AN ORDINANCE amending and reordaining $6-110, Location of apiaries,
and ~6-111, Water supply for bees, Code of the City of Roanoke (1979),
as amended, and adding a new ~6-109.1, Definitions, and a new ~6-112,
Density requirements, the amended and added sections defining "beehive",
establishing permitted locations for beehives, maximum density regula-
tions for beehives and other regulations pertaining to the keeping of
bees; and providing for an emergency and an effective date.
WHEREAS, expert apiculturists recognize that it is possible to keep
a small number of beehives in a crowded urban environment without cre-
ating a nuisance;
WHEREAS, however, the same experts recognize that too ~ny beehives
on a small urban lot can create a nuisance; and
WHEREAS, it is the intent of this Council to protect the public
health and safety and to abate nuisances without interfering with the
ability of beekeepers who practice good management and good housekeep-
ing to ~intain a reasonable number of beehives as a hobby;
THEREFORE, BE IT ORDAINED by this Council as follows:
1. Section ~-110, Location of apiaries, and ~6-112, Water supply
for bees, Code of the City of Roanoke (1979), as amended, are amended
and reordained as follows:
~6-110. Location of beehives.
It shall be unlawful for any person to keep or
place a beehive or cause or allow a beehive to remain:

Closer than ten (10) feet to the property
line of adjoining property of anyone other
than the person maintaining the beehive or
his immediate family; or
Closer than fifty (50) feet to any house
or other building used for residential
purposes by anyone other than the person
maintaining the beehive or his immediate
family or any apartment, hotel, motel,
office, commercial establishment, church
or school; or
Closer than thirty (30) feet to any "street"
as defined by $1-2 of this Code.
$6-111. Water supply for bees.
Every person owning, possessing or keeping any
beehive shall maintain, within fifty (50) feet of
each beehive, an adequate, accessible and useable
supply of water for the bees.
2. The Code of the City of Roanoke (1979), as amended, is amended
and reordained by the addition of the following new sections:
$6-109.1 Definitions.
For the purposes of this Article, the word "beehive"
shall have the following meaning:
Beehive. The word "beehive" shall mean
single colony, hive or stand of bees, re-
gardless of size.
$6-112. Density requirements.
(a) No person shall keep, place or maintain more
than four (4) beehives on any parcel of real property
which contains ten thousand (10,000) square feet or
less in area. With respect to parcels larger than
ten thousand (10,000) square feet in area, one addi-
tional beehive shall be permitted for each two thou-
sand (2,000) square feet of area in excess of ten
thousand (10,000) square feet. Notwithstanding the
foregoing, during the months of April, May and June
(swarm season) only, a person shall be permitted to
keep two additional beehives, over and above those
permitted during the balance of the year, on any par-
cel of real property.
(b) The density restrictions established by this
section shall have no application to beehives kept,
placed or maintained on any parcel of real property
of one acre or larger in size or on any parcel zoned
Residential Agricultural (RA).
3. In order to provide for the usual daily operation of the
municipal government, an emergency is deemed to exist, and this ordi-
nance shall be in full force and effect on and after July 1, 1988.

Re: Beekeeping regulations
Dear Mrs. Bowles and Gentlemen:
At the Council meeting of April 25, 1988, Council had
before it our report recommending certain beekeeping regula-
tions along with a draft of a proposed ordinance regulating
beekeeping. A copy of our report of April 25, 1988, is at-
tached for the convenience of Council. After being briefed
and hearing comments of beekeepers and other citizens, Coun-
cil referred the matter back to the City Manager and the
City Attorney for the preparation of an ordinance to be pre-
sented at the Council meeting of May 2, 1988. Subsequently,
on April 26, 1988, the review team established to recommend
an ordinance with respect to this matter met with members of
the Blue Ridge Beekeepers Association and obtained additional
comments from them.
After hearing the comments of beekeepers and citizens at
large, we are pleased to recommend to you the attached ordi-
nance which we believe represents a balanced approach to the
issue of beekeeping in a crowded urban environment. The ordi-
nance has been amended in four respects from the draft which
was before you on April 25, 1988.
First, the word "beehive" will be substituted for the
word "apiary" in the City Code. The word "beehive" is de-
fined by $6-109.1. The Blue Ridge Beekeepers Association
recommends this change, and we believe that it provides more
precision to the proposed ordinance.
Second, the ordinance now provides that a beehive shall
not be kept closer than thirty feet to any "street" as de-

fined by the City Code. The Code's definition of "street"
includes streets, alleys and other public rights-of-way. The
draft ordinance before you on April 25, 1988, provided for a
setback of forty feet from a street. We believe that this
amendment will be fairer to beekeepers ~hile still protect-
ing public safety.
Third, the ordinance now allows a beekeeper to keep two
additional beehives during the months of April, May and June
(the swarm season). This provision was added at the request
of the Beekeepers Association and in an attempt to accommo-
date beekeepers who perform a public service by capturing
swarms.
Finally, the effective date of the ordinance has been
amended from May 15, 1988, to July 1, 1988. We are advised
that bees are now beginning their heaviest honey production,
and the amendment in the effective date of the ordinance
will mitigate the hardship to the one beekeeper who is known
to have compliance difficulty.
We would be pleased to answer any questions Council may
have with respect to this matter.

