1989 CITIZEN OF THE YEAR
ON BEHALF OF THE MEMBERS OF CITY COUNCIL, OUR ADMINISTRATIVE
OFFICIALS, AND MORE THAN 100,000 CITIZENS OF THE CITY OF ROANOKE, I
HAVE THE GREAT PLEASURE OF INTRODUCING TO YOU THIS EVENING ROANOKE'S
1989 CITIZEN OF THE YEAR.
OUR HONOREE IS NOT AN EIGHT TO FIVE WORKING INDIVIDUAL. HE IS A
TWENTY-FOUR HOUR A DAY MAN. HIS COMPASSION FOR PEOPLE, HIS SKILL IN

TO FAMILIES WITH LIMITED INCOME. UNDER HIS VERY ABLE LEADERSHIP, THE
CENTER HAS BECOME A VISIBLE AND EFFECTIVE ORGANIZATION WITHIN OUR
COMMUNITY. THE PRIMARY PURPOSE OF THE PRESBYTERIAN CENTER IS TO MEET
THE HUMAN BASIC NEEDS OF FOOD, CLOTHING AND SHELTER, SHELTER IN THE
FORM OF FUNDS AVAILABLE FOR RENT AND UTILITIES. WITH CAREFUL
SCREENING OF CLIENTS BY THE STAFF AT THE CENTER, FOOD, CLOTHING AND
FUNDS ARE MADE AVAILABLE FOR DISTRIBUTION THROUGH DONATIONS FROM
CHURCHES, INDIVIDUALS AND ROANOKE AREA MINISTRIES. GOVERNMENT FUNDS

Dear Mrs. Bowles & Gentlemen:
I have learned several things from watching our local
representatives in the Virginia General Assembly over this current
session.
One thing I have learned is the difference between
sponsoring legislation and merely presenting legislation at the
request of someone else. To "sponsor" a bill means that the
representative is placing the measure on the docket for considera-
tion with the representative's full endorsement. Alternatively,
submitting legislation "by request" does not necessarily indicate
the representative's own support, but merely acknowledges a courte-
sy shown to someone else who requested that the legislator submit
the bill for consideration by everyone.
This distinction came to mind this week as I witnessed
the School Superintendent and the Roanoke City School Board play
politics, once again, with our school teachers, the school budget
and our taxpayers. It is unfortunate that the Superintendent
and the Board are merely setting up another showdown with Roanoke
City Council. The board seems set on confrontation, and I am
afraid that the members of City Council who elected this school
board have only themselves to blame for this lack of cooperation
on budgetary matters.
At any rate, since the Superintendent and the School
Board have requested a $2.1 million increase over the expected
budget, notwithstanding a $3.0 million increase already alloted
to them, I intend now to submit their proposal for $2.1 million
additional taxpayers' money "by request" to the budget study
session of the upcoming Roanoke City Council in late April.
This request for an additional $2.1 million is, in my estimation,
at least an additional twenty-one cents on the property tax rate,
thus increasing the rate from $1.25 to at least $1.46 per hundred
dollars of assessed value.
Now, the Superintendent and the School Board should

know that they, too, must adhere to budgetary restraints. We
need a City government that is willing to live within its means,
and we need to come to the realization that our taxpayers'
pockets are not limitless. "Tax and spend" policies, must some-
time yield to prudence. If the schools "request" additional
tax money, they should know of the cost of raising it.
Accordingly, this letter shall serve as notice to
the members of council and our citizens that I hereby submit
"by request" of our Superintendent and school board that the
Council consider at budget study a 21¢ increase in the property
tax rate in order to satisfy the school department's insatiable
hunger.
Since I am not a "sponsor" of this proposal, but
merely placing it on the docket "by request," I reserve the right
to raise questions about it and to deem it flagrantly political
and imprudent as the case may be.
I ask that this letter be placed on the consent agenda
for our regular meeting to be held on March 12, 1990, and there-
after to be referred to budget study.

