Interviews were conducted by the selection com- mittee on July 19, 1990. Smithey & Boynton~ P.C. was selected as the best qualified architectural/engineering firm for this particular project; they designed Fire Stations 6 and 13 and the remodeling for Fire Station 3. De Project consists of the design of a new, two apparatus bay fire station similar in function to Fire Station No. 13 on Appleton at Peters Creek, N.W., which was designed by Smithey & Boynton, P.C. In addition, this fire station will provide for female fire fighters, with bedroom and toilet facilities, and will also provide for Emergency Medical Services to be housed within the fire station in a portion of one of the bays. Allocation provides funds for services to improve care and preparation of teenagers and other children in foster care for, ultimately, independent living through foster home recruitment, training of foster parents and social work staff, and development of local training efforts to help foster care youth to develop skills necessary for successful independent living. II. CURRENT SITUATION A. Independent Living Services are 100% reimbursed by the State Department of Social Services. B. City Council is requested to appropriate revenue for supplemental funds allotted by the State Department of Social Services. III. ISSUES A. Services to eligible foster care children. B. Funding. IV. ALTERNATIVES A. Appropriate revenue of $14,014 to provide for Independent Living Services to eligible children. Services to eligible children 16 years and older will be available to assist them in making the transition from foster care to independent living. I. Back~round Peat Marwick, in their 1989 "Letter of Recommendations" recommended that the City implement a Security Software System. The security system is a computer software program which will strengthen controls which limit access to data stored on the City's mainframe computer. City Manaqement a~reed with the recommendation and funds were earmarked in the 89-90 Internal Services Fund Retained Earnings account. CIS Technical Services staff has been expanded by one position in order to install and maintain the system. Funds were allocated in FY 90-91 for this expansion. RFP specifications for the Security Software System were developed and sent to eighteen (18) vendors on September 9, 1990. RFP responses for the Security Software System, after due and proper advertisement, were received and publicly opened and read in the Office of General Services, at 2:00PM, on October 23, 1990. II. Current Situation Two companies responded, with proposals on three software packages. It is our understanding that these are the only companies marketing security software for the City's Mainframe. Ail RFP responses were evaluated in a consistent manner on seven (7) year costs. See Bid Tabulation, Attachment A. All three proposed packages meet the mandatory requirements. "Furtherance of trade or business" as used in this article shall mean payment made by or on behalf of a trade or business organization; payment made by an individual from an account which the individual uses primarily for trade or business purposes; payment made by an individual who is reimbursed for the payment by the individual's employer or by a trade or business organization; or other payment made in connection with an individual's trade or business, including entertaining clients or busi- ness associates, holding meetings or other business-related events. "Regularly accepts payment" as used in this article shall mean accepting as many payments during the course of a year as the number of weeks any part of which any institution, club, organization or place of accom- modation is available for use by members or nonmembers per year; the payments may be for dues, fees, use of space, facilities, services, meals or beverages. Sec. 16-2. Prohibition a~ainst discrimination. Any institution, club, organization or place of accommodation which (1) has more than 200 members, (2) provides regular meal service and (3) regularQy accepts payment for dues, fees, use of space, facilities, services, meals or beverages, directly or indirectly, from or on behalf of nonmembers for the furtherance of trade or business shall be considered a place of public accommodation for purposes of this article, and shall not discriminate on account of race, - 3 - color, national origin, creed, religion, or sex, determining its membership, or in providing full enjoyment of its accommodations, facilities and services. in Sec. 16-3. Exceptions. The provisions of this article shall not apply to an institution or corporation organized and operated exclusively for religious purposes as defined in 26 U.S.C. §501(c)(3); nor shall this article apply to lodges or other fraternal and benevolent orders or associations organized for the benefit of members therein and their beneficiaries and not for profit. Sec. 16-4. Enforcement and penalties. (a) Civil Action. Any person may enforce the provi- sions of this article by means of a civil action. The City may also enforce the provisions of this article by means of a civil action. (b) Injunctions. (1) Any person who commits an act, or proposes to commit an act, or engages in any pattern and practice of discrimination in violation of this article may be enjoined therefrom by any court of competent jurisdiction. 