AN ORDINANCE approving the opening and grading of a portion of
unopened right-of-way to provide for the extension of Pineland Road,
S. W., upon certain terms and conditions, and appointing an officer of
the City to ascertain whether such grading will damage abutting pro-
perties; and providing for an emergency.
BE IT ORDAINED by the Council of the City of Roanoke that:
1. The opening and grading by a developer of a portion of
unopened right-of-way to provide for the extension of Pineland Road,
S. W., be and is hereby deemed desirable and is hereby approved, con-
tingent upon the following: (1) that the plans relating to the
grading be approved by the City Engineer; (2) that the right-of-way
be graded to City standards; (3) that the developer indemnify the
City for damages, if any, arising out of the opening and grading,
including but not limited to damages ascertained by the City Engineer
pursuant to Section 15.1-368 of the Code of Virginia (1950), as
amended; and (4) that the developer obtain a street opening permit
and post a performance and payment bond to ensure that the opening
and grading is completed consistent with the approved plans.
2. Pursuant to Section 15.1-368 of the Code of Virginia (1950),
as amended, the City Engineer is hereby designated and directed to
proceed by personal inspection of all of the premises likely to be
affected by such grading to ascertain what damages, if any, would
accrue to the owners of any properties so likely to be affected and to
take any other necessary or appropriate action consistent with legal
~equirements.
S. In order to provide for the usual daily operation of the
municipal government, an emergency is deemed to exist, and this ordi-
nance shall be in full force and effect upon its passage.

I. Back,round:
Letter dated May 30, 1989 (attached), along with an earlier letter of
June 6, 1988, regarding the opening of a portion of Pineland Road,
S.W., was sent to the City Engineering Department by Neil Schlossberg,
owner of property (Parcel No. 5010320) adjacent to unopened Pineland
Road right-of-way. Mr. Schlossberg has verbally indicated that he
intends to construct a single-family home.

State law requires the approval of City Council before the City or a
developer can proceed with grading on a previously platted but uno-
pened right-of-way. City would not be obligated to provide these im-
provements as there is no law requiring the City to do so.

Existin~ portion of Pineland Road is approximately 950 feet in length.
Extension of approximately 80 feet would be required to provide the
access desired by Mr. Schlossberg, as well as provide an area for
vehicles to turn around. Mr. Schlossberg has expressed no interest in
extending Pineland Road its final 100 feet to its intersection with
Circle Drive.
II. Current Situation:
A. Code of Virginia Section 15.1-368 provides that whenever the council
of any city shall deem it desirable to grade any street, they shall, by
resolution or ordinance, direct the same to be done, and if the improve-
ments be such as may cause damage to the abuttin~ owners, the resolu-
tion or ordinance shall designate and direct some committee of council
or some officer of the city to proceed by personal inspection of all of
the premises likely to be affected by such ~radin~ to ascertain what
damases~ if any~ will accrue to the owners of the several properties so
likely to be affected.

percent cost to the developer (no City funds involved) and appoint
a committee/officer to inspect the Pineland Road area and determine
what damages, if any, will be incurred by the owners of properties
affected by the proposed improvements.
Legal requirements of determining what damages, if any, would
occur with the grading of Pineland Road would be met. Developer
will need to obtain a street-opening permit and be properly
insured and bonded. City would need to approve plans pertaining
to the grading, which would need to be graded to City standards.
2. Timeliness would be met inasmuch as the developer has no
immediate building plans.
Costs for engineering and construction would not be incurred by the
City. Cost of damages, as determined by committee/officer, would
be the responsibility of the developer. Developer would also need
to indemnify the City for damages arising out of grading, even if
the committee concludes that no damages will result from the
grading.

Dear Mr. Stecker:
The City Bngineering Department has received a request to provide you with
information relative to the City's requirements for accessing the above
referenced property.
As you are aware, any building constructed on this lot needs to have front-
age on an improved street. Pineland Road is not improved along the frontage of
this property. Any extension of Pineland road from its present terminus (which
ends approximately 35 to 40 feet before reaching the subject property) would
require action by Roanoke City Council. Only City Council can authorize grading
on previously platted, but unopened, public rights of way.
Based upon our preliminary field review, it appears that we would require a
roadway extension approximately 80 feet in length and 20 feet in width as well
as a 20-foot wide turning area (see attached sketch). This could change subject
to conflicts encountered during construction. This concept is based upon a dri-
veway to this property being located at the western-most side of the property.
If this ultimately is presented to City Council, it is likely that our staff
recommendation would be that a third party, not the City, be responsible for all
costs and construction sssociated with the roadway extension.
It should also be noted that neighborhood concerns exist with respect to the
future possibility of extending Pineland Road through to Circle Drive. While we
understand that this is not what is proposed, the City staff would welcome a
proposal for the official closure of the remainder of the undeveloped right-of-
way (whAle maintaining 90 feet of frontage for the subject property as is
required in an RS-1 zone).

