Bowers, Mayor and Members of City Council Roanoke, Virginia Dear Mayor Bowers and Members of City Council: Subject: Briefing Stares Report - Inoperative Motor Vehicle Ordinance Please reserve space on your agenda for a briefing regarding the above subject. WRH:WFC:pr CC' Respectfully, obert Herbert City Manager City Attorney Director of Finance Director of Public Works ROANOKE CITY COUNCIL BRIF. FING JUNE 2, 1997 INOPERATIVE VEHICLE PROGRAM INTRODUCTION A. GOOD AFTERNOON. B. MR. MAYOR, MEMBERS OF CITY COUNCIL C. A LETTER MORE THAN 1 YEAR AGO, THE DEPARTMENT OF PLANNING AND COMMUNITY DEVELOPMENT IMPLEMENTED A NEW PROGRAM DESIGNED TO HELP RID THE CITY OF JUNK MOTOR VEHICLES STORED OR ABANDONED ON PRIVATE PROPERTY. D. AS I'M SURE COUNCIL MEMBERS ARE AWARE, JUNK CARS AND TRUCKS ARE A MAJOR SOURCE OF BLIGHT IN THE CITY'S NEIGHBORHOODS. E. ACCORDING TO SURVEYS CONDUCTED BY THE ROANOKE NEIGHBORHOOD PARTNERSHIP STAFF SEVERAL YEARS AGO, JUNK CARS WERE A MAJOR SOURCE OF COMPLAINTS FROM CITIZENS AND NEIGHBORHOOD GROUPS. F. PRIOR TO THE ADOPTION OF THE INOPERATIVE VEHICLE ORDINANCE LAST YEAR, THE CITY'S ENFORCEMENT STAFF WERE LUCKY IF THEY MANAGED TO ELIMINATE 25 VEHICLES A YEAR. THE OLD STATE MANDATED PROCESS WHICH REQUIRED STAFF TO TABLE VIOLATORS TO COURT FRUSTRATED BOTH CITIZENS AND NEIGHBORHOOD GROUPS. II* CURRENT SITUATION. A. I'M PLEASED TO BE ABLE TO REPORT TO CITY COUNCIL THAT SINCE THE NEW INOPERATIVE VEHICLE PROGRAM WENT INTO EFFECT 13 MONTHS AGO, ALMOST 1900 JUNK MOTOR VEHICLES HAVE BEEN ELIMINATED FROM THE CITY'S RESIDENTIAL AREAS. B. OF THE 1900 INOPERATIVE VEHICLES WHICH WERE CITED, ONLY 123 VEHICLES OR 8.0% OF THE TOTAL HAD TO BE TOWED BY THE PRIVATE TOWING COMPANY UNDER CONTRACT TO THE CITY. C. THIS EQUATES TO A 92% VOLUNTARY COMPLIANCE RATE WHICH IS EXTREMELY HIGH FOR THIS TYPE OF PROGRAM. D. FOR COUNCIL INFORMATION, ALMOST HALF (47%) OF THE VEHICLES CITED AND ELIMINATED WERE LOCATED IN THE Fo NORTHWEST SECTION OF THE CITY. THIS IS BECAUSE THIS IS THE AREA WHICH REPORTED THE LARGEST NUMBER OF COMPLAINTS. IT'S ALSO AN AREA WITH HIGH CONCENTRATIONS OF LOW INCOME INDIVIDUALS WHO CAN'T AFFORD TO REPAIR THEIR VEHICLES ONCE THEY BREAK DOWN. THE REMAINING VEHICLES CITED BY STAFF WERE SOME WHAT EQUALLY DISTRIBUTED BETWEEN THE OTHER 3 QUADRANTS OF THE CITY. III. RECENT AMENDMENTS A. SEVERAL AMENDMENTS TO THE ORDINANCE HAD TO BE MADE OVER THE COURSE OF THE YEAR IN ORDER TO ADDRESS SEVERAL ISSUES WHICH CAME UP. B. FOR EXAMPLE, UNDER THE TERMS OF THE ORIGINAL ORDINANCE, VEHICLE OWNERS CAN COME INTO COMPLIANCE BY SCREENING THEIR INOPERATIVE VEHICLES. C. IT WAS OUR HOPE THAT OWNERS WOULD USE APPROPRIATE LANDSCAPING OR FENCING TO SCREEN THEIR VEHICLES. UNFORTUNATELY, MANY OWNERS, STARTED USING TARPS AND OTHER COVERINGS TO SCREEN THEIR VEHICLES. AS INDICATED ON THE PHOTOS ON THE EASEL, TARPS ARE NOT EFFECTIVE IN SCREENING VEHICLES FOR A PROLONGED PERIOD. THEY GET TORN OR JUST KEEP GETTING BLOWN OFF. AS A RESULT OF THE GROWING NUMBER OF INDIVIDUALS WHO STARTED USING TARPS TO AVOID COMING INTO COMPLIANCE, COUNCIL AGREED TO AMEND THE ORDINANCE IN DECEMBER 1996 TO PROHIBIT THE USE OF TARPS OR COVERS AS A MEANS TO COMPLY WITH THE NEW ORDINANCE. ANOTHER IMPORTANT AMENDMENT TO THE ORDINANCE WHICH WAS APPROVED BY CITY COUNCIL EARLIER THIS YEAR INCREASED THE FINE THAT ENFORCEMENT STAFF COULD LEVY IF THE CITED VEHICLE WAS NOT REMOVED WITHIN THE REQUIRED TIME FROM THE PROPERTY. THIS AMENDMENT WAS IMPORTANT FOR DEALING WITH VEHICLES THAT WERE BEHIND FENCES AND OTHER BARRIERS THAT PREVENTED OUR TOW TRUCK FROM REMOVING THEM. (POINT TO CAR BEHIND FENCE) IV. CURRENT ISSUES AND PROBLEMS. A. CURRENTLY THE OFFICE RECEIVES APPROXIMATELY 30 CALLS A WEEK FROM CITIZENS REPORTING JUNK VEHICLES. B. THE DEPARTMENTS FULL TIME TEMPORARY INSPECTOR IS KEPT BUSY RESPONDING TO THESE CALLS AS WELL AS CITING OTHER VEHICLES WHICH HE FINDS IN THE FIELD ON HIS OWN. C. WE'RE LOOKING FORWARD TO THE LOAN OF A PART TIME SECRETARY FROM THE COMMONWEALTH ATTORNEY'S OFFICE. D. WITH ALL OF THE REQUIRED PROPERTY OWNER NOTICES AND LEGAL ADS THE PROGRAM REQUIRES A LOT OF CLERICAL SUPPORT. THE LOAN OF THE PART TIME SECRETARY FROM THE COMMONWEALTHS ATTORNEYS OFFICE WILL ENABLE OUR INSPECTOR TO SPEND MORE TIME IN THE FIELD CITING VEHICLES. STAFF IS ALSO CURRENTLY PREPARING AN AMENDMENT WHICH WOULD ALLOW TRAIl,ERS WHICH ARE BEING USED FOR STORAGE PURPOSES TO BE EXEMPT FROM THE ORDINANCE UNDER CERTAIN CONDITIONS. DOGS ARE ONE OF THE MAJOR OCCUPATIONAL HAZARDS OF OUR INOPERATIVE VEHICLE INSPECTORS (POINT TO PHOTO'S) IN CLOSING I'D LIKE TO THANK COUNCIL FOR THEIR SUPPORT OF THIS PROGRAM. I THINK ITS A GREAT EXAMPLE OF WHAT CAN BE ACCOMPLISHED WHEN CITY COUNCIL, THE CITY ADMINISTRATION AND THE NEIGHBORHOOD GROUPS WORK TOGETHER TO ADDRESS A PROBLEM. ATTEST: city Clerk. June 2, 1997 Honorable Mayor and Members of City Council Roanoke, Virginia Subject: Fund Appropriations- Personnel Lapse Report Dear Mayor Bowers and Members of City Council: I. BackRround on the subiect is as follows: Personnel lapse is generated due to employee