Dear ~rs. Bowles and Gentlemen:
In my haste to meet the deadline for submitting items for the
Council Agenda on Thursday, I apparently miscalculated ia my
arithmetic regarding the tax increase requested by the School
Board.
The $2.1 million increase should equate to about 11¢ on the real
estate property tax rate, given the understanding that we had in
the previous years that a i¢ increase on the rate equalled about
$200,000.00.
I apologize for my miscalculation, but the impact of an 11~
increase up to $1.36 is still an overly extravagant request.
If my math had been better in school, ~ would have become
Director of Finance instead of a Lawyer.

Dear Mrs. Bowles and Gentlemen:
I am enclosing for your review a copy of the article printed in
the Roanoke Times & World News on Wednesday morning, March 7,
1990, regarding alleged abuses in bingo operations here in the
City of Roanoke.
As you know, the Commonwealth of Virginia authorized bingo by
certain eleemosynary organizations such as the American Legion,
church groups, the SPCA, etc. We, the public officials of the
City, have an obligation to assure that persons playing and
enjoying bingo here in the City shall know that their funds are
being transmitted to a charitable cause. Our law will allow for
nothing else.
I believe the issues raised in the newspaper account warrant some
probe by the Municipal Auditor regarding the City's compliance
with the State law, and proper procedures for licensing and
collecting these funds. For instance, at one location in the
article, it is indicated that one of the alleged parties grossed
$150,000.00 just last year. If this is the case, then certainly
the City has an obligation to know that the funds are being pro-
perly addressed for charitable reasons, and that all proper City
taxes and licenses have been paid.
Accordingly, as Chairman of the Audit Committee of the City
Council, I am asking your permission and consent to refer this
matter to Bill Brogan, the Municipal Auditor, for his review,
investigation and recommendations back to Council as soon as
possible.
I need to advise Roanoke City Council and the community that I,
myself, am a volunteer worker for the Knights of Columbus Bingo
at St. Elias Hall, and a registered member of St. Andrews Church,
whose name has been associated, (apparently illegally and in an
unauthorized way), with at least one bingo operation. I would
ask that the City Attorney advise me, in writing, whether my
involvement with the Knights of Columbus, or St. Andrews, renders
a potential conflict of interest for me to participate in any
further action on this matter. If so, then I will appoint a spe-
cial subcommittee of the Audit Committee to handle any further
investigation and decision making regarding it, and would take no
further action myself.

Re: State and Local Government Conflict of Interests Act
Dear Mr. Bowers:
By letter of March 12, 1990, you have requested my opinion as to
whether you would have any conflict of interests in presiding over the
Audlt Committee of Clty Councll if such Committee conducts a review of
bingo operations regulated by the City. As you know, the Common-
wealth's Attorney is responsible for the enforcement of provisions of
the State and Local Government Conflict of Interests Act as well as
the prosecution of any violations relating to City officers or
employees. Section 2.1-639.23.B., Code of Vtrglnla (1950), as
amended. Furthermore, the Commonwealth's Attorney is also charged
with responsibility of rendering advisory oplntons as to whether the
facts of a particular case would constitute a violation of the Act.
Section 2.1-639.23.B. Notwithstanding, I am pleased to provide you
with this informal optnlon for your guldance in thls matter. A copy
of this opinion ts belng provided to the Commonwealth's Attorney for
his review and determination as to whether any further action upon
this matter is w~rranted.

May you, as Chalrm~n of the Audit Committee, preside over a review
by such Commtttee of blngo operations regulated by the City when you
volunteer your services for the conduct of bingo games sponsored by

