Frank P. Tota, Jr., a Senior at Patrick Henry High School,
as one of the twenty members of the First Team;
WHEREAS, winners of this prestigious designation were
selected from a field of 1607 outstanding students nomi-
nated for the honor by their schools;
WHEREAS, these students represent the best all around
students attending high schools in this country, and the
winners combine outstanding grades, leadership in activities
in and out of school and leadership in intellectual endeavors
that have taken their education beyond the classroom;
WHEREAS, Mr. Tota has earned a 4.2666 grade average at
Patrick Henry High School and achieved a score of 1530 on

I have reviewed the attached request for the appropria-
tion of two school grants and undesignated capital funds for the
School Board. The Staff Development Title II and Instructional
Services Title II grants are funded with 100% federal funds.

school bond proceeds to purchase computer for the
Instructional Management System in elementary Funding
for this equipment was identified in the City's Five Year Capital
Improvement Program.

Dear Members of Council:
As the result of official School Board action at its meeting of May 26,
1987, the School Board respectfully requests City Council to appropriate the
following funds to school accounts:
Grant No. 6219
$8,450.00 for the Staff Development Title II, 1987
program to provide funds for staff development
activities. The program is one hundred percent
reimbursed by federal funds.
Grant No. 6221
$3,000.00 for the instructional Services Title II
program to provide funds to improve the
participation of female and minority students in
mathematics and science education. The program
is one hundred percent reimbursed by federal
funds.
The Board further requests City Council to appropriate $160,000.00 of
Undesignated Capital Project Funds to provide for the purchase of computer
equipment for the Instructional Management System. The system will provide
automated testing and student evaluation services for each elementary school.

AN ORDINANCE amending and reordaining subsections (a) and
(b) of §6-62, Vaccination of dogs, Code of the City of Roanoke
(1979), as amended, to require rabies inoculations for cats;
establishing an effective date; and providing for an emergency.
BE IT ORDAINED by the Council of the City of Roanoke that:
1. Subsections (a) and (b) of §6-62, Vaccination of dogs,
Code of the City of Roanoke (1979), as amended, be and is hereby
amended and reordained to read and provide as follows:
§6-62. Vaccination of dogs and cats.
(a) It shall be unlawful for any person to
own, keep or harbor any dog or cat over six (6)
months of age within the City, unless such dog or
cat has been vaccinated against rabies, within a
period of three (3) years, either at a clinic
established in the City by the City Manager for
the purpose or by a duly licensed veterinarian. A
reasonable charge shall be made for vaccinations
made at clinics established by the City Manager;
provided, however, that in any case in which such
charge would result in a demonstrable hardship,
no charge shall be made.
(b) At the time a dog or cat is vaccinated
as required by this section, a certificate of such
fact shall be issued to the owner, which shall con-
tain a description of the dog or cat, the name of
the owner, the date on which such vaccination took
place, the type of vaccination used and the signa-
ture of the veterinarian or other person who vacci-
nated the dog or eat.
2. In order to provide for the usual daily operation of the
municipal government, an emergency is deemed to exist, and this
ordinance shall be in full force and effect on and after August
1, 1987.

Subject: Rabies Inoculations for Cats
I. Background:
March 5, 1987, Mayor Noel C. Taylor received a letter
from Dr. C. M. G. Buttery, State Health Commissioner,
citing the increased number of rabies cases and the
spreading of the geographic areas affected. Dr.
Buttery urged that this locality adopt an ordinance
requiring cats to be immunized against rabies.

Jr.'s, Director of Roanoke City Health Department,
letter of support for Doctor Buttery's request requir-
ing cats to be immunized against rabies. (Letter

II. Current Situation:
Forty-three (43) localities in Virginia have enacted
requirements for cat inoculation according to State
Health Department epidemiologist Susan R. Jenkins.
A list of those localities and the dates of enactment
is attached.
Roanoke City has not found rabid animals wild or do-
mestic. However, there are pockets of wild animal
concentrations within the City. The animals are of
the type that are carriers and susceptible to rabies,
i.e, raccoons, skunks, foxes, groundhogs, opossum.
The probability of wild animal contact with domestic
cats is very high.
Domestic and feral cats are presently considered
free-roaming animals in the City and no ordinance
exists requiring rabies vaccination.