turnover and vacancies in City departments. For the current Fiscal Year, salary savings of $815,000 are projected as a result of these vacancies. II. Current Situation is as follows: To provide timely information to City Council and increase administrative efficiency, the status of lapse was reported quarterly to City Council for the first 2 quarters as a Consent Agenda item. This report will provide a budget ordinance that encompasses all quarters, eliminates the budgeted lapse amount and adjusts affected departmental operating budgets. Total estimated personnel lapse .qenerated for Fiscal Year 1996-97 is $1,019,106. This funding is allocated as shown on Attachment "A" of this report. Personnel lapse generated exceeds the estimate of $815,000 by $204,106. This additional funding is recommended to be used for the following purposes: Workers Compensation WaRes and Medical Expenditures - $85,000 - Workers Compensation expenditures for FY 1996-97 are projected to be approximately $785,000, an increase of $85,000 over the budgeted amounts. A separate council report will transfer these funds to the proper departmental accounts. D-Day Memodal - $50,000 - During the FY 1996-97 budget study process, City Council made a commitment to provide funding of up to $250,000 over a five year period to The National D-Day Memodal Foundation. The first year's funding of $50,000 was included as part of this year's CMERP program. Funding identified in this report would provide the second installment to this commitment. III. IV. 3. Risk Management - $69,106 - The remaining lapse funds are required to supplement the Risk Management fund charges to General Fund departments. Issues in order of importance are as follows: A. Funding B. Timing Alternatives in order of feasibility are as follows: A. Authorize the transfer of personnel lapse funds from departmental accounts to personnel lapse account 001-002-9410-1090 as listed on Attachment '%" of this report. 1. Funding is available in the salary accounts due to turnover and vacancies in City departments. 2. Timing is important since funds need to be transferred prior to June 30, 1997. B. Do not authorize the transfer of personnel lapse funds from departmental accounts to personnel lapse account 001-002-9410-1090 as listed on Attachment "A" of this report. 1. Funding would remain in departmental budgets and salary lapse savings would not be transferred to salary lapse account 001-002-9410-1090. 2. Timing is not an issue. Recommendation: City Council concur in Alternative A and authorize the transfer of funding from departmental accounts to personnel lapse account 001-002-9410-1090 as listed on Attachment A. ATTEST: this City Clerk. June 2, 1997 #97-18 Honorable Mayor and Members of City Council Roanoke, Virginia Subject: Funding for Workers' Compensation Wage and Medical Accounts Dear Mayor Bowers and Members of Council: I. Backoround on the subject in chronological order is as follows: Workers' Compensation is defined as "exclusive remedy, under law, for all covered employees for compensating injuries and occupational diseases arising in the course of and within the scope of employment." B. The City_ is currently self-insured for Workers' Compensation liability. C. Funding has been budgeted for the current fiscal year to cover workers' compensation wage and medical payments. D. These h/Des of fringe benefits are budgeted as a lumo sum in the non-deDartmental category because annual charges for each department are difficult to accurately project. il. Current Situation is: A. Workers' comoensation expenditures for FY 1996-97 are projected to be approximately $785.000. an increase of $85,000 over FY 1995-96. This information is based on actual expenditures through April 30, 1997, and projected expenditures for May and June, 1997 (see Attachment A). 1. Workers' compensation expenditures for the Police and Fire Departments are greater for these two departments due to State law (Heart & Lung Bill) and are based on the presumption that heart, hypertension and lung disabilities affecting these public safety employees are job-related. Also, this bill now includes certain cancer for firefighters. 2. Workers' compensation claims are carried over from year to year. State law requires employers to pay workers' compensation wages for up to 500 weeks or until the employee either returns to work or is eligible for retirement. The City is liable for workers' compensation medical exoenses (which are the consequence of the original on-the-job injury) for the lifetime of the retired employee. Twenty-four (24) new claims (waQes and medical) have been submitted by Police Deoartment employees since July 1, 1996, totaling $34,767.11. Payments in the amount of $258,056.89 were made regarding claims carried over from previous fiscal years. Honorable Mayor and Members of City Council OFFICE OF MANAGEMENT & BUDGET Page 2 June 2,1997 Thirteen (13) new claims (waaes and medical) have been submitted by Fire Department emplovees since July 1,1996, totaling $25,648.37. Payments