funds for improvements to Statesman Industrial Park. Mr.

Association.
The matter of correcting drainage problems and other im-
provements in Statesman Industrial Park was referred to the
City Manager and the Director of Finance for report to
Council with regard to developing a source of funds for a
comprehensive plan, a time-table for completion of the

Dear Council Members:
Subject: Application to amend the boundaries of the City of
Roanoke's Enterprise Zone.
I. Background:

City of Roanoke received Enterprise Zone designation in 1983
by Governor Charles S. Robb under authority of the Virginia
1982 Urban Enterprise Zone Act.
The Enterprise Zone Program in the City of Roanoke has been
successful in promoting economic development within the inner
city. Currently 14 companies are certified to receive zone
benefits and incentives. There is no Zone in Virginia that
has certified more businesses than Roanoke.
II. Current Situation:
Roanoke's Enterprise Zone encompasses 1,895 acres. In
accordance with State Enterprise Zone regulations, the City
may file an application with the Department of Housing and
Community Development to expand the City's zone to a maximum
of 1,906 acres, thus allowing 11 additional acres for possible
expansion.
Department of Economic Development has determined three areas
not currently in the zone which would benefit from being
incorporated into the Enterprise Zone. These areas are
highlighted on the attached map and are described as follows:
Starting at the intersection of Luck Avenue and 5th
Street at Tax Map Number 1113513, south to Marshall
Avenue at Tax Map Number 1113531, west one and one-half
blocks to include Tax Map Number 1113313, north to
include Tax Map Number 1113304, south to include Tax Map
Number 1113501, then east to include Tax Map Number
1113513. The major industry in this area is the Roanoke
Dyeing and Finishing facility which is experiencing
phenomenal growth. (See attached map.)

Starting at the intersection of 18th Street and Melrose
Avenue at Tax Map Number 2322115, west three and one-half
blocks to the intersection of Salem Turnpike and Melrose
Avenue to include Tax Map Number 2321814, northeast to
the intersection of Orange Avenue and 20th Street to
include Tax Map Number 2321904, east one block to include
Tax Map Number 2322001, south one-half block to include
Tax Map Number 2322109, then east one block to include
Tax Map Number 2322115. The vacant northwest Kroger
grocery store is located in this area. (See attached
map.)
Starting with the southwest corner of Tax Map Number
2111710 north following the CN zoning line to Orange
Avenue at the northwest corner of Tax Map Number 2222108
east along Orange Avenue to the northeast corner of Tax
Map Number 2120801 south along CN zoning line to the
southeast corner of Tax Map Number 2111802 west to the
starting point.
Office of Economic Development has determined one area
currently in the zone which is not eligible to receive zone
benefits and therefore should be removed from the zone. It is
the only residentially zoned area in the Enterprise Zone and
it contains the Indian Rock Village Public Housing Project.
This area is highlighted on the attached map and is described
as follows:

Starting at the intersection of Wise Avenue and 19th
Street at Tax Map Number 4210337, northeast to Tinker
Creek, southeast following the northern boundary of Tax
Map Number 4210333 to Wise Avenue, west following Wise
Avenue to the starting point. Tax Map Numbers 4210333,
4210334, 4210335, 4210336 and 4210337 make up this area.
State of Virginia Enterprise Zone Program regulations require
at least one public hearing on the requested amendment prior
to its submission to the Department of Housing and Co,unity
Development.

III. Recommendation:
It is recommended that the City of Roanoke's Enterprise Zone be
expanded by amending the boundaries and, to that end, that City
Council authorize the City Clerk to schedule a public hearing for
October 9, 1989 at 7:30 p.m. in Council Chambers in order to
receive citizen comment on the proposed amendment to the boundaries
of the current Enterprise Zone. After the public hearing, Council
will be requested to act upon the proposed amendment.

