FROM THE ROANOKE VALLEY COMMUNITY IN A SIX WEEK PERIOD FOR ITS
TRANSITIONAL LIVING CENTER.
AS A RESULT OF REVEREND TURNER'S CONTINUED CONCERN AND ADVOCACY
FOR THE HOMELESS, THE CITY AGAIN CALLED UPON HIM TO SERVE AS CHAIR~,~N
OF THE FOLLOW-UP TASK FORCE ON HOMELESSNESS TO ENSURE THAT THE

Information Report - Completion of Utility Invoices Audit
Contract with Tri-Stem, Inc. - Ordinance No. 28777
Dear Members of City Council:
I. Background:
A. Objectives in obtaining professional utility invoices auditing ser-
vices were as follows:
To provide assurance that the City has been billed correctly in
the past for utility use, and if not, to provide proper refund(s)
or credit(s) to the City as appropriate.
To provide recommendations on internal control which the City can
use to strengthen its invoice payment process.
To provide recommendations on how the City can realize savings on
utility bills in the future.
B. Utility invoices audited were:
1. Electric invoices - 10/12/84 - 06/30/87
2. Telephone invoices - 01/11/88 - 02/10/88
3. Natural gas invoices - 07/17/84 - 06/30/87
Funding for the professional services was not required. If the
results of the audit were such that a refund (or credit against future
utility invoices) is due to the City, the selected vendor would be
responsible for securing the refund or credit, and the City would pay
the selected vendor fifty percent (50%) of the refund or credit, but
only after the City has the refund "in hand" or has realized the cre-
dit. The City would not be liable for payment to the selected vendor
if no refund(s) or credit(s) is found to be due to the City as a
result of the audit.

II. Current Situation:
A. Tri-Stem, Inc.~ has completed the utility invoices audit for the City.
No billing errors were detected in the Roanoke Gas, Appalachian Power
and Chesapeake & Potomac bills provided.
Only one item was overbilled within the American Telephone & Telegraph
billing audit. This has been corrected. Tri-Stem, Inc., will not ask
for a fee on this review as the potential refund was not significant.
B. There is sufficient internal control in the City's invoice paJa~ent
process to detect billing errors.
C. The utilitS invoices audit was provided at no cost to the City due to
the lack of errors detected in the billing.
D. This report is provided for sour information.

Last week I was able to complete our audit of utility bill-
ing for the City. You may recall that there were two facilities
that required an on-site investigation.
Mr. Nelson Jackson was most helpful to me. We looked at the
blueprints, metering, and facilities at the Court's Building and
Melrose Library. In doing so, we were able to determine that
metering and billing to these facilities though high, has been
accurate. ,

AN ORDINANCE amending the Code of the City of Roanoke (1979),
as amended, by enacting new $30-4.1, Sidewalk sales, providing for
conduct of sidewalk sales by merchants in the Downtown Service Dis-
trict; establishing ruies and regulations for the conduct of such
sales; and providing for an emergency.
BE IT ORDAINED by the Council of the City of Roanoke as follows:
1. The Code of the City of Roanoke (1979), as amended, is
amended and reordained by the addition of the following new section:
S30-4.1. Sidewalk sales.
(a) Upon application of merchants in the
Downtowu Service District as defined by S32-102.2
of this Code, the City Manager shall be authorized
to issue permits for the display of goods and mer-
chandise and The conduct of sales on public sidewalks
in the Downtown Service District during one (1) calen-
dar week only in each calendar year. A single appli-
cation may be submitted on behalf of more than one
merchant provided such application shall be properly
executed by an authorized representative of each
merchant seeking to become a permittee. No such
permit shall authorize the exhibition of goods or
wares on any sidewalk in excess of three (3) feet
in front of the building line of the building
occupied by the permittee, and in no case shall
available sidewalk width be less than three (3)
feet between exhibited goods and merchandise and
any other permanent sidewalk amenity, such as
street trees, trash receptacles, utility poles or
sign posts.
(b) Each permit Shall require that the permit-
tee conducting a sidewalk sale shall indemnify and
hold harmless the City, its officers, agents and
employees, from any and all claims, injuries or
damages to persons or property that may arise by
reason of the grant of such permit or activities
conducted pursuant to such permit. The City
Manager may issue one permit designating all par-
ticipating merchants as permittees. Each permittee
shall obtain standard form public liability insurance,
issued by some company licensed to transact business
in this State, insuring such permittee against
liability for personal injury or death for not less
than $100,000.00 for any one person and not less than
$300,000.00 for any one accident or occurrence and
for not less than $50,000.00 for property damage
occurring as a result of such permit or activities
conducted pursuant to such permit; the amounts of
such insurance may be evidenced by a policy combining
bodily injury and property damage liability in an
aggregate amount of at least $500,000.00. The City,
its officers, agents and employees, shall be named
as additional insureds in every such policy of
insurance, and a certificate of such insurance shall
be filed with the City Manager or his designee not
less than seven (7) days prior to the commencement of
any sidewalk sale. A single policy of insurance
meeting the requirements of this subsection and
naming each permittee and the City and its officers,
agents and employees as insureds or additional insureds
may be accepted.
(c) Each permittee shall a~ the close of each
business day remove from that portion of the sidewalk
occupied by him all garbage, trash, refuse and other
material.
(d) The City Manager shall be authorized to
issue rules and regulations, not inconsistent with
this section, governing the use of public sidewalks
in the Downtown Service District for sales. Any such
permit may be revoked by the City Manager for failure
to comply with such rules and regulations.
2. In order to provide for the usual daily operation of the
municipal government, an emergency is deemed to exist, and this ordi-
nance shall be in full force and effect upon its passage.

