A report recommending award of an engineering services
contract to Hayes, Seay, Mattern & Mattern, Inc., in an
amount not to exceed $176,000.00, in connection with
the realignment and reconstruction of Thirlane Road,

A report concurring in a report of the Bid Committee
recommending acceptance of the bid submitted by Outdoor
Aluminum, in the amount of $16,659.22, for installing

Berglund Chevrolet, Inc., in the amount of $17,246.75~
Allred Chevrolet~ Inc., in the amount of $22,358.00,

AN ORDINANCE temporarily changing the polling place for Williamson
Road Precinct No. i from Oakland Elementary School to the Huntington
Court United Methodist Church Fellowship Hall; providing for an emer-
gency and an expiration date for this ordinance.
WHEREAS, Oakland Elementary School will be under renovation during
the 1989-1990 school year, and such renovation will make unavailable
the normal polling place for Williamson Road Precinct No. 1;
WHEREAS, the Electoral Board has recommended the establishment
of a temporary polling place for Williamson Road Precinct No. 1 at
the Huntington Court United Methodist Church Fellowship Hall at 3333
Williamson Road, N. W., and such temporary polling place is within the
boundaries of Williamson Road Precinct No. i as required by S24.1-36,
Code of Virginia (1950), as amended; and
WHEREAS, the temporary change of polling place for Williamson Road
Precinct No. 1 has been duly advertised in a newspaper having general
circulation once a week for two consecutive weeks, pursuant to
§24.1-39, Code of Virginia (1950), as amended, and a public hearing
with respect to such proposed temporary relocation has been held on
May 8, 1989;
THEHEFOHE, BE IT ORDAINED by the Council of the City of Roanoke as
follows:
1. Notwithstanding ~10-30, Code of the City of Roanoke (1979),
as amended, the polling place for ~illiamson Road Precinct No. 1 shall
be relocated from Oakland Elementary School to the Huntington Court
United Methodist Church Fellowship Hall, 3333 Williamson Road, N.
Roanoke, Virginia, in this City for the school year 1989-1990 only.
2. Such temporarily relocated polling place shall be applicable
for the November 7, 1989, and May 1, 1990, general elections and any
primary or special elections required during the 1989-90 school year
only.
3. The City Clerk is directed to forward attested copies of this
ordinance to Audrey M. Franklin, Registrar, so that notice of this
change in polling place can be mailed to all registered voters of
Williamson Road Precinct No. 1 as required by law.
4. In order to provide for the usual daily operation of the
municipal government, an emergency is deemed to exist, and this ordi-
nance shall be in full force and effect upon its passage and shall
expire by its own terms on the last day of the 1989-1990 Roanoke City
Public School year. Upon the expiration of this ordinance the polling
place for Williamson Road Precinct No. 1 shall be returned to Oakland
Elementary School.

NOTICE OF PUBLIC HEARING
TO WHOM IT MAY CONCERN:
Pursuant to §24.1-39 of the Code of Virginia (1950), as
amended, the Council of the City of Roanoke will hold a
public hearing on Monday, May 8, 1989, at 7:30 p.m., in the
Council Chamber of the Municipal Building in the said City,
on the proposed temporary relocation of the polling place
for Williamson Road Precinct No. i from Oakland Elementary
School to Huntington Court United Methodist Church Fellow-
ship Hall, 3333 Williamson Road, N. W., Roanoke, Virginia.
This temporary relocation would be effective for the
November 7, 1989, and May 1, 1990, general elections and any
primary or special elections required during the 1989-1990
school year only.
Ail parties in interest and citizens may appear on the
above date and be heard on the question.

