Dear Members of Council:
On March 3, 1989, I forwarded to you a proposed schedule for the Fiscal
Year 1989-90 Budget Study and Adoption Process. My letter requested that you
review the proposed schedule and advise Mr. Reynolds of any conflicts which
you might have with this proposed schedule by March 20, 1989. In that Mr.
Reynolds received no adverse comments from any members of City Council, I
would like to request that City Council concur in this schedule of dates, times,
and activities which are essential to City Council's review and ultimate adop-
tion of the Fiscal Year 1989-90 Budget.

SUBJECT: REQUEST FOR ADDITIONAL FOSTER CARE FUNDS
I. BACKGROUND
Cost of caring for children in the custody of Roanoke City
who are in need of Foster Care placement has continued to
increase over the years, especially the care of children who are
in need of special treatment services.
B. Payments for treatment of handicapped and mentally disturbed
children have increased most significantly.
1. Average cost of care per child per month, 1977 - $519.00.
2. Average cost of care per child per month, 1988 - $1742.00.
Co
Handicapped and mentally disturbed children include children
who are autistic, schizophrenic, brain-damaged, emotionally
disturbed, behaviorally acting out, or mentally retarded.
1. Children with these diagnoses at one time were placed in
State institutions.
Since the practice of deinstitutionalization) these children
are often co~nitted to the local Department of Social
Services for appropriate treatment plans.
Children are often placed in private institutions or with
foster parents who specialize in offering 24-hour care to very
needful children.
Responsibility for palanent of the increased cost of care has been
shifted from Federal resources to State and local resources
because of a 25% reduction in Title XX funds in 1981 and a
federal ceiling on the reduced amount of funds available through
Title XX since that date.

II. CURRENT SITUATION
Foster Care maintenance and service funds for the FY 88-89 are
underestimated by $287,000. because of the following:
1. Number of children coming into custody of local Department of Social
Services has increased signifcantly.

services to children in custody of local Department of
Social Services.
Budget Increase of $287,000. in additional funds to continue
Foster Care Program will be required as follows:
a. New Funds of $250,000 of which 50% ($125,000) will be
reimbursed by the State.
b. Fund transfer of $37,000 from existing Social Services
accounts of which 100% will be reimbursed by the State.

2. Legal - Foster Care services that are mandated by State Statutes will
be provided.
B. Do not approve necessary funds for foster care program.
1. Budget - not an issue.

Legal - Mandated Foster Care services will not be provided. Room
and Board for over 300 children will not be paid for the rest
of FY 88/89. City is obligated to pay for the care of these
children.
V. RECOMMENDATION
City Council concur in the implementation of Alternative A and authorize
the following:
A. Appropriate $250~000. to the Department of Social Services Account
#001-054-5314-3140, Foster Care.
B. Transfer $37~000. to the Department of Social Services Account
#001-054-5314-3115, ADC-Foster Care as follows:
1. $13~000. from Account #001-054-5313-3105, Aid to Dependent Children.
2. $ 3~000. from Account #001-054-5313-3150, Refugee.
3. $ 7~000. from Account #001-054-5315-2010, Fees for Professional
Services.
4. $14~000. from Account #001-054-5316-2010, Fees for Professional
Services.
C. Transfer $125,000. to the Department of Social Services Account
#001-054-5314-3140, Foster Care as follows:
1. $119,575. from Account #001-004-9310-9512, transfers to Debt Service Fund.
2. $ 5,425. from Account #001-002-9410-2199, General Fund Contingency.

and read aloud the bids received to construct the Elevator
for Handicapped and Related Use in the Civic Center
Auditorium.

Eight (8) bids were received with Gardner-Smith, Inc. sub-
mitting the low bid in the amount of $160,600.00 and 150
consecutive calendar days.
Co
Elevator for Handicapped and Related Use at the Civic Center
Auditorium was rejected by City Council on January 17, 1989
because the project exceeded the available funding. The pre-
sent project is as follows:
An elevator constructed next to the stairway facing the
Terrace over the Exhibit Hall and closest to Williamson
Road.

Elevator serves the Exhibit Hall level, the main lobby
and terrace area, and the mezzanine level. The elevator
is equivalent to a four story elevator due to the floor
to floor heights, thirty-seven feet of vertical lift.

Elevator controls are designed to operate the elevator
from the terrace to the Exhibit Hall level; the
Auditorium may be locked out when not in use. It can
also be used to serve the Auditorium Lobby and mezzanine
levels, locking out the Exhibit Hall level or it may be
used to serve all three levels.

