the Department of Environmental
Quality.
The question was raised as to whether or not a private property owner can build a berm to
protect his own property? It was stated that an engineering study would have to be done to
ensure flood waters will not increase on someone else's property if the berm is built.
Mr. Kiser stated that the City is not dealing with Environmental Protection Agency any more.
It is now the Corps of Engineers, with our support, asking a state agency how to handle
contaminated waste.
The City's environmental consultant and our project engineer are scheduled to meet with the
Corps of Engineers in Wilmington, N.C. in late February, or early March, with the goal of
finalizing a final plan to dispose of all excavated material and present that plan to the State
DEQ in April. Once the State DEQ approves a disposal plan and the benefit:cost ratio is
verified to remain above I:1, the COE will finalize construction plans and the City will
initiate property rights acquisition procedures (a process expected to take 12 to 18 months).
The COE would then advertise the project as a "continuous project", meaning the successful
contractor would work on the project as Congress provides funding.
The Committee discussed at length and expressed concern regarding the amount of time it
was still going to take to get project underway.
The Committee recommended that someone from Norfolk Southern be appointed to fill one of
the vacancies.

I. Back(~round in chronological order is as follows:
Development of new Brookfield Subdivision off Va. Route 660 in the Coyner
Springs area requires installation of drainage facilities to handle drainage.
Existino VDOT drainage facilities are inadeouate to handle flows, especially
after heavy rainfall, sometimes causing flooding in the roadway. Additional
drainage is required.
Developer's Enoineer ('LMW. PC~ has identified the best location for the new
drainage facilities on property owned by the City of Roanoke. VDOT has
agreed to accept maintenance responsibility of the new drainage facilities.
It has been the oolicy between the City and VDOT to donate easements, rights
of way, and residual properties left over from highway projects to one another
as appropriate. An example was the donation to the City of residual property
left over from the Franklin Road widening project a few years ago.
II. Current situation is as follows:
An easement across City-owned prooerty has been reauested by the
Develooer's Enaineer for the drainage facilities that need to be installed.

Original lease with the General Services Administration (GSA) for this
space dated July 15, 1985, which is occupied by the Bankruptcy
Court, was authorized by Ord. No. 27529. (GSA Lease #GS-O3B-
50012.) GSA Leases 12,413 sq. ft. of the total net leasable space of
46,161 sq. ft., the remaining 33,748 sq. ft. are leased to the
Commonwealth of Virginia under a lease due to expire June 30, 2005.

term of the ten-year lease to expire February 1, 1997, have
subsequently been approved.
Lease extensign8 for five-year terms are provided for in the original
lease agreement and do not require Council action. By letter dated
November 25, 1998, GSA notified the City that it would exercise its

the rate of 10% for the first $50,000 per month collected and 13% all over
$50,000 collected.

the Municipal Building to provide space for the provider's billing clerk to
handle City accounts.
Specifications were developed for the EMS billing and collection services.
Request for proposals were sent to Eleven (11) Firms providing such
services. A public advertisement was also published in the Roanoke
Times and Roanoke Tribune.

Interviews were conducted with both Firms in accordance to the
requirement of the Code of the City of Roanoke by representatives of
Fire/EMS, Billings & Collections and Supply Management.
Quantum Medical Business Services, Inc. was determined to be ranked
first after the interview process. Negotiations were conducted.
Lease A reement for the space for the billing clerk needs to be authorized
for the same period as the Contract to provide EMS billings and collection
services.

City Manager to execute a contract in a Form approved by the City

EMS billing and collection services for a period of One (1) year with
the City having the option to renew for Two (2) additional One (1)
year periods. The billing service commission shall be calculated
based on the net monthly collections which shall mean gross cash
receipts less refunds. If the monthly net collections total less than
$94,916.00, the commission shall be 8% of collections. If the net
monthly collections total $94,916.00 or more, the commission shall
be calculated at a rate of 8.45%.
City Manager to execute a new Lease Agreement in a Form
approved by the City Attorney, with Quantum Medical Business
Services, Inc. for a term of One (1) year with the City having the
option to renew for Two (2) additional years in a form approved by
the City Attorney.

Appeal Petition
As we discussed by telephone earlier this week, the two
house that are the subject of our Petition have not yet been
move~. The original moving date was scheduled ~or some time
around March 1~. We had all of the tenants who were occupying the
one bDilding vacate before that date, only to learn that the move
was pDstponed. The new date was set for some time around the end
of M~rch. I called to follow-up on that and learned that i= had
agai~ been postponed to early in April (never an exact date}- I
call~ again ChAp,il 9 and was aduised that the house mover ~ould
be h~re in approximately a week ~o a week and a half, agaxn no
firm date. I have not had an opportunity to go to the Clerk's
Of£ice yet ~o de=ermine whether or not the lots have been acquired
by P~rsell and Zeigler, but I do know that they have done the
preliminary site work for the new foundations, and I will find out
about the closings prior to the Council meeting.
I~ecause the houses have not yet been moved, we feel that it
is o~ce again necessary to continue this matter to the May Council
meeting. I am aware of no opposition to this request.

