VIRGINIA 24018-0798 , (703) 772 2004 AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER ON TUESDAY, FEBRUARY 28, 1989 RESOLUTION 22889-2 APPROVING THE FISCAL YEAR 1989/90 OPERATING BUDGET FOR THE ROANOKE REGIONAL AIRPORT COMMISSION WHEREAS, Section 17 of the contract between the City of Roanoke and Roanoke County, Virginia, requires the Roanoke Region- al Airport Commission to prepare and submit its operating budget for the forthcoming fiscal year to the Board of Supervisors of the County and the City Council of the City prior to February 15 of each year; and WHEREAS, mitted its 1989-90 the Roanoke Regional Airport Commission trans- budget to the City of Roanoke and Roanoke County by letter dated February 14, 1989; and WHEREAS, the Roanoke Regional Airport Commission adopted its fiscal year 1989-90 annual operating budget at its February 14, 1989, meeting; and WHEREAS, it appears that estimated revenues shall once again exceed estimated expenses. NOW, THEREFORE it is hereby resolved by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the annual operating budget for fiscal year 1989-90 of the Roaaoke Regional Airport Commission is hereby approved. 2. No. 29488, ROANOKE, VIRGINIA, A RESOLUTION authorizing the execution of an agreement with the Virginia Housing Development Authority providing for an allocation of a total of $360,000 in mortgage financing for certain areas of the City, and authorizing certain other actions relating thereto. BE IT RESOLVED by the Council of the City of Roanoke that: 1. This Council hereby authorizes the execution by the City Manager, for and on behalf of the City, of an Urban Preservation and Infill Program Targeted Areas Allocation Agreement with the Virginia Housing Development Authority (VHDA), dated December 14, 1988, providing for the allocation by VHDA of a total of $360,000 in mortgage financing at the rate 9-7/8 percent interest, subject to periodic adjustment to reflect changes in commercial lending rates, for the purchase of properties located within those areas of the City set out in such Agreement, and as identified in a report of the City Manager to Council dated March 13, 1989. 2. The City Manager is empowered and directed to select such financial institutions as are necessary to receive and process loan applications in the City as a part of the program described above, such selections to be made in the manner set out and described in the above-referenced report from among those institutions eligible to do so. Roanoke, Virginia ~ March 13, 1989,~9 ~i , Honorable Mayor and Members of City Council Roanoke, Virginia Dear Members of Council: Subject: Offer of Home Purchase Loan Funds to the City from the Virginia Housing Development Authority (VHDA) Background: A. VHDA makes loans at below-market interest rates for home purchases, construction or purchase and repair, to families with income generally in the $12,000 - $38,000 range. B. Urban Preservation and Infill Program (UP & I Program) is specifically designed to reserve loan funds for use in low income and/or distressed "Qualified Census Tracts and/or Approved Areas of Chronic Economic Distress", as defined by the U. S. Internal Revenue Code. C. A "Qualified Census Tract" is a census tract in which, according to the latest available census data, 70% or more of the families are of low- moderate income, i.e. with income at or below 80% of the statewide median income. The areas identified on Attachment B are those meeting this defini- tion. An "Area of Chronic Economic Distress" is one determined to be so by the Internal Revenue Service and HUD, considering primarily age and con- dition of existing housing stock and proportion of low income, welfare- receiving, and/or unemployed residents. No areas of Roanoke have been designated as Areas of Chronic Economic Distress. D. VHDA has regularly made allocations of these funds for such targeted areas of Roanoke since 1981, enhancing homeownership, rehabilitation and new construction in older neighborhoods. II. Current Situation: A. VHDA has offered the City an allocation of $360~000 at a current interest of 9 7/8?6 to be loaned in IRS-designated "Targeted Areas" (see attach- ments A and B). This interest rate may be adjusted periodically to reflect changes in commercial lending rates. The allocation is effective through December 1#, 1989. B. No funds come directly to the City from this Program. Loan applications are received and processed by private local commercial lenders, as recommended by the City and approved by VHDA. March 13, 1989 Page 2 III. Issues: A. Cost to the City. B. Consistency with Housing Development Strategic Plan recommendations. C. Impact on Neighborhood, and homeownership opportunities. IV. Alternatives: A. Authorize the City Manager to execute the commitment agreement with VHDA in the amount of 5360,000 (Attachment A), and to request VHDA to allow all qualified lending agents to originate loans from this pool of funds. Cost to the City would be nothing. The City already publicizes the availability of VHDA financing as an alternative for homebuyers. No other financial or legal liability is incurred by the City under this Program. No loan funds come directly to the City government. Consistency with the recommendations of the Housing Development Strategic Plan Task Force would be met through attractive financing to foster homeownership. Impact on neighborhoods and homeownership opportunities would be positive in that these loans encourage new construction and reha- bilitation in the targeted areas and make it more feasible for low-moderate income families to become homeowners. B. Do not authorize the City Manager to execute the commitment agreement