Dibling, Jr. City Attorney Roanoke, Virginia Dear Wi l l: I'd like to ask your legal opinion and guidance on the following matter. First, I have received several letters from school students in the Roond<e City School system cor~n~nting on the upcoming city budget. I do not find their letters or c~,~nts to be offensive. In fact, as you know, I welcom~ the expression of our citizens on the upcoming budget process. !~/hat con- cerns rte is that these letters were sent in envelopes with "Crystal Spring School" engraved on the outside. I do object to the use of City property and perhaps postage being used to lobby Council Members. It is not appropriate to use taxpayers' funds to lobby for increases in future expen- ditures. Additionally, I have received on unconfirmed report that an err~loyee of the School Board, in the Central Administration Office, has been spending several hours during the day, while at work, using city telephones, to encourage citizens to co~ out to the public hearing on Tuesday night. Here again, I have no objection whatsoever of hearing public co,truant on the budget. I certainly want to have a good attendance at the public hearing, and to receive the telephone calls and letters of our citizens. However, I am objecting to the use of taxpayers' funds, i.e. e~r~loyees' tir~e and use of city property, in lobbying for certain aspects of the upcoming budget. I am not sure that either o~ these alleged abuses require fore.al investiga- tion. However, I would ask your office to issue a statement of conduct to our city ~vloyees regarding the use of their time and city property for the purpose of lobbying Council Merr~bers regarding the upcoming budget. A RESOLUTION designating the Clean Valley Committee, Inc., to develop a coordinated litter control program for the entire Roanoke Valley and authorizing such Committee to apply for certain grant funds from the Commonwealth for operation of such program. WHEREAS, the City of Roanoke recognizes the existence of a litter problem within the boundaries of this City; WHEREAS, the Virginia Litter Control Act of 1976 provides, the Department of Conservation and Historic Resources, Division of Litter Control, for the allocation of public funds in the form of grants for the purpose of enhancing local litter control programs; and WHEREAS, having reviewed and considered the regulations and the application covering administration and use of said funds; THEREFORE, BE IT RESOLVED by the Council of the City of Roanoke that: 1. The Council endorses and supports such a program for the City of Roanoke. 2. The Council expresses its intent to combine with the City of Salem, Town of Vinton, and Roanoke and Botetourt Counties in a mutually agreed upon cooperative program contingent on approval of the application by the Department of Conservation and Historic Re- sources, Division of Litter Control, and contingent upon the receipt of funds. through 3. The Clean Valley Committee, Inc., is authorized to plan and budget for a cooperative litter control program, which shall represent said program for all localities named in this resolution. 4. Such Committee is authorized to apply on behalf of all of the above-named localities for a grant and be responsible for the administration, implementation and completion cf the program as it is described in Application Form LC-G-1. 5. This City accepts responsibility jointly with the Clean Valley Committee and the City of Salem, Town of Vinton. and Roanoke and Botetourt Counties for all phases of the program in accordance with applicable regulations and the application. 6. This City accepts responsibility for its pro rata share of any funds not properly used or accounted for pursuant to the regula- tions and the application. 7. Taylor, Mayor and Members of City Council Roanoke, Virginia Dear Members of Council: Subject: Renaming of City Public Streets Kimball Avenue/Hollins Road, N.E. Thoroughfare Hollins Road/Read Road, N.E. Thoroughfare I. Back,round: me Kimball Avenue, N.E./Hallins Road, N.E. thoroughfare and the Hollins Road, N.E./Read Road, N.E. thoroughfare both extend in a northerly direction from the U.S. Route 460 East area. Thoroughfares are situated in close proximity to each other, and are both currently designated by dual or multiple street names. Street systems are distinctly separate thoroughfare yet both are currently designated and signed in part as Holl~s Road, N.E. De Portions of both thoroughfares were renamed a number of years ago to coincide with a new road link that was proposed at the time to connect the parallel thoroughfares. Road connector is no longer proposed. II. Current Situation: City Public Works Director recently requested that the Planning Commission review the subject street name systems to determine if the multiple names could be consolidated and simplified by the designation of single and continuous street City Ordinance and Names Subcommittee reviewed the existing street name systems and determined that one single street name should be designated for each of the subject thoroughfares. Roanoke, Virginia 24011 (703) 981-2344 Subcommittee concluded that Kimball Avenue/Hollins Road, N.E. street system within the City and the Roanoke County road system designated as Plantation Road, N.E. were all, in fact, one continuous thoroughfare from U.S. Route 460 East to Interstate 81. Subcommittee also concluded that the