The Mayor presented a key to the City to Commander Richard S. Thomas in recognition of his service to the Roanoke Valley community. CONSENT AGENDA (Approved 7-0) ALL MATTERS LISTED UNDER THE CONSENT AGENDA ARE CONSIDERED TO BE ROUTINE BY THE CITY COUNCIL AND WILL BE ENACTED BY ONE MOTION IN THE FORM LISTED BELOW. RECOMMENDED ACTION: Dispense with the reading thereof and approve as recorded. A communication from Mayor Noel C. Taylor requesting an Executive Session to discuss personnel matters relating to (1) C-3 C-4 C-5 vacancies on various authorities, boards, commissions and com- mittees appointed by Council, pursuant to Section 2.1-344 (A) (1), Code of Virginia (1950), as amended. RECOMMENDED ACTION: Concur in request for Council to convene in Executive Session to discuss personnel mat- ters relating to vacancies on various authorities, boards, commissions and com- mittees appointed by Council, pursuant to Section 2.1-344 (A) (1), Code of Virginia (1950), as amended. A report of the City Manager requesting an Executive Session to discuss acquisition of an interest in real property and disposition of publicly held property, specifically possible acquisition of an interest in certain real property and the sub- sequent disposition thereof by conveyance, pursuant to Section 2.1-344 (A) (3), Code of Virginia (1950), as amended. McBride, Executive Director, City of Roanoke Redevelopment and Housing Authority, requesting that Council schedule and advertise a public hearing for Monday, June 11, 1990, on Amendment No. 3 to the Downtown East Redevelopment Plan, R-42 (CD-3), the impetus being develop- ment proposed by Norfolk and Western Railway Company for Disposition Parcel 2 located in the Downtown East Project Area. RECOMMENDED ACTION: Concur in request. (2) RB3ULAR AGENDA 3. Hearing of Citizens Upon Public Matters: Request of the Roanoke Valley Youth Soccer Club to address Council with regard to the status of the "Crestar Festival Soccer Tournament." Messrs. Petitions and Communications: A communication from the Roanoke City School Board with regard to the 1990 Virginia Public School Authority Bond Issue. Adopted Resolution No. 30049-52190. Items Recommended for Action: A report recommending waiver of rental, concession fees and rights for use of Victory Stadium by the Roanoke Special Events Committee for the Grand Opening Night of Festival-in-the-Park on Friday, May 25, 1990, and closing night activities on Sunday, June 3, 1990. Adopted Resolution No. 30052-52190. (7-0) A report recommending approval of insurance coverage to be provided by Festival-in-the-Park, Inc., with liabi- lity limits of $1,500,000.00 per occurrence and $250,000.00 per aggregate, in connection with the requested use of certain public streets and parks for Festival-in-the-Park, scheduled for May 24 June 3, 1990. Adopted Resolution No. 30053-52190. (?-0) (3) A report concurring in a report of a bid committee recommending that a contract be awarded to William Caruso and Associates, in the lump sum amount of $13,500.00, to provide consultant services to assist in the preparation and evaluation of food service bids and subsequent contract negotiations for operations of con- cessions and catering services at the Roanoke Civic Center, and that funds be transferred therefor. ATTEST: 1990 EMPLOYEE OF THE YEAR PUBLIC WORKS DIRECTORATE CITY COUNCIL MEETING May 21, 1990 -- 2:00 p.m. THE DIRECTOR OF PUBLIC WORKS HAS INSTITUTED A PROGRAM TO RECOGNIZE THE SERVICE AND CONTRIBUTIONS OF ONE OF HIS EMPLOYEES EACH YEAR. THEREFORE, IT GIVES ME GREAT PLEASURE TODAY TO OFFICIALLY RECOGNIZE THE EMPLOYEE OF THE YEAR DIRECTORATE. IN THE PUBLIC WORKS OUR HONOREE IS A SECURITY/CUSTODIAN IN THE CUSTODIAL SERVICES DEPARTMENT AT THE PUBLIC WORKS SERVICE CENTER AND HAS BEEN AN EMPLOYEE OF THE CITY OF ROANOKE SINCE 1980. THIS DEDICATED CITY EMPLOYEE HAS MISSED NO TIME FROM WORK IN THE LAST FOUR YEARS. WHILE PERFORMING HIS DUTIES, HE WITNESSED AN ATTEMPTED BREAKING AND ENTERING OF AN EMPLOYEE'S OCCASIONS AND ON EACH OCCASION, RESULTED IN THE APPREHENSION OF MOTOR VEHICLE ON AT LEAST TWO HIS QUICK AND APPROPRIATE ACTION THE PERSON RESPONSIBILE FOR THE CRIMINAL ACT AND THE RECOVERY OF THE STOLEN GOODS. OUR HONOREE HAS RECEIVED CASH AWARDS FOR TWO SUGGESTIONS OF MONEY SAVING IDEAS WHICH HE SUBMITTED UNDER THE CITY EMPLOYEE SUGGESTION PROGRAM. THOMAS, AN OUTSTANDING CITIZEN OF THE ROANOKE VALLEY COMMUNITY AND AN OUTSTANDING CITIZEN OF THE UNITED STATES OF AMERICA. I HAVE KNOWN COMMANDER THOMAS FOR A NUMBER OF YEARS DURING WHICH TIME HE HAS BEEN ACTIVE IN THE AFFAIRS OF HIS COMMUNITY. HE IS A GRADUATE QF TRI STATE UNIVERSITY WHICH IS LOCATED IN ANGOLA, INDIANA, AND HOLDS A DEGREE IN AERONAUTICAL ENGINEERING AS WELL AS A DEGREE IN MECHANICAL