in the amount of $172,384.63 were made regarding claims carried over from previous fiscal years. B. Fundino to cover FY 1996-97 Workers' Compensation claims is available in the following accounts and needs to be allocated to departmental accounts from the non-departmental categories: Funding Sources: Account Number Amount Workers' Compensation - Wages Workers' Compensation - Medical Personnel Lapse 001-004-9110-1135 001-004-9110-1140 001-002-9410-1090 $350,000 350,000 85.000 Total Funding Sources $785,000 III. Issues In order of importance are: A. Mandated Program B. Funding Availability IV. Alternatives in order of feasibility are: A. CiN Council authorize the transfer of funding to cover current workers' compensation claims during the current fiscal year. 1. Program is mandated by State and Federal regulations for the City of Roanoke to provide workers' compensation benefits to its workers. 2. Funds are available in the General Fund to provide for this recommendation. B. City Council not authorize the transfer of fundin0 to cover workers' compensation claims during the current year. 1. Program is mandated by State and Federal regulations for the City of Roanoke to provide workers' compensation benefits to its workers. 2. NO. 33416-060297. A RESOLLrrION establishing the rate of reimbursement per mile to be paid to officers and employees of the City for use of privately owned personal motor vehicles on City business; and providing for an effective date. WHEREAS, City Council is required by §2-35, Code of the City of Roanoke (1979), as amended, to establish, from time to time, a rate of reimbursement per mile to be paid to officers and employees of the City for the use of privately owned personal motor vehicles on City business; THEREFORE, BE IT RESOLVED by the Council of the City of Roanoke as follows: 1. On or after July 1, 1997, the rate of reimbursement per mile to be paid to officers and employees of the City for the use of privataly owned personal motor vehicles on City business is hereby established at the rate of twenty-seven cents ($0.27) per mile for the first 15,000 miles of such travel in each fiscal year and thirteen ($0.13) per mile for each additional mile over 15,000 miles in such fiscal year. 2. This resolution shall be in full force and effect on and after July 1, 1997. ATTEST: City Clerk. June 2, 1997 #97-19 Honorable Mayor and Members of City Council Roanoke, Virginia Subject: Automobile Mileage Reimbursement Dear Mayor Bowers and Members of Council: I. Background on the subject In chronological order is as follows: Mileaae reimbursement at the rate of $.24 per mile for the first 15,000 miles and $. 11 per mile for all additional miles traveled has been made to City employees utilizing their personal automobiles in the performance of City business. This rate was established by City Council on May 22, 1989. Historically, the City has set its mileage reimbursement rate at the same level established by the Commonwealth of Virginia for its own employees. B. Mileage reimbursement rates paid bv the Commonwealth have been increased retroactive to March 24, 1997, as follows: 1. $.27 per mile for the first 15,000 miles. 2. $.13 per mile for all additional mileage over 15,000. II. Current Situation is: A. City Council needs to adopt a resolution authorizing the new reimbursement rates in order to permit the new rates to be paid. III. Issues in order of importance are: A. Eauitv of reimbursement. B. Legal - Comnliance with State Code C. Cost/Funding. IV. Alternatives in order of feasibility are: A. Establish increased mileaoe reimbursement rate at $.27 per mile for the first 15,000 miles, $.13 per mile for all additional miles effective July 1,1997, for all City employees authorized to receive mileage reimbursement for business use of their personal automobile. 1. EQuity of Reimbursement - This alternative would provide an equitable rate of reimbursement for business use of personal automobiles. The Internal Revenue Service allowable mileage cost is $.31 and the new State reimbursement rate has been set at $.27 per mile for the first 15,000 miles and $.13 per mile thereafter. Honorable Mayor and Members of City Council OFFICE OF MANAGEMENT & BUDGET Page 2 June 2, 1997 L, egal - Compliance with State Code - This alternative would comply with the Code of Virginia with respect to those employees to whom the State makes mileage reimbursement payments. This alternative will also permit the City to receive reimbursement from the State in those instances where the City makes the mileage reimbursement payment and that cost is shared by the State. 3. Cost/Funding - Increased cost will be funded within departmental Training and Development and Local Mileage budget accounts for FY 1997-98. B. Do not establish an increased mileage reimbursement rate at $.27 per mile for the first 15,000 miles, $.13 per mile for all additional miles effective July 1, 1997, for all City employees authorized to receive mileage reimbursement for business use of their personal automobile. 