One hundred and one applications were filed with the Board during the year. In accordance with State law, public hearings were advertised in a local newspaper once a week for two successive weeks not less than six days nor more than twenty-one days prior to the public hearing date. Notices of public hearings were sent by first-class mail to owners of all abutting properties and properties immediately across the street or road from any property in question. VIRGINIA, AN ORDINANCE authorizing the execution of six grant agreements with Virginia Mountain Housing, Inc.; and pro- viding for an emergency. BE that: 1. for and IT ORDAINED by the Council of the City of Roanoke The City Manager is hereby authorized to execute, on behalf of the City, six grant agreements with Virginia Mountain Housing, Inc., each agreement granting to such corporation up to $2,500 in Community Development Block Grant funds in reimbursement for certain of the costs to be incurred in relocating, renovating and selling six houses on those lots identified in the City Manager's report to Council dated January 19, 1988, such agreements to be consistent with the terms of the City's Vacant Lot Homesteading Program, as amended by Council on November 7, as to form by the City Attorney. 2. Roanoke, Virginia 3anuary 19) 1988 Honorable Mayor and Members of Council Roanoke, Virginia Dear Members of Council: Subject: Contracts Under Vacant Lot Homesteading Program--Support of Shadeland Relocation Project I. Background: A. Vacant Lot Homesteading Program generally is intended to encourage positive maintenance of vacant land in older areas of the City. B. Extension of Program, approved by Council on November 9, 1987, takes this concept further by encouraging development of new housing on vacant land, by reimbursing the builder/developer for certain costs of development. C. Allowable costs reimbursable under the Program~ up to a maximum of $2500 in each case, are: 1. Purchase price of the lot, up to the fair market value; 2. Legal fees associated with purchase and resale, as paid by builder/developer. 3. Clearing and grading where necessary; Building permit fees; 5. Water and sewer connection fees; 6. Other reasonable expenses customarily associated with such real estate transactions. D. Conditions which builder/developer must meet to receive reimbursement are: Building and site plans approved by Building Department as meeting applicable building and zoning codes and being compatible with existing neighborhood designl 2. Build or move a residential building onto the lot within specified time; 3. Sell or lease the building initially to a low-moderate income party. If the builder/developer is a non~profit corporation, benefits of reimbursement are to be passed on to the low-moderate income occupant via reduced sales price or rent. Page 2 3anuary 19, 1988 Shadeland Relocation Project, in which Virginia Mountain Housing moves, repairs, and sells houses for owner occupancy, is the sort of development in older neighborhoods the Vacant Lot Homesteading Program extension was intended to supplement. II. Current Situation: III. Development costs of Virginia Mountain Housing's first house moved from Shadeland Avenue and renovated were higher than projected. Though these costs will be reduced significantly for the remaining l0 houses VMH is to move from Shadeland Avenue, there is still some question whether complete quality renovation can be performed for a cost less than the houses would appraise for, in the locations targeted for the remainder of the Shadeland Relocation Project. Proposed Use of the Vacant Lot Homesteading Program would reduce the total development costs to Virginia Mountain Housing by bringing their costs below the appraised value i.e. selling price of the completed houses. Contracts would provide that reimbursement via the Program would not be made until documentation of costs and appraised value is provided to the Housing Development Office showing that the margin of the value over total unreimbursable costs is not excessive. Lots identified for the next phase of the Shadeland Relocation Project are identified on the attachment for Council's consideration of reimbursement under the Vacant Lot Homesteading Program. All six (6) of these are in the Gainsboro neighborhood and are currently owned by the RRHA, which has agreed to transfer them to VMH for this Project. Issues: A. Quality of rehabilitation work. B. Affordability of houses to low-moderate income buyers. C. Cost to the City. IV. Alternatives: Authorize the City Manager to execute contracts with Virginia Mountain Housing, Inc. providing for reimbursement for certain costs as provided in the approved Vacant Lot Homesteading Program as extended, outlined in I. C. above, and specified in the individual contracts~ for relocating, renovating and selling 6 houses in the Shadeland Relocation Project to lots identified on the attachmentl and authorize reimbursement to Virginia Mountain Housing for such costs upon completion and occupancy oi each house according to the terms of the contracts. Quality of rehabilitation work would be enhanced by reducing VMH's costs~ allowing more to be put into actual rehabilitation, resulting in a better, more attractive product~ of greater benefit to the surrounding neighborhoods. 2. Aifordability of houses to low-moderate income buyers would be enhanced by likelihood that house's appraisal would cover the cost~ allowing a low down payment and a full mortgage (a 5% interest. The contract under the Program requires the benefits of the reimbursement grant be passed to the buyer. 