ENGINEERING. HE RECEIVED HIS MASTER OF EDUCATION DEGREE FROM THE UNIVERSITY OF VIRGINIA IN CHARLOTTESVILLE AND ON THREE OCCASIONS, HE HAS BEEN THE RECIPIENT OF THE "TEACHER OF THE YEAR" AWARD. HE GAVE THIRTY YEARS OF HIS LIFE IN SERVICE TO HIS COUNTRY, OF WHICH FIVE YEARS WAS DEVOTED TO ACTIVE DUTY IN THE NAVAL AIR RESERVE DURING WORLD WAR II. UPON RETURNING HOME FROM THE WAR, COMMANDER THOMAS WAS EMPLOYED BY THE STATE BOARD OF EDUCATION AS SUPERVISOR OF THE VETERAN'S ON-THE-JOB TRAINING PROGRAM IN THE WESTERN PART OF THE STATE. HE ORGANIZED THE FIRST "MASSING OF THE COLORS" WHICH WAS HELD AT ST. JOHN'S EPISCOPAL CHURCH ON JUNE 14, 1984. HE HAS SERVED AS PRESIDENT AND SECRETARY OF THE ROANOKE VALLEY VETERANS COUNCIL AND HAS BEEN IN COMMAND OF THE MILITARY ORDER OF WORLD WARS ON T~O OCCASIONS. COMMANDER THOMAS HAS BEEN AN ARDENT SUPPORTER OF THE ROANOKE VALLEY WAR MEMORIAL AND HAS BEEN IN CHARGE OF THE HISTORIC FLAG DISPLAY AT LEE PLAZA. HE HAS ASSUMED THE RESPONSIBILITY OF POSTING TWENTY-T~O FLAGS ON CERTAIN SPECIAL DAYS OF THE YEAR. IN HIS POSITIONS WITH THE ROANOKE VALLEY VETERANS COUNCIL, COMMANDER THOMAS HAS TAKEN ON THE GREAT RESPONSIBILITY FOR THE ONE HUNDRED SEVENTY UNITED STATES FLAGS WHICH ARE FLOWN IN DOWNTOWN ROANOKE ON SELECTED HOLIDAYS, AND IN THIS CAPACITY, HE HAS SECURED WORKERS, PURCHASED FLAGS, AND EVEN STORED THE FLAGS IN HIS OWN HOME. THOMAS) Mr. Richard S. Thomas, a native of Roanoke, Virginia, graduated from Tri State University in Angola, Indiana, with two degrees, one in aeronautical engineering and one in mechanical engineering, and later graduated from the University of Virginia, receiving his Master of Education Degree; and Mr. Thomas was the recipient of the "Teacher of the Year" Award on three occasions during his tenure at Jefferson High School and Andrew Lewis High School; and Mr. Thomas devoted thirty years of service to his country in the military, of v~ich five years was served in active duty in the Naval Air Reserve; whereupon, he took cortmgnd of the Naval Air Training Unit flying from Norfolk to Woodrum Field and was later assigned as Recruiting Officer for the Fifth Naval District. Re was employed by the State Board of Education as Supervisor of the Veteran's On-The-Job Training Program for the western section of the Conmonwealth of Virginia; and as past President and Secretary of the Roanoke Valley Veterans Council, Mr. Thomes has been in con, hand of the Military Order of World Wars on two separate occasions. He is an ardent supporter of the Roanoke Valley War Memorial and has taken the responsibility for the historic twenty-two flag display at Lee Plaza and for the one hundred seventy United States Flags that are flown in downtown Roanoke on selected holidays. He organized the first "Massing of the Colors" which was held at St. John's Episcopal Church on June 14, 1984; and ~EREAS, Mr. Thomas has secured workers, solicited donations to replace flags as needed, purchased flags, and even stored flags in his own home, and is respectfully referred to by local veterans as "Mr. Flag"; and Mr. Thomas has performed his many tasks with dedication, enthusiasm, and efficiency. He has earned the respect and admiration of his co-workers and members of his professional organizations for the level of professionalism he has exhibited throughout his years of service; and as a token of sincere appreciation total life of the Roanoke contnunity, than one hundred thousand citizens, outstanding American. for Mr. Thomes' contributions to the un behalf of the "Star City" and more I wish to pay special tribute to this ~', TfJEREFORE, I, Noel C. THOMAS Birth Date: July 17, 1909 He is still living in the house he was born in on Crystal Spring Avenue. Graduated from Tri State University in Angola Indiana with two engineering degrees; one in aeronautical and one in mechanical engineering. Worked for Boing. Then taught at Jefferson High School before the war and Andrew Lewis High School after the war. Received his Master of Education degree from the University of Virginia. Also received the "Teacher of the Year" award, three times. Served 30 years in the military, five years active duty in the Naval Air Reserve during World War II. Upon returning home after World War II from California, Thomas was put in command of the Naval Air Training Unit flying from Norfolk to Woodrum Field. They were called the "Weekend Warriors." After that Thomas was assigned as the recruiting officer for the Fifth Naval District. Immediately after returning from the war, Thomas was employed by the State Board of Education as Supervisor of the Veteran's on-the-job training program in the western part of the state. Commander Thomas organized the first "Massing of the Colors" held at