original street name of Hollins Road, N.E. should be retained and extended northward to establish a single street name to replace the existing multiple names of Hollins/Read Roads, N.E. Letters were mailed to a number of business concerns situated on both thoroughfares to explain the need for the Subcox~ittee's recommended street name changes and to solicit a sampling of general comments, opinions and suggestions from the residents. Responses received from a number of businesses in the areas were supportive and favorable. Subcommittee's recommendation to rename the above-cited streets was reviewed by the Planning Commission at its regular meeting of April 1, 1987. III. Issues: Street name identification and location - The subject thoroughfares are both currently designated by multiple street names. Street name duplication - Street systems are separate thoroughfares yet both are currently named, in part, Hollins Road, N.E. 911 emergency system - Implementation of the 911 emergency system requires that street names be clarified and easy to locate. Street name continuit~ - Cooperation among the various localities in the naming of streets and roads extending through or serving separate jurisdictions would result in a more efficient street naming process. IV. Recommendation: The Planning Commission, by a vote of 4-0 (Messrs. Buford, Price and Waldvogel absent) recommended to City Council that the following street name systems be officially changed to the following: At That the current street system designated as Kimball Avenue/ Hollins Road, N.E. be changed to Plantation Road, N.E. from U.S. Route 460 northward to the City's north Corporate Limits. That the current street system designated as Hollins Road/ Read Road, N.E. be changed to the single name of Hollins Road, N.E., by extending the name Hollins Road, N.E., in a northerly direction to its intersection with the above recommended Plantation Road, N.E., and thereby eliminating the name Read Road, N.E. A typographical error was found in the Group Care Facility definition on page 8. The term Congregate care facility should be replaced with Group care facility and the term Group home should be replaced with Congregate home. Neither change has an effect on the definition. The RM-3 and RM-4 districts are intended to provide for high population densities in multi-family dwellings in areas of the city where such development is in keeping with the surrounding neighborhood. The RM-4 district is further intended to provide for and encourage the development of multiple-family dwellings near the C-3 Central Business district and to include high rise structures. Sec. 36-145. Permitted uses. The following uses shall be permitted as principal uses in the RM-3 and RM-4 districts: (1) Townhouses subject to the requirements of Section 36-460, et seq. The comprehensive rezoning process we are undergoing now is a result of problems with our present ordinance which is more than 20 years old. First and foremost, the present ordinance is a confusing and often vague and contradictory document. It is a roadblock to revitalization and stabilization of our neighborhoods and makes innovative development difficult. It permits commercial uses to eat away our industrial land and our residential neighborhoods. The process used to get to this point has been very thor~ough and has stressed citizen participation at every step. How we got here: October 1984 April 1985 Citizens conduct land use survey Comprehensive Plan Advisory Committee of 15 persons formed July 1985 City-wide forum held - 200 people in attendance September, October, November 1985 Workshops held on Roanoke Vision September 1985 through September 1986 April 1986 October 15 and November 5, 1986 Ordinance Review Committee met to review draft zoning ordinances Public hearing and adoption of Roanoke Vision Comprehensive Plan Planning Commission public hearing on zoning ordinance December 1986 Public hearing and approval of zoning ordinance by City Council March 1987 Planning Commission public hearing on zoning map Next Steps Immediately Planning Commission will commence a regular review process of the zoning ordinance and zoning map. This will help identify and eliminate any unforeseen problems with the zoning ordinance. This process will be ongoing. September 1987 Neighborhood Planning program initiated in six neighborhoods. Program will provide for a more detailed review of zoning and land use issues. With recjard to the zoninc~ map: There are two types of zoning changes being considered today. The first change is to eliminate "old wood," that is, old zones that have served no benefit, which are now contrary to the City's development policies and that the zoning ordinance has eliminated. This is an essential first step to enacting the new zoning ordinance. In most cases, the proposed replacement zone has a positive economic impact, due primarily to the increased development potential (either greater number of uses, uses more likely to be developed, or more inviting development standards). Second, the proposal includes zoning changes identified in the Roanoke Vision Comprehensive Plan. These are the Neighborhood Preservation (H-2) District and the Neighborhood Commercial (CN) District. Both changes are specifically identified in the Vision. Although we are rezoning less (in terms of areas of the City that are zoned H-2 or CN) than what the Vision