NOTICE OF PUBLIC HEARING
TO CITIZENS OF THE CITY OF ROANOKE:
NOTICE IS HEREBY GIVEN that the Council of the City of
Roanoke will, pursuant to ~15.1-835, Code of Virginia (1950),
as amended, hold a public hearing on Monday, October 23, 1989,
at 2:00 p.m., in the Council Chambers, Municipal Building, in
said City, at which time citizens of the City of Roanoke shall
have an opportunity to be heard to determine if such citizens
desire Council to request the General Assembly of Virginia to
make certain amendments to the Roanoke Charter of 1952, as
amended, which amendments are informatively summarized as fol-
lows:
Amend and reenact $40, Contracts for public improve-
ments; purchases, to provide that any purchase, public
work, or improvement, costing more than fifteen thou-
sand dollars (increased from ten thousand dollars) shall
be executed by contract and to provide further that all
contracts for more than fifteen thousand dollars (increa-
sed from ten thousand dollars) shall be awarded after
public advertisement and competition in accordance with
general law.

As the result of official action at its meeting of October 17, 1989, the
School Board respectfully requests City Council to appropriate funds to the
following school accounts:

Grant No. 6574- $1,000.00 for the Child Development Clinic program to
provide equipment. The program will be one hundred
percent reimbursed by state funds.
Grant No. 6575- $1,000.00 for the Child Specialty Services program to
provide equipment. The program will be one hundred
percent reimbursed by state funds.
Grant No. 6576- $1,200.00 for the Juvenile Detention Home program to
provide equipment and supplies. The program will be
one hundred percent reimbursed by state funds.
Grant No. 6813- $25,000.00 for the Artist in Education program to
provide for the enhancement of the district's arts
program by bringing experts into the schools for
student workshops. The program will be reimbursed
in the amount of $10,000 by federal funds with a local
match of $15,000.
Grant No. 6956-
$21,340.00 for the High Risk Youth Substance Abuse
Prevention and Education program to provide for the
training and evaluation of staff members to aid in the
identification of high risk youth. The program will be
reimbursed in the amount of $10,669 by federal funds
with a local match of $10,671.

Refugee Resettlement Program is funded by the Federal Government
to provide assistance to households who qualify under Federal

C. Local Social Services is reimbursed at 100% of cost for funds
allotted to families.
II. CURRENT SITUATION

Roanoke City Social Services underestimated the number of refugee
families that would settle during Fiscal Year 1989-90 in the City,
now estimated to be seven.
B. Projection was based on number of families served the previous
fiscal year, which was one.

Refugee resettlement has increased and $22,400 additional funds is
needed to provide services to approximately seven families at
approximately $400 per month per family.

A. City of Roanoke receives funds from the United States Department of
Agriculture (USDA), through the Virginia Department of Corrections to
enhance the food service program of the Crisis Intervention Center
(Sanctuary), Juvenile Probation House (Youth Haven), and Juvenile
Detention Home.
II. CURRENT SITUATION
USDA funds for the Fourth Quarter of Fiscal 1989 and the First
Quarter of Fiscal 1990 have been received by the City of Roanoke for
the faci.lities, as follows:

Agriculture, is hereby ACCEPTED.
2. The City Manager or his designee and the City Clerk are
hereby authorized, for and on behalf of the City, to execute and
attest, respectively, a contract with Cost Containment, Inc., for
the services listed above, at an annual cost of approximately
$32,000.00, upon such terms and conditions as more fully set out
in the report to this Council dated October 23, 1989.
3. The form of the contract with such bidder shall be
approved by the City Attorney.

over-the-counter issuance of Food Stamps and mail issuance of
Food Stamps.
B. This contract expires October 31~ 1989.

of similar services for Food Stamp Issuance.
Only one bid was received, publicly opened and read in the office of

Accountability - The contract will hold Cost Containment~ Inc.
responsible for requisition, inventory, controlling, and
distribution of Food Stamps in manner spelled out in contract.
2. Compliance with Specifications - The bid response from Cost
Containment, Inc., meets all City requirements.
3. Cost - No increase from previous year.

4,275 transactions at .55 per transaction = $28,000 plus

service without interruption.