to accept the allocation of loan funds. Cost to the City would be nothing, except in terms of lost oppor- tunity to increase homeownership and to preserve and expand housing stock. Consistency with the recommendations of the Housing Development Strategic Plan Task Force would not be met. Impact on neighborhoods and homeownership opportunities would be negative, as a possible resource for homeownership, new home infill construction, and rehabilitation would not become available. V. Recommendation: Concur in Alternative A, thereby authorizing the City Manager to execute the commitment agreement with VHDA for $360,000 in home purchase loan funds in the areas shown on Attachment B, and to request VHDA to allow all qualified lending agents to originate loans from this pool of funds. Rhodes Planning and Research Assistant VJR:rl tal ATTACHMENT A(2) VIRGINIA HOUSING DEVELOPMENT AUTHORITY URB~N PRESERVATION AND INFILL PROGRA~ TARGETED AREAS ALLOCATION AGREEMENT THIS AGREEMENT, made as of the 14th day of December, 1988, by and between the VIRGINIA HOUSING DEVELOPMENT AUTHORITY, a political subdivision of the Commonwealth of Virginia (hereinafter referred to as the "Authority") and the City of Roanoke (hereinafter referred to as the "Locality"); W I T N E S S E T H: WHEREAS, the Locality has applied to the Authority for mortgage financing for purchasers of single-family dwelling units which are eligible under the Urban Preservation and Infill Program (hereinafter the "UP & I Program") in Richmond, Virginia; WHEREAS, the Authority expects to make available its Commonwealth Mortgage Bonds, 1988 A-AMT (The Series A Bonds"), a portion of the proceeds of which are expected to finance mortgage loans in "Targeted Areas" (as hereinafter defined). NOW, THEREFORE, in consideration of the premises aforesaid, the commitments herein contained and other good and valuable consideration, the parties agree as follows: Reservation of Funds. Subject to the terms and conditions herein, the Authority hereby agrees to make an allocation (the "Allocation") for the Locality in the amount of $360,000 (the "Allocated Funds") to be used to provide mortgage loan financing under the Authority's single-family mortgage loan program (the "Program") for persons and families of low- and moderate-income who purchase single- family dwelling units which are located within Targeted Areas (as defined in Paragraph 2 below). The Locality hereby accepts such Allocation. Mortgage loans to be financed with the Allocated Funds shall be originated, processed and disbursed by the Authority's Processing/Disbursing/ServicingAgents ("PDS Agents") in accordance with this Agreement, the Rules and Regulations of the Authority, the PDS Agreements between the Authority at the PDS agents, the Authority's Processing and Disbursing Handbook and the Authority's Procedures, Instructions and Guidelines for the Program. Use of Funds. Ail mortgage loans made pursuant to this Agreement must be for the purchase of properties which are located within Qualified Census Tracts and/or APProved Area~ of Chronic Economic Distres-, ("Targeted Areas") as defined -1- in Section 143 of the Internal Revenue Code, as amended, and the regulations issued thereunder (herein "Section 143"). If no such areas are approved within 90 days of the date of this Agreement, the Authority may recapture these funds and reallocate such funds to other approved areas. Allocation Periods. Subject to the provisions hereof, the Allocated Funds will be allocated for the Locality until the latter of December 14, 1989, or one year from the date the Authority determines that "funds are first made available with respect to Targeted Area residences" for purposes of Section 143. To the extent that such funds are not committed, settled and disbursed by said date, such funds shall (at the option of and to the extent deemed appropriate by the Authority) no longer be deemed Allocated Funds for the Locality and may be used by the Authority for any lawful purpose. Rate of Interest. (a) Initial Interest Rate. Mortgage loans made pursuant to this Agreement ("Targeted Mortgage Loans"), the applications for which were received by the applicable PDS Agent before the effective date of the first notification, if any, sent pursuant to subsection b. of this section shall bear interest at a rate of 9-5/8 (9.625)%. (b) Changes in Interest Rate. The Authority may from time to time adjust the interest rate to be charged on Targeted Mortgage Loans the applications for which are received by the applicable PDS Agent on or after the effective date of such notification. Such new rate shall be specified in the notification and shall have been determined in accordance with the resolutions authorizing the issuance and sale of the Series A Bonds. Loans to One-Person Households. The Authority shall not impose any limit on the number of mortgage loans made to one-person households pursuant to this Agreement. Reduction of Amount of Allocated Funds. The Authority may, at any time and from time to time, reduce the amount of the allocated Funds for the Locality if: (a) The Authority has determined that it is unlikely that mortgage loans will be committed, settled and disbursed within the time period set forth in paragraph 3 hereof in the amount of the Allocated Funds, in which case the Authority may reduce the amount of Allocated Funds to such amount as the authority determines will be fully committed, settled and disbursed within such period; or -2- (b) The Authority is unable to make available a sufficient aggregate principal amount of the Series A Bonds to enable it to provide the total amount of Allocated Funds set aside for all localities for Targeted