You will note from the introductory statement from Dr. ~endell H. Butler, the Chairman of the Board of Commissioners, that the Authority has had another successful year of operation on behalf of the citizens of our City. included in their 1989-1990 accomplishments are the addition of 50 units to the Section 8 program under the "Operation Boot Strap" Program, obtaining CIAP federal funding for improvements at Hurt Park and ~orningside Manor, the sale of land in the Downtown East Redevelopment Project for the construction of new office buildings for Norfolk Southern Corporation, and a five story parking facility adjacent to the No. I Fire House. On behalf of Dr. Butler, the other members of the Board of Commissioners, Herbert McBride, the Executive Director, and all of the staff, I can assure you that every effort is being made to provide quality housing for the needy and elderly of our City, as well as deYeloping successful economic development projects for our downtown area and other neighborhoods in the City. I would respectfully request that this letter and the attached 1989-1990 Annual Report of the City of Roanoke Redevelopment and Housing Authority be placed on the Consent Agenda for the City Council meeting scheduled for Monday, November 19, 1990, and thereafter that it be received and filed. Taylor, Mayor and Members of City Council Roanoke, Virginia Dear Mayor and Members of Council: Subject: Informational Report Ms. Frances F. Mathena 5127 Victoria Street, N.W. Drainage Complaint I. Background: September 20~ 1988, Mrs. Mathena contacted City Engineer's office regarding stormwater runoff from street eroding her property. She was notified that the 5000 and 5100 blocks of Victoria Street are on the City's curb and gutter request list. City Engineer's office issued a work order to the Street Maintenance department to install an asphalt berm to help keep the flow from the street in the street right of way and reduce erosion on her property. The berm was installed in October, 1988. II. Current Situation: Mrs. Mathena appeared before City Council on October 22, 1990 and requested relief from the stormwater runoff from the street. 5000 and 5100 blocks of Victoria Street are still on the City's pending list for curb and gutter improvements. That list of requests from citizens totals in excess of $7.7 million. Engineering Department personnel met with Mrs. Mathena on October 25, 1990 and assessed the problem with her. It seems that the original asphalt berm has been damaged and is no longer effective. Page 2 III. Conculsion: Work Order #156117A has been issued to the Street Maintenance Department to remove the old berm and built-up gravel and to rework the shoulder area in the form of a swale four (4") inches deep with an asphalt berm formed along property side edge. Mrs. Mathena is in agreement with this. Street Maintenance indicates the work should be accomplished by the middle of November, weather permitting. Respectfully submitted, W. Taylor, Mayor and Members of Roanoke City Council Roanoke, Virginia Dear Mayor Taylor and Members of Council: Subject: Funding Proposal by Mr. Melvin Garrett - "Reach and Teach" Program At your September 24, 1990, regular meeting, Mr. Melvin Garrett presented to you a request for funding in the amount of $75,000.00 to support a program which he had developed to provide services to youth. Council referred this matter to me for study and a recommendation back to City Council. The Director of Human Resources, Mr. James D. Ritchie, met with Mr. Garrett on several occasions to review his proposal in detail. Mr. Ritchie has informed me that Mr. Garrett's proposal, although well intended, needs considerable work in terms of the development of the program strategy, as well as financing. Additionally, Mr. Garrett's program, in order to be successful, requires con- siderable coordination with the school system, as well as other community based agencies, which relationships have not yet been defined or consummated. Finally, given the position we currently find ourselves in, relative to state and federal funding reductions, I could not recommend local funding for this project as this expenditure was not anticipated when City Council adopted its fiscal year 1990-91 General Fund Budget. Mr. Garrett was, however, given information by Mr. Ritchie on how to apply for grants that may be available for this purpose. This correspondence is intended to inform you of our response to Council's desire that we work with Mr. Garrett on this matter. FY 91 Budget for the Law Library of }145~048 was adopted by Council in May, 1990. City Code Sec. 18-30(c) states "The assessments collected by the clerks of the courts under this section shall be remitted to the City Treasurer, who shall hold such assessments in a separate fund subject to disbursement for the maintenance of the Law Library." 