RE: Storm Drainage Problems
in 2100 Block of Staunton Avenue, N.W.
Dear Mayor Taylor and Members of Council:
As you requested at your regular meeting of October 17, 1988 staff has
investigated the concerns of Mrs. Gladys O'Neil Brown of 2110 Staunton Avenue,
N.W. concerning flooding during the summer of 1988.
On October 31, 1988 Charles M. Huffine, P.E., City Engineer and Versal R.
Dearing, Engineering Technician II, met with Mr. and Mrs. Brown and Mrs. Ogden
of Total Action Against Poverty at 2110 Staunton Avenue to learn of all concerns
and view pictures previously shown to Council. Further on-site investigation by
staff following the meeting revealed the following information:
1. Storm drain drop inlets located upstream from the 2100 Block were filled
with debris. These were cleaned out by the Street Maintenance Department.
Televising of the storm drain line running in the 2100 Block revealed a par-
tially collapsed pipe in front of 2110 Staunton Avenue. This section of
pipe was repaired by the Utility Line Services Department.
A study of the existing conditions and system will be undertaken by the
Department of Engineering to learn if other problems exist in the existing
storm drainage system. This study should be complete by February 1, 1989.
Following completion of corrective actions on November 1, 1988, Mrs. Ogden
was contacted and informed of the status of the investigation. She assured
staff that she would brief Mr. and Mrs. Brown.

Subject: Briefing "Heart at Work" Wellness Program
I. Back~round
Research indicates that a comprehensive wellness
program can have an influence on health care costs,
workers compensation costs, absenteeism and employee
morale.
Heart At Work is a wellness program designed by the
American Heart Association which includes programs on:

Signals & Alarms (CPR)
Smoking Cessation
Blood Pressure
Stress Management
Grant - the Virginia State Department of Health awarded
a $2,500.00 grant to the City of Roanoke for the Heart
at Work Program on September 23, 1988.
II. Current Situation
The following wellness programs and activities are now
offered to City employees:
Dental Insurance which emphasizes maintaining the
care of teeth and the mouth, became effective
January 1, 1989. Under this program, check-ups
are covered at 100%.
Well Baby Care for children of employees ages five
and under has been added to the City's Blue Cross
and Blue Shield program. This benefit covers
physicals and routine immunizations for these
children in an effort to prevent potential health
problems.
Wellness Prescriptions such as Nicorette, which
helps people stop smoking, are now reimbursable
under the City's health care plan.
Weight Control Class which meets each Wednesday in
Room 159 of the Municipal Building from 12 noon to
1:00 p.m. sponsored by Community Hospital of
Roanoke Valley and the YWCA.
Aerobic Class which meets each Tuesday and
Thursday from 5:30 to 6:30 p.m. with the class
beginning on January 10, 1989 in Room 159 of the
Municipal Building. The program is sponsored by
the Department of Parks and Recreation.

Blood Pressure and Blood Work Screenings are
offered daily in the occupational health clinic,
Room 177, Municipal Building.

Planned health activities include but are not limited
to:
Health Screening - Center for Disease Control
Health Risk Appraisal to include cholesterol and
blood screening during January; free to City
employees.
Smoking Cessation Class to be taught by Dr.
Karen Miller beginning February 1, 1989 from 5:15
to 6:30 p.m. in the Municipal Building.
Heart Saver CPR Class to be taught by Trena Hicks,
Safety Specialist and Annette Strickland, R.N.,
Cardiovascular Risk Reduction Coordinator, in
February.
Nutrition - Lunchtime sessions will be offered in
March and conducted by a registered dietition.
Short and long range goals were identified by the
Occupational Health Clinic and Personnel Management:
Short Range Goals:
a. Improve employee morale
b. Increase employee productivity
Long Range Goals:
a. Decrease absenteeism
b. Maintain or reduce health care costs and
workers' compensation claims
c. Lower turnover rates
d. Attractive job benefit to recruit new
personnel
III. Conclusion
The City of Roanoke is undertaking a major effort to
improve the overall "wellness" of City employees.

Work" Wellness Program. The presentation will take
approximately 10 to 15 minutes. Space is also requested in
the Council Conference Room to set up the equipment for the
Health Screening that will be offered to City Council
Members, the City Manager, Assistant City Manager, City
Attorney and the Director of Finance immediately after the
meeting. The presentation will be made by Mr. Cronin and
myself.