I. Background:
Display and sales of merchandise on public sidewalks, except
in the Market area, is currently prohibited by Section 30-4 of
the Code of the City of Roanoke.
Downtown Service District was established by Ordinance No.
28453, adopted by Roanoke City Council on December 6, 1986,
effective July 1, 1987.
II. Current Situation:
Downtown Roanoke, Inc. has requested that the City Code be
amended to authorize the City Manager to issue permits for the
display of goods and merchandise and the conduct of sales on
public sidewalks in the Downtown Service District during one
calendar week each year.
An Ordinance providing for the display and sales of
merchandise on public sidewalks is attached to this report.

for the First Sidewalk Sale in Downtown Roanoke which has
been tentatively scheduled for June 30 and July 1.
Economic Development activity will be enhanced in
Downtown.

Legal - Sidewalk sales will expose the City to additional
liability. To address the additional risk, the City
Attorney has included the following mechanisms:
Each permittee will be required to indemnify and
hold the City harmless.
Public liability insurance naming the City as an
additional insured will be required of each
permittee and will be monitored by the City's Risk
Management Officer.
Public convenience will not be affected due to the space
requirements for sidewalk passage defined in the Code
amendment.
Do not approve Downtown Roanoke, Inc.'s request to amend
Section 30-4 of the City Code.
1. Timing of Downtown Roanoke, Inc. will not be met.
Economic Development opportunity in Downtown would be
missed.
3. Legal - City is exposed to no additional liability.
4. Public convenience will not be affected.
V. Recommendations:
Adopt the attached ordinance approving Downtown Roanoke, Inc.'s
request to amend Section 30-4 of the City Code, and authorize the
City Manager to issue permits for the display of goods and
merchandise and the conduct of sales on public sidewalks in the

A RESOLUTION extending the pay benefits provided for by Resolution
No. 4748 for a certain emerEency service employee.
WHEREAS, Resolution No. 4748, adopted February 28, 1936, provides
that police officers and firefighters absent from duty because of
disabling injuries incurred in the line of duty shall suffer no loss
in compensation for sixty days;
WHEREAS, by Resolution No. 4748, Council has voluntarily estab-
lished a local benefit for the City's police officers and firefiEht-
ers, and eligibility for such benefit is determined solely by the
terms of Resolution No. 4748, not by the Workers' Compensation Act or
related law;
WHEREAS, Resolution No. 4748 requires that extension of benefits
provided for by such resolutlon beyond sixty days shall be only upon
authority of Council;
WHEREAS, John C. Arrington of the Fire Department has previously
been determined eligible for such benefits, and by report of June 26,
1989, the City Manager has recommended that benefits available to such
employee be extended beyond sixty days by authority of Council.
THEREFORE, BE IT RESOLVED by the Council as follows:
1. John C. Arrington of the Fire Department shall be paid the
difference between his base pay and any sums received pursuant to the
Workers' Compensation Compensation Act for a period of sixty days from
May 24, 1989, or until such officer is able to return to duty,
whichever occurs first.
2. Such employee shall under no circumstances receive payments
from the City, including Workers' Compensation benefits, in excess of
his regular base pay.
3. The City Manager shall be authorized to terminate the benefits
provided for by this resolution should it be established by report of
a licensed physician that said employee is able to return to duty.

