eligibility from the City of Roanoke Pension Plan.

1987-88 General Fund Appropriations, and providing for an
emergency.
WHEREAS, for the usual daily operation of the Municipal
Government of the City of Roanoke, an emergency is declared to
exist.
THEREFORE, BE IT ORDAINED by the Council of the City of

SUBJECT: FOSTER CARE
I. BACKGROUND
ADC Foster Care Program, within the budget for the Social
Services Department, provides costs of maintenance for
children in custody of the local Department of Social
Services. Costs of this program are determined in
relation to the legal requirements for providing for
necessary care for achievement of a permanent home for
each child in care.
ADC Foster Care maintenance funds are 100 percent
reimbursed by the State Department of Social Services.
II. CURRENT SITUATION
ADC Foster Care maintenance funds for the 87-88 fiscal
year were underestimated by the local department because
of changes which occurred after the budget was completed.
Number of children coming into care has increased by
25 since July, 1987.
2. Cost of all care has increased.
$42,500 additional funds is needed for maintenance of
children in custody of the local department.

Transfer $42~500 from the following existing accounts to
ADC Foster Care for providing for the cost of care of
children in custody of local department:
*$28,000 from Aid to Dependent Children

2. Legal. Foster Care program is mandated by federal
regulations.
Children in need of care would continue to receive
maintenance (room and board).
Do not transfer }42~500 from Aid to Dependent Children
and Indo-Chinese Program to ADC Foster Care.

regulations could not be provided.

The Community Development Block Grant program is
accounted for on the City's financial records by program year.
Four program years are currently appropriated.
This report recommends that the two earliest Community
Development Block Grant years (B-84-MC-51-0020 and B-85-MC-51-0020)
be closed by reprogramming the unspent funds in those program years
to the next subsequent program year (B-86-MC-51-0020). The funds
being reprogrammed will be used for the same activities for which
they are currently appropriated. Reprogramming these funds allows
the City to maintain a maximum of three program years on its re-
cords at any given time. HUD allows localities to determine the
number of