Elevator platform has the capacity to move light fur-
niture (such as eight foot tables and folding chairs)
from the storage room off the Exhibit Hall level to
either of the other two levels. (Personnel at the Civic
Center are currently carrying this furniture up and down
the steps when needed.)
II. Issues in order of importance are:
A. Compliance of the bidders with the requirements of the
contract documents.
B. Amount of the low bid.
C. Funding of the project.
D. Time of completion.
III. Alternatives are:

Award a lump sum contract to Gardner-Smith, Inc. in the
amount of $160~600.00 and 150 consecutive calendar days in
accordance with the Contract Documents as prepared by the
City Engineer's Office.
1. Compliance of the bidders with the requirements of the
Contract Documents was met.
Amount of the low bid is acceptable. The lower bid was
achieved by changing the face material to a brick that
will match the exposed concrete and in the elevator
location in the Auditorium.
3. Funding for the project is available in the Handicap
Compliance Account No. 008-002-9507-9065.
Time of completion is quoted as 150 consecutive calendar
days which is acceptable. Most of this time is required
to manufacture, deliver and install the elevator.
B. Reject all bids and do not award a contract at this time.
1. Compliance of the bidders with the requirements of the
Contract Documents would not be an issue.
2. Amount of the low bid would probably change if rebid at
a later date.
3. Funding would not be encumbered at this time.
4. Time of completion would be extended.

IV. Recommendation is that City Council take the following action:
Concur with the implementation of Alternative "A".
Authorize the City Manager to enter into a contract with
Gardner-Smith, Inc. to construct the Elevator for the
Handicapped and Related Use according to the Contract
Documents as prepared by the City Engineer's Office in the
amount of $160,600.00 and 150 consecutive calendar days.
Transfer $170,000.00 from the Capital Projects Fund Account
No. 008-002-5907-9003 to an account to be established in the
Civic Center Fund for Elevator for Handicapped.
D. Reject the other bids received.

AN ORDINANCE authorizing the issuance of not to exceed $170,758.74
general obligation school bonds, Educational Technology Series, of the
City of Roanoke, Virginia, to be sold to the Virginia Public School
Authority and setting forth the form and details thereof and
authorizing participation in the State Non-Arbitrage Program.
WHEREAS, the City Council (the "Council") of the City of Roanoke,
Virginia (the "City") has determined that it is necessary and expe-
dient to borrow not to exceed $170,758.74 and to issue its general
obligation school bonds for the financing of the purchase of equipment
for school purposes through the Governor's Educational Technology
Initiative Procurement and Financing Program.
WHEREAS, the City held a public hearing on March 20, 1989 on the
issuance of the Bonds (as defined below) in accordance with the
requirements of $$15.1-171.1 and 15.1-504, Code of Virginia (1950), as
amended.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of
Roanoke as follows:
1. Authorization of Bonds and Use of Proceeds. The Council
hereby determines that it is advisable to contract a debt and issue
and sell bonds in the amount of not to exceed $170,758.74 (the
"Bonds") for the purpose of financing the purchase of equipment for
school purposes through the Governor's Educational Technology
Initiative Procurement and Financing Program. The issuance and sale
of the Bonds iu the form and upon the terms established pursuant to
this Ordinance is hereby authorized.
2. Sale of the Bonds. It is determined to be in the best
interest of the City to sell the Bouds to the Virginia Public School
Authority ("VPSA") at par, upon the terms established pursuant to this
Ordinance. The appropriate officers of the City are hereby authorized
and directed to sell the Bonds to VPSA.
3. Details of the Bonds. The Bonds shall be issuable in fully
registered form; shall be dated the date of issuance and delivery of
the Bonds; shall be designed "City of Roanoke General Obligation
School Bonds, Education Technology Series"; shall bear interest
payable semi-annually on June 15 and December 15 (each an "Interest
Payment Date"), beginning December 15, 1989, at the rates established
in accordance with paragraph 4 of this Ordinance; and the principal
amount of the Bonds shall be payable in semi-annual installments ou
the dates (each a "Principal Payment Date") and in the amounts
established in accordance with paragraph 4 of this Ordinance. The

