A. Public hearing on the request of Mr. French H. Hagy
that a certain alley twelve feet in width extending in
a northwesterly direction from Eastgate Avenue, N. E.,
for a distance of one hundred and twenty-five feet,
situated between Official Tax Nos. 3230910 and 3230911,
be permanently vacated, discontinued and closed.

the 1988-89 ConSortium Fund Appropriations, and providing for an
emergency.
WHEREAS, for the usual daily operation of the Municipal
Government of the City of Roanoke, an emergency is declared to
exist.
THEREFORE, BE IT ORDAINED by the Council of the City of
Roanoke that certain sections of the 1988-89 Consortium Fund
Appropriations, be, and the same are hereby, amended and

Subject: Funding Adjustments for the Fifth District Employment and Training
Consorti~n
I. Background
The .C~n~so.rtium and .P~anoke City's Department of Social Service~ have
recenuiy Dean awa~eo a competitive grant ~rom the Governor's
Employment and Training Depar~n~nt in the ~nonmt of $177,000, .to
administer a project titled IMAGE (Indepandant Mothers---j~h-i~ving
Growth and Employment), for teen mothers who are school dropouts,
receiving Aid to Dependent Children (ADC) and between the ages of
16-20. '
Plarmed programs will .i~.clude life manag~ent skills, basic
education, GED preparatzon, skills training, job development
and placement, and housing assistance.
jAPanuaPrOximately forty teen mothers will be served for the period
ry 1, 1989 - Jcme 30, 1990 from the Counties of Roanoke,
Botetourt and Craig, as well as the Cities of Roanoke, and
Salem.
65% or 26 of the teen mothers to be served will be Roanoke City
res idan%'~.
Veterans Pro~ect funds have been awarded for the Consortitm~ to
continue serving this targeted group for the period of December 23,
1988 to December 22, 1989.
125 Veterans will be served throughout the Fifth Planning
District, primarily in occupational skills training, and on the
job training (OJT) programs.
The Job Trainin~ Prosram lesislation, allows the Governor's
Employment and Training Departmmnt (primary funding source for the
Consortium), to reward Service Delivery Area (SDAs) who meet or
exceed their performance standards under Title II-A, for any given
program year.
Annual closeouts for Title II-A have been submitted to the
Governor's Employment and Training Departanent by the Consortium for
FY 1988.

II. Current Situation

The Consortium was awarded a Veteran's Grant (NOA #89-183-01) in the
amount o~ $51,750.
The Governor's ~loynmnt and Tr~n~n~ Departmmnt awarded the
Consortium an Incentive Grant (NOA #89-03-04) of $97,894, for
meeting and exceeding FY 1988 performance standar~-'fS~-Title II-A.
Among the performance standards are:
1. Adult entered ea~loyment rate of 62.16%.
2. Youth entered ~91oyment rate of 54.69%.
3. Adult welfare entered ~loyment rate of 65.24%.
4. Adult average hourly wage at placement $4.53.
5. 967 total participants served and 759 terminated (208 carried
over into this progrmn year). Of the 967 total participants
served, 700 or 72% were Roanoke City residents.
6. 443 participants placed in jobs. Of the 443 participants
placed in jobs 332 or 75% were Roanoke City residents.
Ihexpended~ but appropriated FY 1988 Title II-A funding, in the
amount o~ $212,059 was available to be transferred by ~he Governor's
Employment ~---~ining Department, from the last fiscal year into
the current year. The W~'l'O's allowable carryover policy, however,
transferred only $189~016 into the new fiscal year.

The Fifth District Employment and Trainin~ Consorti,~, received NOA
#88-03-07 for $14,065 in reallocated Summer youth tunds for excess
carryover from the GETD. Due to the lateness of the increase, these
funds were not budgeted for in last years progrmn and will be
utilized in the current year.

SUBJECT: LIBRARY GRANT FOR VIDEO CASSE1-FES
I. BACKGROUND
The John D. and Catherine T. MacArthur Foundation is a
private, independent, grant-making foundation created in
1978 for charitable and public service purposes.
In 1988 the MacArthur Foundation solicited applications
from public libraries for their library video classics
project, a nationwide project to make Public Broadcasting
System programming available to public libraries.
II. CURRENT SITUATION
The Roanoke City Public Library applied for and was awarded an
outright grant of a video collection valued at approximately
$6,300.
III. ISSUES
A. quality of library video cassette collection.