1. Forty-one thousand seven hundred forty dollars ($41~740) more was collected in FY 90 than was appropriated or expended. Encumbrances of $11~038 from FY 90 were re-appropriated to the Law Library Budget by Ordinance Number 30146-70990 in July, 1990, bringing the Law Library FY 91 Budget to $156~085. Estimated revenues are based on the four-dollar ($4.00) filing fee collected for each case filed in the Circuit and General District Courts times the number of court cases from previous years. D. Revenue excess from the previous fiscal year is transferred to operating accounts during the following fiscal year. II. Current Situation Revenue excess of $30~704 from FY 90 should be appropriated from the Capital Maintenance and Equipment Replacement Program (CMERP) to the Law Library's FY 91 operating budget. FY 91 adopted revenue estimates and appropriations to the Law Library's operating budget should be increased by ~11~000 to reflect the $1.00 increase in filing fee effective October 1, 1989. III. WHEREAS, November 5, November 2, by the terms of a Short Term CDBG Loan Agreement dated 1987, and authorized by Ordinance No. 28850, adopted 1987, a loan in the amount of $962,000.00 in Community Development Block Grant funds was made to Downtown Associates for a two-year term, to provide for refinancing of the rehabilitation and redevelopment of the City Market Building; WHEREAS, Downtown Associates requested an extension of the loan period to November 23, 1990, in order to allow more time for develop- ing of market leasing; WHEREAS, by Ordinance No. 29824-111389, adopted November 13, 1989, City Council authorized the execution of Amendment No. 1 to the Agree- ment, such amendment providing for a one year extension of the then- existing two year short term CDBG float loan; and WHEREAS, the Note securing Amendment No. 1 becomes due and payable on November 23, 1990, and Downtown Associates has requested a sixty (60) day extension of the loan upon certain terms and conditions to allow more time for developing of market leasing. THEREFORE, BE IT ORDAINED by the Council of the City of Roanoke that: 1. The City Manager and the City Clerk are authorized to execute and to seal and attest, respectively, for and on behalf of the City, Amendment No. 2 to the Short Term CDBG Float Loan Agreement, dated November 5, 1987, which Agreement provided for the loan of $962,000 in Community Development Block Grant funds to Downtown Associates, for a period of two years with interest at the rate of three percent (3%) per annum, payable quarterly in arrears, as amended; such Amendment No. 2 to be in the form as is attached to the report of the City Manager dated November 19, 1990, and to be subject to the terms and conditions therein; such Amendment No. 2 to be approved as to form by the City Attorney. 2. Background: City Council aDproved a short-term low-interest CDBG loaq, in the amount of $962,000, to Downtown Associates by Ordinance No. 28850 on November 2, 1987, for the Market Building. Loan was to promote the creation and retention of jobs in the City Market Building. When originally granted, the loan assured the retention of 51 jobs. Currently there are 87 jobs provided within the Market Building, and 21-23 more anticipated. City has received 3% interest per year for three years or $86,580. Council extended the original two-year loan by one additional year by Ordinance 29824, adopted November 13, 1989. C. Loa__n i__s due November 23, 1990. Downtown Associates has requested an extension of loan to allow more time for developing of market leasing. II. Current Situation: Developers of two other Drojects have requested CDBG short-term financing to assist their projects. City's CDBG budget has the capacity to loan only $1,000,000 on a short-term basis, therefore all three loan requests cannot be satisfied. Downtown Associates is seeking assistance of a consultant to recommend improvements which will increase leased space in the Market Building. The closing of the loan extension will occur no later than 5:00 p.m. on November 23, 1990. Benefit to City is provided by time to evaluate proposals and assess the most productive use of CDBG funds. Risk to the City's CDBG program is minimal. The loan is secured by a letter of credit from Dominion Bank, and can be drawn down at any time the City requires funds for CDBG programs or administration. Impact on other CDBG projects is negligible. A sixty day delay in repayment will not affect current projects, and will not impact plans for those projects which have requested CDBG loan funds. Legal: The attached agreement was drafted by the City Attorney's office. Funding is available from the unexpended portion of the City's CDBG allocation. Do not authorize the City Manager to execute the attached amendment to the three-party, short-term, loan agreement. float Benefit to City is undetermined at this point. LOAN, 3. LOAN TERMS, and 4. LETTER OF CREDIT, as follows: 1. LOAN. The City has heretofore drawn from its CDBG letter of Credit with the Federal government funds in the amount of $962,000 to provide short term financing to Downtown Associates for a period of two (2) years with interest at the rate of three percent (3%) per annum from the date of closing of the loan which occurred on November 23, 1987, and for an additional period of one (1) year with interest at the rate of three percent (3%) per annum from the date of closing of the amendment to the loan which occurred no later than November 23, 1989. In order to provide continued short term financing to Downtown Associates, the City agrees to extend the term of the loan for an additional period of sixty (60) days beginning November 23, 1990, and ending January 21, 1991, upon appropriate execution of a Note by - 2 - Downtown Associates evidencinE the indebtedness, and provision by Dominion, at the expense of Downtown Associates, of an uncon- ditional and irrevocable Letter of Credit in the amount of $962,000, the Note and Letter of Credit to be approved as to form by the City Attorney. The date and place of closing on the exten- sion of the Loan shall be as mutually agreed upon by the parties, but shall occur not later than 5:00 p.m. on November 23, 1990. 