According to an article appearing in the Roanoke Time8 & World News
on Wednesday, March 7, 1990, two persons have been charged with run-
ning illegal bingo games allegedly on behalf of charity In the City.
According to the same article, one of the persons is alleged to have
conducted bingo games in the name of St. Andrews Youth Group,
apparently~tthout permission from the Church.
In your letter of March 12, 1990, you recommended that the Audit
Committee, which you chair, conduct a review of bingo operations in
the City to determine whether City ordinances are being complied with;
to determine whether all proper City licensee are being obtained; and
to determine whether the proceeds of bingo operations are actually
being used to support the charities in whose names bingo operations
are being conducted. You also noted in your letter that you are a
volunteer worker at bingo games conducted by the Knights of Columbus
at St. Elias Hall and that you are a member of St. Andrews Church.
DISCUSSION OF LAW
The State and Local Government Conflict of Interests Act (herein-
after sometimes the "Act") generally regulates three areas of conduct
of local government officers and employees. First, in Article 2
(SS2.1-639.3 through 2.1-839.4), it defines certain prohibited con-
duct, such as acceptance of bribes and kickbacks. Second, in Article
3 ($J2.1-639.5 through 2.1-639.9), it establishes certain prohibited
conduct regarding contracts with an officer or employee's own govern-
ment or a governmental agency which is a component part of his govern-
ment. Third, in Article 4 ($J2.1-639.10 through 2.1-639.11), it
prohibits certain conduct regarding transactions. The Act also
requires certain local government officers and employees to file
disclosure statements. See Article 5 ($$2.1-639.12 through
2.1-639.15).
The matter about whlch you have inquired has no reference to any
prohibited a~tm regulated by Article 2 of the Act. Furthermore, since
your inquiry h~m no reference to any contracts with the Clay Council
or any gover~ntal agency which is a component part of the City of
Roanoke, Article 3 of the Act would have no relevance. The issues you
have raised, therefore, must be analyzed pursuant to Article 4 of the
.Act relating to prohibited conduct regarding transactions.
Analysis of prohibited conduct relating to transactions requires
consideration of three definitions set forth in J2.1-639.2. This sec-
tion defines "personal interest in a transaction" as follows:
"...a personal lnterest of an officer or employee in any
matter considered by his agency. Such personal interest

exists ~hen an officer or employee or a member of his ~mme-
diets family has a personal interest in property or a busi-
ness, or represents any individual or business and such
property, business or represented individual or business
is the subject of the transaction or (ii) may realize a
reasonably foreseeable direct or indirect benefit or detri-
ment as a result of the action of the agency considering the
transa~ion.'
*'Transaction" is defined by the same section to mean:
"...a~y matter considered by any governmental or advisory
agency, whether in a co~mittee, subcommittee, or other entity
of that agency or before the agency itself, on which official
action is taken or contemplated."
Finally, S2.1-639.2 defines "personal interest" as follows:
"...a financial benefit or liability accruing to an officer
or employee or to a member of his ~a~ediate family. Such
interest shall exist by reason of (i) ownership in a business
if the ownership interest exceeds three percent of the total
equity of the business; (ii) annual income that exceeds, or
may reasonably be anticipated to exceed, $10,000 fro~
ownership in real or personal property or a business; (iii)
salary, other compensation, fringe benefits, or benefits from
the use of property, or any combination thereof, paid or pro-
vided by business that exceeds, or my reasonably be antici-
pated to exceed, $10,000 annually; (iv) ownership of real or
personal property if the interest exceeds $10,000 in value
end excluding ownership in a business, income or salary,
other compensation, fringe benefits or benefits from the use
of property; or (v) personal liability incurred or sssumed on
behalf of a business if the liability exceeds three percent
of the asset value of the business."
Given the broad definition of "transaction" set out in S2.1-639.2,
! a~ of the opinion that review by the Audit Co~tttee of compliance
of various or~nizations with the City's bingo ordinances and the
supervision o£ an audit to be conducted by the Municipal Auditor would
constitute a "transaction" as such ter~ ie defined by the Act. You do
not, however, have ownership in any organization, annual income or
salary from any organization or personal liability on behalf of any
organization which would be the subject of the Audit Co~ittee's
action nor do you have ownership of any real or personal property
which would be the subject of the Audit Co~s~tttee'e action. I also
note that you do not represent any individual or business which is the
subject of Audit Co~mittee review nor will you realize a reason-
ably foreseeable direct or indirect benefit or detriment as a result
of the Audit Committee's actions. Therefore, I conclude that you do

not have a "personal interest in a transaction" with respect to the
actions you have recommended that the Audit Committee take.
Under these circumstances, you may participate as Chairman of the
Audit Committee in the compliance review which you have described as
well as in superv~sion of the audit proposed to be conducted by the
Municipal Auditor.
Should,~he focus of any review, investigation or audit conducted
by or on behalf of the Audit Co~mittee become any organizat~on of
which you are a member, you may want to withdraw and refrain from par-
ticipation in such transaction regardless of whether permitted under
the State and Local 6overnment Conflict of Interests Act.

