Dear Members of Council:
Subject:
Request from A. B. Properties Affiliated Services, Inc.,
that property located on the corner of Hollins Road and
Drew Avenue, N.E., designated on Roanoke City appraisal
map as official tax number 3280406, be rezoned from RM-1,
Residential Multi-Family District, to C-i, Office
District, such rezoning to be subject to certain
conditions proffered~by the petitioner.

Purpose of the rezoning is to permit the use of the property
for an office.
Petition was submitted on August 12, 1987, and contained the
following proffered conditions:
1. The property will only be used for office purposes; and
2. There will be no signs erected on the property.
C. Site plan was submitted for informational purposes only.
Propert~ was the subject of two previous rezoning requests in
3une and December, 1986. At the June 4, 1986, public hearing
before the Planning Commission adjoining property owners
voiced opposition to the rezoning based on its impact on the
stability of the neighborhood. The request was withdrawn by
the petitioners after the Planning Commission voted 3-1 to
deny the request. The major reason for recommending denial
was that the rezoning would encroach into a relatively stable
residential neighborhood and that it would have the effect of
encouraging continued strip development along Hollins Read.
The second rezoning request submitted in November, 1986 was
withdrawn before the Planning Commission's public hearing.

Plannin~ Commission public hearing was held on September 2,
1987. Mr. Lawrence Breeding (3811Hollins Road) appeared in
opposition to the request and presented a petition signed by 41
residents also in opposition (attached). Four other residents
also spoke in opposition to the request. The residents'
primary concern was the impact of the requested rezoning on
their residential area.
Plannin~ staff recommended denial of the request noting that
if approved, the rezoning could have the effect of increasing
commercial development pressure on adjoining residential
property.
Additional proffered condition to the petition to rezone which
was proffered at the September 2, 1987, hearing was filed on
October 16, 1987. The following additional condition was
proffered:
The present condition of the building will be maintained in-
cluding fencing, landscaping, and parking.
II. Issues:
Zonin~ would change from ILM-1 to C-1. C-2 and LM zoning exist
along Hollins Road to the north and south. Remaining
surrounding tracts are zoned RM-1. Proposed zoning would
encroach into a residential neighborhood. The new Zoning
Ordinance allows a separate C-1 district of less than two (2)
acres to be created when it abuts an existing C-2 district.
Land use is consistent with the character of the surrounding
area. Land fronting on Hollins Road has in recent years been
developed for commercial and industrial purposes. Buffering
requirements of the new Zoning Ordinance will minimize
somewhat the visual impact of the proposed office on adjoining
residences.
Traffic generated from the proposed office use would be
minimal and would not impact the surrounding residential
neighborhood.
Neishborhood will not be detrimentally impacted by the
proposed office use. Rezoning to C-1 may, however, have an
impact on the future development potential of adjoining
residential properties.
Comprehensive Plan recommends that existing neighborhoods be
protected from non-compatible uses and strip commercial
development should be discouraged.

III. Alternatives:
A. City Council deny the rezoning request.
1. Zoning remains RM-1.
2. Land use is unchanged.
3. Transportation is unchanged.
4. Neighborhood is unchanged.
5. Comprehensive Plan is followed.
B. City Council approve the rezoning request.
Zoning becomes C-1 with conditions which minimize
somewhat the impact of the use on the adjoining
residences. Potential is increased for future commercial
development in the neighborhood especially those lots
fronting on Hollins Road.
Land use changes from residential to office. Proffered
conditions limit use to office.
3. Traffic impact would be minimal.
Neighborhood would not be detrimentally affected by the
proposed use. The rezoning could, however, have the
effect of increasing commercial development pressure on
adjoining residential property.
Comprehensive Plan is followed to the extent that the
proposed commercial development will have a minimal
impact on the area.
VI. Recommendation:
The Planning Commission recommended denial of the rezoning request
by a vote of 7-0. The Commission felt that approval of the pro-
posed rezoning is inappropriate at this time since the area is

still a relatively stable residential neighborhood. It was also
noted that approval of the requested rezoning would contribute to
commercial strip development along Hollins Road.

Virginia, containing one-fifth acre known as Lot 12, Block
12, Northfield Addition, located on the corner of Hollins
Road and Drew Avenue, N.E., Roanoke, Virginia 24012, and

2. Pursuant to Article VII of Chapter 36, Code Qf the City of

the purpose of using an existing building as an office.
3. The petitioners believe that the rezoning of the said

Estes Express Truck Lines), a very large number of trucks pass
in front of the subject property each day. According to the
City of Roanoke Traffic Engineer, and evidenced by the Roanoke
Valley Regional Area Traffic VQlume Study, (see next page),
approximately 13,000 vehicles pass in front of the subject property,
3801 Hollins Rd., each day. With the development of Hershberger Rd.
into a major shopping center and business area, the traffic volume
on Hollins Road can only increase.
< .'., RESIDENTIAL APPRAISAL REPORT
The subject property is located in a neighborhood where the
present land use and future land use is a combination of residen-
tial and commercial use, as evidenced by an appraisal completed
on June 22, 1986 of the subject property.
In a typical neighborhood it is possible that property values
could be affected in a negative way by nonconforming rezoning.
However, the rezoning requested is not nonconforming and the
subject neighborhood is not a typical neighborhood. A typical
residential neighborhood is not directly fronted by an extremely
high traffic four lane road as is the subject neighborhood. A
typical residential neighborhood does not have a nearly 50% turn-
over rate in sales as does the subject neighborhood. A typical
residential neighborhood does not have commercially zoned business
and multihousing property within its neighborhood boundaries as
does the subject neighborhood.. A typical residential neighborhood
is not surrounded by commercial, light manufacturing, and heavy
manufacturing zoned property as is the subject neighborhood.
Therefore, there can be no doubt what-so-ever that the subject
neighborhood is not a typical residential neighborhood, but rather
a very different nonconforming neighborhood in which conditional
rezoning does not adversely affect it in any way. The most recent
evidence of proof of this is the rezoning of 3735 Hollins Road,
which is inside the subject neighborhood boundaries. Since the
rezoning of 3735 Hollins Road, from RD to C-2 on August 24, 1981,
the Roanoke City assessment of the adjacent properties have
remained stable and have not declined in any way, nor has it low-
ered the resale value of any property in the subject neighborhood.