Since 1980, thirty-three (33) cats and three (3) dogs
have been diagnosed as rabid in Virginia and incidents
have occurred in early 1987 in Hanover County, Fauquier,
and Rockbridge counties of reported rabid cats and the
requirement for post exposure treatment to numerous
people as a result of exposure to unvaccinated cats
according to Doctor Buttery.

with domestic cats and dogs that may have contracted
rabies from wild animals.
III. The issues are:
A. Public health.
B. Legality of cat inoculation.
Alternatives:
City Council amend Code of the City of Roanoke (1979) as
amended, Section 6-62, to provide for the inoculation of
cats.
1)
Public health and welfare will be addressed in that
the risk of rabies exposure to citizens will be
substantially reduced as a result of contact with
domestic animals.
2)
Legality of the City's enactment of an ordinance as
provided for in Section 15.1-28.5, Code of Virginia,
which clearly provides such authority for localities
to require rabies inoculations for cats.
City Council not act to amend Article III, Rabies Control
ordinances to permit inoculation of cats.
1)
Public health issues will not be immediately ad-
dressed nor is there evidence of imminent danger;
however, the probability of citizen exposure to
rabies through contact with domestic cats will not
be reduced.
2) Legality is not an issue.
IV. Recommendation:
It is recommended that City Council adopt Alternative "A" and
amend Section 6-62 of the Code of the City of Roanoke (1979)
as amended, to require rabies inoculations for cats.
While it's recognized that enforcement of this regulation will
be difficult in the absence of a licensing provision for cats
it will none the less provide a measure of protection for
citizens and animal control officers coming in contact with
domestic animals.
The City Health Department, Police Department, and the
Veterinarian's Association will sponsor an inoculation clinic
to further encourage voluntary compliance with the ordinance.

The rabies problem is increasing in Virginia. During the
first 7 weeks of 1987, 44 rabid animals were reported compared to
12 for the same time last year. The rapid geographic expansion
of the raccoon epizootic (an epidemic occurring in animals) is
significant. Last year Alleghany, Caroline, Essex, Goochland,
Henrico, and King and Queen Counties reported rabid raccoons for
the first time. Rabid skunks, believed to be associated with
the raccoon outbreak, were reported from south of the James River
in Buckingham and Cumberland Counties. This year King William
and Cumberland Counties have already reported their first rabid
raccoons; the latter confirms the spread of the raccoon outbreak
south of the James River.
In Northern Virginia the number of animal rabies cases
increased between 1985 and 1986 in Clarke, Fairfax, Loudoun,
Shenandoah and Warren Counties. Several counties in southwest
virginia continue to report rabid skunks as part of a larger
outbreak affecting the midwest United States.
Since there are presently no effective direct methods to
control wildlife rabies, we depend on indirect methods to protect
the public from this universally fatal disease. The most
important protection is vaccination of dogs and cats against
rabies. Because pets are so much a part of family life, they are
much more likely than wild animals to expose large numbers of
people when they become rabid. Since 1980, 33 cats and 3 dogs'
have been diagnosed as rabid in Virginia. This coincides with
the nationwide trend where more cats are consistently reported
rabid. The number of rabid dogs decreased dramatically in the
mid 1950's when effective dog rabies vaccines became available
and stray dog control became a priority. Virginia presently has
a law requiring all dogs over 6 months of age to be vaccinated
against rabies.

Cat rabies has b~c0me headline news in Virginia since two
rabid cats were reported from Hanover County early in 1987. Six
people underwent expensive (approximately $500 per person) rabies
post exposure treatment as a result of exposure to these
unvaccinated, pet cats. Fauquier and Rockbridge Counties have
also reported rabid cats this year resulting in another 6 to 9
people receiving post exposure treatment.
It would be a grave mistake not.to take every reasonable
action to prevent human rabies cases in Virginia. Accordingly, I
request that your locality adopt an ordinance as soon as
possible, requiring cats to be immunized against rabies. Section
15.1-28.5 of the Code of Virginia allows the governing body of
any county, city or town to require by ordinance ,that all
domestic cats be innoculated against rabies by a currently
licensed veterinarian or by an animal technician certified
pursuant to Section 54-786.3 " To date at least 35
localities in Virginia have adopted a cat rabies vaccination
ordinance (see attached example from New Kent County). The risk
of rabies transmission to people is sufficiently great to warrant
this action in all remaining jurisdictions.
The enactment of an ordinance in your locality has been
discussed with your'District Health Director, Dr. E. J. Clarke,
Jr. He agrees with me that such an ordinance is indicated.
Adopting it is a desirable step towards ensuring that the people
living in your locality are protected against transmission of
this disease by their pets. If you have questions or comments or
desire further explanation or clarification, I urge you to
discuss this recommendation with Dr. Clarke at (703) 983-7600 or

Recently Dr. C.M.G. Buttery, State Health Commissioner wrote to
Mayor Noel C. Taylor, concerning the Wildlife Rabies problem in
Virginia and outlining the progress of the problem and the very
real potential for human risk, as this epizootic continues to
spread. He stated that family pets are more likely than wild
animals to expose large numbers of people when they become rabid,
resulting in very expensive post-exposure treatment,
(approximately $500 per person), for all who had contact with the
animal.
Since 1980 cats have increasingly been diagnosed as rabid. Since
the State of Virginia has a proven effective law requiring all
dogs over six months of age to be vaccinated against rabies, dog
rabies has decreased dramatically. It would therefore be
reasonable to expect that required vaccination of cats would have
a favorable impact on this disease in cats.
Therefore, I would like to support Dr. Buttery's request that
Roanoke City adopt an ordinance requiring cats to be immunized
against rabies.