Architectural Review Board
On behalf of the Board, I wish to express our sincere
continuing interest in providing assistance to the City of
Roanoke and its citizens in renovation, rehabilitation and
identification of our historic resources and properties.
Throughout 1989 the Board observed increased renovation
efforts in the H-l, Market Historic District and in the H-2,
Neighborhood Preservation District. Applications for
Certificates of Appropriateness increased over fifty percent
in 1989. Even with increased responsibilities the Board was
delighted to see additional property investment. We were
encouraged by the accompanying increase in assessed property
values in downtown and Old Southwest. While a variety of
factors influenced property values, one contributing factor
was our historic district. The increase illustrates that
the City's commitment to preservation is beneficial, not
only in improving the quality of life in neighborhoods, but
also in strengthening the economic viability of our City.
The City of Roanoke must continue progressing in
historic preservation and economic revitalization. Towards
this end, it is essential that public education materials be
available to assist residents and property owners in
rehabilitation of older structures and in construction of
compatible new ones. A critical need for design guidelines
was indicated at two work sessions of the Architectural
Review Board in 1989. This year, the Office of Community
Planning is requesting $20,000 in supplemental budget
funding for the preparation of architectural guidelines. We
hope that you and the City Manager will recognize the value
and need for public education to meet our goals for the
future.

Subject: 1988-89 Annual Report - Youth Services
Citizen Board
The members of the Youth Services Citizen Board have
experienced transition of leadership, new members and
sickness among Board members and staff. However, we feel
that we still maintained a quality of excellence during
these times.
We are happy to present this 1988-89 Annual Report and
Annual Plan for program year 1989-90. This Board has been
very active in carrying out the mandated services of the
Department of Corrections and has been able to complete
special projects that have continued to have positive impact
on the quality of life of children, youth and their
families.
Funding for program year 1988-89 was basically at level
funding. However, with the network of volunteers, community
support and City administrative support, we were able to
complete our mandated objectives as well as special
activities and events.

The Office on Youth and Youth Advisory Committee have
carried out special projects which involved over 4,000 young
people and adults in various ways, including but not limited
to the following: speaking engagements, employment seminar/
workshops, youth employment package, recreation activities,
youth forum, educational information, surveys, tours, youth
employment package and wallet-size informational guides.
Highlights of the work performed by the Youth Services
Citizen Board's committees are as follows:
Communications Committee continued to provide and
promote educational opportunities for children, youth
and their families. This year the committee promoted
the first "Youth Weekend '89." The major focus of this
weekend included the teen dance on April 29, 1989,
(sponsored by the Office on Youth, Recreation
Department, Central Council of PTAs and other community
organizations). The young people purchased tickets
through their schools and the money collected from
ticket sales was donated to their schools and the
Roanoke Area Ministries. Approximately 350 young
people attended the dance and it was deemed successful
by its sponsors.
The Youth Forum was held on Sunday evening, April
30, 1989. The forum covered the following workshops:
Youth Employment; Teen and Adolescent Suicide; Race
Relationships; Drug and Alcohol Abuse; Youth and Crime;
po 3.
and Teen Pregnancy and Date Rape. Youth Advisory
Committee members served as co-leaders along with
community experts to conduct the various workshops.
Approximately 150 people attended the forum.
On May 1, 1989, Student Government Day was held.
This event gave high school seniors the opportunity to
run City government for the day. This event was deemed
one of the most successful events of the year.
Participation by City staff increased by 15%. It was
suggested that next year we should invite our local and
state representatives to participate as well and this
suggestion will be included in next year's plans.
Attendance at this event was approximately 180 people.
Recreation Committee met regularly during this
program year. The committee members visited the City's
recreation centers. Their tour was initiated in order
to give the staff feedback on youth activities within
the Centers. The Committee also has been involved in
working with the City staff on special events. A
Center survey was also conducted.
Employment Committee conducted its first Youth
Employment Seminar/Workshop with representatives from
area employers as well as interested young people and
continued the distribution of the Youth Employment
Packages. Both activities were successful.

