WHEREAS, transmitted posed Fiscal Year Grant Program and and Projected Use by report dated April 13, 1987, the City Manager has to the Council for its review and consideration the pro- 1987-1988 Budget for the Community Development Block the Statement of Community Development Objectives of Funds, and this Council is desirous of approving these documents and authorizing the City Manager to execute them for submittal to the United States Department of Housing and Urban Develop- ment; and WHEREAS, Council was briefed on this matter on April 6, 1987, and conducted a public hearing on it on April 13, 1987, and citizen input was received earlier during hearings on January 20, 1987, and March 12, 1987. Background: Ae City Council was briefed April 6, 1987, on recommended CDBG program including $1,545,000 in new funds from U. S. Department of Housing and Urban Development. B. The CDBG Statement of Objectives should be submitted by May 1, 1987, in order to receive HUD approval of the program by June 1, 1987, to ensure that funds will be allocated before previous year's program expires. Citizen comments, suggestions and proposals have been con- sidered and integrated into the proposal. Do not authorize Cit~ Manager to submit FY 1987-88 CDBG Statement of Objectives to HUD for its review and approval. 1. Impact on communitx development in the City could be negative if programs are delayed or cancelled. 2. Funding would not be an issue. 3. Timing could be a problem if construction projects, acquisitions or staff salaries are delayed. 4. Citizen participation could be negative if concerns of neigh- borhood groups and residents are not addressed. IV. Recommendation: It is recommended that City Council adopt the CDBG Statement of Objectives and budget as recommended by City Manager, and authorize the City Manager to submit the program to HUD for final review and approval, and authorize the City Manager to execute the grant agreement with HUD on behalf of the City. Upon receipt of program and budget approval from HUD, a report detailing the necessary budget appropriations by program and line item, as well as contracts necessary to carry out the FY 87-88 program, will be presented to City Council for adoption. NOTICE TO*THE PUBLIC'*" CITY OF ROANOKE 1987-1988 COMMUNITY DEVELOPMENT PROGRAM PUBLIC HEARING All interested groups and individuals are invited to participate at a public hearing on the 1987-1988 Community Development Block Grant (CDBG) Program for the City of Roanoke on Monday, April 13, 1987 at 7:30 p.m. in City Council Chambers, fourth floor of the Municipal Building. The CDBG public hearing is being held in order to obtain citizens' views and comments on, the Proposed Statement of Objectives and Proposed Use of Funds delineated below. Funds available through Title I of the Housing and Community Development Act of 1974, as amended, are estimated to be es foJJows: ESTIMATED 1987-88 SOURCE OF FUNDS CDBG Entitlement Grant $1,545,000 Program Income $1,632,000 Reprogrammed Funds -0- TOTAL $3,177,000 CDBG funds are made available for the planning and execution of eligible projects and activities where the majority of the funds benefit Iow and moderate income persons. Projects may also aid in the prevention or elimination of slums and blight, or respond to community development needs having a particular urgency. PROPOSED STATEMENT OF OBJECTIVES The City of Roanoke proposes to fund projects that meet objectives in six areas: 1. Housing Revitalization $700,399 2. Contractual Commitments $742,000 3. Employment and Industrial Development $1,392,000 4. Neighborhood Assistance $148,860 5. Community Services $20,000 6. General Administration $173,741 PROPOSED USE OF FUNDS 1987-1988 CDBG PROGRAM YEAR Housing Revitalization: 1. Operation Paintbruah--$31,134--Paint the exteriors of houses of Iow and moderate income families in Belmont, Hurt Park, Gilmer and Villa Heights neighborhoods. 2. Private Rahab Loan program--$40,000--Funds for a loan loss reserve to leverage mortgage revenue bonds for a rahab loan pool for homeowners in Rahab and Conservation areas regardless of income, and Iow and moderate income families throughout the City. 3. Private Loan Subeidy--$50,000--Funds to subsidize rehab loans to Iow and moderate income families in rehabilitation and conservation areas. 4. Critical Home Bepoir--$187,358--Grants and no-interest loans to Iow and moderate income homeowners city wide for critically needed repairs to their homes. Maximum subsidy would be $6,000 with special exceptions up to $8,000 per home. 5. Gaineboro Hooelng Grenta--$90,000--Grants up to $15,000 to Iow and moderate income homeowners in the Gainsboro neighborhood. 6. 304 Fairfex Avenue Roheb--$25,000--Rehab of house at th~s location into apartment for Iow or moderate income family and office for Gainsboro PAC/GNDC. 7. Gelnaboro Vacant House Rahab Program--$16,000--Purchase of one to three vacant houses in the Gainsboro neighborhood for rehabilitation and eventual sale or rent to families regardless of income. Specific houses not yet determined. 