Dear Members of City Council:
I am writing to you as the newly elected President of the
Statesman Industrial Park Association (S.I.P.A.) and also as the
President and owner of Tread Corporation which is located in
Statesman Industrial Park.
The S.I.P.A. represents 56 companies with approximately 1,600
employees. This letter expresses our disappointment that City
Council and City Management continue to allocate funds for major
economic development and other city projects while making no
provision for addressing problems in Statesman Park.
Over the past three years, our association has worked with
various city departments and members of City Council to obtain
funding for a traffic light on 460, storm drainage, curbs and
gutters, street paving and landscaping. A traffic light was
placed in operation this summer resolving a major traffic safety
issue for trucks and automobiles entering and leaving the Park.
The other projects, however, have no firm schedule or funds
committed at this time.
During the course of this sum~er, we have written to City
Council outlining the need for the City to address Statesman
Park improvements in conjunction with acquiring new land for
additional industrial development. We also appeared before a
Planning Commission hearing with a request for the City to
allocate funds to bring Statesman Park facilities up to an
acceptable level at the time major economic development funds
are being committed to adjacent property. On August 11, we met
with the City Manager and staff from the Engineering and
Economic Development departments; at this meeting we were
advised that funds for our projects may be included in a 1991
bond issue with substantial funding provided in 1992-95
depending on other City spending priorities at that time.

It is our view that the needs of Statesman Park keep getting
pushed into the future and this is totally unacceptable to us.
We are businessmen trying to expand businesses and jobs in the
Roanoke Valley, but this is increasingly difficult to do in view
of the poor facilities in the Park. We have tried to work with
City officials in developing priority needs but to date have
been unsuccessful in achieving funding for these projects.
Recently, we have spoken separately with most members of City
Council. These members all support the need for improvements,
feel that businesses in the Park deserve a better return on
taxes paid to the City, and have indicated that funds could be
made available starting in 1990 not in 1992. We want to know
how to obtain such a committment since our efforts to date have
generated no concrete results.
We are tired of being treated like second class citizens and
businesses. It reflects on our business growth prospects,
employee morale, and operating conditions. We, respectfully,
request City Council to consider allocating funds for Statesman
Park starting in 1990. A preliminary Phase II improvement
program outlined by the City Manager totalled $2,000,000 which
we feel could be spread over 3-4 years.
In order to openly discuss this request with Council, we plan to
attend the October 2, 1989 meeting and further review our ideas
with Council members. In the meantime, please feel free to

Subject: Storm Drain Revision - Appropriation of Funds
Elm Avenue, 1st Street, & Jefferson Street
I. Back~round:
Storm Drain inlets located at the intersection of Elm Avenue and 1st
Street, S.W. (3 each) have been determined to be connected directly to
discharge into the existing 12 inch sanitary sewer running along Elm
Avenue to Jefferson Street. City Ordinance prohibits the introduction
of storm water run-off into the public sanitary sewer system.
Inlets are concentrat£ng storm water run-off and inducing flow into
the sanitary sewer system beyond the limits for which it was designed
to function.
C. Construction plans to solve the problem have been developed by the
Engineering Department.
II. Current Situation:
Construction Plans propose plugging the outlet ends of the three
inlets at Elm and 1st and installing two (2) additional inlets
downstream at Elm Avenue and Jefferson to discharge into the existing
storm system. Run-off which was formerly concentrated at the old
inlets and discharged into the sanitary sewer system can then flow
along the existing gutter lines to the new inlets at Jefferson Street.
Construction will be accomplished by City forces at an estimated cost
of $28~000.00; and it is necessary to authorize funds in the amount
of $10,000.00 to purchase materials. Labor charges for the work will
be billed to the Street Maintenance Department Budget through internal
billing. Funding is available in the Street Maintenance Budget for
the billing of labor charges. Work will be performed by the Utility
Line Services Department.
III. Issues in order of Importance:
A. Effective means of redirecting inflow of stormwater run-off into the
sanitary sewer system on Elm Avenue.
B. Funds for construction.

IV. Alternatives are:
Authorize the transfer of $10,000.00 from the Internal Service Fund
Contingency, Account No. 006-002-9411-2199, to Account Number
006-056-2625-3005, Project Supplies.
Effective means of redirecting inflow of stormwater runoff into
the existing sanitary sewer system on Elm Avenue has been provided
for Section 26-48 of the Code of the City of Roanoke, 1979
(amended), which prohibits the introduction of stormwater run-off
into the public sanitary sewer system, would be met.
2. Funds for construction currently exist in but need to be trans-
ferred from Internal Service Fund Contingency.
B. Do not authorize the transfer of $10~000.00 from the Internal Service
Fund Contingency to permit this construction.
Effective means of redirecting inflow of stormwater run-off into
the exisiting sanitary sewer will still exist but cannot be
addressed at this time. Section 26-48 of the City Code would not
be met.
Funds for construction will remain in the Internal Service Fund
Contingency Account. The project will be delayed and inflow of
stormwater run-off into the sanitary sewer on Elm Avenue will
continue.
Recommendation: City Council authorize the implementation of Alternative
"A" as follows:

viding for an emergency and an effective date.
BE IT ORDAINED by the Council of the City of Roanoke that:
1. Subsection (a) of §20-6, Adoption of state law; subsec-
tion (d) of ~20-7, General powers and duties of city manager with
respect to traffic; subsection (e) of ~20-11, General duty of
drivers and passengers in event of accident; subsection (b) of
§20-26, Required; exceptions; subsection (o) of $20-28, Tax
imposed; subsection (11) of ~20-$5, Parking prohibited in speci-
fied places; subsection (j) of ~20-69, Parking regulations on
property of Virginia Western Community College; $20-76, Parking
in spaces reserved for handicapped persons; subsection (c) of
$20-81, Exemptions from certain requirements of parking meter
regulations; subsections (b)(1), (b)(2), (b)(3), and (c) of
$20-89, Penalties for unlawful parking; ~20-93, Impoundment
authorized; §20-101, Definitions; $20-102, Abandoned vehicles
may be taken into custody; $20-103, Notice to owner of vehicle
taken into custody; $20-104, Sale of vehicle at public auction;
disposition of proceeds; $20-105, Vehicles abandoned in garages;
~20-106, Disposition of inoperable abandoned vehicles; and sub-
section (a) of $21-40.1, Open storage of inoperative vehicles in
residential or commercial or agricultural districts of the Code
of the City of Roanoke (1979), as amended, be and are amended as
follows:
~20-6. Adoption of state law.
(a) Pursuant to the authority of section 46.2-1313, of
the Code of Virginia, all of the provisions and require-
ments of the laws of the state contained in Title 46.2
of the Code of Virginia, except those provisions and
requirements the violation of which constitutes a
felony, and except those provisions and requirements
which, by their very nature, can have no application to
or within the city, are hereby adopted and incorporated
in this chapter by reference and made applicable within
the city. References to "highways of the state" con-
tained in such provisions and requirements hereby
adopted shall be deemed to refer to the streets, high-
ways and other public ways within the City. Such provi-
sions and requirements, as amended from time to time,
are hereby adopted and made a part of this chapter as
fully as though set forth at length herein, and it shall
be unlawful for any person within the city to violate or
fall, neglect or refuse to comply with any provision of
Title 46.2 of the Code of Virginia which is adopted by
this section; provided, that in no event shall the
penalty imposed for the violation of any provision or
requirement hereby adopted exceed the penalty imposed
for a similar offense under Title 46.2 of the Code of
Virginia.
~20-7.
General powers and duties of city manager with
respect to traffic.
(d) The city manager may promulgate rules and regula-
tions temporarily decreasing the weight limits of
vehicles pursuant to the provisions of section 46.2-1104
of the Code of Virginia. He may also issue special
permits for oversize and overweight vehicles pursuant to
the provisions of section 46.2-1139 of the Code of
Virginia.

§20-11. General duty of drivers and passengers in
event of accident.
(e) The reports required by this section are in addi-
tion to other accident reports required by title 46.2 of
the Code of Virginia, and shall be made irrespective of
the amount of property damage involved.
$20-26. Required; exceptions.
(b) No person shall be required to obtain a license
under this article for a vehicle that is exempt from
annual registration and license plates under Title 46.2,
Chapter 6, Article 6, of the Code of Virginia, or a
vehicle upon which the city is prohibited from imposing
a tax or license fee by section 46.2-755.
120-28. Tax imposed.
(o) Notwithstanding the provisions above, upon receipt
of an application on a form prescribed by the com-
missioner of revenue and receipt of written evidence
from one of the armed forces that an applicant for the
annual motor vehicle license was a prisioner of war and
was honorably discharged, if not currently a member of
the armed forces, the annual motor vehicle license shall
be issued with no tax being assessed. Issuance of such
free license shall be limited to passenger vehicles and
pickup or panel trucks as defined in section 46.2-100,
Code of Virginia. No individual shall be issued a free
license under this subsection for more than one vehicle.
Any person who is not a person described in this sub-
section and who willfully and falsely represents himself
as having the qualifications to obtain the free annual
license shall be guilty of a traffic infraction
punishable by a fine of not more than one hundred
dollars ($100.00).
§20-65. Parking prohibited in specified places.
(11) Any parking space reserved for the handicapped on
a public street, unless a special vehicle parking permit
for transmitting handicapped persons issued pursuant to
section 46.2-1238, Code of Virginia, is displayed in the
window of vehicle.
$20-69. Parking regulations on property of Virginia
Western Community College.
(j) Any operator who displays in the window of his
vehicle a special vehicle parking permit for handicapped
persons issued pursuant to section 46.2-1238, Code of
Virginia, may park such vehicle for an unlimited period
of time in parking zones otherwise restricted as to
length of parking time permitted and shall be exempt
from paying parking meter fees.
§20-76.
Parking in spaces reserved for handicapped
persons.
No person shall park or leave standing any vehicle
not displaying a special license plate, decal or parking
permit issued pursuant to sections 46.2-731, 46.2-739 or
46.2-1238, Code of Virginia, in a parking space reserved
for handicapped persons on public property or in private-
ly owned parking areas open to the public.

