ATTEST: City Clerk. Roanoke City Planning Commission October 9, 1989 The Honorable Noel C. Taylor, Mayor and Members of City Council Roanoke, Virginia Dear Members of Council: Subject: Request from W. H. Fralin, Attorney, representing J. F. Davis, that a tract of land lying on the southeasterly side of Carvin Street, N.E., being official tax nos. 3322301 and 3322201, be rezoned from RM-1, Residential Multi-Family, Low Density District, to RM-2, Residential Multi-Family, Medium Density District. Background: Purpose of the rezoning request is to permit the construction of an 8-unit apartment building. B. Petition to rezone was filed on August 16, 1989. Planning Commission public hearing was held on Wednesday, September 6, 1989. Mr. W. H. Fralin, attorney, appeared before the Commission and stated that the proposed rezoning was being sought to permit the construction of an eight unit apartment building and that the site plan was being proffered as part of the request. Mrs. Goode asked if eight units were being proffered and Mr. Fralin responded that the petitioner would amend his request so that eight units would become a proffered condition. Amended petition to rezone was filed on September 13, 1989. The conditions proffered by the petitioner are as follows: Room 355 Municipal BuiLding 215 Churdn Avenue, 5'94 R~c~anoke, Virginia 24011 (703) 981 2344 II. Issues: A 10' buffer of white pines, at least 6' tall, staggered approximately each 12' will be planted along the southwest side of the property, as shown on the attached map; The property will be developed in substantial compliance with the conceptual plan attached; There will be no more than eight (8) units constructed on the site; If no building permit has been issued and no construction commenced within 3 years from the date of final zoning approval, the zoning shall revert to RM-1, Residential Multifamily District without further action by City Council. Zoning is presently RM-1. To the north, across Carvin Street, N.E. the zoning is RM-2, Residential Multifamily. To the east, south and west of the subject site the zoning is RM-1. Land use is presently undeveloped residential multifamily. To the north, a mix of single family and multifamily uses occur. To the east is vacant single family use. To the south and west of the site are large tracts with single family use. The tract to the south also contains miscellaneous storage buildings related to the single family use. Utilities are available to the site. A sanitary sewer easement crosses the site but is not affected by the proposed development. Storm water detention can easily be handled on the site. Traffic impact is projected to be minimal. Trip generations, as estimated by the traffic engineer will be approximately 50 average daily trips. Neighborhood organization, the Wildwood Civic League, has been notified of the requested rezoning. No objection has been received by the office as of the date of this report. F. Comprehensive Plan recommends that: III. IV. A variety of housing choices in existing neighborhoods be provided through a balance of new construction, rehabilitation and preservation. Quality construction and attractive design be encouraged. Alternatives: A. City Council approve the rezoning request. Zonin~ becomes RM-2 and a single 8-unit apartment building can be constructed. Land use becomes multifamily residential. Utilities have capacity and can be easily accessed. 4. Traffic impact is minimal. Neighborhood organization has offered no comments as of this writing. 6. Comprehensive Plan would be followed. B. City Council deny the rezoning request. 1. Zonin~ remains RM-1. Land use would be limited to permitted RM-1 uses. 3. Utilities would not be affected. 4. Traffic would not be affected. Neighborhood organization would not be affected. 6. Comprehensive Plan could be followed. Recommendation: By a vote of 7-0, the Planning Commission recommended approval of the rezoning. Given the size of the parcel and the proposed development plan the neighborhood would realize the benefit of improvement to a vacant parcel and the intent of the comprehensive plan would be followed. THEREFORE, BE IT ORDAINED by the Council of the City of Roanoke that §36.1-3, Code of the City of Roanoke (1979), as amended, and Sheet No. 711 of the Sectional 1976 Zone Map, City of Roanoke, be amended in the following particular and no other: Property described as a tract of land containing 1.878 acres located on Mexico Way, N. E., approximately 250 feet from the inter- section of Mexico Way and Orange Avenue, N. E., designated on Sheet No. 711 of the Sectional 1976 Zone Map, City of Roanoke, as a portion of Official Tax No. 7110105 be, and is hereby rezoned from RS-3, Residential Single Family District, to C-2, General Commercial District, subject to those conditions proffered by and set forth in the Amended Petition to Rezone filed with the City Clerk on September 8, 1989, and that Sheet No. 711 of the Zone Map be changed in this respect. ATTEST: City Clerk. Roanoke Cily Planning Commission October 9, 1989 The Honorable Noel C. Taylor, Mayor and Members of City Council Roanoke, Virginia Dear Members of Council: Subject: Request from Joel J. Ewen, represented by James F. Douthat, Attorney, that 1.878 portion of Official Tax No. 7110105, located on Mexico Way, N.E., approximately 250 feet from the intersection of Mexico Way and Orange Avenue, N.E., be rezoned from RS-3, Residential Single Family District to C-2, General Commercial District, such rezoning to be subject to certain conditions proffered by the petitioner. Background: ae Purpose of the rezoning is to permit the construction of a sales and gas filling and distribution business. Petition to rezone was filed on August 1989. The petition is subject to the following conditions: 16, The existing access road, Mexico Way, will be extended to serve the property to be rezoned in compliance with the width, paving, curb and gutter standards of the City of Roanoke. Ail utilities serving the property to be rezoned will be underground. 