8. Houaiog Support Coata--$187,000--Direct support cost for CDBG and other HUD housing programs implemented by the Roanoke redevelopmect and Housing Authority. Loca- tion and benefit are determined by individual projects being implemented. 9. Housing Merketing--$5,000--This activity provides for preparation of informational materials and activities to be distributed city wide to promote neighborhood revitalization generally and housing rehabilitation particularly. 10. Demelition/Se©uroment--$13,000--Funds for demolition and boarding up vacant and hazardous buildings in the conservation and rehabilitation areas. 11. Code Eeforcement--$55,907--Provides salaries and support costs for two building inspectors to enforce the Building Maintenance Code in ail conservation and rehabilitation areas. Contractual Commitments: 1. Cooo-Coia 108 Loan Ropoyment--$530,000--Funds to pay for the third of ten annual repayments to HUD of the $3,015,000 borrowed by the City for the Coca-Cola UDAG project. Of this amount, $400,000 is provided by Coca-Cola's annual repayment of the UDAG loan funds. 2. Deenwood/Shaffer'a Croseing 108 Loan Ropeyment--$212,000--Funds to pay the first of six annual repayments to HUD of the $922,300 borrowed from HUD for the Deanwood Expansion area and Shaffer's Crossing Industrial area. Employment and Industrial Development: 1. Henry Street Revivel--$250,000--Funds will begin improving the landscaping, parking lots, public utilities, and the design and engineering of street and sidewalk Improvements along Fir.~t Street from Wells Avenue to Centre Avenue; and provide for stabilizing the buildings acquired by the RRHA in that area. Jobs will be created for Iow and moderate income persons as well as services provided to the surrounding Iow and moderate income neighborhood. 2. Main Street Coordinetor--$10,000--Matching funds with the Williamsen Road Area Business Association to provide a coordinator to promote the Williamson Road corridor to both local and area businesses. Three new jobs for Iow and moderate income persons will be created. 3. Deenwood Expansion- $75,000- Funds are to cover site development costs in order to make the property marketable to prospective businesses. Project is expected to provide for jobs to Iow and moderate income persons. 4. Market Building Float Loan--$962,000--Short-term interim financing to Downtown Associates as incentive for job creation and retention for iow and moderate income persons. 5. Economic Development Support--$95,000--Funds to pay for direct support costs of the Roanoke Redevelopment and Housing Authority to implement CDBG end other economic development programs. Location and benefit are determined by individual projects being implemented. Neighborhood Assistance: . 1. Roanoke Neighborhood Portnorahip--$34,860--Funds provide operating costs for the 6 year old partnership of neighborhood organizations, private businesses, non-profit organiza- tions and local government. 2. Mini-Grants (category to bo delormined)--$5,000--The Roanoke Neighborhood Partnership awards matching grants to quall6ed neighborhood organizations undertaking neighborhood improvement projects. Grants are on a 4 to 1 match with grants up to $1,800. Location and benefit are determined at time of application from member neighborhoods. 3. Goinaboro PAC Adminielretion --$49,000-- Funds provide for a full-time staff of two for the Gainsboro neighborhood to coordinate citizen input in neighborhood development projects. Community Services 1. Geleeboro Community Sowice~--$20,000--Funds provide for a staff coordinator, supplies and fees for trainers and facilitators for the provision of services to the residents of the Gainsboro neighborhood. Administration & Planning 1, City CDBG Adminielration--$100,741--Funds provide for coordination, monitoring, and support for the overall CDBG program. 2. Roanoke Redevelopment and Housing Auihority General Adminiefredon--$73,000-- Funds provide for salaries and non-salaried expenses related to carrying out the City's FY 1987-88 CDBG program. Of the $3,177,000 expected to be available for activities, $2,740,492 or 86% will fund activities to benefit iow and moderate income persons. During the fiscal year, 87 substandard houses will be improved. BACKGROUND The Fifth District Employment and Training Consortium is currently renting 8,700 square ~eet o~ o~ice and classroom space for $28,800 annually. The $3.31 average cost per square -{~-~t includes employee parking and all utilities, except refuse collection. Janitorial services are not included in the rental agreement. The cost is $6,600 per year. All jani- torial supplies are inclu-~n this cost, except lightbulbs. The City of Roanoke owns the Knights of Pythias building on Campbell Avenue. A small portion of the building is utilized, in the winter months, for administration of the Fuel Assistance Program. The