Neighborhood Analysis
The subject neighborhood is fronted by a 4 lane major thoroghfare
on Hollins Road and bordered completely on the remaining three sides
by light manufacturing and commercially zoned property. The subject
neighborhood is comprised of 31 lots, partially consisting of an
office building, one 12 unit apartment complex, one 4 unit apart-
ment complex, 2 duplexes and 5 single family rental properties.
According to the Roanoke City Real Estate Valuation Office,
15 properties located in the subject neighborhood sold 22 times
with the sale dates ranging from 1979 through 1987 resulting in
a 71% sales activity. This abnormal amount of sale activity in
such a small neighborhood represents a very unstable neighborhood.
This destablization places the subject neighborhood in a phase
of decline which can possibly ~e reversed with controlled rezoning
such as that being requested by A.B. Properties Affiliated Services,
Inc. The rezoning of the subject property would result in.almost
no discernable change of use already allowed under current zoning,
and would be of temendous benefit to the City of Roanoke and the
neighborhood by helping to stablize property values and reverse
the trend of declination now suffered by the neighborhood.
Area Analysis
The subject propert~ is located on a corner lot in the midst of a
commercialized area fronting the east side of a four lane busy
main thoroughfare on Hollins Road. The subject property is sur-
rounded by commercial property with such property immediately
adjacent to the south side of the subject property, 2 lots to the
rear of the subject property, and 9 lots to the north of the sub-
ject property. Immediately adjacent to and south of the subject
property, is a continuous 1/2 mile of commercial and light manu-
facturing property comprised of the following: Campbell Realty,
a 4 unit apartment complex, two billboard signs, Ferris Shell
Station, Quick-ette Food Mart, Williams Auto Repair, Hardees,
Security Scale, Costal Trucking, Virginia Avenue Auto Sales, Peoples
Drug Store, Big Lots, and United Virginia Bank. Continuing 1~ miles
south on Hollins Road from the'end of the above stated half mile
of commercial and light manufacturing property until Route 460 is
reached, is commercial and light manufacturing property interspersed
with residential properties, with an average buffer zone between
commercial property and residential property of 3 feet. This
commercial and light manufacturing property is comprised of the
following: Industrial Saw and Mower Service, Lindbergh Court
Grocery Store, Pizza King, Red Ball Lumber Co., Lawrence Transfer,
Rainbow Thrift Store, Rainbow Bakery, Snappy's Store, Imperial
Floor and Tile, National Alignment, On Target Gun Shop and Range,
Carter Cabinet Shop, Bud Weaver Air Conditioning, Dixie Carpet and
Tile Co.,Brammer Welding Supply Co., Preston Truck Lines, Standard
Trucking, Mason Dixon Trucking Co., Guard Rail Inc., Consolidated
Freight Lines, Hall's Trucking Co, Pilot Freight Lines, Grand
Piano and Furniture Co. Warehouse, Roanoke Public Warehouse,
Berglund Chevrolet Storage Lot, Roanoke Apple Products Co., Taylor

Beginning immediately 9 lots north of the subject property is
property zoned light manufacturing, which borders the subject
neighborhood and is located approximately 6 feet from the north
side of a house located in the subject neighborhood. From the
light manufacturing property stated above and continuing for one
mile are other light manufacturing and commercial property comprised
cf the following: Turbo Food Mart, Soft Brushes Car Wash, White-
side Laundry Center, Plantation Car Wash, Jim Richard's Barber
Shop, Second Act Clothing Store, Claudette's Hair Center, T-Roy's
Restauran~ Morgan Discount Drapery, The Real Estate Center, Diet
Center, Adventureland, Dr. Kenneth Smith Dentist Office, All American
Pools, Tom Boy Supermarket, Eli Lilly and Co. Plant, Frontier Apart-
ment Complex, John's Mower and Saw Service, Food Lion Supermarket,
Revco Discount Drug Store, Movie Time Video, Hair Works, Star City
Roller Skating Rink, Edenburg Square, Amoco Service Station and
Dominoe's Pizza. Two lots to the rear of the subject property is
property zoned light and heavy manufacturing with Norfolk Southern
Railroad tracks running north to south along the back yards of
houses in the subject neighborhood, and Mason-Litteral Electrical
Contractors Warehouse located across said railroad tracks.
General Information
Mr. Bohon, President of A.B. Properties Affiliated Services Inc.,
has for the past 32 years lived one block west of the subject
property on Bohon Street, so named after his grandfather, Wilson
Bohon, for his contribution in developing the surrounding area. Mr.
Bohon's parents, grandmother, sister and brother-in-law also live on
Bohon Street, and as such, Mr. Bohon has both a professional and
very personal concern for the proper development of the area.
Mr. Bohon currently operates a real estate service oriented business
from his home on Bohon Street, specializing in appraisal, and feels
in his opinion that the rezoning of 3801 Hollins Road from
residential duplex to conditional commercial, will be beneficial
to the City of Roanoke and the subject neighborhood, by serving to
help stabilize the property values in the neighborhood, and to re-
verse the current declining status of the neighborhood. Since the
purchase of the subject property located at 3801 Hollins Road, N.E.,
over $12,000.00 has been Spent on repairs and improvements in an
effort to show the surrounding property owners that the owner of
said subject property, A.B. Properties Affiliated Services, Inc.,
takes pride in the appearance of the neighborhood, and would like
to reverse the current existing unstable condition of said neigh-
borhood. As a result of these efforts, 29 adjacent and surrounding
property owners now support the rezoning of the subject property
from R M to C1, Commercial Office.
This is the second time a petition to rezone 3801Hollins Road
has been officially filed and submitted to the City of Roanoke.
The first time said petition was submitted was prior to any repair
or improvements having been made to said property. At the subse-
quent hearing, four neighborhood residents showed an~ expressed
their concern that the rezoning of said property might result in
property changes to 3801 No]]ins Road which would not b]end with
existing structures. They were also conc,N-ned about tbe s~ze and

placement of any signs on said property. Even though the City
Planning office recommended approval of the rezoning request,
stating that the subject neighborhood would not be detrimentally
affected by the proposed use, Mr. Bohon, in an effort to work
with his new neighbors to the fullest extent possible, withdrew
the rezoning petition and set up meetings with his neighbors.
As a result of these meetings, Mr. Bohon has made repairs and
improvements to the subject property in keeping with other
existing structures in the neighborhood, and assured the neighbors
that no sign would be erected on the property. As a result of
Mr. Bohon's efforts, a deteriorated piece of rental property, a
source of numerous neighbor complaints, was converted to an attractive,
functional potential office, gaining the support of 29 adjacent
and surrounding property owners who signed a petition supporting
the rezoning.
The subject property is not suitable for use as residential property
because of its location on an extremely noisy and high traffic four
lane thoroughfare on Hollins Road, and its location adjacent to a
busy and thriving real estate office, Campbell Realty. The requested
rezoning can only be beneficial to the neighborhood and the City
of Roanoke. Mr. Bohon does not want strip rezoning in the subject
area, but rather, controlled transitional rezoning in an effort to
better stabilize the area and create more of a blend of residential
and commercial properties, rather than abrupt zoning now existing
in the area, such as Light Manufacturing and Heavy Manufacturing
adjacent to Residential Zoning.