ultimately calls for. We have lived a long time with our present zoning ordinance. Much like living with an old car, people tend to ignore the rust and rough spots, and are willing to spend money to replace worn out parts here and there (hang the muffler with clothes hangers, body putty a few holes). But there comes a point when the repair bills are too expensive or come too quickly to keep the old car. We have reached that point with our ordinance. There are new ideas in the ordinance. The Commission recognizes that problems may arise with the transition from old to new and will work to monitor, review and correct those parts of the ordinance that may need adjustment. We are convinced, having reviewed the proposed ordinance for over a year, and after public hearings on the ordinance and map, that the vast majority of citizens support the new ordinance. We have continued to respond to citizens concerns to the last minute, and in fact, altered our recommended map changes to eliminate those areas where there was obvious citizen concern and misunderstanding. The Planning Commission strongly supports all of the rezonings being brought to you today and urges you to adopt these changes so that the new ordinance can take effect and we will no longer be in limbo between the old and new ordinances. Section 36-165 Neighborhood Commercial (CN) - changed to permit the construction of larger buildings without requiring Board of Zoning Appeals approval and to eliminate confusion about the use of existing buildings. 4. Sections 36-165, 36-186 and 36-207 Neighborhood Commercial (CN), Office (C-I) and General Commercial (C-2) Districts - Would now require a special exception permit, granted by the Board of Zoning Appeals for all group care facilities. 5. Section 36-249 Light Manufacturing (LM) District - Building supplies stores and service establishments would now be permitted principal uses provided they have floor areas of at least 20,000 square feet. Office buildings would be permitted by special exception and would also be required to have a floor area of 20,000 square feet or more. o Section 36-254 light Manufacturing (LM) District - Changed to eliminate the rear yard setback (originally 30 feet) except when it's needed to protect an adjacent residential district. City Council endorsed a new zoning ordinance in December, 1986. B. New zoning ordinance cannot be enacted until changes are made to the City's Official Zoning Map. Changes are necessary because: the new zoning ordinance eliminates several zone classifications shown on the Official Map; 2o the new zoning ordinance changes the title of several zone classifications shown on the Official Map; the new zoning ordinance creates several new zones that are called for by the Roanoke Vision Comprehensive Plan. II. Current Situation: Planning Commission held a public hearing to consider 25 rezonings. The public hearing was attended by approximately 160 citizens. Twenty-five people spoke to the proposed zoning changes. Planning Commission withdrew two areas from~consideration for ~ due to the strong neighborhood concern about the · The two areas no longer under consideration are: I. Thirteenth Street, S.E., at Dale Avenue, S.E., and 2. Williamson Road at Tenth Street. Both areas were proposed to be changed from C-2, General Commercial District to CN, Neighborhood Commercial District. However, there was vocal support for this change from the local neighborhood organization and other residents. Two people spoke in opposition to the Neighborhood Preservation (H-2) district. The major concern dealt with the time frame needed for the Architectural Review Board approval. A petition was also presented to the Commission (copy attached) stating concerns regarding the proposed H-2 regulations. Representatives from the Old Southwest and Mountain View neighborhood organization spoke in support of the proposed change. The Mountain View representative also felt the area included in the H-2 District should be expanded to include more of their neighborhood. III. Issues: A. Land use. B. Zoning. C. Neighborhoods. D. Economic development. E. Comprehensive Plan. IV. Alternatives: A. City Council approve the proposed changes to the Official Zoning Map which will enable implementation of the new Zoning Ordinance. Land use will be unchanged. Changes to the zoning map do not a--f?-~t uses that are already legally in existence due to the "grandfather" clause of the new ordinance which states: "Where, at the effective date of adoption or amendment of this Chapter, lawful use exists of buildings or structures, individually or in combination, which use is made no longer permissible under the terms of the Chapter as enacted or amended such use may be continued so long as it is not discontinued for more than two (2) years, and so long as buildings or structures in such nonconforming use are maintained in their then structural condition." Proposed rezonings do not change the general land use pattern (residential, commercial, or industrial) except in situations where the prevailing land use and zoning pattern support a change. Neic~hborhoods will benefit from the proposed changes. The new CN, Neighborhood Commercial district, encourages the creation or preservation of smaller commercial areas within our neighborhoods. The new zone provides standards which emphasize compatibility between the commercial and residential