Request of the City Manager for an Executive Session to discuss a
metier involving acquisition of real property for public purpose,
pursuant to Section 2.1-344 (a) (3)., Code of Virginia (1950), as
amended; also a matter involving potential litigation, Section 2.1-344
Request of Council Member David A. Bowers for an Executive Session
to discuss a legal matter, pursuant to Section 2.1-344 (a) (7), Code
of Virginia (1950), as amended.
Ms. Danielle Rand representing the Greater Deyerle Neighborhood Assoc-
iation addressed Council with regard to the establishment of a Little
Caesar's Pizza Restaurant on a site located at the southeast corner
of the intersection of Route 419 and Woodmar Drive, S. W., which was
the subject of a rezoning by Council on Monday, March 16, 1987. Ms.
Rand expressed concern that one of the proffered conditions to rezoning
was that the property would not be used for a fast food establishment.
Upon advice of the City Attorney, it was agreed that the appropriate
party to hear the complaint was (3) the Board of Zoning Appeals.

Dear Mrs. Parker:
In accordance with Section 10(c) of the Roanoke Valley
Regional Landfill Agreement, attached is the budget recap and
revenue projections as approved by the Roanoke Valley Regional
Solid Waste Management Board for the upcoming fiscal year 1989-90.
The Regional Landfill Board has approved a twenty-three (23%)
increase in tipping fees for local governments and twenty-five (25%)
increase for private haulers effective July 1, 1989. The Landfill
Board approved an increase in tipping fees for local governments
from $13.00 per ton to $16.00 per ton and for private haulers fr~n
$16.00 per ton to $20.00 per ton.
This rate increase is necessary due to new, more stringent solid
waste regulations, engineering costs associated with landfill siting
process, provide funds for closure/post closure care and inplementation
of a recycling incentive program.

Dear Mayor and Members of Council:
At your February 6, 1989, regular meeting, Mr. Melvin T. Patrick appeared
before you in connection with a decision of the Architectural Review Board to
deny his request to construct a fence surronnding a portion of a parking lot
which is a part of his property located at 816 Franklin Road, S. W. The subject
property, including parking area, is located within the boundaries of the area
designated by the City Council as an H-l, Historic District. Upon hearing the
concerns of Mr. Patrick, Council forwarded this matter to the City Attorney and
me for a report back to Council. Mr. Dibling has placed a report on this agenda
addressing the legal issues surrounding the Architectural Review Board's deci-
sion and Mr. Patrick's ability, at this point, to appeal that decision to
Council. The following is intended to address Mr. Patrick's comments to Council
on several matters regarding the delivery of basic City services:
Neighborhood security - Mr. Patrick's statement regarding the need to
erect his fence to provide additional security to his property is a
private matter as long as the erection of the fence meets all of
the City's codes and ordinances. However, Mr. Patrick did make several
remarks regarding law enforcement needs in his neighborhood. Upon
discussing this matter with the Chief of Police, we discovered in
calendar year 1988 the Roanoke City Police Department has recorded one
(1) call for service from Mr. Patrick's address. This is not to imply
that Mr. Patrick has not experienced problems on his property.
However, we have and will respond to any situation in Mr. Patrick's
neighborhood that we are advised of and will continue our regular
patrol activities as a normal part of our law enforcement program in
the Old Southwest area.
Condition of the Adjacent Alley and Adjacent Private Properties - Mr.
Donald Keaton, Manager of Refuse Collection, and Mr. Ron Miller, the
City's Building Commissioner/Zoning Administrator, visited with Mr.
Patrick at his property and viewed his concerns regarding the adjacent
alley and the condition of the adjacent private properties. Since that
time, the City's crews have corrected any problems that were noted in
the public right-of-way (alley) and have notified adjacent property
owners of any violations with respect to refuse containers. Mr. Miller
has also contacted an adjacent property owner with respect to possible
violations noted at that site.
On Wednesday, February 23, my assistant, Dolores Daniels, visited with Mr.
Patrick to ensure that the City had addressed the major concerns which he had
regarding the above-noted issues and to determine if we need to take any further
actions in these two major areas. Mrs. Daniels has reported to me that

Mr. Patrick was generally satisfied with the actions that we have taken to date
in the basic service delivery areas but he still expressed to her his concern
with respect to the Architectural Review Board's decision.
We will continue to provide quality, basic services in the Old Southwest
neighborhood and to respond to any special issues that may come to our atten-
tion. Mr. Miller will continue to follow up on the condition of the private lot
mentioned above and we will pursue the cleanup/removal of any debris or objects
which are in violation of the City's codes and/or ordinances.