Request from Randy A. Bohon and Margaret E. Simpson that
Lot 12, Block 12, Northfield Addition, located at the
corner of Hollins Road and Drew Avenue, N.E., and
designated Official Tax No. 3280406, be rezoned from RD,
Duplex Residential District, to C-2, General Commercial
District, such rezoning to be subject to certain
conditions proffered by the petitioner.
I. Backsround:
Purpose of the rezoning is to permit the operation of an
office offering real estate-related services.
Petition was submitted on May 12, 1986, contained the
following proffered condition: "The tract as rezoned will be
used only for the purpose of a business office, to be located
in the existing building."
C. Site plan was submitted for informational, purposes only.
II. Issues:
Zonin~ changes from RD to C-2. Adjacent zoning to the south
is C-2, along Holltns Road. Remaining surrounding tracts are
zoned RD. Land to the east, adjacent to the rail lines is
zoned for industrial development.
Land use is consistent with the character of thee surrounding
area. Land fronting on Hol!ins Road has in recent years been
developed for commercial and industrial purposes. The
proposed use provides an appropriate transition between the
residential neighborhood to the north, and the more intensive
commercial development to the south.

Transportation issues ave the location of the existing
driveway and the location of the entrance to the proposed
parking area. City Traffic Engineer recomm~ends that the
existing entrance be closed and that the proposed entrance he
moved further from the intersection.
D. Utilities would not be adversely impacted.
Neighborhood should not be adversely impacted. Landscaped
buffers will be required along the north and east sides of the
site. Preservation of the existing building will help
maintain the character of the neighborhood.
Resident who contacted staff was primarily concerned about the
potential for retail businesses to locate on the site.

Comprehensive Plan recommends that existing neighborhoods be
protected from non-compatible uses. Strip commercial
development should be discouraged.
Commercial uses should be adequately buffered from surrounding
residential uses.
III. Alternatives:
A. Recommend approval of the request.
1. Zonin~ changes from P~ to C-2.
Land use is changed from residential to business offices.
Proffered conditions limit use and preserve existing
structure.
3. Transportation not impacted.
4. Utilities not impacted.
Neishborhood affected by encroachment of commercial

IV. Recommendation:
It is staff's recommendation that the petition be approved as
proffered. The proposed development will have a minimal impact on
the surrounding neighborhood and is consistent with existing
development in the area.

Petition Highlights
We are against uncontrolled commercial strip zoning in the
subject area. For said area, we desire controlled, transitional
zoning, such as that being requested by this petition. The
requested rezoning would allow the residential and commercial
properties to blend together, which would stabilize the subject
area and promote growth instead of decline. We wish to avoid any
further zoning of the type currently in existence in the subject
area, which consists of residentially zoned properties adjacent
to light manufacturing zoned properties, such as in the subject
neighborhood.
The development of Hollins Rd. into a major four lane throughfare,
and resulting commercial development in the subject area, has
irrevocably changed the highest and best use of the subject
property from residential to commercial use. We believe, without
reservation, that the subject ~roperty can only be usefullto the~
City of Roanoke, A.B. Properties, and the surrounding area, as
such.
The subject neighborhood is surrounded by, and contains commercially
zoned properties. Therefore, the rezoning of the subject property
would not in any way adversely change the subject neighborhood or
.surrounding area.
We have done everything possible to work with the surrounding
property owners concerning this rezoning. We have taken extensive
time to meet individually with said property owners to gather their
input, and have abided by their wishes of improving the subject
property to blend with the surrounding structures, and have assured
them no sign would be erected on the subject property. As a result
of these efforts, we have the support of 29 adjacent and surrounding
property owners located on all four sides of the subject property.
Of the thirteen residential type properties located in the subject
neighborhood, and fronting Hollins Rd. as is the subject property,
nine owners of said properties support the rezoning of 3801 Hollins
Rd. from residential to commercial use.

property. As can be clearly seen, business properties co-
exist side by side with residential properties in both the
subject neighborhood and surrounding neighborhoods. The
rezoning of the subject property from RM-1 to C-l, would
not in any way change the subject or surrounding neighborhoods
into non-compatable uses, and therefore said rezoning is full
in line with the Comprehensive Plan.

Dear Mrs. Bowles and Gentlemen:
This is in regard to the request of A. B. Properties
Affiliated Services, Inc., to rezone a tract of land in the
City located on the corner of Hollins Road and Drew Avenue
from RM-1 Residential-Multi-Family, Low Density District to
C-I, Office District. A petition has been filed with the
City by citizens opposed to the rezoning. It is my opinion
that a sufficient number of signatures have been set out in
this petition to invoke the provisions of §62(5) of the Roa-
noke City Charter which provides with reference to amendments
to the City's Zoning Map, in pertinent part, as follows:
"Such regulations, restrictions, and boundaries may
from time to time be amended, supplemented, changed,
modified or repealed. In case, however, of a protest
against such change signed by the owners of twenty per
centum or more either of the area of the lots included
in each proposed change, or of those immediately ad-
jacent in the rear thereof, or of those directly
opposite thereto, such amendment shall not become
effective except by the favorable vote of five-
sevenths of all the members of the Council."
According to City Official Tax Appraisal ~ps. there are
seven parcels in the City which can be construed as being ad-
jacent to the rear or opposite the one proposed to be rezoned.

additional conditiom to which we will be bound:
The present condition of the building will be maintained