Installments. (a) The Mayor of the
City is hereby authorized and directed to accept the interest rate or
rates on the Bonds established by VPSA, provided that no such interest
rate or rates shall be more than sixty-five one hundredths of one per-
cent (65/100 of 1%) over the annual rate to be paid by VPSA for the
corresponding maturity on the bonds to be issued by VPSA, the proceeds
of which will be used to purchase the Bonds (the "VPSA Bonds"), and
provided further, that no interest rate of the Bonds shall exceed nine
percent (9%) per annum, and the execution and delivery of the Bond as
described in Section 6 hereof shall conclusively evidence the same as
having been approved and authorized by this ordinance.
(b) The principal amount of the Bonds shall be payable in nine
(9) semi-annual installments the first of which shall be due December
15, 1989, and the remaining installments semi-annually thereafter.
The Mayor of the City is hereby authorized and directed to establish
the principal amount of the Bonds not to exceed $170,758.74 and to
accept the amortization schedule on the Bonds established by VPSA,
provided that debt service on the Bonds from their dated date until
the end of the first fiscal year (1989-1990) shall not exceed the
amount appropriated by the General Assembly from the Literary Fund
therefor, and provided further, that debt service on the Bonds from
the second fiscal year to the fifth fiscal year shall be approximately
level, subject to the actual rate or rates of interest on the VPSA
Bonds, and the execution and delivery of the Bonds as described in
Section 6 hereof shall conclusively evidence the same as having been
approved and authorized by this ordinance.
5. Payment;. Paying Agent and Registrar. The City Treasurer is
hereby designated as Bond Registrar and Paying Agent for the Bonds and
the following provisions shall apply:
(a) All payments of principal of and interest on the Bonds shall
be made in immediately available funds to VPSA at or before 11:00
a.m. on the applicable Interest Payment Date
Date, or if such date is not a business date
for the Commonwealth of Virginia, then at or
and Principal Payment
for Virginia banks or
before 11:00 a.m. on the
business day preceding such Interest Payment Date and Principal
Payment Date; and
(b) All overdue payments of principal or interest shall bear
interest at the applicable interest rate or rates on the Bonds.
6. Execution of the Bonds. The Mayor or Vice Mayor and the
Clerk or any Deputy Clerk of the Council are authorized and directed
to execute and deliver the Bonds in an aggregate principal amount not
to exceed $170,758.74 and to affix the seal of the City thereto.
7. Use of Available Moneys; Pledge of Full Faith and Credit.
(a) The Council hereby appropriates and directs that all income
realized from the investment and reinvestment of the proceeds of the
Bonds and not required to be rebated to the United States pursuant to
the provisions of the Internal Revenue Code of 1986, as amended
("Investment Income"), shall be credited to a sinking fund for the
Bonds. The Council hereby further directs that, as directed by a
designated representative of VPSA, on each Interest Payment Date, the
City Treasurer shall apply, or cause to be applied, such Investment
Income to the payment of interest due on the Bonds.
(b) The Council further appropriates and directs that immediately
after the application of the Investment Income as provided in sub-
paragraph (a) above, the City Treasurer shall apply, or cause to be
applied, so much, if any, of the funds appropriated by the General
Assembly from the Literary Fund or otherwise for such purpose to, or
for the benefit of, the City to the payment of principal and interest
due on the Bonds on the next Principal Payment
Payment Date.
(c) The full faith and credit of the City
pledged for