Dear Mary:
Please be advised that I intend to appear at the City
Council meeting session scheduled for 7:00 p.m. on
February 20, 1996, to request an additional extension for
presenting our appeal in the above-captioned matter. As you
may be aware, we have been successful in finding a party who
is interested in moving the two structures which are the
subject of the appeal. They have secured approval of the
Architectural Review Board for their proposed plans.
However, they have yet to secure a building permit and there
are a variety of things that could happen between now and the
proposed moving of those houses scheduled for some time in
the middle of March, 1996. Therefore, we feel that it is
prudent to preserve our rights to have this matter heard in
the event that some unforeseen circumstance should occur that
would prevent this party from carrying through on its plans
to move the structures.
I have spoken with Steve Talevi in the City Attorney's
Office about this matter, and he confirmed that it would be
necessary to make a personal appearance on February 20 to
request this extension.

Roanoke City Council this afternoon approved a request from the Episcopal
Diocese of Southwestern Virginia to postpone an appeal of an Architectural Review
Board (ARB) decision. That appeal was planned for tonight's City Council meeting.
The ARB has denied the dioceses' request to demolish two structures the diocese
owns on First Street Southwest.
A significant number of individuals were expected to attend the 7 p.m. meeting,
both from the diocese and the neighborhood. The City Council meeting will still be held
to consider other items on the agenda. The diocese's appeal is expected to be
rescheduled for the Tuesday, February 20, City Council meeting at 7 p.m.

Dear Mayor Bowers and Council Members:
On Tuesday evening, January 16, 1996, City Council will hear
the appeal of the Episcopal Diocese of Southwestern Virginia to the
October 12, 1995, decision of the Architectural Review Board. The
decision of the Board issued a Certificate of Appropriateness
approving the removal, but not the demolition of two buildings and
further approved in concept a proposed addition to the Evans house
(1000 First Street, S. W.). The report of the Architectural Review
Board, which is part of your agenda package, does a good job of
explaining the background and the applicable ordinances. In this
regard, I call your particular attention to the standard of review
which is set out in §36.1-348 of the City Code and which is quoted
on page 3 of the report.
Because of the uniqueness of this matter, I wanted to provide
City Council some assistance in framing the alternative motions
that might be made after the hearing. Attached to this letter, you
will find two alternative motions. The first motion approves the
decision of the Architectural Review Board in its entirety. This
motion approves the removal, but not demolition of the two subject
buildings and also approves in concept the proposed addition to the
Evans house (1000 First Street, $. W.). The second motion approves
the applicant's request. It permits the demolition of the two
subject structures and also approves the plans for the addition to
the Evans house.
These are not the only motions that could be made after the
hearing on Tuesday night. There are a myriad of other
possibilities, and I would be pleased to assist any Council member
in drafting any other motion desired.
I trust that the information contained in this letter will
prove useful to you. Please do not hesitate to contact me if you

PETITION FOR APPEAL
This is a Petition for Appeal from a decision of the Architectural Review Board
under Section 36.1-642(d) of the Zoning Ordinance of the Code of the City of Roanoke
(1979), as amended.
1. Name of the Petitioner: Episcopal Diocese of Southwestern Virginia
(hereinafter "Petitioner").
2. Address: 1000 First Street, SW, Roanoke, Virginia 24009.
3. Overlay Zoning of the property which is the subject of this appeal is
H-1/C-2.
4. The hearing before the Architectural Review Board was held October 12,
1995.
5. The Certificate of Appropriateness was requested from the Architectural
Review Board pursuant to the City of Roanoke Code Section 36.1-327. Petitioner
requested approval in concept of scale and massing of proposed addition to existing
structure located at 1000 First Street, SW, known as Evans House and
acknowledgement that the proposed addition would be of consistent architectural
appearance with the existing structure. The request also asked for permission to
demolish the structures located at 1010 and 1014 First Street, SW, adjoining the
existing structure in the event that Petitioner was unable to find a party that was willing
to remove the houses located on said two lots. Petitioner, as a part of the request,
volunteered to donate the structures on said lots and further volunteered the sum of
Thirty-six Thousand Dollars ($36,000.00) to be contributed toward costs of moving the
said structures, said removal to be accomplished prior to April 1, 1996.
6. Grounds for appeal: Petitioner feels that the ruling of the Architectural
Review Board in denying its request to demolish the structures represented an abuse
of discretion by said Board in that it ignored the economic realities associated with
moving and rehabilitating said structures. Petitioner also feels that this ruling is
inconsistent with previous rulings of the Board which have permitted demolition after
a reasonable period of time was afforded to locate interested parties, if any, who would
be willing to bear the removal and repair costs associated with the removal. Petitioner
also questions the histodc significance of the property located at 1014 First Street, SW,
and would further note that the structure located at 1010 First Street, SW, is not unique
as evidenced by the fact that there is an older structure of identical design located less
than a block away at 921 First Street, SW.
7. Petitioner will be represented by David C. Helscher of the law firm of Jolly,

