Superfund Amendments and Reauthorization Act of 1986
SARA Title III
BACKGROUND
Major disasters like that in Bhopal, India in December
1984, which resulted in an estimated 2,000 deaths and
over 200,000 injuries, are rare. However, reports of
hazardous materials spills and releases are increas-
ingly commonplace.
August 1985, a chemical leaked from a Union Carbide
plant in Institute, West Virginia injuring six workers
and sending about 125 persons to hospitals for
evaluation and treatment.
Thousands of new chemicals are developed each year.
Recent evidence shows that hazardous materials
incidents are considered by many to be the most signi-
ficant threat facing local jurisdictions.
October 17, 1986, the "Superfund Amendments and Re-
authorization Act of 1986" (SARA) was enacted into law.
Title III: the Emergency Planning and Community Riqht-
to-Know Act of 1986 is one part of the SARA legisla-
tion. Title III provides for the following:
Establishes requirements for Federal, State and
local governments and industry regarding emergency
planning and "community right-to-know" reporting
on hazardous and toxic chemicals.
This legislation is aimed at helping communities
meet their responsibilities in regard to
potential chemical emergencies.
Community right-to-know provisions of Title III
will help increase the public's knowledge of and
access to information on the presence of hazardous
chemicals in their community and releases of these
chemicals into the environment.

Title III is organized into three (3) subtitles:
Subtitle A - Emergency Planning and Notification
establishes the framework for local emergency
planning. In addition, it provides the mechanism
for community awareness with respect to hazardous
chemicals present in the locality. This informa-
tion is critical for effective local contingency
planning.
Subtitle B - Reporting Requirements includes re-
quirements for the submission of MSDS (Material
Data Safety Sheets) and emergency and hazardous
chemical inventory forms to State and local
governments, and the submission of toxic chemical
release forms to the State and the EPA.
Subtitle C - General Provisions concerning trade
secret protection, enforcement procedures, citizen
suits, and public availability of information.
April 17, 1987, Governor of Virginia appointed Virginia
Emergency Response Council (VERC). The VERC is
responsible for supervising and coordinating the
activities of the local emergency planning committees
(LEPC), for establishing procedures for receiving and
processing public requests for information collected
under other sections of Title III, and for reviewing
local emergency plans.
July 17, 1987, Roanoke City, Roanoke County, City of
Salem and the Town of Vinton, formed the LEPC which was
named the "Roanoke Valley Hazardous Materials Emergency
Planning Committee." The local committee has the
following responsibilities:
Coordinate emergency response plans, prepare and
distribute a comprehensive local emergency
response plan for chemical emergencies to
include:

Identification of facilities and extremely
hazardous substances transportation routes;
Emergency response procedures, on site and
off site;
c. Emergency notification procedures;

Methods for determining the occurrence of a
release and the probable affected area and
population;

Description of community and industry
emergency equipment and facilities, and the
identity of persons responsible for them;
f. Evacuation plans;
Description and schedules of a training
program for emergency response to chemical
emergencies; and,
Methods and schedules for exercising response
plans.
Accept facility emergency notifications.
Manufacturing and non-manufacturing facilities must
immediately notify the VERC, LEPC, and National
Response Center (NRC) if there is a release of a
listed hazardous substance that exceeds the re-
portable quantity for that substance.
3. Establish a local emergency coordinator; and,
Establish procedures for receiving and processing
requests from the public for chemical information
received by the committee. This must be accom-
plished by October 17, 1988.
August 17, 1987, the VERC appointed members of the
local committee. (See Attachment "A") for list
of local committee members.
September 17, 1987, facilities subject to the emergency
planning requirements appointed a representative who
will participate in the planning process as the
Facility Emergency Coordinator.
october 17, 1987, MSDS or list of MSDS chemicals were
to be submitted to the VERC, local committee and local
fire department.
November 24~ 1987, Department of Emergency Services
sponsored conference at Roanoke Civic Center on
Emergency Planning and Community Right-to-Know Act
held for representatives of industry, local govern-
ment and emergency services organizations.
March 1, 1988 and annually thereafter, facilities were
to submit their emergency inventory forms to the
VERC, local committee and local fire department.