St. John's Episcopal Church on June 14, 1984. Massing of the Colors is the Blessing of the Colors. Thomas has served as President and Secretary of the Roanoke Valley Veteran's Council. He has also been in command of the military order of world wars twice. Commander Thomas has been an ardent supporter of the Roanoke Valley War Memorial being in change of the Historic Flag display at Lee Plaza. He posts 22 flags on special days of the year. In his positions with the Roanoke Valley Veterans Council, Thomas has taken the responsibility for the 170 U. S. Flags flown in Downtown Roanoke on selected holidays. Thomas has secured workers, solicited donations to replace flags as needed, purchased flags and even stored them in his own home. Commander Thomas is respectfully referred to by local veterans as "Mr. Flag" and has given much to the Roanoke Valley raising our awareness and individual and collective patriotism through his unselfish actions. The impetus for this amendment is the development proposed by Norfolk and Western Railway Company for Disposition Parcel 2 located in the Downtown East Project Area. On May 23, 1990, the City of Roanoke Redevelopment and Housing Authority will hold a public hearing on the amended Plan. The Authority's Board of Comm2ssioners is to approve the Amendment on May 29, 1990. Schlanger School Board Request for the Appropriation of Anticipated Bond Funds and Grant Funds I have reviewed the attached request to appropriate funds for the School Board. This report will appropriate $938,677 in the Capital Projects Fund for boiler system replacement and asbestos abatement. Funding is from the anticipated proceeds of the City's 1990 bond issue. The previously approved bond issue of $15,250,000 includes $3,300,000 designated for asbestos removal in schools and $430,000 for replacement of school heating systems. This report also will appropriate funds for six grant programs. Five of the grants are funded with 100% federal or state funds or contributions. The Governor's School grant for FY91 requires $193,500 in FYgl school funds to be transferred from the General Fund as a local match. Funding in the FY91 adopted budget is available in the Education category of the General Fund account 001-060-6001-6307-0382 (Tuitions - In State). Two budget ordinances are attached for Council's approval. One is for the bond funds and all grant funds except the local match. The second is for the local match being appropriated from the FY91 previously adopted budget. The City Manager or the Assistant City Manager and the City Clerk are hereby authorized on behalf of the City to execute and attest, respectively, the requisite contract with the suc- cessful bidder, based on its proposal made therefor and the City's specifications made therefor, said contract to be in such form as is approved by the City Attorney, and the cost of said work to be paid for out of funds heretofore or simultaneously appropriated by Council. 3. Background on the project includes: Bids were received by City Council at its April 23, 1990 meeting. These bids were publicly opened and read aloud for Bituminous Concrete Overlays and Pavement Profiling of Various Streets Within the City of Roanoke. Four (4) bids were received and referred to the bid committee for review and report back to Council. The low bid, in the amount of $857,332.60 was submitted by Virginia Asphalt Paving Co., Incorporated. Adding Alternate No. 1 (raising manholes), which was bid at $44,200.00, the total bid amounts to $901,532.60.. City Council, at its October 1, 1979 meeting, directed the Administration to give "every consideration" to maintaining a 20-year paving cycle on City Streets. The 20-year paving cycle requires that 57 lane-miles be paved each year within the City of Roanoke. Co Funds totaling $650~000.00 in next fiscal year's (1990-91) Annual Paving Account (No. 001-052-4120-2010) could be supplemented with $261,000.00 from miscellaneous operating accounts as summarized in Attachment III. The $650,000.00 will not be available until on or after July 1, 1990. However, invoices from the contractor prior to July 1, 1990 would not exceed the $261,000.00 that is presently avail- able. The revenue sources noted above total $911,000.00 and would provide a contract of $901,532.60 and a contingency of $9,467.40 for 31,500 tons of asphalt which would pave 57 lane- miles of streets, at prices contained in the low bid shown on Attachment II. Compliance of the bidder with the requirements of the contract documents was met. 2. Amount of the low bid is acceptable. The $24.61 price per ton of asphalt is identical to last year's price. 