2) Action for injunctions under this subsection may be brought by any aggrieved person, by the City, or by any person or entity who will fairly and adequately represent the interest of the protected class. (c Criminal Penalty. Any person violating any of the provisions of this article shall, upon conviction, be guilty of a Class 3 misdemeanor. (d) Non-exclusive remedies and penalties. Nothing in this article shall preclude any person from seeking any other remedies, penalties or procedures provided by law. 2. In this regard, I am pleased to present the attached ordinance for the consideration of City Council. By way of background, the 1989 Session of the General Assembly added a new subsection 31.1 to ~2 of the 1952 Charter of the City of Roanoke, as amended. New subsection 31.1 of §2 authorizes City Council "[t]o enact an ordinance, after public hearing, to define places of public accommoda- tion and to prohibit discrimination in such places of public accommodation on the basis of race, creed, color, national origin or sex." A public hearing has been scheduled and properly advertised for your meeting of November 26, 1990. At such public hearing, all persons having an interest in the attached ordinance should be permitted to comment. Please pay particular attention to the first two pages of the proposed ordinance. The "whereas clauses" set out here constitute the legislative findings which are necessary to support the "compelling interest" Council has in regulat- ing the institutions, clubs, organizations or places of accommodation subject to the ordinance. Pursuant to authority granted by the General Assembly~ the ordinance defines a "place of public accommodation" and prohibits discrimination by such places on account of race, creed~ color, national origin or sex in determining member- ship or in providing full enjoyment of accommodations, facilities and services. A "place of public accommodation" Honorable Mayor and of City Council November 26, 1990 Members Page 2 subject to the ordinance is defined as any institution, club, organization or place of accommodation which meets the fol- lowing criteria: (1) has more than 200 members; (2) provides regular meal service; and (3) regularly accepts payment for dues, fees, use of space, facilities, services, meals or beverages, directly or indirectly, from or on behalf of nonmembers for the further- ance of trade or business. See §16-2 of proposed ordinance. This definition of "place of public accommodation" is essen- tially the definition approved by the Supreme Court of the United States in New York State Club Association v. New York City, 487 U.S. 1 (1988), although I have reduced the member- ship threshold for coverage from 400 members to 200 members. I am of the opinion that such reduction in the membership threshold is reasonable and appropriate given the differ- ence in the populations of New York City and the City of Roanoke. Because of the membership characteristics of the organizations subject to the New York City ordinance, the Supreme Court concluded that these organizations are not distinctly private in nature and are, in fact, commercial in nature. Therefore, the Supreme Court held that the New York City ordinance did not infringe upon the private associational rights of club members. See New York Club Association, id. at 9-10. Please note that (1) institutions or corporations organized and operated exclusively for religious purposes and (2) lodges or other fraternal and benevolent orders or associations organized for the benefit of members therein and their beneficiaries and not for profit are exempted from the proposed ordinance. See §16-3. Religious organiza- tions, lodges and fraternal and benevolent orders do not engage in commercial activities for the benefit of nonmem- bers. These organizations enjoy First Amendment asso- ciational protections which anti-discrimination ordinances may not reach. See New York State Club Association, id. at 13-15. Section 16-4 of the proposed ordinance relates to en- forcement and penalties. The ordinance will be enforced by Honorable Mayor and Members of City Council November 26, 1990 Page 3 civil action, injunction and a criminal penalty in the form of a fine not to exceed $500.00. Finally, I call to your attention that the proposed ordinance carries an effective date of July 1, 1991. Thus, any noncomplying place of public accommodation will have a reasonable time period in which to voluntarily bring its membership policies into compliance with the ordinance prior to its effective date. I am not aware that any other local government of the Commonwealth has adopted an anti-discrimination ordinance similar to the ordinance before City Council. By adoption of the attached ordinance, the City of Roanoke will assume a position of leadership in the Commonwealth in dealing with this important societal issue.