3. LOAN TERMS. The terms of the Loan extension, including repayment, shall be as set out in the Note attached as Exhibit A hereto and incorporated herein (the "Note"). The Loan extension shall be subject to the due authorization, execution and delivery to the City by Downtown Associates of the said Note in the form attached hereto and of the Letter of Credit described below. The City may, in its discretion, prior to extension of the loan, require the receipt of additional documents, duly executed by the respective parties hereto, deemed advisable or necessary to further evidence or document the Loan or Letter of Credit, or which may be required by HUD. 4. LETTER OF CREDIT. Dominion shall, prior to extension of the Loan, at the expense of Downtown Associates, deliver to the City a duly authorized and executed, unconditional and irrevocable Letter of Credit in the amount of $962,000, in the form of the Letter of Credit attached hereto as Exhibit B (the "Letter of Credit"). The Letter of Credit shall be drawn so as to be in effect for a period of at least thirty (30) days past the maturity date of the Note. - 3 - All terms and conditions of the Short Term CDBG Float Loan Agreement dated November 5, 1987, as amended by Amendment No. 1, but not amended herein, shall remain unchanged and in effect. Background: City Council, at its October 22, 1990 meeting, publicly opened and read aloud the bids received to Paint the Ground and First Floors of the Commonwealth Building. Three (3) bids were received with Williams Painting and Remodeling, Inc. of Roanoke, Virginia submitting the low bid in the amount of $26~800.00 and ninety (90) consecutive calendar days. -- Ce Work covered by this contract would repair all damaged sur- faces on these two levels and apply one prime coat to the repaired surface followed by one full coat of paint on all surfaces that are now painted. II. Current Situation: Ae The City of Roanoke lease with the Commonwealth of Virginia for this building states that the City of Roanoke would be responsible for the maintenance and repair of the facility and the Commonwealth would reimburse the City yearly for the cost of the service. Any major remodeling would have to be approved by the Commonwealth before being executed. Bids for this project were submitted to the Commonwealth for their approval and they stated that they did not wish to pur- sue the project at this time (see the attached letter). III. Issues in order of importance are: A. Compliance of the bidders with the requirements of the Contract Documents. B. Amount of the low bid. Page 2 C. Funding of the project. D. Time of completion. IV. Petition to zone for historic district overlay was filed on August 9, 1990. Historic preservation in downtown Roanoke and in the City's neighborhoods has been a successful revitalization tool. Property values have increased and community awareness, appreciation, and interests have been stimulated. Roanoke Vision recognized the value of historic preservation, especially in downtown and in the City's inner neighborhoods. It was recommended that more historical/cultural sites be inventoried and regulations enacted to preserve landmarks. Ee Design 79 and Design 85 also recognized the importance of historic buildings in downtown and encouraged their protection and rehabilitation. Two public hearings were held before the Planning Commission in 1988 that were supplemented by numerous information and working meetings between Commission and Architectural Review Board members, City staff, property owners and developers. The results of those meetings were the creation and subsequent adoption by City Council of three (3) preservation programs that offer financial and technical assistance to property owners and developers in the H-1 district. Planning Commission public hearing was held on Wednesday, October 3, 1990. Mr. Michael Murphy, Patrick Henry Hotel Investors, Inc., appeared before the Commission and briefed the Commission on the history of the Patrick Henry Hotel. He said that the Patrick Henry Hotel Investors group was committed to preserving the architectural integrity of the building. He continued by stating how excited the investors were about the restoration and refurbishing project and that his group intended to take advantage of the City's financial incentive programs. Mr. Murphy also informed the Commission that at a later date, the investors would be pursuing National Register nomination of the buildings. Mr. Bradshaw asked Mr. Murphy if he was aware of the requirements placed on the buildings within the H-1 overlay. Mr. Murphy assured Mr. Bradshaw that he was very familiar with the H-1 regulations and intended to work with the Architectural Review Board. Mrs. Dorsey gave the staff report and stated that staff recommended approval of the rezoning request. Issues: H-1 zoning will provide protection for the structure and ensure sensitive and appropriate treatment of the architectural features should exterior changes be proposed. The zoning would also encourage rehabilitation and continued use of the structure rather than demolition. Expansion of the H-1 district by including the Patrick Henry Hotel would protect this important landmark for future generations. Continued revitalization of downtown is dependent on maintaining significant architectural and historical buildings, maintaining intact groups of buildings, and ensuring