3. Background: Purpose of the rezoning request is to permit the construction of a structure to be used in the operation of an existing paint and remodeling business. The proposed structure will permit certain painting operations which are currently conducted outdoors to be moved inside out of public view. Petition to rezone was filed on February 12, 1990. Proffers one and two below were offered. Ce First amended petition to rezone was filed March 1, 1990. Additional proffers were offered in response to staff concerns regarding future use and development impact. Proffered conditions were as follows: That the property will be developed in substantial conformity with the site plan prepared by Lumsden Associates, P.C., a copy of which is attached to the petition for rezoning as Exhibit "B", subject to any changes required by the City during site plan review and or changes required to ensure safety and a good engineering practice. The rezoned property shall be used only for a paint and remodeling business within the existing and proposed buildings. The first Planning Commission public hearing held on March 7, 1990. Mr. Gary Robertson of Lumsden Associates appeared before the Commission on behalf of Mr. Williams. Mr. Robertson summarized the requested rezoning noting that Mr. Williams currently had a nonconforming business that had been in existence for a number of years. He stated that Mr. Williams wanted to replace a dilapidated, existing garage and metal shed with a new one-story structure. Mr. Robertson noted that the proposed proffers and landscaping would help buffer the surrounding residential neighborhood. Mr. Marlles gave the staff report recommending approval of the request. Mrs. Helen Sink (2225 Ridgefield Street) appeared before the Commission and stated she did not approve of the rezoning. Mrs. Sink presented a petition signed by 23 residents (attached) opposing the rezoning. She also stated that she was concerned with traffic on Ridgefield Street and the appearance of Mr. Williams' property. Ms. Joan Martin (2328 Ridgefield Street) appeared before the Commission and noted that Mr. Williams had damaged her property with some of his machinery. In response to a question from the chairman, Mr. Robertson stated that they had not held a neighborhood meeting prior to the public hearing. Action on the request was tabled until April 4, 1990 in order to give the petitioner an opportunity to meet with the neighborhood residents. 3 Neighborhood meetin9 was held on March 20, 1990, at the Hollins Road Baptist Church. Approximately 25 residents attended the meeting. Ms. Susan Perkins with Lumsden Associates reviewed the site plan and described the proposed proffers. Neighborhood residents were concerned with the speed and volume of traffic through the neighborhood, sewerage capacity, paint fumes associated with the existing painting operation currently conducted outdoors, outside storage of materials and the appearance of the property. Ms. Perkins noted that the petitioner was proffering that there would be no outside storage of materials and that all business operations, including the existing outside painting operation, would be confined within the existing and proposed structures. Ms. Perkins stated that the she felt that the proposed landscaping and buffering would also significantly improve the appearance of the property. In response to a question from one of the residents, Mr. Williams stated he would be willing to install the landscaping and buffering before the end of the three year period. In response to resident concerns about the fumes, Mr. Williams noted that the proposed structure would be equipped with the same type of ventilation system used by paint and body shops which should significantly reduce any fumes from the painting operation. Mr. Marlles stated that he would investigate the need for signage to control traffic and the adequacy of the existing sewer lines. Second amended petition to rezone was filed on March 27, 1990. Additional amended proffer is as follows: "The landscape buffer yards shall be installed within the first year after the construction commences. Second Planning Commission public hearing was held on April 4, 1990. Mrs. Susan Perkins appeared before the Commission on behalf of the petitioner, Mr. Williams. She noted the request had been tabled in order for the petitioner to meet with the residents and address their concerns. She noted that the 4 biggest concern had been the introduction of heavy manufacturing into a residential district. She said that it had been explained that the development plan was a proffered condition of the rezoning and that no other use could be made of the property. She noted that the residents also were concerned about the following: Possibility of the buildings being larger than what was shown on the plans; 2. landscaping