CREATION AND PURPOSE: The Industrial Development Authority of the City of Roanoke, Virginia, is a political subdivision of the Commonwealth created by the Council of the City of Roanoke on October 2], 1968, pursuant to Chapter 33, T~tle 15.1 Code of Virginia (1950), as amended (Industrial Development Revenue Bond Act). The Authority promotes industry and develops trade by inducing manufacturing, industrial, governmental, and commercial enterprises to locate or remain in Roanoke. To this end, the Authority issues low-interest, tax-free industrial revenue bonds to acquire and improve property and equipment which is then sold or leased to the enterprise at terms necessary to retire the financing. 2. SUMMARY OF SIGNIFICANT ACCOUNTING POLICIES: The financial statements have been prepared on the modified accrual basis under which revenues are recorded when received and expenditures are recorded at the time the liabilities are incurred. 3. LIMITATION OF LIABILITY AND EVENTS OF DEFAULT: The Authority has issued revenue bonds and notes to acquire and finance improvements of property and equfpment which are immediately sold or leased. The notes and bonds, as to principal and interest, are payable solely from lease payments or payments on notes receivable. The long-term leases are essentially sales agreements as the lessees have a bargain purchase option to acquire the property at the expiration of the lease. The Authority does not reflect in its accounts any incidences of ownership in the properties. In the event of default by the lessee or note makers, the holders do not have recourse from the Authority, but must obtain indemnity from the lessee, note maker or by sale of the property. Bonds and notes issued pursuant to the provisions of the Industrial Development and Revenue Bond Act are not deemed to constitute a debt of the Commonwealth or any political subdivision thereof, and are guaranteed by the Authority only to the extent of revenues and other security pledged under the terms of the individual agreements. However, the Authority and the City of Roanoke, Virginia may choose at their option to assume responsibility for the debt issues in the event of default to preserve the credit rating of the Authority for future issues. The BFP partnership project is currently in default due to the delinquent status of the note. Collection efforts are being pursued by the noteholder and the ultimate outcome of these efforts is not determfnable at this time. Two of the four partners have filed for liquidation as individuals in U.S. Bankruptcy Court. 4. REVENUE BONDS AND NOTES: As of June 30, 1986, the Authority has issued and outstanding $182,858,781 of Industrial Development Revenue Bonds and Notes, pursuant to Chapter 33, Title 15.1 of the Code of Virginia (1950), as amended. These debt issues are not included in the accompanying financial statements since the Authority ia not liable for their repayment, as discussed in Note 3. Taylor, Mayor and Members of City Council Roanoke, Virginia Dear Members of Council: Subject: Annual Report 1986 Work Program 1987 By authority of the full Commission, I am pleased to forward to you the Annual Report and 1987 Work Program for the Commission and Planning staff. 1986 has been an extremely productive and demanding year for both the Planning Commission and its support staff. We have accomplished much with the adoption of the Comprehensive Plan and the new Zoning Ordinance. Early in 1987 we expect to bring the new zoning map and then subdivision regulations to you. As you will see in the annual report, the Commission reviewed almost twice as many rezoning requests in 1986 as in 1985. Alley closures remained about the same, but subdivision requests increased by almost 40%. In addition, approximately 80 site plans were reviewed by staff. This activity indicates a continuing healthy development environment in the City which shows no sign of abating in the near future. This will include not only the new zoning map and subdivision regulations but also the establishment of neighborhood plans on a timely basis. Because of the success of the efforts so far, we feel it is imperative to build on the momentum we have going now. The citizens need to know the Comprehensive Plan we have put so much effort into is not going to be put aside. Taking this into consideration, along with the increased routine work caused by development demands within the City (rezonings, site plan review, etc.), the Planning Commission feels that an increase in Planning staff is essential. We strongly urge extra funds to enable the Office of Community Planning to carry out the detailed planning called for in the Comprehensive Plan and to keep the momentum in the neighborhood groups (both business and residential) going. Finally, I would like to commend the Commission members and staff support (including Bill Hackworth of the legal department) for all the many extra hours of work that