Exemptions from certain requirements of
parking meter regulations.
(c) Any operator who displays in the window of his
vehicle a special vehicle parking permit for handicapped
persons issued pursuant to section 46.2-1238, Code of
Virginia, may park such vehicle for an unlimited period
of time in parking zones otherwise restricted as to
length of parking time permitted and shall be exempt
from paying parking meter fees.

Penalties for unlawful parking.
(b)(1) A penalty of five dollars ($5.00) may be paid
for a violation of section 20-65 (except subsection (4)
thereof), 20-66, 20-67, 20-68, 20-69, 20-70, 20-71,
20-72, 20-73, 20-75, 20-79, 20-80 or 20-81, if paid
within ten (10) days of the issuance by an officer of a
notice of a violation thereof; if paid thereafter, the
penalty shall be fifteen dollars ($15.00). If not paid
within ten (10) days, a notice pursuant to section
46.2-941, Code of Virginia, shall be sent by the city's
office of billings and collections to the violator. Any
violator to whom such notice is sent may pay such
penalty of fifteen dollars ($15.00) within five (5) days
of receipt of such notice.
(b)(2) A penalty of ten dollars ($10.00) may be paid
for a violation of section 20-65(4) or section 20-74, if
paid within ten (10) days of the issuance by an officer
of a notice of a violation thereof; if paid thereafter
the penalty shall be twenty dollars ($20.00). If not
paid within ten (10) days, a notice pursuant to section
46.2-941, Code of Virginia, shall be sent by the city's
office of billings and collections to the violator. Any
violator to whom such notice is sent may pay such
penalty of twenty dollars ($20.00) within five (5) days
of receipt of such notice.
(b)(3) A penalty of twenty-five dollars ($25.00) may
be paid for a violation of section 20-76, if paid within
ten (10) days of the issuance by an officer of a notice
of a violation thereof; if paid thereafter, the penalty
shall be thirty-five dollars ($35.00). If not paid
within ten (10) days, a notice pursuant to section
46.2-941, Code of Virginia, shall be sent by the city's
office of billings and collections to the violator. Any
violator to whom such notice is sent may pay such penalty
of thirty-five dollars ($35.00) within five (5) days
of receipt of such notice.
(c) If a violator does not pay the penalty provided
for above within five (5) days of receipt of a notice
sent pursuant to section 46.2-941, Code of Virginia, the
clerk of the.general district court and the officer
responsible for issuing parking summons shall be
notified of the failure to pay such penalty, in order
that a summons be issued.
§20-93. Impoundment authorized.
(a) Any motor vehicle, trailer or
thereof may be removed by or under
semitrailer, or parts
the direction of the
chief of police for safekeeping to a storage area if:
(i)
It is left unattended on a public highway or
other public property and constitutes a traf-
fic hazard;
(2) It is illegally parked;
(3)
It is left unattended for more than ten days
either on public property or on private prop-
erty without the permission of the property
owner, lessee, or occupant; or
(4)
It is immobilized on a public roadway by
weather conditions or other emergency
situation.
(b) This section, shall not authorize removal of motor
vehicles, trailers, semitrailers, or parts thereof from
private property without the written request of the
owner, lessee, or occupant of the premises. The person
at whose request a motor vehicles, trailer, semitrailer,
or part of a motor vehicle, trailer or semitrailer is
removed from private property shall indemnify the city
against any loss or expense iacurred by reason or remo-
val, storage, or sale thereof.
(c) Prior to any removal and impoundment by the city
under the authority of subsection (a)(3) of this sec-
tion, the chief of police or his designee shall send by
certified mail, return receipt requested, notice of such
proposed removal to the owner of such automobile at his
last known address as shown on the records of the divi-
sion of motor vehicles. Such notice shall advise that
the owner may, within forty-eight (48) hours of receipt
of the notice, contact the police department to request
a hearing regarding the proposed removal. If a timely
request for hearing is made, the hearing shall be sche-
duled before an officer appointed by the chief of police