AN ORDINANCE accepting the bid of Mine Safety Appliance Company
made to the City for furnishing and delivering Breathing Air
Cylinders; rejecting all other bids made to the City; and providing
for an emergency.
BE IT ORDAINED by the Council of the City of Roanoke that:
1. The bid of Mine Safety Appliance Company, made to the City,
offering to supply 130 new Breathing Air Cylinders, meeting all of the
City's specifications and requirements therefor, for the total bid
price of $36,915.00, which bid is on file in the Office of the City
Clerk, be and is hereby ACCEPTED.
2. The City's Manager of General Services is hereby authorized
and directed to issue the requisite purchase order therefor, incor-
porating into said order the City's specifications, the terms of said
bidder's proposal and the terms and provisions of this ordinance.
S. Any and all other bids made to the City for the aforesaid
system are hereby REJECTED, and the City Clerk is directed to notify
each such bidder and to express to each the City's appreciation for
such bid.
4. In order to provide for the usual daily operation of the
municipal government, an emergency is deemed to exist, and this ordi-
nance shall be in full force and effect upon its passage.

Subject: Bids for Breathing Air Cylinders
Bid Number 88-9-28
I. Background
State of Virginia, Fire Programs Fund, is distributed
to localities in the Commonwealth of Virginia, for the
purpose of procuring additional fire safety equipment
and training.
Existing Breathing Air Cylinders are in old, poor
condition, and much heavier than new cylinders. The
additional weight contributes to faster fatigue for
firefighters.
Bid specifications for the breathing air cylinders was
developed and specifically sent to eight (8) vendors.
A public advertisement was also published in the
Roanoke Times and World News on September 15, 1989.
Bids were received, after due and proper advertisement
and were opened and read in the Office of the Manager
of General Services, at 2:00 p.m. on September 26,
1989.
II. Current Situation
A. Five (5) bid responses were received. Bid tabulation
is attached.
Ail bids received were evaluated in a consistent manner
by representatives of the Fire Department and General
Services.
The lowest bid, submitted by Mine Safety Appliance,
meets all specification requirements.

Accept the lowest responsible bid for 130 new Breathing
Air Cylinders as submitted by Mine Safety Appliance for

130 steel, Breathing Air Cylinders used in the
fire service.
Compliance with specifications - the low bid from
Mine Safety Appliance meets all required specifi-
cations.
Fund availability - state funds are available in
account number 035-050-3217-2035 to provide for
this purchase.
B. Reject all bids
Need - the replacement of necessary breathing air
cylinders would not be accomplished in the most
effective and efficient manner.
Compliance with specifications - would not be a
factor in this alternative.
Fund availability - state funds provided for this
purpose would not be expended.

Eleven projects within the Capital Improvement Program (CIP)
have been completed since the end of Fiscal Year 1988-89.
These balances may now be deappropriated. A total of
$310,614 in excess appropriations should be transferred by
budget ordinance to the Capital Improvement Reserve accounts
and used as a funding source for the new five (5) year
Capital Improvement Program.

Appropriation of Program Income Received from Roanoke
Redevelopment and Housing Authority, Greater Roanoke
Transit Company, and Other Miscellaneous Program Income
Program Income From RRHA
By agreement with the City of Roanoke, the Roanoke
Redevelopment and Housing Authority administers a large segment of
the City's Community Development Block Grant Program. The Housing
Authority receives program income during the course of its
administration of various projects by renting properties, by
receiving rehabilitation loan repayments from project area
residents, and by receiving repayments of loan loss reserve funds
as housing loans are repaid. The Housing Authority is required to
transfer this program income to the City of Roanoke. The City of
Roanoke is required to
use the income for a community development
activity.
The Housing Authority has made payment to the City in
the amount of $40,856 through June 30, 1989, for the following
categories of program income:
$33,189 in parking lot rentals in the Downtown East
Project in excess of parking lot income previously
appropriated

$7,667 in rehabilitation loan repayments by project
residents in excess of amounts previously appropriated
Program Income From GRTC
The Greater Roanoke Transit Company manages the daily
operation of the Williamson Road Parking Garage. A portion of the
annual net income of the Williamson Road Parking Garage is
considered program income as a result of UDAG funding provided to
construct the garage. The Transit Company transfers these funds
to the City. The City of Roanoke is required by grant agreement
to use these funds for housing rehabilitation.
The amount of program income for the year ending
June 30, 1989, is $7,175.
Miscellaneous Program Income
The City has received

of amounts previously appropriated
$2,876 in CDBG loan repayments from the Northwest
Neighborhood Environmental Organization (NNEO) in excess
of amounts previously appropriated
$563 in CDBG loan repayments from Chemical and Paper
Services in excess of amounts previously appropriated