were given to make the Comprehensive Plan and Zoning Ordinance a reality. The staff, faced with the absence of a director and an increased daily workload in addition to these demands, put in countless overtime hours and are to be commended for their efforts. Roanoke Vision provided new direction to guide the City's continued growth and revitalization and established a noteworthy public participation process for citizen involvement and input. Revised Land Development Regulations Significant changes to the City's zoning and subdivision regulations had not been made since 1966. The objectives and action strategies established in the new comprehensive plan required major revisions to ~he existing regulations. A new zcning ordinance was written and was recently approved by City Council with strong community support. Revisions to the land subdivision regulations currently are under review. Rezonin~/S~ree[ Closures/Subdf%isi3n Review A more detailed description of the rezoning and street closure requests heard by the Commission is attached. The Commission reviewed 40 rezoning requests in 1986, almost twice that reviewed in 1985, and 14 street/aiie7 closures. Seventy-one subdivision requests totalling 311 acres were reviewed, which represented almost a 40% increase over 1985. Coordination of Land Development Boards Two Planning Commission members served on the City's Architectural Review Board for 1986. The Commission's staff also assisted the Board of Zoning Appeals in 1986 in their review of special exception permits and other issues involving community plannin8 and land use. City Council's adoption of the Plan in April, 1986, included the establishment of a Five-Year Action Schedule which sets out specific planning and development activities aimed at accomplishing the objectives of the Plan. The ultimate success of Roanoke Vision, despite the awards and national recognition it has received, will depend on the degree to which it is implemented and utilized as a mechanism for future growth. The Planning Commission is recommending that the planning activities outlined on the following pages be incorporated into the City administrations work program for 1987. These activities do not represent the complete Five Year Action Schedule. They include those, such as the neighborhood action plans, which will require a full five years to complete, which are on-going activities, or which are necessary to maintain the public support and energy ignited by the Roanoke Vision process. I. ON-GOING PLANNING COMMISSION ACTIVITIES Preparation of revised zonin~ ordinance and map. Text is complete except for minor changes and the map is at the staff review stage. Enactment of the ordinance should occur in - February or March. Preparation of revised subdivision ordinanc.. Text is at the staff review stage. Planning Commission review may commence in February. Review of rezonin~ petitions. Approximately 40 such petitions are expected during 1987. Review of street and alley closure applications. Based on past years, 15 to 20 such applications are expected. Subdivision reviews. Based on past trends, approximately 75-100 subdivision plats will require review. Site plan review. Approximately 80-100 such reviews are anticipated. G. Review of street name change applications. Liaison with adjoining municipalities. At least one joint meeting of local Planning Commissions should be held. Staff continues to work with other jurisdictions on an informal basis on such items as rezonings, street names, and other issues as they arise. Respondin8 to inquiries and requests for service, Staff will continue to spend a large portion of time responding to interdepartmental requests as well as citizen requests for information and assistance. II. ACTIVITIES ARISING FROM THE COMPRRW~wSIVE PLAN A. NEIGHBORHOOD PLANS ~ 1. Objectives me To implement the Roanoke Vision comprehensive plan neighborhood planning program. To regenerate neighborhood esteem and energy necessary to facilitate neighborhood self-help activities. Ce To identify and resolve land use and zoning issues in a comprehensive and participatory manner. To provide detailed capital and operating "needs" information in each neighborhood. To identify "self-help" opportunities in each neighborhood. 2. Process The process would entail our typical three or four workshop process which has proven successful in other areas (four workshops may be necessary in neighborhoods which are not organized). Citizen participation would include discussion during workshops, seeking participants prior to the workshops and verifying or gathering background data between workshops. Process would result in the following: a. Recommended zoning changes. Land use policies pertaining to rezonings and development issues. Recommended capital improvements, and/or "self-help" activities to be initiated by the neighborhood group. 