Emergency Services staff have attended a week long
Hazardous Materials Contingency Planning Course which
outlined organizing an LEPC, conducting a hazard/
vulnerability analysis, and developing an emergency
response plan for hazardous materials.
II. CURRENT SITUATION
Ail requirements outlined in background above have been
met within the established deadlines for completion.
Roanoke Valley Hazardous Materials Planning Committee
meets once a month. Sub-committees have been formed
to begin development of the local emergency response
plan.
Efforts are being made to identify and evaluate
computer hardware and software programs which will
assist in collecting and maintaining data on emergency
planning and community right-to-know requirements as
established by SARA Title III. Additional program
capabilities include resource and personnel management,
emergency preparedness and disaster response and pro-
viding real-time information about flooding conditions.
III.
ISSUES
A. Funding
Local government must bear the cost of these
requirements as there are no state or federal
funds available for implementation.

Legal Issues
State Department of Solid and Hazardous Waste
Management has made provisions to provide
liability insurance coverage for members of local
planning committees.
Municipalities and facilities face potential civil
and criminal penalties for failure to comply with
the provisions under SARA Title III.
Timing
October 17~ 1988, local emergency planning
committee (LEPC) is responsible for completing
an emergency plan and reviewing the plan at least
annually.
IV. CONCLUSION
It is important to understand that SARA Title III presents
many complex and challenging issues for municipalities.
During the early stages of this program, there will be much
confusion, an overabundance of information and demands will
be placed upon understaffed and underfinanced state and
local authorities.

funding in Five-Year Capital Budget (1984-1989).
July 22, 1985, City Council authorized the City
Manager to proceed with implementation of an Enhanced
9-1-1/CAD Communication System.
September 9, 1985, City Council by Ordinance No. 27783
accepted the proposal submitted by C & P Telephone
Company to provide Enhanced 9-1-1 telephone service.
October 10, 1985, City Manager executed application for
Enhanced 9-1-1 service with C & P Telephone Company.
March 16, 1986, City Manager appointed in-house 9-1-1
Committee to coordinate and expedite implementation of
the 9-1-1/CAD system.

purchasers of local telephone service.
March 16, 1987 City Council awards bid by contract to
NCR Corporation to furnish and install a computer-
aided dispatch system.
March 16, 1987 City Council awards bid by contract to
Motorola C & E, Inc. to furnish and install
communications consoles and mobile data terminal
system.

II. CURRENT SITUATION
October 5, 1987, 9-1-1 implemented Valley-wide on
schedule. City operation conducted from temporary
Emergency Communications Center. Transition completed
in timely manner with no complications. All reports
indicate system operating as predicted with total
Valley-wide acceptance. Today, local Police, Fire and
Rescue administrators express complete satisfaction
with this new technology.
Statistics indicate 9-1-1 usage for Fire and Rescue
nearly 80% after six months. Old seven digit numbers
will be gradually phased out during the first six month
of 1988. Police usage of 9-1-1 system approximates
59% with Fire 78.5% and Rescue 78.1%. During the
six month period October 5, 1987 through April 5, 1988,
the total number of emergency calls processed was
46,306 with 22,549 being handled on the new 9-1-1
system. Telephone experts consider this to be a better
than average six month system evaluation. Total usage
will not occur until the old emergency seven digit
numbers are disconnected; at which time automatic
recorders will direct callers to 9-1-1 trunks.
Structural modifications to Emergency Communications
Center 98% complete. Fine-tuning of heating,
ventilating and air conditioning are currently being
accomplished. The target date for completion is
May 6, 1988.
Training of Communications, Emergency Services, Fir~
and Police personnel to be completed by May 29, 1988.
These personnel received instruction in operation of
the computer-aided dispatch (CAD) system. Adminis-
trative personnel receive an overview of the computer-
driven systems capability. Additionally, Communica-
tions personnel training included operation of the CAD
system in a simulated live environment.
Move to new Communications Center targeted for lato
May. Communications operating personnel are
scheduled to occupy the new Emergency Communications
Center May 23, 1988. This move will begin a transition
cycle of approximately 90 days. During this period,
we will pre-test the CAD System in a live environment.
Final testing will begin subsequent completion of the
Mobile Data Terminal System in late August.

III. SUMMARY
It is well to note that the planning design and implemen-
tation of these complex systems have spanned a twenty (20)
year period which began in 1968 with the AT&T announcement
that the digits "9-1-1" would henceforth be reserved as the
universal emergency telephone number. Subsequent the
relocation of our Communications Center to a temporary site
May 1, 1987, the 9-1-1/CAD Project activities completed
are as follows:
First Draft of the Geographical Database was completed
October 1987
B. CAD Computer installed August 1987
Communications Consoles installed September 1987
Fully operational with 9-1-1 October 1987
Mobile data terminal radio system turned on for test
December 1987
F. Two primary interfaces were completed by March 1988.
These interfaces were to connect 9-1-1 and the
Virginia Criminal Information Network to the CAD System
The remaining critical activities necessary to complete this
project are the interfaces between the City's host (IBM)
computer, Mobile Data Terminal Network and the CAD computer.
During the transition period over the next several months,
we expect our personnel will be highly stressed as these new
technologies are brought on line. We will endeavor to be
accountable and retain our high standards throughout this
critical period.

