VIRGINIA, AN ORDINANCE authorizing the City Manager to file an application with the Virginia Department of Transportation for up to $200,000 in Industrial Access Road Funds to provide industrial access by con- struction of a new roadway to serve a new industrial project in the City; setting out the need therefor; making provision for furnishing the necessary right-of-way therefor and for the adjustment of utili- ties; assuring that the City will maintain said new roadway; and pro- viding for an emergency. WHEREAS, the Tultex Corporation will be constructing a new facility on industrial property presently unserved by an improved public right- of-way; and WHEREAS, there is adjacent to the site, to be developed by the Tultex Corporation a substantial quantity of other similar land equally suitable for industrial development, which other land can be made available for such purposes provided adequate means of access and necessary utilities and other public services are made available to said property; and WHEREAS, the nature of the business operations of the Tultex Corporation involves the use of substantial numbers of heavy motor vehicles as well as numerous smaller vehicles, all of which will result in a heavy traffic load on the industrial access road needed to serve this business; and WHEREAS, $33.1-221, Code of Virginia (1950), as amended, provides legislative authority for the use of certain public funds by the Com- monwealth Transportation Board for constructing or improving access roads to commercial and industrial sites on which manufacturing, pro- cessing or other establishments are or will be constructed. THEREFORE, BE IT ORDAINED by the Council of the City of Roanoke that: 1. The City Manager is hereby authorized and directed to file an application with the Virginia Department of Transportation of up to $200,000 in Industrial Access Road Funds for the Tultex Corporation project pursuant to the provisions of $33.1-221, Code of Virginia (1950), as amended, to construct the aforesaid roadway to the new site of this business. 2. This Council, in making the aforementioned authorization, hereby assures and guarantees the Commonwealth Transportation Board that the City will, if such project be approved, provide adequate right-of-way and for the adjustment of existing utilities which might be affected by said project, the adjustment of existing utilities funds appropriated by the Council cost of such right-of-way and for the to be paid for by the City from its for the purpose; and that the City will, after construction of said new roadway, assume proper main- tenance of the same. 3. In order to provide for the usual daily operation of the municipal government, an emergency is deemed to exist, and this ordi- nance shall be in full force and effect upon its passage. Roanoke, Virginia February 16, 1988 Honorable Mayor and City Council Roanoke, Virginia Dear Members of Council: Subject: Authorization for the City Manager to file an application with the Virginia Department of Transportation for Industrial Access Road Funds I. Back,round on this subject includes: City of Roanoke owns approximately 20 acres of land zoned light manufacturing in the northeast part of the City located off of Berkley Road. Subject land has appeared in all of the Roanoke City Economic Development Commission's master plans as a piece of property that the City should market for industrial purposes. Commonwealth Transportation Board adopted a policy on December 18, 1986, to govern the use of industrial access funds pursuant to Section 33.1-221, as amended, of the Code of Virginia (1950). D. Funding guidelines for industrial access funds are: $300~000 in funding from State for an acceptable industry whose value of construction is $3m000}000. No matching funds are required for this first $300~000. $150}000 in additional funding can be made available for an additional $3~000~000 in value of construction, and provided a dollar for dollar match up to $150~000 is also provided. E. Other guidelines for industrial access include: 1. City to provide adequate right-of-way and bear cost of same. 2. City adjust any existing utilities which might be affected by the project and bear cost of same. 3. City maintain roadway after completion. II. Current situation of this subject includes: A 90-day option has been exercised by Tultex Corporation on approximately 10.3 acres of land, being an as yet unsubdivided por- tion of official tax no. 7050107, in the site that the City owns off of Berkley Road (map attached). Tultex intends to build an approximately 50,000 square foot facility which would initially employ 200 people and is expected to eventually employ in excess of 400 people. Page 2 Access to the site via a new roadway is desired and could be constructed using an estimated $200~000 in industrial access road funds, based upon preliminary cost estimates. This amount is also the maximum amount that can be requested since it is equal to 10 percent of Tultex's anticipated capital outlay of $2,000,000. Items not eligible for reimbursement by State, including right-of- way acquisition and utility adjustments, would be funded from pro- ceeds from the sale of land and capital fund interest. III. Issues in order of importance are: A. Timing B. Funding IV. Alternatives in order of recommendation are: Authorize the City Manager to file an application with the Virginia Department of Transportation for Industrial Access Road Funds up to $200,000 for roadway construction to Tultex Corporation. Timing is crucial as the City desires to have a completed application to the VDOT's Richmond office as soon as possible for the Transportation Board's meeting as early as March 17, 1988. Funding in the amount of $200~000 would be 100% State funds, with no local matching funds required, if the application is approved for the Tultex access road. B. Do not authorize the City Manager to file the application for Industrial Access Road Funds. 