Subject: Extension of Pay Benefits
I. Back~round:
Council Resolution No. 4748 of February 28,
1936, established policy for payment of
regular salaries in lieu of other compensa-
tion paid by the City, to employees of the
Police and Fire Departments absent from duty
due to line-of-duty injuries, not to exceed
60 days without approval of City Council.
City Council may consider paying the employee
injured in the line of duty for additional
time absent from his regular duty; in excess
of 60 days, but in no event will payment in
excess of 60 days be made until authorized by
Council.
November 11, 1988, John C. Arrin~ton, a Fire-
fighter, was injured during physical train-
ing while on duty at Number 9 Fire Station.
II. Current Situation:
Firefi~hter Arrin~ton suffered a knee injury
and was treated conservatively with physical
therapy in an attempt to avoid surgery and
released for duty on January 12, 1989. Fire-
fighter Arrington continued to work until
March 24, 1989 when he re-injured his right
knee while on duty which required reconstruc-
tive surgery on May 15, 1989 at the Roanoke
Orthopedic Clinic. Firefighter Arrington
received full pay on March 24, 1989 and con-
tinued to receive full payment pursuant to
Council Resolution No. 4748 for 60 days
(until May 23, 1989).

Firefi~hter Arrin~ton has not returned to
duty and his doctor advises that complete
recovery may take as long as one (1) year and
that he can anticipate Firefighter Arrington
being allowed to be put on light duty status
in several months.

tive "A" and authorize continued regular salary
payment to Firefighter Arrington retroactive to

1989, or until such employee is able to return to
duty, which ever occurs first.

for the usual daily operation of the Municipal
Government of the City of Roanoke, an emergency is declared to
exist.

Subject: Sharing Federally Forfeited Property
I. Background:
Congress amended 21 USC. Sec. 881 el-4, October,
1986, which authorized the transfer of certain
federally forfeited property to state and local law
enforcement agencies that participated in the
investigation and seizure of the property.
ADDlication for an equitable share of property
seized by local law enforcement must be made to the
U. S. Department of Justice and certified by the
City Attorney as to the appropriate agency and
representative to receive the property and that the
transfer is not prohibited by state or local law.
Property (including funds shared with state and
local agencies) may be used only for the purpose
stated in the application, i.e., narcotics investi-
gations related to law enforcement.
The agency requesting the transfer of property
agrees to pay fees and expenses necessary to effect
the transfer.

January 4, 1988, Council, at its regular meeting,
authorized the Director of Finance to establish
grant fund accounts from which funds may be dis-
persed in accordance with provisions of this
program.
II. Current Situation:
Police Department receives additional funds
periodically from the federal government's asset
sharing program.
City Council action is needed to accept additional
funds to be dispersed in accordance with provisions
of the program.
Revenues collected to date for these grant funds are
$78,688.00 and deposited in Grant Account Number
035-050-1234-7060. Current account estimate is
$54,300.00. Funding received in excess of the
estimated revenue which totals $24,388 needs to be
appropriated at this time.

equipment to enhance undercover narcotics control
investigations.

ness of investigations through assets seized and
forfeited in Joint investigations with federal
agencies.

City Council reject assets from Federal Forfeiture
Sharing Program and not authorize Director of Finance to
establish appropriate accounts for such assets.
Need for supplemental funds enabling increased
effectiveness of undercover drug enforcement will
not be met.
2. Funds will not be applied for or received from the
Federal Forfeiture Sharing Program.
Recommendation is that Council approve Alternative "A" to
accept assets from the Federal Forfeited Property Sharing
Program and:
A. Appropriate $24f388 to the following grant fund account:

Increase the revenue estimate for this grant by $24,388.

BE IT RESOLVED by the Council of the City of Roanoke that:
1. The City of Roanoke hereby accepts the offer of the United
States Department of Housing and Urban Development, under date of June
9, 1989, of a grant of Community Development Block Grant funds for
Program Year 1989-1990 amounting to $1,547,000, to fund certain com-
munity development activities and projects set out and described in the
City's application for said funding, upon all of the terms, provisions
and conditions therein set out.

Acceptance of 1989-90 Community Development Block
Grant (CDBG) Entitlement and Appropriation of Funds
for CDBG Activities
Back~round:
City Council authorized filin~ a CDBG application to the
Department of Housing and Urban Development (HUD) for FY
1989-90 on April 10, 1989 by Resolution No. 29512.
HUD approval of the City's FY 1989-90 CDBG application
was received in a letter dated June 9, 1989 (see
Attachment A).
Grant approval i__s for the amount requested by the City,
or $1,547,000.
This report includes $714,443 in expected CDBG program
income from parking receipts, Housing Authority
rehabilitation loan repayments, Cooper Industries land
lease, Coca-Cola UDAG loan repayment and interest
payment from Downtown Associates for a short-term loan.

Recommendation:
Recommendation is that City Council:
A. Adopt a resolution accepting the FY 1989-90 CDBG funds
approved by HUD and authorizing the City Manager to
execute the requisite Grant Agreement, Funding Approval,

and any other forms required by HUD on behalf of the
City in order to accept such funds; and
ADproDriate $2,261,443 to revenue and expenditure
accounts in the Grant Fund to be established by the
Director of Finance ($1,547,000 CDBG entitlement and
$714,443 projected program income) as detailed in
Attachment B; and
Transfer $219,446 from older accounts and appropriate
FY 1989 program income of $39,902 to Grant Fund accounts
as detailed in Attachment C.