development. The new H-2, Neighborhood Preservation district, will overlay a major portion of the Southwest Historic District now on the National Register of Historic Places. The remaining rezonings will have no significant impact on the neighborhoods since the overall development pattern is maintained. Economic development potential will be enhanced in several cases. In areas where property is proposed to change from Industrial Development (IDM) to Light Manufacturing (LM) the industrial development potential is expected to increase. In a similar situation, where land zoned Industrial Development (IDM) is proposed to be General Commercial (C-2) the development potential is expected to increase because of the commercial nature of surrounding development. In such cases, the market value for the property may also icrease. The remainder of the properties included in the rezoning will experience no immediate change in development potential. The proposed rezonings are the minimum necessary to enact the new zoning regulations, and to enact the Neighborhood Commercial and the Neighborhood Preservation districts which are specifically called for in the Roanoke Vision Comprehensive Plan. City Council deny the proposed changes to the Official Zoning Map, which action will not allow the implementation of the new Zoning Ordinance. Land use would be unchanged. Land use conflicts resulting ri~m existing regulations would continue to occur. ~ classifications would be unchanged. Map designations would continue to refer to the 1966 district regulations. Enactment of new zoning regulations will not be possible until changes are made to the Official Zoning Map. Neighborhoods will be affected. Existing land use conflicts will continue. Neighborhood revitalization and preservation would not be supported. Economic development potentia~ of the subject areas will not be enhanced. Potential jobs and tax benefits to the community may not be realized. Comprehensive Plan will not be followed. Roanoke Vision identifies the proposed changes as the first step towards improved development quality and the resolution of long- standing development conflicts. Denial of the proposed rezoning will serve to delay implementation of the Comprehensive Plan which will ultimately affect the City's quality of life. V. Recommendation: The Planning Commission recommends Alternative A, approval of the proposed rezonings. The Commission voted on each proposed rezoning and in all cases the change was unanimously (7-0) supported. The changes to the Official Zoning Map will enable Council to enact the new Zoning Ordinance. In doing so, Council completes the first comprehensive revision to our land use regulations in 20 years. Preparation of the new zoning ordinance and map has not been carried on in a vacuum. The process has taken almost three years to complete. Discussions of land use regulations, zoning and development review procedures were a major component of the Roanoke Vision process. The revised zoning regulations and zoning map represent the new community attitude towards development which arose from the Roanoke Vision process and which recognize the need to balance the old with the new. W}~REAS, in order to provide revenue for the necessary opera- tion, maintenance and improvement of the Roanoke Regional Airport, Woodrum Field, it is incumbent upon this Council to make, pursuant to §4-3, Code of the City of Roanoke (1979), as amended, appropriate adjustments to charges for the use of its facilities. THEREFORE, BE IT ORDAINED by the Council of the City of Roanoke that effective June 1, 1987, the following fees, rentals and charges, terms and conditions and regulations shall govern use and enjoyment of facilities at Roanoke Regional Airport, Woodrum Field: 1. Fee for use oC field generally by fixed base operators. All fixed base operators, or agents therefor, of aviation businesses and airport bhsinesses or who publicly advertise a business or service as being made available at the airport shall, in addition to other applicable fees, pay a yearly privilege charge of $396.00 for each business, agency or enterprise, which shall be paid on or before the first day of July of each year; provided, that any such operator commencing business on or after January first of any year shall pay one half such charge for the privilege of operating through June thirtieth of such year. These charges may be superseded by special agreements approved by the City Council. Fee for use of field for passenger service by fixed base operators· All owners or operators of fixed base aircraft using the airport commercially involving passenger use shall pay $7.50 per occupant place including pilots in such aircraft, per month. The charge may be superseded by special agreements approved by the City Council. Fee for use of field by temporary transients; commercial. Ail owners or operators of transient aircraft using the airport commercially on a temporary basis shall pay $16.00 per day, or part thereof, for each such aircraft while actively engaged. For transient commercial operations in excess of thirty calendar days, the same fee provided for in paragraph 1 of this ordinance shall apply· 4. Fee for parking or tying down of certain tran- sient aircraft. All owners or operators of transient aircraft not falling within the classifications set out in paragraphs 1, 2 or 3 of this ordinance