within seventy-two (72) hours.
920-101. Definitions.
As used in this division:
Abandoned motor vehicle means a motor vehicle,
trailer, or semitrailer or part of a motor vehicle,
trailer, or semitrailer that:
(1)
Is inoperable and is left unattended on public
property for more than forty-eight (48) hours,
or
(2) Has remained illegally on public property for
more than forty-eight (48) hours, or
(3)
Has remained for more than forty-eight (48)
hours on private property, without the consent
of the property's owner, regardless of whether
it was brought onto the private property with
the consent of the owner or person in control
of the private property.
Demolisher means any person, firm or corporation
whose business is to convert a motor vehicle, trailer or
semitrailer into processed scrap or scrap metal or
otherwise to wreck or dismantle such vehicles.
Inoperable abandoned motor vehicle means an aban-
doned motor vehicle which is inoperable and whose fair
market value, as determined by the Commissioner of
Revenue, is less than the cost of its restoration to an
operable condition.
$20-102. Abandoned vehicles may be taken into custody.
The city manager, acting through the chief of
police, may take or cause to be taken into custody and
dispose of any abandoned motor vehicle. In such connec-
tion, the city may employ city personnel, equipment and
facilities or hire persons, equipment and facilities or
firms or corporations who may be independent contractors
for removing, preserving and storing abandoned motor
vehicles.
§20-103. Notice to owner of vehicle taken into custody.
(a) When the city takes an abandoned motor vehicle into
custody, the chief of police shall, within fifteen (15)
days, by registered or certified mail, return receipt
requested, notify the owner of record of the motor
vehicle and all persons having security interests in the
vehicle of record, that it has been taken into custody.
The notice shall (i) state the year, make, model and
serial number of the abandoned motor vehicle; (ii) set
forth the location of the facility where it is being
held; (iii) inform the owner and any persons having
security interests of their right to reclaim it within
fifteen (15) days after the date of the notice, after
payment of all towing, preservation and storage charges
resulting from placing the vehicle in custody. The
notice shall state that the failure of the owner or per-
sons having security interests to reclaim the vehicle
within the time provided shall consitute (i) a waiver by
the owner and all persons having any security interests
of all right, title and interest in the vehicle, and
(ii) consent to the sale of the abandoned motor vehicle
at a public auction.
(b) If records of the Department of Motor Vehicles con-
tain no address for the owner or no address of any per-
son shown by the Department's records to have a security
interest, or if the identity and addresses of the owner
and all persons having security interests cannot be
determined with reasonable certainty, notice by publica-
tion once in a newspaper of general circulation in the
area where the motor vehicle was abandoned shall be suf-
ficient to meet all requirements of notice pursuant to
this section as to any person who cannot be notified
pursuant to the foregoing provisions of this section.
Notice by publication may contain multiple listings of
abandoned motor vehicles. Any notice of this kind shall
be within the time requirements prescribed by this sec-
tion for notice by mail and shall have the same contents
required for a notice by mail.
(c) The consequences of failure to reclaim an abandoned
motor vehicle shall be as set forth in a notice given in
accordance with and pursuant to this section.
$20-104.
Sale of vehicle at public auction; disposition
of proceeds.
If an abandoned motor vehicle is not reclaimed as
provided above, the city or its authorized agent shall,
notwithstanding the provisions of §46.2-617, Code of
Virginia, sell it or cause it to be sold at public auc-
tion. The purchaser of the motor vehicle shall take
title to the motor vehicle free of all liens and claims
of ownership of others, shall receive a sales receipt at
the auction and shall be entitled to apply to and
receive from the Department of Motor Vehicles a cer-
tificate of title and registration card for the vehicle.
The sales receipt from the sale shall be sufficient