Temporary relocation of polling place for Williamson Road
No. i Precinct
By Council report dated April 3, 1989, the Electoral Board has
advised City Council that it will be necessary to relocate the poll-
ing place for Wllliamson Road No. i Precinct from Oakland Elementary
School to the Huntington Court United Methodist Church Fellowship Hall
during the 1989-1990 school year only. This relocation is due to the
renovation of Oakland Elementary School. City Council has set a pub-
lic hearing at 7:30 p.m. on May 8, 1989, with respect to the proposed
polling place relocation.
I have attached for your use a Notice of Public hearing to be pub-
lished in the Roanoke Times & World News. According to $24.1-39, Code
of Virginia (1950), as amended, this notice must be published once a
week for two consecutive weeks. I would recommend publication on April

been completed at this time; and
WHEREAS, the City Sheriff recommended the additional tables
and bunks (one table and five bunks to each of the original day
rooms) to relieve overcrowding at the City Jail at a total cost
of $7,646.00;

portion of the Jail, and request for reimbursement for the

Work was completed at a total cost of $813~000.00 and the
City was reimbursed in the amount of $406~047.90 by the
Commonwealth Department of Corrections for the project.

Overcrowdin~ continues to be a problem and for this reason
six (6) tables and thirty (30) bunks are being added to the
main floor level in each of the existing six day rooms and
thirty cells on the third floor level. Ail minimum and
medium security cells on the floor level of the second and
third floor are now double bunked (not the balcony levels).
Pursuant to Ordinance No. 29510, adopted April 3, 1989, a
contract was executed with Security Detention Equipment, Inc.
to perform the fabrication and installation of the six (6)
tables and thirty (30) bunks. Contract amount was $7,646.00
and 24 consecutive calendar days.
Current Situation:
A.
Reimbursement of project costs by the State Board of
Corrections is possible for all approved jail construction,
enlargement or renovation projects at a rate of 50% of the
project cost.

cating approval of the Jail expansion project by City
Council. Other forms are being completed and forwarded by

United Parcel Service (U.P.S.) plans to locate a facility on
a 50~ acre site along Thirlane Road, N.W., requiring approxi-
mately 1.6 miles of realignment and reconstruction of the
road.
B. Engineering design services for the roadway and related
utilftles are needed.
Current situation is that Engineering Services Qualification Pro-
posals for the project were publicly advertised on February 19,
1989 and seven (7) proposals were received on March 10, 1989 from:

AGREEMENT FOR ENGINEERING SERVICES
This Agreement made this 21st day of April , 1989, between the City of
Roanoke, Virginia ("the -C~-~"), and Hayes, Seay, Mattern & Mattern, Inc.,
Architects-Engineers-Planners~ with offices at 1315 Franklin Road SW, Roanoke,
Virginia ("the Engineer").
WITNESSETH:
WHEREAS, the City proposes to engage the services of the Engineer to provide
engineering services for approximately ~.6 miles of roadway, along with sanitary
sewers, water distribution, storm drainage, landscaping, construction contract
administration and surveying with the necessary recordation plats and plans and
specifications in accordance with Virginia Department of Transportation procedures
and standards.
WHEREAS, the Engineer has been duly selected by the City for the performance of
the project services as defined below.
WHEREAS, the Engineer agrees to furnish executed "Certification of Engineer" and
certain professional engineering services enumerated hereinafter, in connection
with the Project.
NOW, THEREFORE, in consideration of the mutual covenants set out below, it is
agreed between the parties as follows:
ARTICLE I - ENGINEER'S BASIC SERVICES
The Engineer shall perform engineering design and construction administration
services under this Agreement in accordance with the terms and conditions set
forth herein. It is understood that references to the City described herein, as
appropriate, shall mean the City Manager or his representatives authorized to act
in the City's behalf. The Engineer's Basic Services include:
A. Roadway Design and Roadway Landscaping.
The plans and specifications for the project will be prepared in
accordance with the Virginia Department of Transportation Design
Standards and Specifications and other City of Roanoke standards as
appropriate.
During the preliminary design stage of the project two (2) separate
alignments will be studied. The study will include the development
of both horizontal and vertical alignments and vertical cross
sections. A comparative analysis will be made for both alignments.
Traffic impact analysis will consist of a capacity anlaysis of the
Thirlane Road and Peters Creek Road intersection, based on the
existing and design year traffic. Design year traffic will be
adjusted to allow for projected Thirlane Road development. The
estimated fee is based on the assumption that the existing and design
year A. M. and P. M. peak hour turning movements are available from
the City of Roanoke or other governmental agencies.