shall pay a parking charge of $4.00 per day or part thereof to the City for each aircraft allowed to remain parked at the airport, which shall entitle said aircraft to tie-down services if such latter service be requested or required. All other owners or operators of transient aircraft not falling within the classifications set out in paragraphs above referred to shall, if tie- down service be requested or required, pay $4.00 per day or part thereof to the Ci'ty for such ser- vice. Fee for other commercial users. All other non-scheduled commercial air carriers of passengers, mail, express and/or freight, shall pay for each aircraft landing at the airport, on the occasion of each landing, for the use of the runways, ramps, aprons, taxiways, lights and emergency equipment, and the maintenance thereof, $0.65 for each one thousand pounds, or fraction there- of, of the certificated gross rated capacity of such aircraft (minimum charge, $7.00 on all aircraft - 2 - having over two passenger places); all other sche- duled commercial air carriers of passengers, mail, express and]or freight, shall pay for each aircraft landing at the airport, or the occasion of each landing, for the use of the runways, ramps, aprons, taxiways, lights and emergency equipment, and the maintenanee thereof, $0.55 for each one thousand pounds, or fraction thereof, of the certificated gross rated capacity of such aircraft (minimum charge, $7.00 on all aircraft having over two passenger places); provided, however, that the charge established by this paragraph may, by the authorization and approval of the Council, be fixed by contract at rates other than those prescribed by this section with those commercial air carriers maintaining established offices in the terminal building at the airport and those commereial air carriers maintaining established offices at the airport shall have the privilege of paying the total of such charges monthly, no later than the tenth day of the month following that in which such charge was incurred. Such carrier shall submit monthly to the airport manager a written report of each daily landing of each aircraft of the carrier at the airport, and the applicable weight involved. Such other commercial air carriers shall, in addi- tion, pay such parking and/or tie-down charge as is provided for in paragraph 4 of this ordinance. 6. Han~ar and miscellaneous building rentals. Each person using the public address or paging system, now installed in said terminal building, shall pay $14.00 per month for each drop or microphone connection to said - 5 system, required by such person, said microphones and con- nections to be installed and maintained by the City and to remain the property of said City. 10. Fees for use of interoffice communications. Each person using the interoffice communication facili- ties, now or hereafter installed in the terminal building, shall pay $11.00 per month for each interoffice com- munication unit required by such person to be connected to such system, such units to be installed and maintained by the City and to remain the property of the City. 11. Limousine service. Each person operating a limousine service to or from the airport, pursuant to the authority of any certificate of public convenience and necessity granted by the State Corporation Commission, shall pay to the City $12.00 per month, payable on or before the tenth day of each month, for each assigned ready car space, in addition to a monthly charge equal to ten percent of all gross receipts derived from all business originating or terminating at, or attributable to its operations at, the airport during the next preceding month. 12. Automobiles for hire. Each person operating an automobile for hire service at the airport shall pay to the City, in addition to the other provisions of this ordinance, $12.00 per month for each assigned ready car space, in addition to a monthly charge equal to ten percent of the gross receipts derived from all that person's business originating at the air- port. Payment shall be made to the airport manager prior to the tenth of the month preceding supported by a state- ment in writing certified under oath. 13. Land lease. The charge for ground rental of large tracts of unused land at the airport shall be $12.00 per acre per year. Capital improvements and operational expenses are funded by commissions, fees and rental income from businesses, federal agencies and airlines using and occupying airport facilities. Federal and state grants fund approved major construction and maintenance projects with City participation of five to twenty percent. C. Airport operating budget has increased 9% in the past three fiscal years. Maintenance to buildings and grounds has doubled during the same period, from $38,500 in FY 83-84 to $77,500 in FY 85-86. Utilities have increased 16%. Insurance cost has increased 83% in the past three years. Current situation: A. Commissions from other sources such as parking lot, rental car agencies, restaurant, etc., have increased 31% over the past three fiscal years due to a rise in passenger traffic. B. Airport use agreements expire'Jarch31, 1987. Negotiations underway concerning landing fees may also provide additional revenue. General aviation fees can arguably be justified to be raised higher than the 9% CPI due to higher maintenance, insurance, utility costs and market trends. The justification for