Background November 28, 1989 City Council designated funds in the Capital Maintenance and Equipment Replacement Program to provide for the purchase of necessary equipment. Also funds are available in retained earnings for the purchase of equipment needed by Internal Services Departments. Bids were received after due and proper advertisement, until 2:00 p.m., on January 23, 1989, at which time all bids so received were publicly opened and read, in the office of the Manager of General Services. II. Current Situation Seven (7) bid responses were received. Tabulation of those bids is attached. Ail bids received were evaluated in a consistent manner by representatives of the following departments: Motor Vehicle Maintenance Signals and Alarms Communications Police General Services Ail responses were compared with vehicles available through the State Contract System. Bid evaluation results are as follows: Item #1 - Two (2) new midsize Sedans. One (1) for Billings and Collections and one (1) for Communications. The State Contract provides a vehicle that meets all required specifications for a cost lower than any bid responses received. That contract cost is $8,565.68 per unit and will be provided by R.K. Chevrolet, Inc., Virginia Beach, Virginia. Item #2 - One (1) new full size Sedan. This unit, for Building Inspections, is available under State Contract and meets all specifications at a cost lower than any bid response received. The contract cost is $11,208.50 and will also be provided by R.K. Chevrolet, Inc., Virginia Beach, Virginia. Item #3 - One (1) new midsize Station Wagon, for~Social Services. The lowest bid submitted by Allred Chevrolet, Inc. meets all required specifications for a total cost of $11,549.00. Item ~4 - One (1) new 4 wheel drive Station Wagon for City Nursing Home. Item ~6 Eight (8) new unmarked intermediate size Sedans for the Police Department. The lowest bid, provided by Shelor Chevrolet was determined non responsive in that they did not provide appropriate information about the vehicle being bid, as specifically requested, to allow for necessary evaluation. The second low bid, submitted by Berglund Chevrolet, meets all required specifications for a cost of $10,574.32 each. Item #7 - One (1) new Heavy Duty Cargo Van for Signals and Alarms. The only bid received, submitted by Magic City Ford, meets all required specifications, for a total cost of $14,365.54. Single bids were received on Item 94 and #7. Reasons were, they did not feel they could be competitive, they could not supply a vehicle heavy enough to comply with required specifications and vehicle purpose, and they did not have enough time, due to internal delays, to respond. Issues 1. Need 2. Compliance with Specifications 3. Timeliness 4. ATTEST: City Clerk. 'BP FE -7 February 13, 1989 Honorable Mayor and Members of City Council Roanoke, virginia Dear Council Members: Subject: Contract between the City of Roanoke and Cova Corporation (a wholly-owned subsidiary of United Parcel Service of America, Inc.) (UPS) I. Background ao UPS currently leases a 51,000 square foot building in Statesman Industrial Park. Large increases in mail order business and the addition of a hub component have made it necessary for UPS to expand its operations. Bo Cova is negotiating to buy 50 acres from the Andrews family for its proposed new location on Thirlane Road. Thirlane Road must be improved, approximately 1.5 miles, from the Peters Creek Road intersection to the Comfort Inn Motel to accommodate industrial/commercial development. Cost estimates for these improvements total approximately $1,000,000. This project appears to be eligible for State Industrial Access funds. We have our full allocation ($450,000) available to us between now and the end of June. Do Cova is also negotiating to buy 13 acres across from their proposed site. This property is necessary for the road realignment. E. Relocation of Thirlane Road onto Airport Commission property may be necessary to a minor extent to provide better road alignment around runway 6. Water and sewer extensions to the property are required. Depending on which alternatives are ultimately pursued, the estimated costs of these utility extensions are $200,000 to $400,000. Cova will pay for water/sewer extensions under City extension policies. Cova proposes to construct, in Phase I, a building of about 200,000 square feet with a total building and equipment investment of $20.5 million. Employment will increase from the current full-time equivalent of 231 persons to 368. The pay scale for these jobs is substantially above manufacturing wages. Members of Council February 13, 1989 Page 2 H. Major components of the contract between Cova and the City of Roanoke are as follows: 1. Cova to acquire the 13 acre Garst property across from its proposed site (condemnation by the City for right-of-way an alternative with full reimbursement by Cora). 2. Cova to pay for all off-site utilities under City extension policies and code required on site work. 3. Cova to construct facility as described. 4. Cova's performance as described above is contingent upon City's making improvements to Thirlane Road. 5. Cova will reimburse the City for up to $35,000 in road design fees if Cova does not go forward with the project. II. Issues A. Timing. B. Economic Development. C. Cost. III. Alternatives A. Authorize the City Manager to execute a contract (attached) between the City and Cova, defining the responsibilities of both parties regarding the Thirlane Road improvement project. 1. Timing is critical to meet Cova's proposed construction schedule. Cova has already begun preliminary survey and topographical work in preparation for the work at the site to begin as soon as possible. 