Roanoke that:

Valley Fair.
4. The applicant organization shall, and by execution of
this resolution, does agree to indemnify and save harmless the
City, its officers, agents and employees from any and all claims,
legal actions and judgments advanced against the City and for
expenses the City may incur in this regard, arising out of such
organization's intentional acts or negligent acts or omissions
related to use of City facilities and property.
5. The applicant organization shall comply with all appli-
cable terms and conditions of Resolution No. 24982, dated
January 28, 1980.

Roanoke Special Events Con~nittee was appointed by City

Family-type events must be planned and implemented, as
well as adult events.
Ob.jectives of the Committee are to create entertaining
and fun type events, attracting local citizens, as well
as bringing thousands of other people into Roanoke.
The Roanoke Valley Fair is planned for Victory Stadium
and Armory on June 24, - July 2, 1988, including carnival
rides, crafts, and Old MacDonald's Farm, country foods,
exhibitions, and shows and in honor of Roanoke County's
Sesquicentennial.
The Motown Beach Party is May 14, 1988, and features four
(4) nationally known acts playing an afternoon concert.
Criteria established by Resolution No. 24982, for waiving
fees for Victory Stadium's use has been met as the
Committee is tax exempt.
Net proceeds will be used by the Committee for ongoing
events.
Public liability insurance in an amount of $1~000~000 per
occurrence is provided by the Committee with a hold-
harmless clause and names the City of Roanoke as
co-insured.

BE IT RESOLVED by the Council of the City of Roanoke as
follows:
1. That the City of Roanoke does hereby accept the offer
made to said City by the United States of America, Department of
Housing and Urban Development, under date of April 21, 1988, of
a grant of Federal funds under Subpart B of Title IV of the
Stewart B. McKinney Homeless Assistance Act of 1987 (Public Law
100-77), amounting to $4,000.00 in funding to be used for opera-
tion of shelters for the Roanoke area homeless population as set
out and described in the City's application for said funding made
as Grant No. S-88-MC-51-0005 by said Department, upon all of the
terms, provisions and conditions therein set out, a copy of the
aforesaid offer to which is attached the Grant Agreement and HUD
funding approval forms, and the terms, provisions and conditions,
upon which said grant is made being on file in the Office of the
City Clerk and being expressly incorporated herein by reference.
2. The City Manager, or Assistant City Manager, be and is
authorized and directed to execute, for and on behalf of the
City, written acceptance of the City on the proper forms, thereby
agreeing on behalf of the City, to comply with the terms and con-
ditions of the aforesaid Grant Agreement, applicable law and
regulations and all requirements of the U. S. Department of
Housing and Urban Development, now or hereafter in effect, per-
taining to the assistance provided.
3. That upon execution of the City's acceptance of said
offer and execution of agreement to the terms and conditions
incorporated therein, the original and one copy of the aforesaid
document be forthwith forwarded to the Richmond Area Office of
the Department of Housing and Urban Development, together with

SUBJECT: EMERGENCY SHELTER GRANTS PROGRAM GRANT AWARD ALLOCATION
I. BACKGROUND
City Council accepted a__qn Emergency Shelter Grants Program
grant award of $26,000 on November 16, 1987, by Resolution
No. 28872, allocated under the Stewart B. McKinney Homeless
Assistance Act from the U.S. Department of Housing and Urban
Development to provide services to the homeless.
City appropriated the funds to an Emergency Shelter Resource
Fund enabling local non-profit organizations to apply for
financial support to improve the quality of shelter
facilities.

Council concurred with the recommendation submitted by the
City Manager's Follow-up Task Force on Homelessness on
January 25, 1988, by Resolution No. 28963, to allocate the
funds as follows:
1. $20,000 to Total Action Against Poverty, Inc.
2. ~ 3,000 to Roanoke Area Ministries.
3. ~ 3,000 to Salvation Army.

The Salvation Army declined to accept the grant due to
objections by its national office to the exclusionary
religious language used by the Department of Housing and
Urban Development.
Council authorized the City Manager on April 4, 1988, by
Resolution No. 29047, to reallocate $3,000 from the
Emergency Shelter Resource Fund to Roanoke Area Ministries.