We understand that Mr. Melvin Patrick complained last week
to City Council about Architectural Review Board denial of
approval for the above-referenced item in the Old Southwest
Historic District; that he cited security concerns in de-
fense of his fence; and that council referred the matter
to you and City Attorney Wilburn Dibling.
Old Southwest Inc. supports the ARB's action, and wishes to
bring certain aspects of the situation to your attention.
First, Mr. Patrick erected the fence before applying for a
Certificate of Appropriateness. To approve it now, simply
because it is already up, would set a very bad precedent.
Second, the steel-mesh fence, which reaches almost to the
street and has no landscaping, is an eyesore and inappro-
priate for the historic district. Moreover, it is on a
block that has made a remarkable, visible comeback in re-
cent years.
Third, adjacent property-owners oppose Mr. Patrick's fence,
even though they also have an obvious interest in the secu-
rity of the area. But the issue is not security; it is how
Mr. Patrick has chosen to deal with the problem. If he had
gone to the ARB in the first place, as he was supposed to
do, a solution might well have been reached that would have
satisfied everyone concerned.

Dear Mrs. Bowles and Gentlemen:
At the Council meeting of February 6, 1989, Mr. Melvin T.
Patrick appeared and informed Council that a decision rendered
by the Architectural Review Board (hereinafter referred to as
the "ARB") regarding a chain link fence was adverse to him and
requested that the matter be considered by Council. Mr. Patrick
also stated that certain neighborhood problems in the area of
his business need to be addressed by the City. After hearing Mr.
Patrick's comments, Council referred the matter to the City Mana-
ger and the City Attorney for a report and recommendation. This
report addresses the legal issues relating to Mr. Patrick's appeal,
and an accompanying report from the City Manager addresses Mr.
Patrick's neighborhood concerns.
In considering this matter, it is important to bear in mind
that Mr. Patrick was not exercising his right to appeal the
adverse ruling to Council; he was simply advising Council of a
matter upon which the ARB had already ruled. A full hearing was
held on December 8, 1988, pursuant to Mr. Patrick's application
for a certificate of appropriateness, seeking permission to con-
tinue maintaining a chain link fence he had erected in the South-
west Historic District. Although Sections 36.1-25 and 36.1-345
of the City Code provide that a certificate must be issued by the
ARB before a fence can be erected, Mr. Patrick had already erected
the fence on his property by the time he filed his application for
the certificate.
At the ARB hearing held on December 8, 1988, at which I was
present, neighborhood opposition to Mr. Patrick's fence was heard.
At the conclusion of the hearing, the ARB found that the apppear-
ance of the chain link fence and its location on Mr. Patrick's
property rendered it not in keeping with the character of the
Southwest Historic District and that the fence was objectionable
to adjoining property owners. The ARB unanimously voted to deny
Mr. Patrick's application for a certificate, and ordered him to

remove the fence. Since the ARB's decision was the first instance,
to my knowledge, in which the ARB denied an application for a cer-
tificate, I explained the appeal procedure to Mr. Patrick and
specifically reminded him that he had thirty days in which to file
a petition for an appeal with the City Clerk. A letter under date
of December 9, 1988, sent to Mr. Patrick by Ms. Evelyn S. Gunter,
Secretary to the ARB, likewise reminded him of the thirty-day
deadline.
On January 10, 1989, Mr. Patrick filed a petition with the City
Clerk, appealing the ARB's decision rendered on December 8, 1988.
Section 36.1-642(d) of the City Code specifically states that any
property owner aggrieved by any decision of the ARB may file a
petition appealing such decision, "provided such petition is filed
within thirty (30) days after the decision is rendered" by the
ARB. Accordingly, in correspondence dated January 19, 1989, the
City Clerk advised Mr. Patrick that his appeal was not timely
filed and that she was therefore unable to place the matter on the
Council's agenda.
Clearly, the requirements of Section 36.1-642, while simple
and easily understood, are mandatory. No form or specific
language is needed to comply with the Code requirement; all that
is required is that a writing, indicating the basis for the
appeal, be filed within a thirty day time period. Although Mr.
Patrick stated in his petition for appeal that the minutes of the
ARB's meeting held on December 8, 1988, were not available when he
filed his petition, such an assertion is neither substantially
correct nor relevant. First, Mr. Patrick, like any citizen, had
access to the tapes of the proceedings held on December 8, 1988.
In fact, Ms. Gunter invited Mr. Patrick to listen to the tapes
subsequent to the hearing. The above notwithstanding, Section
36.1-642 clearly provides that Council acts as a reviewing body in
matters involving the denial of a certificate of appropriateness
by the ARB. Under such circumstances, neither the minutes nor the
tapes, nor any reference to either of them, are necessary for an
appeal to be filed.
The thirty-day deadline for the filing of an appeal is an
integral part of the zoning ordinance. It provides all landowners
with plenty of time to determine the ramifications of a ruling by
the ARB and to determine whether an appeal should be filed. The
time limit also ensures that a ruling by the ARB becomes final
after a certain period of time. After that period of time, the
landowner, the neighbors involved, the City's Zoning Administra-
tor, and the ARB, know that a matter has been fairly heard, decided

and put to rest. Without any finality, the City's Zoning Admini-
trator will never be able to know when it will be proper for him
to enforce the ARB's ruling, as his actions may be stymied by an
appeal filed months after the ARB's ruling. For these reasons,
I recommend that the filing deadline set forth in Section 36.1-
642(d) be enforced and that no action be taken on Mr. Patrick's
request.