appropriate construction for contributing structures. City sponsored preservation incentive programs will become available to assist the property owner in protecting and maintaining this landmark structure. Comprehensive Plan has recommended that the City have a stronger preservation program and begin protection of significant local and existing or potentially eligible state and national register properties. III. Alternatives: A. City Council approve the zoning request. H-1 zonin~ would provide protection to this landmark building and ensure sensitive treatment of any exterior alterations. Expansion of the H-1 district by including the Patrick Henry Hotel would help protect both public and private investments downtown. Continued revitalization of downtown would be continued by ensuring that such a significant building as the Patrick Henry Hotel would be maintained and appropriate rehabilitation takes place. City-sponsored preservation incentive pro~rams would be available to the property· Comprehensive plan recommendations for the protection and preservation of significant historic and architectural landmark structures in the community would be followed. B. City Council deny the zoning request. H-1 zonin~ would not be extended to include this significant downtown building which could possibly result in the structure being adversely altered or demolished without public involvement. Since February, staff has studied successful preservation ~rogram~ and the City Manager has recoz~ended several incentives to City Council for adoption. These programs are: Expansion of the City's existing Tax Abatement Program from five years to ten years for properties in an H-1 or H-2, Historic district. Ordinance to be effective on January 1, 1989. Establishment of a City-sponsored Low Interest Loan Program to provide for rehabilitation of historic structures in H-1 districts. At present, the initial funding level is proposed to be $100,000. Establishment of a technical services assistance f~na to assist property owners and developers in H-1 districts with various technical issues associated with the development of historic properties. These could include architectural or engineering design services, National Register no,nations, tax act coordination or financial coordination. At present, the recommended level of funding is $20,000. M_eetings with property owners to discuss H-1 zoning and the incentive programs were held the week of September 26, 1988. A general information meeting was held on September 28. Second public hearing before the Planning Commission was held on October 5, 1988. Mr. W. L. Whitwell, Chairman of the Architectural Review Board and Mrs. Martha B. Boxle~, President of the Roanoke Valley Preservation Foundation, spoke in favor of the zoning request. Several property owners spoke in opposition to the request. Mr. Frank Boxle~, trust executor for the Boxley Building, advised that the building had been restored to National Register standards and that the incentives available would not benefit the building. The Boxley trust was committed to maintaining the historical integrity of the building, but did not want to enc,,mher additiona% regulatory requirements in the future. Mrs. C~nthia Gardner, owner of three warehouses, Blain Supply Company, spoke in opposition. She felt that the incentives would not be helpful to Blain Supply Company, that the application of the H-1 district to individual buildings versus a block(s) of str~ctures was not appropriate, and that she considered the zoning a "taking of rights without compensation." Mr. Frank Ro~ers, re~resentin~ Mr. Jame~ Trinkle, appeared before the Co~ission and advised that Mr. Trinkle was opposed to the zoning unless the City exercised its option on October 12. Mr. Ed Hall and Mr. T. D. Steele also addressed the Comission and indicated their concern for limiting future new office development in downtown by preserving individual buildings. II. In January, 1988, the Architectural Review Board recommended to the Planning Commission that the H-l, Historic district designation, be given to those buildings in the downtown area that are on the National Register of Historic Places, or are eligible for the National Register of Historic Places. Zoning request was tabled to allow more time for property owners to discuss H~i zoning with staff and to allow staff time to investigate financial incentives that could be implemented to offset concerns of property owners. Numerous persons spoke at the public hearing including those for both the H-1 zone protection and those against. Since February, staff has studied successful preservation programs and the City Manager has recommended several incentives to City Council for adoption. City Council has endorsed them and has scheduled a public hearing for October 10, 1988, to provide funding and officially adopt recommended programs. These programs are: Expansion of the City's existing Tax Abatement Program from five years to ten years for properties in an H-1 or H-2, Historic district. Ordinance to be effective on January 1, 1989. 