CONFLICT RESOLUTION SERVICES FOR DIVORCING OR
DIVORCED SPOUSES REGARDING CHILD CUSTODY AND
VISITATION ISSUES
I. BACKGROUND

In a letter to the Mayor and members of City
Council dated November 6, 1989, Councilman
David Bowers brought to Council's attention a
possible need for services to assist
divorcing or divorced spouses with children
in dealing with conflicts arising from child
custody and visitation privileges.

City Council referred the issue to the City
Manager on November 13, 1989 for study,
report, and recommendation.
A study group comprised of members of the
Human Resources Steering Committee was
established to research available resources
and to provide additional information on the
issue.
II. CURRENT SITUATION
The study group found that there is a need
for services to assist divorcing/divorced
spouses with conflicts concerning child
custody and visitation privileges. Human
service professionals indicated that these
types of conflicts are common and may
continue without satisfactory resolution for
years.
The study grouD examined the scope of
existing services and found that the
following programs are offered.
Family Services of the Roanoke Valley
provides counseling services for
divorcing or divorced Roanoke City
residents on an ability to pay fee
scale. However, Family Services does not
offer

conflict resolution services for
divorcing/divorced spouses.
Roanoke County Social Services offers
mediation services which provide
divorcing spouses assistance with child
custody and visitation conflicts.
Roanoke City Department of Socia]
Services currently provides staff to
work with the court system to conduct
court-ordered custody investigations, or
"home studies", for cases involving
separation and divorce issues such as
custody and visitation. Almost 100 home
studies were conducted by Social Service
in 1989. Within the next 12 months, the
Social Service Department will train two
case workers in mediation, conciliation
and arbitration services. These
services will be integrated into the
current service delivery system for
families.
A group of local citizens is
establishing the Conflict Resolution
Center, Inc. Services are scheduled to
begin in October 1990. The purposes of
this organization include the provision
of mediation, conciliation, and
arbitration services for citizens
seeking expeditious and less costly
resolution of disputes, and, the
development of educational programs
regarding the nonjudicial resolution of
disputes and to promote their use in the
community.

Donna Norvell, Human Resources Coordinator, asked the
Conflict Resolution Center, Inc. for an endorsement of the
Visitation School Study Group's report and recommendations to
City Council regarding the Center. This letter will serve as
that endorsement. ~
At a meeting on April 25, the Board of the Conflict
Resolution Center read those recommendations and approved of
them. We are excited and hopeful about the prospect of
establishing a community-based center which can provide mediation
services to persons with custody and visitation disputes, as well
as other disputes. We think our mediation program will serve the
objectives of Councilman Bowers (and the needs of Roanoke
citizens) to a great extent, in allowing and enabling divorcing
couples to work out their differences in a collaborative manner,
rather than an adversarial one. It sounds as if the visitation
school idea is aimed at meeting the same need.
As I mentioned to Ms. Norvell once before, we will be
willing to deal with individual couples on an ongoing basis. If
they mediate their issues once, and find that their agreement is
not satisfactory, they will be able to return to mediation if
they so desire. Changing needs and circumstances over time make
this something to expect. So our program, even in its first
year, should help couples deal with their various disputes as
they aris~e. We would not limit mediation to one particular time
period, ~., the time of divorce.
We will certainly stay in touch with the City on the
visitation school idea and, over the next year, consider if such
a program should be included in our center.
We thank you for your confidence in our Board and our
planned Center. If we can obtain anticipated funding, we believe
we can establish a very valuable source of dispute resolution for
Roanoke.