On December 8, 1988, the Architectural Review Board of the
City of Roanoke, Virginia, considered your request for a new
fence for property on Mountain Avenue, more specifically
described as Official Tax No.1020811 and your request for a
Certificate of Appropriateness was denied. The Board advised
that the new fence was not in keeping with the character of the
Southwest Historic District and was found to be objectionable
to adjoining property owners. Fences are structures that must
receive approval from the Architectural Review Board before
they can be erected in a historic district. Because the fence
was erected without the approval of the Board and has been
denied a Certificate of Appropriateness, it is in violation of
Section 36.1-345 of the Roanoke City Zoning Code and will have
to be removed.
If you are aggrieved by the Board's decision, you have 30
days to appeal the Board's decision to City Council. Please do

1. This ia an appeal from a decision of the Architectural

2. Your Petitioners are the owners of an Improved Parking
Lot known as Lot No.8, Mountain Avenue S.W. in the Ciy of Roanoke,
which is within the boundaries of an area which the Council has
designated as H-1 (Historic District).
3. On December 8, 1988, the ARB for the City of Roanoke
denied application for a certificate under Section 36.1-327 (b)
of the Zoning Ordiance of the Code of the City of Roanoke that it

often left on the parking lot or thrown upon the top of our building.

private property and that they had no jurisdiction. The fence was
installed by a bonded contractor of the City of Roanoke prior to
ARB notification and without the Petitioners knowledge that the
property was within the designated Historical District. We ask
council to consider the relationship of cause in the Petitioners
interest and that in the best interest of the community. During the
next several years as the area developes, we believe after that time
it would be in the interest of the Historical District to remove
the fence without prejudice on the part of the Petitioners. We
further ask council to reverse the decision made by the ARB and
further inform them that the Petitioners would be willing to sign
a statement removing the fence at some appropriate time in further

I. BACKGROUND
November 28, 1988 City Council designated funds in
the Capital Maintenance and Equipment Replacement
Program to allow for the purchase of three (3) new
Refuse Trucks.
December 30, 1988 request for quotations were
specifically sent to twenty-one (21) vendors
currently shown on the City's bid list. A public
advertisement was also published on the Roanoke
Times and World News on January 5, 1989.
Bids were received, after due and proper
advertisement, until 2:00 p.m. on January 17, 1989,
at which time all bids so received were publicly
opened and read in the Office of the Manager of
General Services.
II. CURRENT SITUATION
Seven (7) bid responses were received. Bid
tabulation is attached.

BE IT ORDAINED by the Council of the City of Roanoke that:
1. The bid of MSC Equipment, Inc., made to the City offering
to furnish and deliver to the City, f.o.b., Roanoke, Virginia,
one (1) new vacuum catch basin cleaner to be mounted on existing
truck cab/chassis, for the sum of $63,080.00, is hereby ACCEPTED.
2. The City's Manager of General Services is, hereby
authorized and directed to issue the requisite purchase order
therefor, incorporating into said order the City's specifica-
tions, the terms of said bidder's proposal and the terms and pro-
visions of this ordinance.
3. The other bid made to the City for said equipment is
hereby REJECTED; and the City Clerk is directed to so notify such

A RESOLUTION approving the installation of a partial fire sprink-
ler system in the City Jail as directed by the State Fire Marshal and
requesting reimbursement of one-half of the project costs from the
State Department of Corrections.
WHEREAS, expansion of the City Jail was authorized by City Coun-
cil on the 22nd day of July, 1985, by Ordinance No. 27691;
WHEREAS, said expansion was completed and placed in use; and
WHEREAS, the State Fire ~arshal, at the time of his final inspec-
tion, directed that a partial sprinkler system be added to the
facility at a total additional cost of $6,906.00;
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Roanoke that:
1. This Council concurs with the need to add the partial sprink-
ler system as directed by the State Fire ~arshal.
2. Pursuant to $53.1-80, Code of Virginia (1950), as amended,
the Board of Corrections of the Commonwealth of Virginia is requested
to provide reimbursement to the City for one-half of the cost of such
partial sprinkler system installation.