Plans for improvements to Peters Creek Road are limited to the
lengthening of turning lanes and possibly widening the crossover to
accommodate turning vehicles. Development of plans for additional
lanes on Peters Creek Road is not included.
Subsurface geotechnical investigation and pavement design will be
based on five (5) CBR samples and tests, a slope stability analysis
of the existing embankment for Runway 5 and the utilization of
geotechnical data obtained for nearby sites or any other existing
data in keeping with good engineering practice.
The preparation for or participation in a location and design public
hearing is not included.
Roadway landscaping will be limited to the general area of the Peters
Creek Road entrance. Seeding of roadway slopes will be included as
part of the roadway construction.
Construction administration is based on an eight-month construction
contract. A full time project inspector and the testing of materials
are not included.
The Engineer agrees to furnish and perform the various profess-
ional engineer services required for the design of the Project as
follows:
a. Attending as needed, detailed conferences with the City and other
agencies involved in the development of the Project.
Analyze the proposed site, establish design objectives and
develop a project criteria and program to serve the Project
requirements as identified by the City.

Hold conferences with the City to review the City's wishes and
requirements, inspection of the site, review of available
material assembled by the City, and discussion of scheduling.
Conference also may be held with various approving and regulatory
agencies of the federal and state government.

cations and reports, where applicable, and the Engineer's
specific recommendations.

Topographic mapping covering 100 feet each side of the centerline
will be provided on plan and profile sheets at a 1 inch : 50 feet
scale with two foot contour intervals. An additional 200 foot strip
of mapping will be required during preliminary design for the
alternate alignment through the airport property. In the vicinity of
Runway 5 an additional 100 feet on each side of the centerline will
be taken to ensure coverage of all possible alignments.
All ground control to accomplish the above will be established. The
proposed centerline will be staked after the completion of final
alignment computations.
Based on the current City of Roanoke tax maps, ~7 parcel plats and
four easement plats are included. This does not preclude additional
parcels being discovered and plats provided up to ~5% more at no

additional cost to the City.
¢. Sanitary Sewer and Water Distribution.
The sanitary sewer includes approximately 2,900 linear feet. This
line will extend from an existing manhole in the vicinity of the
Comfort Inn to the north along the proposed Thirlane Road alignment
to a point near the southeast corner of the proposed retention pond
of the UPS property. This item is for UPS.
The water distribution system includes approximately 7~000 feet. This
line will extend from an existing line in the vicinity of the Comfort
Inn along the existing property line to the right-of-way on Thirlane
Road. From there the line will follow the proposed Thirlane Road
alignment to the north until it connects with another existing line
in the vicinity of the Virginia Department of Transportation Area
Headquarters. The portion of the line extending from the connection
in the vicinity of the Comfort Inn to a point near the southeast
corner of the proposed retention pond on the UPS property is 4,800
feet and is for UPS. The additional 2,200 feet is for the City of
Roanoke.
The Engineer will provide the City with all geographical information
relating to this project in digital form suitable for use with Auto Cadd
Version 10 and DCA Cogo in addition to other work related herein.
ARTICLE II - RESPONSIBILITIES OF THE CITY
A. Provide all existing and design year A. M. and P. M. peak hour turning
movements for Thirlane Road and Peters Creek Road.
B. Provide a full time construction inspector for the entire construction
period.

ARTICLE IV - PAYMENT FOR SERVICES
A monthly invoice will be rendered by the Engineer (stating manhours, equipment
costs, and approved overhead-profit factors used), as shown in Attachment A,
Computation of Projected Ceiling Cost, attached hereto as Exhibit I, and incor-
porated herein by reference, giving the actual cost incurred during the billing
period. Total payroll costs for the professional services provided will be based