City Council authorizes the acceptance of the video
collection.

Library will be able to meet user demands for these

almost every title which allows the videos to be
used in group showings in both the Library and the

Bids to Purchase Sedans,
Station Wagons and Vans,
Bid Number 89-1-15
I. Background
November 28, 1989 City Council designated
funds in the Capital Maintenance and
Equipment Replacement Program to provide for
the purchase of necessary equipment. Also
funds are available in retained earnings for
the purchase of equipment needed by Internal
Services Departments.
Request for Quotations were sent to sixteen
(16) suppliers of automobiles and trucks. A
public advertisement was also published in
the Roanoke Times and World News on January
8, 1989.
Bids were received after due and proper
advertisement, until 2:00 p.m., on January
23, 1989, at which time all bids so received
were publicly opened and read, in the office
of the Manager of General Services.
II. Current Situation
Seven (7) bid responses were received.
Tabulation of those bids is attached.
Ail bids received were evaluated in a
consistent manner by representatives of the
following departments:
Motor Vehicle Maintenance
Signals and Alarms
Communications
Police
General Services
Ail responses were compared with vehicles
available through the State Contract System.
Bid evaluation results are as follows:
Item #1 - Two (2) new midsize Sedans.
One (1) for Billings and Collections and
one (1) for Communications. The State
Contract provides a vehicle that meets
all required specifications for a cost
lower than any bid responses received.
That contract cost is $8,565.68 per unit
and will be provided by R.K. Chevrolet,
Inc., Virginia Beach, Virginia.
Item #2 - One (1) new full size Sedan.
This unit, for Building Inspections, is
available under State Contract and meets
all specifications at a cost lower than
any bid response received. The contract
cost is $11,208.50 and will also be
provided by R.K. Chevrolet, Inc.,
Virginia Beach, Virginia.
Item #3 - One (1) new midsize Station
Wagon, for~Social Services. The lowest
bid submitted by Allred Chevrolet, Inc.
meets all required specifications for a
total cost of $11,549.00.
Item ~4 - One (1) new 4 wheel drive
Station Wagon for City Nursing Home.
The only bid submitted for this unit is
from Berglund Chevrolet. That unit
meets all required specifications for a
total cost of $15,700.10.
Item #5 - Two (2) new Seven Passenger
Mini Vans. One (1) for Social Services
and one (1) for Management Services.
These units, available through the State
Contract System, meets required
specifications at a cost lower than any
bid response received. This unit, which
will cost $12,378.00 each will be
provided by World of Ford Sales, Inc.,
Alexandria, Virginia.

Item ~6 Eight (8) new unmarked
intermediate size Sedans for the Police
Department. The lowest bid, provided by
Shelor Chevrolet was determined non
responsive in that they did not provide
appropriate information about the
vehicle being bid, as specifically
requested, to allow for necessary
evaluation. The second low bid,
submitted by Berglund Chevrolet, meets
all required specifications for a cost
of $10,574.32 each.
Item #7 - One (1) new Heavy Duty Cargo
Van for Signals and Alarms. The only
bid received, submitted by Magic City
Ford, meets all required specifications,
for a total cost of $14,365.54.
Single bids were received on Item 94 and #7.
Automobile and truck dealers were contacted
to determine the reasons for only one (1)
bid. Reasons were, they did not feel they
could be competitive, they could not supply a
vehicle heavy enough to comply with required
specifications and vehicle purpose, and they
did not have enough time, due to internal
delays, to respond.