3. Time Frame In order to complete 45 neighborhoods in the five year time frame considered in Roanoke Vision (1990), ten neighborhood plans must be completed each year. (This assume~ combining some neighborhoods.) Each neighborhood process will require approximately 12 weeks. Overlapping of the workload is essential. 7 B. IMPROVE ADMINISTRATIVE PROCESS 1. Objective me To ensure that the efforts of the Architectural Review Board (ARB), the Board of Zoning Appeals (BZA), and the Planning Commission (PC) are coordinated and in general compliance with the Roanoke Vision Plan. To offer developers, homeowners and other petitioners a coordinated and efficient review process. To offer the ARB and BZA improved levels of staff support. 2. Process Open discussions among all boards and commissions to identify issues and opportunities related to administrative procedures. Establish regular meetings between the Planning Commission, Architectural Review Board and the administrative staff. Enact changes in staff procedures to align them with any agreed upon changes. 3. Time Frame This process should be implemented immediately upon adoption of a new zoning ordinance and map. The process could be initiated in a series of two or three workshops designed to identify and resolve problems within the present administrative structure, establish goals and take advantage of any opportunities. These workshops would result in a strategy that could then be implemented by the Boards and Commission. Thereafter regular meetings of the ARB, BZA and PC could be scheduled to provide regular review and adjustment as may be necessary. C. PUBLIC EDUCATION 1. Objectives ao To facilitate public acceptance and understanding of new land use ordinances. io improve private/public relations relative to development. 8 c. To encourage faster and more comprehensive review of proposed development. 2. Process Conduct seminars with real estate, legal and development representatives and other interested groups. Prepare Zoning Handbook and development pamphlets for distribution. Continue to offer staff as speakers to organizations throughout the City. 3. Time Frame This process should be implemented immediately. The initial activity will be completion of the Zoning Handbook which is already in draft form. Thereafter pamphlets can be prepared on general or specific topics (zoning, subdivision, development plans, non-conforming uses, etc.) D. COMPONENT PLANS 1. Objectives To ensure that utility, transportation, airport plans and other similar planning efforts are carried out within the framework established by the goals established in the Comprehensive Plan. To better coordinate the provision and operation of city services and facilities. To coordinate the various planning efforts of city departments with the neighborhood planning program. 2. Process The component planning process should be initiated by the relevant city department with participation of the Planning Commission and planning staff. 3. Time Frame Several planning efforts are presently underway in the City: transportation, sewage treatment plant facility improvements, housing for the homeless, etc. The Comanission should undertake to become informed and involved in these planning programs as soon as possible. E. ORDINANCE REVIEW 1. Objectives me To ensure the functional integrity of the zoning and subdivision ordinances. be To eliminate any problems arising with the administration of the ordinances. Process The ordinance review process would entail a regular schedule of staff reports concerning any possible problems with the ordinance and regular Joint workshops with the Planning Commission, the Architectural Review Board and the Board of Zoning Appeals. Such meetings could identify possible issues such as trends in variance requests. 3. Time Frame This review process and, specifically the monitoring of development activities should be initiated immediately. Joint meetings of the Commission, ARB and BZA should occur approximately six months after ths new ordinances are enacted and should be held regularly thereafter. 10 III. PARTICIPANTS Office of Community Plannin~ is identified in the Comprehensive Plan as the City department responsible for all the activities outlined in the Five-Ysar Action Schedule except the component plans program. As such, the Planning staff will be responsible for providing logistical support such as clerical, graphic, and supervisory assistance; and planning expertise including data collection and analysis, report preparation, and mesting facilitation. Planning Commission involvement on specific activities will vary but overall the Commission will act in its capacity as an advisory body to City Council. The Commission will serve as liaison between City Council and those groups involved in each activity; attempt to coordinate the various planning activities with each other and the objectives of the Comprehensive Plan; and maintain a high public profile for the Five-Year Action Schedule. Other City