A RESOLUTION urging that certain solid waste regulations pro-
mulgated by the Commonwealth of Virginia be amended to exempt
composting of natural grass and wood products from the formal
permit application process.
WHEREAS, the City of Roanoke, Virginia, is attempting to
comply with the Commonwealth of Virginia, Department of Waste
Management, Solid Waste Management Regulations VR672-20-10; and
WHEREAS, the only authorized alternative to burning is to
landfill grass clippings, leaves, tree trimmings, construction
lumber, brush and tree stumps and other natural organic material;
and
WHEREAS, this aforesaid material is all biodegradeable,
represents a significant portion of the solid waste stream, and
if properly composted would decompose, creating no environmen-
tally harmful side effects while contributing to recycling and
conserving much needed space in the landfill; and
WHEREAS, the new solid waste regulations, while environmen-
tally sound, impose a drastic financial burden on the citizenry
of the Commonwealth in the form of tax and/or landfill tipping
fees to cover the cost of the new regulations.
NOW, THEREFORE, BE IT RESOLVED that this Council hereby
requests that the said regulations be amended to permit the com-
posting at landfill sites of grass clippings, leaves, tree trim-
mings, construction lumber, brush and tree stumps, thus promoting
the recycling of natural biodegradeable grass and tree products
with the resultant conservation of landfill space.
BE IT FURTHER RESOLVED that the City Clerk is directed to
forward a copy of this resolution to Senator J. Granger
Macfarlane, Delegates Clifton A. Woodrum, III, and A. Victor
Thomas, and the proper officials at the Department of Waste
Management urging their support for this change to the current
regulations.

Requested Revision to State Solid Waste Regulations
to Provide that Composting of Natural Grass and
Wood Products are Exempt from the Formal Permit
Application Process
I. Background:
Current solid waste regulations approved and enforced by the
State Department of Solid Waste Management requires that
composting of grass and wood products be subjected to the same
formal Part "A" and Part "B" permit application and review
process as other methods of solid waste disposal, e.g.
incinerators, landfills, recourse recovery facilities, etc.
Formal permit procedures being imposed on composting will
hamper recycling efforts and serve to increase the utilization
of landfills for the disposal of grass and wood refuse.
Letter, copy attached, received May 1, 1990 by Mayor Taylor
from the Chairman of the Board of Mecklenburg County urges the
City to support an effort to get the State Department of Waste
Management to change the Solid Waste Management regulations to
exempt the composting of grass and wood from the formal State
permitting process. This request was referred to my office
for action.
Informal discussions with persons dealing with the Solid Waste
Management regulations support the fact that the Department of
Solid Waste Management is willing to give serious
consideration to this suggested change in the regulations.

Council pass a resolution similar to that received from
Mecklenburg County urging the State Department of Solid Waste
Management to exempt grass and wood and natural wood product

copy of this report and a copy of the resolution to the
Executive Director of the State Department of Solid Waste
Management, the Virginia Municipal League Environmental
Quality and Legislative Affairs Committee and to Chairman
Blalock of Mecklenburg County.
Environmental impact will not be harmed by this
regulatory change but should be enhanced by providing a
better method of disposal than through customary
landfilling, which method will encourage illegal dumping
or disposal to avoid landfill disposal fees.
Cost avoidance will occur by exempting composting from
the formal permitting process.
3. Promotion of recycling and reuse will occur.

New Department of Waste Management Regulations were promulgated on October 18,
1988 governing Landfill Operational Requirements for the handling of Municipal
Solid Waste. The new regulations, while good to the extent of preserving and
protecting the environment, have presented the various county, city, and town
governments with the very real problem of how to fund the mandated, unfunded
requirements and meet the time table required to be in compliance by July 1,
1992.
Among the changes is one dealing with the handling of grass trimmings, leaves,
tree branches, construction lumber, and tree stumps. Formerly, these were burned
during permitted times of the year. Currently, burning is permitted infrequently
at best, with the preferred requirement that these items be landfilled and covered
daily. These aforementioned items are all biodegradable'and.could be composted,.
thus recycling this asset which makes up some 20% of all Municipal Solid Waste
and conserving valuable and expensive space in our respective landfills. A recent
article in the Virginia Review Magazine pointed to the opposition posed by the
Department of Waste Management to a natural composting operation in Loudon County.
Both the position of the Department and the Regulations, as currently written,
need to be changed to permit the composting of the aforementioned biodegradable
assets with the view toward conservation both of this asset and valuable and
expensive space in our respective landfills.
Toward this end, the Board of Supervisors of the County of Mecklenburg, Virginia,
adopted the attached Resolution end urge your Board of Supervisors/City or Town
Council to adopt this or a similar Resolution and forward it to your representatives
in the General Assembly, urging a change in the Regulations to permit composting.
Collective action by each governmental unit affected could influence change in
the Department's regulations. A change in regulations to allow comPosting at our
respective landfills could (1) count toward our recycling requirements; and (2)
provide significant space saving in our $250,000 per acre landfill space.