2o Establishment of a city-sponsored Low Interest Loan Program to provide for rehabilitation of historic structures in H-1 districts. At present, the initial funding level is proposed to be $100,000. Establishment of a technical services assistance fund to assist property owners and developers in H-1 districts with various technical issues associated with the development of historic properties. These could include architectural or engineering design services, National Register nominations, tax act coordination or financial coordination. At present, the recommended level of funding is $20,000. Go Meetings with property owners to discuss H-1 zoning and the incentive programs were held the week of September 26, 1988. A general information meeting was held on September 28. Second public hearing before the Planning CoF~ission was held on October 5, 1988. Mr. W. L. whitwell, Chairman of the Architectural Review Board and Mrs. Martha B. Boxley, President of the Roanoke Valley Preservation Foundation, spoke in favor of the zoning request. Several property owners spoke in opposition to the request. Mr. Frank Boxley, trust executor for the Boxley Building, advised that the building had been restored to National Register standards and that the incentives available would not benefit the building. The Boxley trust was committed to maintaining the historical integrity of the building, but did not want to encumber additional regulatory requirements in the future. Mrs. Cynthia Gardner, owner of three warehouses, Blain Supply Company, spoke in opposition. She felt that the incentives would not be helpful to Blain Supply Company, that the application of the H-1 district to individual buildings versus a block(s) of structures was not appropriate, and that she considered the zoning a "taking of rights without compensation." Mr. Frank Rogers, representing Mr. James Trinkle, appeared before the Commission and advised that Mr. Trinkle was opposed to the zoning unless the City exercised its option on October 12. Mr. Ed Hall and Mr. T. D. Steele also addressed the Commission and indicated their concern for limiting future new office development in downtown by preserving individual buildings. II. Issues: ao H-1 zoning will provide protection for the structures and ensure sensitive and appropriate treatment of the architectural features should exterior changes be proposed. The zoning also would encourage rehabilitation and continued use of the structure rather than demolition. Bo Continued revitalization of downtown is dependent on maintaining significant architectural buildings, maintaining intact groups of buildings, and ensuring appropriate construction for contributing structures. Expansion of the H-1 district will protect property values for adjoining property owners and will help maintain these important landmarks for future generations. Financial incentives will assist property owners and developers of historic structures. Eo Comprehensive plan has recommended that the City have a stronger preservation program and begin protection of significant National Register properties. III. Alternatives: ao Approve the zoning request. 1. H-1 zoning would provide protection for these significant landmarks and ensure sensitive treatment of any exterior alterations. H-1 zoning would not prohibit demolition. Rather, it would provide a framework for pursuing alternatives to demolition. 2o Revitalization effort for downtown would be continued. Development plans for the City and downtown would be followed. 3o Expansion of the H-1 district would protect both public and private investments. 4. Financial incentives available to historic properties. 5. Comprehensive Plan followed. B. Deny the rezoning request. H-1 zoning would not apply to significant downtown landmarks. Petition to rezone was filed on August 16, 1990. First amended petition to rezone was filed on September 19, 1990. Plannin~ Commission public hearing was held on Wednesday, October 3, 1990. Mr. Bill Cruey, attorney, appeared before the Commission and stated that he represented Woodmen of the World. He noted that the property had been correctly zoned while in the County. Mr. Cruey explained that the Woodmen wanted to construct an addition on the rear of their present structure, but when applying for a building permit, had found they did not have the proper zoning, he further noted that the structure was located approximately 600 feet off of Peters Creek Road and the addition would be at the rear of the present structure and would not be seen from Peters Creek Road. He also noted that there was a large area in the rear that would remain Mrs. Dorsey gave the staff report and noted that staff recommended approval of the request. She said that the zoning would bring an existing nonconforming use into the correct zoning category. She said that the rear portion of the site had been proffered to remain RM-2 and would remain in its existing vegetative state. There was a question from the Commission relative to the buffering around the sides of the property and staff advised that all property lines that adjoin residentially zoned districts are required to be buffered. Issues: Zonin~ of the subject property is currently RM-2 and C-2. The surrounding zoning in the area is as follows: to the north and south, RM-2 zoning; to the west, RS-3 zoning; and to the east, C-2 zoning. Land use of the property is a fraternal organization camp/lodge facility. Land uses surrounding the site are as follows: to the north, single family residences and vacant, undeveloped land; to the south, a church; to the east, vacant, undeveloped commercially zoned land; and to the west, the undeveloped wooded portion of the subject property and a single family residential subdivision to the north and west of that area. Utilities are available and adequate. During and upon completion of the proposed construction, the petitioner