departments will be needed in two cases. During the neighborhood planning process, City staff from various departments may be needed to provide background data and expertise related to their specific field. Component plans are to be prepared by the department most heavily involved with that particular component (utilities, sewage treatment, social services. . .). The City Manager and the City Clerk are authorized to execute and attest, respectively, on behalf of the City, the appropriate agreement with the Norfolk Southern Corporation, in form approved by the City Attorney, providing for installation of a storm drain crossing located on Norfolk Southern Corporation property for the Whitmore Avenue Storm Drain Project, said agreement to provide for relieving the railway of all expense and legal liability for the crossing, as this Council dated February 17, 1987. 2. In order to provide for the set forth in the report to usual daily operation of the municipal government, an emergency is deemed to exist, and this ordinance shall be in full force and effect upon its passage. Background: A. Whitmore Avenue Storm Drain was designed to alleviate a drainage problem in a low area in and around the railroad siding in the alley east of Whitmore Avenue. The standing water creates a problem for vehicles entering Virginia Scrap Iron and Metal Co. and Roanoke City Mills. The proposed storm drain will be constructed by the City of Roanoke Utility Lines Department. The estimated cost of materials for this project is $2~200.00 and funds are available in existing operating accounts. B. Norfolk Southern requires a signed agreement with the City of Roanoke relieving them of all expense, legal liability for the crossing and assurance that no interference will result to the maintenance or operation of the railway. There will be no cost to the City by Norfolk Southern for this crossing agreement. C. Background on this subject is: Major snowstorms occurred in the Roanoke Valley on January 22, 1987, and again on January 25/26, 1987. These two storms deposited nearly twenty-five inches (25") of snow accumula- tion at Roanoke Regional Airport. B. In all of 83-84, 84-85, and 85-86, only twenty-six inches (26") of snow fell at Roanoke Regional Airport. 1986-87 City Budget included $83,145 for Snow Removal from the City's streets and rights-of-way, for overtime salaries and chemicals; other operating accounts are used for regular salary and equipment costs. Airport snow removal operations also occurred by departments not funded in the General Fund. Those operations, while sig- nificant, are generally not included in this report. Il. Current Situation on this subject is: City employees worked continuously from 3:30 a.m., Thursday, January 22, until 7:~00 p.m. Tuesday, January 28, in an ef- fort to combat this unusual snowfall. Extra manpower and equipment continued to operate at night and on the weekend thru February 1 responding to specific requests for service from citizens. Bo Approximately 4500 hours of regular time and 5000 hours of overtime were expended by City personnel plowing and salt- ing streets, keeping equipment in service, etc. The salary cost was approximately $93,000. City equipment was operated for 5215 hours. In addition to the fuel, parts, and supplies costing approximately $19,000, the wear and tear on equipment is almost incalculable. Total cost to the City for these recent snowstorms was approx- imately $316,000. III. Issues in order of importance are: City personnel have returned to normal duty and are becoming rested for another significant snow removal effort if and when such becomes necessary. B. City equipment has been cleaned, checked, and repairs made so as to be available when needed. C. Supplies and materials have been restocked, including 1200 tons of rock salt. Overtime salaries and fringe benefits are the only accounts needing supplemental appropriations at this time. $32,145 was originally budgeted for this purpose and approximately $56,000 was expended during the recent storms. E. Funding is available in the General Fund Contingency Account No. 001-002-9410-2199. IV. WITNESSETH: That, The Railway, for and in consideration of the one-time payment of TWO THOUSAND TWO HUNDRED FIFTY AND O0/lO0 DOLLARS ($2,250.00), which the Licensee agrees to pay to the Treasurer of the Railway, and the covenants hereinafter stated which the said Licensee agrees to Keep and perform, hereby licenses and permits, insofar as said Railway has the right so to do, but without warranty and subject to all encumbrances, conditions, covenants and easements to which Railway's title to the premises is subject, the Licensee to construct, maintain, repair, renew, operate, use and remove, at the sole cost and expense of Licensee, one 30-inch sanitary sewer pipeline crossing; said crossing to be installed and maintained in accordance with the attached plans and specifications, for the handling of sewage