remainder of the building is used as storage by the Finance Department. City Council has returned, to the Consortium, the last CETA cost allocation fee. The funds are being utilized for the Job Training Partnership program's administrative purposes this fiscal year. City Council also granted the Consortium additional funds last year, through an agreement with the other jurisdictions in the Fifth Planning District, by increasing the City of Roanoke's slot level of participants to be served and decreasing the other jurisdictions' by the same number. II. PRESENT SITUATION The estimated fundin8 for the Consortium in the year besinning July 1, 1987, to serve approximately 584 persons, distributed throughout the eight jurisdic- tions, is $1.3 million. The Consortium is projecting an administrative budget deficit of approximately $34,500.00, even with staff reductions of five (5) persons, and a 5% decrease in salaries for remaining staff, in the fiscal year beginning July 1, 1987. This deficit includes the cost of office rental. The Engineering Department of the City has estimated that the Knights of Pythias building can be renovated into suitable office space for $58,500. Almost one-half of the cost, $24,000.0~i-~--for a new air conditioning and heat pump unit. Funds are available for the building's renovation from t-~ndesignated capital fund. The Policy Board members of the Fifth District Employment and Training Consortium have agreed to enter into a contract with the City of Roanoke. The contrac- ted agreement increases the level of services to Roanoke City residents and reduces service levels to the other seven jurisdictions. The City, in exchange, will provide one year's office space to the Consortium. The contract will be reviewed, for continuation, by both parties on an annual basis. The Fifth District Employment and Training Consortium will, in all probability, cease to exist sometime in FY 1987 if a contractual agreement is not approved to provide for office rental, or additional funds are not secured. W./Gainsboro Road. I. Back~round on this subject is: Thoroughfare Element of the City's 1995 Comprehensive Plan was adopted by City Council with Resolution No. 23524 on March 14, 1977. Priorities No. 5 and No. 6 listed in the Thoroughfare Element indi- cate the need for "improvement of the Loudon-Wells Avenue corridor from Commonwealth Avenue to Tenth Street, N.W." and "improvement to the Franklin Road - 3rd Street corridor from Elm Avenue to Loudon Avenue with a new bridge", respectively. Loudon-Wells Avenue corridor no longer exists in its entirety due to the Wometco Coca-Cola development. However, there continues to be a need to widen and realign the Wells Avenue segment from Williamson Road to First Street (Henry Street), N.W. North-South corridor would begin near the intersection of Gainsboro Road and Madison Avenue (0.3 miles north of Wells Avenue), then proceed in a southerly direction to Wells Avenue and continue along First Street, N.W. to Centre Avenue at the north end of the First Street Bridge over the Norfolk Southern Railway, for which a bridge replacement project has previously been requested for programm~ing in the Virginia Department of Transportation Six-Year Improvement Program (by City Council on April 28, 1986, Resolution No. 28109). See attached map. Wells Avenue between Williamson Road and First Street, N.W. is approximately 0.3 miles in length. The 1995 Thoroughfare Plan indi- cates that this segment is to be widened to a pavement width of 48 feet within a 70-foot right-of-way. North-South corridor between Madison Avenue and Salem Avenue is approximately 0.5 miles in length. Segments of this corridor would likely require 48 feet of pavement in a 70-foot right-of-way. Improvements would include the creation of left turn lanes, which would be necessary to minimize traffic delay at this intersection and to encourage the use of this North-South corridor. G. Tenth Street Widening from Gilmer Avenue to Williamson Road, N.W. (updating survey data). 5. Thirteenth - Ninth Street from Orange Avenue to Dale Avenue, S.E. (none). 6. Hershber~er Road Extension from Williamson Road to Orange Avenue (alignment study in progress). 7. Fifth Street Brid~e replacement over NS Railroad (none). 8. First Street Brid~e replacement over NS Railroad (none). 