on the summation of actual hours worked times the actual pay rate of each person
working on the project. Payroll and general and administrative overhead totaling
135.4 percent of the total actual payroll costs shall be added to the total actual
payroll costs to establish total salary costs. The maximum compensation to the
Engineer for Basic Services as shown on the Projected Ceiling Cost on Exhibit I
shall not exceed $176,000.00 without formal amendment to this Agreement, including
scope of services by authorization of Roanoke City Council. After receiving all
required materials and determining work claimed has been performed satisfactorily,
the City will pay the invoice promptly.
ARTICLE V - ENGINEER'S ACCOUNTING RECORDS
The Engineer's accounting records shall be kept on the basis of generally accepted
accounting principals and shall be available to the City at mutually convenient
times. Such accounting records shall substantiate invoices submitted by the
Engineer.
ARTICLE VI - TERMINATION OF AGREEMENT
This Agreement may be terminated by either party upon fourteen (]4) days' written
notice should the other party fail substantially to perform in accordance with its
terms through no fault of the party initiating the termination.
Except for termination in the case where the Engineer fails substantially to
perform in accordance with the terms of this Agreement, the fee to be paid the
Engineer upon termination of this Agreement will be equitable to cover all
services rendered. Data, including plans, sketches, computations, charts,
surveys, etc. shall be made available to the City without restrictions or
limitations on their use.
ARTICLE VII - GENERAL
The Engineer shall serve only in a consulting and professional capacity as set
forth in this Agreement. The public dissemination of information relative to the
Project will be handled by or through the City.
ARTICLE VIII - SUCCESSORS AND ASSIGNS
The City and the Engineer each binds itself, its successors, assigns, and legal
representatives to the other party to this Agreement. Neither the City nor the
Engineer shall assign its interest in this Agreement without the written consent
of the other.
ARTICLE IX - EXTENT OF AGREEMENT
This Agreement represents the entire and integrated Agreement between the City and
the Engineer and supersedes all prior negotiations, representatives or agreements,
either written or oral. This Agreement may be amended only by written instruments
signed by both the City and the Engineer.
ARTICLE X - ENGINEER'S INSURANCE
The Engineer shall provide the City with a certificate of their "Architects and
Engineers Professional Liability Insurance" as a matter of record for the City.

ARTICLE XI - ENGINEER'S EMPLOYMENT PRACTICES
During the performance of this Agreement, the Engineer agrees as follows:
1. The Engineer will not discriminate against any subcontractor,
employee, or applicant for employment because of race, religion,
color, sex or national origin, except where religion, sex or national
origin is a bona fide occupational qualification reasonably necessary
to the normal operation of the Engineer. The Engineer agrees to post
in conspicuous places, available to employees and applicants for
employment, notices setting forth the provisions of this nondiscrimi-
nation clause.
The Engineer, in all solicitations or advertisements for employees
placed by or on behalf of the Engineer, will state that the Engineer
is an equal employment opportunity employer.

Notices, advertisements, and solicitations placed in accordance with
federal law, rule or regulation shall be deemed sufficient for the
purpose of meeting the requirements of this section.
The Engineer will include the provisions of the foregoing paragraphs 1, 2
and 3 in every subcontract or purchase order of over $10,000 so that the
provisions will be binding upon each subcontractor or vendor.

The Engineer hereby agrees that Mr. J. Scott Hodge is the Engineer's designated
representative for this contract and that he is empowered to make all necessary
decisions on behalf of the Engineer. The Engineer further agrees that Mr. Hodge
will not be reassigned away from this contract during it's course. This does not
preclude his being assigned additional duties not related to this contract.

AN ORDINANCE accepting bids made for providing certain vehicles
the City; rejecting other bids; authorizing the purchase of another
vehicle by utilizing the Commonwealth of Virginia's contract with a
certain vendor; and providing for an emergency.

WHEREAS, the City of Roanoke has publicly advertised and received
bids for providing certain vehicles to the City; and
WHEREAS, the Commonwealth of Virginia has, pursuant to its com-
petitve bidding procedures, awarded contracts for the purchase of cer-
tain items, including a 15-passenager van; and
WHEREAS, local governing bodies in Virginia are authorized to
purchase items through use of state-awarded contracts; and
WREREAS, the state contract price for such 15-passenger van is
lower than the bid price received by the City.
THEREFORE, BE IT ORDAINED by the Council of the City of Roanoke that:
1. The bids in writing of the following named bidders to furnish
to the City the items hereinafter set out and generally described,
such items being more particularly described in the City's specifica-
tions and any alternates and in each bidder's proposal, are hereby

I. Background

November 28, 1988, City Council designated
Funds in a Capital Maintenance and Equipment
Replacement Program to provide for necessary
expenditures.
Funds are also available in the Fiscal Year
1988-89 General Fund Budget for some
Equipment Replacement and Fixed Asset
Maintenance.