I. Back~round:
April 11, 1988, Ms. Stephanie Jackson, 2014
Staunton Ave. N. W. appeared before City Council
to express her concerns about her neighbor's
beekeeping activities and requested a change in
the ordinance, city Council referred request to
City Manager and City Attorney for their review
and recommendations.
Code of the City of Roanoke (1979), chapter 6,
article 6 governs beekeeping and was developed
after extensive public hearings in 1978.
Ce
Intent of the ordinance is to allow
beekeepers who practice good management and good
housekeeping to maintain a reasonable number of
apiaries (beehives) as a hobby within residential
zoning.
Enforcement is handled by the Animal
Control unit of the Police Department.
II. Current situation is:
City Manager established a review team to
analyze the situation and develop recommenda-
tions. The review team consisted of Wilburn C.
Dibling, Jr, City Attorney, George C. Snead,
Jr., Director, Administration and Public Safety,
Dolores C. Daniels, Assistant to the City Manager
for Community Relations, M. David Hooper,
Chief of Police, Gordon E. Peters, City Treasurer
(and mem~ber of Blue Ridge Beekeepers
Association), and Dr. Richard Fell, Virginia
Tech Associate Professor of Entomology
(Apiculturist).
Review team of Ms. Jackson's request concerning
property owner at 2024 Staunton Ave. N. W.
revealed that there were twenty-nine (29) working
apiaries on an approximately fourteen thousand
(14000) square foot lot. A violation was cited by
the Police Department and is now pending before
court.
C. Timing is important because warm weather causes
bees to become more active.
III. Issues are:
A. Effectiveness of existing ordinance.
B. Enforcement of ordinance.
C. Cost to the City.
IV. Alternatives:
Amend the existing ordinance to further restrict
the distance that apiaries can be placed to
adjoining properties and enact a density require-
ment. Draft of proposed amended ordinance is
attached.
Effectiveness of existing ordinance does not
address the number of apiaries on small urban
lots.
Enforcement of the present ordinance will
remain with the Animal Control unit of the
Police Department.
3. Cost to the City would be none.
B. Do not amend the existing ordinance.
1. Effectiveness will be unchanged.
Enforcement of present ordinance would still
be the responsibility of the Police
Department.
Cost to the City would be none. However,
citizen concerns in neighborhoods where
large beekeeping activities are present
may cause these neighborhoods to become

property maintenance due to lower resale
potential.
Recommendation is that City Council approve Alternative
"A" to amend the existing ordinance to further restrict
the distance that apiaries can be placed to adjoining
properties and enact a density requirement. Draft
ordinance will be presented for consideration of
Council on May 2, 1988. Proposed draft ordinance sent

BE IT ORDAINED by the Council of the City of Roanoke as
follows:
1. The bid of Branch & Associates, Inc., in the total amount
of $276,675.00, for replacement of the existing diesel blower drive
unit at the Water Pollution Control Plant, such bid being in full
compliance with the City's plans and specifications made therefor
and as provided in the contract documents offered said bidder,
which bid is on file in the Office of the City Clerk, be and is
hereby ACCEPTED.
2. The City Manager or the Assistant City Manager and the
City Clerk are hereby authorized on behalf of the City to execute
and attest, respectively, the requisite contract'with the success-
ful bidder, based on its proposal made therefor and the City's spe-
cifications made therefor, said contract to be in such form as is
approved by the City Attorney, and the cost of said work to be paid
for out of funds heretofore or simultaneously appropriated by
Council.
3. The other bid made to the City for the aforesaid work is
hereby REJECTED as nonresponsive and the City Clerk is directed to