AN ORDINANCE authorizing the City Manager to file an application
with the Virginia Department of Transportation for $450,000 in Indus-
trial Access Road Funds to provide industrial access by realignment
and reconstruction of Thirlane Road, N. W., to serve a new industry
in the City; setting out the need therefor; making provision for fur-
nishing the necessary rights-of-way therefor and for the adjustment
of utilities; assuring that the City will maintain said upgraded road-
way; and providing for an emergency.
WHEREAS, the Cova Corporaton, a wholly-owned subsidiary of United
Parcel Service of America, Inc. (hereinafter referred to as "Cora"),
has contracted to construct a new facility in the City on a site pre-
sently unserved by an improved public right-of-way suitable for
industrial/commercial traffic; and
WHEREAS, there is adjacent to the site to be developed by Cora
a substantial quantity of other similar land suitable for industrial
development, which other land can be made available for such purposes,
provided adequate means of access and necessary utilities and other
public services are made available in the area; and
WHEREAS, the nature of the business operations of Cora involve
the use of substantial numbers of heavy motor vehicles as well as
numerous smaller vehicles, all of which will result a larger volume
of heavy traffic load on the industrial access road needed for this
business; and
WHEREAS, S33.1-221, Code of V£rginla (1950), as amended, provides
legislative authority for the use of certain public funds by the V£r-
ginia Department of Transportation for constructing or improving
access roads to commercial and industrial sites on ~hich manufac-
turing, processing or other establishments are or will be constructed.
THEREFORE, BE IT ORDAINED by the Council of the City of Roanoke
that:
1. The City Manager is hereby authorized and directed to file
an application ~ith the Virginia Department of Transportation for
up to $450,000 in Industrial Access Road Funds for the Cova Project,
pursuant to the provisions of $33.1-221, Code of Virginia (1950), as
amended, for the realignment and reconstruction of Thirlane Road, N.W.,
to provide access to the new site of this business.
2. This Council, in making the aforementioned authorization,
hereby assures and guarantees the Commonwealth of Virginia Transpor-
tation Board that the City will, if such project be approved, provide
adequate rights-of-ray and for the adjustment of existing utilities
~hich might be affected by said project, the cost of such rights-of-
way and for the adjustment of existing utilities to be paid for by the
City from funds appropriated by the Council for the purpose; and that
the City will, after realignment
assume maintenance of the same.
3. In order to provide for
and reconstruction of Thirlane Road,
the usual daily operation of the
municipal government, an emergency is deemed to exist, and this ordi-
nance shall be iu full force and effect upon its passage.

I. Background
ao
UPS currently leases a 51,000 square foot building in
Statesman Industrial Park. Large increases in mail order
business and the addition of a hub component have made it
necessary for UPS to expand its operations.
Bo
Cova is negotiating to buy 50 acres from the Andrews family
for its proposed new location on Thirlane Road.
Thirlane Road must be improved, approximately 1.5 miles, from
the Peters Creek Road intersection to the Comfort Inn Motel to
accommodate industrial/commercial development. Cost estimates
for these improvements total approximately $1,000,000. This
project appears to be eligible for State Industrial Access
funds. We have our full allocation ($450,000) available to us
between now and the end of June.
Do
Cova is also negotiating to buy 13 acres across from their
proposed site. This property is necessary for the road
realignment.
E. Relocation of Thirlane Road onto Airport Commission property
may be necessary to a minor extent to provide better road
alignment around runway 6.
Water and sewer extensions to the property are required.
Depending on which alternatives are ultimately pursued, the
estimated costs of these utility extensions are $200,000 to
$400,000. Cova will pay for water/sewer extensions under City
extension policies.
Cova proposes to construct, in Phase I, a building of about
200,000 square feet with a total building and equipment
investment of $20.5 million. Employment will increase from
the current full-time equivalent of 231 persons to 368. The
pay scale for these jobs is substantially above manufacturing
wages.

H. Major components of the contract between Cova and the City of
Roanoke are as follows:
1. Cova to acquire the 13 acre Garst property across from
its proposed site (condemnation by the City for
right-of-way an alternative with full reimbursement by
Cora).
2. Cova to pay for all off-site utilities under City
extension policies and code required on site work.
3. Cova to construct facility as described.
4. Cova's performance as described above is contingent upon
City's making improvements to Thirlane Road.
5. Cova will reimburse the City for up to $35,000 in road
design fees if Cova does not go forward with the project.

A. Authorize the City Manager to execute a contract (attached)
between the City and Cova, defining the responsibilities of
both parties regarding the Thirlane Road improvement project.
1. Timing is critical to meet Cova's proposed construction
schedule. Cova has already begun preliminary survey and
topographical work in preparation for the work at the
site to begin as soon as possible.
2. Economic Development Program of the City of Roanoke would
be realized by the retention of a valuable existing
business and initial addition of 137 jobs and $4 million
in payroll to the Roanoke Valley economy. The City will
also receive over $1,300,000 in local taxes over a five
year period. The remaining 50 acres adjacent to Thirlane
Road will become extremely valuable for future
development. UPS's marketing efforts will be geared
toward further selling the City of Roanoke for future
site locations.