This condition was initially proffered, but
excluded from'our originial petition on the
advice o~,Ms. E. ~. Gunter that it was not
enforceable. Subsequently, Mr. John Marlles
suggested that this condition should be
proffered, and wl did so. We submitted this
proffered condition to him in'writing prior
to the 9/2/87 Planning Commission meeting.
He assured the petitioner that he (Mr. Marlles)
would forward this proffer to the City Clerk.
As a result of Mr. Marlles' failure to do so,
our petition was withdrawn from the 10/12/87
City Council Agenda. We are hereby resubmitting

The petitioner, A.B. Properties Affiliated Services, Inc.
own a certain tract of land located in the City of Roanoke,
Virginia, containing one-fifth acre known as Lot 12, Block
12, Northfield Addition, located on the corner of Hollins
Road and Drew Avenue, N.E., Roanoke, Virginia 24012, and
designated on Roanoke City Appraisal Map as Official Tax
Number 3280406; the said tract is currently zoned RM-1,
Residential Multi-Family District. A site plan map of the
property to be rezoned is attached as Exhibit A.
Pursuant to Article VII of Chapter 36, Code of the City of
Roanoke (1979), as amended, the petitioners request that
the said property be rezoned from RM-1, Residential Multi-
Family District, to C-l, Commercial Office District, for
the purpose of using an existing building as an office.
The petitioners believe that the rezoning of the said

Fiscal Year 1987 General Fund Balance designated for Capital
Maintenance and Equipment Replacement per Council Ordinance No. 26292
has been determined to be $2,979,641 (audited) by the Director of
Finance. A report from the Director of Finance regarding this matter
was presented to City Council on October 26, 1987.
B. Capital Maintenance and Equipment Replacement Program for Fiscal Year
1987, based on the total of $2,979,641 between City and School
Administrations, is as follows:

C. Residual funds from the Fiscal Year 1986 and Fiscal Year 1987 Capital
Maintenance and Equipment Replacement Program for the City and School

Additional funding sources available for capital maintenance and
equipment replacement expenditures were approved for Fiscal Year
1988 by City Council with the implementation of a prepared food and
alcoholic beverage tax effective August 1, 1987, and an increase in the
cigarette tax rate effective July 1, 1987.
Cit~ Council's approval is required for expenditures relating to the
City Administration's Capital Maintenance and Equipment Replacement
Program per Council Ordinance No. 26292.

Funding for items will be appropriated after actual bids/proposals are
received and recommended for City Council's approval.
Needs of the Cits - This action will help meet many of the criti-
cal capital maintenance and equipment replacement needs of the
City.

Availabilits of Funds - Total funding of $2,399,938 has been
identified for use in the FY 1987-88 Capital Maintenance and
Equipment Replacement Program which is in addition to previously
budgeted General Fund sources.
Cit~ Council not approve the recommended expenditure list for the
Capital Maintenance and Equipment Replacement Program for the City
Administration.
1. Needs of the Cit~ - Critical capital needs of the City will not be
met.
Availability of Funds - Funds would continue to be available for
the Fiscal Year 1988 Capital Maintenance and Equipment Replacement
Program for the City Administration.
IV. Recommendation:
Recommendation is that City Council adopt Alternative A which will
approve for purchase the recommended items on Attachment "A" to be
included in the Fiscal Year 1987-88 Capital Maintenance and Equipment
Replacement Program for the City Administration.

A RESOLUTION authorizing a revocable permit to Downtown Roanoke,
Inc., for the attachment or installation of holiday decorations to
certain City light standards and other facilities in the downtown area
of the City, upon certain terms and conditions.
WHEREAS, Downtown Roanoke, Inc. (hereinafter "Permittee"),
has requested that City Council authorize Permittee to install
holiday decorations on certain City light standards and other
facilities on streets in the Downtown Business District;
WHEREAS, Council is desirous of granting the request of Per-
mittee pursuant to certain terms
THEREFORE, BE IT RESOLVED by

1. Permission is hereby granted to Permittee to attach, in-
stall and maintain holiday decorations on certain City li£ht stan-
dards and other facilities on Jefferson Street, Campbell Avenue and
Church Avenue in the Downtown Business District pursuant to the
following terms and conditions:
(a) Such permit shall be revocable and shall be
effective from November 21, 1987, through
January 10, 1988;
(b) Permittee shall indemnify, keep and hold the
City free and harmless from liability on account
of injury or damage to any person or property,
including City property, growing out of or direct-
ly or indirectly resulting from the permission
herein granted;
(c)
Permittee shall provide the Director of Public
Works with a certificate of insurance naming
the City of Roanoke as an additional insured,
providing liability insurance in the amount of
at least $300,000 for bodily injury and property
damage combined;
(d)
Permittee shall pay to the City $5.00 per day
during the term of this permit for use of the
City's electrical power and other incidental
costs;
(e)
Electrical equipment installed by Permittee
shall be UL approved for wet locations and
installed pursuant to the National Electrical
Code and the National Electrical Safety Code;
(f)
No object shall be constructed, attached, in-
stalled, erected, or maintained by Permittee
so as to obscure the view of any directional
or informational sign by any operator of a
motor vehicle or pedestrian;
(g)
Permitteee shall obtain any and all necessary
permissions for construction, attachment, in-
stallation, erection and maintenance of such
objects from any affected private property
owners and the State Department of Highways
and Transportation;
(h) Permittee shall not install or attach any ob-
ject to any tree or shrub on City property.
(i) The City shall incur no cost as a result of
grant of this permit; and
(J)
Permittee shall give notice to the City's Direc-
tor of Public Works prior to entry on City pro-
perty for installation and maintenance of such
holiday decorations;
2. This permit shall be in full force and effect at such
time as a copy of this Resolution, duly signed, sealed, attested
and acknowledged by permittee has been filed in the Office of the
City Clerk.

Once again, we envision alternating our red bows and

Avenue. Jefferson Street, however, would receive new
holiday banners between Salem Avenue and Elm Avenue.
As always, we plan to have these decorations installed
the weekend before Thanksgiving and removed by January 10.'
The actual installations and removal would again be coor-
dinated by the Vietnam Veterans of America.