I. BACKGROUND

The Consortium administers the Summer Youth Program for
economically disadvantaged youth~-~-Planning District.
The program operates from May 15th to September 30th of each
year.
1. 312 disadvantaged youth wzR1 be served with 129 from the
City of Roanoke.
2. Program activ~s include admirdmtration, eligibility,
der ' ' ' -- --
errmmation, work experzence, career exploration and
specJml projects involving remedial education.
Veterans Project funds have been awarded for the Consortium to
continue serving this targeted group for the period of February 1,
1990 - January 1, 1990.
25 Veterans will be served throughout the Fifth Planning
District, primarily in occupational sk~q~ training and
on-the-job (OJT) training programs.
II. CURRENT SITUATION
A. Notice of Award (NOA) # 90-03-05 has been received in the amount
of $445,146.00 for the Summer Youth Program.
B. $28,981 of lest years Summer Youth Funding needs to be
deobligated and appropriated to the current years' program, as
indicated by NOA #90-03-06.
C. The Consortium was awarded a Veterans Grant, NOA #90-191-1, in
the amount of $34 ~ 867 . 00.
Notice of Award (NOA) #90-01-03 has been received in the amount
of $126~756 for TJt]m II-A funds. $110~103.00 is carryover from
Program Year 1988 (PY'88) grant and $16~653.00 in add~onal
funding from a reallocation of state funds.

FY'90 grant needs to be deappropziated and transferred to the

A. Account 3005 - Project Supplies provides for maintenance/service/
inspection of 789 motorized vehicles and 400 other items in our
fleet.
B. Estimated average monthly expenditures for FY 89/90 was $44~871.
C. Total FY 89/90 Budget appropriation for account 3005, Project
Supplies, was $538,456.
II. Current Situation:
A. Projected year end expenditure deficit for account 3005, Project
Supplies, is estimated to be $59,000.
B. Estimated average monthly expenditures have been higher than orig-
inally estimated when FY 89-90 budget was approved.

Projected deficit is attributed to the increasing age of the fleet and
more major items (motors, transmissions, etc.) that were repaired than
anticipated. Currently the City's average equipment age is 9.73 years
old.

1. The City Manager is authorized and empowered to execute, for
and on behalf of the City, upon form approved by the City Attorney,
Amendment No. 1 to the City's contract with NCR Corporation, dated
March 17, 1987, related to provision of a public safety computer aided
dispatch system.
2. Such Amendment shall provide that Paragraph 7 of Addendum No.
1, dated September 19, 1986, to the City's Plans and Specifications
for the computer aided dispatch system shall not be performed and that
instead NCR Corporation shall provide certain other System enhance-
ments more particularly described in the City Manager's report dated

Dispatch (CAD) System, March 17, 1987.
II. CURRENT SITUATION
Virginia Criminal Information Network (VCIN) Form Tool
Enhancement is a requirement of the contract. Plans and
specifications for VCIN Form Tool are recommended to be
deleted from the contract as this enhancement is no
longer considered a necessary component of the system.
Specific System Enhancements have been offered by NCR
Corporation in lieu of the VCIN Form Tool Enhancement as
follows:

to execute the requisite contract for such work; and rejecting all
other bids made to the City.
BE IT RESOLVED by the Council of the City of Roanoke that:
1. The bid of Hubbard Service Department, made to the City,
offering to install replacement heating, ventilation, and air con-
ditioning equipment at Preston Park Recreation Center, such bid
being in full compliance with the City's specifications and require-
ments therefor, and as provided in the contract documents offered
said bidder, for the total bid price of $10,500.00, which bid is on
file in the Office of the City Clerk, is hereby ACCEPTED.
2. The City Manager or Assistant City Manager and the City
Clerk are hereby authorized on behalf of the City to execute and
attest, respectively, the requisite contract with the successful
bidder, based on its proposal made therefor and the City's specifi-
cations made therefor, said contract to be in such form as is
approved by the City Attorney, and the cost of said work to be paid