title only for purposes of transferring the vehicle to a
demolisher for demolition, wrecking or dismantling, and
in that case no further titling of the vehicle shall be
necessary. From the proceeds of the sale of an aban-
doned motor vehicle the city or its authorized agent
shall reimburse itself for the expenses of the auction,
the cost of towing, preserving and storing the vehicle
which resulted from placing the abandoned motor vehicle
in custody, and all notice and publication costs
incurred pursuant to this division. Any remainder from
the proceeds of a sale shall be held for the owner of
the abandoned motor vehicle or any person having
security interests therein, as their interests may
appear, for ninety (90) days, and then be deposited with
the treasurer of the city.
§20-105. Vehicles abandoned in garages.
Notwithstanding $20-101 above, any motor vehicle,
trailer, semitrailer or part thereof shall be considered
abandoned and may be reported by the garagekeeper to the
city if it has been left in a garage for more than ten
(10) days or for more than the (10) days beyond the
period the vehicle was to remain on the premises pur-
suant to a contract, after notice by registered or cer-
tified mail, return receipt requested, to the owner of
record and all persons having security interests of
record therein, to reclaim the vehicle within fifteen
(15) days of the notice. Any abandoned motor vehicle
left in a garage may be taken into custody by the city
in accordance with the provisions of this division, and
shall be subject to the notice and sale provisions set
forth in this division. If however, the vehicle is
reclaimed, the person reclaiming it, in addition to the
other charges required to be paid, shall pay the reason-
able charges of the garagekeeper unless otherwise pro-
vided by contract. If the vehicle is sold pursuant to
the provisions of this division, any garagekeeper's
charges shall be paid from, and to the extent of, the
excess of the proceeds of sale after paying the expenses
of the auction, the costs of towing, preserving and
storing the vehicle which resulted from placing the
vehicle in custody and all notice and publication costs.
For the purposes of this section, "garage" means any
commercial parking place, motor vehicle storage faci-
lity, or establishment for the servicing, repair, main-
tenance or sale of motor vehicles whether or not the
vehicle had been brought to that location with the con-
sent of the owner or person in control of the premises,
and "garagekeeper" means the operator of a garage.
$20-106. Disposition of inoperable abandoned vehicles.
Notwithstanding any other provisions of this Chapter,
any inoperable abandoned motor vehicle, which has been
taken into custody pursuant to other provisions of this
Chapter, may be disposed of to a demolisher, without the
title and without the notification procedures, by the
city or by the person on whose property or in whose
possession the motor vehicle is found. The demolisher
on taking custody of the inoperable abandoned motor
vehicle shall notify the Department of Motor Vehicles,
on forms and in the manner prescribed by the
Commissioner. Notwithstanding any other provision of
law, no other report or notice shall be required in this
instance.
§21-40.1. Open storage of inoperative vehicles in resi-
dential or commercial or agricultural districts.
(a) It shall be unlawful for any person to keep or
store, except within a fully enclosed building or struc-
ture, or otherwise shielded or screened from view, on
any property zoned for residential or commercial or
agricultural purposes, any motor vehicle, trailer or
semitrailer, as such are defined in section 46.2-100 of
the Code of Virginia, which is inoperative. As used in
this section, an "inoperative motor vehicle" shall mean
any motor vehicle which is not in operating condition or
which, for a period of sixty (60) days or longer, has
been partially or totally disassembled by the removal of
tires and wheels, the engine, or other essential parts
required for operation of the vehicle or on which there
are displayed neither valid license plates nor a valid
inspection decal.
2. In order to provide for the usual daily operation of the
municipal government, an emergency is deemed to exist, and this
ordinance shall be in full force and effect retroactive to
October 1, 1989.