a lower amount of increase deals with depreciated structure and at least three to five years before substantial improvements are planned under the master plan. III. Capital improvements and operational expenses are funded by commissions, fees and rental income from businesses, federal agencies and airlines using and occupying airport facilities. Federal and state grants fund approved major construction and maintenance projects with City participation of five to twenty percent. Co Airport operatinK budget has increased 9% in the past three fiscal years. Maintenance to buildings and grounds has doubled during the same period, from $38,500 in FY 83-84 to $77,500 in FY 85-86. Current situation: Ao Commissions from other sources such as parking lot, rental car agencies, restaurant, etc., have increased 31% over the past three fiscal years due to a rise in passenger traffic. General aviation fees can arguably be justified to be raised higher than the 9% CPI due to higher maintenance, insurance, utility costs and market trends. The justification for a lower amount of increase deals with depreciated structure and at least three to five years before substantial improvements are planned under the master plan. III. Agreement will be extended for up to a maximum 36 month period ending not later than March 31, 1990, with a 9% increase in rates subject to adjustment after 24 months if desired by either party by giving the other 30 days written notice of intent to negotiate rates or, term will end prior to March 31, 1990, if one of the following occur: Sixty (60) calendar days beyond the date of substantial completion of the new airport terminal building project, as said date is determined by the city's engineer for the project and assuming the airline use space would be eligible for occupancy and operation within that 60 day period with reasonable effort by the airline. 2. Date of issuance of a certificate of occupancy for the airline use space. Agreement extension will also provide for airline space adjustment for cause. III. Issues in order of consideration: A. Commission did not concur in the City Administration's recommen- dation and expressed concern in the reduction of lighting and visibility of the new MALSR lighting system. Airport Manager was requested by the Con~nission to inquire if the present ALSF-1 system could continue to serve runway 33 with modification to existing towers adding frangible bases and if the City could take over operation and maintenance of the system. II. Current Situation: A. Existing liKht lane (ALSF-1). 1. Twenty-eight (28) rigid steel towers on 100 foot centers. First 2,000 ft. have 21 sequenced flashers and all steady burning lights are 300 watt flood lamps. Sequenced flashing lamps are unknown wattage. 3. Forty-nine (49) threshold lights on five foot centers with 220 watt lamps. 4. Installed in 1964-65, system is becoming difficult to maintain due to unavailability of replacement parts. System is operating under waiver by the FAA due to being outdated and non-frangible design. Take over by the City would be expensive and difficult to maintain. Existing towers cannot be converted to frangible bases as the weight and design of the tower would not lessen impact damage to aircraft. Page 2 B. Proposed Light Lane (MALSR). 1. Fifteen (15) aluminum alloy towers on 200 ft. centers that are designed to break away on impact by aircraft. First 1~600 feet have sequenced flashing lights of unknown wattage on eight towers. Steady burning lights are 150 watt spot lamps on remaining seven towers. 3. Eighteen (18) threshold lights on five foot centers with 300 watt lamps. Over 400 MALSR systems are operational at United States airports providing guidance to runway thresholds with minimums as low as 200 ft. National Transportation Safety Board recommends removal of all non-frangible approach lighting structures. (FAA letters dated 12/17/84 and 8/28/85) 6. Present instrument landing minimums would not be affected by new system. III. Realistic appraisal of proposed installation of MALSR system. A. Runway 5 has 3~000 ft. MALSR that has been operating approximately five years. FAA could void existing waiver on ALSF-1 and eliminate instrument approach status for runway 33. This action would limit aircraft IFR operations. Co Lighting specialists in the FAA Airways Facilities Division~ Electrical Engineering Branch, assure that the lower watt lamps used in MALSR systems provide equivalent discernibility with higher watt lamps used in ALSF-1 systems. (See attached letter from ATA dated 2/26/85) Do Shopping mall lighting has not been reported as a problem by pilots. The FAA is confident the new MALSR will not be affected by the lights of the mall or Williamson Road. (See attached letter dated 10/3/85 from Congressman Jim Olin) Compliance with the FAA new standard system, which is one of two approved designs, is to satisfy operational requirements for airports on a national basis. Non-compliance could jeopardize federal funding for the proposed new terminal building and other capital projects defined in the Airport Master Plan for Roanoke Regional Airport. Page 3 FAA has agreed~ as previously reported~ to maintain the 3,000 foot length of light lan~ which is 600 feet more than the standard 2,400 ft. MALSR system. Installation of new system will require approximately five month-:, Lead time to begin construction after approval