retirement, Code of the City of Roanoke (1979), as amended, by the
addition of a new subsection (e), and amending and reordaining ~22.1-
62, Retirement and service retirement allowance generally, by the addi-
tion of a new subsection (d); the subsections defining the maximum an-
nual retirement benefit available under Employees' Supplemental Retire-
ment System and under Employees' Retirement System, respectively, and
providing for an emergency.
BE IT ORDAINED by the Council of the City of Roanoke as follows:
1. Section 22.1-44, Normal service retirement, Code of the City
of Roanoke (1979), as amended, is amended and reordained by the addi-
tion of a new subsection (e) to read as follows:
~22.1-44. Normal service retirement.
(e) Maximum annual benefit. Nothwithstanding any
other provision of this article to the contrary, the
annual benefit of any member shall not exceed the les-
ser of $90,000 or 100% of the member's average compen-
sation (as defined below) for the three consecutive
years of creditable service with the city which produce
the highest amount, and the rate of benefit accrual shall
be frozen or reduced accordingly; provided, however,
that such limitatlon, hereinafter sometimes referred to
as the maximum benefit, shall be subject to the follow-
ing:
(1) For purposes of this subsection (e)
only, compensation means the aggregate of the
member's wages, salaries, overtime, bonuses
and other similar amounts paid for personal
services actually rendered, including amounts
deferred by members, but excluding fringe
benefits.
(2) If the annual benefit commences before
age 62, the benefit must not exceed the lesser
of (i) the actuarial equivalent of a $90,000
annual benefit commencing at age 62 or (ii)
100% of the member's average compensation
(defined above) for the three consecutive
years of creditable service with the city which
produce the highest amount. This actuarial ad-
justment must not reduce the $90,000 limitation
below $75,000 if the benefit begins at or after
age 55. If the annual benefit commences before
age 55, it must not exceed an amount which is
the greater of (i) the actuarial equivalent of
a $75,000 benefit commencing at age 55 or (ii)
the actuarial equivalent of a $90,000 benefit
commencing at age 62. To determine actuarial
equivalence, the interest rate assumption must
not be less than the greater of the rate other-
wise specified for such purpose under the City
of Roanoke Pension Plan or 5%.
(3) If the annual benefit commences after
age 65, the benefit must not exceed the lesser
of (i) the actuarial equivalent of a $90,000
annual benefit beginning at age 65 or (ii)
100% of the member's average compensation for
the three consecutive years of creditable ser-
vice with the city which produce the highest
amount. To determine the actuarial equiva-
lence of benefits beginning after age 65, the
interest rate assumption must not be greater
than the lesser of the rate otherwise speci-
fied in the City of Roanoke Pension Plan for
such purposes or 5%.
(4) If the benefit is payable in any form
other than a straight life annuity (as defined
for purposes of Section 415 of the Internal
Revenue Code of 1954, as amended), for purposes
of determining compliance with the limitation of
this subsection (e) the annual benefit must be
adjusted so that it is the actuarial equiva-
lent of the straight life annuity in accord-
ance with the applicable United States Treasury
Regulations. The interest rate assumption used
for determining the actuarial equivalence of
such other forms of benefits must not be less
than the greater of the rate otherwise speci-
fled for such purpose in the City of Roanoke
Pension Plan or 5%.
(5) The maximum benefit must be reduced by
1/10 for each year less than 10 of the member's
years of creditable service.
(6) Effective on January 1, 1986, and each
January 1 thereafter, the $90,000 portion of
the maximum benefit, as well as the 100% of
compensation portion of the maximum benefit in
the case of any member whose employment has
terminated, must be increased in order to take
into account the increases in the cost of liv-
ing, or, with respect to the 100% of compensa-
tion portion, since the end of the calendar
year in which the termination of employment
occurred, the increases in the maximum benefit
shall occur automatically, without the neces-
sity of an amendment to this article, but only
when permitted by and in such amounts as are
prescribed in or pursuant to United States
Treasury Regulations promulgated under Section
415(d) of the Internal Revenue Code of 1954, as
amended.
(7) For the purposes of the foregoing limi-
tation, the limitation year within the meaning
of Section 415 of the Internal Revenue Code of
1954, as amended, means the 12 consecutive
calendar months beginning on July 1 and ending
on June 30. Years of creditable service must
be calculated on the basis of the limitation
year for purposes of this subsection (e).

City Pension Plan
The City of Roanoke Pension Plan is a qualified
retirement plan with the Internal Revenue Code Section 401. This
qualification is required to maintain a tax-free status of the
Pension Plan funds.
After revising the Employees' Retirement System (ERS)
and creating the Employees' Supplemental Retirement System (ESRS),
we requested a favorable determination from the Internal Revenue
Service to remain a qualified retirement plan.
We have received correspondence from the Internal
Revenue Service that once the attached ordinance is passed, the
necessary changes to our Code would once again allow qualification
of our plan under I.R.S. Code Section 401.
This ordinance in no way affects the calculation of
pension benefits in ERS or ESRS but is a required section on
maximum annual benefits required by the I.R.S.
I recommend adoption of the attached ordinance in order
to qualify our Pension Plan under the Internal Revenue Code
Section 401.

The six deficiencies all concerned the maximum benefit limitations.
We suggest adding this language as the new subsection (e) of Section

the old plan. This will avoid having to renumber all the sections
which follow and avoid the need to revise references to the plan which
now exist in the text.