1. Timing would not be an issue. 2. Funding by VDOT of up to $200~000 for Tultex roadway would not be a revenue source for this road project. Page 3 V. Recommendation is that City Council concur with Alternative A and thereby: Authorize the City Manager to file an application with the Virginia Department of Transportation for Industrial Access Road Funds up to $200~000 for roadway extension to Tultex. Assure the Commonwealth Transportation Board that the City will, if such project is approved, provide adequate right-of-way, provide for adjustment of any utilities affected by construction and pro- vide future maintenance of the roadway through other funding Respectfully submitted, W. ATTEST: City Clerk Roanoke, Virginia February 16, 1988 Honorable Mayor and Members of Council Roanoke, Virginia Dear Members of Council: Subject: CDBG funded Private Loan Subsidy housing rehabilitation program I. Background: ae Council apDroved the CDBG-funded Private Loan Subsidy program on April 13, 1987, by resolution number 28604 to assist low and moderate income families to purchase and rehabilitate homes in the city. Bm Council authorized a contract between the City and the Roanoke Redevelopment and Housing Authority (RRHA) on June 22, 1987, by ordinance number 28700 which delegates the responsibility of administering this program to the Housing Authority. II. Current Situation ae Council aDDropriated $50,000 CDBG funds to the 1987-1988 Private Loan Subsidy program. Be RRHA has five approvable aDDlications from low income families for loans totalling $115,400 which would need grant subsidies in the amount of $38,972 in order to make the monthly payments affordable to the applicants. Funds remaining in this year's budget for the Loan Subsidy Program total $965.00, making a shortfall of $38,007 if these loans, noted in II-B above, were approved. III. Issues ae B. C. D. Goals of Council Timing Funding Impact on other CDBG programs IV. Alternatives Authorize the Director o__f Finance to transfer $38,007 from Critical Home Repair Program, Account # 035-087-8720-5101, to Private Loan Subsidy, Account # 035 087 8720 5113, and authorize the City Manager to amend the contract between the City and the Roanoke Redevelopment and Housing Authority to allow for this shift in program allocations so that the five loans referenced above can be approved. Goals of Council for eliminating substandard housing in the City of Roanoke would be furthered by complete rehabilitation of five houses. Timing is important since the purchase and rehabilitation loans are dependant upon the availability of the subsidy grants, and these loan funds are due to expire before other loans could be approved. Funding is available in Critical Home Repair account 035-087-8720-5101. Impact o__n other CDBG programs, specifically Critical Home Repair would be minimal. N_~o commitments have been made yet from Critical Home Repair funds that were recently appropriated to that program. This transfer will leave approximately $27,000 in the Critical Home Repair Program to make limited repairs to 4 or 5 houses. Do not Authorize a transfer of funds for this purpose. Goals of Council would still be addressed; however, five low income families could not receive home purchase/rehabilitation loans because they would not be able to afford the payments. In this regard, my Office is working to provide full legal support to the excellent staffs of the Office of Billings and Collections, Treasurer's Office and other City offices involved in debt collection. Every effort is being made through the effective use of available legal options to more agressively minimize the City's loss of money from delinquent accounts. These initiatives in a relatively short period of time have increased the City's recoveries, and by continuing the vigorous debt collection process, the City will see its delinquent accounts diminished substantially in the near future. Collection strategies used or to be used to collect the debts owed the City include demand letters, debtor interrogatories,1 garnishments of wages and bank accounts, lawsuits in General District and Circuit Courts, attorney appearances at Section 341 creditors' meetings in the United States Bankrupty Court,2 levies on personal property, and delinquent tax sales. Recently, we collected a delinquent meals tax debt in excess of $3,000.00. To avoid appearing in court for debtor interrogatories on Janu- ary 22, 1988, several debtors paid their delinquent accounts in full. Two estates of debtors recently paid in excess of $500.00 for previously uncollectible delinquent personal property taxes of the deceased. We were also successful in collecting delinquent meals tax in the amount of $910.56 from a local restaurant presently in Chapter 11 bankruptcy and $1,163.07 for an outstanding demolition debt. Lastly, we are assisting the Treasurer's Office and the Office of Billings and Collections in preparation of a delinquent real estate tax list to be published in the local newspaper in the very near future. Honorable Mayor and Members of City Council February 16, 1988 Page 2 The vigorous debt collection efforts now being pursued by this Office were made possible by Council's approval of one