1. Eouitv of Reimbursement - Equity of reimbursement for business use of personal automobiles would not exist. The cost to the individual utilizing their personal automobile for business would be significantly higher than the amount being reimbursed by the City. 2. Legal - Compliance with State Code - The City would not be in compliance with the Code of Virginia with respect to mileage reimbursements required to be made to certain City employees (courts, election officers, probation officers, social service workers, etc.). 3. Cost/Funding - This would not be an issue. Recommendation: A. City Council concur with Alternative "A" and adopt the appropriate resolution which: 1. Establishes the increased mileage reimbursement rate of $.27 per mile for the first 15,000 miles and $.13 per mile for all additional miles. 2. Establishes an effective date of July 1, 1997. ATTEST: City Clerk. June 2, 1997 Report #97-23 The Honorable David A. Bowers, Mayor and Members of Roanoke City Council Roanoke, Virginia SUBJECT: Resolution to Endorse the Funding Distribution Methodology For Incentive Funds to be Distributed Among Participating Local Governments in the Fifth Planning District Regional Alliance I. Backaround Roanoke City Council endorsed the City of Roanoke's participation in the Fifth District Regional Alliance by Resolution 33251-020397 on February 3, 1997. The Fifth Plannino District Regional Alliance was formed under the Authority of the 1996 Regional Competitiveness Act. Sections 15.1-1127.1 through 15.1-1227.5, Code of Virginia (1050) as amended provides in part that incentive funds will be provided to jurisdictions within a qualifying region that agree to participate in the regional cooperation activities within their respective region. Citv Council endorsed the action of the Virginia General Assembly to provide incentive funding to regions that are formed under the guidelines of the Regional Competitiveness Program in its 1997 Legislative Program. Funding will be available to qualifying regions on July 1, 1997 from the Regional Competitiveness incentive fund which is valued at $6 million. Qualifying regions will receive their share of state incentive funding based upon the percentage of population within their region as compared to that of other qualifying regions within the state of Virginia. Within aualifvin~ re~ions, jurisdictions must agree on the funding distribution formula by which these incentive funds will be shared among the local governments participating in that region. I1. Current Situation A. The Regional Alliance's Board of Directors is composed of the chief elected The Honorable David A. Bowers, Mayor and Members of City Council June 2,1997 III, IV, official and the chief administrative official of each participating local government as well as leaders from the business, civic, higher education and secondary educational communities within the region. The Reoional Competitiveness Act Program provides that each participating local government within the region must approve by resolution a methodology for the distribution of incentive funds to participating governments within their region. The Regional Alliance's Board of Directors met on April 24, 1997 and approved a specific funding distribution methodology recommendation to each participating local government which is participating in the Regional Alliance. The Fundino Distribution recommendation is as follows: · Ninety percent (90%) of the total funds to be distributed on a per capita basis · Eight percent (8%) of the total funds to be distributed based on the level of fiscal stress of each local government as calculated by the Virginia Commission on Local Government · Two percent (2%) of the total funds to be allocated to the Regional Alliance for administrative and research support. Issues A. Timing B. Incentive Funds C. Leoal Alternatives City Council endorse by resolution the funding distribution methodology as recommended by the Board of Directors of the Fifth Planning District Regional Alliance. Timing is critical. In order for the Regional Alliance to be eligible for funding on or after July 1, 1997, all localities within the region must adopt the funding method by June 21, 1997. The Honorable David A. Bowers, Mayor - 3 - June 2, 1997 and Members of City Council Incentive funds will be available to qualifying regions on or after July 1, 1997. Legal requirements of the Regional Competitiveness Act will be satisfied. City Council not endorse by resolution the funding distribution methodology as recommended by the Board of Directors of the Fifth Planning District Regional Alliance. Timing would make the Alliance unable to meet the application deadline for qualifying regions. 