will comply with the City's storm water management policy and erosion/sediment control ordinance for "0" runoff on adjoining properties. Access to the subject property is provided by a single 16 foot wide private paved driveway from Peters Creek Road. The proposed storage facility addition will not increase vehicular or pedestrian demands on the site. Screenin~ would be required by the zoning ordinance for those property line boundaries of the subject property that adjoin residentially zoned areas. The proffered (conceptual) site plan indicates a 10 foot wide buffer of plant material along the southern property line. The existing vegetation on the western portion of the subject property to remain RM-2 will serve to buffer the adjoining residential development. Neighborhood organization is the Peters Creek Civic League. The Planning Office notified their president in writing of the rezoning request on September 19, 1990, and no comments have been received by this office as of the date of this report. G. Comprehensive Plan recommends that: Neighborhood character and environmental quality be protected. Expanded commercial development is carefully evaluated to ensure minimal conflict with residential areas. Promote development of facilities and services that enhance the community's livability. III. Alternatives: A. City Council aDDrove the rezoning request. Zoning of this portion of the property would be C-2, General Commercial District. Land uses would be the fraternal lodge/clubhouse that would become a conforming use. Construction of the proposed storage facility addition could occur. Utilities to the property are adequate but unaffected by the proposed rezoning and storage facility addition. Access to and from the site would continue to be from the existing 16 foot wide paved driveway as indicated. Screening will be provided by the proffered landscaping buffer area, the preservation of existing vegetation on the property and the supplemental planting required as a result of the comprehensive development plan review process. Neighborhood realizes that the proposed storage facility addition to the existing clubhouse would have no negative impact on the area nor increase the functions or activities of the clubhouse. Comprehensive Plan issues as set forth would be followed. B. City Council deny the rezoning request. Zoning of the site remains C-2 along the Peters Creek Road frontage and RM-2 for the balance of the property. The existing use and structure would remain nonconforming in conflict with the existing zoning ordinance. Land use would remain a fraternal lodge/ clubhouse with portions of vacant, undeveloped commercial and residentially zoned areas to the east and west of the building. 3. Utilities would be unaffected. Access would remain as is and would not be an issue. 5. Screening would not be required. Neighborhood would remain unchanged. Comprehensive Plan issues as set forth could be followed at a later date. IV. Recommendation: By a vote of 5-0 (Mr. Bradshaw absent), the Planning Commission recommended approval of the rezoning request. The rezoning would place an existing nonconforming building and use into a conforming zoning status and would allow for the construction of a storage facility addition. The preservation of the rear portion of the property as residential in conjunction with the proffered landscaping buffer area as well as the preservation of the substantial natural vegetation on the western portion of the property, demonstrate the petitioner's awareness and sensitivity to the neighborhood and a desire to continue to be a quality and harmonious development in the area as set forth in the comprehensive plan. Said portion of tract is currently zoned P/fl-2. A map of the property to be rezoned is attached as Exhibit Pursuant to Article VII of Chapter 36.1-690, Code of the City of Roanoke (1979), as amended, the Petitioner requests that a portion of the said property be rezoned from R~-2, Residential Multi-Family District, to C-2, General Commercial District, subject to certain conditions set forth below, for the purpose of bringing the existing clubhouse into conformance with the current zoning regulations and for the addition of a 50' X 30' storage facility. So that expansion can be permitted. The Petitioner believes the rezoning of the said tract of land will further the intent and purposes of the City's Zoning Ordinance and it comprehensive plan, in that the rezoning will further facilitate the use of the existing land use and development on the subject project. The Petitioner hereby proffers and agrees that if the said tract is rezoned as requested, that the rezoning will be subject to, and that the Petitioner will abide by, the following conditions: 1. That the property will be developed in substantial conformity with the prepared site plan to add a 50' X 30' extension on back of the existing clubhouse, a copy of which is attached to the Petition for Rezoning as Exhibit"B" subject to any changes required by the City during site plan review. 2. That if no building permit has been issued and no construction commenced within three (3) years from the date of final zoning approval, the zoning shall revert to RM-2, Residential Multi-Family District, without further action by City Council. Attached as Exhibit "C" are the names, addresses, and tax numbers of the owner or owners of all lots or property immediately adjacent to or immediately across a street or road from the property to be rezoned.