I am pleased to transmit to you the Fiscal Year 1989 Community Development
Block Grant (CDBG) for Roanoke in the amount of $1,547,000.00. The program year for
Roanoke begins on June 1, 1989.
Enclosed is the Grant Agreement and Funding Approval (three copies of HUD-
7082), which constitutes the contract between the Department of Housing and Urban
Development and Roanoke. You should note particularly any special conditions included
in Item 13 of the Funding Approval
The special condition in your Grant Agreement and Funding Approval concerning
the review procedures under Executive Order (E.O.) 12372, Intergovernmental Review of
Federal Programs and HUD's implementing regulations at 24 CFR Part 52 (see June 24,
1983 Federal Register, pages 29206-29221), restricts the obligation or expenditure of
funds for the planning or construction of water or sewer facilities until the completion of
the review process and receipt of written notification of release of funds from HUD.
Since you have not submitted your final statement for review under E.O. 12372, we
assume you do not propose to use funds for activities subject for review. However, the
condition requires that in the event you amend or otherwise revise your final statement
to use funds for the planning or construction of water or sewer facilities, you must
receive written release of funds from HUD before obligating or expending funds for such
activities.
In order to amend your Letter of Credit to reflect the Fiscal Year 1989 grant, it
will be necessary for you to execute and return two copies of the Grant Agreement. In
addition, if there is a need to delete or add signatures of individuals authorized to draw
on the amended Letter of Credit, or if there is a change in the depository, the following
document(s) must be completed and returned with the executed Grant Agreement:
1. Standard Form 1194, Authorized Signature Card for Payment of Vouchers on
Letter of Credit (the SF-1194 must not have corrections of any kind);
2. Form HUD-274 (Designation of Depository for Direct Deposit of Loan and/or
Grant Funds).
Attachment A
Upon receipt of the executed Grant Agreement (two copies) and other forms
required to establish/amend your Letter of Credit, HUD will transmit to you a copy of
the Letter of Credit, which will reflect your FY 1989 grant amount and indicate when
drawdowns may commence.
You are reminded that certain activities are subject to the provisions of 24 CFR
Part 58 (Environmental Review Procedures for the Community Development Block Grant
Program). Funds for such activities may not be obligated or expended unless the release
of funds has been approved in writing by HUD. A request for the release of funds must
be accompanied by an environmental certification. A copy of the new form is enclosed.
You are also reminded that your Grantee Performance Report for the 1988
Program Year is due in this office no later than August 30, 1989.

This Grant Agreement is made by and between the Department of Housing and Urban Development (HUD) and
of Roanoke
(the Grantee) pursuant to the authority of Title I of the Housing and Community Devel-
opment Act of 1974 (Public Law 93-383), as amended. The Grantee's submissions for Title I assistance and the HUD regulations at 24
CFR Part 570 (as now in effect and as may be amended from time to time), which are incorporated by reference, together with the H U D
Funding Approval Form 7082 and any special conditions, which are hereto attached, constitute part of the Agreement.
In reliance upon and in consideration of the mutual representations and obligations hereunder, HUD and the Grantee agree as follows:
Subject to the provisions of this Grant Agreement, HUD will make the funding assistance for Fiscal Year 19 8 9 specified in the
attached HUD Funding Approval Form 7082 available to the Grantee upon execution of the Agreement by the parties. The obligation
and utilization of the funding assistance provided is subject to the requirements of the regulations and any special conditions set forth in
the HUD Funding Approval Form 7082, including the requirement for a release of funds by HUD under the Environmental Review
Procedures at 24 CFR Part 58 for any activities requiring such release.
The Grantee agrees to comply with all applicable requirements of Titles II and III of the Uniform Relocation Assistance and Real
Property Acquisition Policies Act of 1970 (42 U.SC. 4601) as specified in regulations issued by the Secretary and published in 24 CFR
Part 42.
The Grantee further agrees to assu me all of the responsibilities for environmental review, decision making and actions, as specified and
required in regulations issued by the Secretary pursuant to section 104(f) of the Act and published in 24 CFR Part 58.
The Grantee further agrees to accept responsibility for adherence to the Agreement by subrecipient entities to which it makes funding