9. Wonju Street Extension from Colonial Avenue to Brandon Avenue (none). Presently, each of these projects have been listed or are likely to be listed in the VDOT's upcoming Tentative Six-Year Highway Plan. Page 3 II. Current situation on this subject is: Funding amounts for other City highway projects are projected in the Virginia Department of Transportation's Six-Year Improvement Program to be $6~414~000.00 for fiscal year 1987-88. This would likely include all projects previously requested for programming as pre- viously listed above. The remaining five years of the Six-Year Improvement Program are projected to be funded at $6~000,000 each. The City's 5% share (approximately $300,000 each year) is not funded. It is intended that the City's 5% share for these projects would be included in the City's next Capital Improvement Program. The funding of the next Capital Improvement Program is contingent upon the approval of future bond sales. Widening/realignment of the subject roadways is desired at this time to improve traffic movements along this northern entranceway to Downtown Roanoke, serving to relieve other northern entranceways (Fifth Street corridor and Williamson Road corridor). Existing First Street, N.W./Gainsboro Road roadway system is not efficient and has the potential to provide access to a significantly greater number of vehicles by such widening/realignment. Costs associated with subject roadway improvements is estimated at $6~000~000.00 (does not include previously requested First Street Bridge Replacement, which is estimated at $1~000~000.00). Of these totals, Federal and State urban funding would pay for 95 percent of the pro ject cost ($5,700,000.00). City share would be only five percent ($300~000.00). Funding for the City's 5% share would have to be made available in the Highway Construction Fund at the time of construc- tion, with funding intended to come from the next Capital Improvement Program, which is contingent upon the approval of future bond sales. City Council would need to take formal action before the April 22, 1987 Preallocatlon Hearing to allow this project to be requested at that time, or by April 30, 1987, in order that written comments can be sent to Virginia Department of Transportation for their use in developing the Six-Year Improvement Program for fiscal year 1987-88. B. In January 1982 the Department of Agriculture once again encouraged localities to distribute Surplus Commodities. Roanoke City agreed to participate. 1. January 1982 Cheese was distributed on a quarterly bas is. 2. December 1982 Butter was added. 3. May 1983 Nonfat Dry Milk was added. 4. September 1986 Cheese, butter, nonfat milk, flour, cornmeal, rice and honey were made available for distribution. C. Documentation of distribution of these 7 foods has increased in complexity. We have progressed from a simple system of punching a hc%e in the Food Stamp ID card to signify program participa- tion to setting up individual record cards on each household to ensure accountability. Current situation on this subject is: A. Barricade consisting of concrete planters was put in place on March 25, 1987 to put this closure into effect. Letter dated January 28, 1987 (attached) has been received from The Snyder-Hunt Corporation, regarding their Westwind Apartments which are located on Coveland Drive between Ferncliff Avenue and Hershberger Road. They request that they be allowed to temporarily install a fence across Coveland Drive (referred to on their letter as Ordway Drive) adjacent to and in conjunction with the City's tem- porary street closure. Page 2 C. Fencin~ across Coveland Drive would link together the existing fence that partially encloses the entire Westwind Apartment Complex. This would serve to further improve security at the apartment complex by diminishing the unlawful acts of vandals that pass through the apartment complex on foot. III. Safety at the Westwind Apartment Complex will be further enhanced due to the diminished foot traffic, some of which has presumably been responsible for vandalism at the apartment complex. Pedestrians who have lawfully used Coveland Drive to access the opposite side of Hershberger Road do have alternate access along Ferncliff Avenue. A benefit to using Ferncliff Avenue is that the west side of the street does have new sidewalk, whereas Coveland Drive has no sidewalk. Timin~ of the fence installation is appropriate inasmuch as it coincides with the City's barricade installation. Removal of the fence would coincide with the removal of the City's barricade. 4. Installation of the fence across Coveland Drive would need to be done in a manner acceptable to the City. The Snyder-Hunt Corporation will be required, as a condition to the granting of the license, to indemnify and save harmless the City, and to insure the City from general public liability in an amount of not less than $300~000.00 for combined bodily injury liability, including death, and property damage liability for any one occurrence. Yellow Cab Company of Roanoke, Inc., organized in 1933, is the primary provider of taxicab service within the City of Roanoke. Yellow Cab Company of Roanoke, Inc. has been issued a Certificate of Public Convenience and Necessity. Section 34-97 of the City Code requires that no Certificate previously issued shall be transfer- able, except by ordinance of the City Council based on an investigation by the City Manager regarding the character and qualifications of the applicant transferee. CURRENT SITUATION A. March 17, 1987, the City Manager received a a request to transfer the Certificate of Public Convenience