2. Incentive funds would not be available on or after July 1, 1997 Legal requirements of the Regional Competitiveness Act will not be satisfied. V. ATTEST: City Clerk. Roanoke, Virginia June 2, 1997 Report No. 97-341 Honorable Mayor and City Council Roanoke, Virginia Dear Members of Council: Subject: Civic Center Request for Appropriation I. Back~round ae The original FY '97 Civic Center budget appropriation was $2.626,471 including operations, promotions, depreciation and capital outlay. Budget adjustments through April, 1997 total $88.404. The current Civic Center operating budget as of April 1997 totals $2,714,875 and multi-year projects budgeted in the amount of $215.671. Total expenses for FY '97 are now estimated to be $3.177.446, an increase of $246,900 over the current budget. De The primary reasons for over budqet expenditures are the increase in number of events as well as a direct increase in expenses attributed to those events. E. Current oDeratinq budqet synopsis is as follows: Current Civic Center Expense Budget Estimated Expenditures for FY '97 Additional Funding Required $2,714,875 2.961.775 $ 246.900 Estimated Collections for FY '97 Current Revenue Estimate Revenue in Excess of Estimation Less: Additional Funding Required Remaining Unappropriated Contingencies for FY '97 $2,755,898 2.351.498 $ 404,400 246,900 $ 157.500 Fe Remaininq unappropriated contingencies for FY '97 will revert to Retained Earnings at the end of the fiscal year. Page 2 II. Current Situation Appropriation of funds from revenues is requested to cover the cost of additional operational expenses as detailed in I. E. Funding source is available from civic Center revenues due to an increase in the total number of events. There were substantial increases in Coliseum rental, parking, admission taxes, concessions and novelty fees. III. Issues A. Justification of Need B. Fundinq Source IV. Alternatives ADDrove the appropriation of $246,900 to cover cost of certain operating expenses and adjust the revenue estimates by $404,000. Justification of need has been verified through analysis of the Civic Center operating budget. Funding source for operational expenses is available from revenues realized in excess of estimate. Do not approve the appropriation of $246.900 to cover cost of certain operating expenses. Justification of need has been verified. This alternative will not provide for over expenditure of certain operating expenses. Fundinq source would not be an issue for consideration. Recommendation is that City Council approve Alternative A, as listed below: A. Increase revenue estimates by S404.400 as follows: Increase Coliseum Rental by S63.600. ATTEST: City Clerk. June 2, 1997 Report 97-593 Honorable Mayor David Bowers and Members of City Council Roanoke, Virginia Members of Council: SUBJECT: GAINSBORO BRANCH LIBRARY I. BACKGROUND The Gainsboro Branch Library was recently designated as a Virginia Historic Landmark and is also listed on the National Register of Historic Places. Library service began in the Gainsboro community in 1921 in a former YMCA building. The current facility was opened in 1941-42. In 1994-95, the library's front concrete steps and entry walk was modified and door openers installed to provide wheelchair accessibility into the building. A library facility's master plan completed in the fall of 1996 identified several items that need to be done to bring the Gainsboro Branch into compliance with current building codes and the Americans with Disabilities Act (ADA) including new toilets, plumbing renovations and emergency lighting. An additional 500 sq. ft. is needed to provide space for two new wheelchair-accessible restrooms, expansion of the Virginia Y. Lee African-American collection, and relocation of current periodical back files from the meeting reom to an expanded staff work area. An on-site parking lot for approximately 10 spaces has been designed as there is no off-street designated parking for the library. G. Total estimated cost of these improvements is $145,770. II. CURRENT SITUATION City Manager has applied to the Library of Virginia for Library Services and Construction Act, Title II funds ($72,885) for expansion and remodeling of the Gainsboro Branch Library. Honorable Mayorand Membem of City Council Page 2 June 2,1997 III. IV. Should the city's application for said funds be approved, the City Manager will recommend to Roanoke City Council that they accept the grant award, thereby creating a contract between the city of Roanoke and the Library of Virginia. Assurance must be given that local matching funds, equal to a least 50% of the cost of the project, are available for expenditure. These must be public funds available to a library building account. ISSUES A. Compliance with regulations. B. Compliance with grant requirements. C. Budget. ALTERNATIVES Provide funding for the city's local cost of the Gainsboro Library Branch improvements and transfer $75,000 from the jail (Sheriff's) recovered cost account 001-024-3310-8005 to an account in the Capital Projects Fund to be established by the Director of Finance. 