and buffering; 3. traffic; 4. paint fumes and particles from outside painting; and 5. sewer capacity. Mrs. Perkins advised that each concern had been addressed and the petitioner would install fans, with filters, to control the paint fumes and particles from his painting operation. She noted also the petitioner would speak with his employees about obeying the speed limit in the area and that the City would post a speed limit sign on Ridgefield Street. Mr. Marlles presented the staff report in favor of the requested rezoning. He stated that the the existing non- conforming business would be upgraded by the required buffers and landscape screening and the relocation of the outdoor painting inside the proposed structure. He noted that he had contacted the State air pollution control board as well as the City's building department and no record of complaint in the area was found. Mrs. Goode asked if condition no. 4 excluded any outdoor painting or storage. Mr. Dibling suggested that outdoor storage was permitted unless it was proffered otherwise. Mrs. Helen Sink (2225 Ridgefield Street) appeared before the Commission and stated she was still against the rezoning because her house sat in front of the petitioner's building and she had to look at a eight foot fence. She also asked if her property value would decline if the property was rezoned. Mr. Waldvogel advised that property value was a question that the Commission could not address. He referred Mrs. Sink to the Real Estate Valuation office. Mr. Bradshaw asked Mrs. Sink what type of use she would like on the property and Mrs. Sink that she did not want to look at the high fence. Mr. Bradshaw advised Mrs. Sink that the concept plan showed the existing fence being relocated to the rear of the proposed landscaping buffer along Ridgefield Street. Mr. Waldvogel asked if the reversion clause of three years was in conflict with one year landscape buffer proffer. Mr. Dibling advised that it was not. There was further discussion of the three year reversion clause as well as the one year installation of landscape materials. Mrs. Perkins advised the Commission of the reasons for having a three year reversion clause. She noted that the City's subdivision and site plan review process could take as long as eight months to a year and then the petitioner would have to look at his financial situation. She conferred with the petitioner, who agreed to change the reversion clause to one year. After further discussion of the proffers, following amendments were read by Mrs. Franklin: the Proffer #2: That if no building permit has been issued and no construction commenced within one year from the date of final zoning approval; the zoning shall revert to RM-1, Residential Multifamily, Low Density, District without further action by City Council. Proffer #4: The rezoned property shall be used only for a paint and remodeling business, which shall be conducted entirely within the existing and proposed buildings. No outside storage shall be permitted on the premises. II. Proffer 95: The landscape buffer yards shall be installed within one year from the effective date of rezonin9 or concurrent with construction, which shall be completed within one year of commencement. Third amended petition was filed on April 19, 1990. Proffers were as follows: That the property will be developed in substantial conformity with the site plan prepared by Lumsden Associates, P.C., a copy of which is attached to the petition for rezoning as Exhibit "B", subject to any changes required by the City during site plan review and or changes required to ensure safety and a good engineering practice. That if no building permit has been issued and no construction commenced within 1 year from the date of final zoning approval, the zoning shall revert to RM-1; Residential Multifamily, Low Density District without further action by City Council. That the proposed building color shall be visually harmonious in color with the environment and shall be subject to the approval of the Agent to the Planning Commission. Issues: Zonin9 is currently RM-1, Residential Multifamily, Low Density District. RM-1 zoning exists to the north, south and east of Fo the subject tract. The area to the west across the Norfolk and Southern railroad tracks is zoned HM, Heavy Manufacturing District. Land use is presently light manufacturing (painting and remodeling operation). Land uses to the north, south and east are single family residential uses. To the west, across the Norfolk and Southern railroad tracks, a mixture of commercial and industrial uses exist. Utilities are available and adequate to serve the site. The City's Utility Line Services indicated that the existing sewer line serving the subject