I recommend that City Council appropriate the total of
$51,916 in program income received from the Housing Authority and
other sources as follows:
$33,189 to account 035-088-8840-5183, Unprogrammed CDBG
- Parking Lot Income. This amount will be available for
future appropriation transfers for a community
development purpose; and
$7,667 to account 035-088-8840-5180, Unprogrammed CDBG -
Rehabilitation Loans. This amount will be available for
future appropriation transfers for a community
development purpose; and
$3,885 to account 035-088-8840-5186, Unprogrammed CDBG -
Other Loan Repayments. This amount will be available
for future appropriation transfers for a community
development purpose; and

AN ORDINANCE to amend $36.1-3, Code of the City of Roanoke (1979),
as amended, and Sheet No. 332, Sectional 1976 Zone Map, City of
Roanoke, to rezone certain property within the City, subject to cer-
tain conditions proffered by the applicant.
WHEREAS, application has been made to the Council of the City of
Roanoke to have the hereinafter described property rezoned from RM-1,
Residential Multi-Family, Low Density District, to RM-2, Residential
~ulti-Family, Medium Density District, subject to certain conditions
proffered by the applicant; and
WHEREAS, the City Planning Commission, which after giving proper
notice to all concerned as required by $36.1-693, Code of the City of
Roanoke (1979), as ~mended, and after conducting a public hearing on
the matter, has made its recommendation to Council; and
WHEREAS, a public hearing was held by City Council on said appli-

Background:
Purpose of the rezoning request is to permit
the construction of an 8-unit apartment
building.
B. Petition to rezone was filed on August 16,
1989.
Planning Commission public hearing was held
on Wednesday, September 6, 1989. Mr. W. H.
Fralin, attorney, appeared before the
Commission and stated that the proposed
rezoning was being sought to permit the
construction of an eight unit apartment
building and that the site plan was being
proffered as part of the request. Mrs. Goode
asked if eight units were being proffered and
Mr. Fralin responded that the petitioner
would amend his request so that eight units
would become a proffered condition.
Amended petition to rezone was filed on
September 13, 1989. The conditions proffered
by the petitioner are as follows:

Zoning is presently RM-1. To the north,
across Carvin Street, N.E. the zoning is
RM-2, Residential Multifamily. To the east,
south and west of the subject site the zoning
is RM-1.
Land use is presently undeveloped residential
multifamily. To the north, a mix of single
family and multifamily uses occur. To the
east is vacant single family use. To the
south and west of the site are large tracts
with single family use. The tract to the
south also contains miscellaneous storage
buildings related to the single family use.
Utilities are available to the site. A
sanitary sewer easement crosses the site but
is not affected by the proposed development.
Storm water detention can easily be handled
on the site.
Traffic impact is projected to be minimal.
Trip generations, as estimated by the traffic
engineer will be approximately 50 average
daily trips.
Neighborhood organization, the Wildwood Civic
League, has been notified of the requested
rezoning. No objection has been received by
the office as of the date of this report.

AN ORDINANCE to amend 936.1-3, Code of the City of Roanoke (1979),
as amended, and Sheet No. 711, Sectional 1976 Zone Map, City of
Roanoke, to rezone certain property within the City, subject to cer-
tain conditions proffered by the applicant.
WHEREAS, application has been made to the Council of the City of
Roanoke to have the hereinafter described property rezoned from RS-3,
Residential Single Family District, to C-2, General Commercial
District, subject to certain conditions proffered by the applicant;
and
WHEREAS, the City Planning Commission, which after giving proper
notice to all concerned as required by ~36.1-693, Code of the City of
Roanoke (1979), as amended, and after conducting a public hearing on
the matter, has made its recommendation to Council; and
WHEREAS, a public hearing was held by City Council on said appli-
cation at its meeting on October 9, 1989, after due and timely notice
thereof as required by 936.1-693, Code of the City of Roanoke (1979),
as amended, at which hearing all parties in interest and citizens were
given an opportunity to be heard, both for and against the proposed
rezoning; and
WHEREAS, this Council, after considering the aforesaid applica-
tion, the recommendation made to the Council by the Planning Commis-
sion, the City's Comprehensive Plan, and the matters presented at
the public hearing, is of the opinion that the hereinafter described
property should be rezoned as herein provided.
THEREFORE, BE IT ORDAINED by the Council of the City of Roanoke
that §36.1-3, Code of the City of Roanoke (1979), as amended, and
Sheet No. 711 of the Sectional 1976 Zone Map, City of Roanoke, be
amended in the following particular and no other:
Property described as a tract of land containing 1.878 acres
located on Mexico Way, N. E., approximately 250 feet from the inter-
section of Mexico Way and Orange Avenue, N. E., designated on Sheet