1. Compliance with regulations. Needed improvements will be made to bdng the Gainsboro Branch Library into compliance with current building codes and the ADA. 2. Compliance with grant requirements. Local funds will be available to match federal funds requested from the Library of Virginia should they be awarded. Honorable Mayor and Members of Council Page 3 June 2, 1997 3. Budget. Funds are available in the jail (Sheriffs) recovered cost account. Do not provide funding and do not transfer $75,000 from the jail (Sheriffs') recovered cost account. 1. Compliance with regulations. Needed improvements to the Gainsboro Branch Library could be delayed. 2. Compliance with grant requirements. Local matching funds would have to be identified from another source if grant funds are awarded and the city wishes to accept them. 3. Budget. Funds in the jail (Sheriff's) recovered cost account could be spent for another purpose. V. RECOMMENDATION City Council concur with Alternative A and transfer $75,000 from the jail (Sheriff's) recovered cost account 001-024-3310-8005 to an account in the Capital Projects Fund to be established by the Director of Finance. Alvin Hudson, Sheriff Departm~t of Fimmc~ City of Roanoke, Virginia June 2, 1997 TO: FROM: SUBJECT: Honorable Mayor and Members of City Council James D. Cnisso, Director of Finance April Financial Report This financial report covers the first ten months of the 1996-97 fiscal year. The following narrative discusses revenue and expenditure trends to date. REVENUE Total General Fund revenues reflect an increase of 6.53% or $8,081,000, on a year-to-date basis, compared to FY96. Variances in specific categories of revenue are as follows: General Proper~y Taxes have increased 5.53%, or $3,192,000. Real estate taxes have increased by more than $2.0 million, or 5.6%, due to a combination of increased assessments and increased delinquent tax collections. Personal property taxes, which are recorded on an accrual basis bom assessments issued during the year, have grown by approximately $1.2 million, or 6.7%, through April 30. The due date for personal prope~j taxes is June 2. By June 30, real estate taxes are projected to meet the budget estimate, while personal property taxes are expected to exceed it. Other Local Taxes have increased $1,042,000 or 2.81%. Leading this growth are increased sales taxes, up $529,000 or 4.70%. Business, professional and occupational license (BPOL) taxes have increased $348,000, or 3.90%, as a result of increases in the gross receipts of businesses subject to the tax. E911 telephone surcharge taxes and prepared food and beverage taxes have also increased, while electric service utility tax and franchise taxes have declined. Fines and Forfeitures increased $120,000 or 15.61% due to growth in all categories of court fines and collection fees. This has resulted from increases in several traffic fines and a more aggressive collection approach. Revenue from the Use of Money and Property decreased $125,000, or 14.73%, due to a decline in interest earnings offset by increased property rental. The decreased interest income has resulted from a reduction in the General Fund's cash balances which occurred when the new Risk Management Internal Service Fund was established July 1. The Risk Management function was previously part of the General Fund. Revenue from property rental has increased due to higher rental income from the Commonwealth Building and other buildings. Honorable Mayor and Members Roanoke City Council June 2, 1997 Page 2 Grants-in-Aid Commonwealth have increased $3,308,000 or 14.43%. Revenue from shared expenses has grown by $645,000 due to increased revenue for the Sheriff's department which has more employees in FY97 as a result of the City Jail expansion. Revenue from the Jail Block grant has likewise increased, providing $335,000 in additional revenue. Welfare related revenues from the Commonwealth have increased across-the-board, with Comprehensive Services Act increases of nearly $1.4 million leading this trend. Welfare revenues for foster care, daycare and general administration of the program have also increased. Revenues from the Virginia Juvenile Community Crime Control Act have also risen in FY97. Grants-in-Aid-Federal Government are up $13,000 or 44.23%. There have been higher FEMA payments this year, but a $14,000 flood damage reimbursement was received last year. Miscellaneous Revenue has increased $243,000 due to the receipt of nearly $193,000 in connection with Trigon's settlement regarding discounts not properly deducted from claims costs of its subscribers. There have also been increases in other miscellaneous revenues. Internal Services revenues have increased 12.91% or $152,000. Airport fire safety billings have increased on a year-to-date basis, due to earlier billings during the current year for these services. Building Maintenance charges to the Transportation and Nursing Home Funds have risen, and Engineering billings are up as well. Cross connection inspections are a new source ofinteffund revenues in FY97, and they have generated $50,000, as budgeted. EXPENDITURES AND ENCUMBRANCES Expenditures and encumbrances in the General Fund have increased 8.91% or $11.0 million since FY96. There were three payrolls during April 