July 1, 1989, City Council approved a Capital Maintenance
of Fixed Asset Budget. Included in that budget is the
replacement of the heating and cooling equipment at
Preston Park Recreation Center.
April 26, 1990, specifications were developed and along
with request for quotations, were sent to fourteen (14)
Heating & Air Conditioning Contractors currently listed
on the City's bid list. A public advertisement was
also published in the Roanoke Times and World News.
Bids were received, after due and proper advertisement,
until 2:00 PM on May 11, 1990, at which time all bids
so received were publicly opened and read in the Office
of the Manager of General Services.
II. Current Situation
A. Ten (i0) bid responses were received. Bid tabulation
is attached.
Ail bids received were evaluated in a consistent manner
by representatives of Building Maintenance Department
and General Services.
C. The lowest bid submitted by Hubbard Service Department
meets all specifications for a cost of $10,500.00.

I. Background:
A. Lease of Signboard Space (2 faces) to the Lamar Corporation was ori-
ginally authorized by Ordinance No. 10647, dated July 10, 1950.
B. Lease was renegotiated and new five (5) year lease was effective Jan-
uary 1, 1985. This was authorized by Ordinance No. 27441, dated March
4, 1985.
C. Income from new lease was $50.00 per annum.
D. Lamar Corporation (Lamar) now conducts business in the name of Lamar
Advertising Company - Roanoke.
II. Current Situation:
A. Lease terminated December 31, 1989.
B. Extensive public improvements are planned in the area around the sign
location, including improvements to First Street, N.W. and a new 2nd
Street Bridge overlooking the sign location.

signs be removed within thirty (30) days.

3. Cost to City is loss of $50.00 per annum fee.
4. Income to City is zero.
Committee recommend to City Council that it authorize the appropriate
City officials to execute an agreement with Lamar allowing the signs
to remain in place for a five (5) year period, with thirty (30) days
notice of termination by either party during the term of the agreement
but only if Lamar agrees to a new fee of $2~000.00 per annum.
1. Need by Lamar Advertising for advertising space is met.
2. Timing to renew agreement, which expired December 3, 1989, as soon
as possible is met.

LEASE
THIS AGREEMENT, made as of the 1st day of January, 1985, by
and between the CITY OF ROANOKE, VIRGINIA, a municipal cor-
poration, as "Lessor", and THE LAMAR CORPORA%ION, ("Lamar~), as
Lessee.
WI TNE S SETH:
Lessor hereby leases to Lamar certain two total face sign
board spaces located on the west side of the First Street Bridge,
N. W., upon certain terms and conditions, with the right to main-
tain advertisements on such structures for a term of five (5)
years from January l, 1985, through December 31, 1989, at an
annual rent of FIFTY DOLLAR~ ($50.00), payable in advance in
annual installments of FIFTY DOLLARS ($50.00).
Should Lamar fail to pay the rent or perform any other obli-
gation under this lease within thirty (30) days after such per-
formance is due, Lamar will be in default under the lease. In
the event of such default, Lessor shall have the option to give
Lamar written notice by first class mail to Lamar at the address
shown below. If such default is not cured within thirty (30)
days of the date of such notice, Lamar shall be deemed to be in
breach of this agreement.
Either party may terminate this lease for any reason upon
thirty (30) days written notice sent by first class mail to the
address of the other party shown below. In no event shall this
lease extend beyond December 31, ~989.
Lamar agrees to indemnify Lessor from all injury and damages
to person or property resulting from the installation, main-
tenance, or dismantling of any advertising structures or displays
during the term of this lease and to repair any damage to the
leased premises resulting from the installation, maintenance, or
dismantling of such advertising structures or displays, less
ordinary wear and tear, and to provide general public liability
insurance and contractual liability insurance showing Lessor, its
officials, agents and employees as insureds in amounts acceptable
to Lessor.