ARB heard the matter at their Dubtic meetino on 10112,J95. After considerable
discussion by the Board, representatives of the Diocese, representatives of
Old Southwest, Inc., and the public, the Board voted 4-0 to aoorove the
removal, but not demolition, of the buildinos to an aoorooriate location in the
Old Southwest Historic District. and to anorove in conceot the orooosed
addition to the Evans House (1000 First Streefl, consistent with the general
scale, mass and architecture as discussed with the Board. Messrs. Manetta,
Jones, Harwood, and Whitwell voted in favor of the motion (Mr. Jamieson was
absent from the meeting). Messrs. Motley and Deck abstained from the
consideration of the matter because the architectural firm with whom they are
associated is involved with the project.
A Certificate of Appropriateness was issued, Number 95-035, in accordance
with the Board's action and is attached as Exhibit B.

The Board's decision was based uoon its findina that the loss of the buildina.~
at 1010 and 1014 First Street. S. W. would be adverse to the district by virtu=
of their architectural uniaueness and sianificanc~ Both buildings, especially
1010 First Street, contribute to the historic and architectural character of the
Southwest Historic District; therefore, demolition was not considered
appropriate.
The Board encouraged the Diocese to work further with Old Southwest and
others regarding moving the houses to an appropriate location in the
neighborhood. Once a new location was established, a Certificate of
Appropriateness would be required to erect the structure on the new lot.
The minutes of the ARB meeting are attached as Exhibit C.
Aooeal of ARB decision was filed with the City Clerk on 11/9/9~. Section
36.1-642 of the City Code requires that City Council schedule a public
meeting and render a decision within sixty days of the receipt of a petition for
appeal. The matter was scheduled for 1/8196, an evening meeting, but was
re-scheduled for 1/2/96 to meet Council's schedule and appeal hearing
requirements.

As stated in Section 36.1-342 of the City Zoning Ordinance, the intent of the
H-2. Neiahborhood Pl'eservation District. is "to ensure the oreservation Qf

buildinas which, in their aaareoate or individually, are of soecial community
~. The general intent includes, among others, the following specific
purposes":
"Encourage preservation, protection~ and enhancement of
streetacapes, structures and areas of architectural, historic or
cultural importance;"
"Encourage new construction, or alterations which are compatible
with the existing scale and character of surrounding properties;"
"Encourage the rehabilitation and continued use of existing
buildings, rather than their demolition."
Section 36.1-348 of the City Code provides that the ARB shall issue a
Certificate of AooroDriateness for demolition in the district where it findc that:
"Loss of the structure would not be adverse to the district or the
public Interest by virtue of its uniqueness or its significance to the
district."
"Demolition would not have an adverse effect on the character
and surrounding environment of the district."
'%/Vhera demolition is in conjunction with a proposed new use of the
site, such use satisfies the Intent and standards of the H-2 district."
ARB adooted Architectural Desian Guidelines for the H-2 Distri~+ to assist
them in reviewing applications for a Certificate of Appropriateness. The
applicable guidelines for new construction and demolition are included as
Exhibit D end recommend:
The size, proportion, and location of new buildings in relation to
existing buildings is important in maintaining the appearance of the
H-2 District.
New buildings that reflect the traditional site planning and
architectural characteristics of the neighborhood without copying
the architecture provide a link between the past and present.
Demolition of a building should only be considered if altemaflves
for rehabilitation are not feasible and the loss of a building will
not adversely affect the integrity of the district.

Preservation of a building In its existing location Is preferable to
it~ relocation. When relocation is unavoidable, the building, as well as
adjacent buildings, must be stabilized to protect important architectural
and structural features.
Structures at 1010 and 1014 First Street. S.W. are sionificant architectural
~ within the H-2 district.
Both are listed as contributing buildings in the National Register of
Historic Placea Inventory for the Southwest Historic District in
Roanoke, Virginia.
Mrs. Leslie Giles, Architectural Historian, for the Roanoke Regional
Office of the Virginia Department of Historic Resources, advised the
ARB that "both structures reflect the history and architectural
variation of the district" and "contribute to the historic character
of First Street streetscape due to their high level of integrity".
The building at 1010 First Street, S. W. is unique and especially
contributing to the district because of its outstanding Queen
Anne architecture. The building is a featured building on the
information and marketing poster produced by the City for the
Southwest Historic District, and it is included in on page 123 of W. L.
Whitwell's book, The Architectural Heritaae of the Roanoke Valley.

approved on appeal by City Council (Certificate
No. 91-001).