3. Cost to the City would be borne entirely by Community Development Block Grant funds allocated to the Vacant Lot Homesteading Program. The reimbursement per lot is expected to be approximately $1800~ which is less than the maximum allowable $2~500~ because there is expected to be no purchase cost of the land~ currently held by the RRHA. Most of the costs reimbursed by the Program will be paid into the City's General Fund through building permit fees, or the sewer and water fund through sewer and water lateral and hook-up fees. Do not authorize the City Manager to execute contracts with Virginia Mountain Housing for reimbursement under the Vacant Lot Homesteading Program. 1. Quality oi rehabilitation work would be jeopardized. Affordability of houses to low-moderate income buyers will be hin- dered. II costs to VMH exceed appaised value of houses, buyers will have to pay more than the appraised value. Because 5% interest mortgage is limited to a percentage of the appraised value~ the buyers will have to pay the difference either with a larger cash down payment or with another loan, e.g. second mortgage. 3. Back~round: November 1985 Flood deteriorated the double 5' × 7' box cnlvert underneath Washington Park. Hayes, Seay, Mattern & Mattern was authorized to prepare plans and specifications for the repair of the damage. Although damaged, the culvert has continued to satisfactorily handle the flow of Lick Run. Plans and specifications called for the most seriously damaged section of the box culvert to be eliminated and a new 102" concrete pipe tunneled and jacked approximately 640 feet through rock and the old landfill to a spot in the existing box where a junction box would be constructed. From the new junction box, seventy (70) feet of tunnel liner was to be installed, in the less severely damaged section of the existing box culvert. City Council received bids on the project on November 10, 1986. After review by the Bid Committee, City Council awarded the contract to A. L. King, Ltd., of Nitro, West Virginia on November 24, 1987, in the amount of $1~243~833.00. II. Current Situation: Engineering Department and Hayes~ Seay~ Mattern & Mattern inspected the less severely damaged section of the culvert after the heavy rains and flooding that occurred Labor Day weekend, 1987. Inspection revealed that the side wall sec- tions where the tunnel liner is to be installed have sustained more damage, probably caused by the Labor Day flooding. City Engineer and Hayes~ Seay~ Mattern & Mattern began nego- tiations with the Contractor to tear out the damaged section (121 feet) of the box culvert and install new 102" concrete pipe. This would move the junction box section ahead to a joint in the existing box culvert where the damage ends. Page 2 Negotiated price with the Contractor is a total amount not to exceed $389~470.00 which equates to $3,218.76 per linear foot. This compares to $4,545.00 per linear foot for the 43.5 feet of this work already included in the current contract. In addition, the City will receive a credit of $42~700.00 due to elimination of the tunnel liner required under the current contract. The total cost to the City will then be a maximum of $346~770.00. Due to the complexity of the proposed construction, which includes tunneling and jack hammering out the existing double box culvert while working under constant water flow conditions and the lower cost per linear foot for the additional work, we feel this price per foot is fair and equitable to the City. III. Issues in order of importance are: A. Engineering concern B. Funding IV. Alternatives are: A. Authorize the City Manager to execute Change Order No. 1 in an amount not to exceed $346~770.00. Engineering concerns would be met since the recently discovered damage would be corrected and the City would have a complete structure free from any observable failure. Funding availability would be from the project con- tingency and funds available in the Capital Improvement Reserve Account - Washington Park Storm Drain. B. Do not authorize the City Manager to execute Change Order No. i. Engineering concerns would not be met. The Project as originally designed could be completed, but the addi- tional damage found could cause additional failure of the box culvert in the future and another contract to repair the future failure will be more expensive. The one crack and inward bulge in the center of the east side wall, first observed in November, 1986, has recently become a series of cracks top to bottom with a more pronounced inward bulge. The timing of the expected future failure cannot be accurately predicted; however, its inevitability can. 2. Funding availability would not be an issue. Page 3 V. Recommendation is that City Council take the following action: Authorize the City Manager to execute Change Order No. I with A. L. King, Ltd., in an amount not to exceed $346~770.00 and the extend the contract time 150 consecutive calendar days in order to complete the additional work. Background: General Services, on December 22, 1987 at 2:00 p.m., after due and proper advertisement, publicly opened and read aloud bids for Electronic Distance Measuring Equipment for the Department of Engineering. Four (4) bids were received for this equipment. The low bidder in the amount of $10~641.20 was submitted by James River Equipment and Supply Company and 15 days for delivery. This bid did not meet the full requirements of the Contract Documents. The low bid submitted by Tri-City also took exception to required specifications. The lowest responsive bid was submitted by Thorpe-Smith, Inc. in the amount of $12~339.00 and 14 days for delivery. Requested equipment will provide the Department of Engineering with up to date Electronic Distance Measuring Equipment. November 9~ 1987~ Council designated funds in the Capital Maintenance and Equipment Replacement Program to provide for the purchase. E. Rejection of two lowest bids is based upon the following: Compatible programmable field data recorder as quoted does not comply with the requirements of the Contract Documents. The Contract Documents call for the capabi- lity of being able to manipulate data in the field while the proposed recorder of the two low bidders does not permit field manipulation. Proposed equipment of the two low bidders is not as accurate in the reading of angles as the requirements specified in the Contract Documents. Equipment proposed by the two low bidders is 23% heavier than the equipment specified. For the above listed reasons the bid committee believes the two low bidders do not comply with the requirements of the Contract Documents and that their bids be rejected. Dillon, David K. Lisk and James M. Turner, Jr., will expire on June 30, 1988. According to Section 9-16, on or before February 15 of each year, Council shall announce its intention to elect trustees of the Roanoke City School Board for terms commencing July 1 through (1) public announcement of such intention at two consecutive regular sessions of the Council and (2) advertisement of such intention in a newspaper of general circulation in the City twice a week for two consecutive weeks. Planning Commission reviewed the subject application for closure at its regular meeting of December 2, 1987. Closure of this undeveloped portion of the alley would have no effect on the immediate neighborhood. 2. Refuse collection trucks currently back down the developed portion of the alley system for garbage pick-up. 3. Closure of the undeveloped portion of the alley would have no effect on current refuse collection procedures. B. Traffic Impact: 1. Alley as it extends from Sixth Street, S.E., is narrow and restrictive. Developed portion of alley system ends abruptly with no available area sufficient for vehicular turn around movements. 2. Closure of the undeveloped portion of the alley would have no effect on the existing situation. C. Utilities within the right-of-way. 1. Taylor and Members of City Council Roanoke, Virginia Dear Members of Council: Subject: Request from Imaging Center of Southwest Virginia, Inc., that a 15 foot wide alley extending northerly from Marion Street for a distance approximately 508 feet more or less to Albermarle Avenue and the por- tion of Marion Street running easterly from South Jefferson Street to the western boundary of the right-of-way for U.S. Route 220 be permanently vacated, discontinued and closed. I. Back~round Street and alley as requested for closure are located between and adjacent to, the properties situated at the southeast corner of Jefferson Street and Albermarle Avenue, S.E. Alley requested for closure extends in a southerly direction from Albermarle Avenue, S.E., for a distance of approximately 508 feet. Alley right-of-way width is 15 feet. Alley is developed and open (graveled). Marion Street, S.E., as requested for closure is a 50 foot wide right-of-way. Street section dead ends at the westerly right-of-way boundary of Webber expressway. Properties adjacent to the alley and street requested for closure are identified on the attached map "A" by official tax number, ownership and current land use status. II. Current Situation Application for street and alley closure was received on November 13, 1987. Plannin8 Commission reviewed the subject application for closure at its regular meeting of December 2, 1987. Street and alley previously served businesses and residences that have now been demolished and razed. Properties adjacent to the street and alley are now vacant, with the exception of the Jefferson Street Baptist Church, 15 Albermarle Avenue, S.E., Bantam Market 1204 Jefferson Street, S.E., and the Pancake House 1106 Jefferson Street, S.E., see attached map "A" & "B". Properties owned by the applicant and fronting on Jefferson Street, S.E., are currently zoned (C-2) Commercial. Proper- ties owned by the applicant and fronting on 1st Street, S.E., are currently zoned (LM) Light Manufacturing. Medical facilities (clinics, etc.) are permitted uses within the (C-2) commercial zone. Medical facilities (clinics, etc.,) are only allowed in the (LM) Light Manufacturing zone by spec~ial exception uses. Applicant's properties and proposed land use would be more appropriately classified under (C-i) office district zoning. Properties should be rezoned to C-I, office district. III. Issues A. Neighborhood Impact Closure will have no adverse impact on the immediate neighborhood or adjacent properties. Property owners immediately adjacent to the alley are in agreement with the requested closure. Letter to applicant (attached, exhibit C) indicates that the church is agreeable to the closing of the alley, but it also indicates that the church has concerns related to the following: (a) that a proper survey will be made to establish new property lines. (b) that a new curb or entranceway will be installed to provide access into their property. Roanoke City Council January 11, 1988 Page 3 Church representatives have been advised that responsi- bility for any surveys or for the installation of any new curb-cuts or entranceways will be the sole responsibili- ty of the adjacent property owners. B. Traffic Impact: Closure of this street and alley will have no adverse effect on traffic or traffic needs. C. Utilities within the ri~ht-of-way. 1. City has a sewer line within the alley right-of-way. Appalachian Power Company has existing utilities within the street and alley right-of-way. C & P Telephone Company has utilities within the street and