A RESOLUTION authorizing an amendment to the City's contract
with Bio Gro Systems, Inc., for the second year of removal and
disposal of sludge from the Water Pollution Control Plant, and
authorizing the proper City officials to execute the requisite
contract documents.
BE IT RESOLVED by the Council of the City of Roanoke that the
City Manager or Assistant City Manager and the City Clerk are
authorized for and on behalf of the City to execute and attest,
respectively, the requisite unit price contract amendment, on
such form as is approved by the City Attorney, with Bio Gro
Systems, Inc., for furnishing all tools, labor, machinery and
materials necessary to remove, transport and dispose of a minimum
of 8,000 dry tons to a maximum of 10,000 dry tons, subject to
approval by the City based upon funding and available volume, of
digested sludge from the Water Pollution Control Plant, at the
unit price of $?7.82 per dry ton for a total sum of $485,720.00
for 8,000 dry tons up to $778,200.00 for 10,000 dry tons, in a
total time frame of one year from execution of the amendment,
such amendment to include provisions for additional hauling as
approved up to 10,000 dry tons, and additional one year exten-
sions of the contract, as well as appropriate bonding and liabi-
lity insurance, all in accordance with the City's plans and
specifications made for such work, the terms of the proposal made
to the City and any other provisions which the City Manager may
deem necessary, the cost of said work to be paid for out of funds
heretofore or simultaneously appropriated by Council, as more
particularly set forth in the report to this Council dated June
4, 1990.

Renewal Contract for Yearly Quantity Sludge Hauling with
Bio Gro expires in May 1990. This is the second contract
negotiated for one year with the option to renew for a total
of five (5) years.

5,000 day tons of sludge to be hauled at ~73.7~ per dry ton.
The renewed contract price based on the consumer price index
for all urban consumers, will be as follows:

Sludge volume for 1990-91 should be established at a minimum

II. Current Situation:
A. Council authorization is desired to execute a contract amend-
ment with Bio Gro Systems, Incorporated to contract for the
second year's quantity of sludge removal, hauling and land
application.
Bio Gro Systems, Incorporated also wishes to renew the
contract for a second year per the attached letter.
Committee recommendation to Council for that contract amend-
ment is requested.

A. Committee recommend that Council authorize the Second Year's
Sludge Disposal Contract with Bio Gro Systems, Incorporated
at a minimum quantity of 6,000 dry tons and a maximum quan-
tity of 10,000 dry tons at $77.62 per dry ton with the twelve
month term of the amendment time period to run from the exe-
cution of the renewed contract (not later than July 1990) and
the understanding that Bio Gro may be shut down at least
from December 15, 1990 to March, 1991.
1. Sludge disposal contract will remain valid.
Sludge quantity will be (at the City's option):
Minimum - 6,000 dry tons - cost, $465,720.00
Maximum - 10,000 dry tons - cost, $776,200.00
3. Contract price will be $77.62/dry ton.
Funding is available in FY 89-90 Sewage Fund Account
Number 003-056-3150-2010 for the minimum 6,000 dry tons.
FY 90-91 budget provides required funding.
5. Time period is established to consider a shutdown for
certain winter months for climate reasons.
B. Committee recommend that Council not authorize the second
year's sludge disposal contract with Bio Gro.
1. Sludge disposal contract will need to be advertised for
proposals.
Sludge quantity will accumulate in the holding/ageing
lagoons until a new contractor is selected and starts
work.
3. Contract price will be unresolved.

Defined Natural Drainage Area
I. Background:
Inter.~urisdictional sewage treatment agreement (agreement)
dated March 23, 1972 requires the City to accept sewage flows
up to a designated capacity allocation from a defined area of
Botetourt County.

Area is defined by Section I (A) of the agreement as being all
of the areas or territory of Botetourt County, Virginia,
within the natural drainage basin of the Roanoke River and its
tributaries and including the territory of the Town of
Troutville, in said County.
Request for certification of downstream capacity was received
from representative of Botetourt County in August, 1989 to
permit deliverance of 20,000 gallons per day from property
owned by the Tarmac Lone Star Cement Company.
Property owned by Tarmac Lone Star Cement Company starts at
the divide between the natural drainage area of the Roanoke
River and the James River.
Capacity was certified correctly as being available in a
letter dated August 22, 1989 from Kit B. Kiser.
Error was stated in the certification letter, copy attached,
as follows: "It is your decision as to whether to use your
capacity reservation for flows originating outside the natural
watershed".
Pre-treatment program inquiry again brought this area for
service to mind on April 27, 1990.

Prior consent of the City, expressed in the form of a
resolution or resolutions of its governing body, is required
before Botetourt County can deliver sewage flow originating
outside the limits of the defined area to the City's regional
Sewage Treatment Plant under the terms of the 1972 agreement.

Correct procedure was explained by Mr. Herbert to Mr. John
Williamson, Botetourt County Administrator, on May 3, 1990.
Mr. Williamson has responded with the attached letter of May
10, 1990 requesting that the City, by City Council resolution,
approve the 20,000 gallons per day flow from outside the
natural drainage area.