Areas under the UP & I Program. The Locality understands and agrees that the Authority has made the determination that the Allocated Funds must be committed, settled and disbursed within the time periods set forth in paragraph 3 hereof in order to assure the success of the Authority's UP & I Program and therefore agrees that any determination made by the Authority pursuant to this paragraph 6 above shall be final and binding on the Locality. Termination of Allocation of Funds. The Authority may, at any time, terminate the allocation of Allocated Funds for the Locality upon 30 days written notice to the Locality that the Authority has determined (a) that the Locality is not complying with the program or other agreements between the Locality and the Authority, or (b) that termination is necessary to comply with the tax covenant in the General Bond Resolution for the Series A Bonds or (c) that termination is necessary to comply with Section 143. Obligation of the Locality to Advertisp. The Locality shall assist the Authority and the PDS Agents in using reasonable diligence to place the Allocated Funds in qualified mortgages within the meaning of Section 143. As part of said duty to assist the Authority and the PSD Agents, the Locality shall be required to make available the availability of these funds in the manner prescribed by the Authority, and shall provide evidence to the Authority of its compliance with this requirement. 9e '10. Conditions Precedent. Ail rights, covenants and duties of the parties hereto are contingent upon the Authority,s making available the Series A Bonds within 90 days of this Agreement at such interest rates and upon such other terms and conditions as are acceptable to the Authority. In the event that the Authority fails or is unable to make available such Series A Bonds, this Agreement shall be null and void as of the date hereof. Choice of Law; Miscellaneous. This Agreement shall be construed in accordance with the laws of the Commonwealth of Virginia. All provisions contained herein are severable and should any provision be held invalid by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. In addition, all documents, resolutions and agreements referred to in this Agreement shall be deemed incorporated herein by reference. -3- IN WITNESS WHEREOF, the parties hereto have executed this Agreement by their duly authorized representatives, as of the day and year first above written. Backsround on this subject includes: Bo Code of Virsinia establishes the eligibility criteria of localities for receiving funds from the Virginia Department of Transportation (VDOT) for street maintenance. It speci- fies two functional classifications of highways (Principal/ Minor Arterials and Collector/Locals) and establishes a base payment rate per lane mile for each classification of roadway. These rates are adjusted annually by VDOT based upon a statewide maintenance index of unit costs for labor, equipment and materials used by VDOT on roads and bridges. City eligibility for fiscal year 1988-89 is approximately $5~860~104 in street maintenance payments from VDOT. These funds are used for many maintenance expenditures that the City incurs for streets, sidewalks, curb and gutter, traffic signals, bridges, signs and pavement markings. II. Current situation of this subject is: Inventory additions need to be submitted to VDOT prior to April 1, 1989, in order to be eligible for payment for the next fiscal year. These additions are to be submitted on VDOT forms with an accompanying resolution from City Council. City staff has found that the attached list of streets should be submitted to VDOT before April 1, 1989, to enable their eligibility for payment in the next fiscal year. Approval of this addition to the street inventory could add $24,141 at current year payment rates. These include new streets, cor- rections to VDOT's current inventory, and streets omitted from the VDOT inventory. Page 2 III. Issues in order of importance are: A. Maintenance payments B. Timin8 IV. Back~round: Oakland School was originally built in 1923 (by Roanoke County), it was expanded in 1937 and a multi-purpose addition was built in 1973. The site is currently 2.86 acres in size. School enrollment is currently 265 students. Mo City Council by Ordinance No. 29403, dated December 19, 1988, authorized the acquisition of real estate identified by Official Tax Nos. 3160103, 3160104 and 3160150, to be added to the school property. At that time, by Ordinance No. 29402, Council appropriated $221,200.00 to cover the purchase, demolition of structures and initial improvements to the added property. New area added to school property will total 0.93 acre. II. Current Situation: mo Initial appraisal information on the properties was in the form of an independent appraisal prepared as of November 15, 1985, which placed the value at $175,000.00. Subsequent information obtained relative to the current fair market value of the property indicates a current fair market value of $202,500.00. B. Schlanger Actuarial Report of the Cit~ of Roanoke Pension Plan as of June 30, 1988 In compliance with Section 22.1-22 of the Roanoke City Code, which states in part, "...the Board shall .... submit to the City Council, annually .... the financial condition of the system as shown by an actuarial valuation of assets and liabilities of the system", I attach a copy of our report just received from Buck Consultants for the year ended June 30, 1988. It is interesting to note that the number of active retirees has risen from 764 as of June 30, 1980, to 971 as of June 30, 1988, revealing that longer life spans are adding to the retirement roles. As of June 30, 