by City is esti- mated to take a minimum of three months. The approach light system for runway 33 will be out of service for approximately two months during conversion. Also, the minimums for runway 33 will be increased one-half mile during instrument operations. IV. Recommendation is that the Commission concur in the Administration's original report dated December 17, 1986, and recommend to City Council approval of lease agreement for installation of a new MALSR system for Runway 33. This new design will be one of two new standard systems the FAA will operate and maintain on a national basis. National Transportation Safety Board recommends that the FAA remove all non-frangible approach light structures after several major aircraft accidents in aircraft approach zones. Present approach light system is a 3,000 ft. High Intensity Approach Lighting System with Sequenced Flashers, Category 1 Configuration (ALSF-1). Towers are spaced at 100 ft. intervals with 500 watt lamps. Base of towers are non-frangible. Do Proposed approach light system is a Medium Intensity Approach Lighting System with Runway Alignment Indicator Lights (MALSR). The lighting structures will have frangible couplings, towers spaced 200 ft. intervals, lighted with 300 watt lamps. FAA has agreed to keep the 3~000 ft. length of light lane rather than install the standard 2,400 ft. system. This can be contri- buted to City Council's resolution in September 1984, Congressman Jim Olin, and airlines and airline safety organizations expressing concern to the FAA about air safety and approach minimums at Roanoke being compromised if the MALSR was a standard installa- tion. Approach light system is located south of the airport and Hersh- berger Road on 18.4 acres of land that is under lease to the FAA on a rent free basis. II. Issues to be considered: A. Alternatives: Approve proposed lease agreement No. DTFA105-87-L-61166 with FAA on a rent free basis in consideration of benefit to the Roanoke Regional Airport by the operation of the Runway 33 MALSR. Safety of airport operations will be improved with frangible couplings on light towers to lessen resistance on impact. Light lane will maintain its 3,000 ft. length to give maximum visibility in marginal weather. Lower wattage in lamps should not significantly reduce visibility of lights. Construction and operation cost will be funded through FAA facilities and equipment budget. Term of lease is effective December 1, 1986, renewable year to year at option of government until September 30, 2006. B. Do not approve proposed lease agrm~ment. 1. The Federal Aviation Administration (FAA) developed the Approach Lighting System Improvement Program (ALSIP) primarily because of its concern for aviation safety. Since '1965 there have been numerous accidents/fatalities in the United States where approach light supports have been struck by aircraft making approaches or departures. The National Transportation Safety Board (NTSB) issued a recommendation requesting that a program be developed to provide frangibility to the approach lighting system. Since then, aircraft that have struck the low-impact resistant structure installed under ALSIP have incurred only minor damage, no loss of life, and have executed safe landings. Formerly, the Federal Aviation Administration had six types of approach light systems. This variety in design had caused complex problems in the maintenance and operation of the system. Therefore, two designs were selected to satisfy operational requirements on a national basis. The new standards systems are the MALSR to support Category I precision operations, and .the ALSF-II to support Category II operations. An ALSF-I is installed at Roanoke. FAA has no designs or equipment to provide an ALSF-I with inherent frangibility and energy saving features of the MALSR or the AdSF-II. If one could be specially designed it would be unique and unnecessarily expensive. Based on national experience with the MALSR, our technical judgment is that the outdated, non-frangible lighting structure on Runway 33 of the Roanoke Airport should be replaced with the standard NALSR. The MALSR system would not derogate the present Runway 33 ILS minimums, and even though the standard length of the NALSR is 2~00 feet, if required, the system could be extended to 3000 feet. While we can appreciate your concern, please be assured that we are confident that this action will in no way affect the safe operations at this airport. They are confident that the conversion will in no way affect safety. They have also expressed "no comment" about the possible effect the new shopping mall could have on future approaches. Our experience is that where new lighting configurations have caused distractions or problems, they are corrected by angling, shielding or other means. Office of the Council April 22, 1987 Honorable Mayor and Members of Roanoke City Council Roanoke, Virginia Dear Mrs. Bowles and Gentlemen: When I was elected to Roanoke City Council in 1984, the budget for the City was only $103 million. This year the proposed budget is $123 million. In other words, although it took our City 100 years to break that magic $100 million mark, it's now only taken four years for the budget to increase by 20 percent again. In reviewing the 1985-86 budget, I couldn't find any cut backs by then City Manager Bern Ewert. in Bob Herbert's first budget last year, he