the same become due and payable. There shall be levied and collected
annually on all locally taxable property in the City an ad valorem tax
sufficient to pay such principal and interest as the same respec-
tively become due and payable unless other funds, including, without
limitation, those funds referred to in subparagraphs (a) and (b)
above, are lawfully available and appropriated for the timely payment
thereof.
8. School Board Approval. The Clerk of the Council is hereby
authorized and directed to cause a certified copy of this Ordinance to
be presented to the School Board of the City. The Bonds hereby
authorized shall not be issued by the Council until the School Board
of the City shall have adopted an appropriate resolution consenting
to the issuance of the Bonds.
9. Non-arbitrage Certificate and Tax Covenants. The appropriate
officers and agents of the City are hereby authorized and directed to
execute a Non-Arbitrage Certificate and Tax Covenants setting forth
the expected use and investment of the proceeds of the Bonds and con-
taining such covenants as may be necessary in order to show compliance
with the provisions of the Internal Revenue Code of 1986, as amended
(the "Code"), and applicable regulations relating to the exclusion
from gross income of interest on the Bonds or on the VPSA Bonds. The
Council covenants on behalf of the City that the proceeds from the
issuance and sale of the Bonds will be invested and expended as set
forth in such Non-Arbitrage Certificate and Tax Covenants and that the
City shall comply with the other covenants and representations con-
tained therein. Furthermore, ~he Council covenants on behalf of the
City that the City shall comply with the provisions of the Code so
that interest on the Bonds and on the VPSA Bonds will remain excludable
from gross income for Federal income tax purposes.
10. State Non-Arbitrage Program. The Council hereby finds and
determines that (9) the Council has received and reviewed (i) a draft
of the Information Statement dated February 17, 1989 (the "Information
Statement"), describing the State Non-Arbitrage Program of the
Commonwealth of Virginia ("SNAP") and (ii) a draft of the Contract
dated January 16, 1989 (the"Contract"), creating the State
Non-Arbitrage Program Pool I ("SNAP Pool I"), and (b) the City has
been afforded the opportunity to discuss SNAP with the investment
manager of and special counsel to SNAP, and the Council hereby further
determines that it is in the best interests of the City to authorize
the City Treasurer to participate in SNAP. The Contract is hereby
approved, and the City Treasurer is hereby authorized to execute and
deliver the Contract on behalf of the City. The Council acknowledges
that its decision to authorize the participation in SNAP is based
solely on the information set forth in the Information Statement and
in the Contract, and the Council hereby acknowledges that the Treasury
Council of the Commonwealth of Virginia is not, and shall not be, in
any way liable to the City in connection with SNAP, except as other-
wise provided in the Contract.
11. Filing of Ordinance and Publication of Notice. The
appropriate officers or agents of the City are hereby authorized and
directed to cause a certified copy of this Ordinance to be filed with
the Circuit Court of the City and, within ten (10) days thereafter, to
cause to be published once in a newspaper having general circulation
in the City a notice setting forth (a) in brief and general terms the
purposes for which the Bonds are to be issued and (b) the amount of
the Bonds.
12. Further Actions. Each member of the Council and all other
officers, employees and agents of the City are hereby authorized to
take such action as they or any one of them may consider necessary or
desirable in connection with the issuance and sale of the Bonds and
any such action previously taken is hereby ratified and confirmed.
13. Effective Date. This Ordinance shall take effect April 7,
1989.

NOTICE OF PUBLIC HEARING ON PROPOSED
BOND FINANCING BY THE CITY OF ROANOKE, VIRGINIA
Notice is hereby given that the Council of the City of
Roanoke, Virginia (the "City") will hold a public hearing in
accordance with Sections 15.1-171.1 and 15.1-504, Code of
Virginia (1950), as amended, on the issuance of not to exceed
$170,758.74 general obligation school bonds (the "Bonds") of the
City to finance the purchase of equipment through the Governor's
Educational Technology Initiative Procurement and Financing
Program for school purposes. An ordinance authorizing the
issuance of the Bonds will be considered by the City Council at
its meeting on March 20, 1989. A copy of such proposed ordinance
is on file in the office of the Clerk of the City Council in
Roanoke, Virginia.
The public hearing, which may be continued or adjourned, will
be held at 2:00 o'clock p.m. on March 20, 1989, before the City
Council, in the Council Chamber at the Municipal Building, 215
Church Avenue, S. W., Roanoke, Virginia.
At such public hearing, all citizens shall be given an oppor-
tunity to appear and be heard on the proposed bond issue.

NOTICE OF BORROWING
CITY OF ROANOKE
$170,758.74
On March 27, 1989, the Council of the City of Roanoke,
Virginia (the "City") adopted an ordinance (the "Ordinance")
authorizing the City to borrow $170,758.74 for the purpose of
financing the purchase of equipment for school purposes through
the Governor's Educational Technology Initiative Procurement and
Financing Program and to issue its $170,758.74 General Obligation
School Bonds, Educational Technology Series (the "Bonds"), for
sale to the Virginia Public School Authority. The Ordinance was
adopted pursuant to authority granted by the Code of Virginia
(1950), as amended.
On April 12, 1989, the Council of the City caused a certified
copy of the Ordinance to be filed with the Circuit Court of the
City. For a period of thirty (30) days after the date of such
filing with the Circuit Court of the City, any person in interest
shall have the right to contest the validity of the Bonds or the
taxes to be levied for the payment of the principal of and the
interest on the Bonds. Under Section 15.1-212, Code of Virginia
(1950), as amended, if such contest shall not have been begun
within the thirty (30) day period, the authority to issue the
Bonds, and the validity of the taxes necessary to pay the prin-
cipal of and the interest on the Bonds, and the validity of any
other provisions contained in the Ordinance and all proceedings
in connection with the authorization and the issuance of the
Bonds shall be conclusively presumed to have been legally taken
and no court shall have authority to inquire into such matters
and no such contest shall thereafter be instituted.