SPECIAL CONTRACT CONDITION
Notwithstanding any other provision of this agreement, no funds provided under this
agreement may be obligated or expended for the planning or construction of water or
sewer facilities until receipt of written notification from HUD of the release of funds on
completion of the review procedures required under Executive Order (E.O.) 12372,
Intergovernmental Review of Federal Programs, and HUD's implementing regulations at
24 CFR Part 52. The recipient shall also complete the review procedures required under
E.O. 12372 and 24 CFR Part 52 and receive written notification from HUD of the release
of funds before obligating or expending any funds provided under this agreement for any
new or revised activity for the planning or construction of water or sewer facilities not
previously reviewed under E.O. 12372 and implementing regulations.

with the Southwest Virginia Community Development Fund for the im-

Loan Fund program, providing for certain Community Development Block
Grant (CDBG) funds for the purpose, for the period beginning July
1, 1989, and ending June 30, 1990; and providing for an emergency.
BE IT ORDAINED by the Council of the City of Roanoke that:
1. The City Manager and the City Clerk are hereby autho-
rized to execute, and to seal and attest, respectively, for and
on behalf of the City, a written agreement, to provide for the
implementation and administration of the Western Virginia
Revolving Loan Fund program, which will provide low interest
loans to small businesses in greater Northwest Roanoke and
industrial areas of the City for the creation of jobs; provide
for CDBG funds in the amount of $33,333; for the period beginning

I. Background:
City Council authorized the Western Virginia Revolving
Loan Fund as P--~-~e Community Development Block
Grant (CDBG) application; approved by Council on April
10, 1989 by Resolution No. 29512.
City has received HUD approval of the CDBG application
by letter dated June 9, 1989.
II. Current Situation:
Western Virginia Revolvinq Loan Fund is a project
operated by Southwest Virginia Community Development
Fund (SVCDF) to provide low interest loans to small
businesses in greater northwest Roanoke and industrial
areas of the city for the creation of jobs. (see
Attachment A for more details)
Local matching funds necessary for this program are
provided by $33,333 in CDBG funds. This will leverage
a minimum of $411,111 additional funds from various
sources for businesses in Roanoke.

like to loan these funds to businesses to create
jobs.
Compliance with applicable regulations is assured
through contract review and project monitoring by
the City's Office of Grants Compliance.

BUDGET:
The total budget for the portion of this project within the

PROPOSED PAYMENT SCWR~ULE AND PROCEDURES:
Ail loan applications must be approved and certified for
payment by a review committee established by the City. Requests
for payment will be submitted to the City's Office of Grants
Compliance, accompanied by an approved loan application from the
small business applicant. Payment will be made to the Subgrantee,
based on the individual loan agreement, within ten (10) days from
date of receipt.
INDE~H~IFICATION:
The Subgrantee agrees to indemnify and hold harmless the
City, its officers, agents and employees, from any and all claims,
legal actions and judgments advanced against the City and for
expenses the City may incur in this regard, arising out of the
Subgrantee's intentional acts and negligent acts or omissions with
respect to the rights and privileges granted by the City to the
Subgrantee in this Agreement.
COMPLIANCE WITH FEDERAL REGULATIONS:
The Subgrantee agrees to abide by the HUD conditions for CDBG
programs as set forth in Attachment A, as if it were the Grantee
referenced therein, and all other applicable federal regulations
relating to specific programs performed hereunder. Further the
Subgrantee agrees to require compliance with applicable federal
regulations of the loan recipient by agreement.

7. UNIFORM ADMINISTRATIVE REQUIREMENTS:
The Subgrantee shall comply with the requirements and
standards of OMB Circular No. A-122, "Cost Principles for Non
Profit Organizations" and with the following Attachments to OMB
Circular No. A-110, if applicable: Attachment A, "Cash
Depositories"; Attachment B, "Bonding and Insurance"; Attachment
C, "Retention and Custodial Requirements for Records"; Attachment
F, "Standards for Financial Management Systems"; Attachment H,
"Monitoring and Reporting Program Performance," paragraph 2;
Attachment N, "Property Management Standards"; and Attachment O,
"Procurement".
8. PROGRAM INCOME:
"Program income" means gross income received by the Grantee
or Subgrantee directly generated from the use of CDBG funds. The
Subgrantee may retain program income, generated by this agreement,
to be revolved in subsequent loans having the same guidelines and
restrictions as those covered by this agreement. The earned
interest portion of such program income may also be used for
certain administrative expenses of this program. All program
income and expenses shall be reported to the Grantee on a
quarterly basis.
9. RECORDS AND RR~ORTS:
The Subgrantee shall maintain full and accurate records with
respect to all matters covered under this Agreement. Ail records
pertaining to this Agreement and the services performed pursuant
to it, shall be retained for a period of three (3) years after the
expiration date of this Agreement or its amendments. Appropriate