· Demolition of building approved by ARB
(Certificate No.93-054). ARB found that because
of the ooor condition of the buildina and its
location, its loss of buildino would not Be advers~

I am writing to request that the hearing date before
Roanoke City Council on the above-captioned matter be
postponed to January 16. The matter was originally scheduled
for January 8, 1996, and this was acceptable to us. However,
when City Council decided at its meeting in December to
change meeting dates for 1996, that decision moved the date
forward to January 2. That change presents a hardship to my
client in preparing for its presentation before Council. As
you can imagine, the week before the meeting is the week
between Christmas and New Year's and it will be dif.ficult to
do the necessary preparation because of vacation and travel
plans that have already been made by a number of people
associated with this matter.
I would be most appreciative if you could take an
informal poll of the Council members to determine whether
there would be opposition to this request. I am advised by
Wil Dibling that the request must be made in person before
Council at the January 2 meeting, and I am certainly willing
to do so. However, it will obviously help in our preparation
for that meeting to know whether we are going to have to
present our appeal at that time or if our request will be
granted to provide us with additional preparation time.

PETITION FOR APPEAL
This is a Petition for Appeal from a decision of the Architectural Review Board
under Section 36.1-642(d) of the Zoning Ordinance of the Code of the City of Roanoke
(1979), as amended.
1. Name of the Petitioner: Episcopal Diocese of Southwestern Virginia
(hereinafter "Petitioner").
2. Address: 1000 First Street, SW, Roanoke, Virginia 24009.
3. Overlay Zoning of the property which is the subject of this appeal is
H-1/C-2.
4. The headng before the Architectural Review Board was held October 12,
1995.
5. The Certificate of Appropriateness was requested from the Architectural
Review Board pursuant to the City of Roanoke Code Section 36.1-327. Petitioner
requested approval in concept of scale and massing of proposed addition to existing
structure located at 1000 First Street, SW, known as Evans House and
acknowledgement that the proposed addition would be of consistent architectural
appearance with the existing structure. The request also asked for permission to
demolish the structures located at 1010 and 1014 First Street, SW, adjoining the
existing structure in the event that Petitioner was unable to find a party that was willing
to remove the houses located on said two lots. Petitioner, as a part of the request,
volunteered to donate the structures on said lots and further volunteered the sum of
Thirty-six Thousand Dollars ($36,000.00) to be contributed toward costs of moving the
said structures, said removal to be accomplished prior to April 1, 1998.
8. Grounds for appeal: Petitioner feels that the ruling of the Architectural
Review Board in denying its request to demolish the structures represented an abuse
of discretion by said Board in that it ignored the economic realities associated with
moving and rehabilitating said structures. Petitioner also feels that this ruling is
inconsistent with previous rulings of the Board which have permitted demolition after
a reasonable period of time was afforded to locate interested parties, if any, who would
be willing to bear the removal and repair costs associated with the removal. Petitioner
also questions the historic significance of the property located at 1014 First Street, SW,
and would further note that the structure located at 1010 First Street, SVV, is not unique
as evidenced by the fact that there is an older structure of identical design located less
than a block away at 921 First Street, SW.
7. Petitioner will be represented by David C. Helscher of the law firm of Jolly,

WHEREFORE, your Petitioner requests that the action of the Architectural

Dear Mayor Bowers and Members of Council~
The matter of the Henry Street Revival Committee Report appears on the FebnJa~y
18, 1997 7:00 meeting by virtue of an earlier vote of Roanoke City Council. The City Clerk
was requested to place it back on the agenda at the end of ninety (90) days There has
been some community discussion on how to proceed; but, I do not believe that any of the
interested community groups have coalesced around a single idea. City staff indicates lo
me that Rebuilding Ihe Black Community (RBC), a relatively new organization representing
portions of the black community, is currently preparing a written survey to determine the
opinions of the black community regarding the future of Henry Street. It is staff's
understanding that it would be their intent to present the results of the survey at some
future date to City Council.
I suggest that Council may consider extending consideration of this matter at least
another ninety (90) days to allow interested parties to discuss and perhaps reach a
consensus on a best method to deal With the Henry Street Revival Committee report. This
would allow time for continuing dialog and eliminate a concern that a decision is imminent.