1988, the report was based on factual information of 2,002 active members with 12 active members over age 65. We are also paying benefits to 95 former city employees age 80 or older, and 78 dependents/beneficiaries age 80 or older. Of these, 25 are over age 90 with the oldest retiree as of June 30, 1988, being 98 years old. Honorable Mayor and Members of City Council Page 2 March 13, 1988 One of the key elements of determining the actuarial rate that the City of Roanoke has consistently funded is the adjusted asset value which is determined under the five year moving average method. This method is used to reflect good years in the market (such as this past year) as well as bad years. This is detailed on page 24 of the "Report of the Actuary". The past nine years actuarial rates as calculated by Buck Consultants are as follows: June 30, 1988 12.61% June 30, 1987 12.07% June 30, 1986 13.15% June 30, 1985 13.69% June 30, 1984 14.85% June 30, 1983 14.89% June 30, 1982 14.10% June 30, 1981 13.29% June 30, 1980 13.05% The actuarial rate rose slightly from FY87 to FY88 partially due to the cost of granting lump sum payments to qualified retired members and surviving spouses which was effective July 1, 1988, at a cost to the system of $113,943 and the permanent cost-of-living raise granted to the same retirees effective July 1, 1987, at a cost of $935,793 to the system. As you can see, a permanent cost-of-living raise is extremely costly compared to the lump sum method. Background Virginia Tech, under the leadership of Dr. James McComas, announced that they will be running the Graduate Center Program in Roanoke. Virginia Tech is working with the University of Virginia, Radford University, Roanoke College, Hollins College and others, as a lead agency in providing credit and non-credit courses for the citizens of the Roanoke Valley. Identifiable space separate from Virginia Western Community College was thought to be important in order to properly market these services City Council, at its November 28, 1988 meeting authorized the City Manager to enter into an agreement with Virginia Tech. Virginia Tech has completed their space planning for the facility. The cost to renovate the space to make it suitable for a graduate center is substantially higher than estimated. This higher cost is partly due to a very expensive microwave transmission system to broadcast some of their classes via satellite. Additional estimated costs have resulted in the State asking for a longer rent free period in order to amortize their investment in the space. Specifically, Virginia Tech is asking for the space rent free for three years instead of two. II. Issues A. Cost. B. Education. C. Economic Development. D. Future developments. Recommendations Alternative A Authorize the City Manager to enter into an appropriate letter of agreement and lease agreement in a form approved by the City Attorney. Cost to the City will be zero in that Virginia Tech will pay for all expenses incurred on the space. These permanent improvements will add substantial value to the space. Education opportunities for credit and non-credit courses will be provided by the various universities in this location. There should also be opportunities for relationships between the Graduate Center and the City School, with the possibility of a shared computer. Economic Development impact will be great in that hundreds of students will be coming into the area on a daily basis, eating and shopping in downtown Roanoke. Do Future development involving Virginia Tech and related to other major projects in downtown is tremendous. We view this as a first investment in a long future relationship with Virginia Tech and the other universities. Alternative B Do not authorize the City Manager to enter into any agreements related to this project. A. Cost would not be a factor. Education opportunity would probably be provided somewhere else in the Valley. C. Economic development opportunity would be missed. Strickland as a Circuit Court Judge of the Twenty-Third Judicial Circuit. WHEREAS, the Honorable Diane McQ. Strickland, one of the five General District Court judges of the Twenty-Third Judi- cial District, has been elected as a Circuit Court Judge of the Twenty-Third Judicial Circuit by the 1989 Session of the General Assembly; WHEREAS, the General Assembly has heretofore seen fit to elect five General District Court judges to serve the Twenty- Third Judicial District which is composed of the City of Roanoke, the City of Salem, the Town of Vinton and Roanoke County; WHEREAS, failure to certify the vacancy created by the election of Judge Strickland to the Circuit Court Judiciary will create a backlog of cases and impose an undue hardship upon the public, Bar and judiciary; and WHEREAS, this Council is of the firmly held opinion that it is very important that the Twenty-Third Judicial District continue to be served by five General District Court judges; THEREFORE, BE IT RESOLVED by the Council of the City of Roanoke as follows: 1. This Council respectfully urges the Committee on District Courts to certify the need for five General District Court 3udges for the Twenty-Third Judicial District in order that a successsor can be elected to the Honorable Diane McQ. Strickland. 2. The City Clerk is directed to forward attested copies of this resolution to the members of the Committee on District Courts, to the Circuit Court Judges of the Twenty- Third Judicial Circuit, to the General District Court Judges of the Twenty-Third Judicial District, to the President of the Roanoke Bar Association and to the members of the General Assembly representing jurisdictions in the Twenty-Third · Judicial District.