under the premises of the Railway at or near ROANOKE, State of Virginia, Eastern Region, Radford Division, located at Mile Post 247+1,793', as shown on Plan V-2/S-65b, dated August 17, 1984, which is attached hereto and made a part of this agreement, and hereinafter referred to as the FACILITY, subject, however, to the following terms and conditions, all of which the Licensee covenants and agrees to keep, abide by and perform: FIRST: The FACILITY shall be constructed and maintained at such time or times, in such manner, with such material and under such general conditions as shall be satisfactory to and approved by the chief engineering officer of the Railway, or his duly authorized agent. The FACILITY shall be constructed and maintained in accordance with American Railway Engineering Association "Specifications For Pipelines For Conveying Flammable and Non-Flammable Substances", Part 5, Pipelines, dated 1972, and by reference hereby made a part of this agreement and shall be at least 3.0 feet below surface of ground and below the bottom of ditches of the Railway and at points where the FACILITY passes under the track it shall be at least 5.5 feet below base of rail, and shall not interfere with the proper and safe use and operation of the property of the Railway. The Licensee shall, after completing the construction of the FACILITY restore the premises of the Railway to the same or as good condition as they were in, prior to commencing the construction of such FACILITY. Should the FACILITY be overhead it shall comply with the provisions of the applicable statutes, or with any orders, rules or regulations of any public authority having jurisdiction in the matter in the State in which the FACILITY is to be constructed and maintained in accordance therewith, or with any future modifications thereof. SECOND: All of the acts to be performed by the Licensee, or by the contractors, agents, or servants of the Licensee, in connection with the construction of the FACILITY, or in connection with the repair, renewal, maintenance, or use thereof, shall be performed at the sole risk and expense of Licensee, and the Railway shall be reimbursed for any anU all costs and expenses incurred by it as the result of making any changes in Railway's tracks or appurtenances necessitated by the construction of the FACILITY, in the checking of plans, and for the wages of any inspectors or watchmen which, in the judgment of the chief engineering officer of the Railway, may be required during such construction, or in connection with the repair, renewal, malntenance, or use of such FACILITY, for the proper and safe protection of the property, traffic and business of the Railway, and the Licensee hereby agrees to pay unto the Railway such costs and expenses upon presentation of bills therefor. THIRD: Whenever It may be necessary to make any repairs to or renewals of the FACILITY in or upon the premises of the Railway, such repairs or renewals shall be made under the supervision and control of said chief engineering officer of the Railway, or his duly authorized agent, at the sole expense of the Licensee, in such a manner as to interfere as little as possible with the premises, property and business of the Railway, and the Licensee shall, at the cost and expense of the Licensee, restore the premises of the Railway to the same or as good a condition as they were in prior to the making of such repairs, or renewals; or the Railway may, at its election make such repairs or renewals, and the expense thereof shall be paid to it by the Licensee, as hereinbefore provided. FOURTH: The Licensee shall and will at all times hereafter indemnify and save harmless the Railway, its officers, agents and employees, from and agalnst any and all detriment, damages, losses, claims, demands, suits, costs or expenses covering damage to property or injury to or death of persons, which the Railway, its officers, agents or employees, may suffer, sustain or be subject to, directly or indirectly~ caused either wholly or in part by reason of the location, construction, maintenance, use or presence of the FACILITY as permitted by this license or resulting from the removal thereof, except where detriment, damages, losses, claims, demands, suits, costs or expenses are due to the sole negligence of the Railway. FIFTH: This agreement and the privilege it confers may be revoked and terminated at the option of either the Railway or the Licensee at any time by giving 60 days written notice to the other party, or by posting such notice in a conspicuous place where the FACILITY has been constructed; and upon the expiration of said 60 days after service of said notice, this license and the privilege hereby granted shall be absolutely terminated and extinguished; and thereupon the Licensee shall remove the FACILITY from the premises of the Railway and restore same to their former condition at the expense of the Licensee, or on the failure