alley right-of-way. D. Creation of a dead end street or alley: Closure as requested will not create a dead end street or alley. E. Land use: Alley and street as requested for closure once served a number of businesses and residences. Those land uses for the most part have now been demolished and removed. The street and alley serve no useful purpose for the adjacent property owners or the public in general. IV. Relationship to the Comprehensive Plan Request for closure is compatible with the intent of the Comprehensive Plan that available land be used in the most appropriate manner. Adjacent property owners could utilize the land within the street and alley right-of-way in a more efficient manner. V. Recommendation The Planning Commission by a vote of 6-0, (Mr. Bradshaw absent) recommends to Council that the applicant's request for closure be approved, subject to the condition that an easement be retained for the existing utilities listed below until such time as they are relocated: Roanoke City Council January 11, 1988 Page 4 A. The Petitioner agrees to relocate any public utility lines running over or under the alley and str~t to be vacated which would be affected by the Petitioner's planned use of th~ property. CN Neighborhood Commercial District designation for the Grandin Road Village commercial area was deleted from the re- vised zoning map and referred back to the Planning Commission for further study in an effort to address concerns of residents in the area. Ce Plannin~ Staff met with residents and representatives of the Greater Raleigh Court Civic League on three occasions to address concerns and to discuss proposed changes to the CN, Neighborhood Commercial District regulations. Planning Commission held a public hearing on August 19, 1987 to consider amendments to the CN District regulations. City Council adopted the proposed amendments after a public hearing on October 12, 1987. No residents spoke in opposition to the proposed amendments. II. Current Situation 1976 Zonin~ Map for the Grandin Village commercial area now needs to be amended in order to bring the area into conformity with the City's Comprehensive Plan. Be Plannin~ Commission held a public hearing on December 2, 1987 to consider a proposed amendment to the 1976 Zoning Map that would rezone the Grandin Village Commercial area from C-2, General Commercial District to CN, Neighborhood Commercial District. Mr. Larry Moore, Moore and Company, spoke in opposition to the proposed rezoning. Mr. Moore, whose company manages several properties in the area, was concerned that the rezoning would downgrade the future value of the property. Mr. Ray Garland, a major property owner in the Grandin Village area, spoke in favor of the request stating that he felt the purposed zoning requirements were very generous and would accommodate the needs of the area for a long time. Correspon- dence was received from Mr. Lou Ellis, President of the Raleigh Court Civic League supporting the proposed amendment. III. Issues A. Zonin~ B. Land Use and Development C. Neighborhood D. Zoning would remain C-2, General Commercial District. 2. Land use and development would be unchanged. 3. Neighborhood would be affected. Potential for incompati- ble commercial development out of scale and character with surrounding residential development will continue. 4. Comprehensive Plan would not be followed. Recommendation By a vote of 6-0 (Mr. Bradshaw absent), the Roanoke City Planning Connnission voted to recommend approval of the proposed amendment to the 1976 Zoning Map, City of Roanoke. The proposed rezoning of the Grandin Road commercial area from C-2, General Commercial District to CN, Neighborhood Commercial District is consistent with the City's Comprehensive Plan and would help ensure the continuation of commercial development compatible in scale and character with the surrounding residential neighborhood. Dibling, City Attorney Roanoke, Virginia Jr. Dear Will: I was absolutely astounded by the report in the Roanoke Times on Thursday morning, January 14, 1988, that the General Assembly was considering an appropriation of $100,000.00 for the trade center in downtown Roanoke. I am surprised about two matters. First, I was astounded that the comment was made that our request for $250,000.00 was "pulled that figure out of the air." I cer- tainly would expect that you, as Council's liaison to the General Assembly, would certainly see that our request was substantiated with the appropriate figures and documentation. Secondly, I was even more astounded with the report that this funding from the Commonwealth would come through the River Foundation or Explore. I just cannot believe this. This Council is on record for requesting this money to be paid directly to the City, and that the trade center be built in downtown Roanoke. If the funds are coming through the Explore/River Foundation, then are they going to be able to decide to build that trade center out at the Explore site off of the Blue Ridge Parkway. This just does not represent the views of the Council. I would certainly hope, once again, in your role as legislative liaison, that you fully inform our local legislators of our desires in this matter. If everything that the City of Roanoke is going to obtain from the Commonwealth this year is going to come through the River Foundation, then we might as well surrender our City Charter, dismiss the City Council, and allow our former City Manager and the River Foundation Board of Directors to run the City. I would just as soon not abrogate my civic responsibility like that. I would ask that you give these matters your full attention and that you report back to Council within two weeks.