and Necessity which is currently assigned to the Yellow Cab Company of Roanoke, Inc. to a newly created, wholly-owned subsidiary of Yellow Cab Company of Roanoke, Inc. to be named the Yellow Cab Services of Roanoke, Inc. Yellow Cab Company of Roanoke, Inc. operates a taxicab service as well as a rental car business under one corporation. For insurance purposes, the creation of Yellow Cab Services of Roanoke, Inc., would allow the owners to differentiate the taxicab operations from their rental car business. Effect on Existing Taxicab Services - There would be no effect on existing taxicab services. The level and scope of operations would remain the same. Qualifications of operator - The applicant transferee, Yellow Cab Services of Roanoke, Inc.is a wholly-owned subsidiary of Yellow Cab Company of Roanoke, Inc. This subsidiary will be managed by the same officers and Board of Directors. Operational procedures, rate schedules, financial ability, etc. will not change. This taxicab service has pro- vided service in Roanoke since 1933. Do not grant permission to transfer the Certifi- cate of Public Convenience and Necessity from Yellow Cab Company of Roanoke, Inc. to Yellow Cab Services of Roanoke, Inc. (a) The City manager is appointed agent of this City to examine and determine a person's qualifica- tions for certification under this chapter to engage in plumbing, electrical, or building-related mechani- cal work in this city, either as a journeyman or master. In his examination and determination, he shall employ the standards promulgated by the State Board of Housing and Community Development to deter- mine an applicant's ability, proficiency and quali- fications. (b) No person certified pursuant to this chapter shall be required to obtain such certification if he has been so certified by any other county, city or town. (c) No person shall be required to be examined or certified under this chapter if such person was certified or licensed prior to July 1, 1978, in accord- ance with the applicable provisions of any Virginia local governing body or of the commonwealth. (d) The powers, duties and functions of the City Manager in addition to those specified in the other sections of this chapter, shall be as follows: (~) The City Manager shall issue plum- bers' electrical contractors' electricians' and building-related mechanics' certificates of qualifi- cation to such persons as may be en- titled thereto and conduct examina- tions for the purpose of determining the competency and knowledge of per- sons who are required to possess such certificates. He shall refuse to grant a certificate to an appli- cant found not to be so qualified. (2) The City Manager shall maintain an accurate report of all examinations given and certificates issued or re- fused. (3) The City Manager may adopt such rules and regulations as he sees fit for the proper and efficient discharge of his duties hereunder. (4) The City Manager shall have the power, after hearing, to revoke any certifi- cate or qualification issued under this chapter when the holder thereof: Proves himself, by his work, incompe- tent and unable to meet the standards of work prescribed by this chapter; Permits his name to be used by any other person, directly or indirect- ly, to obtain a permit; Permits any work for which he has been certified under this chapter to be done under his name, license or bond by any other person who is not his bona fide employee; Obtains a permit for any person to do work in this City for which he has been certified under this chapter, when such person is not a bona fide full-time employee of such holder. §7-6. Criminal Penalty. Each violation of any provision of Article III, Plumbing, Work, Article IV, Electrical Work, or Arti- cle V, Building-Related Mechanical Work, of Chapter 7, Building Regulations, Code of the City of Roanoke (1979), as amended, shall constitute a Class 3 misde- meanor. BE IT FURTHER ORDAINED that a new Article V, Building-Related Mechanical Work, be added to Chapter 7, Building Regulations, Code of the City of Roanoke (1979), as amended, to read and provide as follows: ARTICLE V. BUILDING-RELATED MECHANICAL WORK §7-113. Definition. For the purpose of this chapter, the term "build- ing-related mechanical work" shall mean the performance of building-related mechanical work, including heating, air conditioning, ventilation and gas piping. §7-114. Qualifications of Building-Related Mechani- cal Workers. No person shall engage in the business of building- related mechanical work, or hold himself out to the pub- lie as being engaged in such business, until he has passed an examination given by the City Manager or has had issued to him a certificate of qualification, which shall not have expired. Applications to take such examination shall be made to the City Manager, accompanied by such fee there- for as may be prescribed by City Council. §7-115. Bond required. Every building-related mechanical worker required by §7-3 to give a bond to the City shall do so in the sum of five thousand dollars ($5,000.00), with some surety company authorized to do business in the state as surety, and conditioned to indemnify and save harmless the City, as well as any other person, from all expense or damages that maybe caused by any negligent, defective or inade- quate work done in the City under contract that such per- son may undertake. Background: Existing regulations under Chapter 7 of Roanoke City Code requires bonding and certification of plumbers, electrical contractors and electricians to guard against defective or inadequate work by these contractors. B. Bonding and certification of building-related mechanical contractors has not been required. Ce Standards for local certification of plumbers, electricians and building-related mechanical workers was adopted by the State Board of Housing and Community Development effective April 1, 1986. D. Testing of Plumbers and electricians was administered by City Building Department for the following fees, until September 1986; 1. Electrical contractor - $30 2. Electrical journeyman - $15 3. Master plumber - $30 #. Plumbing journeyman - $15 Approximately 35-#0 tests were administered by the City Building Department annually, bringing the City approximately $800-$1000 in fees. II. Current Situation: Mechanical contractors are presently licensed and bonded as if they were building contractors, but are not tested for competency to practice . Since September 1986, certification tests have been administered by the Virginia Department of Housing and Community Development. Localities in Virginia use these tests, including for mechanical contracting, for all building trade certifications. The State charges fees to contractors to take these tests. C. City no longer administers the tests~but only certifies that contractor is qualified to take examination. April 6, 1987 Page 2 III. Issues: Local standards for bonding and certification of building-related mechanical contractors and adoption of reasonable fees for all plumbing, electrical, and mechanical contractors need to be established consistent with state standards. A. Sufficient bond to protect City and clients of contractors. B. Proficiency and qualifications of mechanical contractors. C. Reasonable local fees IV. Alternatives A. Authorize the amendment of Chapter 7 of Roanoke City Code, to.' -Set amount of building-related mechanical contractors, bond at $5~000, -Provide for testing and certification of building-related mechanical contractors in accordance with the standards promulgated by the Department of Housing and Community Development; and -Amend the City's fee compendium to establish a uniform $10 fee for the testing of all contractors, including building-related mechanical contractors. Sufficient bond and surety to protect the City and others from defective or inadequate building-related mechanical work performed by contractors in the City would be achieved by $5000 bond requirement, which is the same as required of plumbing and electrical contractors. Proficiency and qualifications of building-related mechanical contractors would be assured by testing and certification of qualifications to perform such work. Local fees of $10 to certify eligibility to take exam would be reasonable, considering the minimal time required of Building Department staff. The proposed fees would total $350-400 yearly, in place of the $800-1000 currently collected by the City for tests it no longer administers. B. Do not authorize the Amendment of Chapter 7 of Roanoke City Code to provide for bonding and certification of building-related mechanical contractors, and establishing certification fees for plumbing, electrical and mechanical contractors and workers. Proficiency and qualifications of mechanical contractors would not be assured because testing and certification would not be required. Local fees currently charged for plumbing and electrical contractors is excessive because of the negligible time required to administer the City's portion of the certification for the different trades. v. Recommendation: Concur in Alternative A, thereby amending Chapter 7 of Roanoke City Code to: A. Set amount of building-related mechanical contractor's bond at $5,000; Provide for testing and certification of building-related mechanical contractors in accordance with standards promulgated by the Virginia Department of Housing and Community Development; and C. Standard easement should be retained for any private utilities that may be situated in the alley right-of-way. Relationship to the Comprehensive Plan: Applicant's request is consistent with the intent of the Comprehensive Plan that available land be used in the most appropriate manner. Alley has remained undeveloped and unneeded for public use for many years. City has not current or future plans to utilize this alley section. Adjacent property owners could utilize the land within the alley right-of-way