Petition to rezone was filed on August
1989. The petition is subject to the

constructed thereon in compliance with
the site plan attached hereto as Exhibit

Other than the storage tanks shown on
the attached site plan (Exhibit E),
there will be no outside storage of
materials.
Portion (3.6445 acres) of the subject
property was rezoned from RS-3 to C-2 in
October, 1985. The currently proposed
rezoning is consistent with the petitioner's
conceptual development plan which calls for
the front portion of the entire tract to be
developed commercially.
Petitioner's attorney has been advised that a
proper subdivision plat must be approved and
recorded.
Planning Coz~ission public hearing was held
on September 6, 1989. Mr. James Douthat,
attorney, appeared before the Commission and
summarized the request for rezoning. Mr.
Douthat noted that Mr. Ewen had presented
plans to the Commission in the past calling
for the front portion of the property to be
used for commercial use. In response to a
comment from Mr. Marlles, Mr. Douthat agreed
to proffer that if no building permit or
construction was commenced within three years
of approval of the rezoning, the property
would revert to RS-2 without further action
by City Council.
Amended petition to rezone was filed on
September 8, 1989. The amended petition
includes the following additional proffer:
"If no building permit is issued or no
construction commenced within three years of
the effective date of the ordinance rezoning
the property, the zoning designation will
revert to RS-2 Single Family Residential
District, without further action of City
Council."

Issues:
Zonin9 is presently RS-3. Zoning to the
north, south and east is also RS-3. Zoning
to the west is C-2. Zoning to the west
across Route 460 is a mixture of C-2 and LM.
Land use of the property is vacant.
Petitioner's residence is to the east of the
property requested for rezoning. Several
churches are located to the west as well as a
few scattered residences off Route 460.
Residences abut the far rear of the 78 acre
tract.
Utilities are available. Storm water
retention can be accommodated on site.
Transportation and access would be provided
from an existing access road, Mexico Way, to
Route 460 which is a signalized intersection.
Neighborhoods are fairly removed from the
area requested for rezoning. Residences abut
the rear of the large 78 acre parcel and
would require buffering if the tract is ever
developed for any non-residential use.

Comprehensive Plan recommends discouraging
new strip commercial areas along major roads
or highways and the use of landscaping and
buffering to minimize visual conflicts
between residential and commercial uses.
Alternatives:
A. City Council approve the rezoning request.
Zonin9 becomes C-2 consistent with the
adjacent parcels.
Land use as proposed is compatible with
existing development. Proposed deed
restrictions (attached) will help ensure
a quality development.
3. Utilities are available.

accommodated. The intersection with

and the existing zoning pattern in the immediate
area. Proposed deed restrictions will help ensure

MAYOR AND MEMBERS OF THE COUNCIL OF THE
Joel J. Ewen, owns a tract of land located
containing 1.878 acres (the Property) which
in
is a portion of a larger tract containing 73.91 + acres -
designated on Roanoke City Appraisal Map as Official Tax No.
7110105. The Property, which is to be designated as Rancho
Mexico Lot B1, is currently zoned RS-2 Single Family Residential
District and is more particularly described on the plat attached
hereto as Exhibit A and the legal description attached hereto as
Exhibit B. A copy of Roanoke Appraisal Map No. 711 and a map
indicating the general location of the Property are attached
hereto as Exhibits C and D respectively.
2. Petitioner, David H. Luther, has entered
to purchase the Property for the construction and
sales and gas filling and distribution business for Industrial
Gas and Supply Company.
3. Pursuant to Articles VII and VIII of Chapter 36 Code of
The City of Roanoke (1979), as amended, the petitioners request
that the 1.878 acre tract, Rancho Mexico Lot B1, be rezoned from
into a contract
location of a