355 Municipal Building 215 Church Avenue, S.'gX P4:~noke, Virginia 24011 (703) 981-2344 Ce The property to be rezoned will be developed, landscaped and improvements constructed thereon in compliance with the site plan attached hereto as Exhibit E subject to the requirements of or further agreement with the City of Roanoke. Other than the storage tanks shown on the attached site plan (Exhibit E), there will be no outside storage of materials. Portion (3.6445 acres) of the subject property was rezoned from RS-3 to C-2 in October, 1985. The currently proposed rezoning is consistent with the petitioner's conceptual development plan which calls for the front portion of the entire tract to be developed commercially. Petitioner's attorney has been advised that a proper subdivision plat must be approved and recorded. Planning Coz~ission public hearing was held on September 6, 1989. Mr. James Douthat, attorney, appeared before the Commission and summarized the request for rezoning. Mr. Douthat noted that Mr. Ewen had presented plans to the Commission in the past calling for the front portion of the property to be used for commercial use. In response to a comment from Mr. Marlles, Mr. Douthat agreed to proffer that if no building permit or construction was commenced within three years of approval of the rezoning, the property would revert to RS-2 without further action by City Council. Amended petition to rezone was filed on September 8, 1989. The amended petition includes the following additional proffer: "If no building permit is issued or no construction commenced within three years of the effective date of the ordinance rezoning the property, the zoning designation will revert to RS-2 Single Family Residential District, without further action of City Council." II. III. Issues: Zonin9 is presently RS-3. Zoning to the north, south and east is also RS-3. Zoning to the west is C-2. Zoning to the west across Route 460 is a mixture of C-2 and LM. Land use of the property is vacant. Petitioner's residence is to the east of the property requested for rezoning. Several churches are located to the west as well as a few scattered residences off Route 460. Residences abut the far rear of the 78 acre tract. Utilities are available. Storm water retention can be accommodated on site. Transportation and access would be provided from an existing access road, Mexico Way, to Route 460 which is a signalized intersection. Neighborhoods are fairly removed from the area requested for rezoning. Residences abut the rear of the large 78 acre parcel and would require buffering if the tract is ever developed for any non-residential use. Fe Comprehensive Plan recommends discouraging new strip commercial areas along major roads or highways and the use of landscaping and buffering to minimize visual conflicts between residential and commercial uses. Alternatives: A. City Council approve the rezoning request. Zonin9 becomes C-2 consistent with the adjacent parcels. Land use as proposed is compatible with existing development. Proposed deed restrictions (attached) will help ensure a quality development. 3. Utilities are available. Transportation and access can be accommodated. The intersection with Route 460 is signalized. 5. Neighborhoods not affected. 6. Comprehensive Plan would be followed. IV. B. City Council deny the rezoning. 1. Zoning remains RS-3. 2. Land use restricted to residential. 3. Utilities not affected. e Transportation and access would not be an issue. Comprehensive Plan could still be followed. Recommendation: By a vote of 7-0, the Planning Commission recommended approval of the requested rezoning, subject to the submittal, approval and recordation of a proper subdivision plat. The proposed rezoning is consistent with the petitioner's conceptual development plan for the entire tract and the existing zoning pattern in the immediate area. Proposed deed restrictions will help ensure a quality development Respectfully submitted, Michael M. Waldvogel, Chairman Roanoke City Planning Commission JRM:mpf attachments cc: Assistant City Attorney Director of Public Works City Engineer Building Commissioner/Zoning Administrator Petitioner's attorney IN RE: IN THE COUNCIL FOR THE CITY OF ROANOKE, ~IRGINIA Rezoning of a 1.878 acre tract of land fronting on Mexico Way 250 + feet from the inter- section ~f Mexico Way and Orange Avenue (U.S. Route 460 East) from RS-3 Single Family Residential District to C-2 General Commercial District subject to certain conditions.