of the Licensee so to do, the Railway may remove the FACILITY at the expense of the Licensee, which expense said Licensee hereby covenants and expressly agrees to pay on demand. Neither party hereto shall be agreement of any obligation which shall termination. relieved by the termination of this have accrued thereunder prior to such SIXTH: It is understood and agreed by and between the parties hereto that if at any time or times hereafter, the Railway shall desire to make any changes in its tracks, structures, roadbed or other installations at the point of crossing, or make any changes whatever in. to, upon, over or under the premises owned, controlled or leased by the Railway, and crossed or in any way affected by the FACILITY, then the Licensee shall, at its own cost and expense, upon thirty (30) days notice in writing to that effect from the Railway make such changes in the location or construction of the FACILITY as in the judgment of the chief engineering officer of the Railway may be necessary to accommodate any future construction, improvements or changes of the Railway. SEVENTH: No cathodic protection systems shall be installed which will cause electric current to flow across or along the Railway~s premises without the specific written authorization by the Railway. - 2 - If cathodtc protection system is authorized, it shall be installed and maintained so that no interference will exist wlth the electric systems on the Railway's premises and so as not to cause any deterioration of the Ratlway's structures in service or hereafter installed, and it is understood that the provisions of Article Fourth of this agreement apply to the construction, maintenance, repair, removal, presence or use of the said cathodic protection system. EIGHTH: It is agreed that in no event shall any pipe, or other structures, be placed under the tracks or upon the property of the Railway, except those herein mentioned and shown on the plan attached hereto, without the express permission so to do being first obtained in writing from the Railway. NINTH: (al During the period of construction or any period of maintenance, repair, renewal, removal or relocation of the FACILITY, Licensee shall insure the obligations assumed in Article Fourth in a manner and with a company satisfactory to Railway and with limits of $500,000 for injury to or death of one person and $1,000,000 for injury to or death of two or more persons In any one accident and $500,000 for damage to property. Licensee shall not occupy Railway's property until satisfactory proof of compliance with this provision shall have been furnished to and accepted by Railway. (bi If an outside contractor is to construct, maintain, repair, renew, remove or relocate said FACILITY on Railway's premises, then Licensee, in lieu of the insurance provided for in subsection (al hereof, shall require said contractor to furnish Railway with a Railroad Protective Liability Insurance Policy naming Railway as the insured and issued to the contractor, with limits of $500,000 for injury to or death of one person and $1,000,000 for death of two or more persons in any one accident and $500,000 for property damage. The contractor shall not occupy Railway's premises until satisfactory proof of compliance with this provision shall have been furnished to and accepted by Railway. (c) All insurance policies required by this Article Ninth must show in the (1) "Description of Operations/Locations/Vehicles/Special Items" 8lock on the Certificate of Insurance, and (2) on the Insurance Policy and all subsequent endorsements, an accurate description of the location of the project or property, the type of agreement, the date of the agreement and the parties to the agreement. TENTH: The covenants and agreements herein contained shall be binding upon, and shall inure to the heirs, executors, administrators, lessees, successors and assigns of the parties hereto respectively, provided, however, that no assignment of this ticense, or any rights thereunder, by the Licensee shall be valid without the written consent of the Railway. ELEVENTH: Licensee shall not create or permit to be created or to exist in or about said FACILZTY any nuisance, public or private, during the continuance of this agreement, and Licensee hereby agrees to save and keep harm)ess Rai)way, its officers, agents and employees, from any suit or claim growing out of any nuisance arising from the presence, use or operation of the FACILITY or Licensee's violation of any applicable laws, ordinances or governmental regulations, including, without limitation, laws, ordinances and governmental regulations controlling air, water, noise, solid wastes and other pollution. Licensee shall install and bear the expense of any and all pol)ution control structures, devices or equipment which may be required during the term and continuance of this agreement under any applicab)e laws. ordinances or governmental regulations