I. Background:

City Council, at its March 28, 1988 meeting, following proper
advertisement, publicly opened and read aloud two (2) bids
received to Replace the Existing Diesel Blower Drive Unit
with an Electric Motor at the Water Pollution Control Plant.
Two (2) bids were received with the General Electric Company
of Richmond, Virginia appearing to be the iow bidder in the
amount of $225~000.00. The General Electric Co. had an
attachment to their bid form that listed eight (8) exceptions
to the contract documents. In response to a request from the
Engineering Department the City Attorney's office advised
that six (6) of these items appeared to substantially
affect price, quality, quantity or delivery schedule for
the goods, services or construction being procured. For
these reasons the City Attorney advised that the exceptions
rendered General Electric Company's bid non-responsive. See
attachment of exceptions.
Co
Branch & Associates~ Inc. submitted the other bid with a
base price of $270~093.00 based upon the 1750 HP, 4160 Volt
Motor from Toshiba for the sum of ~68~845.00 and the Medium
Voltage Starters with controls and enclosures from Toshiba
for the sum of $24~800.00. The consulting engineer for
the City of Roanoke had specified several manufacturers for
these two items that would be acceptable and Toshiba was not

one of the pre-approved suppliers. The specifications
further stated that any manufacturer wishing to bid the pro-
ject, that was not pre-approved, should submit their engi-
neering data to the Consulting Engineer for review prior to
submitting their quotation. The required pre-bid information
was not submitted by Toshiba and the consulting Engineer has
declared their bid non-responsive. The approved bid from
Branch & Associates, Inc. would then become a Westinghouse
Motor for $79~000.00 and Square D Voltage Starter and
controls for $25~727.00 or a total base bid of $281,175.00.
This quotation is acceptable to the Consulting Engineer and
is in compliance with the requirements of the Contract
Documents. A deduct of $4,500.00 may be taken to permit the
delivery of the disassembled blower engine to the plant
storage warehouse to be warehoused by City personnel, rather
than crating parts. This would reduce the acceptable bid to
$276~675.00. This would actually speed up the process of
cataloging parts and would be acceptable.
Pro~ect consists of the replacement of a diesel blower engine
with an electric motor, the electric service, starters and
controls.
II. Issues in order of importance are:
A. Compliance of the bidders with the requirements of the
contract documents.
B. Amount of the iow bid.
C. Funding of the project.
D. Time of completion.
III. Alternatives are:
Award a lump sum contract to Branch & Associates, Inc. of
Roanoke, Virginia in the amount of ~276~675.00 and a spe-
cified construction time of 210 consecutive calendar days in
accordance with the contract documents as prepared by Clean
Water Engineers, Inc., Consulting Engineers.
Compliance of the General Electric Co. bidder with the
requirements of the contract documents was not met as
listed under Background above. Branch & Associates,
Inc. did comply with the bid document requirements with
their second listed bidder which increased their low bid
amount as quoted under I. C. above.

IV.
Amount of the low responsive bid is acceptable because
of the urgency of having another source of power for the
blower engine.
3. Fundin~ is available in the Retained Earnings Account
for the Water Pollution Control Plant.
Time of completion is specified as 210 consecutive
calendar days which is acceptable. One diesel blower
engine is operational, one is being overhauled and this
one (No. 8) should be replaced as soon as possible.
This replacement also will provide another source of
power for operation which gives the plant versatility of
operation.
Reject the bids and do not award a contract at this time.
1. Compliance of the bidders with the requirements of the
Contract Documents would not be an issue.
2. Amount of the low bid would change if re-bid at a later
date.
3. Fundin~ would not be encumbered at this time.
4. Time of completion would be extended. It is important
that this project be completed as quickly as possible to
provide a back-up source of blower power for the opera-
tion of the plant. (Without blower power the plant
would be out of operation.) It should also be noted
that this blower power source is different from the
remaining blower engines for the sake of versatility of
operation.
Recommendation is that City Council take the following action:
A. Concur with the implementation of Alternative "A".
Authorize the City Manager to enter into a contractual
agreement, for the lowest responsive bid, with Branch &
Associates, Inc., for the Replacement of the Existing Diesel
Blower Drive Unit with an Electric Motor at the Water
Pollution Control Plant in accordance with the Contract
Documents as prepared by Clean Water Engineers, Inc., in the
amount of $276,675.00 and 210 consecutive calendar days.