1997, while a third payroll occurred during May last year. This timing difference contributes greatly to the overall variance in expenditures through April. Variances in individual expenditure categories, beyond those attributed to the additional payroll, are discussed as follows: Health and Welfare expenditures have increased $2,931,000 or 20.47%. The Health Department subsidy of approximately $700,000 was made in April of the current year but in May of 1996, causing a timing difference on a year-to-date basis. Cultural and Human Services contributions have increased by $449,000, mostly beca-~ some contributions previously included in the Parks, Recreation and Cultural category are now in Health and Welfare. As such, the contributions to the Center in the Square, the Virginia Museum of Transportation, Harrison Cultural Center, and Virginia Amateur Sports, Inc. are now in this category. Social Services costs have risen due to increased personnel costs, higher purchased services and CIS charges, and increased daycare and foster care expenditures. CSA expenditures have risen by approximately 20%, adding $917,000 in expenditures, due to increased children in the program and more at very expensive facilities due to the high level of supervised care they require. Community Development expenditures have increased 12.48% or $117,000. The Department of Planning and Community Development has incurred higher personnel, administrative and training costs, and Economic Development has incurred higher costs for personal services and diversified housing. Honorable Mayor and Members Roanoke City Council June 2, 1997 Page 3 The Transfer to Debt Service Fund has increased $1,345,000 or 16.88%. The transfer has increased in FY97 for to fund payments of principal and interest associated with the 1996 public improvement bond issue. These bonds were issued in February 1996, and payments began in FY97. Nondepartmental expenditures rose $1,841,000, or 35.57%, due to increased transfers to other funds. The transfers to the Fleet Management and Capital Projects Funds increased by $1,265,000 and $612,000, respectively, due in part to appropriations of the Capital Maintenance and Equipment Replacement Program (CMERP). The transfer to the City Information Systems Fund decreased $659,000 from FY96. Transfers to the Civic Center, Transportation and Grant Funds have also risen. I would be pleased to answer any questions which City Council may have regarding the monthly financial statements. Grisso, Director of Finance Appropriations Transfer of Internal Service Funds Charges The City of Roanoke's Internal Service Funds account for certain services provided to departments of the General Fund. The Internal Service Funds recover their costs by charging the receiving departments for services provided. Budgeted funds for internal services are allocated in each fiscal year's budget throughout various departments based on estimated usage. Usage usually varies from the original estimates. Each fiscal year, at this time, it is necessary to make appropriations transfers between departments to provide s~fficient funds for internal services for the fiscal year. This ordinance makes such transfers, and it adjusts the salary lapse by $57,937 to provide additional funds for risk management claims, as the amount originally budgeted will not cover anticipated costs. The transfers do not increase the overall General Fund budget, but only reallocate amounts between departments. The attached budget ordinance will accomplish the required transfers. I recommend it for your approval. Direct6r 6f Finance JDG/AHA/bls Attachment F. Pa~ker, CMC/AAE city Ck.k CITY OF ROANOKE Office of the City Clerk Sandra H. ATTEST: this City Clerk. DEPARTMENT OF FINANCE CI~ OF ROANOKE, VA. June 2, 1997 FROM: SIJBJEC~. Honorable Mayor and Members of City Council James D. Grlsso, Director of Finance Transfer of Appropriations for Employee Fringe Benefits The fiscal year 1996-97 General Fund budget included funds in the nondepartmental category for texudnation (vacation) leave and unemployment wages. These fringe benefits are budgeted at estimated amounts in the nondepartmental category because annual charges for each department are difficult to project. Actual costs are charged to departments in anticipation of budget transfers to cover the costs. The attached budget ordinance transfers funds from the nondepartmental category to the applicable departmental budgets. Additionally, the ordinance transfers funds remaining in two departments for life insurance. These amounts are not needed for life insurance, and they are available to cover other fringes. The ordinance also adjusts the Payroll Accrual to provide an additional $20,492 in termination leave wages, as the amount originally budgeted will not cover anticipated costs. The transfers do not increase the General Fund budget in total, but only reallocate amounts between departments. A summary of the total transfers in the attached budget ordinance is as follows: Budget Amount Transfers