RS-3 single family residential family district to C-2 general
commercial district subject to certain conditions as set forth
below.
4. The petitioners believe the rezoning of the Property
will further the intent and purpose of the City Zoning Ordinance
and its comprehensive plan in that it will cause the zoning
classification of the Property to be compatible with that of
adjacent property, will allow the Property to be a portion of the
existing Rancho Mexico Commercial Development and, as such,
contribute to an increase of the tax base, offer additional -
employment opportunities, improve the business environment and
foster the economic growth of the City of Roanoke.
5. The petitioners hereby Droffer and agree that if the
Property is rezoned
the following
as requested, the rezoning will be subject to
conditions:
a. The existing access road, Mexico Way, will be
extended to serve the property to be rezoned in compliance with
the width, paving, curb and gutter standards of the City of
Roanoke.
b. All utilities serving the property to be rezoned
will be underground.
c. The property to be rezoned will be developed,
landscaped and improvements constructed thereon in compliance
with the site plan attached hereto as Exhibit E subject to the
requirements of or further agreement with the City of Roanoke.

TO WHOM IT MAY CONCERN:
Pursuant to the provisions of Article VII of Chapter 36.1
Code of the City of Roanoke (1979), as amended, the Council of
the City of Roanoke will hold a Public Hearing on Monday, October
9, 1989, at 7:30 p.m., in the Council Chamber in the Municipal
Building, 215 Church Avenue, S. W., in the said city, on the
question of rezoning from RS-B, Residential Single Family
District, to C-R, General Commercial District, the following pro-
perty:
A tract of land containing 1.878 acres and being a
portion of Official Tax No. 7110105, located on Mexico
Way, N. E., approximately 250 feet from the intersec-
tion of Mexico Way and Orange Avenue, N. E.
This rezoning is to be subject to certain conditions prof-
fered by the petitioner. A copy of this proposal is available

TO THE HONORABLE MAYOR AND MEMBERS OF THE COUNCIL OF THE
CITY OF ROANOKE:
1. Petitioner, Joel J. Ewen, owns a tract of land located in
the City of Roanoke containing 1.878 acres (the Property) which
is a portion of a larger tract containing 73.91 + acres
designated on Roanoke City Appraisal Map as Official Tax No.
7110105. The Property, which is to be designated as Rancho
Mexico Lot B1, is currently zoned RS-~ Single Family Residential
District and is more particularly described on the plat attached
hereto as Exhibit A and the legal description attached hereto as
Exhibit B. A copy of Roanoke Appraisal Map No. 711 and a map
indicating the general location of the Property are attached
hereto as Exhibits C and D respectively.
2. Petitioner, David H. Luther, has entered into a contract
to purchase the Property for the construction and location of a
sales and gas filling and distribution business for Industrial
Gas and Supply Company.
3. Pursuant to Articles VII and VIII of Chapter 36 Code of
The City of Roanoke (1979), as amended, the petitioners request
that the 1.878 acre tract, Rancho Mexico Lot B1, be rezoned from

RS-3 single family residential family district to C-2 general
commercial district subject to certain conditions as set forth
below.
4. The petitioners believe the rezoning of the Property
will further the intent and purpose of the City Zoning Ordinance
and its comprehensive plan in that it will cause the zoning
classification of the Property to be compatible with that of
adjacent property, will allow the Property to be a portion of the
existing Rancho Mexico Commercial Development and, as such,
contribute to an increase of the tax base, offer additional
employment opportunities, improve the business environment and
foster the economic growth of the City of Roanoke.
5. The petitioners hereby proffer and agree that if the
Property is rezoned as requested, the rezoning will be subject to
the following conditions:
a. The existing access road, Mexico Way, will be
extended to serve the property to be rezoned in compliance with
the width, paving, curb and gutter standards of the City of
Roanoke.
b. All utilities serving the property to be rezoned
will be underground.
c. The property to be rezoned will be developed,
landscaped and improvements constructed thereon in compliance
with the site plan attached hereto as Exhibit E subject to the
requirements of or further agreement with the City of Roanoke.