Thank you for your letter of biay 3, 1990.
The amendment to our interjurisdictional agreements
relative to industrial pretreatment and sewer system oper-
ations is scheduled for approval by the Botetourt County
Board of Supervisors on May 21, 1990. Immediately follow-
ing their approval, I will execute the agreement for Bote-
tourt County and forward it for your approval and signa-
ture.
You are indeed correct that we wish to extend a two
inch pressure line froia Roanoke Cement Company to our
existing gravity collection lines in Daleville. The pres-
sure line is very small and has been deliberately designed
as such to limit costs and to prohibit its ~se for promo-
tion of major sewer dependent development outside of the
natural drainage basin .of the Roanoke River. The line
will, however, allow Roanoke Cement Company a major em-
ployer in the Roanoke Valley to properly deal with its
sewage discharge. As you probably know, it is very inef-
ficient and expensive to build, man, and operate a small
sewage treatment plant to handle the needs of only one or
two users.
The State Water Control Board and the Health Depart-
ment have given project design approval and based on cor-
respondence with Mr. Kiser. we assumed this minor connec-
tion to the system would be no problem. However, in re-
viewing the 1972 contract, I concur that Section II.D.
requires consent of City Council and I apologize for not
having recognized the need to request the necessary reso-
lution in the earlier stages of the project.

BE IT ORDAINED by the Council of the City of Roanoke that the
Mayor and City Clerk are authorized to execute and attest,
respectively, in form approved by the City Attorney, a quitclaim
deed of conveyance releasing whatever interest the City may have
in an abandoned private road off of Colonial Avenue, S.W., to
and Mrs. Troy E. Goad, as more particularly set forth in the
report to this Council dated May 29, 1990.

I. Background:
Remains of old roadway, possibly a portion of the original alignment
of what eventually became Colonial Avenue, S.W. (previously called
Poor House Road and Bent Mountain Road) passes through several proper-
ties, including the Goad's.
II. Current Situation:
A. Unclear legal status of old roadway must be cleared up prior to sale
of property by the Goad's.
B. Granting of quitclaim deed to any interest the City may have in old
roadway has been requested by Mr. & Mrs. Goad.
C. Five (5) or Six (6) additional properties may be affected by this
situation.
III. Issues:

Council authorize the appropriate City officials to execute a quit
claim deed to old roadway south of Colonial Avenue, S.W. and west of
Winding Way Road, S.W. Appropriate legal documentation and all costs
to be provided by petitioner.

Dear Mr. Kiser:
This is to request that I be placed on the agenda for the
Water Resources Committee which meets on May 29, 1990, for
consideration of the City granting a quit claim deed relative to
an old private road off of Colonial Avenue. I would additionally
request that we be placed on the agenda for City Council for the
same day so that this deed can be authorized as soon as possible.
I request this on behalf of Mr. and Mrs. Goad who are
residents of the City and own fronting on Colonial Avenue. In
examining the title to their property which they are selling, it
appears there was an old roadway which appears to have been a
private road in the early 1940's. This road has long since been
closed and was in fact closed when the Goads bought the property.
I can see how a question may be raised as to whether the road has
ever been appropriately closed but since it appears to be a private
road leading to the former City Poor House it has been requested
by the attorney for the purchasers that the Goads obtain a release
of any interest the City of Roanoke may have in this road. Please
find attached a copy of an old plat showing the road.

A RESOLUTION memorializing the late PERCY T. KEELING, SR.
WHEREAS, this Council has learned, with sorrow, of the
passing of Percy T. Keeling, St., on May 27, 1990;
WHEREAS, Mr. Keeling, a Roanoke native, attended Lucy
Addision High School and thereafter graduated from Shaw
University;
WHEREAS, Mr. Keeling was appointed Youth Director at the
Hunton YMCA in 1954, and four years later he was appointed
Executive Director of the Hunton YMCA, serving in this capacity
for thirty years and working with three generations of Roanoke
youth;
WHEREAS, Mr. Keeling served this City and its people as a
member of the Roanoke Redevelopment and Housing Authority since
1984, a member of the Henry Street Revival Committee since 1984,
and a member of the Revenue Study Commission since 1971;
WHEREAS, Mr. Keeling gave unselfishly of his time and ability
and will be remembered as an energetic community leader who
served this City and its people with integrity, dedication and
loyalty; and
WHEREAS, this