Subiect: Extension of Vacant Lot Homesteading Program
I. Background
Vacant Lot Homesteading Program, approved by City Council on July 25,
1983, was developed to reduce the number of vacant, neglected lots in
the City's neighborhoods by helping responsible parties buy the lots.
B. Loans of federal funds made by the City under the Program cover:
1. Purchase price, up to appraised value;
2. Services of a realtor (in some cases);
3. Legal fees associated with closing on transaction;
~-. Costs to clear lot initially, in cases where needed;
5. Other related expenses, such as recording fees.
C. Loans have been mainly to adjacent homeowners.
Current Program prohibits construction on these vacant lots without
the express written permission of the City. Because most of these
lots have been "homesteaded" by adjacent homeowners, none have been
used for new construction thusfar.
II. Current Situation
Vacant lots of appropriate size according to zoning requirements could
be used for infill building, which would aid the revitalization
efforts in the Conservation Areas and Rehabilitation Districts.
Little new construction has occurred in these areas due to
construction costs approaching or exceeding mortgage or resale value.
A subsidy is needed to stimulate development of new housing through
construction or house-moving.
Homesteading lots to building contractors or families who intend to
build on the lots would be an incentive for building in Conservation
Areas and Rehabilitation Districts.
D. Provisions for extension of the Vacant Lot Homesteading Program
are set out in Attachment A.

Approve the expansion of the Vacant Lot Homesteading Program
(Attachment A) to encourage infill building on problem vacant
lots in Conservation Areas and Rehabilitation Districts; and
appropriate $20,000 from Unprogrammed CDBG Funds (Account No.
035-056-$6#0-5150) to a Vacant Lot Homesteading account to be
established by the Director of Finance.
Neighborhood impact would be positive in that newly built
homes on vacant lots would stimulate further revitalization in
the Conservation Areas and Rehabilitation Districts. Program
extension might be used to attract private developers to build
infill houses, or might assist special projects such as the
Shadeland Avenue relocation project. However, Program requires
specific Council authorization of each contract and grant or
loan. Additional funding will support 10-12 transactions.
Local cost to the City would be nothing. All costs would be
eligible for CDBG Program reimbursement. CDBG funds are currently
available from unallocated program income. Administrative staff
time necessary to implement this expansion of the Vacant Lot
Homesteading Program will be absorbed by existing staff. Tax
revenues would be increased by the value of the new homes
built.
B. Do not approve the expansion of the Vacant Lot Homesteading Program
and appropriation of additional funds for the Program.
Neighborhood impact would be limited by the lost opportunity
to encourage and subsidize infill development in targeted areas
through the Vacant Lot Homesteading Program. Current funding will
finance about 5 transactions under existing Program.
Local cost to the City could include the unreimbursed cost of
cutting/clearing these lots each year. In addition, potential
tax revenues from new buildings would be lost.
V. Recommendation:
Adopt Alternative A, thereby approving the extension of the Vacant Lot
Homesteading Program (Attachment A) to include homesteading lots to
persons wishing to build or move houses into Conservation Areas and
Rehabilitation Districts; and appropriating $20,000 from Unprogrammed
CDBG funds to an account to be established by the Director of Finance to
supplement existing Program funds.

Vacant Lot Homesteading
Extension of Program
II.
I. Description of Program
The Vacant Lot Homesteading Program was approved by City Council
3uly 25, 1983. Its goal is to "homestead" vacant lots to responsible
parties who will keep them clear of weeds, and hopefully put
them to a good use that will enhance the neighborhood. Currently,
construction on homesteaded lots, prior to release of the Deed of
Trust, would require permission from the City.
The proposed extension of the Vacant Lot Homesteading Program would
provide for homesteading to contractors and/or individuals who plan
to construct or move a residential unit onto the Jot.
The purpose of this proposed extension of the Vacant Lot
Homesteading Program is to enhance the beneficial use of vacant
lots under the Program by providing an incentive for contractors,
developers or individuals to build new or move existing houses onto
lots located in Conservation Areas or Rehabilitation Districts.
Procedure
A. Acquisition
The City will make grants, up to $2500 each, to responsible parties
who agree to build or move houses onto the land. A lot will be
considered for this program under the following conditions:
a. Lot must be in a Conservation Area or Rehabilitation
District.
b. Lot must meet all zoning requirements for the proposed
residential building.
c. Lot must not be in a flood hazard area.
2. This grant can be used for:
a. the purchase price of the lot, up to the fair market value;
b. legal fees associated with purchase and resale of the lot,
as paid by buyer/builder;
c. clearing and grading where necessary;
d. building permit fees;
e. water and sewer connection fees;
f. other reasonable expenses customarily associated with such
real estate transactions.

The total of all costs reimbursed by the grant may not exceed
$2500 per lot.
Recipients
The buyer/builder will be identified before action is taken to
transfer the lot. Recipients of grants under this extension may
be either:
a. Individuals or families of low-moderate income intending to
occupy house after its completion; or
b. Contractors/Developers agreeing to rent initially or sell
building to low-moderate persons after its completion.

Conditions of Transfer
As approved individually by City Council~ a contract for a
reasonable time will be executed between the City and the buyer
of the lot, providing a grant to the buyer/builder upon the
fulfillment of certain conditions. In return, the
buyer/builder must agree to the following minimum conditions
(more stringent conditions may be applied in some cases):

Buyer/builder must submit building and site plans for a
review by the Building Department to insure that the
proposed structure meets all applicable building and zoning
codes and is compatible with the neighborhood.
Construction or relocation must begin within six months of
the closing on the lot and be completed within one year
from the date of closing.
Initial occupancy of any building placed on a lot in con-
junction with this Program extension must be by a low-
moderate income occupant. Low-moderate income is defined
as at or below 80% of the median family income in the
Roanoke Metropolitan Area as established by HUD.
This requires that a buyer/builder who intends to
occupy the building himself/herself must be of low-moderate
income.
Buyer/builder will receive a grant for reimbursement for
all allowable expenses after the terms of the contract have
been met; that is~ when the construction is completed and
the building is occupied by a low-moderate income person.
D. Typical Scenario
Prospective buyer/builder makes contact with the Housing
Development Office inquiring about the possibility of homestead-
ing a particular piece of vacant lot.