I. Backsround:
Addition to the Jail, which was the completion of the fourth
portion of the Jail, and request for reimbursement for the
project was approved by Ordinance No. 27619 dated July 22,
1987.
Work was completed at a total cost of $813,000.00 and the
City was reimbursed in the amount of $406,047.90 by the
Commonwealth Department of Corrections for the project.
State Fire Marshal, in his routine inspection of the
completed facility, instructed the City of Roanoke to add a
sprinkler system in the Storage Room on the second floor.
The inmates clothing storage room had been expanded through
the years and the State Fire Marshal required that the addi-
tion be sprinkled. The dry food storage room was also
requested to be sprinkled.

Sprinkler system, as required by the State Fire Marshal, was
added at a total cost of $6,906.00. This system covers three
(3) areas as required by the State Fire Marshal.
Current Situation:
A.
Reimbursement of project costs by the State Board of
Corrections is possible for all approved Jail construction,
enlargement or renovation projects at a rate of 50% of the
project cost.
Reimbursement must be requested via local resolution indi-
cating approval of the Jail expansion project by City
Council. Other forms are being completed and forwarded by
the Sheriff's Office.

AN ORDINANCE accepting the bid of H. Hamner Gay & Company, Inc.,
for construction of alterations to aeration and nitrification basins
at the Water Pollution Control Plant, upon certain terms and con-
ditions, and awarding a contract therefor; authorizing the proper City
officials to execute the requisite contract for such work; rejecting
all other bids made to the City for the work; and providing for an
emergency.
BE IT ORDAINED by the Council of the City of Roanoke as follows:
1. The bid of H. Hamner Gay & Company, Inc., made to the City in
the total amount of $123,0OO.00 for construction of alterations to
aeration and nitrification basins at the Water Pollution Control Plant
such bid being in full compliance with the City's plans and specifica-
tions made therefor and as provided in the contract documents offered
said bidder, which bid is on file in the Office of the City Clerk, be
and is hereby ACCEPTED.
2. The City Manager or the Assistant City Manager and the City
Clerk are hereby authorized on behalf of the City to execute and
attest, respectively, the requisite contract with the successful
bidder, based on its proposal made therefor and the City's specifica-
tions made therefor, said contract to be in such form as is approved
by the City Attorney, and the cost of said work to be paid for out of
funds heretofore or simultaneously appropriated by Council.
3. Any and all other bids made to the City for the aforesaid
work are hereby REJECTED, and the City Clerk is directed to notify
each such bidder and to express to each the City's appreciation for
such bid.
4. In order to provide for the usual daily operation
municipal government, an emergency is deemed to exist, and
nance shall be in full force and effect upon its passage.

I. Background:

City Council, at its February 13, 1989 meeting, publicly
opened and read aloud the bids received for the Alterations
to three (3) Aeration and Nitrification Basins at the Water
Pollution Control Plant.

Five (5) bids were received with H. Hamner Gay & Company,
Inc. of Lynchburg submitting the lowest total bid (base bid
plus alternate I) in the amount of $123~000.00 and 180 con-
secutive calendar days.
C. Alterations to Aeration and Nitrification Basins involve the
replacement of the present aeration system in the bottom of
the basins with a more economical and more even distribution
of air system. There will be only 4-6" pipe air supplies in
the new basins that replace the present 12-6" air drops.
Need to replace the current system because the current porous
blocks are becoming more and more nonporous and making it
very inefficient to continue to try to pump air through the
deteriorating blocks.
II. Issues in order of importance are:
A. Compliance of the bidders with the requirements of the
Contract Documents.
B. Amount of the low bid.
C. Funding of the project.
D. Time of completion.

III. Alternatives are:

Award a lump sum contract to H. Hamner Gay & Company, Inc.
of Lynchburg, Virginia, in the amount of $123~000.00 which
includes the base bid of $83~500.00 and Alternate I in the
amount of $39,500.00 and a construction time of 180 con-
secutive calendar days. Alterations to Aeration and
Nitrification Basins to be done in accordance with the
Contract Documents as prepared by the City Engineer's Office.
1. Compliance of the bidders with the requirements of the
contract documents was met.
2. Amount of the low bid is acceptable.
Fundln~ for the project is available in the Water
Pollution Control Plant account "Maintenance of
Machinery and Equipment" Account No. 003-056-3155-2048.
Time of completion is quoted as 180 consecutive calendar
days which is acceptable. Most of the time is required
because of the lead time for delivery of the aeration
equipment.
B. Reject the bids and do not award a contract at this time.
1. Compliance of the bidders with the requirements of the
Contract Documents would not be an issue.
2. Amount of the low bid would probably change if rebid at
a later date.
3. Fundin~ of the project would not be encumbered at this
time.

Time of completion of the project would be extended.
The projected savings anticipated by the use of the new,
more efficient air distribution system would be delayed.
IV. Recommendation is that City Council take the following action:
A. Concur with the implementation of Alternative A.

City Engineer's Office in the amount of $123~000.00, which
includes the base bid (2 basins) plus Alternate I (one addi-
tional basin) and 180 consecutive calendar days.