addi- tional professional staff position. Katherine Howe Jones, who was appointed Assistant City Attorney on October 12, 1987, has been assigned the responsibility of leading this Office's debt collection efforts. I believe that Ms. Jones will prove herself an effective advocate on behalf of the City and that her appoint- ment will pay dividends. It has been my experience that the vast majority of our citi- zens conscientiously pay their taxes and other debts. There are, however, a few people, including some who have the ability to pay, who have ignored their obligations to the City. To the extent that some have acted irresponsibly, others have had to pay more than their fair share. In this regard, Council's provi- sion of additional resources for debt collection should benefit all our citizens. I will continue to keep you advised of any developments in this matter. Background: ae Project is part of the on-going design and construction of the overall storm drainage system of the Williamson Road Area and represents the middle segment of a total of three segments now proposed for Phase 2. The upper segment is now being designed and is being scheduled for construction. Segment begins at Forest Hill Avenue and runs generally along Forest Hill Avenue, Spring Hollow Avenue, and Hillcrest Avenue to Bowman Street at Williamson Road. Advantage will be taken of the primary storm drain excavation to update and replace numerous sections of old, deteriorated sanitary sewer pipe with new design pipe and thereby substan- tially reduce infiltration/inflow to the City system from the Williamson Road Area. This infiltration/inflow reduction is part of the program now being activated to reduce total infiltration/ inflow through the major interceptors to the Sewage Treatment Plant. By taking advantage of sharing the cost of the excavated trench for the main storm sewer and paralleling the sanitary sewer replacement in the same trench, a substantial savings in the cost of the new sanitary sewer can be realized compared to the same cost if the sewer replacement were bid as a separate project. City Council received and publicly opened seven (7) bids for the referenced project at 7:30 p.m., Monday, January 25, 1988, with Aaron J. Conner, General Contractor, Inc. sub- mitting a low base bid of $1~484,493.84. E. City Council referred all bids to a bid committee to review and report back to Council with its recommendations. Current Situation Planning Commission Public Hearing held on January 6, 1988. One property owner, Mr. Rogers Johns, owner of an apartment complex located at the intersection of Hanover Avenue and Eleventh Street, spoke in opposition to the requested rezoning stating that he felt a four unit apartment building would be too large for the lot. Several Planning Co~m~ission members also expressed concern that four units were too many for the existing structure and that a four unit apartment building would not conform with the character of the surrounding neighborhood. Amended petition to rezone was filed on January 20, 1988. Proffered conditions are: The exterior appearance of the structure fronting on Hanover Avenue will not be altered. The property will be rehabilitated to contain only three living units meeting city site plan requirements. That if no building permit has been issued and no con- struction commenced within three years from the date of final zoning approval, the zoning shall revert to RM-1 without further action by City Council. III. Issues Land Use is presently residential. Property to the north, east and west is primarily a mixture of single-family and two-family residential dwellings. There are several non- conforming three-family residential dwellings in the vicinity. Land use on the south side of Hanover Avenue is a mixture of single-family, two-family and multi-family residential development. Zoning is presently RM-1, Residential Multi-family District, Low Density Residential. Zoning to the north, east and west is also RM-1. Zoning on the south side of Hanover Avenue is RM-1 and RM-2, Residential Multi-family District, Medium Density Residential. Traffic is not a significant issue. Neighborhood north of Hanover Avenue is primarily a mixture of single-family and two-family dwellings. Area south of Hanover Avenue includes a mixture of single-family, two-family and multi-family dwellings. Roanoke City Council February 8, 1988 Page 3 E. Comprehensive Plan recommends: Encouragin~ a variety of housing choices in existing neighborhoods. 2. Encouraging quality construction and design in housing. Providing appropriate infill development that is sensi- tive to the existing neighborhood environment. IV. Alternatives A. City Council approve the rezoning request. Land Use becomes medium density, multi-family. A three- family residential structure would be more in keeping with the development pattern in the neighborhood north of Hanover Avenue. 2. Zonin~ becomes RM-2 subject to proffered conditions. Traffic would not be an issue. The required five (5) off-street parking spaces could be accommodated on-site. 4. Neighborhood character would not be adversely affected. 5. Comprehensive plan would be followed. B. City Council deny the rezoning request. Land Use is unchanged. The existing vacant residential structure remains available for single-family or two- family development. Zonin~ remains RM-i which is consistent with surrounding zoning north of Hanover Avenue. Adequate RM-2 zoning is available on the south side of Orange Avenue. 3. Traffic would not be an issue. 