2. The Housing Development Office determines that the lot meets
ali the requirements set out in this description, prepares a
contract between the City and the buyer/builder specifying the
reimbursable items and conditions, and sends it to City Council
for approval.
3. City Council approves and the City Manager executes the
contract.
The buyer/builder negotiates with owner of lot and obtains
contract of sale. Buyer/builder retains an attorney to prepare
legal documents necessary for the transfer of the lot and closes
transaction.
Buyer/builder arranges for house to be placed on lot and, upon
completion, occupies, sells, or rents house according to terms
of contract.
Housing Development Office verifies that the terms of the
contract have been met) that is, construction is completed and
the building has been occupied by a low-moderate income person.
The buyer/builder then is reimbursed for allowable expenses as
set out in the contract. The following items are examples of
proof which can be used to verify expenses:
-document showing cost of the lot
-receipts from an attorney for necessary legal work
-receipts from Building and ~/ater Departments showing
the cost of water and sewer hookups and building permits
-receipt for any grading work done to the property
Not all of these documents would be necessary in each
case. The items that will be paid for by the City will
be set out in the contract between the City and the
buyer and will not exceed $2,500 on each lot.
III.
Funding
The funds for the acquisition, etc. of lots for this extension of
the Vacant Lot Homesteading Program will come from the City's
Community Development Block Grant allocation, as appropriated by
City Council to the Vacant Lot Homesteading Program.

AN ORDINANCE providing for the purchase of blower equipment
for use by the City at the Water Pollution Control Plant, upon
certain terms and conditions, by accepting a bid made to the City
for furnishing and delivering such equipment; rejecting other
bids made to the City; and providing for an emergency.
BE IT ORDAINED by the Council of the City of Roanoke that:
1. The bid of Dresser Industries, Inc., made to the City
offering to furnish and deliver to the City, f.o.b., Roanoke,
Virginia, a pressure lubricated rotary blower unit, for the sum of
$47,090.00, is hereby ACCEPTED.
2. The City's Manager of General Services is authorized and
directed to issue the requisite purchase order therefor, incorporat-
ing into said order the City's specifications, the terms of said bid-
der's proposal, and the terms and provisions of this ordinance.
3. The other bids made to the City for the supply of such
equipment are hereby REJECTED, and the City Clerk is directed to
notify such other bidders and to express the City's appreciation
for their bids.
4. In order to provide for the usual daily operation of the
municipal government, an emergency is deemed to exist, and this
ordinance shall be in full force and effect upon its passage.

Blowers at the Water Pollution Control Plant feed air into the
system for treatment.
No. 5 Blower has been severely damaged due to bearing failure
with method of lubrication being a contributing factor.
Repair of the existing blower will cost in excess of
$50,000.00.
Public advertisement was placed in the local paper soliciting
replacement cost from interested blower manufacturers.
II. Current Situation:
Three manufacturers responded to the request for replacement
costs. (See attached bid tabulation).
1. Dresser Industries~ Inc. - $47,690.00.
Sutorbilt~ Inc. - Did not meet specifications in regard
to lubrication system, impeller construction, and ease of
installation.
Berkness Corporation - Could not meet specifications and
did not bid.
Installation will be by separate contract estimated to be in
the $7,500.00 range.

Subject: Executive Summary - Report on Selection of a Health Care
Provider for Hospitalization Coverage
The attached staff report recommends a new one year employee health
insurance contract with Blue Cross and Blue Shield of Virginia. Our
present contract expires December 31, 1987, and we have worked diligently
for the past two months to analyze bids from a number cf insurance car-
riers and negotiate the best new contract possible.
I am recommending that the City increase its level of contribution from 85
to 90 percent of the cost of individual employee health insurance. This
increases the monthly City contribution from $54 to $78 per employee. The
new premiums are as follows:

Employees are being notified, individually, by letter today of these
changes.
I have recommended the City increase its portion to 90 percent in order to
lessen the impact of the increase on those in the employee/child and
family plans. The calendar year deductible will remain at $100 for
individuals and/or $200 per family.
Three other changes have been recommended with the new plan in order to
increase benefits and contain costs.
1. Increase the Lifetime Maximum from $750~000 to $1~000,000.

Increase the individual out-of-pocket maximum from $500 to $750
and increase the family out-of-pocket maximum from $1,000 to
$1~500.
Place a $250 penalty on participants who do not get their
hospital stay approved through preadmission review.
To understand the increase in premiums, one must realize the determining
factors: (1) Medical Costs have increased greatly over the past two
years; (2) In the first 9 months of 1987, claims (money paid out for
medical services) exceeded premiums (money taken in) by $425,000; and (3)
Employees are utilizing more expensive hospital emergency rooms as opposed
to neighborhood medical centers or family doctors. These facts bring to
light that each of us must have a personal role in keeping insurance costs
down by utilizing good judgment in seeking responsible, cost effective
health care.
I am reco~nending funding for this increase from the General Fund Contin-
gency to address the cost through June 30, 198~. Future funding will be
developed in the FY 88/89 budget process.
Under the proposed new health insurance contract, coverage has been
structured to make the most desirable benefits available to every City
employee at a reasonable rate and at the same time encourage cost aware-
ness.

Medical Coverage following the expiration of the current contract
on December 31, 1987.
I. BACKGROUND:

The present Comprehensive Health Insurance contract with
Blue Cross and Blue Shield of Virginia expires December
31, 1987.
B. City currently contributes 85% toward single employee
rate.

Specifications for services were developed for
obtaining competitive proposals on the City's Group
Hospitalization and Health Insurance.

Request for Proposals of one and two year contracts on the
Health Insurance Plan as it exists today and the cost
effects of ten (10) options were identified for cost
containment and/or enhancement of benefits.
Thirty-five (35) a~ents/brokers were mailed request for
proposals on August 3, 1987. A listing of those
agents/brokers is attached. (Attachment A)
F. Advertisement of this request for proposals was published
in the Roanoke Times and World News, August 9, 1987.
Seven (7) responses were received, publicly opened and
read at 2:00 p.m. on Tuesday, September 15, 1987 in
Council's Conference Room. (Attachment B)

CURRENT SITUATION:

Medical Costs have escalated in the last two years;
therefore, causing a direct increase in health insurance
premiums.
Claims Experience for the City of Roanoke in the first
nine months of 1987 exceeded premiums by approximately
$425,000. A few statistical examples are listed below:
- Psychiatric inpatient utilization increased 82% above
the previous year.
- City employees and their family members were admitted to
the hospital at 5% above the norm.