because of or arising from the use or - 3 - operation of the FACILITY by Licensee or those claiming by, through or under Licensee. These rehabilitation loans in Roanoke have been made at 4% interest to low-moderate income homeowners in the City's Conservation Areas and Rehabilitation Districts (see attachment). C. Administration of the Section 312 program in Roanoke has been by Redevelopment and Housing Authority. II. Current Situation: A. HUD has notified the City that Section 312 funds are available now to be loaned for rehabilitation. No specific allocation of funds has been made to the City; rather, approximately $1.2 million has been allocated to Virginia by HUD and will be reserved for applications from across the state on a first come-first served basis. III. Issues: Contract for services with RRHA currently does not provide for administration of the Section 312 Program because no funds were expected when the contract was prepared. A. Alternatives: Authorize the City Manager to execute an amendment to the contract for services with the RRHA to provide for the administration of the Section 312 Program, with payment of no additional compensation, such amendment to be approved as to form by the City Attorney. 1. Effect on community revitalization would be positive to the extent Section 312 loans are made locally. The sooner qualified applications can be forwarded to HUD for approval, the greater the number of loans likely to be made in Roanoke (estimated to be $100,000-$200,000). Do not authorize the City Manager to execute an amendment to the contract for services with the RRHA to provide for the administration of the Section 312 Program. Administration of the Section 312 Program would have to be performed by existing City staff, without experience in this type of loan processing and servicing, or by another agent under contract with the City. In either case, the result is likely to be less efficient than administration by the RRHA. Cost to the City would be incurred if another agent is retained to operate the Program. If the Program is not administered, there would be no cost. Effect on community revitalization would be negative to the extent that some low-moderate income homeowners would not be able to obtain these favorable loans to rehabilitation their homes. V. Recommendation: CC: Adopt Alternative A, thereby authorizing the City Manager to execute an amendment to the contract for services with the RRHA to provide for the administration of the Section 312 Program, with payment of no additional compensation, such amendment to be approved as to form by the City Attorney. Amount of the Letter of Credit will cover the expense which the City will have incurred should development not proceed. 2. Time of completion of site grading can remain within the deadline desired by this new development. 3. Cost to the City will not increase beyond the amount already bid for the site grading. Do not amend the Option Agreement and continue to require that a Letter of Credit be submitted in the amount of $570,000, which is more than the amount of the bid for the project. Amount of the Letter of Credit will exceed the sum sufficient to cover the City's expenses should develop- ment not proceed. 2. Time of completion of site grading may be delayed for the purposes of negotiating further with the developer. 3. Cost to the City may increase if the delay requires the project to be rebid. V. Recommendation is that City Council take the following action: Ao Approve Alternative "A" and amend the Option Agreement with Nicholas F. Taubman to allow for a Letter of Credit to be submitted for the bid amount for site grading, including contingencies, of $410,336.65, such Letter of Credit in a form acceptable to the City Attorney and Director of Finance; reference will also be made to a particular plan as prepared by Mattern & Craig, Consulting Engineers, and approved by the City Engineer, for the 28.1 acre parcel to be acquired. Schlanger Appropriations Transfer for Internal Service Fund Charges The City of Roanoke's Internal Service Fund accounts for certain service-providing departments. The service-providing departments within the Internal Service Fund recover the costs of providing those services by charging the receiving departments. The costs are recovered to the Internal Service Fund as revenue. Appropriations to charge for internal services were allocated in the current fiscal year budget throughout the various departments based on estimated usage. Usage has varied from the original estimates. It is necessary to make appropriation trans- fers between several departments to provide sufficient funds for internal services for the remainder of the fiscal year. These transfers will not increase the original budgeted amounts, only reallocate those amounts between departments. The attached ordinance ~ill accomplish the needed trans- fers. Back~round: Halon 1301 Fire Suppression System