Fund Appropriations - Capital
Maintenance and Equipment
Replacement Program
I. Background
November 28, 1988, City Council approved a
Capital Maintenance and Equipment Replacement
Program.
The Capital Maintenance and Equipment
Replacement Program approved included a list
of necessary items which will not exceed the
single item cost of $10,000.00.
Council's approval is required for single
item purchases which cost exceed $10,000.00,
as stated in the Code of the City of Roanoke,
Chapter 23.1, Procurement, (1979), as
amended.
II. Current Situation
Single purchase items from the approved
expenditure list, which will cost less than
$10,000.00, are listed on Attachment "A" of
this report.
Those items shown on Attachment "A" will be
procured through the State Contract System or
through competitive request for quotations by
the Department of General Services.
Council appropriations are requested to allow
for the procurement of all items listed on
Attachment "A".

will be made in accordance with the City

appropriate funds to specific accounts for
Capital Maintenance and Equipment Replacement
expenditures.
Need - critical needs will not be
addressed as expediently as in
alternative "A".
2. Timeliness - would not be met.
Competition of Purchase - would not be a
factor in this alternative.

I am enclosing three copies of Ordinance No. 29410 granting a
revocable license for the construction of certain building appen-
dages encroaching over and into the right-of-way of Kirk Avenue,
S. E., located at the Center in the Square Building between 19
Campbell Avenue and 20 Church Avenue, S. E., Official Tax Nos.
4010806, 4010808 and 4011311, upon certain terms and conditions,
which Ordinance No. 29410 was adopted by the Council of the City
of Roanoke on first reading on Tuesday, December 27, 1988, also
adopted by the Council on second reading on Tuesday, January 3,
1989, and will take effect ten days following the date of its
second reading.
You are requested to file with the undersigned evidence of
general liability, bodily injury and property damage liability
insurance coverage in amounts set forth on Page 2 of said
Ordinance, such coverage to include the City of Roanoke, its
officers, employees and agents as additional insureds.
Ordinance No. 29410 shall be in full force and effect at such
time as a copy duly signed, sealed, attested and acknowledged by
the licensee has been admitted to record at the cost of the
licensee in the Office of the Clerk of the Circuit Court of the
City of Roanoke and shall remain in effect so long as a valid,
current certificate evidencing the public liability insurance
required in Paragraph 4 of said Ordinance is on file in the City
Clerk's Office.

AN ORDINANCE granting a revocable license for the construction
of certain building appendages encroaching over and into the
right-of-way of Kirk Avenue, S.E., located at the Center in the
Square Building between 19 Campbell Avenue and 20 Church Avenue,
S.E., Official Tax Nos. 401080B, 4010808, and 4011311, upon cer-
tain terms and conditions.
BE IT ORDAINED by the Council of the City of Roanoke that:
1. A revocable license shall be and is hereby granted the
current owners, Western Virginia Foundation for the Arts and
Sciences, a Virginia corporation, their grantees, assignees, or
successors in interest, of the property bearing Official Tax Nos.
4010806, 4010808, and 4011311, otherwise known as the Center in
the Square Building between 19 Campbell Avenue and 20 Church
Avenue, S.E., within the City of Roanoke, to construct, maintain
and utilize, an elevated pedestrian bridge encroaching approxima-
tely 25 feet in length, 52 feet in width, approximately 1300
square feet in area, and 14.5 feet above the public right-of-way
of Kirk Avenue, S.E., as more fully described in a report of the
Water Resources Committee dated December 27, 1988, on file in the
Office of the City Clerk.
2. Said license, granted pursuant to $15.1-376, Code of
Virginia (1950), as amended, shall be revocable at the pleasure
of the Council of the City of Roanoke, and is subject to all the
limitations contained in the aforesaid $15.1-376.
3. It shall be agreed by the Licensee that, in construct-
ing, using, and maintaining such encroachments, said Licensee and
its grantees, assignees, or successors in interest covenant and
agree to indemnify and save harmless the City of Roanoke, its
officials, officers, agents and employees, from all claims for
injuries or damages to persons or property that may arise by
reason of the construction, maintenance, use, or existence of the
above-described encroachments over public right-of-way.
4. Licensee, its grantees, assignees or successors in
interest shall, for the duration of this permit, with respect to
claims arising out of the construction, maintenance, use, or
existence of any of the appendages or areas permitted to encroach
into City right-of-way hereunder, maintain on file with the City
Clerk's Office evidence of general liability, bodily injury and
property damage liability insurance coverage in amounts not less
than:

$1,000,000 for injuries, including death, to one person
in any one occurrence and $5,000,000 annual aggregate;
In the case of property damage insurance, $500,000 for
damage in any one occurrence and $1,000,000, annual
aggregate;
In the case of general liability insurance, coverage
in the amount of $1,000,000; and
The above amounts may be met by "umbrella" coverage
in a minimum amount of $5,000,000;
such coverages shall include the City of Roanoke, its
officers, employees and agents as additional insureds. The

years and may be increased or decreased at the request of the
City. Any increase in the amount of required insurance shall be
mutually agreed upon between the City and the Licensee. If the

5. If for any reason the revocable license granted
hereunder should be revoked or terminated, or if at any point
during the license period the structure encroaching over public

is unable to correct such structural or safety defect within a
reasonable time after proper notice thereof, Licensee agrees to
demolish and remove the encroaching structure solely at its own
expense. All demolition and related work required for such re-
moval shall be done diligently and in conformity with all legal
and safety requirements, in a good and workmanlike manner, and in
accordance with any applicable standards.

do business in the Commonwealth of Virginia and in the initial
amount of $60,000. The bond shall be in force prior to the ini-
tiation of any construction within the encroaching area and shall
remain in force for the term of this license. The amount of the
bond required herein shall be reviewed every five years and may
be increased or decreased at the time of each review at the
discretion of City to reflect the reasonable cost of demolition
and removal at that time. Any increase or decrease in the amount
of the bond shall be mutually agreed upon. If the Licensee and
City cannot agree upon a mutually satisfactory sum to cover the
cost of demolition and removal, or if the Licensee and City cannot
agree upon a mutually acceptable means for insuring that the
building will be demolished or removed at no expense to City if
it is no longer feasible to obtain a performance bond, the matter
will be referred to three independent arbitrators. One of these
arbitrators will be chosen by the City and one will be chosen by
the Licensee. After being chosen, these two arbitrators shall
then choose a third arbitrator and the majority decision of the
three arbitrators shall then be final and binding on the parties
hereto.
6. This ordinance shall be in full force and effect at such
time as a copy, duly signed, sealed, attested, and acknowledged
by Licensee, has been admitted to record, at the cost of the

I. Background:
Center in the Square, located at 19 Campbell Avenue, S.E.,
has purchased the old Phelps & Armistead building at 20
Church Avenue, S.E. This property is identified by Official
Tax No. 4011311, and is located directly south of Center in
the Square across Kirk Avenue, S.E.

has requested that City Council authorize a revocable license
for the construction of a 25 foot by 52 foot overhead
pedestrian bridge over Kirk Avenue, S.E. to connect their two
properties.
Elevated brid~e would connect the second floors of the two
structures. It would be 52 feet wide, 25 long (that is the
street width) and is requested to be 14.5 feet above the
street surface and be approximately 1,300 square feet in
area.
Purpose of elevated bridge is to permit the expansion of the
Center in the Square across Kirk Avenue, S.E., and into the
property at 20 Church Avenue, S.E.

I wrote to you on November 28, 1988, requesting that the City
o£ Roanoke lease to Center in the Square air rights over Kirk
Avenue. S, E. , Roanoke, Virginia. to build a bridge to connect our
two buildings in the Market area. '
Due to clearance requirements of the Code of Virqinia, we
will not be able to construct the bridqe across Kirk Avenue in air
space leased from the City. We therefore request that the City
qrent a revocable license to encroach on the public riqht of wa,v
in this location. The bridqe will be build with a m~nimum
clearance of fourteen feet, six inches, accordinq to plans and
specifications previously furnished to Kit ~iser, Director of
Utilities and Operations of City of Roanoke.
We will maintain the bridge to the satisfaction o£ the City,
provide a bond to assure removal and indemni£ieation: and
insurance to protect the City from liability.