2. Economic Development Program of the City of Roanoke would be realized by the retention of a valuable existing business and initial addition of 137 jobs and $4 million in payroll to the Roanoke Valley economy. The City will also receive over $1,300,000 in local taxes over a five year period. The remaining 50 acres adjacent to Thirlane Road will become extremely valuable for future development. UPS's marketing efforts will be geared toward further selling the City of Roanoke for future site locations. Members of Council February 13, 1989 Page 3 3o Cost to the City for Thirlane Road improvements is estimated to be $1,000,000. Proposed sources of funds are as follows: a. State Industrial Access funds $450,000 $125,000 $425,000 b. Rollback taxes Proceeds from sale of City property to Universal Communication Systems and Kroger Bakery Building Do not authorize the City Manager to execute a contract between the City and Cova related to improving Thirlane Road for industrial development purposes. 1. Timing is not an issue as project will not materialize. Economic Development Program benefits would not be realized. 3. Cost would not be an issue. IV. Recommendations Authorize the City Manager to execute a contract defining the responsibilities of the City of Roanoke and Cova regarding the facility to be constructed by Cova and public improvements to be made by the City. Authorize the City Manager to file an application with the Virginia Department of Transportation for Industrial Access Funds up to $450,000 for roadway realignment and reconstruction to serve UPS. Co Assure the Commonwealth Transportation Board that the City will, if such project is approved, provide adequate right-of-way, provide for adjustment of any utilities affected by construction, and provide future maintenance of the roadway through other funding sources. Council authorized the administration to move forward on the development of the strategies. Be Technical assistance pro~ram was one of the recommended strategies and included the following two approaches: City sponsored effort to assist property owners or property developers desiring to rehab historic properties. City Council, at its November 14, 1988 meeting approved $20,000 for this program. State sponsored effort (establishing a pilot regional preservation center) in Roanoke was to be pursued. Ce City applied to the State Division of Historic Landmarks to be the host locality for the Pilot Regional Preservation Center Program. Space for office personnel and archaeology lab and other inkind general services were a part of the City's application. Governor Baliles announced Roanoke as the host locality for the state's first regional preservation center program on November 3, 1988. II. Current Situation: III. IV. Regional center will employ four professional staff. An archaeologist with the Jefferson National Forest will also be involved with the center. Center would be operational in January, 1989. Office and laboratory space is available at Buena Vista in vacant rooms that currently are not utilized for City recreation programs. The space is located in the basement and in the second story wing of the house. (see attached) Buena Vista will continue as a recreation center. Issues: A. Need: B. Timing: C. Benefit to City: D. Recreation impact: Alternatives: Committee recommend to City Council that it authorize the lease of a portion of Buena Vista to the Commonwealth of Virginia Division of Historic Landmarks (DHL). Conditions of the lease are: Space will be leased at no charge to DHL. This was an enticement offered to get the pilot center placed in Roanoke. Term of lease would be for one year. The City would reserve the option to renew for an additional one year term. The Center is a pilot program subject to future state funding. Utilities and maintenance of building sMstems would be provided by the City. CitM will be responsible for minor improvements to bring building up to code for occupancy. These improvements would have been ultimately necessary for use of the space and will be provided for within the Building Maintenance budget. - Division of Historic Landmarks would be responsible for furnishings, telephone, supplemental heat and air conditioning, custodial maintenance. and Need is met for technical assistance from the state preservation office. Timing is met to permit operation of the Regional Center in January. Benefit to the City. Local assistance for historic and cultural properties will be available. Preservation programs and resources will be enhanced. Current recreational facility and programs not affected. Buena Vista will continue as a community recreation center. Space to be utilized is currently vacant. Measures to secure recreational center space from the space to be used by DHL staff will be incorporated in building improvements. Committee not recommend that City Council authorize the lease of a portion of Buena Vista. Need is not met for technical preservation assistance. Timing is not met. Pilot regional center was budgeted by the state for FY 1988-89. Opening has already been delayed. Benefit to the City is lost unless another facility is found. Recreational facility and proqrams not affected. The attached report was considered by the Water Resources Committee at its regularly scheduled meeting on January 23, 1989. The Committee recommends that Council authorize a standard revocable license in a form approved by the City Attorney to allow the continuation of the encroachment of the retaining wall at 2314 Patterson Avenue, S. W., in accordance with the terms and conditions stated in the attached