Impact on Services in the City would be positive,
through the provision of additional funds to be used for
the improvement of facilities and services available to
the area's homeless population.
2. Funding would not be an issue since no additional City
funds are required.
Timing is important in order to assure that the grant
award is not recovered and reallocated by the Department
of Housing and Urban Development. Funds must be
obligated within 180 days of April 21, 1988.
B. Do not authorize the City Manager to accept the Emergency
Shelter Grants Program grant award.

to Account No. 035-054-8831-2210 and increase the revenue
estimate in the Grant Fund.

lowest responsive bid, is hereby ACCEPTED.
2. The City's Manager of General Services is authorized and

I. BACKGROUND
March 7, 1988, specifications were developed for one (1) new
offset printing press as replacement to an existing unit in
Management Services Department.
Bid Requests were specifically sent to four (4) firms
currently listed on the City's bid list. A public
advertisement was also published in the Roanoke Times and
World News on March 13, 1988.
Bids were received, after due and proper advertisement,
until 2:00 p.m., on March 24, 1988, at which time all bids,
so received, were publicly opened and read in the Office of
the Manager of General Services.

the Equipment Replacement Contingency Account to
purchase police automobiles.
Decen~ber 21, 1987, Council awarded the bids for
marked police automobiles and rejected the bids on
unmarked automobiles. The lowest responsible bid
for unmarked automobiles was $12,574.00 per unit.

Specifications were revised around previously
owned mid size vehicles not more than one (1) year
old with no more than 10,000 odometer miles.
Request for Quotations were sent to sixteen (16)
vendors and was publicly advertised in the Roanoke
Times and World News. No bids were received.
Specifications were again revised around new mid
size automobiles. These specifications were sent
to sixteen (16) vendors and publicly advertised in
the Roanoke Times and World News.
E. Bid responses were received.
II. CURRENT SITUATION
Five (5) bid responses were received. Bid
tabulation is attached.
Ail bids were evaluated in a consistent manner by
representatives of the following departments:

General Services
The lowest bid submitted by Allred Chevrolet,
Inc., took exception to the required minimum
wheelbase and is not classified as a mid-size
vehicle.

The second lowest bid submitted by Shelor
Chevrolet Corporation took exception to the full
size spare tire and rim as requested. This
exception will substantially affect price and
quality and cannot be waived as an informality.
The lowest responsible bid submitted by Woodson
Pontiac Inc., took one exception to the specifi-
cations. Their quote is for a manually operated
left side mirror instead of remote operated. This
exception has been determined an informality as it
does not substantially affect the price and
quality, as defined in the Code of the City of
Roanoke, Section 23.1-1.

I. BACKGROUND
November 9, 1987, City Council designated funds in the
Capital Maintenance and Equipment Replacement Program
to provide for trucks and related equipment for Build-
ing Maintenance and Street Maintenance Departments.
Requests for Quotation were developed and sent specifically
to nineteen (19) vendors currently listed on the City's
Bid List. An advertisement was also published in the
Roanoke Times and World News.
Bid Responses were received after due and proper adver-
tisement until 2:00 PM on March 10, 1988, at which time
all bids so received were publicly opened and read in
the Office of the Manager of General Services.
II. CURRENT SITUATION
Eight (8) Bids were received. Bid tabulation is attached.
All Bids were evaluated in a consistant manner by repre-
sentatives of the following departments:

Sunlink Site - Parcel lB
I. Background
Sunlink Corporation has contracted to buy 13.8 acres of land
from the City of Roanoke, being Parcel lB in the Roanoke
Centre for Industry and Technology. Sunlink is the real
estate division of Bell Southern, a corporation which recently
bought Universal Communication Systems (UCS).
Universal Communication Systems, which currently employs 240
people in the City of Roanoke will be occupying a 70,000
square foot facility with an investment of $7,000,000 and
expanding their work force by 100 to 150 people over the next
several years. With Bell Southern as owner of Universal
Communication Systems its potential for future growth is
enormous.
II. Current Situation
Sunlink Corporation will lease the land and building to
Universal Communication Systems.
Deed Restriction No. 12 states that "No purchaser from the
City of property in the Centre shall lease such property
without the prior written consent of the City."