property and the neighborhood is adequate to handle the proposed expansion. Traffic and access. Residents expressed concern with the volume and speed of traffic on local streets in the neighborhood. No increase in automobile or truck traffic to or from the subject property is anticipated as a result of the proposed rezoning. There is currently no signage indicating existing speed limits. The City's Traffic Engineer has determined that such signage is appropriate and will be installed. Neighborhood is primarily older single family residential. The subject property has existed within the neighborhood for many years. The current owner has attempted to improve the appearance of the property. Further additions or expansions cannot be accommodated without a change in zoning. Neighborhood organizations, Williamson Road Action Forum and Williamson Road Area Business Association, have reviewed the proposed rezoning and have notified the Planning office that they are in favor of the request. Comprehensive Plan recommends that conflicts between residential and industrial sites should be minimized. In addition, attention should be given to impact on the neighborhood housing market, circulation, access, noise and visual appearance. The appearance of the property would be improved as a result of III. required landscaping and buffering. Proffers restricting outside storage and stipulating that all activities associated with the existing paint and remodeling business will be confined within the existing and proposed structures will significantly improve the appearance of the property. The existing topography also aids in screening and separating the site of the proposed structure from the surrounding neighborhood. Alternatives: A. City Council approve the rezoning request. 1. Zoning becomes HM, conditional Land use remains manufacturing and is restricted to a paint and remodeling business. 3. Utilities could be provided. Traffic and access would be accommodated. Neighborhood impact would be minimal. Buffering exceeding the requirements of the City is being proposed along the easterly property line adjoining Ridgefield Street. Furthermore, due to elevation changes on the site, the existing topography aids in screening and separating the site of the proposed structure from the neighborhood. The proposed structure will ultimately improve the appearance of the property by permitting certain painting operations to be moved indoors. 6. Comprehensive Plan would be followed. B. City Council deny the rezoning request. Zoning remains RM-1. Existing light manufacturing operation remains non-conforming. Ability of the owners to expand or make improvements remains restricted. 2. Land use remains manufacturing (paint and remodeling business). IV. Utilities are available but not affected. 4. Traffic and access are unaffected. 5. Neighborhood is unaffected. 6. Comprehensive Plan could be followed. Recommendation: By a vote of 7-0, the Planning Commission recommended approval of the requested rezoning. In addition, staff conferred with the petitioner's counsel to encourage the petitioner to restrict the use to a manufacturing establishment primarily engaged in the manufacture, assembly, mixing, processing or other processes related to the creation of new products and including as an accessory use, the retail sale of goods manufactured on the premises (Sec. 36.1-249(20). This proffer was consistent with the purpose and protects the Melrose corridor from any potential incompatible LM development. At the time of Planning Commission report preparation, counsel was unable to confirm the owner's/petitioner's acceptance of this additional proffer. Planning Commission public hearing was held on Wednesday, April 4, 1990. Mr. Harwell Darby appeared before the Commission and stated that Roger Myerson was also present if questions arose. Mr. Darby explained that the site in question once housed the Lowes store on Melrose Avenue. Mr. Darby said that HASI Inc., proposed to lease the store to Valley Apparel for purposes of running a garment manufacturing operation. He noted that 40-75 people would be employed on the site and none of the employees would be moving from the 6th Street building. Mr. Darby outlined the proffers as described above and offered a fourth proffer which stated that "the use of the property would be limited to manufacturing establishments, primarily engaged in manufacturing, assembly, mixing, processing and other processes related to the creation of new products and including as an accessory use, the retail sale of goods manufactured on the premises." The proffer addressed staff concerns expressed prior to the public hearing. Mr. Tasselli presented the staff report which recommended approval of