4. Neighborhood would not be affected. Comprehensive plan would be followed. Bradshaw, Jones, Sowers, Waldvogel and Mrs. Goode voting for approval and Mr. Price voting against the motion, Mr. Buford absent), the Planning Commission approved the requested rezoning. In discussing the motion, the Commission felt that a three-family residential structure would better conform with' the residential character of the neighborhood north of Hanover Avenue and would result in higher quality units. On behalf of the Museum I am requesting an annual appropriation of $75,000.00 for the next three years from the City of Roanoke. As you know from your capacity as Chairman of the Economic Development Commission, the Virginia Museum of Transportation is known as one of the top five transportation museums in the United States. As such it is the principal tourist attraction located in the City of Roanoke which can and does attract tourists from all over the United States and abroad. We are now gaining recognition for our educational programing. I am sure you are aware that every third grader in the Roanoke City School System participates in educational programing at the Museum as a part of his or her curriculum. Recently David Weitzman, a nationally known educator in the field of engineering and technical education, recognized us as doing the best job of any of the transportation museums in the country in terms of educating the visitors and students who go through our Museum. As you recall from your involvement, the Museum was originally established by the City of Roanoke to preserve its heritage and deep roots in the transportation industry. As the non-profit charitable organization invited to be the successor to the City in the operation of the Museum, we feel a special relationship exists because the City still owns &2% of the exhibits at the Museum. Because of our special relationship with the City of Roanoke, we are making the first request to the City of Roanoke. We know that the other Valley Governments will ask what is being done by the City before they will consider our request. In addition, we are the official transportation museum of the Commonwealth of Virginia. Last year they funded us with $100,000.00 of operating funds. This year we have gone back to the Legislature with funding requests, and while the reception has been good, one of the first questions we are asked is what sort of help is the City of Roanoke giving you. We need the City's help to assure the continuation of our State funds. In the last two years, since the flood of 1985 which devastated our collection, we have come a long way. With the support of the City, and others, we will continue to make significant contributions to the education of young and old alike. Our potential to be a major force in the tourism industry for the City, Valley, and State, is only limited by the financial support necessary to make our goal a reality. AN ORDINANCE providing for certain disability or death bene- fits or both for certain Council-appointed officers; and provid- ing for an emergency. WHEREAS, §22.1-4(b), Code of the City of Roanoke (1979), as amended (hereinafter "City Code"), provides that certain Council- appointed officers who have elected to participate in an optional deferred compensation plah offered by City Council in lieu of par- ticipation in the City of Roanoke Pension Plan (defined by §22.1-2 of the City Code and hereinafter referred to as the "Plan") shall not be included in the membership of such Plan; WHEREAS, such officers of the City who are not included in the Plan are without the advantage of the disability and death benefits made available under the Plan to all members of the Plan; WHEREAS, in the case of Council-appointed officers who do not participate in the Plan, this Council has previously agreed to purchase disability insurance coverage through private carriers on behalf of such officers, and funds have been appropriated for such disability coverage which is currently in force for all those Council-appointed officers who do not participate in the Plan with one exception; WHEREAS, this Council is desirous of providing disability coverage and death benefits for one Council-appointed officer who is not a member of the Plan and for whom private disability insurance coverage purchased by the City was available on and after August 11, 1987, only at a greatly increased premium which was deemed unreasonable, and, therefore, such coverage on behalf of such officer was allowed to lapse as of such date; and WHEREAS, such officer has been without the benefit of any disability coverage provided by the City since August 11, 1987; THEREFORE, BE IT ORDAINED by the Council of the City of Roa- noke as follows: 1. The City shall procure, put into force, premium payments with respect thereto, private disability ance policies providing reasonable benefits to compensate loss of income on behalf of the following officers: a. City Clerk; and b. other Council-appointed officers who have been authorized by ordinance of Council to participate in the International City Management Association Deferred Compensa- tion Plan in lieu of participation in the City of Roanoke Pension Plan and who have elected to participate in such Deferred Compensation Plan and are not included in membership in the City of Roanoke Pension Plan. and make required insur- for 2. For purposes of disability benefits (§S22.1-47 and 22.1-48) and death benefits (§§22.1-50 and 22.1-51) under the Employees' Sup- plemental Retirement System only, such Council-appointed officer shall be accorded membership credit pursuant to §22.1-43 of the City Code. 3.