AN ORDINANCE to amend and reordain ~22.1-9, Workers' Compen-
sation benefits offset against disability or death benefits, Code
of the City of Roanoke (1979), as amended, to provide that any
Workers' Compensation benefits payable to a member or beneficiary
shall be offset against any benefits payable under the City of
Roanoke Pension Plan; and providing for an emergency.
BE IT ORDAINED by the Council of the City of Roanoke as fol-
lows:
1. Section 22.1-9, Workers' Compensation benefits offset
against disability or death benefits, Code of the City of Roanoke
(1979), as amended, is hereby amended and reordained to read and
provide as follows:
$22.1-9. Workers' Compensation benefits offset
against retirement benefits.
Any amounts which may be paid or payable under
the provisions of the Virginia Workers' Compensation
Act or any similar law to any member or beneficiary,
or to the dependents of any member or beneficiary,
on account of any injury, occupational disease or
disability or incapacity, total or partial, or death
shall in such manner as the board shall determine,
be offset against and payable in lieu of any bene-
fits payable out of funds provided by the city
under the provisions of the city plan.
In the case of a member, beneficiary or depen-
dent of a member or beneficiary who elects to re-
ceive a lump sum settlement in lieu of periodic
payments for disability or death compensable under
the Virginia Workers' Compensation Act, the retire-
ment allowance shall cease or be reduced, as the
case may be. The amount of reduction shall be de-
termined by the workers' compensation benefit which
such person would have received had the lump sum
settlement not been consummated. The reduction
shall continue each month for a period of months
determined by dividing the workers' compensation
benefit which such person would have received had
the lump sum settlement not been consummated, into
the settlement actually accepted by the member,
beneficiary or dependent.

Benefits Offset Against Disability or Death Benefits
The Employees' Supplemental Retirement System (ESRS)
designates that a member age 55 or over cannot apply for non-
occupational or occupational disability. The Employees'
Retirement System (ERS) designates that a member age 65 or over
cannot apply for nonoccupational or occupational disability.
Section 22.1-9 of the Code of the City of Roanoke
addresses workers' compensation benefits offset against disability
or death benefits. Currently the Code does not specifically
address the situation of an employee applying for and being
awarded workers' compensation from the City of Roanoke and then
applying for normal service retirement from the City Pension Plan.
The workers' compensation offset should apply against
any benefit eligibility because Federal regulations now require
that mandatory retirement age is no longer allowed, except for
police officers and firefighters.

whose works are on permanent display at many Roanoke
Valley locations.
Roanoke Arts Conmission has reconunended acceptance and
installation of this sculpture in Colonial Plaza by the
City of Roanoke.

ture during the Annual Sidewalk Art Show scheduled to
begin on June 4, 1988.

Location of the permanent display in Colonial Plaza
would be very appropriate because Mr. Ostaseski was
a regular participant and an award winner in Roa-
noke's Sidewalk Art Shows held annually at this site
(see attached map). This location has been reviewed
with the property manager of the adjoining Colonial
American National Bank Building property.
Cost to the City would be the installation the
subject sculpture by City forces. The self-weather-
ing corten steel would not require any maintenance.
Timing relative to Council's action on this matter
is important because Roanoke Arts Comisston desires
to dedicate this sculpture during the Sidewalk Art
Show scheduled to begin on June 4~ 1988.
Do not accept Roanoke Museum of Fine Arts' offer to
donate the sculpture by the late Mr. Paul Ostaseski.
Recognition of a prominent local artist, through

Dear Bob:
Please consider this letter to be oar formal request that the City
receive the Corten Steel sculptural piece by the late Paul Ostaseski
entitled "Vertical Break".
This impressive piece of Modernist work by a native son was purchased
from the artist by the museum in 1979. It was installed in front of
the museum's old home at Cherry Hill until our move to Center in the
Square in December, 1983. Since then it has been in storage with the
hope that the city would be able to place it in an appropriate location.
At this time there seems to be agreement that "Vertical Break" should
be permanently placed near Colonial Plaza as the property, free and clear,
of the City of Roanoke. Our only stipulation is that there be an under-
standing that if the piece is removed from public display its ownership
will revert to the Roanoke Museum of Fine Arts.
For your records, the piece was purchased from Paul Ostaseski for
a very special price of $600 (for the museum). It probably had a real
market value in 1979 of about $2,500 which value has increased today
to about $5,000.
We here at the museum are all very pleased that this important piece
of sculpture is once again going to be on public display. Paul was a
very fine sculptor, and his sudden death at a young age was a great loss
to the entire arts community.