City Council's approval is required for
expenditures relating to the Capital
Maintenance and Equipment Replacement
Program.
II. Current Situation
This report will address several needs which
are identified as follows:
Recommend a bid award for Aluminum
Seating Planks at Victory Stadium·

Recommend a bid award for Vans and
Utility type Vehicles.
Appropriation of funds for previously
approved items in CMERP costing less
than $10,000, single item cost.
Fund appropriation and adjustments to
Capital Maintenance and Equipment
Replacement Program.
Specifications were developed and sent to all
vendors currently listed on the City's Bid
List for the following Bids:
1. Aluminum Seating Planks
2. Vans and Utility type Vehicles
Bids were received, after due and proper
advertisements, on specified dates and times,
at which times all bids so received were
publicly opened and read in the Office of the
Manager of General Services.
Tabulations of Bids received are attached.
All Bids received were evaluated in a
consistent manner by representatives of the
following departments:
General Services
Motor Vehicle Maintenance
Building Maintenance
Four (4) bids were received for Aluminum
Seating Planks at Victory Stadium.
The lowest bid for Aluminum Seating Planks as
submitted by Outdoor Aluminum, meets all
required specifications.
Four (4) bids were received for Vans and
Utility type Vehicles. These bids were also
compared to the current State Contract.
Evaluations of the Van and Utility type
Vehicles are as follows:
Item #1 - New 4 wheel drive Utility type
Emergency Medical Vehicle, as submitted
by Berglund Chevrolet, Inc. meets all
required specifications.
Item #2 - 2 New Cargo Vans, for Building
Maintenance as submitted by, Allred
Chevrolet, Inc. meets all required
specifications.
Item #3 - 1 15 passenger Van for Parks
and Recreation. The unit available
under State Contract meets all required
specifications.

Replacement Program approved included a
number of items, as shown on Attachment "A",
which will not exceed $10,000, single item
cost, but will require Council approval for
appropriation of Funds.

A HESOLUTION expressing concern over the problem of drug and
alcohol abuse in the Roanoke Valley area and calling upon the
City of Salem and the Counties of Botetourt and Roanoke, parti-
cipants along with the City of Roanoke, in Mental Health Services
of Hoanoke Valley, to recognize and address the immediate need to
provide adequate funding for the renovation of the Mental Health
Services of the Roanoke Valley's Alcohol Detoxification and
Rehabilitation Center.
WHEREAS, the Mental Health Services of the Roanoke Valley
has operated said Alcohol and Detoxification and Rehabilitation
Center, located at 801 Shenandoah Avenue, N.W., for fifteen
years; and
WHEREAS, this facility is the Roanoke Valley's only
residential faqility for low-income residents with substance
abuse problems; and
WHEREAS, in order to significantly address the issue of drug
and alcohol abuse on a regional basis, through development and
expansion of education and awareness programs, prevention and
treatment programs, and enhancement of other related substance
abuse services, the Mental Health Services of the Roanoke Valley
has undertaken the renovation of its Alcohol Detoxification and
Rehabilitation Center at a total projected cost of $256,876.00;
and
WHEREAS, upon completion of the renovation project in October
1989, said Alcohol Detoxification and Rehabilitation Center will
be upgraded and fully licensed to provide over 5,800 bed days for
low-income individuals annually; and
WHEREAS, this Council will appropriate $84,000.00 in Commun-
ity Development Block Grant (CDBG) funds toward said renovation
project; and
WHEREAS, the Mental Health Services Board has requested addi-
tional funds for the project from the City of Salem and Counties
of Botetourt and Roanoke.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Roanoke that:
1. This Council adopts this means of expressing its deep
concern over the current problem of drug and alcohol abuse in the
Roanoke Valley area and calls upon the City of Salem and Counties
of Botetourt and Roanoke, as jurisdictions served by the Mental
Health Services of the Roanoke Valley, to provide adequate
funding for the renovation of said Alcohol Detoxification and
Rehabilitation Center.
2. The City Clerk is hereby directed to forthwith transmit
attested copies of this resolution to the appropriate officials
of the City of Salem and Counties of Eotetourt and Roanoke.