City employees and their family members used hospital
outpatient services at 21% above the norm which
represented a 25% increase above the previous year.
Emergency room visits accounted for the majority of this
category.
16% of all hospital inpatient charges involved
life-style related disorders such as high blood
pressure, heart disease and substance abuse. This
category excludes Public Safety employees which are
covered directly under Workers' Compensation by the
Heart and Lung Bill.
Bid Committee was appointed by the City Manager to
evaluate current situation, review proposals and make
recommendations. Bid committee consisted of the
following:

Director of Administration & Public Safety
Manager of Personnel Management
Benefits Coordinator
Initial evaluations were made by the Bid Committee
and the Department of General Services on the three (3)
proposals that met specifications on one year contracts.
Two (2) proposals offered administrative services only
which would require the City to assume all financial risk
through a self insured program and two (2) proposals
offered dental coverage only.
City Attorney has advised that in accordance with the
City of Roanoke procurement code negotiations are
permissible under Section 23.1-6 in the procurement of
Health Insurance Services.
Informational meetings were called with each of the three
(3) health care companies meeting bid specifications to
provide enough comparable data to competitively rank the
companies.
Cost Containment Recommendations to help stabilize the
premium rate were made by all three (3) health care
companies as follows:
Increase the Individual Out-Of-Pocket Maximum from
$500 to $750 and increase the Family Out-Of-Pocket
Maximum from $1,000 to $1,500.

Reduce the co-insurance amount from 85% to 80%.

Bid Committee endorsed the following changes with the
objective of maintaining quality health care coverage for
a reasonable rate and adopting fair cost containment
features to limit future premium increases.
1. Increase the Lifetime Maximum from $750,000 to
$1,000,000.
Increase the Individual Out-of-Pocket Maximum from
$500 to $750 and increase the Family Out-Of-Pocket
Maximum from $1,000 to $1,500.

Safety in compliance with the City procurement code,
negotiated with the first ranked vendor, Blue Cross and
Blue Shield of Virginia.
COBRA Administration which allows terminating employees
and their families to continue health insurance under the
City's Group for 18 or 36 months is provided for a present
cost of $.35 per employee contract amounting to
approximately $525 per month or $6,300 per year.
Section 125 of the Internal Revenue Code established
regulations allowing the City to permit employees to
elect to change payroll deductions for health insurance
premiums from an after-tax contribution to a pre-tax
contribution; therefore, increasing the employee's net pay
by creating a tax savings for the employee and the City.

Dependent Coverage. The City presently
contributes $54.00 per participating employee per
month. The new contribution would now be $78.00

of both the City and it's employees would be
$2,519,279 for the contract period based on
current enrollment data as illustrated in
Attachment C (Chart 2).

time set charge of $1,000 and 2% of each
continuing participants monthly premium saving the
City approximately $4,000 over present situation.

the understanding that Blue Cross and Blue Shield of
Virginia provide the City Manager with said contract ready
for execution no later than December 1, 1987, if possible.

Council ADDrove Alternative A to increase City

AN ORDINANCE accepting the bid of Construction Services of
Roanoke, Inc., for alterations and additions to Fire Station No. 1,
upon certain terms and conditions, and awarding a contract therefor;
authorizing the proper City officials to execute the requisite
contract for such work; rejecting all other bids made to the City for
the work; and providing for an emergency.
BE IT ORDAINED by the Council of the City of Roanoke as follows:
1. The bid of Construction Services of Roanoke, Inc., made to
the City in the total amount of $84,138.00 for alterations and addi-
tions to Fire Station No. 1, such bid being in full compliance with the
City's plans and specifications made therefor and as provided in the
contract documents offered said bidder, which bid is on file in the
Office of the City Clerk, be and is hereby ACCEPTED.
2. The City Manager or the Assistant City Manager and the City
Clerk are hereby authorized on behalf of the City to execute and
attest, respectively, the requisite contract with the successful
bidder, based on its proposal made therefor and the City's specifica-
tions made therefor, said contract to be in such form as is approved
by the City Attorney, and the cost of said work to be paid for out of
funds heretofore or simultaneously appropriated by Council.
3. Any and all other bids made to the City for the aforesaid
work are hereby REJECTED, and the City Clerk is directed to notify

I. Back,round:
City Council, at its October 26, 1987 meeting, publicly
opened and read aloud the bids received for the Alterations
and Additions to Fire Station No. 1 at 13 E. Church Avenue,
Roanoke, Virginia.
Five (5) bids were received with Construction Services of
Roanoke~ Inc. submitting the low bid in the amount of
$84,138.00 and 100 consecutive calendar days project
construction time.
Fire Station No. 1 is on the Historical Registry for
Buildings and all the work involved has been reviewed and
approved by the Architectural Review Board. The major items
of work are as follows:
1. New acoustical ceiling and lights in kitchen.
2. New kitchen cabinets and appliances.
3. New composition floor.
4. New food closets for the three duty shifts.
Ail the above is about the same as was done at Stations
#6 and #13.
5. New air conditioning of the occupied spaces on the
second floor.
6. Three new showers and two lavatories in the bathroom.
7. New composition floor in bathroom (linoleum).
8. New washer and dryer.

11. New three phase electric service to accommodate new air
conditioner.

Contract Documents.
B. Amount of the low bid.

Alternatives are:
A. Award a lump sum contract to Construction Services of
Roanoke~ Inc. in the amount of $84~138.00 and 100 consecutive
calendar days for Alterations and Additions to Fire Station
No. 1 in accordance with the Contract Documents as prepared
by the City Engineer's Office.
1. Compliance of the bidder with the requirements of the
Contract Documents was met.
2. Amount of the low bid is within the engineer's estimate
and is acceptable.
3. Fundin~ is available from the undesignated capital
funds.
4. Time of completion as quoted is acceptable.
B. Reject the bids and do not award a contract at this time.

2. Amount of the low bid may increase if the project is

Time of completion would be extended. This is one of
many projects that was put off due to the November 1985
flood. It would be better if we had no further delays.
IV. Recommendation is that City Council take the following action:
A. Concur with the implementation of Alternative "A".
Authorize the City Manager to enter into a contractural
agreement with Construction Services of Roanoke~ Inc. for the
Alterations and Additions to Fire Station No. 1 in accordance
with the Contract Documents as prepared by the City
Engineer's Office in the amount of $84~138.00 and 100 con-
secutive calendar days.
Appropriate $93~000.00 from undesignated capital funds to an
account to be established by the Director of Finance;
$84~138.00 contract amount plus $8~862.00 project contingency
account,

Lease Assignment
Southeast Action Forum, Inc.
I. Background:
Initial lease for the Old Fire Station No. 6 on Jamison
Avenue, S.E. was executed by Mrs. Mildred Prater for the
Belmont Neighborhood Watch Group for a five (5) year term
beginning on July 14, 1980. The lease provided that the
facility be used as a community center and meeting place for
the group.
Assignment of the lease from Mrs. Prater to the Belmont
Neighborhood Watch Group, Inc. was authorized by Ordinance No.
26027, dated May 25, 1982. Term of the lease was five (5)
years from the original date of the lease, July 14, 1980.
New five (5) year extention of the lease was authorized by
Ordinance No. 27734, dated August 26, 1985. This lease was
executed on September 5, 1985.
Assignment of the lease from the Belmont Neighborhood Watch
Group, Inc. to the Southeast Action Forum, Inc., an expanded
neighborhood organization, was authorized by Ordinance No.
28442, dated November 21, 1986. Term of the lease was five
(5) years from the date of the extended lease dated September
5, 1985.
II. Current Situation:
Sublease is requested by Southeast Action Forum, Inc. to
permit the League of Older Americans to use the first floor of
the Old Fire Station No. 6 for the Southeast Diner's Club.
This action will formalize and continue an activity which has
been in operation for some time.