proposed decreases in the amount of $858,281.00. This year he proposes decreases in the amount of $567,386.00. However, when considering these proposed decreases in relation to the entire budget, we find that the proposed cuts only represent less than .5 percent of the entire budget. Over the last three years the City of Roanoke has spent $353 million and we've cut only $1.4 million, less than .5 percent. Due to the "Reagan Revolution" and a lagging economy, we are faced with a difficult budget this year in the City of Roanoke. We're not alone. I read just recently where the Governor of West Virginia closed state offices for a week in order to save that state $10 million. I'm certainly not proposing that we do this here in Roanoke, but I do think that we ought to consider austerity to be the guiding principle behind this year's budget. In good times in recent years we've been able to spend a lot of money on the City of Roanoke. Now that we are in temporary hard times, it is important for us to "bite the bullet" in order that our government will get along another year until the good times come back. Before we come out for new taxes, I think we need to thoroughly scrutinize the budget. I would not like to have any cuts in the Police Department or Fire Department budgets. ! hope that the Administration will accept this request in the sincere spirit it is given, and that the Administration would not "Johnsonize" the cuts to dramatize the most controver- sial. Just like Proudfoot went through Norfolk and Western Railroad many years ago to cut unnecessary expenses, so to it is important that our own Administration carefully scrutinize their own operations to see what areas can be cut. As I stated above, cutting only .5 percent out of government operations over three years is not an entirely commendable result. This year we have been told that the Administration may have to reduce expen- ditures by 1.4 million dollars to balance this year's budget. I would like to ask the Administration to provide us with a line by line statement identifying the items being withheld from expenditures under this year's budget. I have asked for the last two years for information on City contributions to Regional Agencies. Although I believe the City has been paying more than its fair share, I am still convinced that the contributions of other local governments have been minuscule in this regard. I would respectfully request that the Administration update the information pro- vided to us in this regard over the last two years and provide us some insight into Honorable Mayor and Members of Council Page 3 April 22, 1987 the contributions being made by other local governments. We've heard a lot over the last year about the "magnet affect" of the City of Roanoke in that we attract, and usually provide for the underprivi- leged, poor and needy of all kinds. We must begin to convince our neighbors in the suburbs of their moral obligation to help the City of Roanoke in providing for those who are underprivileged and live here in the Greater Roanoke area. Finally in a recent article about the con- solidated governments in Nashville and Davidson County, Tennessee, The Roanoke Times reported that 10 percent of Administrative expenses had been saved by government merger. I've noticed in the newspaper over recent days that Roanoke County is also suffering budgetary problems just like our City. Why not have the City and County work together to save the taxpayers money for a change? I would ask that the Administration set out a list of budgetary priorities and a timetable by which we can meet with our neighbors to try to cut Administrative expenses. Over the last several days I have had an opportunity to review our school budget proposed by Dr. Tota and the School Board. Like my colleagues, Mr. Musser and Mr. Harvey, I have found the school budget to be perplexing. I am not entirely con- vinced that the School Board rendered a full examination of the budget at their level. At any rate, I believe that it may be necessary to once again categorize the school budget appropriations and there- fore, would ask our expert financial offi- cers and budget team in the City Administration to carefully scrutinize the School Board budget to see whether there are any additional cuts that might be made with regard to Roanoke City Schools. Just as our President must learn to provide for the national defense while at the same time balancing the federal budget, so too Honorable Mayor Page 4 April 22, 1987 and Members of Council is it important that we provide an excellent education for our students while living within our budgetary means here in the City of Roanoke. Our City Manager was quoted in The Roanoke Times on April 20, 1987, as saying, "If the economy had continued to boom, the City's tax revenues would probably have been adequate to meet future needs without the new and higher taxes." I believe, therefore, that the current budget crisis is only temporary and that we must carefully scrutinize our expenditures over the next year in order to keep our budget in line, and yet still provide for the future progress of our City. I would ask that these several requests for information be for- warded to the City Manager and the Director of Finance for report back prior to budget study, and that this matter be placed on the next consent agenda of Council for your concurrence.