City and/or HUD personnel shall have free access to those records
during the Agreement duration and the following three-year time
period.
The Subgrantee shall submit quarterly financial reports to
the Grantee's Office of Grants Compliance. Such reports shall
consist of a cumulative listing of loans made, the payment status
of each loan, the amount available for loans, program income and
expenses. Reports of jobs created or retained shall also be
submitted for each loan including the number of such jobs for
which low and moderate income persons have been employed.
CONFLICT OF INT~qEST:
No employee, agent, consultant, officer or appointed official
of the Subgrantee, who is in a position to participate in a
decision-making process or gain inside information with regard to
any CDBG activity, may obtain a personal or financial interest in
any contract, subcontract or agreement with respect thereto, or in
the proceeds thereunder, either for themselves, their family or
business associates, during their tenure or for one (1) year
thereafter.
SUSP~SION AND TERMINATION
Suspension or termination may occur if the subgrantee
materially fails to comply with any term of this award, and the
award may be terminated for convenience by the grantee or
subgrantee upon written notification to the awarding agency (HUD),
setting forth the reasons for such termination, the effective
date, and in the case of partial termination, the portion to be
terminated.

12. REVERSION OF ASSETS:
Upon expiration of this agreement, or amendments thereto,
the Subgrantee shall transfer to the city any CDBG funds or
program income on hand at the time of expiration and any accounts
receivable attributable to the use of CDBG funds.
13. ANNUAL AUDITAND~ONITO~ING:
The Subgrantee shall provide for an annual independent audit
of all CDBG expenditures covered by the Agreement. Copies of said
audit report shall be furnished to the Grantee's City Manager and
Director of Finance within thirty (30) days of completion of the
audit.
14. THIRD-PARTYCOBTKACTS:
The Grantee shall not be obligated or liable hereunder to any
party other than the Subgrantee.
15. AMENDMENTS.
The Grantee, from time to time, may require changes in the
obligations of the Subgrantee hereunder, or its City Council may
appropriate further funds for the implementation of the Western
Virginia Revolving Loan Fund project. In such event or events,
such changes which are mutually agreed upon by and between the
Subgrantee and grantee shall be incorporated in written amendment
to this Agreement.
16. GOVERNING LAW:
This Agreement shall be governed by laws of the Commonwealth
of Virginia.

WRABA has developed a five-year business
revitalization plan for the area including
duties and responsibilities for the Main
Street Coordinator to promote the Williamson
Road area and recruit businesses to locate
in this area, thereby providing increased
employment in the community.

Current Situation:
WRABA has retained a coordinator to promote
the Williamson Road corridor to both local
and area businesses. The Main Street
Coordinator has also recruited new business
members, helped develop an advertising
program, coordinated special events and
encouraged businesses to locate in the
corridor.
WRABA has office space for the Main Street
Coordinator provided by the Virginia Hair
Academy.
WRABA has raised matching funds ($21,000) as
required by the grant application.

Training Consortium
The Consortium administers the Summer Youth Pro,ram for econom-
ically disadvantaged youth in the Fifth Planning D~strict. The
program operates from May 1 to September 30 of each year.
1. 415 disadvantaged youth will be served with 163 of the youth
s-~o-ta, for Roanoke City residents.
Program activ~$ include administra~on, ~ligibility
determina~on, counseling, assessment, work experience,
remedial education, and career explora~on.
B. The Governor's Employment and Training Department's (GETD)
Policy Guidance Memorandum #89-01 allmws for a maximum of 30%
expenditures for administration of 6% funds under Titl~ II-A.
C. The City of Roanoke is the grant recipJmnt for Consortium funding.
"City Council must appropriate the funding for ~1l grants the
Consortium receives.
II. CURRENT SITUATION
Notice of Award #89-113-03 has been received in the amount of
8'489,311, of which $424,488 is new funding for the Summer Youth
Program.
B. $64,823 of last year's Summer Youth Funding needs t~. be deobligatad
and appropriated to the current year av~,qab~qiry, as indicated by
Notice of Award #89-113-03.
FY'89 Consortium appropria~ons and Revenues need to be adjusted
to reflect the change in the admirdstra~ve---~--~]~ca~ion of 6% funds as
directed by GETD Memo #89-01. These funds are used for "hard-to-
serve" individuals, in accordance with the Job Training Partnership
Act (JTPA) requirements.