Need to recognize the agreement between the Southeast
Action Forum, Inc. and the League of Older Americans
would be met.
Neighborhood stability is enhanced by supporting the
continued provision of services of Southeast Diners Club
at neighborhood sponsored site.
Public liability insurance to be provided by the League
of Older Americans insuring the City against all legal
liability for injuries to persons and damages to
property.
Do not recommend that City Council authorize the Southeast
Action Forum, Inc. to enter into a sublease with the League of
Older Americans.
1. Cost to City is not changed.
Need for recognition of an an ongoing agreement is not
met.
Neighborhood stability is threatened by loss of
significant service (Southeast Diner's Club.)
4. Public liability insurance is not an issue.
V. Recommendation
Committee recommend to City Council that it authorize the Southeast
Action Forum, Inc. to enter into a sublease with the League of
Older Americans for the use of the Old Fire Station No. 6 as the
Southeast Diner's Club.

AN ORDINANCE granting to the Commonwealth of Virginia, State
Air Pollution Control Board a revocable permit providing for the
installation of an air pollution monitoring device on certain
City property, upon certain terms and conditions.
BE IT ORDAINED by the Council of the City of Roanoke as
follows:
1. Permission is hereby granted to the Commonwealth of
Virginia, State Air Pollution Control Board (Permittee) to install
and maintain an above ground automatic monitor of airborne par-
ticulates on City-owned property, the location of such monitor
being within the right-of-way of the dead-end portion of Mulberry
Street, N.W., as more particularly set forth in report to this
Council dated November 2, 1987, a copy of which is on file in the
Office of the City Clerk.
2. The permit granted by this ordinance shall be revocable
at the pleasure of the City of Roanoke.
3. Any and all costs in connection with the granting of
this permit will be borne by the Commonwealth of Virginia, State
Air Pollution Control Board.
4. Installation and maintenance of such pollution moni-
toring device shall be at the sole expense of the Permittee.
5. The Permittee shall restore the surface of the City pro-
perty to substantially the same condition which existed prior to
any construction or alteration necessary to install said device.
6. Permittee agrees to engage in its best efforts and
undertake any and all action necessary in order to indemnify and
hold harmless the City, its officers, agents and employees, from
any and all claims, legal actions and judgments advanced against
the City and for expenses the City may incur in this regard
arising out of the Permittee's intentional acts or negligent acts
or omissions with respect to the rights or privileges granted
hereby.
7. Permittee shall give notice to the City's Director of
Public Works prior to entry onto City property for installation,
repair or maintenance of said air pollution monitoring device.
8. This permit shall be in full force and effect at such
time after its effective date as a copy, duly signed, sealed,
attested and acknowledged by the Commonwealth of Virginia, State
Air Pollution Control Board and has been filed in the Office of
the City Clerk.

High Volume Particulate Monitor Site
I. Back~round:
A. State Air Pollution Control Board
(S.A.P.C.B), Regional Office, maintains a number of automatic
(electric) monitors of airborne particulates around the Roanoke
Valley.
B. Particulate Monitor near the Roanoke Electric Steel Plant was
located on private property in the Cherry Hill Subdivision area
by agreement with the property owner. It has been located there
for a number of years.
II. Current Situation:
Private property owner, of monitor site, has sold the property to
Roanoke Electric Steel. S.A.P.C.B cannot, or will not, place a
monitor on the property of a company (air pollution "source")
being monitored.
S.A.P.C.B. desires to continue to maintain a monitor adjacent to
Roanoke Electric Steel. They feel that a location somewhere
within the right of way of the dead-end portion of Mulberry
Street, N.W. would satisfy their requirements (See attached
letter and map).
S.A.P.C.Bo has provided, at our request, information relative to
their ability to provide liability insurance for the monitor
installation (attached). S.A.P.C.B. is without authority to
enter into a contract indemnifyin~ and holdin~ the City
harmless. The board itself maintains no insurance. The
attached information describes the State's self-insurance which
covers the State and its a~encies only. This situation is stan-
dard State practice, unless special authorization is granted by
the General Assembly to a specific State agency.
Indemnification should still be required even if it can only be
enforced on a moral obligation basis or through special action
of the General Assembly if circumstances require that action.
D. City Administration feels that, if the S.A.P.C.B. can provide
the necessary electric power, physical protection for their
installation, and locate out of the traveled portion of Mulberry
Street, N. W. the installation could be provided in that loca-
tion.

As you know, Roanoke Electric Steel has recently purchased some property
on Cherryhill Circle where our High Volume Particulate Monitor is located.
Because the monitor is now located on Roanoke Electric Steel property, viola-
tions of our particulate ambient air quality standard could not be enforced at
that location. For this reason a new site for the monitor is being sought.
We have pursued several sites owned by private citizens, but either the
site turned out to be not suitable or the individual just didn't want someone
on their property every week. However, we have located a site on the City
Right of Way on Mulberry that would be suitable for the monitor. Would the
city allow the installation of a monitor at this site?

located near a dead-end road in the City of Roanoke, Virginia.
I have enclosed a Certificate of Self-insurance for the
Self-insured General Liability Plan for the Commonwealth of
Virginia.
Should someone be injured resulting from the presence of our
equipment, and it is deemed that we are negligent, the State
Self-insurance Liability Plan would respond. If an automobile
owned by the Commonwealth damages the equipment, the plan should
respond.
Should a member of the public run into the equipment near
the dead-end road, and they were negligent, then their personal
automobile insurance would respond.