report. INTE P, DI~PARTMgNTAL COMMUNICATION DATE: January 23, 1989 TO: Members, Water Resources Committee FROM: Mr. Kiser thru Mr. Herbert~/~ SUBJECT: Encroachment in Public Street Right of Way Breakell, Inc., General Contractors 2314 Patterson Avenue, S.W. I. Backsround: Breakell~ Inc., on October 30, 1987, received a building per- mit to build a retaining wall adjacent to and east of their existing structure. This type of building permit does not require a previously approved site plan, but, does require inspections. Bo Engineering Department Inspector found on March 25, 1988, that the wall, parallel to Patterson Avenue, S.W., 46'-6" long, had been built two (2) feet into the public right of way. In addition, the footing for the wall extends twelve (12") inches further into the right-of-way. Breakell, Inc. was aware of the encroachment prior to that date and had marked the right-of-way line on the wall. Breakell~ Inc. had their property surveyed prior to construc- tion of the wall. Based upon initial (later found to be pre- liminary) locations of survey stakes set to mark the street right-of-way/front property line, the retaining wall was begun. As a precaution, it was located six (6) inches back onto the private property. As they had a crew standing by to do the job, Breakell, Inc., was well along with construction before the surveyors returned, after refining their data, and moved the stakes south onto private property enough to place the wall two (2) feet into the street right-of-way. Buildin~ Inspection Department should have been notified to perform an inspection of the footing for the wall, but, was not informed in time. II. Current Situation: Breakell~ Inc., on August 18, 1988, requested that City Council authorize a permit to allow them to maintain the encroachment of the wall and footing into the street right of way (see attached letter). Page 2 Sequence of events enumerated in "Background" (above) acted to prevent the Building Inspection Department from having knowledge of, and providing proper inspections of, the impro- perly located construction. Had appropriate regulations been followed by petitioner, encroachment could have been avoided. City Staff is of the opinion that the error in locating the wall was unintentional and was caused by poor judgement on the part of the petetioner and might have been avoided by appropriate and timely City inspections; however, the encroachment presents no hazard, as the street right-of-way is seventy (70) feet wide at this point, and would be exces- sively expensive to remove or replace at a revised location out of the public right of way. III. Issues: A. Need B. Timin8 C. Cost to City D. Cost to Petitioner E. Public (General) Liability Insurance IV. Alternatives: Committee recommend to City Council that it authorize a revo- cable license, for the life of the structure, for the en- croachment of a wall 46' 6" long, two (2') feet into the right-of-way on the south side of Patterson Avenue, S.W., including a footing extending an additional twelve (12") inches into the right-of-way. Permits shall contain provi- sions idemnifying and holding harmless the City, its' offi- cers, agents, and employees from claims resulting from the encroachment into the public right of way and requiring general public liability insurance with limits of not less than ~300,000 combined bodily injury liability and property damage for any one occurrence and including City, its' agents, officers, and employees as additional insureds. Need by petitioners for continued use of retaining wall is met. Timin~ to clear questions about wall for petitioner as soon as possible is met. 3. Cost to City is zero. Page 3 4. Cost to petitioner is continuing cost of insurance. Public (General) Liability Insurance to be in amounts not less than $300~000 including the City, its' officers, agents and employees as additional insureds. Committee recommend to City Council that it refuse to author- ize a revocable license to allow the continued encroachment of a wall 46' 6" long, two (2') feet into the right-of-way on the south side of Patterson Avenue, S.W., at 2314 Patterson Avenue, S.W., including a footing extending an additional twelve (12") into the right-of-way. 1. Need by petitioner for retention of wall not met. Timin8 to clear up this issue for petitioner quickly is not met. o Cost to City is cost of processing potential request for closing this portion of right-of-way of Patterson Avenue, S.W. 4. Cost to petitioner is potential cost of removing wall. 5. Public (General) Liability Insurance is not an issue. Recommendation: Committee recommend to City Council that it authorize a standard revocable license in a form approved by the City Attorney to allow the continuation of the encroachment of the retaining wall at 2314 Patterson Avenue, S.W. in accordance with Alternative "A" upon appropriate terms and conditions. Kiser Director of Utilities & Operations Municipal Building, Room 354 Roanoke, VA 24011 Dear Mr. Kiser: We would like to respectfully request that the City Council grant Breakell, Inc. a Permit for Encroachment for our property located at 2314 Patterson Avenue. (Tax No. 131-3102) During the process of constructing an addition to our existing building, a retaining wall along Patterson Avenue was built two feet (2'0") over our property line. Please see the enclosed site plans for exact location being described. We regret that this mistake was made, and sincerely hope that you will grant our request. To remove said wall would be both time and expense consuming for our company. Thank you for your consideration. Any further contact with our office should be directed to Stanley G.