AN ORDINANCE authorizing acquisition of certain real property
adjacent to King Street for the purpose of constructing a public
street; authorizing the City Manager to take appropriate action
for purchase of this property; authorizing the City's acquisition
of this property by condemnation, under certain circumstances;
and providing for an emergency.
BE IT ORDAINED by the Council of the City of Roanoke that:
1. For the construction of a public street adjacent to King
Street, the City wants and needs fee simple title, with appur-
tenant rights, to the following described property owned by
Obediah and Anita T. Overstreet, and Alice K. Harris, consisting
of .193 acre and .222 acre, respectively, as set forth in the
report to this Council dated May 9, 1988, and more particularly
described on Roanoke City Plan Nos. 6070 and 6070-A, dated
April 27, 1988, copies of which are on file in the Office of the
City Clerk, and are incorporated by reference as a part of this
ordinance. The proper City officials are authorized to acquire
this land for the City for the amount of the final appraised
value, the amount negotiated by the City administration and the
landowner, the exchange of similar City-owned property, or the
amount of any condemnation award.
2. A public necessity and use exists for the acquisition of
said property and immediate acquisition by purchase or condem-
nation is necessary and expedient.
3. The City Manager is authorized to contract with said
landowners on behalf of the City for purchase of such properties
for amounts or property exchanges deemed appropriate. Upon
acceptance of any offer and upon delivery to the City of a deed,
approved as to form by the City Attorney, the Mayor and City
Clerk are authorized to execute and attest, respectively, any
appropriate deed of exchange and the Director of Finance is
directed to pay the agreed upon amount to the owners of the
interests conveyed, certified by the City Attorney to be entitled
to the same.
4. Should
any real estate

(1950), as amended, including, without limitation, issuance, exe-
cution, and recordation of an appropriate certificate and accom-
panyinE documentation pursuant to $33.1-119, et seq, Code of
VirEinia (1950), as amended, vestinE title to the subject pro-
perty immediately in the City, and the Director of Finance, upon
request of the City Attorney, shall be authorized and directed to
draw and pay into Court the appropriate sums in connection with
such proceedinEs.
5. The City Clerk is directed to mail a copy of this ordi-
nance to Thomas N. Key, Esquire, and Anthony F. Anderson,
Esquire, counsel for the respective property owners.

City owns an approximate 20 acre tract Official Tax Map No.
7050107 off Berkley Road, approximately 10 acres of which is
under contract to Tultex Corporation for construction of a
50,000 square foot manufacturing facility to be used as a
sewing plant.
B. Public street connecting City Property to King Street is
needed immediately. Acquisition of property and construction
of public street is necessary and expedient course of action.

Exact location of new public street has now been determined.
The City of Roanoke has an immediate need to acquire property
for the public street.

I. Backsround:
A. City acquired property in two (2) locations as detailed
below:
Lot 13, Section 2~ Monterey North, 4700 Block of
Nelms Lane, N.E., Official Tax No. 7390713,
acquired in 1980 as a part of the Monterey North
Water System.

Lots 9, 10p 11 & 12~ Block 79, Melrose Land
Company, 200 Block of Staunton Avenue, N.W.,
Official Tax Nos. 2332009, 2332010, 2332011 and
2332012, acquired at public auction in 1942.
B. Lots have been declared surplus to the City's needs:
Lot on Nelms Lane~ N.E., Official Tax No. 7390713,
contained a water storage tank. Tank has been
removed.

Lots on Staunton Avenue~ N.W., Official Tax Nos.
2332009 thru 12, have been held as having potential
for park use. Staunton Avenue Park is located two
blocks west, is much larger and has superior
topography.
C. Office of Real Estate Valuation has established the following
values for tax purposes:
1. Lot on Nelms Lane, N.E., $5~000.00.
2. Lots on Staunton Avenue, N.W. $2,500.00 each, total
$10~000.00.

II. Current Situation:
An ad~oinin~ landowner indicated an interest in purchasing
the Nelms Lane, N.E. lot. Several parties expressed interest
in the Staunton Avenue, N.W. lots. As per instructions from
the Water Resources Committee, staff offered the property for
sale to the general public by advertisement published in the
Roanoke Times & World News, on two consecutive Sundays, March
6 and 13, 1988.
III. Issues:
Bids were received for both the Nelms Lane, N.E. and Staunton
Avenue, N.W. lots on March 17, 1988. The bids are summarized
as follows:
Single bid in the amount of $3~700.00 for the lot on
Nelms Lane, N.E., Official Tax No. 7390713 from
Jackson E. Jewell.

Two bids for the lots on Staunton Avenue, N.W.
Official Tax Nos. 2332009 thru 12, one in the
amount of $10~100.00 from Deliverance Church of
Christ and one in the amount of $1~600.00 from
Anthony C. Wade.