Juvenile Justice Committee has been formed and is
composed of representatives from the social services
department, school system, detention home, youth bureau
and the crisis center. This broad base community
representation will encourage youth prevention and
coordination among agencies with the best interest of
youth and their families in mind.
Even in the midst of the hardships, we feel this Board
continues to serve in the best interest of children, youth
and their families within the community. With Council's and
the City Administration's continued support we know we can
have an impact on the delinquency rate.
We encourage City Council and the City administration
to seek our advice and to use us to the fullest extent
possible because we are here to serve.

$33,411.00 for the Eisenhower Math/Science Title II
program to provide for the development of math and
science curriculum related to the middle school. The
program will be reimbursed one hundred percent by
federal funds.
Grant No. 6959-
$8,011.00 for the 1990 Western Virginia Regional
Science Fair. School districts will contribute $6,411.00
toward the cost of the fair, with a local match of

Funding for the Fifth
District Employment and
Training Consortium
I. BACKGROUND
Funds are allocated annually for localizes in Virginia to administer
Ad---~Literacy Programs through a bid process with the State.
These funds are av~]mbla to publ~ schools and agenc~ms.
Total ActioAgeinst Poverty (TAP) submitted an application to
provide Adult IAteracy tzaining to all eight jurisdict~ns within the
Fifth Planning District.
The Department of Education approved funding for TAP to serve
Roanoke and Alleghany count[es, as well as the ~ms of Salem,
Covington, and Clifton Forge. The three school divisions of
Roanoke City, Craig, and Botetourt Countims, elected to serve their
own designated servi~e areas.
The Consortium has been awarded adH~mnal funds for the EconomJ~
Dislocation and Workers Adjustment Assistance Act (EDWAA) under
Title III in the amount of $15,000.00, for the period July 1, 1989
through June 30, 1990 to produce a customized video tape to market
the program to employers.
The Job Training Partnership Act (JTPA) le~la~on, ~]lmws the
Governor's Employment and Training Department (GETD) (primary
funding source for the Consortium), to reward Serv-h~e Delivery
Areas (SDA's) who meet or exceed their performance standards
under TJt]m II-A, for any given program year.
II. CURRENT SITUATION
Funding for the Adult Literacy Project is contingent upon the
Consortium agreeing to receive, administer, and contract the funds
to Total Action Against Poverty.
The Consortium has received no~M~a~on of the grant award from
the State Department of Education in the amount of $54f753.00 to
admirdmter an Adult L~eracy project, within cer~a~n jurisdictions of
the Fifth Planning District.
The GETD has sent to the Consoz~ium a Notice of Award, (NOA)
#E90-03~-0 in the amount of $15~000.00 for the Econom~ Disloca~n
and Workers Adjustment Assistance Act (EDWAA).

D. The GETD, the agency's funding source, has awarded the
Cons~ an incentive grant (NOA #90-03-02) of $60~944 for
meeting and exceeding Fiscal Year 1989 performance standards for
Title II-A. The agency's performance was as follows:
933 par~pants were served throughout the Fifth Planning
District
631 or 68% of those served were Roanoke City residents
802 of the 933 par~pants were terminated from the program,
~ 131 were carried into the new program year.
3. 498 paz~pants or 62% of those terminated were placed into
o-o-o-o-o-o-o-o-o--
379 or 76% of those placed were Roanoke City residents.
117 or 97% of all welfare recipJmnts placed were Roanoke City
residents.
4. The average wage at placement was $4.76 per hour.
An adjustment of previously received revenue under Titlm II-A
between admioJ~trative and program revenues is also required in the
amount of $12~013.00. Overall, revenue in this program will remain
the same.
The City of Roanoke is the grant recipient for Consortium funding.
City Council must appropriate the funding for all grants the
Consortium receives.

which would provide for law enforcement

statewide interdepartmental radio network.
November 15, 1989, Grant award/acceptance was
received from the Department of Criminal
Justice Services.
December 27, 1989, as required, an
appropriate Request for Funds was completed
and sent to the State. The original amount
requested was $75,54_?.00.
II. Current Situation:
January._17, 1990, a communication was
received notifying the City that the grant
was subject to a 2% statewide reduction. The
revised approved grant amount reduced to

public advertisement was also published in

Bids were received after due and proper
advertisement, until 2:00 P.M. on February
22, 1990, at which time all bids
appropriately received were publicly opened
and read in the Office of the Manager of
General Services.