I. Backsround:

City Council, by Ordinance No. 29380 dated November 30, 1988,
appropriated $250~000.00 to convert the old Macado space in
the Municipal Parking Garage into the Roanoke Valley Graduate
Center in conjunction with Virginia Polytechnic Institute and
State University, who is the lead school for the five schools
involved. At the same time, an accounts receivable was
established for reimbursement of the project cost from
Virginia Tech, not to exceed the above appropriation.
Bids were received on the project on March 20, 1989, before
Council, with Breakell, Inc. of Roanoke being the low bidder
at $134~900.00 and 105 consecutive calendar days. Council
accepted the low bid and awarded the contract at the same
meeting.
One administrative chanse order has been executed to date in
the amount of $1~655.00. No additional time was requested.
This change order was for conditions on the jobsite that dif-
fered from the contract drawings, changes requested by the
Fire Marshal and the Building Commissioner and for additions
to the contract as requested by Virginia Tech.
Do
Computer connection to the main frame on the Virginia Tech
campus has been the most difficult problem to overcome in
locating the Graduate Center in the downtown area and
Virginia Tech has contributed a great deal of effort to solve
this problem. The following additions have been requested by
Virginia Tech to be incorporated in the contract. The quota-
tions for this work from the contractor included a request
for three (3) additional days.

Install underground conduit from the computer building
at Virginia Western Community College, that is connected
to the Virginia Tech computer, some 600' + across campus
to the satellite tower to be transmitted ~y microwave to
the top parking level of the Municipal Parking Garage.
Amount - $8,891.00
Erect a mast on the top parking deck of the Municipal
Parking Garage and install a junction box at the base of
the mast. Extend 4" conduit from this point down the
back side of the parking structure and then back to the
Administrative office area of the Graduate Center.
Provide and install a lightning arrestor system for this
installation.
Amount - $17,477.00
Total amount of Change Order No. 2 - $26,368.00 and three (3)
additional days requested for this additional work.

Resolution attracted the attention of several citizens who
wished to acquire the structure for various uses such as
residential and commercial. This caused delays while the
proposals were analyzed. Subsequently, all proposals were
rejected as incompatible with the needs and wishes of the
City and the neighborhood group.
Demolition requested by immediate neighbors and Williamson
Road Action Forum. The lapse of almost a year has caused
some concern, resulting in recent requests for action.
II. Present Situation:
Department of General Services advertised the demolition on
May 17, 1989. Bids were received on May 26, 1989.

IV. Alternatives:
Council authorize the appropriate City officials to accept
the low bid of $17,274.00 from J. H. White, Inc. to demolish
the old Tinker School, authorize the execution of a standard
demolition agreement (copy attached) containing insurance and
indemnification provisions and performance standards, and
transfer $17,600.00 from Account No. 001-050-1237-3020 to an
account to be established in the Capital Projects Fund by the
Director of Finance to fund the demolition, advertisement and
associated costs.
1. Need for removal of structure and associated site
improvements is met.
2. Timin8 to accomplish removal as quickly as possible to
meet neighborhood expectations is met.
3. Cost to City is $17,600.00.
Council not authorize the demolition of the school for the
amount of the low bid:
1. Need for removal of structure not met.
2. Timing to accomplish removal quickly is not met.
3. Cost to City is moot.
Recommendation: Council authorize the appropriate City officials
to accept the low bid and execute the contract for the demolition
and transfer $17~600.00 to an account to be established in the
Capital Projects Fund to cover the cost of the demolition in
accordance with Alternative "A".

BE IT RESOLVED by the Council of the City of Roanoke
that the City Manager is authorized to cause the demolition
and removal of the building known as the former Tinker Creek
School in accordance with the City Manager's report to
Council dated July 25, 1988.

after referred to as the "City".

WHEREAS, there is, a need for the removal of the structure located at 2323
Overlook Road, N.E., the Old Tinker School, Official Tax No. 3240211. Authority
to do so was granted by Roanoke City Council by Ordinance No. 29225, dated July
25, 1988.
I. The Contractor agrees to demolish and remove the structure located on
the above-described property and to remove all asphalt pavement and gravel sub-
base material, fuel otl tanks, building material and debris from the entire pre-
mises, to remove foundations, Co fill, and grade and seed the property in
conformity with the established grades and to leave the premises in a clean and
safe condition.
a) Basement area, after removal of concrete foundation walls, floors
and footings, shall be backfilled with clean fill material compacted and
topped with three (3) inches of good topsoil.
b) All cleaned and graded areas to be leveled, filled and seeded with
4 to 6 lb. per 1000 sq. fo. Tall Turf Type Fescue such as "Arid" or
"Rebel", fertilized with 1 lb. 10-10-10 per 1000 sq. ft. and mulched
with 1 to 2 bales of straw per 1000 sq. ft. tacked with wood fiber.