Virginia Department of Transportation for Industrial Access
Funds up to $450,000 for roadway realignment and
reconstruction to serve UPS.

Assure the Commonwealth Transportation Board that the City
will, if such project is approved, provide adequate
right-of-way, provide for adjustment of any utilities affected
by construction, and provide future maintenance of the roadway
through other funding sources.

Please note the following dates on your calendar with regard to
the School Board selection process:

Dear Mrs. Bowles and Gentlemen:
Pursuant to Chapter 9, Education, of the Code of the City of
Roanoke (1979), establishing a procedure for the election of
School Board Trustees, Council must hold certain meetings and
take certain actions during the months of March, April and May to
conform with the selection process. Therefore, it is respect-
fully requested that Council establish specific dates for the
following:

On or before March 20, Council shall hold an informal

Subject: 1988 Annual Report
By authority of the full Commission, I am pleased to
forward to you the annual report of the Planning
Commission and staff.
As you will see in the report, 1988 has been a very
busy and productive year. The major accomplishment for
the year was the initiation of the neighborhood planning
program, an outgrowth of Roanoke Vision, the City's
adopted comprehensive plan. During the year, Planning
staff completed the planning process in the South Roanoke
neighborhood and expect to bring the plans for Hershberger
Hills and Mudlick/Deyerle to the Planning Commission and
City Council in the near future. The Commission also
participated in regional planning efforts as well as
workshops on the Roanoke River Flood Reduction Study.
In 1988, the Commission reviewed 25
and 14 street and alley closures. Staff
subdivision requests and 115 site plans.

AN ORDINANCE accepting the bid of H. & S. Construction
Company, of Roanoke, Virginia, for certain intersection improve-
ments at Orange Avenue and Granby Street, N.E., as well as as
additional signal for a commercial site, upon certain terms and
conditions, and awarding a coatraot therefor; authorizing the
proper City officials to execute the requisite co~tract for such
work; rejecting all other bids made to the City for the work; and
providing for an emergency.
BE IT ORDAINED by the Council of the City of Roanoke as
follows:
1. The bid of H. & S. Construction Company, of Roanoke,
Virginia, ia the total amount of $159,714.82, for certain inter-
section improvements at Orange Avenue and Granby Street, N.E.,
such bid being in full compliance with the City's plans and spe-
cifications made therefor and as provided in the contract docu-
ments offered said bidder, which bid is on file in the Office of
the City Clerk, be and is hereby ACCEPTED.
2. The City Manager or the Assistant City Manager and the
City Clerk are hereby authorized on behalf of the City to execute
and attest, respectlvely, the requisite contract with the suc-
cessful bidder, based on its proposal made therefor and the
City's specifications made therefor, said contract to be in such
form as is approved by the City Attorney, and the cost of said
work to be paid for out of funds heretofore or simultaneously
appropriated by Council.
3. The City Manager or the Assistant City Manager and the
City Clerk are further hereby authorized on behalf of the City to
execute and attest, respectively, appropriate contract documents
with the successful bidder, in form approved by the City
Attorney, providing for alternate work for an additional signal
for a commercial site in the amount of $40,143.50, provided that
the commercial site owner pays the City $42,200.00 within thirty
(30) days of the date of this ordinance and posts bond within
thirty (30) days of the date of this ordinance to insure that
road improvements are constructed to the site within six (6)
months of the date of this ordinance, as more particularly set
forth in a report to this Council dated February 13, 1989.
4. Any and all other bids made to the City for the afore-
said work are hereby REJECTED, and the City Clerk is directed to
notify each such bidder and to express to each the City's appre-
ciation for such bid.

I. Back~round:
A. Orange Avenue and Granb~ Street intersection has been the
scene of numerous traffic accidents over the years.
B. Truck traffic on both Orange Avenue and Granby Street has
contributed to both traffic delays and accidents.
Improvements to the Orange Avenue and Granby Street intersec-
tion was identified and funded as part of the 1988 Capital
Improvement Program.
Bid package as advertised included an alternate to provide
signals and turn lanes to serve a proposed commercial site on
the south side of Orange Avenue.
II. Current Situation:
A. Design for Orange Avenue and Granby Street included signali-
zation with additional turn lanes.

12, 1988 with a low bid of ~159~714.82 submitted by H. & S.
Construction Company of Roanoke, Virginia. Alternate for
additional signal for commercial site was bid at ~40~143.50.