Dear Mrs. Bowles and Gentlemen:
At the most recent session of the General Assembly, Title 46.1,
"Motor Vehicles," of the State Code was recodifed as Title 46.2. The
effective date of Title 46.2 was established as October 1, 1989.
Throughout the City Code and particularly in Title 20, "Motor
Vehicles and Traffic," there are numerous references to the State Code
sections pertaining to motor vehicles. In order to make the City Code
consistent with the State Code and to ensure that any motor vehicle
infractions which are charged under the City Code are not subject to
challenge as being inconsistent with state requirements, my Office has
prepared the enclosed ordinance which amends several sections of the
City Code.
These proposed amendments are mainly housekeeping in nature and do
not reflect any changes in City requirements other than those mandated
by state law. The ordinance has been reviewed and approved by the
Police Department.
I will be pleased to answer any questions which members of Council

ditions, and awarding a contract therefore; authorizing the proper
City officials to execute the requisite contract for such work;
rejecting all other bids made to the City for the work; and provid-
ing for an emergency.

1. The bid of Aaron J. Conner, General Contractor, Inc., made to
the City in the total amount of $1,009,604.20 for construction of
Williamson Road Storm Drain, Phase 2, Contract IG, Left Segment, such
bid being in full compliance with the City's plans and specifications
made therefor and as provided in the contract documents offered said
bidder, which bid is on file in the Office of the City Clerk, be and
is hereby ACCEPTED.
2. The City Manager or the Assistant City Manager and the City
Clerk are hereby authorized on behalf of the City to execute and
attest, respectively, the requisite contract with the successful

2. Appropriate from the Undesignated Funds in the Capital
Projects Fund the amount of $696~710.00.
The combined appropriated and transfered funds shall include
$1~009~604.20 contract amount and $100~960.80 contingency

Bidders are required to comply with all applicable City Ordinances, State Laws
and Federal Regulations; and are required under Title 54.1, Chapter 11, Code of
Virginia (1950), as amended, to be licensed as a "Class A Contractor" before
submitting a Bid of Forty Thousand {$40,000.00) Dollars or more; or to be
licensed as a "Class B Contractor" before submitting a Bid of Fifteen Hundred
($1,500.00) Dollars or more, but less than Forty Thousand ($40,000.00) Dollars.
Bidders shall show evidence of being properly licensed as required in the
Instructions to Bidders. Bidders shall deposit with their Bid, and the
Employment Projection Form, a Bid Security executed in the amount and form
stipulated in the Instructions to Bidders.

The City of Roanoke expressly reserves the right to reject any or all Bids, to
waive any informality or irregularity in the Bids received, and to accept a Bid
which ls deemed to be in the best interest of the City of Roanoke.
If the Bid by the lowest responsible Bidder exceeds available funds, the City
reserves the right to negotiate with the apparent low Bidder pursuant to
§23.1-14(c), Code of the City of Roanoke (1979), as amended. The conditions and
procedures under which such negotiation may be undertaken are that the
appropriate City officials shall determine that the lowest responsible Bid
exceeds available funds and not£fy such Bidder in writing of its desire to nego-

Bids may not be withdrawn for a period of sixty (60) days after the Opening of

The Bidder shall give notice in writing to the City of Roanoke a claim to
withdraw the Bid within two (2) business days after the Opening of Bids as set

for City Information System (CIS)
Fourth Floor - Municipal North
Roanoke, Virginia
I. Background:
City Council, at its September 11, 1989 meeting, publicly opened and
read aloud the bids received for the new Uninterruptible Power Source
for the City Information System in Municipal North.
Four (4) bids were received with Varney Electric Company, Incorporated
submitting the low bid in the amount of $84~500.00 and 6_q0 consecutive
calendar days.
C. Project is as follows:
The present Uninterruptible Power Source is a iOOA, 3 phase,
208V, 60 Hertz output system that is seven years old (of a 10 year
warranty). Several of the battery cells are beginning to disin-
tegrate and some of the cells have already been replaced. This
system is about 50% efficient (200A input to the UPS and battery
and only a llOA output). The computer was evaluated some time ago
and only critical equipment is on the UPS. The new UPS unit and
battery require 270A input with a 225A output (83% efficiency).
This new system will permit more computer components to be con-
nected to the UPS. If the City experiences a loss of electrical
power, and this system fails, the financial accounting system
could be lost along with other important information.
A new buildin~ power supply is to be installed from the main
distribution panel on the ground floor to the UPS Room on the
Fourth Floor (a minimum of 350A).
3. New higher capacity UPS and feed circuits to the computer are to
also be provided.
The present iOOA emergency generator circuit will be disconnected,
since the new system will give the operators a minimum of 15 min-
utes in which to shut down the computer.

3. Fundin8 would not be encumbered at this time.,
Time of completion would be extended. The CIS Department has
operated on a selective priority equipment basis for some time and
would have to continue. The present battery will require some
major replacement of cells in the near future (72 cells). This
could be avoided by continuing with this project as expeditiously
as possible.