the request. He noted that the petitioner had been working with the City's economic development staff who supported the rezoning. He noted that staff felt the proffers restricted the use and were pleased that the trees would be planted, a building re-used and jobs for the neighborhood would be provided. Roanoke Page 3 May 14, City Council 1990 Mr. Bradshaw asked Mr. Tasselli why there was a difference between the Fibercom rezoning and the present request and asked for an explanation. Mr. Tasselli read the Fibercom proffer, "the property shall be used for manufacturing establishments primarily engaged in the assembly of electrical appliances, telephonic, electronic and small equipment instruments or devices and the manufacture of parts used in any such appliances, equipment, or instruments and the assembly or packaging of materials. No outside storage will be permitted. He said that in the present rezoning, the proffer allowed for the manufacture, assembly or processing and the creation of new products without specifically saying apparel. Mr. Bradshaw said that the Commission was trying to keep the Fibercom rezoning as a clean, office-type operation. Mr. Bradshaw stated that he was not as concerned with the clothing manufacturing use as he was with the next use. Mr. Bradshaw further stated that the Fibercom rezoning clearly stated that Fibercom and any other tenant had to come back to the Commission if the use changed from what was specifically proffered. Mr. Darby advised that his client would be glad to limit his proffer to the manufacture of clothing. Mr. Darby also said that his clients distributed clothing and he would like to add the word distribution to the proffer. A proffer was discussed and Mr. Darby proffered the following, "the use of the property shall be limited to a manufacturing establishment, primarily engaged in the manufacture, assembly, mixing, distribution, processing or other processes related to the creation of new clothing products, including as an accessory use, retail sales." Mr. Buford asked Mr. Phillip Sparks, Economic Development Administrator, if he like to speak to the matter. Mr. Sparks commented in support of Valley Apparel. He said that he had worked with both Roanoke Dyeing and Finishing and Roanoke Valley Apparel and was sure that they would be a good neighbor. First amended petition was filed on April 9, 1990. To the south is a cemetery and to the west is a mini-warehouse operation. Utilities exist on the site and have adequate capacity. Access to the site would utilize existing driveways. Traffic impact is minimal. With only 40 employees, the number of daily trips is expected to be less that what the site has generated in the past. Neighborhood organization representing this are is the Northwest Redevelopment Corporation. Said tract is currently zoned C-2 (General Commercial District). A map of the property to be rezoned is attached as Exhibit A. A concept plan of the property is attached as Exhibit B. Pursuant to Article VII, Division 5, Section 36.1-690, et seq., Code of the City of Roanoke (1979), as amended, the Petitioner requests that the said property be rezoned from C-2, General Commercial District to LM, Light Manufacturing District for the purpose of providing for the renovation of an existing structure to be used as a manufacturing (cut and sew) facility with offices, warehousing and retail space. The Petitioner believes the rezoning of the said tract of land will further the intent and purposes of the City's Zoning Ordinance and its comprehensive plan, in that it will create a use compatible with the surrounding zoning. The Petitioner hereby proffers and agrees that if the said tract is rezoned as requested, that the rezoning will be subject to, and that the Petitioner will cause its Lessee to abide by, the following conditions: 1. That the manufacturing facility to be operated on the property shall make use of the existing structure on the property and that there will be no outdoor storage of materials. 2. That if the Petitioner does not enter into a lease with Valley Apparel, Inc. as to the property within 120 days from the date of final zoning approval, the zoning shall revert to C-2 (General Commercial District) without further action by City Council. 3. The Petitioner will require its Lessee to comply with the Melrose Avenue Street Tree Master Plan. Attached as Exhibit C are the names, addresses and tax numbers of the owner or owners of all lots or property immediately adjacent or immediately across a street or road from the property to be rezoned. WHEREFORE, the Petitioner requests that the above-described tract be rezoned as requested in accordance with the provisions of the Zoning Ordinance of the City of Roanoke.