Jefferson Hish School property has been vacant for a number
of years. Efforts tn find a new use for total facility are
on-going.

Shop Area on rear (Luck Avenue side) of structure is a single
story industrial type building with concrete floor, high
ceiling clearance and large garage type access doors. No
utilities are currently available in this area.

Shop Area has been used at various times for storage and for
painting Park Department picnic tables during winter. The
major portion of it is currently vacant. Another portion is
used for School Board storage.

Roanoke D~ein8 and Finishing Company has purchased the old
Roanoke Mills - Tultex facility west of 6th Street, S.W.,
across that street from subject property, and is in the pro-
cess of remodeling it for their use.
II. Current Situation:
Roanoke Dyein~ and Finishing Company needs a secure indoor
area in which to sort and organize equipment being delivered
for installation in their plant.

Shop Area is generally divided into three (3) areas (see
attached plan). Space "A" is approximately 124' x 53' in
size (6,572 square feet) and is vacant and available for use.
Space "B" is now in use for School Board storage and Space
"C" is vacant, but, access doors are too small for entrance
by industrial forklifts, etc.
Roanoke Dyein~ and Finishing Company has asked to lease Space
"A" for $200.00 per month for an initial six (6) month
period. They will provide a security fence or wall between
Spaces "A" and "B" and will provide electricity to Space "A"
for lighting and to raise and lower the door onto 6th Street,
S.W. They will provide insurance and other protection to the
City as required (see attached letter).

more active historic preservation program were
presented to City Council on September 12, 1988.
Council authorized the administration to move
forward on the development of the strategies.

Technical assistance pro~ram was one of the
recommended strategies and included the
following two approaches:
City sponsored effort to assist property
owners or property developers desiring to
rehab historic properties. City Council,
at its November 14, 1988 meeting approved
$20,000 for this program.
State sponsored effort (establishing a
pilot regional preservation center) in
Roanoke was to be pursued.

City applied to the State Division of Historic
Landmarks to be the host locality for the Pilot
Regional Preservation Center Program. Space for
office personnel and archaeology lab and other
inkind general services were a part of the
City's application.
Governor Baliles announced Roanoke as the host
locality for the state's first regional
preservation center program on November 3, 1988.

City would reserve the option to renew for

a pilot program subject to future state

maintain an encroachment for a maximum period of the life of the

I. Backsround:
Breakell~ Inc., on October 30, 1987, received a building per-
mit to build a retaining wall adjacent to and east of their
existing structure. This type of building permit does not
require a previously approved site plan, but, does require
inspections.
Bo
Engineering Department Inspector found on March 25, 1988,
that the wall, parallel to Patterson Avenue, S.W., 46'-6"
long, had been built two (2) feet into the public right of
way. In addition, the footing for the wall extends twelve
(12") inches further into the right-of-way. Breakell, Inc.
was aware of the encroachment prior to that date and had
marked the right-of-way line on the wall.
Breakell~ Inc. had their property surveyed prior to construc-
tion of the wall. Based upon initial (later found to be pre-
liminary) locations of survey stakes set to mark the street
right-of-way/front property line, the retaining wall was
begun. As a precaution, it was located six (6) inches back
onto the private property. As they had a crew standing by to
do the job, Breakell, Inc., was well along with construction
before the surveyors returned, after refining their data, and
moved the stakes south onto private property enough to place
the wall two (2) feet into the street right-of-way.
Buildin~ Inspection Department should have been notified to
perform an inspection of the footing for the wall, but, was
not informed in time.
II. Current Situation:
Breakell~ Inc., on August 18, 1988, requested that City
Council authorize a permit to allow them to maintain the
encroachment of the wall and footing into the street right of
way (see attached letter).

Sequence of events enumerated in "Background" (above) acted
to prevent the Building Inspection Department from having
knowledge of, and providing proper inspections of, the impro-
perly located construction. Had appropriate regulations been
followed by petitioner, encroachment could have been avoided.
City Staff is of the opinion that the error in locating the
wall was unintentional and was caused by poor judgement on
the part of the petetioner and might have been avoided by
appropriate and timely City inspections; however, the
encroachment presents no hazard, as the street right-of-way
is seventy (70) feet wide at this point, and would be exces-
sively expensive to remove or replace at a revised location
out of the public right of way.