At the Council meeting of April 10, 1989, Council agreed
to appropriate $84,000.00 in Community Development Block
Grant Funds toward renovation of the Alcohol Detoxification
and Rehabilitation Center operated by Mental Health Services
of Roanoke Valley. At the same time, Council requested the
City Manager and City Attorney to prepare a resolution ex-
pressing Council's concern over the problem of drug and
alcohol abuse in the Roanoke Valley and urging other local
governments in the Valley to join the City in addressing
this problem on a regional basis.
With the assistance of information provided by the City
Manager and his staff, I have drafted the attached resolu-
tion which I recommend to you.

parcel of land owned by the City located on the Southwest Corner of
Plantation Road and Mohawk Avenue, N.E. and bearing Official Tax No.
3040712, otherwise known as the 30 foot by 130 foot westerly portion
of Lot 12, Block 32, Map of Deanwood Terrace for the consideration of
$2,500.00, the deed of conveyance to be subject to any and all
recorded restrictions, conditions and easements effectinE title to
said property be and said offer is hereby ACCEPTED.
2. The ManaEer and City Clerk are authorized to execute and
attest, respectively, on behalf of the City the appropriate deed of

I. Back~round:
City of Roanoke, in conjunction with the widening project for Planta-
tion Road, N.E., acquired Official Tax No. 3040712, on July 10, 1985.
Thirty (30) foot by 130 foot westerly portion of lot is in excess of
City's need for a 10 foot by 130 foot strip, (with a 25 foot radius on
the corner ) along Plantation Road. (See attached City of Roanoke
Plan No. 5920-A.)
II. Current Situation:
Executone Communications~ Inc. is purchasing five (5) adjoining lots
which face on Mohawk Avenue, N.E. Executone desires to have a
Plantation Road, N.E., address, but, City property lies between their
property and that street preventing the use of that address.
B. Executone Communtcations~ Inc. has offered $2,500.00 for the surplus
portion of the City-owned lot.
C. City originally paid $3~500.00 for the lot. Assessed value of lot is
currently $3,500.00.
Due to retention of approximately one-third of lot for street widening
purposes, the $2,500.00 offer is adequate. Lot will return to tax
rolls.

as amended, there is hereby adopted by the Council and made

2. The Pay Plan adopted by this Ordinance shall remain in
effect until amended by Council.
3. Pursuant to §2-68, Code of the City of Roanoke (1979), as
amended, effective July 1, 1989, the City ~anager shall promulgate
and cause to be distributed among the officers and employees of the
City a Classification Plan, consisting of a plan of classification
assigning a pay grade, pay range in accordance with this Ordinance
and class code to each position in the classified service of the
City.
4. Merit increases in an amount of not less than 5.3 percent
of the market rate of the relevant pay grade shall be added to the
annual salary rates of officers and employees achieving satisfactory
review of service on their merit review dates under merit evalua-
tion procedures promulgated by the City ~anager; provided, however,
when any such merit increase would cause an officer or employee to
exceed the maximum pay range applicable to such officer's or
employee's position, such officer or employee shall receive a merit
increase only in such amount as will not exceed the maximum pay
range for such officer's or employee's position.
5. Notwithstanding Paragraph 4, with respect to any officer
or employee whose salary on June 30, 1989, is below the applicable
minimum for his pay range, such officer's or employee's annual salary
rate shall be adjusted to the applicable minimum effective July 1,
1989. Thereafter, such officer or employee shall be eligible for a
merit increase, assuming satisfactory service, upon his merit
review date in an amount of not less than 5.3% of market rate added
to his annual salary rate on June 30, 1989.
6. Annual salary increments payable on a bi-weekly basis are
provided for the hereinafter set out job classifications which re-
quire the incumbent to privately own or lease a motor vehicle rou-
tinely used in the course of conducting City business as follows:

AN ORDINANCE providing for certain supplemental benefits under
the City of Roanoke Pension Plan to certain members of such Plan
and certain of their surviving spouses; and providing for an em.r-
gency.
BE IT ORDAINED by the Council of the City of Roanoke as follows:
1. The retirement allowance payable on account of certain mem-
bers of the City of Roanoke Pension Plan being defined in Paragraph
2 infra who retired prior to July 1, 1988, shall effective July 1,
1989, be increased by three (3) percent of itself.
2. The increase in benefits provided for in Paragraph 1 of this
ordinance shall apply to the following categories of persons entitled
to receive benefits under the City of Roanoke Pension Plan only:

Any member of the Employees' Supplemental Retire-
ment System (hereinafter "ESRS") or of the Em-
ployees' Retirement System (hereinafter "ERS")
retired under $22.1-44, Normal Service Retirement,
or under $22.1-62, Retirement and Service Retire-
ment Allowance Generally, respectively, of the
Code of the City of Roanoke (1979), as amended,
(hereinafter "City Code"), provided such member
shall have at least one hundred and twenty (120)
months of creditable service; or
Any member of ESRS or ERS retired under $22.1-47,
Nonoccupational Disability Retirement Allowance,
or under §22.1-65, Nonoccupatlonal Disability
Retirement Allowance, respectively, of the City
Code, provided such member shall have at least
one hundred and twenty (120) months of creditable
service; or

Any member of ESRS or ERS retired under $22.1-
48, Occupational Disability Retirement Allowance,
or under $22.1-66, Occupational Disability Re-
tirement Allowance, respectively, of the City
Code, regardless of number of years of credit-
able service; or
Any member of ESRS retired under $22.1-45,
Early Service Retirement Allowance, or $22.1-
46, Vested Allowance, or any member of ERS
retired under $22.1-63, Early Service Retire-
ment Allowance, or $22.1-64, vested Allowance,
of the City Code; or
Any surviving spouse of a member, provided
such surviving spouse is entitled to benefits
under Article III, Employees' Supplemental
Retirement System, or under Article IV,
Employees' Retirement System, of Chapter 22.1,
Pensions and Retirement, of the City Code,
and further provided that the deceased member
through whom the surviving spouse is entitled
to benefits would qualify, if alive, under
paragraph 4.a., 4.b., 4.c., or 4.d of this
ordinance; or
Any member retired under Article V, Police
and Fire Department Pension Plan as o---~ December
31, 1945, of Chapter 22.1, Pensions and Retire-
ment, o--~ the City Code, or the surviving spouse
of any such member.
3. Effective July 1, 1990, any member of the City of Roa-
noke Pension Plan (hereinafter "member") retired prior to July
1, 1989, or any surviving spouse of such member (hereinafter
"surviving spouse"), provided such member or surviving spouse
qualifies under Paragraph 2 supra on July 1, 1990, shall be en-
titled to a lump sum payment in the amount of three (3) percent
of such member's or surviving spouse's annual retirement allowance
calculated as of July 1, 1990. Such lump sum payment shall be made
on or before July 31, 1990.
4. In order to provide for the usual daily operation of the
municipal government, an emergency is deemed to exist, and this ordi-
nance shall be in full force and effect on July 1, 1989.

BE IT ORDAINED by the Council of the City of Roanoke as follows:
1. The per diem rate of compensation for the members of the
Board of Equalization of the City of Roanoke appointed by Order of
the Circuit Court for the City of Roanoke entered on February 23,
1989, is hereby established at $100.00 per member.
2. The rate of pay established by this Ordinance shall con-
tinue in full force and effect with respect to succeeding Boards
appointed by the Circuit Court until modified by duly adopted ordi-
nance of this Council.
3. In order to provide for the usual daily operation of the
municipal government, an emergency is deemed to exist and this ordi-
nance shall be in full force and effect upon its passage.