2. The Contractor agrees to discontinue and properly cap all service
utility connections.
3. The Contractor agrees to carry and to provide written evidence of stan-
dard form public liability insurance issued by a company licensed to transact
business In this state, insuring Contractor against liability for bodily injury
or death in the amount of $300,000 for any one accident or occurrence, and
$100,000 for property damage, with the City to be named as an additional
insured.
4. The Contractor agrees to indemnify and hold harmless the City from all
claims, loss, damage, and cost, including attorney's fees, incurred by the City
as a result of or arising out of the work to be performed under this agreement.
5. The Contractor shall not assign any of its rights, duties or responsi-
bilities under this Agreement and shall not sublet to subcontractors without
written consent of the City Engineer.
6. The Contractor shall commence the work to be performed under the Agree-
ment within ten (10) days after such date as is established and fixed for such
commencement in written notice to proceed given by the Manager of General
Services, and the Contractor agrees to fully perform and complete the work
within twenty five (25) consecutive calendar days from the date such
notice to proceed is given. If work is not fully and satisfactorily completed
within the period of time above stipulated, the Contractor agrees to pay the
City the sum of One Hundred DOLLARS ($100.00) as liquidated damages, and not
as penalty, for each consecutive calendar day thereafter during which full com-
pletion of the work shall be in default, as provided herein.

7. The Contractor agrees to take adequate precautions through the use of
water or other equipment to prevent the emission of dust or other particulate
matter in the atmosphere.
8. Upon the completion of the above work as herein contemplated, in a
manner to the satisfaction of the City Engineer, the City agrees to pay to the

Closeout of Accounts for Completed Capital Projects
II.
Background on this issue includes:
Capital projects of all types have been approved by
Council for construction over the past years. These
projects have included construction in major
categories for buildings, parks, highways, sanitary
sewers, and storm drains.
Funding is established for each Droject when Council
approves the construction based on the
recommendations of the various bid construction
costs, as well as extra funding for possible
contingencies.
Completed projects often have relatively small
amounts of contingency funds remaining after final
bills are paid because most projects are completed
within the established budgets.
Current situation:
Closeout of projects authorized by Council is needed
in order to clear the completed projects from the
current project listing as well as to transfer the
remaining funds from the completed projects to
capital projects still under construction or to
capital reserve accounts for other future
construction.
Proceeds of $321,315.00 from the sale of 19.6 acres
of land at RCIT to Sun Link Corporation need to be
formally accepted and appropriated by Council in the
Capital Improvement Reserve - Economic Development
account number 008-052-9575-9178.

the City of Roanoke (1979), as amended, to authorize the
City Attorney to compromise and settle litigation, disputes,
claims or controversies involving the City or its officers
and employees in amounts not to exceed $20,000.00; and pro-
viding for an emergency.
BE IT ORDAINED by the Council of the City of Roanoke as
follows:
1. Section 2-138, Authority to compromise and settle
disputes and claims, of the Code of the City of Roanoke (1979),
as amended, is amended and reordained as follows:

The City Attorney, in such manner as he shall
deem proper, shall be authorized to compromise,
settle and discharge any litigation, claim, dispute
or controversy involving the interests of the City
or brought against any officer or employee of the
City arising from the conduct of such officer or
employee in the discharge of his duties; provided
that, where any proposed compromise or settlement
involves the payment of more than twenty thousand
dollars ($20,000.00) by the City, the City Attorney
shall obtain the approval of City Council for such
payment. In exercising his authority pursuant to
this section, the City Attorney shall be authorized
on behalf of the City to execute settlement agree-
ments, releases, covenants not to sue and similar
documents.

1. The bid of David M. Webb, t/a D & B Outfitters, which
bid complies with all City specifications, for concession privi-
leses at Carvins Cove for a fee of $2,100.00 for the period June
1, 1989 to May 31, 1990, with the option to renew for two (2)
additional years, is hereby ACCEPTED.
2. The City Manager is hereby authorized for and on behalf
of the City to enter into and execute the requisite concession
agreement with the aforesaid concessionaire. The agreement shall
incorporate all the terms, provisions and conditions contained in
the City's form of proposal advertised for bids and on which the
aforesaid concessionaire's bid to the City was made, and the form
of such agreement shall be approved by the City Attorney.

I. BACKGROUND
SUBJECT: BID ON CONCESSIONS AT CARVINS COVE
BID NUMBER 89-5-31
Specifications were developed for the purpose of securing
bids for concession operations at Carvins Cove.
Request for Quotations were sent specifically to
twenty-three (23) vendors listed on the City's current bid
list. A public advertisement was also published in the
Roanoke Times and World News.
Concession agreement for Carvins Cove is to be for the
period June 1, 1989 to May 31, 1990.
Bids were requested to identify a vendor and an annual sum
to be paid for concession rights.
II. CURRENT SITUATION

One (1) bid was received. The bid, submitted by D & B
Outfitters, agrees to pay to the City of Roanoke, the sum of
$2,100.00 for the concession rights at Carvins Cove for the
period June 1, 1989 to May 31, 1990.