abandonment of the old twenty (20) foot wide public utility
easement, approximately, one hundred eighty (180) feet in
length, and the dedication of a new public utility easement,
twenty (20) foot wide, approximately two hundred fifty (250)
feet in length (see attached map). Authority to take these
actions to be contingent upon the approval of a site develo-
pement plan by the appropriate City departments.

Dear Mr. Kizer:
This firm represents McDonalds Corporation and for purposes
of this matter, Zane May Operating Partners, LP a Delaware
Limited Partnership, which itself is the owner of Crossroads
Consumer Mall in Roanoke.
Crossroads has agreed to lease certain property to the
McDonalds Corporation for construction of a McDonalds Restaurant.
Unfortunately, the City of Roanoke holds a 20 foot utility
easement which bisects the parcel that is being leased to
McDonalds. In order for McDonalds to build the restaurant as
planned, the easement and the water line need to be relocated.
I have discussed this matter with Craig Sluss, and he has
reviewed the preliminary plats. I attach a copy of a utility
plat showing the relocation of the easement (that which we ask to
be vacated and that which we are willing to grant in replacement.
This is to request that this matter be placed on the next
Water Resources Committee agenda for its review and
recommendation and recommendation to Roanoke City Counsel. We
are in the process of preparing the easement relocation documents
(and will coordinate those so through the City Attorney's Office
so that they are in the proper form) and will provide a draft to
your office within the next week.

This Attachment forms a part of that certain Lease
Agreement by and between the City of Roanoke("Lessor") and
the Commonwealth of Virginia, by the Department of
Conservation and Historic Resources,("Lessee") dated the lS%
day of March , 1989. Lessor and Lessee agree to the
following terms, conditions, modifications, additions and/or
deletions:
1. Any property or equipment placed or stored in the
demised premises by Lessee shall be at the risk of the
Lessee. Nothing herein shall affect the Lessor's liability,
if any, for property damage caused by the negligence of its
officers, agents, or employees.
2. Lessee shall be responsible for damage to, or loss of,
real or personal property of Lessor caused by the negligence
of Lessee or its officers, agents or employees. At the
termination of this lease, Lessee shall deliver peacefully
the demised premises to Lessor.
3. Lessee shall comply with Lessor's requirements, including
means of access to the demised property and parking. It is
agreed that public access to the office space assigned to the
Lessee on the second floor (See Attachment 3) will be through
the front entrance of the building when the Recreation Center
is open to the public.
4. This lease shall not be assigned and the property or any
portion thereof shall not be sublet without Lessor's prior
written consent, which consent shall not be unreasonably
withheld.
5. Lessee agrees and consents that Lessor shall have the
right to enter the premises at all reasonable times for the
purpose of inspecting or making any repairs or routine
maintenance that Lessor may deem necessary or appropriate.
6. Lessee shall provide, at Lessee's expense, telephone and
supplemental heating and air conditioning.
7. With written approval of the City Manager, Lessee shall
have the option to renew this lease for an additional term of
one year upon such terms and conditions as may be mutually
agreed to by the parties.
8. The requirements of paragraph 4(A) of the Lease Agreement
do not apply. Lessor agrees that, when the Recreation Center
is open to the public{ the Center leader will notify Lessee's
employees on the premises of the arrival of physically
handicapped and aged individuals needing information or

assistance from the Lessee. Whenever required by Lessee to
meet the needs of physically handicapped individuals, Center
custodian will provide suitable meeting space on the main
flo6r-t~ the Recreation Center if such space is available.
Access for the handicapped during hours when the Recreation
Center is not open to the public will not be available and
other arrangements will be made by Lessee's employees.
9. Effective July 1, 1989, the leasing agency designated in
paragraph 3 shall transfer its powers and authority as Lessee
to the Department of Historic Resources, in order to permit
the continued use of the demised premises for the purpose and
use for which the same is leased.