Subject: Brandon Avenue Widening
The attached staff report was considered by the Water
Resources Committee at its regularly scheduled meeting on September 25,
1989. The Committee recommends that Council authorize the acquisition
of the necessary right-of-way by providing for the expenditure of funds
for those parcels which must be purchased at appraised fair market
value, and providing for the City Attorney to have authority to
institute condemnation proceedings, as necessary for the subject
property.
The Committee also recommends that Council authorize transfer of
funds for acquisition of right-of-way for the Brandon Avenue Widening
Project in the amount of $10,000.00 from Capital Improvement Reserve -
Streets & Bridges Account No. 008-052-9575-8181 to a new account to be
established by the Director of Finance in the Capital Projects Fund
"mrandon Avenue Land Purchase".

BRANDON AVENUE WIDENING
I. Back,round:

Brandon Avenue is a four-lane roadway from Colonial Avenue to the
lower Towers mall access road, then a three-lane roadway to Malcolm
Street (a distance of approximately 900 feet) at which point it widens
to become a four-lane roadway again. (See Attachment A - map.)
City Council, at their meeting on October 28, 1985, heard a request
from Councilman David Bowers that the then Acting City Manager, W.
Robert Herbert, study the feasibility of adding an additional west-
bound traffic lane to the portion of Braodon Avenue between the lower
Towers Mall access road and Main Street, S.W. Following staff review
of the project, City Council, at their January 21, 1986 meeting,
directed the City Manager to include for consideration in the next
Capital Improvement Program, the construction of this project.
City Council, at their meeting on November 28, 1988, approved an
expenditure list for the Fiscal Year 1988-89 Capital Maintenance and
Equipment Replacement Program which included $160~000 for construction
of the Brandon Avenue widening project.
II. Current Situation:

Design plans are complete to a point where contact has been initiated
with those property owners from whom the City needs to acquire right-
of-way for the purpose of constructing a westbound Brandon Avenue turn
lane onto Main Street
Funds to acquire the necessary project right-of-way are available from
Capital Improvement Reserve - Streets & Bridges Account No.
008-052-9575-9t81.
City Manager is exercising his authority, as defined in Section 21 of
the Charter of the City of Roanoke, to accept the right-of-way dona-
tions for a portion of the right-of-way being donated to the City.

Appraisals and monetary offers equal to the amount of the appraisal
have been made for right-of-way which has not been donated to the
City.

Authorize the acquisition of the necessary right-of-way by providing
for the expenditure of funds for those parcels which must be purchased
at appraised fair market value, and providing for the City Attorney to
have authority to institute condemnation proceedings, as necessary,
for the subject property.
1. Compliance with City Council's desire to widen Brandon Avenue
would be achieved.
Timin8 associated with this right-of-way acquisition process would
make a late-fall construction start undesirable. Maintaining the
project through the winter would significantly increase project
costs. Therefore, project advertisement is scheduled for the
winter and construction in the spring of 1990.
3. Funds are available from Capital Improvement Reserve - Streets &
Bridges Account No. 008-052-9575-9181.
B. Deny authorization to acquire right-of-way for the subject project.
1. Compliance with City Council's desire to widen Brandon Avenue
would be delayed.
2. Timin~ to allow early spring construction would be in jeopardy.
3. Funds which are currently available would not be expended.
Recommendations is that Alternative "A" be implemented as follows:
A. City Council approve the proper measure, in a form acceptable to the
City Attorney, authorizing:

Risht-of-wa¥ acquisition for four (4) parcels identified on
Attachment "B", one (1) of which is known at this time to be by
donation, with three (3) that may be with compensation based on a
negotiated settlement from an appraised value, or by condem-
nation. Total acquisition costs for right-of-way on the three
parcels is not to exceed 810,000.00, including the cost of any
court mandated compensation in the event of condemnation, without
further authorization of Council.
Institution of Condemnation and Risht of Entry Proceedings, as to
right-of-way from the remaining three (3) parcels identified on
Attachment "B", by the City Attorney in the event of continued
refusal of property owners to accept or negotiate a bona fide
settlement in order that undue delay be avoided for the project.
Transfer fundin8 for acquisition of right-of-way for the Brandon
Avenue Widening Project in the amount of $10~000.00 from Captital Im-
provement Reserve - Streets & Bridges Account No. 008-052-9575-9181 to
a new account to be established by the Director of Finance in the
Capital Projects Fund "Brandon Avenue Land Purchase".