is a pressurized liquid which turns to gas when released which deprives the fire of oxygen. There is no water damage or clean up requirements to the area protected. Three (3) bids were received on this project on December 15, 1986 and ranged in price from $7~962.00 to $16~500.00. None of these bids were responsive because each bidder had noted an exception to the requirements of the Contract Documents on the Bid Form. Council approved the rejection of all three bids at its meeting on January 5, 1987. C. New bid date was established for January 26, 1987. II. Current Situation: City Council, at its January 26, 1987 meeting, publicly opened and read aloud bids for the Fire Suppression System of Halon 1301 for the Computer Room in Municipal North. B. One (1) bid was received from the Fire-X Corporation of Richmond, Virginia for $13~554.00 dollars. Second bid was received at the City Clerk's Office on January 27, 1987, at 11:30 a.m. The bid had been sent from Raleigh by Atlantic Fire Systems, Inc., Air Express on Friday, January 23, 1987. Roanoke Regional Airport was closed due to snow,on Friday, January 23, 1987, from 6:30 p.m. to 10:30 p.m. and again Sunday, January 25, 1987, from 5:00 p.m. until Monday, January 26, 1987, until 5:00 p.m. In any event, it is the bidder's responsibility, not the method of transpor- tation, that is responsible for the timing for the bid sub- mittal. The one adjoining resident who spoke in opposition to the rezoning was concerned about increased noise and activity and the possible drop in property values. It was generally agreed that the proffered privacy fence and landscaped buffering required by the zoning ordinance would adequately protect adjacent property. Zonin~ would change from single family to multi-family residential. Density is limited to four units. Site is presently divided by two zones which may result in difficulty in future development. Present commercial zoning may also have a detrimental effect on the neighborhood. Putting the property under one residential classification is more desirable than the present situation. Neighborhood will not be affected. Proposed residential development is comparable to what already exists and is situated such that it would have no impact on other residences. Since this site is the last vacant parcel in the block, its residential use should provide economic stability and security for the surrounding residents. Comprehensive Plan encourages provision of a variety of housing types located in appropriate sites in existing neighborhoods, provided such development is in keeping with the general character of the area. The proposed rezoning addresses this objective of the Plan. B. City Council deny the rezoning request. Land use is unchanged. Site remains available for either commercial or residential use. 2. Zonin~ remains C-2 and RS-3. 3. Neighborhood is unchanged. 4. Comprehensive Plan is followed. V. Recommendation: By a vote of 7-0, the Commission recommended approval of the request. PETITION TO REZONE TO THE HONORABLE MAYOR AND MEMBERS OF THE COUNCIL OF THE CITY OF ROANOKE: I. The petitioners, Paul C. and Connie C. Flegas, own a certain tract of .land located in the City of Roanoke, Virginia, containing .27 acres, located between 3029 Yardley Dr., N.W., and the Plaza Motel located on Williamson Road, and designated on Roanoke City Appraisal Maps as Official Ta~ No. 2170424; the said tract is currently zoned RS-3, Single-Family Residential District, and C-2 General Commercial District. A map of the property to be rezoned is attached as Exhibit A. 2. Pursuant to Article VII of Chapter 36, Code of the City of Roanoke (1979), as amended, the petitioners request that the sa~d property be rezoned from RS-3, Single-Family Residential District and C-2 General Commer- cial District to RG-I General Residential District for the purpose of constructing a four (4) unit apartment complex. 3. The petitioners believe that the rezoning of the said tract of land will further the intent and purposes of the City's Zoning Ordinance and its comprehensive plan, in that it will use vacant land for residential use. 4. The petitioners hereby proffer and agree that if the said tract is rezoned as requested, that the rezoning will be subject to, and that the petitioners will abide by, the following conditions (e.g.): a. The development shall be limited to no more than four (4) dwelling units. b. That all existing trees on the tract will remain in place and a privacy fence of at least six (6) feet in height will be built across the back and down the right side. 4. Attached as Exhibit B are the names and addresses of the owner or owners of all lots or property immediately adjacent to or immediately across a street or road from the property to be rezoned. WHEREFORE, the petitioners request that the above-described tract be rezoned as requested in accordance with the provisions of the Zoning Ordinance of the City o4 Roanoke.