Council considered the subject plan and reports from the Water
Resources Committee and Planning Commission on June 1, 1987. Both
the Committee and the Commission recommended that Council approve the

I recommend for future consideration that there be a measure of
record showing City Council approval. This measure could be important
when applying for funding for specific projects and would be easier than

for construction of a sewage lift station and force main located on
Park Lane, S.W., upon certain terms and conditions, and awarding a
contract therefor; authorizing the proper City officials to execute
the requisite contract for such work; rejecting all other bids made
to the City for the work; and providing for an emergency,
BE IT ORDAINED by the Council of the City of Roanoke as
follows:
1. The bid of S. C. Rossi & Company, Inc., in the total
amount of $35,552.50, for construction of a sewage lift station and
force main located on Park Lane, S.W., such bid being in full
compliance with the City's plans and specifications made therefor,
subject only to the modifications contained in a letter dated
May 19, 1987, from S. C. Rossi & Company, Inc., and as provided in
the contract documents offered said bidder, which bid is on file in
the Office of the City Clerk, be and is hereby ACCEPTED.
2. The City Manager or the Assistant City Manager and the
City Clerk are hereby authorized on behalf of the City to execute
and attest, respectively, the requisite contract with the success-
ful bidder, based on its proposal made therefor, as modified by the
above-mentioned May 17, 1987, letter, and the City's specifications

Park Lane, S.W. Duplex Grinder Sewage
Lift Station and Force Main
I. Back~round:
Project was generated out of necessity due to increasing sep-
tic problems for two property owners on Park Lane, S.W. in
the City of Roanoke, Virginia.
Property owners formally agreed to a proposal by the City of
Roanoke to assist them by designing and constructing a sewage
lift station to transport the sewage flow to the nearest gra-
vity manhole and thereby eliminate the need for septic tanks
and drain fields.

Formal a~reement consists of joint participation between the
City of Roanoke, Mr. Charles Lex, and Ms. Julie Slusher for
the cost of design and construction of the lift station faci-
lity.
Preliminary estimate as of July, 1986, was in the amount of
$21~650.00 and design of the Station attempted to stay within
this budgeted amount. The participating parties would share
in the costs for this project according to the following
percentages of the original preliminary estimate amount of
$21,650.00:

City Council received, publicly opened and read four (4) bids
for the subject project on May 11, 1987, and referred the
bids to a bid committee in order to review the bids and
report back to Counicl.
F. Low lump sum bid in the amount of $42~452.50 was submitted by
S. C. Rossi & Company, Inc., of Roanoke, Virginia.
Low bidder was contacted, in accordance with the contract
documents, Acceptance of Bids, Paragraphs 14.1 & 14.2, in
order to investigate reasons for the high bid in comparison
to the Engineer's estimate and to pursue means of reducing
the bid to a lower amount.
Results of this investigation indicated that the Engineer's
estimate did not include enough allowance for certain items
of the project. These items were modified to reduce the bid
amount to $35~552.50 in accordance with the confirming letter
from S. C. Rossi & Company, Inc., the low bidder on the pro-
ject. This letter is attached as a part of this report.
II. Issues in order of importance:
A. Compliance of the bidders with the requirements of the
contract documents.
B. Amount of low lump sum bid.
C. Funds for construction.
III. Alternatives are:

Award a lump sum contract to S. C. Rossi & Company, Inc. in
the amount of $35}552.50 and establish a contingency fund for
the project in the amount of $3~555.00.
1. Compliance of the bidders with the contract documents
was met.
2. Amount of low lump sum bid, as modified to compensate
for a low engineer's estimate, is acceptable.
Funds for the construction of the project are available
in the sewer fund together with the participating funds
by the other two property owners involved. The funds
from the property owners should be deposited as revenue
and the total project cost appropriated from Previous
Years' Retained Earnings to an account number to be
established by the Director of Finance.