Revised Budget Before Transfers In/lOut) Amount Termination (Vacation) Leave W~ges $ 91,275 $ 28,039 $119,314 Unemployment Wages 35,000 ( 5,558) 29,442 Life Insurance 1,989 ( 1,989} 0 Payroll Accrual 150,000 (20,492) 129,508 The attached budget ordinance will accomplish the required transfers. Ms. Mary Dillon, 1922 Maiden Lane, S.W., expressed concern with potential commercial uses such as a medical office or beauty shop which has a lot of traffic and may need substantial parking. She advised that street parking is already a problem. Planning staffadvised that prior to any use of the building for a commercial purpose, city standards for off street parking for that use would have to be met on the property. Staffalso advised that beauty shops were permitted only by special exception and a public hearing must be held and adjacent property owners notified. The Plannine Commission recommended approval of the rezonine request by a vote of 3-1 (Mr. Chrisman, Mr. Butler, and Mrs. Coles voting in favor of the request and Mrs. Duerk voting in opposition to the request). II. Current Situation: A. Petition to rezone nroperty from RM-2 t0 C-1 was filed on 2/5/97. B. Purpose of the petition is to permit the existin~ residence to be used for an office Room 162 Municipal Building 215 Church Avenue, S.W. Roanoke, Virginia 24011 (540) 853-2344 Members of Council Page 2 commercial use because of various environmental and business conditions affecting the property. Property is located between a public alley and a private alley that serves commemial development fronting on Grandin Road. Petitioner desires to sell the renovated buildimt for office or a combination home/office use. The property has been on the market for some time for residential purposes and has not sold because of the private alley access and its relation to adjacent businesses. IH. Issues: Zonin~ of the subject property is RM-2, Residential Multi-family District. Adjacent zoning is CN, Neighborhood Commercial District. C-l, Office District zoning is located across Grandin Road. Land use of the nroperty is currently a vacant residential building The property is in close proximity to other commercial businesses and is located between a public alley and a private alley that services adjacent commercial businesses on Grandin Road. Also, a commercial building is located across Maiden Lane. Parkin~ and access to the property is available from both the public and the private alley. Additional parking can be accommodated in the rear of the property. On street parking is limited. D. Utilities are available. Neighborhood or~,anization is the Ralei~,h Court Civic League They have been notified of the rezoning request and have been in communication with the petitioner regarding this request. F. Comprehensive Plan recommends: 1. Neighborhood character and environmental quality be protected. Commercial development is carefully evaluated to ensure minimal conflict with residential areas to promote good land use. IV. Alternatives: A. City Council approve the rezoning request. Members of Council Page 3 Zoning is changed to C-1 which allows property to be used for either residential or office district uses. Zoning is consistent with other business uses in the area and would be less intensive than extending the adjacent CN, Neighborhood Commercial District. Land use options are expanded to those permitted in the C-l, Office District. Parking and access can be accommodated on the property_. Commercial use of the building will be more consistent with adjacent business use of the private alley. 4. Utilities are available. Neighborhood orr, anization has not officially comment~,0 on the proposed rezoning request. However, the petitioner advised at the Planning Commission meeting that the Civic League had endorsed the request at their last meeting. 6. Comnrehensive Plan is followed. B. City Council deny the rezoning request. 1. Z nin r rain RM-2. Land use is limited to those permitted within the RM-2, Residential Multi- family District. Adjacent commercial land uses still are an issue. Parking and access is still a concern for residential users of the property given the shared commercial access. 4. Utilities are not an issue. Neighborhood issues relating to adjacent commercial and residential uses are unresolved. 6. Comprehensive Plan could be followed. V. Recommendation: Planning Commission recommended that Citv Council approve the rezoning request by a vote of 4-1 (Messrs. Chrisman, Butler, and Manetta and Mrs. Coles voting in favor of the request, and Mrs. Duerk voting in opposition to the request). The subject property is Members of Council Page 4 directly adjacent to and affected by businesses on Grandin Road. The proposed rezoning to C-l, Office District, will enable the property to be used for residential, as well as low intensity commercial uses, that can be complimentmy to the business district and the neighborhood. Parking requirements for a commercial user would have to be met on the property. Respectfully submitted, Gilbert E.