in a more efficient manner. IV. H. leases the parking area between the hospital and Jefferson Street from the City for $1.00 per year. This lease was authorized by Ordinance No. 12823, dated September 4, 1956, for a period beginning September 1, 1956 and ending September 1, 1958 and automatically renewing for yearly periods thereafter. City's interests in the area are to protect Crystal Spring and its associated water production facilities, including the parking lot, which is intended to provide an area for the future expansion of those facilities and, in addition, to control and protect the phy- sical appearance, including landscaping, of this City-owned property. Lease of property to R.M.H. stipulates that no parking area shall be closer than five (5) feet from the trunks of the trees surrounding the parking area, and that R.M.H. shall maintain the pavement, grass and shrubbery on the premises. There is also pro- vision for the installation of a bus shelter on the site. II. Current Situation Hospital desires to make certain revisions to its property on the south side of the City-owned parking area, and, in conjunction with those developments, alter the traffic flow and configuration of the parking lot itself (see attached map and letter). City Council is requested to approve the proposed changes as they will cause the removal and replacement of several large trees and all other landscaping elements. The plan also includes a covered, drive-thru patient entrance canopy over City-owned property in front of the main entrance to the hospital. III. IV. City Administration desires that all improvements be coordinated through the City Horticulturist an employee in the Grounds Maintenance Department, and further, that Paragraph 5,h of Ordinance No. 12823 leasing the property to R.M.H. be revised to apply to disturbances to the area by the City for access to any public utility lines needing maintenance. The main reasons for the alterations and improvements are to improve the traffic flow situation through the lot and at the hospital entrance, provide a covered, drive through, patient drop-off canopy, implement a comprehensive flood control system, and improve and upgrade the landscaping and thus enhance the overall appearance of the Hospital and City property. All of the costs of proposed improvements and upgrading on City property would of course be incurred by Roanoke Memorial Hospitals. In addition, your letter of November 6, 1986, also stated that we will need to request a waiver from City Council of the Lease Provision No. 5,c that prohibits parking areas from being closer than five (5) feet from the trunks of trees on the site. We propose, on the recommendations of our landscape architect, due to the age and condition of the existing trees, to completely replace and upgrade all of the landscaping as indicated on the landscape plan with no mixing of the old and new. In the final analysis the Board of Zoning Appeals used the new zoning law, not yet passed by council, to justify this action. We were told, at the hearing, by Ron ,~iller and Bill Backworth that t:,e proposed facility would be in a different classification of permitted uses, not a special exception, under the new law, and it would not be subject to the 1500 foot limitation, or a hearing before the Board of Zoning appeals. This new classification was a "Nonprofit counseling facility and related services". This is a new classification in the new law unknown to me, and not previously identified in any published document or public hearing held on this subject. On the next day, Wednesday, April 8, neither 8ill Hackworth nor 3ohn:4errithew of the Planning Department produced for us any documentation or memos relating to its addition beyond hand written additions to copies of the new law in their possession. My wife, 2oel Richert, talked to both during the week pzior to the hearing, about classification of this facility under the old and new law, arid no mention was made of this addition to the new law. Luring ttmt same week an inguiry on the matter to Ron 4iller in the Building department were referred to Bill Hackworth. It has been many years since I have Peen dealt with by tie City administzation with such dcDlicity. I believe the City has a serious problem, and the following action is called for: If Council was serious about enforcement of the current zoning law section 36-140(7), you have no choice but to challenge the April ?th action by the Board of Zoning Appeals. I am convinced that the conditions by which such a variance may be granted, as set forth is section ~6-~1, have not been met, and that such a challenge would be successful. Council should pass the new zoning law excluding any changes that have not been subject to full public disclosure and review in public hearirgs. The events of the past two weeks preclude use of the term "technical corrections" to describe changes, not exposed to the public, that are to be included. Robert N.