I. Background:
Roanoke Memorial Hospitals owns the parcel of land on the
southeast corner of the intersection of Jefferson Street and
Yellow Mountain Road, S.E., identified by Official Tax No.
4060601, which is Block 67, Crystal Spring Land Co. Hospital
intends to use it for parking for the Rehabilitation Center and
will also permit use by First Presbyterian Church on Sundays.
II. Current Situation:
Hospital desires to convert old driveway, which enters Yellow
Mountain Road just east of the intersection, into a new walkway
serving the parking lot. This will eliminate the driveway
entrance to the street.
New walkway will connect to Jefferson Street sidewalk by way of
stairs located adjacent to the northerly side of the existing bus
shelter.
Concrete retaining wall for stairway and walk will be necessary
and will extend into the public right of way of Jefferson Street
approximately eight (8) feet (see attached drawing).
D. Encroaching retaining wall requires a revocable license from City
Council before it may be installed.
E. Existing retaining wall around the bus shelter will be used to
tie into the proposed retaining wall.

appropriate City Officials to issue a revocable license with
appropriate liability insurance and indemnification requirements
to Roanoke Memorial Hospitals to permit the installation of a
concrete retaining wall, which will project approximately eight
(8) feet, but not further than the existing retaining wall for
the adjacent bus shelter into the right of way of the east side
of South Jefferson Street. The location is adjacent to the
northerly side of the existing bus shelter located on the
southeast corner of the intersection of South Jefferson Street
and Yellow Mountain Road, S.E. Retaining wall to support access
stairs and walkway to parking lot in Block 67, Crystal Spring
Land Co., Official Tax No. 4060601.
1. Need for safe, adequate pedestrian access to parking lot met.
2. Timing to permit construction as soon as possible is met.
3. Cost to City is zero.
Advantage to Public is alleviation of parking problems around
Rehabilitation Center and the removal of six (6) existing
masonry piers which are close to or on public right-of-way
around the property.
Do not recommend that City Council authorize the execution of
revocable license permitting retaining wall to encroach into
right-of-way of South Jefferson Street.
1. Need for pedestrian access to parking lot is not met.
2. Timin~ to permit construction is not met.
3. Cost to City is moot.
4. Advantage to Public of improved parking situation is delayed.

Dear Mr. Herbert:
I am writing to you on behalf of Roanoke Memorial Hospitals
which owns a parcel of land located southeast of the intersection
of Yellow Mountain Road and Jefferson Street. As has been
previously discussed with various representatives of the City of
Roanoke, Roanoke Memorial Hospitals plan to construct a parking
lot on this property to alleviate some of the parking problems
now being experienced by its employees and visitors to its
Rehabilitation Center. It will also alleviate parking problems
for First Presbyterian Church as the Church will be allowed to
use the lot on Sundays and should generally decrease congestion
in the area.
As part of the construction of this project a 10-inch
concrete retaining wall is planned which will tie into the
current retaining wall around the existing bus shelter located at
this corner. In so doing this new retaining wall will encroach
upon a portion of the City's right of way for Jefferson Street.
A copy of the architect's site detail showing the location
of this wall is attached. In addition drawings detailing the
plans for the entire project have previously been submitted to
Kit Kiser and John Kahn for review.
It is my understanding that before the above encroachment
can be constructed, the City must grant a revocable license
allowing such encroachment. Accordingly, on behalf of my client,

please accept this letter aB our request for the issuance of such
a revocable license.
In considering the issuance of a revocable license, please
note that the retaining wall as planned will not extend any
farther onto the City right of way than the existing walls or'the
bus shelter and will'not present any additional threat to public
safety. In fact, it appears that the bus shelter with its
current retaining walls would be a greater obstacle to any
vehicle out of control than the new proposed retaining wall. We
also would point out that six masonry piers which are currently
on or close to the right of way for Jefferson Street are being
removed as a part of our renovation of this property, thereby
eliminating other hazardous conditions.
I am advised that this matter may need to be considered by
the Water Resources Committee and by City Council. If that is
the case, I would appreciate you forwarding the request to the
appropriate parties in the approval process. In the event that
additional drawings or information is needed, please do not
hesitate to contact me.
I appreciate your assistance in this matter and shall look
forward to working with you and your staff.

A RESOLUTION finding the Mayor to be incapacitated by
sickness, excusing his attendance at Council meetings and
providing for the Vice-Mayor to perform the duties of the

WHEREAS, the Honorable Noel C. Taylor, Mayor, has recent-
ly been hospitalized and has undergone surgery;
WHEREAS, Mayor Taylor has regrettably been absent from
three consecutive meetings of Council;
WHEREAS, §11 of the Roanoke Charter of 1952 provides

Re: Incapacity of Mayor
Dear Mrs. Bowles and Gentlemen:
During the incapacity of the Mayor, it is important that
there be no question as to the authority of the Vice-Mayor
to act on behalf of the City. Section 15 of the City Charter
provides that, during the absence or disability of the Mayor,
his duties shall be performed by the Viee-Mayor. To provide
the appropriate documentation with respeet to the Mayor's
current disability and the authority of the Vice-Mayor, I
recommend to you the adoption of the attached resolution.
The attached resolution makes explieit the authority and
power of the Vice-Mayor to perform all the acts, duties and
powers required of the Mayor during his incapacity. The
resolution also excuses the Mayor from his absences at Coun-
cil meetings.