AN ORDINANCE accepting the bid of Virginia Resource
Development Corporation t/a Gaines and Oguin, for the exterior
and interior painting of the Carvins Cove Filter Plant, and
awarding a coutract therefor; authorizing the proper City offi-
cials to execute the requisite contract for such work; rejecting
all other bids made to the City for the work; and providing for
an emergency.
BE IT ORDAINED by the Council of the City of Roanoke as
follows:
1. The bid of Virginia Resource Development Corporation t/a
Gaines and Oguin, in the total amount of $9,150.00 for the
exterior and interior painting of the Carvins Cove Filter Plant,
such bid being in full compliance with the City's plans and spe-
cifications made therefor and as provided in the contract docu-
ments offered said bidder, which bid is on file in the Office of
the City Clerk, be and is hereby ACCEPTED.
2. The City Manager or Assistant City Manager and the City
Clerk are hereby authorized on behalf of the City to execute and
attest, respectively, the requisite contract with the successful
bidder, based on its proposal made therefor and the City's speci-
fications made therefor, said contract to be in such form as is
approved by the City Attorney, and the cost of said work to be
paid for out of funds heretofore or simultaneously appropriated
by Council.
3. Any and all other bids made to the City for the afore-

I. Background:
City Council, at its April 18, 1988 meeting, publicly opened
and read aloud the bids received for the Exterior (and
Interior) painting at the Carvins Cove Filter Plant.

Two (2) bids were received with Virginia Resource Development
Corporation t/a Gaines and O~uin of Lynchburg, Virginia sub-
mitting the low bid in the amount of $9~150.00 and 25 con-
secutive calendar days project time. --

Project consists of painting all exterior woodwork on the
filter building except for the new windows installed last
year, the interior side of all windows in the filter bays and
the exterior woodwork of the low lift pump station.
II. Issues in order of importance are:
A. Compliance of the bidders with the requirements of the
Contract Documents.
B. Amount of the low bid.
C. Funding of the project.
D. Time of completion.

III. Alternatives are:
Award a lump sum contract to Virginia Resource Development
Corporation t/a Gaines and Oguin in the amount of $9~150.00
and__25 consecutive calendar days for Exterior (and Interior)
Painting at the Carvins Cove Filter Plant in accordance with
the Contract Documents as prepared by the City Engineer's
Office.
1. Compliance of the bidders with the requirements of the
Contract Documents was met.
2. Amount of the low bid is only slightly higher than the
engineer's estimate and is acceptable.
3. Funding is available in the Carvins Cove Filter Plant
Exterior Painting, Account No. 002-056-8335-9060.
4. Time of completion as quoted is acceptable.
B. Reject the bids and do not award a contract at this time.
1. Compliance of the bidders with the requirements of the
Contract Documents would not be an issue.
2. Amount of the low bid could increase if the project is
rebid at a later date.
3. Funding for the project would not be encumbered at this
time.
Time of completion would be extended. This is one of
the projects that was delayed because of the flood
damage projects and the work needs to be done without
further delay.
IV. Recommendation is that City Council take the following action:
A. Concur with the implementation of Alternative A.

Proposed Audit for the Fiscal Year Ending June 30,

The Roanoke Regional Airport Commission is a separate
and distinct entity, newly created July 1, 1987. In order to
maintain the fiscal integrity and independence of the Commission,
it is essential that an audit of the financial statements be
completed by an independent third party.
Since it is already well into the fiscal year, it is
recommended that the firm of Peat, Marwick, Main & Co. be
contracted with as an addendum to the City of Roanoke's contract
with that firm per their letter to Mr. Brogan dated February 15,
1988.
It is also recommended that the Commission ~ppoint an
Audit Committee composed of two members of the City and two
members of the County to meet with Peat, Marwick, Main prior to
the audit to express any special concerns of the City or the
County and then to receive and review the reports when the audit
is completed prior to submitting it to the Commission.
If you agree with the above recommendations, I will
present this recommendation to the Roanoke City Council for their
approval as this would be an addendum to an existing City
contract.
For all fiscal years following

We are pleased to issue this letter which will serve as an addendum to our audit
contract with the City of Roanoke whereby we will perform the following professional
services for the Roanoke Regional Airport Commission:
Examine the financial statements as of and for the period ended June 30,
, 1988. The examination will be conducted in accordance with generally
· accepted auditing standards and will include such tests of the accounting
records and such other auditing procedures as we consider necessary
in the circumstances.
Render our report in accordance with generally accepted government
auditing standards as defined by Standards for Audit of Governmental
Organizations~ Programs~ Activities~ and Functions issued by the
Comptroller General of the United States relative to financial and
compliance audits, United States Office of Management and Budget
(OMB) Circular A-128, Audits of State and Local Governments, and the
specifications of the Auditor of Public Accounts, Commonwealth of
Virginia.
Issue our separate opinions on the financial statements and the federal
"single audit" statements referred to above.
Issue a letter to the Commission on any matters affecting internal control
that we note during our examination.
We will complete our work in accordance with the time tables agreed to in the basic
audit contract with the City. Since the City's accounting system is used to process
much of the airport's information, and we have knowledge of the City's system,
our fees for these professional services will not exceed $6,000.
